  1. It's not often that TV inspires me to do anything but the bullying antics of the two thugs who are the focus of this program have had me shouting at the TV set so much that the better half has actually turned it off and hid the remote. How dare this bully boy lays his hands on bewildered women to snatch their car keys away not caring they have house keys on the same bunch or with any care for their personal safety. Not often I'm made angry but this has left me apoplectic.
  2. Hi All This is my first post as I'm currently having issues with Samsonite and a suitcase I bought. I bought a small cabin bag size suitcase from a genuine Samsonite outlet store in York during the Black Friday sales at the end of November. It cost £41 which I knew was really cheap for Samsonite as I already have a couple of their cases. I used the case for the first time during a trip to London in mid January, during which time the retractable handle broke while waking along a train platform (so much fun!). I took the case back to the Samsonite store where I purchased it, and was told it would have to be sent away for repair as it was more than 6 weeks since I bought it. I've since received a voicemail from the store advising that the case could not be repaired, and to visit them to discuss. I'd really like to know what my rights are before I travel to the store (which is 90mins from where I live, so I need to be prepared), as to what I can get as a replacement. I do not want store credit or my money back, as I know I won't be able to buy a replacement suitcase without putting a lot more money towards it. As far as I can see the suitcase wasn't fit for purpose, and I'd like a replacement at no cost to me, but is this what I'm entitled to? Any help would be much appreciated so I can be prepared to fight my corner. Thanks Claire

  4. Hello good people of Consumer Action Group, thanks for having me! I find myself in a work situation that I'd really appreciate some legislation-backed-up fact. I've been working for my company manual work minimum wage for nearly 4 years, never rocked the boat, always did my best to keep everyone sweet and help out where I could when people called in sick with management. However, I now find myself in a quandary where I need to take a few days off that have been expressly disallowed by da boss. Our rota goes up a few days before it starts for every two weeks going forward. The boss still finds it acceptable however to change it willy-nilly as the needs of the business dictate. Fair enough if it's a small one-man show, but this is a multi-national. So near Christmas it becomes problematic when people with children suddenly "discover" a once in a life time children's play, or family emergency, I've always tried to help out as I'm a single childless guy. But I have something I must do on Friday 14th that demands I take the day off. I asked the boss, immediately I saw the rota go up today. NO! I said, sorry but YES!! He said review your position, I'll make you work it or give you a disciplinary. I WILL be taking it off, morally and actually. What can I do to avoid the inevitable storm and bad feeling that will result despite me giving him nearly 3 weeks notice about it? It's unfortunate in that unusually this close to Christmas there is no-one else who can cover this specific shift, but I feel given my track record of always covering everyone else with their "sudden child sickness/need to go shopping" issues, etc, that I'm morally in the right to ask for this one little day off. I am prepared to die on this hill. (I'm looking for a new job already for new year), but I don't want to leave on bad terms by just handing in my one week notice now. And then get a bad reference. Especially after 4 years of actually quite enjoying the job and feeling a mutual respect with the boss. But he's dug his heels in with this; and so have I! Any legislation to help me with my stand?   5. We've lived next door to them for over 18 years, they have been here since the 70's. They are an elderly couply, they are not the problem. Their 40 year old son is. He sells drugs at all hours, his Dad has to answer the door to them. The son plays loud music, games and shouts. One time, this was a few weeks ago. My mum was in the bathroom and he said to his friends 'yeah, their grandson lives sleeps in the bath'. He keeps spying on us in the bathrrom. When we reported this to the council all they said was 'He's got mental problems, he can't help it'. His mental problems are due to drugs, my nephew has learnign difficulities which he was born with. He has called my 18 year old nephew(same one mentioned above) a pervert, peado. Because he plays with his brothers and sisters. He has now got a camera which we reported today, it's pointing towards the public grass/pathway. We were told we were not allowed to record beyond our garden, not even allowed to record him if he contronts us. His dad has been to see the council, nothing. Police have been round and had a word with them, again, nothing. My brother refuses to leave the house now, he's too scared. My mum wants to move but it's hard because I have been bidding since I was 18, I'm now 31 and have gotten no where as I am on low band. My ESA (or council rent) won't cover the rent until I'm about 35. I tried to move out in 2012 but couldn't due to the council refusing me rent. I know it's a lot to take in but can anyone help us?
  6. Hi! I'm sorry if this is in the incorrect place, just looking for some legal advice on an unknown debt. So last year I sold a car to a scrappage company and they took my log book and supposedly were going to destroy the car. However, I've since learned I was conned and the car was abandoned while still in my name. I know that I was very foolish for doing this. I have no evidence of any of it and I KNOW I should have contacted the DVLA and informed them but was unaware of this back then. I realise I am fully responsible for this happening. Anyway, I moved house and today received a letter from Martson claiming I owe £1,269.17. I rang up the company, fully believing it to be fake, to then be told it was true. I had been fined for having a SORN car on a public road. It had been taken to court in January and I wasn't there so was found guilty for the offence. All correspondence was sent to my old address. I never changed the details in regards to the car because I believed it to be destroyed. Now, I've rang the DVLA and they have said that the original fine was £400. Is it possible that if I put in a statutory declaration that I will be able to get the amount down? Even a little bit? I've spoken to Marston who will not agree to a payment plan despite me being on maternity with a 3 month old and being in quite a difficult financial position. It is possible I'll have to go back to work early because of this. So...do I bother with a statutory declaration or will they simply say it's my fault for not updating the address? Please, I know I was foolish for the original incident so I don't need any feedback on that. Thank you so much for taking the time to read this.

I'm not sure this is the right place but here goes I suffer from Borderline Personality Disorder, which means I am often very depressed, anxious, scared, etc. I am on medication and generally have the illness to a level that I can cope. However I have got myself in debt with Vanquis, Capital One, Littlewoods and Very. I was making regular payments up to about 6 months ago but then my Mum passed away and my world fell apart. I am on esa and was managing with the help of my partner to maintain my payments. Now I am getting nothing but phonecalls and letters. This morning I received my second letter from Moorcroft for the Vanquis debt (£1287.14) asking for me to talk to them and payment or further action will be taken. I owe Littlewoods £925.73, I have only missed 3 payments on that debt so far but will miss more. I owe Very £2513 including arrears of £409. As for the two credit cards with Capital I owe approx £600 on each card. On top of this I have accounts with JD Williams which I'm not in arrears with but will soon not be able to make the regular monthly payments. I just want advice as to what to do, should I write to them all all and make an offer of a payment each month an hope they accept it. I don't have much money left over each month from my esa benefits so payment would have to be a small amount. Would I be better looking at a debt relief order? I just don't know which way to turn and it is affecting my mental health. It's hard enough dealing with the grief of losing my Mum just under a year ago on top of losing my Dad nearly 3 years ago. I just don't know what to do. I know this is my own fault, after losing Mum i went silly with money, anything to numb the pain I was and still am feeling. I just want some advice and guidance. Thank you for reading my rant and I appreciate any help you may advise me on.
  8. Good evening CAG, I am new to this site but I must say that I have heard how fantastic you are at helping, so, I am hoping you could point me in the right direction. I have received a claim form from Northampton which has been issued by Cabot Financial. Now they say that I owe money to Moneyway (a loan) and give an account number but, it has been issued to me in my maiden name which I have not used since 2007. Now, I dont ever remember taking a loan with a company called Moneyway so I am pretty amazed at this, let alone using a name I havent been known by for a number of years. they say that the debt was assigned to them, so I am guessing they brought this supposed debt cheap, but I think they must have picked me off an old voters list or something as I have never done business with a Company called Moneyway. Now I dont really know much about rights as a consumer or anything but I thought that debts became statute barred after a certain time. I need to do something but I dont know what and I dont know how much time I have to do it before a judgement is registered against me for something I have not had. Could someone please point me in the right direction. I would be so grateful. Thank you LTB

Sent my appeal off with some brief details of why i was appealing , Had a Letter from DWP confirming that they received my appeal, and about how much ESA i will get until it's heard, But so far over 1mth since requesting the full written statement of the Atos wca Form IB /ESA85, But so far i have not been sent it, The person that i recently spoke with from DWP ,Confirmed that they could see that i had previously requested it, but could not understand why i had not yet received it, What can be done to force them to supply this info,(assuming it actually exists) ?
  14. Hi guys I'm new here & after advice, hope this is in the right place. My husband has quite a lot of debts, he was on a DMP with stepchange until the end of 2015 when he lost his job & put it on hold we moved house a month later & although I think he informed stepchange he didn't inform the creditors He's had a few letters here at the new address & has just recently got a ccj, sent admittance form, offer of £50 was rejected court decided the amount £78 per month, which he will pay, last night I checked his credit file with noddle & was shocked to see 2 active ccjs, one from October 2016 the other September last year, our old address is on them & we had no idea about them as the letters were obviously sent there, the creditors oddly on the page where it says the debts are defaulted states our new address though, one debt is £7500 Barclaycard originally & the other i think is originally Halifax for an overdraft of £4400. I'm worried sick & don't know what to do, it's bailiffs that are worrying me the most . Can anyone advise what we do next please Thanks in advance
  15. Hi, Does anyone know what Nationwide is likely to do in our situation please? Wife is 16 years older than me so we had a 10 year self cert mortgage taking her to age 65 originally through Derbyshire/Salt and now taken over with Nationwide. About 12 months ago we rang Nationwide after receiving a standard letter re repaying the loan at the end of the mortgage term. The friendly but extremely unhelpful call center guide was only interested in referring us to an independent mortgage advisor when asking about options and whether we could extend the term as they couldn't give advice and there were NO options on Nationwide doing some sort of deal or changing the mortgage. There wasn't much point in talking to a broker as my business went south in 2009 and we have wobbly credit, can't prove income to service the loan now although have no arrears or ever been in arrears. Instead we have been trying to sell the property - £255000 mortgage and 2 local estate agents started us at £395,000 now down to £340,000 and only 3 viewings in a year! I have been trying to understand 'Forebearance' but can't find any examples of any lenders being helpful to customers when they can't afford repayment. All we want to do is to continue actively trying to sell it while paying interest only rather than have it repossessed and forced sold. Does anyone know what is 'likely' to happen - particulalrly where Nationwide are involved? Any thoughts or advice would be really appreciated. Wife was just going to leave today she is getting so upset. We have until Feb for the mortgage term to end although haven't received any notices about the mortgage since last year. Thanks
  16. Hi there I have a question relating to a loan that I took in 2004 through Zenith Windows to install double glazing. But Zenith windows went into administration in 2010 I believe. Loan amount 5K. It is now paid off. How do I go about getting the PPI back from them and the unfair charges. Can anyone help please? Many thanks and much appreciated.
  17. Hi, I'm hoping for advice, please: We're going for a mortgage. I've just done an Experian search and discovered a problem, namely a CCJ issued on 03/08/17 at Northampton County Court. They say it was from Lowell whom have a solicitor called Cohen/Cramer. I know absolutely nothing whatsoever of this CCJ. I've tried endlessly all morning to speak to the CCBS but the phone just never gets answered. I assume they're tremendously busy. I would very much appreciate help/advice/guidance please. I have a case number off the £4 Government advice website thing, that tells me absolutely sod all that Experian didn't, but they were free. Idiocy. Number I'm calling is 0300 123 1056. The reason I know it's Lowell is I rang an 01604 number which turned out to be the Court but for Northampton residents only and the helpful guy there looked at his computer and said that was whom it was from, but he knows nothing else and to call the useless, pointless, inane, time wasting, and costly to me, business centre number. The Experian entry says, incidentally, that the CCJ was at my current/correct address...

  19. Hiya everyone Newbie here. And I wouldn't be here without something that I did as a bit of a lark earlier today. A friend put me up to looking on Trust Online to see if I had any CCJs. Now I didn't think I did, but I went on anyway and found out I have one!!!!! You could have scraped me off the floor with a spatula. I had NO idea about it till today. I've seen no papers, no letters, no forms. Apparently it was issued on May 21 2017, four months ago. Is this a normal thing, not telling people they are even under threat of a CCJ? Do the courts take their time in telling you about them? Really don't think things are going to a former address, as I have lived at my present address for 19 years - no way it could have gone to a place I lived before. What do people suggest I do now? it'as for 2700 quid I can't pay it up front, I haven't had the 14 day breathing space to scrape up funds. There is a possibility that it could be an issue my business was involved in but a) that should have been dealt with in March this year and b) I'm onto my business insurers and the client concerned about said issue. The credit checker (Trust Online) I used did not tell me who was wanting the money or which court it was lodged at (all it said was County Court Business Centre) and that was it. I have looked up the CCBC and the nearest thing i got to it was a place in Northampton ... but I've herd a few dubious report since about this Northampton office. To misquote Harry Potter, never tickle a sleeping dragon... I'm worried that delving into it all and making inquiries might trigger off people chasing me which at this moment i cannot afford. Six months down the line, fine - not right at this moment. I'm not frantic just yet, but I know I might head that way so can anyone give me any helpful advice before I do go off on one!!!???   20. Hi, I have received CC papers for a debt owing to Moriarty Law on behalf of MotorMile Finance. The total amount is for £350 for a loan taken out in 2013. I have sent in a defence saying that I do not recognise the debt and requesting further information. I have received a letter from Moriarty Law with photocopies of their paperwork. I now have a mediation appointment booked for next week. I am worried because firstly I have never been to court before and it scares me. Secondly, the paperwork does not look correct. The signature in the box that I am supposed to have signed is definitely not mine. They say that they paid the money into an account number XXXXXXXX, but I have changed banks since 2013 and I don't know if it is mine or not. It is possible that this is genuine, I have had payday loans before, but there is also a chance that it isn't (the fake signature is what worries me most). What should I say in mediation? I don't want to end up with a CCJ. I can't afford to pay £350 and I am also disabled so going to court will end up a nightmare as my nearest is the other side of a different county. If I offer them something like £25 as a gesture without admitting liability do you think that they will go away?
  21. There is an electrically operated gate across the entrance to the development which can be opened via a key pad on the outside or a button on the inside. There's also an emergency release lever for if (when) the gate fails. The management company have put a padlock on the emergency release lever so it can't be used. Their argument is that it's use may cause damage to the gate, which supposedly will only fail in an open position unless there's a power cut. As a result, when the gate failed whilst closed on Saturday night one resident was trapped outside and had to book into an hotel and everyone else was trapped inside until someone cut the padlock off the next morning and opened the gate, without damaging it. My engineer hubby thinks it's unlikely that operating an emergency release lever would ever cause damage, so are the management company talking c**p and just using this as an excuse to get us to pay extra for their emergency service, who would have the combination for the padlock? There's no manufacturer name or any other details on the gate or any of the controls, but there is a warning notice directing pedestrians to the (imaginary) pedestrian access!
  22. I took out a £300 Loan with Provident a while back and, due to non repayment, My debt has been sold on to Lowell. Lowell contacted Me by phone to inform Me they were a collection agency and my Debt with Provident had been passed to them and stated over the phone that I owed them over £500. I immediately asked how this was considering My original loan was £300 and the agent said that it was 'fees' when I asked what fee's He claimed an agent had called at My Home (Never happened) and this extra debt was call out fee's for the bailiff. I asked the rep. for a full and complete itemized breakdown showing what every penny over and above the original £300 was added for and how the debt had grown. He responded by telling Me "We do not send out information like that I'm afraid, Sir" and I said "Well I am afraid I am not paying it then." He then tried to use the 'Data Protection Act' as His reason why they could not do this and I stopped Him mid sentence to let Him know that as an employee of SKY TV selling products (Boxes, package upgrades, Broadband and Sky Talk etc) I myself am extremely familiar with the Data Protection Act as I have to work within it's guidelines and rules on a daily basis. He put Me on Hold to speak with His Manager and came back to say "Sir, MY Manager tells me You are correct in that it isn't Data Protection that bars this being done, it's simply not company policy to send itemized bills on request." I then said "Well I could ring anyone and claim they owe me 4 Million pounds and tell them when they natural ask how and why, 'I'm sorry, I'm not obligated to tell you that. Now are We paying by Visa or Mastercard?" Put on Hold a second time and came back to say "Sir, We will post the itemized bill showing what the extra charges are for and when then incurred. Have a nice day." One week later I received My 'Itemized' Debt. "Dear Mr _____ Account Balance Outstanding: £300" They tried it on because they simply assume if they tell You 'We are not obliged to send you itemized bill showing how and where extra charges incurred' that I, the debtor, won't know any better. I just wonder how many people have simply complied and paid who may not have known any better.
  23. Good afternoon everyone. This is going to sound pretty silly but I have been paying Lowells £5.00 per month for nearly 3 years now, but I have no idea what it is I am paying for. Some of you have been helping me with an actual claim, so know the state my life was in a few years ago, so I won't go into that all again. Anyway - I think (but am not certain) that the debt was an old littlewoods catalogue. I have not missed a payment ever in the nearly 3 years it's been going on for - but my credit file just shows default every single month, so I am getting no benefit by paying it back. I'm rambling (as always) sorry; I just wanted some information on how I can find out what this is for. I am loathe to call them as they've lately been writing to me about an old mobile phone contract, and I'm nervous that getting in touch with them may open another can of worms. My credit score page just says Lowell, and nobody else so I don't have a clue what this is for. I imagine most will think it insane that I've been paying them all this time without knowing what it's for - but I just agreed a small amount to get the off my back at the time, and being homeless I have lost any paperwork they might have sent me long ago.   24. Dear all, I am new to the forum and in a bit of a panic. I just don't know what to do. We have been in a debt management plan since 2008 and so since then I of course have not had any credit. I've had a letter from Shoosmiths and now a Court Claim via Northampton County Court Business Centre about an Overdraft I supposedly had with M&S. I thought this strange as I have never had a bank account with M&S. The Particulars of the Claim actually state: The claimant claim is for the sum of £4219.76 being monies due from the defendant to the claimant as a consequence of the defendant incurring an overdraft whilst operating a bank account. It says the debt was assigned to them on 30/1/13 and it says they notified me of that but i have no record of that. I pay another debt to Arrow Global though so I may have received something and assumed it to be part of that. I just don't know. I did have a Personal Reserve with M&S but this was operated like a loan. There was not a bank account. The sum of the Personal Reserve was approximately £3000 but this has been part of the Debt Management Plan so I have no idea what this refers to. I sent a letter to Shoosmiths stating I din't know what they were referring to and that if it is true it is a very old debt so queried their legality in asking for it. I think we crossed post with this court summons though. I've said to the court I will defend all of it but I have to write a defence and I don't know how to do that. Can my defence be that I have no knowledge of that account and have asked for them to prove it is genuine? Losing sleep over this and have that awful sick feeling in my tummy. I don't shy away from my responsibilities and have paid back over £20,000 in debts. I would really appreciate any advice you could give me.
  25. Hello everyone, I am new to this group. I received a letter from Opos (a DCA) back in November 2016, saying I owe money to an energy company for an unpaid energy bill. I replied saying that I did not know their client and the debt was not mine. I asked them to send me copies of the unpaid bill(s). I received a new letter from Opos last month, containing a settlement offer. Again, I replied stating that I did not know their client, nor had I ever received any services from them, and the debt was not mine. I used a template similar to the one shown under "You know nothing of the Debt / Prove It" in the CAG Library in the Debt Collection folder. I have now received a "Final demand" letter from Opos. Again, there is no acknowledgement of my two replies to their previous letters. Any advice would be greatly appreciated, thank you.
