  1. MBNA sold debts that belonged to both me and my husband. Idem bought mine, Moorcroft bought my husbands. I emailed Idem regarding reduced payments that I would make, and eventually they responded agreeing to my reduced amount. However, Moorcroft ignore emails (sent day after day) and they will not reply despite my husband requesting that they not call, but put in writing instead. They call anyway, and to whomever called, I asked them not to call, but to respond to my husband's emails - however, the chap then called my husband's mobile immediately! I got a statement from Idem, and in exactly the same marked envelope (same return address, same statement format) my husband had one from Moorcroft. Does anyone know if this is the same company??? It's really cheesing me off that Moorcroft ignore all the emails. Also, they're sneaky so-and-so's: they are based hundreds of miles away from us, and yet they call the landline using a local number that they must buy to use, to look like they're someone local calling us - idiots! It doesn't take long for me to recognise the number and ignore it. But, they're making me so mad!!! I think I'm wasting my time re-sending the same emails but at least it proves the point that they're ignoring us, dispite contacting them on a daily basis!
  2. Hi, I've received a County Court Business Centre claim from Mortimer and Clarke on behalf of Cabot. The description of what they're claiming is so very vauge and doesn't even mention an account number or any reference at all. It just states that it is regarding a claim for an amount arising from an agreement with a credit card company a rough date as to when they think an agreement was entered into, a statement that the debt was assigned and then "The claimant therefore claims £xxx costs" . And that is it. I had missed the Letter of Claim I had been sent which, now I've found and opened it, does give some more info. However, obviously I haven't responded to it within the 30 days. So.. in response now to the Court claim, do I ignore the info in the Letter of Claim and proceed as if it didn't exist? In other words, should I request all the lacking information in the court claim from Mortimer & Clarke under CPR 31.14 as I have done previously with an old Cabot claim or is the Letter of Claim part of precedings? Many thanks in advance for any advice.

HI, im new to this service so please bare with me. back in 2016 my partner signed upto brighthouse for a washer dryer combo, we paid £50 inital payment at the sign up and two payment of £30 a fornight there after. after a month had gone by and we still hadnt received the item in question we stopped paying. Shortly after this we had split and was going through courts for custody battle, so didn't have the time to chase this up In 2018 we got back together and decided to chase up the debt that brighthouse owes us, on febuary 22nd 2018 we spoke to a customer service agent who claimed to not be able to find my partner on their system. she then requested my details (in hindsight I wish id have never gave them) which I gave and was told they couldn't find me either which is no surprise. We waited until September of 2018 for a response, in which the woman who called and asked my partner for her personal information and ask for her permission to speak to me (which she gave) I was then told that the account was in my name not my partners (which should not be the case) the call lasted all of 2 mins from start to finish. after this call I rang in to discuss why the account was in my name and was told the exact opposite and that it was now in my partners name! I accused them of stealing my personal information and using it illegally and since then the account hasn't switched names again and it has stayed in my name they now claim not to have any information of my partners on their system ( despite having call recordings to prove this is a lie ) I have made multiple data access requests for all the call logs, a copy of the original agreement taken out in 2016 any and all information held in mine and my partners name all been ignored despite going about it legally and sending documents through e-mail (so I have a copy of all correspondence) and recorded delivery. The only aspect of which they addressed was the call recording and instead of giving me the full amount I requested I was given 3 from different points of my enquiry nothing more. I guess what im wanting to know is if there is anyone out there who has the same or similar experience with brighthouse if so have you any advice you could offer? oh I forgot to mention, according to brighthouse records I made 2 payments not 3 and the amounts don't come close to what I actually paid. they are stating I paid £23.10 and £10.78 which is BS as I never pay anything in pence I always pay up to the pound. Myself and my partner have both asked for her account information, and have been met with excuse after excuse and the claim that she doesn't have one despite being told otherwise on multiple occasions.
  4. i started over a year ago with the company and i was told not entitled to holiday pay as casual and 0 hours, so got not holiday pay at all, recently had someone i know who use to work at a union and they asked about my job and i told them everything and they said no you're entitled to holiday pay they showed me how to work it out and turns out I'm owed £300, told my manager who informed wages, had half my payment. rest next week. But I'm wondering if i can get last years holiday pay owed to me as it works out at £100 owed? also When I started a few days later i received a message of someone who I had not heard of in a long time, asking if I had started working for them, I asked how they know, and they said they had a call from someone at the company asking about me! but yet no one knew i was working for this company that knew this person, (this person use to work for the company many years ago) I've mentioned it to my manager who told me to ignore it, I kind of have but it really plays on my mind wondering what else is said to this person as we do not communicate, or to anyone else. Since I raised my holiday entitlement Ive since been told that my Sunday shifts are voluntary and that should not be taken into account, (I mainly work Sundays as no other shifts during week, so no wages if I don't), Ive been told my hair needs to be different in how I put it up (never had issues before) been made to feel guilty if don't take overtime, not had an expenses traveling to other shops like i was told at start i would but then they took it away as they found out I drive, I've had £271 in expenses for parking alone and bus tickets, this would never have occurred as my contracted place is just around the corner.
  5. Hi, I have just received a letter from a debt company that I haven't used for over 15 years. The letter says data protection laws have changed. This means thy need to provide me with an updated explanation of how they use my personal data. I do not want then to use my personal data. Do I ignore the letter? Thanks in advance.
  6. Hi Folks, I'm having a number of issues with Quickquid and them supplying me information of all loans I have had with them. I am planning on putting in a IRL claim against them History: 30/07/18 - Sent E-mail request asking for all loans I had with QQ over the years (was a lot) Provided Date of birth, and all addresses I have had over the last 9 to 10 years 16/08/18 - No response received, sent a chase request 20/08/18 - They provide 6 account statements. I can only reconcile that against 2 of my loans (4 were potentially from an old bank account I had no access to) I was expecting another 14 statements. 26/08/18 - I chase up the missing statements 04/09/18 - Chase again due to no response 11/09/18 - Chase again due to no response 21/09/18 - Chase again due to no response!! 26/09/18 - I call them as this is getting ridiculous. They state they will make the information available on their website as a downloadable file. 28/09/18 - Information is now available. I download it and it is exactly the same as before!! Still missing all the statements. What should my next steps be. Are the actions I have taken essentially a DSAR or do I need to explicitly ask for this? Or should I now just go straight to the ICO and raise a complaint? Thanks in advance KO

  8. I have three accounts, one active and two rarely used. One was "Frozen" due to inactivity. I received a letter telling me to go to the branch to un freeze it. Long story short I had a right barny because the rep wanted to photocopy my Passport and send it to "central office". Insisting the photocopy would not be kept on a database that was her first lie. During the conversation it was insisted a drivers license (or utility bill) and a Passport or something with my photo on were required. Her claim was that after a year of inactivity accounts are frozen for security reasons. That was her second lie. At this point you need to know I've been going to this branch bank for the past 20 years. During the conv the rep insisted details were not on file and need to be updated, yet it emerged when cross questioned that my address name and other details were clearly listed under my active account. My other dormant account containing more funds, had been dormant for over four years, and not been frozen. This insistance on freezing for security reasons was disturbing, as if there was no activity why should there be cause for suspicious activity or any other security risk? The cream in this cake is when I "UN-froze" the account over the telephone. No passport, no drivers license required. However the mass of information they gave me over the phone (Yes... they gave it to me) when unfreezing the account was information mostly forgotton from around 2001, and it's now 2018! The telephone representitive must have been on commission. He created a telephone banking account and input old data about me taking over fifty minutes using existing data to confirm everything from my date of birth to my Limited Company details from the turn of the century; pausing for over a minute between each batch of info confirmed. I believe he was entering my personal data into a credit database for verification, something I've never needed, desired, nor been a part of. I'll be closing all accounts; but my concern is that HSBC have now significantly increased the risk that I might be a target of identity theft. My thoughts are that freezing accounts is a [problem] used to collect data otherwise denied by the now active GDPR. The current banking rules mean I would not be able to withdraw my own funds from my own account in my own branch without presenting data to the HSBC database which they don't have. How can a bank be allowed to do this?
  9. I am a new user to this forum so I don't know if any one can help. I completed an I.V.A. and got the completion certificate in October 2016. I also have a letter of no interest in any P.P.I. or subsequent awards. If I claim for P.P.I. redress will I receive this or can it be used as set-off
  10. Ill start by stating i have never had any dealings with Lloyds Bank in my life but they have registered accounts on my credit report. There is two accounts on my file one mortgage for an address which is not mine and also a credit card again which is not mine. The mortgage is in serious arrears and the credit card is listed as defaulted.I am also receiving debt collection letters. I have had problems with Lloyds in 2010 - 13 where they also had a CCJ against me. They also sent a letter from there solicitors to my address stating i was a fraudster. (see attachment) I managed to get things erased from my credit file eventually through a lot of hard work , and eventually i went to the newspapers and FOS who helped me sort it. I received a disgraceful amount of compensation for what they had put me through and now they have managed to wreck my credit file again. I have sent SAR off and i am awaiting response. Again this is for a person with the same name and DOB as me but this person has a middle name and i do not. Any help or similar experiences with this kind of thing would be good to know so i can again chase them. Thanks.   11. Hi all, We have a joint judgement against a builder and his ltd company (company A). He took the money, disappeared, due his commitment with the Army as he claimed and never got back. He did not defend the claim, and has since tried to enter into IVA, as he acquired a large amount of debt in the course of last year. It seems he hasn't been paying any of the suppliers or providers of services. He says in his IVA proposal that he is planning to close his ltd company and now working a a sole trader. We know that he has since registered another company (company B) on his father's name and we believe that he bought expensive machinery (i.e. digger and dumper). We rejected his IVA proposal, as the information provided was incorrect and it did not seem to guarantee any future payments. We would like to get a court order for questioning, but think that he will just come up with his current bank statements showing 0 balances. He doesn't have anything registered on his name either. Can we ask the court to demand historic statements from his accounts to see where the money that we paid disappeared, so we can possibly connect it to the newly established company? Can we ask to see registration details of the other vehicles in the household and see what name they are registered in? And also ask for prove of purchase by other family members? Also, if he claimed to be away with the Army, can we ask for proof of termination of employment? What we would like to see really, is not so much his current state of affairs, but what was going on for the last year when he acquired these large debts, i.e. we particularly wanted to see how he spent the money that we paid him and also try establish if there are any newly acquired assets in his father or other family member and how they paid for it. I have prepared a list of questions. Would it be OK to post them here for advice? Also, I have come across a thread on some forum, where they say that the debtor still showed up in court without any documents and the court has accepted his words. Is this really possible? Can the court refuse you to attend the questioning if you ask for it? Can I record the questioning session? We have reported this for fraud investigation, but it is taking ages and nobody seems to be doing anything with it. Many thanks for your help

Hi there, I would like to get some advises regarding Vodafone had shared my personal information regarding (full name, address, DOB, email address) Undeniable, once a contract has been formed in between Vodafone, if without monthly payment, Vodafone will pass the information and shared with Debt Collection Agency because Vodafone appointed DCA to collect the debt on behalf. Vodafone claimed that, that clause was in the contract. (Thats what I have been told by Vodafone after the incident.) However, I do not owe Vodafone any money nor any outstanding amount, however, my account was closed yet Vodafone did not do a proper job to close my account, leaving my records in their systems as debit situation hence passing my information to DCA without me knowing it at the first place. A few months later, I got 2 letters, 2 emails from DCA (generic name Jayne Carter) asking for payment as I owed Vodafone, out of the blue, I have no ideas because during the time I had left Vodafone, I have ensure no outstanding payment, which I got a text message from the Customer Service department to confirm that (still have the text message as evidence). I went to Vodafone, they never admit it was their systems fault due to the system automatically flagged up as outstanding and and accidentally passed my personal information to DCA. During the months, no letters from Vodafone or emails to stated that I am owing them money, but directly passed my information to DCA. Numerous phone calls and complaints lodged, Vodafone finally contacted DCA to close my case and no outstanding amount. However, my concern is, Vodafone told me, they couldn't ask DCA to delete my personal information which they had passed to them in the first place because of their mistakes. I have phoned to DCA, they said the same thing and they will archive the record but could not delete my personal information even though they will not need it anymore (from my view, no reasons they will withhold my personal information). Could anyone please advice? is it worth for me to send the SAR to DCA to ask for the information they are holding? thanks for your advises and very much appreciate. Regards,
  13. Hi, I was a victim of identity fraud in around June 2012. "Someone at the time took out loans in my name with quick quid and lending stream". It was a lot of hassle at the time ( I went through the police action fraud, recived a crime number and after a month or so I signed a couple of letters from both companies and the matter was cleaned up. I also opted at that time to put extra restrictions on anyone else trying to fraudulently take out any more loans in my name. "Let me just say that I have never ever applied or taken out any loan in my life other that a mortgage for our home that is now fully paid off". back in June 2017 I started receiving letters from MMF motormile finance now Lantern, stating that I owed them £250 for another loan from what turns out to be taken at around the same time as the other loans in 2012! I phoned them straight away and explained what had happened. But all this did was for them to send demanding letters on a weekly basis! I forwarded the police action fraud crime number from 2012 thinking that that would be the end of the matter. But all they do is keep sending me more demanding letters. Are these people above the law or what! They keep asking for very personal details e.g bank statements from 2012, my national insurance number, payslips, photo id from a passport or driving licence. I'm sure it would be reckless to send such sensitive information to a bad debt collecting company! (Do they cover their costs by selling on this very useful and very accurate information to third parties?) It would be very lucrative if they did as they would have all the information to take out a loan in my name!! What's going to happen in another few years, Am I going to get demanding letters form another bad debt company?? As much I want to clear my name I am very sceptical about about how they would use that information. I lay awake at night worrying myself to death, I am frightened about what they might do. I have been to Citizens advice bureau who just say go to police action fraud! its bonkers. If a company doesn't accept a police action fraud number and the evidence from the time of the identity fraud then they are surly acting above the law!
  14. Hi there. Just on the off chance my husband sent a request to Barclays to see if he had PPI on any of his cards. It turns out he had it on his Barclaycard Mastercard from Sept '97 until Dec 2004 and on his Barclaycard Visa from Sept '97 until Aug 2015. What would be our next step forward please? Thank you.
  15. This is a long story, so I'll try and cut to the chase. Back in 2013 we moved into a property. The landlady who we were renting off asked if she could continue to be registered at the address. She agreed that she would cover all the council tax bills for the property. Two years later we received a letter from the council to "the occupiers" asking us when we moved into the property. We truthfully told them the date. Two months later, we received a massive bill from the council for two years worth of council tax, backdated to the date we moved in. We got in touch with the landlady who admitted she had not paid the council tax. We were now stuck with a £2300 debt when in fact it wasn't our debt. To add to our problem, the landlady admitted she had been illegally claiming benefits from the property whilst we were living there and she could not admit that she was due to pay the council tax as that would lay her wide open to prosecution. We contacted the council and explained the situation, but they wouldn't discuss it. As far as they ( capita ) were concerned, we were liable and they had passed the debt onto Ross and Roberts for collection. We rang Ross and Roberts, who were in fairness understanding, and they agreed a repayment plan which we stuck to like glue. In December 2015 I contacted them to make a payment and they gave us a figure which they said was the amount needed to clear off the debt. I then paid that amount and was told by the lady on the phone that the debt was now paid and we owed nothing more. They would cease any action against us. We didn't think any more about it We got a letter from the council saying we were in arrears with our council tax and they were taking us to court. I went into the offices to talk to them they told me that there was still £470 owing from the previous liability order and that they'd used my council tax payments for that year to clear this off. I explained everything about Ross and Roberts, how they said we'd paid it all off, but the woman insisted that they hadn't collected the full amount and had left £470 uncollected. That was why they were using 2016s council tax payments to clear off those arrears first. After much arguing, they agreed to cease the court action and use the money we had paid for the current years council tax. As for the £470 owing they would simply add it onto the bill and we could repay that on top of the current years council tax over the year. Owing to financial problems we fell into arrears with the council tax, and because as they put it "you have a bad history of paying" they just sent the matter to the courts and we were given another LO. When we contacted Ross and Roberts to sort out payments, they told us that there was still a LO for £470 owing which they were treating seperately, and had added £310 costs onto that bill. Not only that, they added £310 onto the amount for that current year as well. Had Ross and Roberts not told us that we had paid off the full bill, back in 2015, then we would have carried on making all the payments as planned and we wouldn't have been hit with a huge amount of fees, not only for the £470 that they incorrectly didn't collect, but also because that then had a knock on effect for the current year, and owing to us owing the grand sum of £110 for the current year, they whammed us with £310 charges for that. So if you can understand it, we ended up paying £620 in bailliff fees for two liability orders. One for £110 which I accept we owed, and £470 which Ross and Roberts had themselves told us we didn't owe it was their mistake when they didn't collect it as they should have done back when we were willingly making payments to clear off a debt that wasn't even ours in the first place as the landlady should have paid it.

Sent my appeal off with some brief details of why i was appealing , Had a Letter from DWP confirming that they received my appeal, and about how much ESA i will get until it's heard, But so far over 1mth since requesting the full written statement of the Atos wca Form IB /ESA85, But so far i have not been sent it, The person that i recently spoke with from DWP ,Confirmed that they could see that i had previously requested it, but could not understand why i had not yet received it, What can be done to force them to supply this info,(assuming it actually exists) ?
  19. I sent a SAR off in July and have now received a reply from Egg that they cannot trace me and has my name/address changed. Well no it hasn't and they are the first company to have this 'problem'. They want me to provide all sorts of evidence including a valid account number (obviously I don't have this as I would have provided it) details of previous names/addresses and proof of my DOB. Other companies have just supplied the information where I don't know account numbers so shall I write to them again advising nothing has changed and I will be complaining the the Ombudsman if they do not respond within another 40 days. They do say they have destroyed my cheque as there is no charge for this service.
  20. A flat which I have just acquired isin a block where the parking is controlled by UKPC. I have beenspeaking to some other leaseholders who have complained about being harassed this company. The headlease holder is a Housing Associationand I intend to lobby them to sack this pariah. I have spent hours searching theinternet for a case where UKPC have actually taken someone to court,but drawn a blank, although I am aware of the Trading Standards fiasco in Hull Crown Court, and also of the bloody nose administeredto them by Roger Davey. Can anyone dish any more dirt please? Were they clampers in a former life, if so were they taken to court?,

  24. Hi, My girlfriend has been working for an NHS Trust since March 2017, before which she was working with another trust since October 2016 (and has 10 years of service but not concurrent). However, the 3 to 4 years preceding this, she has been living abroad. She had to take sick leave last month due to accepting a (short notice) date for a major operation. The day she was offered the date for the op, she went to the HR dept and spoke with one of the officers, who informed her that she was entitled to full sickness pay for six months based on the fact that she had 10 years and more of service. Today she was informed that she has gone into half-pay since last week! Any advice on what she can do to correct this? She doesnt have a paper trail for the information that HR has given her although she remembers the date and approximate time that the conversation (face to face) took place.
  25. hi guys, so i have the name, mobile number, email address and bank details of the professional that i hired, unfortunately they never gave me an invoice and i never gained their address. The job they did was below standard and they even damaged our property for me to be able to take action against them i need their address, so since i know you need to obtain a court order for the bank to release the address, what form do i need for this to happen.
