  1. I had a seizure a couple of weeks ago, first one ever, and the hospital told me to speak to the DVLA, who told me I had to complete a declaration (FEP1 form) so they could assess my fitness to drive. According to the guidelines it could be a 6 month ban. However the form says "you must not drive if your doctor says you cannot drive". Neither my doctor or the consultant at the hospital will give me a decision - they say that's for the DVLA to decide. So, while the form is being processed etc - am I OK to drive, since no one has said I can't?
  2. I was in a rush for a charity event, which the irony of the whole situation. I didn't have the change for the second set of chocolates (£2) I just walked out with them. I was taken into a small room and after being given a talk on not doing it again I wasn't banned or given anything to sign, as I was told it wasn't worth the hassle given the extent of the items, and was just given a verbal warning. However on a paper they wanted my address, will I be getting any fines in the mail, or third party fines? If so would I have to pay it?
  3. Hello, I'm looking for some advice. At the end of May this year I purchased a used VW Golf GTD from a main VW dealer in West London. The car was six months old and sold to me as a former demonstrator. I paid £22K for the car. At the point of purchase the dealer informed me that he was waiting on the spare key and I drove away with only one key. Seeing as this was a VW dealership, I felt I could trust that said key would be sent to me. After numerous emails between myself and the representative at the dealership, he finally informed me at the beginning of August that the key had arrived, yet needed to be coded to the car. This would require me to return the car for a morning. I live fifty miles away (a trip via the dredded M25) This is easily an hour and a half trip, each way. I challenged him on why it needed coding if it was the spare key, it should already be coded. He simply ignored me and advised me to bring my car in. Due to injury requiring hospitalisation, I was unable to do anything during July and August. I am now picking up where this left off. I contacted the dealership today to find out that the representative that sold me the car has since left the company. I spoke with the used car sales manger who simply told me that the car HAD to be bought to their dealership to have the work done. I have suggested that I take it to my local VW dealership but he refused claiming that they had issues in the past when dealing with dealerships not in their franchise group. As a 'gesture of good will' he has offered to have my car collected and driven to them to have the coding done. Then the car dropped back off to me, with some fuel added. I have no signed documentation from the purchase day stating that the spare key was missing and was 'to follow'. I only have the email chain from the dealer, confirming that he is obtaining the key for me. My wife is my only witness to the transaction and arrangement over the spare key. What are my options please?

  5. I gave 4 weeks notice over 2 months ago now and should of received 4 weeks pay plus holiday entitlement. I did not recieve to holiday pay but they said they would investigate it. It dragged on all month and I did a few shifts for them after my notice was served to help with staff shortages. Today I was paid for the extra shifts I did for them but still no holiday pay. If they are saying I am still staff (bank staff) because I'm helping with a couple of shifts can they deny my holiday pay? Even if I was bank staff I don't see how I would be able to use holiday time because you only get offered shifts short notice when you are bank staff. This firm came in in January as a takeover. I have still received not contract from them. Thanks guys. George
  6. I took out a Service Plan agreement less than 14 days ago and want to cancel. Essentially you pay £26.99 a month for 18 months and it covers a major and minor service, fair enough. However, Ive decided to cancel and simply pay for each service in lump sums as it will in fact be better for me if I want to change cars within the timeframe as if I did then the balance is due which again is fair enough. However, I have NOT claimed on the plan at all and speaking to VW financial services they are saying ok but that it takes up to 28 days to cancel (funny how it only took 20 minutes to set up) and that the first payment is due within that period and they will take it and its non refundable. Other than cancel the direct debit, have I any recourse and is it me, or does this sound like pretty dubious practice anyway?
  7. Hi, I applied for a provisional driving license in October 2016. To this day (Aug 2017) I am still waiting for it. Today DVLA told me it's still in a queue for a doctor to review but would not tell me how many months or years it would take for that review to happen. DVLA refused to tell me the average or approximate time it takes for a medical review to happen. No info whatsoever...just keep waiting... Is this normal? How long does this normally take? Is there a way I could get a provisional license and my lessons as well as the actual driving license abroad and then use that here? - Sorry, this might be a silly question, but I need options. I desperately need a driving license for work/shopping/doc appointments due to bad back, and it seems it's not possible to do it in the UK due to some internal DVLA backlogs. Thank you for any suggestions x
  8. Dear All Almost two years ago received a claim from Restons for £2,500 but with no details. Filed defence requesting details of claim and made a CCA request. Cabot didn't come back until a week ago, with copies of some documents, containing terms and conditions, and copy of agreement, stating that they are now entitled to obtain Judgment. Have to see if it is genuine. I have noticed that they have not provided copy of Deed of assignment, I requested. Not sure if important? Also it appears that the authorisation of Cabot Financial has lapsed with the FCA, which is the name they've used on the Claim form. Does this mean that the claim is not valid and they have to reapply? Also, over half of the amount they are claiming consists of bank charges. Not sure if Default or Termination notices are relevant if they have bought any debts. Please help

  10. Back in May, I received a parking charge to my windscreen from our old friends UKPC. I was parked in a loading bay at my storage space and was displaying a permit. On the charge notice it stated that I was not correctly parked within the marked bay, although no such markings exist. I appealed anonymously, via UKPC online appeals, just giving them the reference number and the car reg. My appeal was acknowledged. Here we are, almost 60 days later and I have had no reply. As we are now over the 56 day I am assuming they will not be pursuing this but I have also noticed that they have not been ticketing cars that have been parking in the same loading space without permits. Are UKPC still in business? If yes,I guess they have lost their contract with the landlords.

Hello, The landlords had started court proceedings for rent arrears, £3,500 although they have submitted incorrect amount to court I put in a defence providing as much info as I could & telling the court I was getting further legal advice. In the meantime I've sought legal advice from Which Legal who confirm that the landlords were in breach of Gas Safe Regs. I've then spoken to Gas Safe Register, I luckily got to speak to an Incident Investigator who said I must definitely report the landlords to HSE. We were in grave danger the entire time we lived at the property & the landlords failed to meet even the very basics of their legal obligations. The only reason there are rent arrears is because I became so ill I couldn't work for a year, still struggling now. Not sure what to do about this claim for rent arrears as I've been sent a Notice of Proposed Allocation to the Small Claims Track to be returned before 7th July. Which Legal can;t help as it's already at court, they told me to contact Shelter, Shelter say thay can't help any further because it's already at court?! Is there anything I can do? Get it delayed in any way? Should I update the court with the info that the landlords were in breach of Gas Safe Regs & further action is starting against them? What do you think would be the best way forward? Will I have to pay the arrears when the landlords were the cause of the arrears? I'd really appreciate any help or advice. Thank you reading my post

Been following these threads and others as I am in the same leaky boat I have sent Erudio the template letter (not their own forms) requesting deferment and three months payslips as I usually did with the SLC. Sent it by recorded mail. They completely ignored it and sent me out a new erudio application form saying my own form was undated and unsigned (it WAS both dated and signed by me.) I set up a hotmail account to deal with them faster (no way I would use my real one with these people) will be sending all email correspondence by recorded mail also as backup. I told them I would not be using their form as it was invasive etc and they had enough info to defer me. Also stated I had no other SECRET income and would happily pay back the loan if I was over the £28k threshold. I am being nice. Also sent a CCA request by recorded mail as advised on various forums. As it stands they said this: 'We can confirm that we have not received your signed deferment pack in our office, and we are not able to accept a signed letter from yourself for deferment applications
  13. I owed £15.00 on a 3mobile which Lowells bought along with a Capital Credit Card debt. This was all paid off - can't remember the exact date as I do not have the paperwork to hand- around 2013. .On 21/6/15 I received a letter stated that I still owed them money. I wrote to them & received a letter on 18/8/15 stating they confirmed the debt had been paid & assured me no further action would be taken & my file would be cleared. On 27/2/17 Lowell's & 3G appeared again requesting a payment for £741.20! I have emailed a complaint to them & they have replied 'that they are looking into this matter' QUESTION - How do I get these vile creatures off my back. Do I report them to OFT or FO or both. I am finding this quite distressing as it took such a long.long time to sort this matter in the past. Any help would be greatly appreciated. Thank you
  14. OK last year i set up a monthly DD to pay my car road tax. This has been paid every single month and i have never missed a payment. At the beginning of April i received a letter saying my car was not taxed the letter was dated around the middle of march. I checked my bank and found the DD for April had been paid so i assumed it must have been a mistake. I just received a second letter telling me my car was not taxed so this time i checked online and it shows my car as being not taxed. There is no reason why my car tax is not taxed. The monthly DD is still being paid and has never failed the M.O.T was renewed in March 2017 1 week before the old M.O.T was due to expire and the insurance has just been renewed a few days ago. I dont know who to contact to sort this out as all the phone numbers seem to be automated and im now worried about being finned for a mistake that is clearly the DVLA's fault. Any advice please?   15. Is anybody on Universal Credit and doing Postal Signing? You could do this on Job Seekers, but what about Universal Credit? Have been offered the phone option in regards to signing on, but the Work Coach wants full access to my Universal Job Match account, before authorizing it. The Work Coach says its not available for Universal Credit, but I would like see documenation stating this. Advice, and help would be great.
  16. Hi 10 days ago, I get sent an e-mail from MMF saying my debt is being referred to Moriarty Law. Ummm, OK then. I replied saying, "I have no knowledge, please provide agreement etc". 4 days later, I get e-mailed a copy of an agreement from Wageday Advance. The signature is dated 23 November 2012 and the credit limit is £120 I then asked for statement of account, breakdown of charges and notice of assignment. On 23 March, I get a very simple breakdown saying the loan date is 1 May 2013 and the original loan value was £330 Those two don't match. I asked if this debt was included in the redress scheme arranged between MMF and the FCA and was told it wasn't. On Friday, I asked for the complaints procedure and for all debt collection activities to be halted; I got that today. I will be asking for this debt to be included in the redress scheme and for all current and future collection activities to cease. All I can say is, if you get an e-mail from MMF chasing debt ask for proof and lots of it.

I'm not sure if this is on the right board, but just before Xmas the recruitment agency advised me that because the firm I was working for had 'invoicing problems' (the firm weren't paying the agency for me being there, although I got paid) and as a result my temporary assignment was ended with immediate effect. However, I checked my social media and emails and one of the bosses who I used to do work for has emailed me today asking me to contact them. If the firm wanted me back surely they must have to go through the agency first etc. I was there for 6 months and in the process of completing a new claim online. Any advice about what to do would be appreciated. Thanks

I stupidly took a loan out with amigo, lost my job and couldn't pay the monthly amount, my guarantor struggled after coming out of work with ill health so too couldn't repay, Amigo issued a ccj against me and the guarantor even though we called them and advised them of the issues and asked for the monthly payments to be reduced..erm no wouldn't do it, I pay £50 per month to amigo after getting the ccj that was what was awarded to them, Amigo then went ahead and put a charing order on my guarantors home, my guarantor has told me not to pay the £50 per month with the order being put on their house i have continued to pay the £50 regardless ..but with the order being on the house would you normally be expected to pay the balance or would amigo be if the home gets sold then i get my money anyway. In paying the £50 per month the debts coming down but dont fully see why they put a charging order on the guarantors house because if i dont pay they go back to court for the bailiffs??? i'm lost with it all and dont understand it to be honest can anybody help please.
  19. Around 20 million energy customers (mainly with large suppliers) in Britain are on ‘standard variable’ rate tariffs, and are potentially missing out on significant savings. Ofgem has published its own league table comparing the cheapest and priciest energy deals on the market. The table compares how much customers on standard variable tariffs (often the most expensive on the market) with each provider could save by switching to a cheaper deal, without even switching companies. More than 1.7 million Npower customers could save £261 a year, simply by moving to another Npower tariff.   20. My home was repossessed by Acenden for SPML last April, and the sale completed on 28 November 2016. I have still not received the residual proceeds, amounting to >£133,000. Am I entitled to interest on this since the date of completion? I'm severely disabled, in temporary accommodation and my health, already known by Acenden to be very poor, is suffering. I need to buy a new home, I'm of an age where I'm eligible for an equity release mortgage, and there are much cheaper places to live than here. I desperately need to get out of here. Having read CAG Guide, can I sue Acenden for breach of the FCA Code of Conduct? It's a heavyweight document and would take me a long time to search for any pointers. Please, could someone at least point me to the section of it I need to read to find out? TIA.
  21. Hi My poor little car had a poorly radiator so I bought another car, transferred my insurance in Nov 2016 and set about repairing the first one. The first clue I had that something was a bit amiss came late November when i tried to buy some temporary cover for that car was rejection as they declined insurance saying the car was Cat A/B. I have had this car 5 years.It has never been dented let alone had a serious crash so I thought they just did not fancy insuring a 2.5 L car on a temporary basis. The second was a keen buyer who wanted to check a few things out and never got back to me. I had no problem getting monthly cover from my main insurer who have covered it since Mar 2013 but it was pricey at £60 odd a 28 day period. So, i tried to advertise the car on Gumtree and they rejected it on the basis of HPI saying the car had been scrapped. A quick call (O.K. no call to Swansea is quick,35 menu options later) to DVLA got me a man who said that there was a problem with my car and I needed to fill in a form to find out what was on the record for my vehicle,no. He could not tell me on the phone, yes he could see the car had a valid MOT but I had to fill in the form to find out what the problem was (reply to my submission could take 6 weeks ) Then I could present my side of the story. So I returned in frustration to HPI to try and speed up the process. HPI told me my car had had a Certificate of Destruction issued against it May 2015. Bit of a shock, so I phoned DVLA who could see this car that had,according to them been crushed in May 2015 had been MOTd Oct 2015 and Oct 2016 and been insured continuously. I eventually got an email from DVLA ordering my car off the road and basically asking me to prove I still had the car and that it was the genuine article. So I had to provide photos of the Car with its registration plate, Photos of the VIN number and a pencil rubbing of the VIN number.I had previously sent in my intact V5c form stating they had scrapped the wrong car off. 2 loads of insurance later I have a letter from DVLA without the slightest hint of an apology admitting that my car is not the one turned into a steel door stop and demanding that I pay an enormous sum of money for back road fund license. Car is now taxed from the beginning of this year. Back in March 2015 I set up a Direct Debit scheme for the Road Fund License, they stopped taking it when they decided my car was scrap (usual practice so they say),I did not notice,you tend to look for things you do not remember buying on a bank statement not payments you expect. Equally they did not send out a "Oy, your road tax is due,pay up you bug**R" note March 2016, No Tax Disc to remind you these days,I always bought a new disc when they sent the letter out. O.K. So I should pay up,money is due,despite the fact none of the above was caused by me. Road fund must be paid but what about my costs and effort, I am looking at another 28 days insurance. I should have have been able to declare this car sold late November so no liability for road tax from then but I have had to pay for January despite being ordered off the road for half that. 3 and a half months Road Tax is about £90, phone calls ,letters and time.They want the full amount.I have listed the car on ebay to just get rid but do not expect it to achieve the price I had negotiated before the sale fell through. Is there any scheme that compensates me for the considerable losses on my part,for my expenses keeping the car legal and making it sale-able.
  22. Hi I am lucky enough not to require the use of a credit card at the moment. However a family member has run up a considerable balance on this card. I cannot see any way which they can ever pay this off when the interest is so high. Can one of you confirm that they are allowed to charge this much, and is there any way in which it can be challenged? Any help you can give would be greatly appreciated.

  24. Please would someone kindly offer me some advice. I bought a flat in a converted house about 9 years ago. I have never lived in it as I married shortly afterwards but I rented the flat to an older gentleman who has lived there since, for about 9 years now. When I bought the flat I was responsible for maintaining my part of the building as there was no management company in place, so I took out buildings insurance for my flat. There are five other flats in the buildings. All the other residents are owner occupiers. About two years ago, one of the residents contacted my husband to say they were thinking of banding together to purchase the freehold so that the maintenance of the building would be secured and the cost shared. They first needed to track down the freeholder. We said we would be interested. Please keep us informed. One of the residents contacted my husband about 18 months ago to say they had two residents interested so far but would keep us informed. To my horror, I received a solicitors letter a few weeks ago stating that I owed over a thousand pounds in service charges for this year till March 2016. It transpires that the other occupants have formed a management committee and had banded together to become the freeholders. I replied to the solicitors stating that the last I heard was the discussion stage and I had not received notification of the forming of a committee or that the other residents had purchased the freehold. They did not want to know. They said that if I did not pay immediately they would take me to court and I could lose the flat. I reluctantly paid the thousand pounds requested by the solicitors for the service charges, as they said I could lose the flat if I did not pay immediately, money that I had put aside for Christmas, but despite my payment they have now sent a claim form stating that I still owe the service charges and have added on another two and a half thousand pounds in legal fees. Can anyone please help, I cant sleep at night. The claim form came last Friday and it says I have 14 days to reply. Any help at all would be greatly appreciated, Thank you
  25. Millions of people who have basic bank accounts may be paying higher fees than necessary.. Basic bank accounts are designed for people who do not already have a bank account and are ineligible for a standard current account .While eight million people have basic accounts, around half of them are still liable to pay fees for failed payments. Completely fee-free basic accounts have been available since January 2016, following an industry agreement. Vulnerable customers who have such accounts are not charged for failed payments, or for going overdrawn. The Treasury figures show that 3.7 million people have accounts that do not conform to the agreement, struck between the government and the banking industry, in 2014.
