  1. Received Parking Contravention 23: Parked in a parking place or area not designated for that class of vehicle. Council: Kingston Upon Thames ( Greater London) Appealed to the council got rejected and Next step is to appeal using londontribunals.gov.uk. Your advice on how to go about it would be greatly appreciated. My draft appeal as follows Dear Sir or Madam, I received a notice to owner on 03/08/2015 but I believe the contravention did not occur and I would like to submit an appeal for the following reasons: 1) Goods Vehicle Loading only is not marked accordence with TSRGD 2002 Regulation. Extract from traffic signs manual: 7.29 The sign to diagram 660.4 must be used with a bay marking to diagram 1028.3 or 1032, each with the legend LOADING ONLY, or 1033 with no legend. The bay to diagram 1028.3 has the largest maximum width (3600mm) and is therefore the most appropriate for goods vehicle loading. Where the loading bay is used mainly by cars or small vans and has been provided to allow customers to collect large purchases from nearby shops, the smallest width of bay to diagram 1028.3 (2700mm) might be adequate. Diagrams 1032 and 1033 are also more appropriate for smaller vehicles. Loading Only’ Bay, is not marked in accordance with Diagram 1028.3 or 1032 of the Traffic Signs Regulations and General Directions 2002 , which must accompany diagram 660.4 as stipulated in Direction 24 of the TSRGD. It has no white line bay markings whatsoever (ParkingSpace_1.jpg and ParkingSpace2.jpg) It has not met the minimum width requirement of 2700m. It has only 2560mm at this location. (ParkingSpaceWidth2.jpg) The bay at this location does not meet the requirements prescribed in law and as such cannot be enforced. 2) The contravention did not occur. The photos (printed on paper) supplied by the council shows the car has made a turn around the road manoeuvre but not parked at this location. The correspondence from council does not states how long the contravention has been observed either. The picture taken by the parking attendant has empty parking bay at 17/06/2015 11:16 which is after the turn around the road manoeuvre at 17/06/2015 11:13. I believe above listed reason indicate that this pcn number XXX was incorrectly issued and I therefore appeal against it. Yours Faithfully XXXXXXX
  2. When I first moved to this flat three or so years ago there was a card meter and I asked my electric company of twenty years, British Gas, to alter it to a 'normal' direct debit one. When their engineer came, he said that he couldn't because this meter and the other three flats' meters were all interconnected (back in the 60s) in such a way that to replace it correctly (& legally) meant ripping the whole wiring system up, which, he insisted, would entail a massive job because the whole apartment block and most of the road would have to be ripped up too. he instead tampered with my card meter a bit (not sure how legal that was) and said it was now direct debit. Since then I've received electricity no problem, but every bill has registered zero usage. Into the bargain, British Gas never sent someone to read the meter, despite my asking them to. After, say, 12 months, I was contacted by "Face2Face" (British Gas enforcers) who said they'd been trying to get access to the meter cupboard but insisted that I kept missing their appointments - totally not true. I actually sent them the key to the meter cupboard (situated outside the flats) and told them to access it whenever they wanted without needing me. Did that happen? No . During the last two years I received nothing but regular "We will get a warrant if you don't let us have access" letters, to which I always replied "YOU HAVE THE KEY", and then they'd apologise, but then a couple of months later I'd get another "We will get a warrant if you don't let us in" letter, and everything would be repeated. Moving forward to about two months ago, some Face2Face bully boys came around out of the blue saying they had a warrant. I pointed out that "YOU HAVE THE KEY", which resulted in their company giving me £150 as an apology after I complained, and also because management then admitted they had lost the key. The management then asked if I would grant their engineer access to the meter cupboard to change the meter today, which I of course agreed to. When their engineer and site foreman arrived, I discovered that they wanted to change the meter to another pre-payment meter, which I told them I preferred not to have thank you very much (and for reasons not worth going into, we luckily couldn't get into the meter cupboard anyway). The result of this was that they said that they'd come back in month, and that I should try to ask their management to ask British Gas if I can have a normal meter. The problem is, they said that they doubted British Gas will agree to that because there will be a large backlog of money owed on this meter. But I haven't caused that, they did. I'm also worried that they'll want any money owed at a rate of return that exceeds my meagre incomings. Any thoughts? Additionally, remembering that the last engineer who tried to change the meter said that doing so would mean a massive "knock down the building and tear up the road to do it properly" job, I'm assuming that the only way they can change the meter this time (without knocking the building down) is to, again, do a makeshift 'dodgy' job. But I suspect that this time they will set it up heavily in their favour!
  3. Have just recieved letter from virgin about their unlimited sim deal. They are saying we are no longer offering the unlimited sim deal as it is uneconomical for us. They are saying keep the phone. they will down grade tto unlimited minutes and texts and 1bg of data and keep the tariff price the same. What are they doing ?
  4. 12 july 2015 Hi, Please can someone help me, its urgent and I am very worried. Just to give you a brief background I am a single mother and was diagnosed with a chronic pain condition at a young age and Iv had for many years other health issues have now made me worse like diabetes, Ibs, arthritis and more. Iv also had to be there for my mother who is bed ridden after a car accident and my step father who for many years had liver disease and was very ill before he died a couple of years ago. I have tried to go back to college and university where I now have a degree but its been really difficult iv also had battles with neighbours, bullying with the children in school etc as well as problems with debt people. Iv been trying so hard to get my life back on track and my credit report and feel that I cant win because there is not enough hours in the day or my health is constantly giving me problems or looking after everyone else is over whelming. I also have dyslexia also so paperwork is a struggle the last few months my mum has been very ill after a suspected stroke, heart was checked out and now she has lost the feeling down one whole side of the body. Due to this and all my other issues including being forced back to work which I was trying to do but I was trying to do it in my time due to my health, my paperwork has had to take a back seat. Recently iv gone through some letters I didn't know that santandar were trying to take me to court and missed the dates etc. I have now received this letter that I have enclosed it on your site for you to see and I am very frightened I don't have a lot but what I do have I cant afford to loose especially when Im trying so hard to get work and start a business if I can, but due to me struggling with everything and feeling very over whelmed and I don't know what to do. Please can some one help me to sort this out quickly, so I don't loose anything. I do have other debts but I feel I need to just work one debt at a time at the moment due to trying to cope with everything and my dyslexia. I have years of this actually going on and my mum helped me pay off this account so that I thought and I moved over to another bank for a new start only to find out latter that I had a debt, I need to go through years of statements which I don't have all of them because I believe at the time they were giving me charges for anything and everything and at one point I was in college/uni and was supposed to be a student and not get any charges at all because I was a student. So I feel let down by this company. Since I have gone over to a new bank iv never had such problems or charges etc ever again. Thanks in advance to everyone. Roguehunter
  5. Please help advice me. The permit expired on the 3rd , I received a PCN on the 11th. I never got a reminder as it is anew sheme in my area in Haringey, it was said to have been put in for spurs and help us resident prevent pp parking in our roads during match days. I do not remember seeing any clear directives in the consultation process or the 1st permit isued to me about ensuring I renew and telling or giving me guidance that I have to renew and if I don't what the consequences are. I appealed he 1st ticket and it was declined and I then got a notice to owner and the fee had doubled now £130. I do not know what to do, can some one please help and advice me on how to dispute this. This is a free permit for resident that is suddenly going to cost me £130.00 potentially. I have till Thursday the 9th when my 28 days run out for challenging the notice to owner. I am really upset about this. This is just another way of Haringey council ripping off its Residents. I found a judgement on Barnet being found in the wrong by a judge for not sending reminders out to their residents and Barnet had to cancel all PCN and refund charges where people had paid. but I couldn't find the case law and I am not also sure if this will help my challenge.   7. hi , i'm new so i apologize if this is in the wrong place , basically i bought a brand new car on hire purchase/pcp through a main dealer roughly 9 months ago , in the 9 months ive not had a single problem with the car mechanically up until 24/03/15 ( 2 weeks ) when it suddenly broke down on the way home from work , the dealer has had my car since the 24/03/15 , for the first week it was in they couldn't find the fault in order to get it running again , on the 02/04/15 they tried replacing the PCM saying it should be up and running by the end of the day but nothing it just won't start , they said the diagnostics are coming back ok but it just wont start/turnover !!!! this is the beginning of the 3rd week , ive just been down to speak to them , i got told that they are in talks with head office about what they are going to do etc i'd just like a bit of advice on where i stand on the matter , my partner and i are a bit in 2 minds about trusting the car again if they ever get it running , do i have to take a replacement or can i reject their offer and get the contract canceled any advice would be great

A whopping 90% of people said they have never heard of this number to report spam text messages to their mobile phone provider. The Information Commissioner's Office (ICO) is now warning of an imminent increase in spam text messages following the changes to pension rules coming into force on 6 April. You can report spam texts directly to your mobile phone provider. All operators now use 7726 - with the exception of Vodafone who uses 87726 - as the short code to report spam texts which is free of charge.   9. I'm hoping that someone will be able to help me as I'm feeling absolutely desperate. Our interest-only mortgage with GE Money was due to expire in May 2014. However, in September 2013, my husband was involved in a road traffic accident and sustained brain injury. Since then he has been unable to return to full-time employment. I wrote to GE Money before the expiry date, explaining our situation and requesting that they extend the mortgage term for another year until our situation improved and we were able to approach another company to re-mortgage. Despite providing them with medical evidence, they rejected this offer. In early October 2014, they sent a letter informing me that they would take legal action to recover the £190,000 outstanding (our property is worth around £270,000). I phoned them, once again reiterating that we had kept the mortgage payments up-to-date and that once I had a full-time job, I would seek a remortgage with another company. They said they would consider this, but make no promises. On Saturday this week, however, we received a letter from their solicitors (Eversheds) informing us that they have been asked to represent GE Money and that we will shortly be notified of a court date. My husband has suffered with anxiety and memory problems since the accident and this situation is making matters ten times worse. Any advice would be most welcome.
  10. Hi there, im trying to help my dad to see if he was mis-sold PPI. He took out a mortgage with Woolwich back in 1996 - 2006 of £20k. He thinks that PPI was added without his knowledge to the loan . He was in full-time employment at the time. He has half of his yearly statements but not the actual policy document. The thing i don't understand is that the mortgage was 'interest only', does that mean they were only paying for the interest and not the money that they borrowed? on the statements it shows that monthly payments were made & at the end of the annual term interest was debited. Does that mean that they paid us the interest back - I'm abit clueless lol. So yeah, can we still claim PPI on this? I'm happy to show the statements, if anyone wants to have a look at them for me. Thank you in advance.

  12. Hi I am trying to obtain some help for some close friends who naively accepted a 100% interest only mortgage about 8 years ago with no capitol repayment plan put in place. They bought the property in Scotland at peak price period. It is a sought after area outside Glasgow 5 min walk to a station with a 15 min commute into Glasgow City Centre. The area has been a low turnover in regards to property sales but downside has been an elderly population who have lived there all their lives. Over the last five years a significant number of properties have hit the market from deceased or elderly moving into homes. Some of these properties have required significant modernisation due to the older generation not updating the properties. This has led to average prices falling and bargain prices on those properties. Naturally most have been modernised now but this has impacted on local values in terms of a falling average sale price. Basically my friends need to rid themselves of the interest only mortgage but are concerned if they approach the lender who discovers there is no capitol repayment plan in place it will have a negative impact and could result in the mortgage being called in. The have had hefty loan and credit card debts putting children through education but now the children have left home and work, they have concentrated on paying off these debts. There is no question they can afford to make the repayments on a standard repayment mortgage given the amount of other debts they have cleared. The downside is the property is in negative equity and a general read through the internet does not off much hope on them being able to remortgage. Loan aprox £135k value of property £100-£120k depending on valuation. They are in need of replacement windows and a new kitchen and possible rewiring which may impact on any valuation. I guess I am seeking any opinion that may help me to guide them. Sorry for the long post but any advice would be helpful. I think the broker who sold the product didn't reinforce advice about capitol repayment.

Hi to all i own a Msi gtx 970 graphics card and over last weekend it has been confirmed by NVIDIA’s Senior VP of GPU Engineering Mr J Alben in a online article (tried to link article would not let me) that nvidia have made an error (or lied:?::? in the spec sheet given to review websites last year and intern has led to consumers being misled with false specification. It has taken nvidia two weeks to come clean about this since consumers first noticed something might be wrong with the card it has also taken them another 3 days to decide they will give a refund to anyone who wants one but the way they have gone about it is a joke the card i have is no longer fit for the intended purpose that i got it for. What i would like to know is have nvidia broken any UK or EU consumer laws and should they be offering more than a refund like compensation or free upgrade to a card that closer matches the original advertized spec. the only option i am open to is the free upgrade as that is the only one that dose not put me out of pocket Any advice or help is greatly appreciated col adlington
  14. After every flight, Qantas pilots complete a form called a "Gripe Sheet" which tells the mechanics about problems with the aircraft. The mechanics correct the problems; document their repairs on the form and the pilots then review the Gripe sheets before the next flight. Never let it be said that the ground crews lack a sense of humour. Here are some actual maintenance complaints submitted by Qantas' pilots (P) and the solutions recorded by the maintenance engineers (S) Apparently Qantas is the only major airline that has never, ever had an accident. P: Left inside main tyre almost needs replacement S: Almost replaced left inside main tire. P: Test flight OK, except auto-land very rough. S: Auto-land not installed on this aircraft.   15. Hi, I was wondering if anyone has any knowledge of the legality of this very common practice. I recently booked a holiday at a very popular resort in Turkey where for the summer holiday months you usually have to book up to a year in advance. We have been 3 times previously and are very familiar with the resort and accommodation etc. Just before xmas on the Thomas Cook website it showed (for our party size and dates) the red flashing text, 'only one room remaining'. Fearing I would miss out, I booked. Out of curiosity, I then went back in and entered the same details and sure enough, it was still flashing, 'one room remaining' (same price, same flights etc) allowing me to go through and book. My issue is that the evidently false claim that there was only one room remaining influenced my decision to book at that time, when in theory a better deal may have been available at a later date. These limited availability claims are very common and I suspect we are being mislead into purchasing decisions we would not otherwise make through fear of missing out altogether. Thanks in advance FF

Well you could knock me over with a feather - I've just obtained an Equifax report and credit score as I figured it was time to knuckle down and try to improve my rating and they have me at 968 which they say is excellent. I've been getting the free Noddle report for a while which has always had me as 1 out of 5 and someone who would have difficulty getting credit. I'm not looking for credit right now. I am in a debt management plan, but need to plan for life after this ends. I genuinely thought I would be at the bottom of a credit score, so just don't get it. (I'm not complaining though )
  17. I partly completed a small load application form with the above company. As there were questions on the form which I was unable to answer (mainly employment questions as I have been retired for 6 years) the form was not completed or submitted. But it seems that important details on the first completed page were still transmitted to them, and 67.88 was taken from my bank. On my membership page with them, it quite clearly shows this incomplete form. I have screen shots of this. I wrote to them, recorded delivery, to cancel this, and have screenshot of their postal receipt. Eventually, I received an answer to say that the refund had been made, and although I realize that this can take a few days through Visa, it is now almost 3 weeks and no refund. Since my refund application, they have a new address, and I have written to this address also. It is impossible to speak to anyone on the phone. I have contacted Citizens Advice (as a first step in putting this matter before Trading Standards) as this company are quite clearly flouting the 14 day refund rule. I want also to confront this company over the way that they obtained my bank details, as this seems to be quite usual going by previous threads on this site. It does not seem legal at all...should I contact the police on this, or can anyone advise me the best course of action ?

  19. Hi - been trying to work this out in my head but wonder if anyone has any ideas about this situation of mine, thanks. I have an interest only mortgage - the arrears I previously had were shown on the statements and increased the outstanding balance, which I understand. The new balance then attracted more interest. Later the lender took me to court and had the arrears added to the security, increasing the balance again. Shortly after that they capitalised the arrears - so - assume the balance went up again. Also added all their legal fees. Does this mean that there has been a double recovery of interest then?
  20. HI Guys, In 2005 I took on an interest only re-mortgage for 20 years with GE Money. I was massively in debt (still am) at the time and this was the one and only way I could release some equity on my house as I was desperate to repair house problems etc. Anyway, GE knew all about the debts and were quite happy to help even though it was 100% of the value We have just received letter from GE asking us how we intend to repay the loan and of course, we can't. There's simply no way of paying £105,000 in 10 years, not on the money we earn. I have written to them asking if they could extend the loan and maybe put us on a repayment plan, but had a phone call from them saying the payments would be over £1200 per month and we couldn't afford that. And that they couldn't extend the loan. So that's that. In 10 years we will be out. Most of it our own fault, not thinking of the future, but at the time everyone was saying houses were a pension, and that we would simply be able to sell and downsize. I think with all our problems, we should never have been given an interest only mortgage, but I guess there's not much we can do now. I really would like to see interest only mortgages banned for main residence, as how can anyone pay them off unless they have massive pension pot coming up sometime. If anyone has any ideas for us, please say!
  21. Hi. Just need some information regarding hire or rental purchase, is there a difference ?? Reason I ask is, 10 month ago I got a computer on hire purchase from Perfect Homes, I went here because the cost compared to brighthouse was almost half and a better spec and also was only £20 more expensive than the well known computer shops. Don't get me wrong, I was and I am happy with my purchase but unfortunately I have hit some serious financial difficulty and costs have got to be cut in my household, I am cancelling my ties with virgin media so internet will have to go, my mobile phone has gone and also the car, I rang the store to explain that there is no way that I can now afford the payments and is there a possibility you can collect and take it back, they said no because I didn't take any insurance out with then. When I made the purchase we had our own home insurance so declined there's as this would have cost a extra £4 a week (maybe a little more) but apparently this also covers you incase you want to return the item with no adverse affect, don't get me wrong even if I knew this I wouldn't have took it out anyway and I am not sure if it was mentioned in the purchase procedure. Any way, back to my point. I want them to come and get it back as its a hire agreement, do I have any rights or am I stuck with trying to find the money every month for something I no longer want to hire.
  22. Hi all, I started receiving calls from Lowell last week over an alleged balance of £28 owing to T-Mobile. I couldn't initially work out what it was, but my mobile was originally with T-Mob, they 'upgraded' me to 4g and the contract moved to EE and looks like I missed the last payment with T-Mob, so I do owe the money and will quite happily pay it. However, I checked with the CRA's and they registered a default against the account in January for the princely sum of the £28. I have never received a default notice. Is there any way I can get it removed, or am I going to have to put up with a 'satsfied' marker and my credit file being blighted for the balance of six years? Thanks.

Hi looking to get some advice about Barclays Bank, basically myself and my boyfriend have a joint additions plus account with an overdraft .for the last 18mths my bf has been without his card,every time the card expires I get a new one but he doesn't. When it first started happening we went to the bank and asked why ,they said they didn't know the reason as there was nothin on there screen to give an explanation as to why it was happening and that they would look into it and call us , didn't hear anything bk so we phoned customer services who didn't have a clue either, they said for some reason the computer won't issue a card to my bf and that it could be bad credit I said well both our credit ratings aren't great so if that's the case then why am I gettin a card and he isn't? Once again it was "we will give you call back and promised they would get to the bottom of it even if the guy had to deal with it himself! Nothing again, we just keep ringing and they keep sayin the same thing. My bf is furious as he works away a lot and has to keep taking my card away with him to use which we've explained to the bank as well, I work full time and I haven't got time to ring the bank every wk to ask them what's going on plus it's not my card so they won't speak to me without my bf present .luckily I have a Halifax account as well that my wages go into so I'm ok for money when my bf goes away otherwise I don't know what we would do.   24. Hi All Anyone have experience of Scottish Sheriff court eviction proceedings? Ever heard of Sheriff granting decree to evict when only 1 discretionary ground is cited in AT6? Case history- I served landlord notice to quit halfway through a 12 month short assured tenancy, however I now need hospital treatment so I've had to cancel a trip I had planned and am unable to find new accommodation at short notice. Notice expires in a few weeks. I have always paid rent on time and adhered to all conditions of the tenancy agreement. So only ground landlord can use to evict me is Ground 10 of Schedule 5 of Housing (Scotland) Act 1988, which even if proven, is at the discretion of the Sheriff as to whether it is "reasonable" or not to grant the order. (Ground 10- (a)the tenant has given a notice to quit which has expired; and (b)the tenant has remained in possession of the whole or any part of the house; and ©proceedings for the recovery of possession have been begun not more than six months after the expiry of the notice to quit; and (d)the tenant is not entitled to possession of the house by virtue of a new tenancy) Landlords' agent has repeatedly stated that reason landlord wants me to leave is because he wants to sell the property. Is the Sheriff likely to find it reasonable to make me homeless just before Xmas 2014 so that the landlord can satisfy their avarice? and Will the Sheriff determine that I have to pay legal fees for eviction because I have stayed passed the quit date without good reason (I would argue that need for medical treatment prevented me from finding new accommodation at short notice) I'm thankful to any CAGgers who take the time to share their expertise on this subject
