  1. Hi all, Fairly straight forward I'd imagine, from the text in question 2, but I thought I'd check with you guys for some actual wording for my appeal. For info: Company Car, and to make matters worse, I'm leaving said company on the 24th Feb and they'll take any outstanding fines from my pay. 1 Date of the infringement: 18/01/2017 2 Date on the NTK [this must have been received within 14 days from the 'offence' date]: 06/02/2017 3 Date received: 10/02/2017 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? Yes 5 Is there any photographic evidence of the event? Yes, car entering and leaving, but not enough detail to read the reg, 6 Have you appealed? Not yet, wanted to take the right tack. 7 Who is the parking company? Total Parking Solutions (TPS UK) 8. Where exactly Brighton Road Retail Park, Redhill, RH1 6QL
  2. hi , i have a loan from welcome F (secured) but on the credit agreement my address does not have the flat number of my home , only the address of the whole building as there is 8 houses in the building does this mean the agreement is not complete right?
  3. Hello all. First of all thank you very much for supporting this website. It has given me some hope in what to me appears to be a very dishonest situation. Summary PCN received after stopping for 12 mins at the entrance to a P&D car park in which ALL 4 Spaces were blocked by a wooden pallet each with a notice saying the road was too narrow for parking and emergency access. Details Broadwater Street West in Worthing, West Sussex is a short, narrow L-shaped side street running along the side of Starbucks and to the left behind it and other buildings, giving access to lock-up garages and waste bins. It has 4 parking spaces nose to tail running from the entrance of the road. My passenger had a painful case of cystitis and needed to use the loo. Thankfully we saw a Starbucks and from the main road it looked like there were parking spaces free in the side street next to it. After turning into the street and letting my passenger out, I saw that each of the parking bays had a wooden pallet in them preventing their use. In addition there was a sheet of paper on the wall to the side of each space saying that access was required at all times in case of emergency, bin collection and deliveries and that the road is too narrow for parking cars and through traffic. This is certainly the case. Having entered this narrow street the only way out was too drive to the end of the L where there is just enough space to turn around and then drive back to the entrance. Unable to park I waited just short of the main road for my passenger to return. Although I had fully intended to pay, with it not being physically possible to park let alone legal, the whole place gave the appearance that parking was at least suspended if not cancelled. Hence it never crossed my mind that I would be penalised for stopping there. There is of course no one supervising to tell you. My passenger could have just run in to Starbucks, used the toilet and run out but being polite she chose to buy some tea. We had just left the vet after having spent an hour talking to one of their very kind nurses about the loss of our dog which has been heartbreaking. It was a very emotional time and with the cystitis as well I couldn't drive off and leave them; stopped by the entrance I could at least clear the road if for example an emergency vehicle required access. They returned after approx 10 mins and we left. What Happened PCN received for "Failing to Park Within a Marked Bay". Given the situation described above where I was physically unable to park in a marked bay, let alone do so without blocking emergency access I thought it was a [problem] and a quite ludicrous one at that. And for this reason I have not contacted One Parking Solutions. I have since received a letter from ZZPS Limited saying my unpaid PCN has been passed to them to resolve. The balance owed has now increased to £170. They have quoted Parking Eye v Beavis as a recent Supreme Court Ruling. I have spoken to them and they said I was parked for 12 mins. If I do nothing the matter will be passed to their solicitors.

N have you received a Notice To Keeper? (NTK) [must be received by you between 29-56 days] No what date is on it N/A Did the NTK provide photographic evidence? N/A 3 Did the NTK mention Schedule 4 of the Protection of Freedoms Act 2012 (PoFA) [Y/N?] 4 If you appealed after receiving the NTK, did the parking company give you any information regarding the further appeals process? 5 Who is the parking company? Indigo Park Solutions UK Ltd 6. where exactly [Carpark name and town] did you park? Tring Station Car Park, Tring. Hertfordshire The penalty notice was issued by Indigo Park Solutions UK Ltd on behalf of West Midland Trains for Breach Code 1 - Failing to display a valid ticket or voucher. At the top of the Penalty Notice, it notes that the car park is regulated by the terms and conditions of parking displayed at the car park in accordance with Rail Byelaw 14, and so on........ Please could someone advise the steps I need to take in order to not pay this please? From reading around this wonderful forum I can see that this appears to be unenforceable in a magistrates court (which I gather they would never do anyway due to not receiving any money from it) after 6 months, I would appreciate a few bullet points outlining what the steps are to get to 6 months and what type of correspondence I can expect please. I'm keen to take this on based on what I have read, however my wife isn't and is looking for some reassurance from the more knowledgeable folk on here. Thanks in advance!
  5. Hi, I inadvertently parked in a residents bay last Sunday at the Olympic park, unsurprisingly I returned to the car to find a £100/£60 PCN from Gemini Parking Solutions London. What's the collective advice with these people when I don't actually have legitimate grounds to appeal it for other than their notice being just that and not a fine? thanks JM

Hey guys on 19/10/2018 I have parked my motorbike next to the car bay in Olympic Park, the ground was not marked by yellow crossing lines there, while I am pretty sure it was in other places, so I assumed it is not a problem to park there. Received a PCN on that day and waited for NTK which arrived on 21/11/2018. The Parking Charge is 100£ at the moment. If not paid in 29 days, I am informed (threatened) that charge will go up by another 60£ I will try to scan and redact the NTK once I am in the office and will send it here as well Questionnaire: Date of infringement: 19/10/2018 at 13:15 Not appealed to PCN Received NTK: 21/11/2918 The NTK mentions Schedule 4 of Protection of Freedoms Act 2012 Parking Company is Gemini Parking Solutions Location is Queen Elizabeth Olympic Park London

I am curious to know what happened and what I should do. Thanks!
  8. Hi. I had a problem with a PCN from Indigo a few years ago and received excellent advice from here to "sit tight". Was successful. Thanks. However, we now have another similar case and someone told me that recent case law has changed things, so I wanted to check that sitting tight is still the right course of action. My wife parked at a Southern Railway station car park recently and used the automated phone response service to pay for a day's parking. Unfortunately, the regstration number used on the automated system was incorrect - one letter was accidently missed off. There was no windscreen ticket, so I assume control was by CCTV. We have now received a PCN from the PCN Admin Centre (29 days after the event) acting on behalf of Indigo requesting payment of £100. It's a "penalty notice by post notice to owner" quoting byelaw 14. In the time between the incident and receiving the notice she has parked there twice more, so I assume we will receive more notices in respect of these dates. So, should we just sit tight? Would it be better to write to Indigo explaining what the mistake was? They could check their records and see that they did receive payment each time. Also, I don't think the registration number used actually exists. Thanks for your help.
  9. I've reached a ridiculous situation with this outfit . Under the agreed T&C's they may, subject to having given 28 days notice, change the T&C's. While there is no record of their having given any such notice, they have never-the-less changed the T&C's to the effect that failure on my part to complete an annual review entitles them to cancel the agreement They now claim that I have cancelled our agreement, but there is no record that I have ever done so. On the other hand they have warned that unless I complete the annual review before some time in December they will exercise their right to cancel the agreement. But this raises the issue as to whether their failure to give the required notice had rendered the changes they had made to be without effect. They say that completion of an annual review allows them to assess whether we can afford to complete the Debt Management Plan, and in doing so accord with FCA recommendations. Whereas I have argued that they are applying an overzealous interpretation of the FCA recommendations. In regard to which I note that according to an FCA enquiry "in some areas, an inaccurate interpretation or overzealous implementation of rules (such as those around data protection or affordability) is preventing firms from meeting the needs of vulnerable customers."
  10. Hi folks. Much the same as many people here I suspect, my first post is about a Parking Charge Notice I received. I'm aware this isn't a penalty charge notice. I have read many different stories about Gemini but I believe mine is a little unique. I and my motorbike (yes, my motorbike) received a Parking Charge Notice, stuck onto my petrol tank at the Queen Elizabeth Olympic Park. Date/Time - 11/08/16 16:50 The Issue reason is "Parking in a No Parking area". I have not appealed yet. All excuses aside - those being that I was attending a job interview and could find NO parking facilities at all. Eventually I locked my motorbike up to a bicycle railing completely missing the road signs as you can see in the photo attachment. I got back to my bike to find the parking charge notice on it. I have till Thursday (the 14th day) to appeal to keep within the £60 reduced fee (from £100). So much advice says ignore the Parking Charge Notice, but I feel my situation is quite unique. What advice do any of you sages have? Cheers in advance.
  11. Hello newbie here, My Husband & I have been dealing with a Debt Collection Agency SMD Credit Solutions Ltd since April to collect a Debt owed to our Company since November last year. A little background: We were owed £38k and the debt was in dispute by the company who owed us. This was construction industry dispute where we worked for contractor (2) who was working for main contractor (1). Main Contractor (1) refused to pay contractor (2) citing poor workmanship therefore contractor refused to pay us. So it was quite in depth but it was being dragged out and being a small company we needed to get a resolution. SMD cold called us but it just so happened we were in the process of looking for an agency after them phoning us everyday for weeks trying to persuade us to agree for them to take the debt on we agreed. We had lengthy discussions about the whole case and we were upfront about everything before we even agreed for them to take on the debt. We knew it wouldn't be straight forward so wanted someone who knew what they were doing. They wanted to charge £2000 + VAT for a reg fee but we simply couldn't afford that so they dropped it to £1000 + VAT payable in 2 instalments. After we agreed we sent them all documentation regarding the debt including invoices owed, purchase orders we received, emails and a report from the main contractor (1). Needless to say SMD were useless, they never answered or return our phone calls, they never returned or answered my emails. In their initial 'guarantee email' they claimed to keep you updated every step of the way and give you a full refund of the reg fee if they don't at least recover the cost of the reg fee. Eventually after quite a few weeks I was emailed and told that SMD had had to obtain legal advice on our behalf and had to pay out in excess of £3000 in order to do so. After weeks of getting nowhere and no answers SMD finally advised us in mid June to set up a meeting with Contractor 2 and main contractor 1 and thrash out what we could get paid. We advised them that we would look for an alternative agency who was specialised in Construction industry disputes and we would like our reg fee returned to which we received no reply and no refund. We then received the official In Administration letter from contractor (2), and I left a negative review on SMD company facebook page. Nothing defamatory or untrue just stating our disappointing experience and that I would not recommend them. Oh and I hope they don't keep telling people about their 100% success rate which is what they said to us. Today I get an email from them saying that unless I remove the comment they will charge us £10,000 (10 x the reg fee) plus the £4000 costs as per their T&C's. They claim we mispresented the debt by not telling about the report Can they do that? Sorry for the long post

  13. Hi my 1st post on here i was hoping somebody can help me i have had 3 letters from civil recovery solutions. I was caught walking out of b and q after swapping parts from a damaged box to a good box i thought that one part was missing so i took it from the damaged box and put it in the good one. After being stopped it turned out that the part was in the good box but i had not seen it. No police were called and i was made to sign a store ban for 1 month. I had received a letter from civil recovery solutions for £95.15 which i ignored and another reminding me that the early settlement fee was about to expire . I am now on my 3rd letter for £118.94 and it is headed letter before refferal. I am now quite worried i have ignored this letter as well but they gave me 28 days which is due to expire next week I am also worried as im going abroad for a few weeks and if it does go to court i wont be in the country and loose by default. This was a mistake on my part i have never been in trouble with the law and im now loosing sleep and its all i think of but i cant afford to pay the fine plus i dont want to pay out of principal. Has anyone ever been taken to court from civil recovery solutions or B&Q or are they just trying to scare me into paying. I hope someone can help me with this please i have read many threads on these companies but most are quite out of date and never come back to say whether they heard anything more or ended up in court.   14. Hi All, I would be grateful for any help to work towards reducing my Welcome Finance loan which has been sold to Coast Financial Solutions despite account being in long term dispute. I do not wish to bore you kind folk with a sob story but think you need a brief history. I got a car from YES Car Credit when I was a student back in 1998. I purchased a property in 2002 and fell victim to Welcome Finance offer of reducing my costs by taking out a home loan. Since then over 15 years has passed and I have put the loan in dispute many times due to charges, incorrect balance and Payment Protection Products including MIF which I was never made aware of. Now I am in the progress of claiming back PPI and have tryed to get WFS to agree to a settlement. I am not greedy just want a soloution to the outsanding Welcome account. The account at present stands at just under 23,000 and has been re-written many times . This is my mistake for giving in to WFS harassment but they stopped interest on balance a while back due to the length of the dispute. Thus this is were its gets weird . Every time I try to communicate with WFS they pass the account on saying they have sold it but so far the purchaser has been a DCA for example Incasso and Cabot who just hand it back after I reminded them that the account was in dispute. Now they say with letter that the account has been sold to Coast Finance Solutions who are based abroad but have a PO Box address in Newport. This is strange because I have offered half the amount as settlement and when you do the maths its a very generous offer. I calculated this by simply deducting miss sold PPI which totals nearly 8,000 and deduction unfair charges. Anyway can anybody advise Many THANKS in Advance

  16. Hi everyone, Recently I was parking close by Westfield Stratford (London) - The East Village Development. I teach an outdoor class there sometimes. On this day I was in such a rush, by the time I got there I realized I'd forgotten my debit card. The parking uses the online Ringo app, usually I'd pay, but I was unable to. I ran taught my 1 hour class. Came back 'phew' no ticket and went home. ==== This was on the 29/04/2018 A week later I received a letter in the post issued on 04/05/2018. (Nothing was placed on my car) My class was at 11:00, I got there 5 minutes early, the ticket was issued at 10:57. The guy must have seen me get out car, hid (I scanned around) and then taken photo's only minutes after. === The letter is a PARKING CHARGE NOTICE TO KEEPER I am asked to pay £60 within 14 days else it goes up to £100. "Your vehicle was parking in a breach of the terms at East Village Development on (date). As a result we have issued Parking Charge Noticed (PCN) We issued a PCN to the vehicle because it broke the following condition. Not Ticket. By parking on this private land, you agree to the terms and conditions clearly displayed on the signs on-site. You are liable to pay a charge if you breach these conditions. A discounted charge if paid earlier.. (shortened)" On other side of page it mentioned ways to contact and the 1998 Data Protection Act. I'm new to this site so apologies I understand questions like this probably get asked over and over. I've tried to read some of the threads, it's my understanding I should send the cost of 1hour parking to them and challenge them?
  17. Apparently in the world of Premier Parking Solutions this amounts to parking outside the parking bay and is worthy of a £100 fine. Rest assured that all four wheels were inside the (small) bay and the photo shows the only bit of overhang. I'd like to think this was issued by some over-zealous newbie warden but then he/she placed the ticket right at the bottom right of the windscreen no doubt in the hope that I would move the car before I noticed it. I've already 'appealed' and put them on notice that unless cancelled forthwith, I will be seeking recovery of costs for my time. I'm actually quite tempted to report them to Action Fraud as well.
  18. Hi there I'm being pursued by these people for some very unfair tickets. I know there is a lot on here about different approaches etc but I was interested in the 6 month rule, can someone please explain the law around that? Also, the tickets definitely say Penalty Notice not Parking Charge, does this mean it's official? Thanks in advance for all your help
  19. Hello, I signed up for a noddle credit report, I have one default maker on my report. I had an H&M credit account which I stupidly defaulted on, the amount is £120.00 and the default date is 11/04/2013; it’s been sold to Arvato Financial Solutions. I do want to pay the debt off in full but I really don’t want to pay it to Arvato Financial Solutions. I was going to write or email H&M and ask them to buy the debt back off Arvato Financial Solutions, so I can pay them (H&M) directly. I will also inform H&M that full payment will be made on the condition, that H&M promise in writing to remove the default marker off my credit report. I just wanted to ask, if this is a correct way to resolve this debt. If not I would be extremely grateful for any advice.   20. This will be a long post, so bare with me on this. A few weeks ago, my mother received a letter from Amigo loans. Strangly enough, telling her to confirm her details for her recent loan application. Pretty strange, I mean we've heard of them but NEVER used them or even been on their site. I decide to ring up, find out what it's about (maybe its a mistake or error). NOPE. They recieved a application from a company called Express Finance. Again, never heard of them. But amigo gave us the contact information for them, and took mum off their system. And we rang Express Finance. Again, they had an application/information sent to them from yet another company, Finance Train. They told us they'd take the information off their system. We then decided to contact finance train, whom we came to notice were a loan broker. And this is where it all begins... I myself decided to try and email them I had any information from them written down (incase it went further than them as this was getting bizzare now). Every single email address on their website came back not sent. Every. Single. One. i'll ring them? Nope. Their phone always (no matter what time of day) goes through as if ringing and then just says 'our offices are shut. Please call again during buisness hours'. Well, what hours are those? You're a UK based company, working normal buisness hours but I can never get hold of ANYONE. So by now, i'm a little mad. We find the FCA authority number and have a quick look if they're still trading. They are, and another company shows up but its MDX solutions. Apparently, Finance Train is a trading style of MDX solutions i think, Okay, email MDX solutions. Someone there should direct me to the right place at least. I emailed on the 4th Nov. I'm still waiting. Now all this sounds a little weird by now as it is, I decided to look into the companies listed with MDX solutions and there's a few in total. 2 have the same website, a few colour changes, and my favourite part about one of them is that it has 'This is a paragraph' written on their privacy policy, you know, just incase I didn't understand the concept of a paragraph. Every company on there which is a loan broker has the same number for customer services, and same style of email address 'customerservices@xxxxx'. The other websites, have a different number to these, but again, their numbers match (little bit odd to say the least). All these companies are registered to flats in London (or at least MDX solutions is, but on the 'contact us page' the address is that exact same one. And looking at the person who managed MDX solutions (who has his own website for his new company) seems very proud of having 5 companies who have gotten FCA approval by him (I know because of a blog post on their telling me all about it). This all seems very weird to say the least. Has ANYONE else had dealings with MDX solutions or Finance Train (Or even a company linked with them) because I really REALLY want to get to the bottom of this. (PS mother has NEVER used a broker in her life, she has had a loan before but we did ring the company to ensure they didn't pass those details on to a broker or in general and they informed us they do not do that what so ever. They're a fairly large company as well so I tend to trust what I have been told by them)
  21. I've been reading around this forum before posting but I can't find an answer. I think I may be in an unusual position, so any advice specific to me would be great. I need to leave my job next week. Let's just leave it as a 'personality clash' (Manager is a , I'm not! lol) I've found a new job starting 1st November. Great! BUT, I went to the job centre on Friday and my area is trialing UC, and so the first payment I'd get is in 7 weeks from when I leave my job. Obviously I'll be working by then, but won't be paid till 1st December. I have no savings, but have paid a bucketload of tax over the last 25 years and something called 'National Insurance' to 'insure' me against being in a situation like this. But now I'm in need for the first time in about a decade I'm whole outta luck apparently!!! I've suffered with anxiety and depression my whole life but realised that life is better if I connect with other people through work rather than give in to my malaise - even if sometimes that work has been beneath me just to keep self-respect. Anything is better than just locking myself away in a darkened room and spending more hours on a computer than a full-time job would be sat alone at a computer trying to convince the JCP "I'm really sick, I can't even work at a computer, I need ESA", etc, all that bad-back . But I'm tempted to claim if ESA pays faster than the 7 weeks I've been quoted for UC. I only need what's my right having paid in, and only need it for a month to tide me over. Any ideas how best way to go? I'm going to hand in my week's notice tomorrow morning either way.
  22. Hi Guys I know there have been many threads about Total Parking Solutions but they seem to be about over staying or ticket machines not working. Mine is a bit different. My son took his 8 1/2 month pregnant wife to hospital and parked his large Ford Ranger in the car park. He hadn't realised until he went back that he had parked 6" outside of the designated box. A TPS employee issued a Parking Charge Notice 8 minutes after he arrived. There were plenty of spaces in the car park anyway - this seems a bit of a money earning ploy. I have seem previous advice about ignoring it - would this be the same here? Obviously, with a little one on the way he has enough stress to cope with and I am trying to help to reduce that by contacting you. Thanks in anticipation

  24. This is my 1st post. Have received a 'Contractual Payment Charge' from the above for parking on a road on double yellow lines with a valid Disabled Blue Badge clearly displayed on my dashboard. There were no visible signs apart from a sign at the entrance to a car park opposite. I made an appeal on the day it was issued explaining he circumstances (was with my elderly, disabled Aunt blah blah blah). Can anyone suggest what I should do? Thanks for any help
  25. dear all I have read this thread http://www.consumeractiongroup.co.uk/forum/showthread.php?440374-Capital2coast-PCN-Lewes-Clamform-received&p=5045522#post5045522 with interest as I am still lumbering on with so called debts from Sussex Security Solutions Ltd who issued PCN at Eastgate Wharf, Lewes in August 2016. Sussex Security Solutions Ltd being owned by the same dodgy dealer as One Parking Ltd (trading as Capital 2 Coast). Having appealed as standard to SSS I heard absolutely nothing, not even a letter to confirm my appeal had not been agreed. Then followed debt recovery letter from DRP in November 2016. Silence until June 2017 when I received a letter from the notorious ZZPS LTD and finally in July a letter from Wright Hassall solicitors acting on behalf of ZZPS acting on behalf of SSS!! I am just penning a letter to Wright Hassall as I am getting to the point of being tired and angry that I keep getting harassed by every parking conman/woman in the land. I didn't even park (as such) on the so called private land I wasn't trying to get away with free parking whilst I shopped. Merely picked up my daughter who was waiting on the pavement at that spot (it looked a safe place to collect stop and let her in the car rather than on the high street!!) I guess the reason for my rant/post is just to check there is someone out there who is still holding up the flag by not paying up. ..It feels a lonely battle and quite intimidating at times.
