  1. Hello. I am 2 and a half years into a 4 year finance deal on my vehicle. It is all up to date at the moment. However I am changing job this month, but am going from self employed to full time employed and paid monthly. As I have no savings I will be going a whole month with no income so I am going to struggle to pay all my bills for this month. Before I start talking to the finance company about this to try and come up with an agreement (which I don't think they will be keen to do) what are the legalities of me missing one payment? I'm assuming they can't start repossession proceedings yet? I'm hoping they will agree to take just a small token payment this month then make up the shortfall over the next two or three but if they try to play hardball where do I stand? Thanks for any help.
  2. Hi, I have received an n24 form “general form of judgment or order”. It states that point 1, it is ordered that judgment for the sum of £1450 and interest to date of £92.08 plus various fixed costs and hearing fee. Total £1964.50. Point 2 states that the court have assessed additional costs claimed .....”and such costs we summarily assessed at £700.00”. Point 3. Above sums to be paid by 4pm on 16/11\18 Dated 26th October Hoping someone can help me understand this. I did try to settle out of court, but the claimaint was seeking an additional £700 (which would have meant £1400 in total over and above judgment amount) in costs. I was advised to let the court decide on this, and in doing so they have assessed the costs at £700. What I really need help on is the fact that I thought I would have 28 days to pay the judgment sum in point 1, but this form is suggesting that all monies including costs have to be paid by the 16th at 4pm. Have I understood this correctly? Or is it the costs awarded in point 2 that have to be paid by then and I would still have until 28 days after judgment to clear the judgment sum?   3. Please can you can help. Today I had a letter from IDRWW regarding a debt from 2009 to HSBC Middle East. I took loan out to pay a debt, lost my job, had to leave the region due to visa rules, was unemployed & had long period of instability. I had given my parents address when taking out the loan and have had zero communication regarding this debt since 2009. It's a relatively small sum of money (£2700) but i'm self employed on a low income so can only afford very small repayments at moment... I'm very anxious about how best to deal with it as I fear it will escalate into a bigger problem. I fear they won't accept my small repayments - and could dump load of extra penalties on me that would make it unmanageable. In principle i'd be happy to pay something as I prefer to clear my debts ....what is the precedent for dealing with this? Thanks in advance for your time reading this.

A few days ago I completed a few transaction over LocalBitcoins.com to a buyer named Muumbis (currently blocked) who seemed to be a trusted user, had good feedback and 2 months of multiple transactions. The buyer sent me the funds through a PayPal transfer, and then I proceeded to send/release the bitcoins to his account once the money hit my account. These transactions were very profitable to me, amounting to about 40% of profit over the then exchange price of bitcoin. Only after 6 PayPal transactions amounting to a total of around £11000, I noticed that the person’s details included in the PayPal account used to forward all these payments differed greatly from the personal information of this LocalBitcoins.com user. For comparison sake, the owner of the PayPal account is a Canadian, while this person seems to be based in Netherlands (Proxy, likely) and has a verified phone number from Kenya, as well as, beginning of a different gender. As of now PayPal as yet to contact me about any irregularities in these transactions and I made sure I transferred all my PayPal balance to my savings account. However I’m confident I got [problem]med and it’s just a matter of time until these payments are flagged as unauthorized transactions and the owner of the PayPal account files a chargeback against me leaving me empty of bitcoins and about 5000£ of negative PayPal balance, which I have no means to payback as I’m student and I already have some debt going. Summary, I sold some bitcoins at 40-50% in profit to a guy who used a hijacked PayPal account to pay me. It’s just a matter of time until the victim of the hijacked account files a PayPal unauthorised transaction/ chargeback against me. PayPal then reverses the transaction and the [problem]mer gets the bitcoins while I’m left to pay around 5000£ of debt due to the profit margin. I’m divested by this, as I’m a victim too just like the affect PayPal account owner, plus I have no means to payback if these transactions are found to be unauthorized. Perhaps, in the end, all I could do is payback the some of the money to the victim excluding the profit/debt margin that was employed in this [problem]. God, I can’t believe a fell for it, I’m aware of this sort of thing yet due to my own stupidity or being a student with no income I just went for it….Never felt so dumb. I know I’m making assumptions on what if…however, I just need to a little guidance on what to do next or who to turn to, basically a course of action to reduce all the possible damage. Thank you all
  5. Ill start with how and what it has come to for me to post on here. Around this time last year my nan went into end of life care at a pilgrims hospice in kent. At the time I was temporarily living with my mum who lives in Hertfordshire for work. There was no long term vision so I never changed my permanent address. I do have a dart charge account but before working there and due to other reasons I hadnt actually been to Hertfordshire often thus using the dartford crossing, overlooking the fact Id got a new car since the last time I had been there. As I also ride motorbikes and more often ride that and wouldnt pay dart charge manually. When my nan went into hospice for end of life care over the space of a couple of weeks there were five occasions i used my car and didn't pay the dart charge fee. My dad would open my post delivered to his address, but in the circumstances with his mum and my nan being so unwell and eventually passing away. The fines were sent to equita. This is where the trouble started... Originally the five penalties added up to a sum of £10, but through equita LTD they amounted to £190 each! Once I became aware of these I got in contact immediately and tried to resolve/explain the situation and set up a payment plan as id never had anything like this before. I ended up having five separate 'accounts' with them, I asked for have one set date a month for an individual payment to be paid by either standing order or direct debit to make things easier for both parties. But they insisted this they couldn't do this so on five separate times of each month a different amount would need to be paid. But being paid weeks, working long hours and with other financial commitments it was difficult. One week with no warning I had missed a £20 by a day, with no warning I had an enforcement agent at my dads door, demanding 3 of the 5 accounts in full plus his £235 fee. I ended up working nights paying him £100 a week. I even payed him £175 while on holiday which was a birthday treat from my girlfriend. After this and paying over £700 in such a short space of time, I called the office number, on hold for over an hour sometimes purely just to ask for a single payment date and a statement of all the money I had paid. With no exaggeration there has been over 20 times I have been hung up on or spoken to either rudely, patronising and even aggressively I have been told they have no record of what I have paid. At the end of November I called and made a payment which apparently cleared of my 'accounts' as the last two payments were made on the 25 and 29 of the month I asked if anyone would be in the office to pay on those dates in December, the lady on the phone told me there wouldn't but it would be fine to pay the end of the first week in jan. Which with luck was actually my pay day and all was well... Until Jan 3rd 2018 when I received a call from the same enforcement agent I had paid hundreds of pounds in the summer saying he had visited the address demanding the full amount plus £235. I had no warning, only recently I have received texts on the 24th and 28th as a reminder, but no one at equita was working!!! And i had been told friday the 5th would be fine. Since they have continued to hang up, will not discuss anything as its not their problem its the enforcement agents. I even have a couple of phone calls recorded proving this. Yet I still have an agent demading now over £500! Any ideas where I go??? Sorry for such a long threat but I thought it would be better to get it all in that reply filling the gaps later Thanks Also, A point I have missed. On four or five occasions asking for the statement and reciepts which they promised to send. Every single time I have only received what seems to be a generic print out of that I owe them money, with no statement or payments!!
  6. Happy New Year to all and thank you for taking the time to read this. Myself and my husband have always struggled financially but always managed to keep our heads just above water but now we are in over our heads and not sure what to do. Without giving the whole story, due to no work, mental health issues and a huge amount of wrong decision making we have got ourselves into a mess that we dont know how to deal with. We have racked up loads of debt on credit cards, Loans and Payday loans just to try and survive and we are sinking. I know we have to deal with this and Bankruptcy could be an option but I am so scared of the implications and stigma. LTB

It would seem to be official - if not properly announced Buy an item or win an auction on ebay and the seller (and apparently buyer) can just 'cancel the order' up to 30 days after the win, and even after a buyer pays... So you win an auction * Seller doesn't like the final bid * Seller just cancels the order with some half baked 'reason' like item is lost or damaged * EBAY automatically send you a seller has cancelled with the only responses being an automatic refund if paid through paypal, or say the payer has refunded. There is mention buried in the t&C's that a seller gets a penalty mark if they do it too often, but customers cant see them. What I seem to have discovered so far working with a member of my family on this issue follows YOU SHOULD CONFIRM ALL THESE ISSUES YOURSELF AS I MAY BE MISTAKEN AND EBAY MAY WELL CHANGE THEM AT NO NOTICE - ITS YOUR RESPONSIBILITY So what seems to be the case is: You win an auction item - the seller (or buyer) can just 'cancel order' up to 30 days after the end of the auction, even if you've paid The seller does NOT HAVE TO CONTACT YOU OR GET YOUR AGREEMENT The EBAY system will automatically send you an email telling you the seller has cancelled your order - it gives you no real options to argue. NOTE: This seems to hide the fact that the seller may NOT GET THEIR FEES REFUNDED if you just dont respond to this Email. Effectively any response means you agree with the cancellation as far as I can see. Our decision is - not to respond to the Email Trying to get a complain option just sends you around the two liner Ebay help system. - at least if we dont accept the email (by not responding) the seller may still have to pay any fees, - accepting the cancellation seems to mean they get their fees back and may mean they dont get their due penalty flag. Ebay also remove all your usual places to leave negative feedback - BUT IT CAN STILL BE DONE and as soon as they cancel. Apparently buyers can do the same. I have no experience of that. Seems to make the auction site rather pointless as it holds no-one to the assumed agreements. I'm no legal expert but perhaps these practices breach trading standards?   8. Hi All, I'm looking for some advice regarding my debts because frankly I'm an idiot and don't know where else to turn. My situation is so: I have £10k or so left on an unsecured Natwest Loan which I originally took out back in 2015 but have rescheduled a few times, I'm pretty sure it's supposed to run for at least another 4 years at around £300 a month. I also have £1900 on a 0% credit card which doesn't run out till September 2019. I will however pay £300 or so off this next month. I also have phone and tablet contracts which run to about £960. I move to Canada at the end of August to start a doctorate, they are giving me enough scholarships to cover my fees and have about £10k afterwards. I'm intending to look for a part time job over there and can work up to 20 hours a week during term or any amount of hours during the summer. I originally was in a job where I earned £26k pre-tax so going from that to £10k even living as a student will make it impossible to cover my debts. I want to find some way of paying my debts off and definitely want to avoid bankruptcy, an IVA or anything of the like as if I wanted to stay in Canada the immigration authorities would, from what I understand, take a very dim view of it. I've spoken to a debt charity who have said they probably could help but are only willing to speak to me properly after I've finished my job on the 20th of July. I would like to try and sort something out before then so I can stop worrying and beating myself about my idiotic credit habits! It'll also the last thing I need when added to the stress of having somewhere to live in Canada etc...etc... Many thanks in advance for any advice anyone can give me
  9. Hi, I'm in a very complex situation and I am loosing my mind and health over this. I was wondering if anyone can assist me, greatly appreciated. Around this time last year I was asked to submit a medical form for WCA, which followed by a face-to-face assessment. My WCA for ESA scored zero points and I submitted my case to Tribunal for review. I believe I meet 4 descriptors for the Support Group. I am currently waiting for a hearing date. The medical WCA assessment outcome in 2016 recommended Work Related Activity for 12 months indicating that I could be ready for work (possibly downgraded to Job Seekers Allowance) after 12 months. As a result of Work Related Activity I ended up in A&E on 4 occasions with a severely excessive heart rate where I was kept in hospital and wired up to a drip. I complaint about this to CHDA who carried out my assessment, they responded stating that I could have gone to the A&E anyway and that it has nothing to do with their assessment, or something to that effect. I have bladder problems and I had to attend a Jobcentre that does not allow toilet use for customers. I have heart problems and I have to attend a service provider in a severely stuffy unaired environment (even the adviser complained about having to use an asthma breathing device there), and that made me very ill. I often feel that my endurance is being tested by physical and psychological torture and I can either make it less painful and quicker for myself by taking own life or prolong the pain but in the end get the same result as the DWP will drive me to an eventual death. While I am still waiting for the Tribunal outcome for ESA medical assessment 2016, I have now been asked to submit a form for medical assessment 2017. I returned the form not to lose my benefits. They sent me a letter for a face-to-face assessment. I believe during this assessment I will be downgraded to the Jobseekers as they will deem me totally fit (as per their recommendation that I will be fit in 12 months). CHDA picked on my doctor letters, ignored the evidence, and handled the formal complaint from me unfairly - that's how I feel. DWP ignored formal complaints from me, made intimidating calls to me, took 4 months to respond to my Mandatory Reconsideration - responded only after I got my MP involved, even then they lied to my MP writing to her that I was happy with the outcome and my MP closed the case. There is absolutely no way in hell this WCA will be a fair one or humane one. It's a conveyor belt to pass you from one torture room to the next, there is nothing more to it. My question to you is, do I have to attend another work capability assessment while I am still waiting for hearing date with the Tribunal? If so, what happens if I need to submit another claim to the tribunal? Will I be able to run two separate claims with the Tribunal on ESA benefits? Thank you in advance for helping me with this madness.
  10. Hi, I am in the process of trying to source a mortgage however the fact that I have historic defaults on my credit files from telecom companies is causing me problems. These are all with Lowell and range from 4 years to 5 years old. What's the best way of dealing with this to ultimately get the defaults removed off my credit file within the next 3 months due to wanting to take advantage of a "right to buy" offer we have. Obviously I am NOT saying that I don't want to pay these however if its best to go down the "final settlement" route as long as the default is removed etc than I am happy to look at that? Some of the defaults I genuinely don't have a clue what they are and would protest against them if time was not against me. any help would be gratefully received. Many Thanks Scott
  11. I seek advice on the following quandary that I find myself in: I am in a 2 year contract with a mobile internet service provider for just over a year now, another 10 months or so to go. The service that I am buying is mobile access to the internet via a dongle. The data allowance is 5GB per month and the charge is £15 per month. I have recently spotted a deal offered by another provider of 20GB per month for £15 per month. That's 4 times the data for the same price. It goes without saying and putting it mildly that I am a bit miffed about what I am being charged compared to what I could be getting for the same money. My question is: How do I go about terminating my current contract so as to enable me to take advantage of the better deal?
  12. Hi guys I have received a parking charge of 100 to be paid in 28 days or 60 if paid in 14 days. I received this just after midnight. I believe that this is unfair as I parked there only for a maximum of 15 minutes to drop my wife and 9months old daughter. It was late in the evening and it was dark. The area is known for drug dealings and drug addicts loitering. I didn't wanted to walk there during that late hours with my daughter and wife. I decided to park near by which is a private road just to drop my family and luggage as we were coming back from holiday. This is the only way to get to access to my flat as it is a new development. By the time I come back to move my car I got a ticket. Kindly advice me on the grounds I can appeal. Thanks Sri
  13. im baffled and shocked that this claim has just been struck out and can only imagine that the judge (case was heard without a hearing) that they were having a bad day or it was their first day doing the job. just now ive received a judgement of order thats stated my claim has been struck out pursuant to CPR 3.4(2)(a) in that it discloses no reasonable grounds for bringing the claim. in short my claim was becxuase the buyer of an item i was seller lied to ebay and paypal and stated the item was faulty. in short i proved it wasnt faulty and also proved that their defense was full of lies and gave evidence showing. not only did they lie to ebay/paypal but also in their defense. and somehow my claim has been struck out. since the order doesnt state how to get it going again and also doesnt explain what aside,vary or stayed means or what i form i need to fil in . im at a loss and ive been given only 7 days to apply. im guessing its the n244 form? but other than that i havent a clue how to get this case going again .
  14. Hi, I am an employee on a Zero Hours contract. I work with Mr. X and had to take him to court and won the judgement. The 14 days deadline has passed and he is yet to make payment. I have a question about how to approach the working environment with Mr X who I took to court and was awarded the judgement which hasn't been paid. The case took two years to go to court during which time I had to endure being harassed at work. Before the court case, I sought Mediation to avoid court action and complain about being harassed. The meeting was held by my line Manager at work who chaired an impartial meeting with Mr. X. Following this meeting Mr. X went to H.R. and then another meeting was held and I was advised / warned to only engage in work related discussions with him going forward. The entire Management Team support him (apart from my line Manager who's hands are tied). Therefore I cannot follow the standard grievance procedure in the staff handbook (i.e. speaking to Management first). We still work together and I haven't seen him since the court case but will do tomorrow. He is discussing the case with colleagues at work and stating the 14 days given to pay doesn't matter as long as he pays within 30 days, he can get the CCJ taken off his record as if it never happened. I am concerned that Mr. X may approach me at work regarding the case. Where do I stand legally? I have contacted ACAS and understand about my rights to work in a safe environment (mentally and physically). If he approaches me at work to discuss the case, would I be considered reasonable to advise him to send me a recorded delivery letter for any further discussions regarding payment arrangements? If I have to make the payment to go back to court to make him pay will the Judge see my behaviour as unreasonable and that I am supposed to talk to Mr. X on his terms? Any advice would be appreciated.

Apparently the tax rate paid was less than 1%, when Ireland has a corporate tax rate of 12.5%. I think it is about time the EU looked at these special tax deals that countries make with large international companies to ensure there is fair competion on tax rates. Why should big companies with sophisticated cross border operations end up paying less taxes than other companies, where they choose to site their head office for tax purposes. I suspect other businesses in Ireland would love to only pay about 1% tax. Apple and the Irish government are appealing against the EU decision. Nb. Re Brexit, if this happens, it is very unlikely EU single market tax rules will change or a UK government would choose not to apply the current EU rules that allows companies to transfer money around to minimise tax. The Tories support tax competition and support businessss taking decisions on transferring revenues cross borders to invest in other countries, while also helping minimise tax. This Tory government brought in new rules anyway to restrict how companies try to avoid tax by shifting profits outside the UK.
  16. In 2013 I had to give up work due to chronic ill health, I notified HMRC of my changed circumstances and my tax credits claim ended. Around six months later, I received a letter from HMRC stating I had been over paid by £3,500. I called them and after explaining my circumstances they agreed to suspend repayment, they didn't say for how long, just to expect further contact in future. I have since heard nothing from them. About a month ago, out of the blue I received a letter from a debt collector agency called LCS demanding repayment, I contacted HMRC and on asking why they had not contacted me directly, I was told it was normal practice to pass debt over to a DCA who would then pass it back to them on receiving proof of inability to pay and I could expect this to happen each year. After receiving a further two threatening letters from LCS, the last being a “notice of further action” I again contacted HMRC. This time they claimed to have contacted me a number of times and as I had failed to respond they had put recovery in the hands of LCS. They flatly refused to deal with me saying I must deal only with LCS. I have read posts on here advising never to contact a DCA. I'm confused and anxious as to what I can to do if HMRC refuse to deal with it. I'm very worried about this debt and its beginning to affect my already poor health. I hope someone can advise me on the best course of action.

Hi, I've only just joined so don't really have any right to dictate how this site should be run, but I can't imagine many children sign up to CAG about injustices of lost pocket money or the tax taken by school bullies at the gate, so I wonder why mild cuss words like **** or *** are blocked out. Who are the moderators scared of offending? I mean, if you're over 18 and you've been ripped off and looking for justice then saying **** or **** might be understandable. What's the CAG fear? Can any site team explain?
  18. Hi, just after a bit of advice here. I have been behind and over my limit for about 12 months but had been making regular payment all be it not enough for my account to be up to date. Today I recieved a letter. It said the following. Overdue amount: £..... IMPORTANT YOU SHOULD READ THIS CAREFULLY Notice of Default served under section 87(1) of the consumer credit act 1974 Youve broken your agreement ........ You must pay the amount overdue shown above. This payment must reach your account within 28 days of this letter. If youve already paid this or have made a payment agreement with - thank you. Please ignore this letter. Then it lists what they will do if I dont do the above ie shut account, chase debt. What I want to know is, I spoke to them monday and paid 70% of the above and agreed to pay the remainder of the arrears by friday. He did mention that a letter had been sent out but told me if I paid this it would be canceled. What I want to know is will they stick to there word?. Is this an actual default notice as I dont remember recieving a warning? Should I ring up and pay it today and argue that I didnt recieve the letter till friday or something because of the snow(foot deep here today). When he says canceled does that mean its already been put on my file and they will just change to satisfied or will it actually be removed or not even be added?. Will they have recordings of the call where he promised it would be removed on payment of the arrears and could I request that if need be?. Sorry to waffle, I know I have been a bit slack with payments but have my reasons and despite my current position, being 29 I could do without any nasty marks on my credit file and the letter seems a bit confusing, maybe deliberate to get me to pay I dont know?   19. Can anybody help I am looking for a Solicitors who can help me deal with the minefield of a Council Tax Liability Order in the South Yorkshire Region. I have had a letter (first time from this firm), stating that they are acting on behalf of the Local Authority regarding outstanding Council Tax Charges. I have been in constant contact with the council and this letter says I must not contact the Council but them. does anyone know of a solicitors firm in the South Yorkshire Region that can help with this.   21. o prior to my line going active on the 19th, I was given an offer for 6 months half price line rental to try and keep me proceeding with the order as Sky had offered me a good deal to stay with them. I was happy with this new offer so obviously told sky I wouldn't be sticking with them. It was at this point they threw out a great offer to which it was back to TalkTalk to tell them I wouldn't be proceeding. On the 13th January, on the live chat, an advisor named Reshan stated ; Reshan: The order is 6 months half price call plan, with line rental and your package. Reshan: Thank you for your patience. Ryan: you're very welcome. Ryan: Yeah, that's the offer I had a note off, that works out just below £65 more expensive than the sky offer. This is absolutely the most you can offer? Reshan: I can offer you 12 months half price on your package. Ryan: that would definitely beat sky so I would be more than happy with that Reshan! Reshan: Please give me a moment. It was at this point the advisors computer stopped working and the offer wouldn;t be applied right away. Notes were being made and it would be applied shortly. I've tried so hard trying to get this applied and advisors are saying what he is saying is 12 months off the broadband cost which is FREE for 18 months so essentially no difference to the package. From the context of the chat I was having, I assumed it was off line rental but TT are insistant that Line Rental is seperate and not part of the 'package'. I've also been on to the Chief Exective Office and they've been so helpful too......not! The person I spoke to said that what Reshan meant was he was extending the offer of FREE broadband from 12 months to 18 (Even although that's not what is said above) ; that's all the person from the CEO team emphasised - I then found my welcome letter which states FREE broadband for 18 months which was generated before any discounts were applied. I just feel that I have been totally misled into proceeding with the order. I have trailled back through all the chat logs and found this gem this morning which again totally contradicts the executive office's stance ; Joan: You're welcome, okay. Here's what I can do for you. Since the account is still not yet active I will need you to contact us right after the 6 months end to add another 6 months of the Half price line rental. Joan: Now if after 6 months it's not available we will just apply a credit for you equivalent to the offer. If I proceed down this route I can absolutely see what would happen 6 months down the line ..... it would not be honoured whatsoever and it would be more of a headache. Can anyone advise me of what I can do as nowhere is being helpful!

  23. Ryanair has signed a deal with Ombudsman Services that will see the organisation operate as the airline’s approved alternative dispute resolution (ADR) body. Approval to the scheme means that passengers of Ryanair who have disputes relating to issues such as denied boarding, lost baggage, delays or cancellations will be able to escalate their complaint to Ombudsman Services if a satisfactory resolution cannot be reached with the airline. The scheme operated by Ombudsman services will be free of charge to consumers. Up until now, you have to take your case to the Civil Aviation Authority (CAA). But the CAA don't have the same powers as ombudsman schemes, meaning they can't force airlines to pay out. Hi there, my husband and i will be making ourselvesf bankrupt, but i need to ask who will deal with the bankruptcy after we have filed for it (my debts total several hundred thousand pounds, repayment of directors loans for our previous LTD company, which we can never repay) We have have no assets, no savings, on benefits and live in a private rented house , on housing benefit. my husband is on ESA due to mental health problems. Will the official receiver oversee it or can the major creditor ,( who happens to be a nasty piece of work) apply to be the trustee? I keep reading if there are no assets, then the OR will act as the trustee himeslf.
