Hi all, I have recently moved to the Winterthur Way development in Basingstoke. I rent a property which includes a parking space. It wasn't until I moved into the flat that I was given a parking permit and told to use it when parking in my allocated space (This was something that was not mentioned in my tenancy agreement!). After moving in I received 2 x £60 parking charge notices for using visitors spaces (Returning within a 48 hour period) to drop off my furniture. I used the visitors space as I had to use a different car of a suitable size to drop the furniture off. Also my space isn't near my flat its further up the road. I kind of understood as I could have possibly been using a space that someone else could have been using, all be it for a very short period of time. After paying these two charges from PPM I thought it was over ! Two weeks later as a result of having to pay £120 to PPM straight after moving in I had to do overtime at a weekend so I was able to pay next months rent. The overtime meant staying away with work from the 8/07/2017 and returned on the 11/07/2017. When I returned on the evening of the 11th I have been met with 2x PCN from PPM on my windscreen whilst I was parked in my own space. Straight away as I approached the car I have seen my permit was not stuck to the top of my windscreen where it was before I left. Both PCN's are for 'Not displaying a valid permit' one for 09/07/2017 & 10/07/2017. I thought this surely wont be an issue I will just send them evidence of where the permit had fallen (A video from my phone was sent) also a picture of my valid permit. After all it is my space and unlike the visitors spaces I could not have inconvenienced anyone as it is 'MY SPACE'. They should just accept that and cancel the charges. To my surprise I have an email from PPM stating my appeal has been rejected ! PPM is now giving me the option to appeal to the IAS but from my understanding I don't stand a chance appealing to them either? I don't really have the cash to pay the 2 x £60 at a reduced rate. Let alone £200 if the appeal to the IAS fails. However I really do feel they can't do this. Any help is greatly appreciated. I understand I probably haven't included all the information you guys need to help but I am also not sure where to start. Hi all! I have received a parking charge - I had no idea I need to pay there, as it is a retail park and those are usually don't charge for parking - I am never shopping there again, that's for sure! We have been in the shop for about 35 min. And now they are asking for £54 or £90 if I don't pay by 14th October! PCN's received through the post [ANPR camera capture] 1 Date of the infringement 22/09/2018 2 Date on the NTK [this must have been received within 14 days from the 'offence' date] Date on the letter 01/10/2018 3 Date received - I don't know, hubby opened it and chucked the envelope out 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [y/n?] No 5 Is there any photographic evidence of the event? Yes, on entry and on exit of the car park 6 Have you appealed? {y/n?] post up your appeal] No Have you had a response? [Y/N?] post it up No 7 Who is the parking company? Smart Parking Ltd 8. Where exactly [carpark name and town] Havens Bank Retail Park, Exeter For either option, does it say which appeals body they operate under. I think it says to send appeal back to them, and if they reject, then POPLA is available - independent Adjudication service Any help is greatly appreciated -
Hi everyone my sister got a letter on the 6th of feb saying she owes £173 for a parking ticket that happened in October last year. It says a warrant has been put though from the courts but my sister hasn’t received any other letters about this. This is the first she’s heard of the parking ticket. With her being on benefits and not having the money to pay I was thinking of sending a n245 form but don’t no what court to send it too. Ill upload a copy of the letter. Any help really appreciate. I have been issued with a a PCN for parking at a local council NCP CAR PARK. I have been photographed leaving the parking site without paying for a valid parking ticket. I DO have a parking ticket for the time of parking but it does not display my vehicle reg number, I could not remember my reg number when I got the ticket,couldnt be bothered to walk all the way back to car, so just entered a series of 1111111 in order to obtain the ticket. I have appealed the charge but am expecting in to be rejected, because thats what they do. what will happen if I refuse to pay up. -
Hello, I'm in need of help and advice please............. On Monday 14th January 2019 I received a parking charge notice from PCN notice to keeper NTK St Mary's Road Retail Park Car Park, Sheffield S2 4AL- DFS sofas, Ammount charge -£100 within 28 days or £60 if paid before 24.1.19 contravention date: 27.12.18 contravention reason: parked for longer than the maximum period permitted - 120 mins!! Total duration stay: 199 minutes I visited DFS to look at sofas, I presumed this was owned by DFS not a private company!! NTK are lying because I left the car park- drove to Ikea Sheffield and Next outlet over at Meadowhall, at least a 20 minute drive over there. Looked the whole way round Ikea- and got stuck in traffic and then Next outlet, i then called at centretainment to pick family members up and then returned back to the car park to show my family a sofa I'd seen in DFS I have contacted my online banking and have evidence via online chat with them the time of transaction I made at Ikea and also have printed a statement with the date I made the transaction. I'm so upset about it- firstly I presumed the car park was owned by DFS and didn't see a sign. I haven't done anything about this charge notice yet- can someone please advise?? Do I appeal if so what should I reply with? Do I ignore it? Many thanks in advance -
got a pcn on my windscreen yesterday at asda newton abbot . Iwas working on site and didnt think i needed parking ticket . my van is a lease van and iam wondering whats my next move . i have seen a couple of other posts about the same site . they have had sucsess with letters .any ideas -
Dear Forum members, I would like to ask you if you could kindly help me draft the best POPLA appeal that I can in regards to the NTK I received from UKPC? Appeal sent as the Keeper of the Vehicle on the following grounds and asked for further information: 1. Equalities Act 2010 compliance (have sent them proof of disability for an occupant of the vehicle) 2. Parking Charge amount claim grounds 3. Asking them to give a breakdown of their actual loss. Is the charge a true reflection of damages? 4. Their status – the creditor? 5. Ownership of premises? 6. Contractual Authority (as required by BPA Ltd AOS CoP B.7) 7. Signage There was no admission on who was driving and that is stated in the appeal letter to UKPC clearly as well. UKPC Rejection of the Appeal: Their reasoning for rejection of my appeal was (verbatim): Disabled parking bays are reserved for Blue Badge holders only and that a valid disabled badge must be clearly displayed at all times. They have not addressed any other issues or points of appeal at all. I have also downloaded the photos they hold on file for my vehicle and they are all silly and also show how inadequate their signs are as they are absolutely unreadable. I have included in this document (further down on following pages) the following: • Copy of the photos UKPC has on their online system for the vehicle at the location • Copy of the photos I have taken subsequently visiting the site to check for signage • UKPC Notice to Keeper copy (personal info scribbled out) • My letter of appeal to UKPC as the owner of the vehicle (personal info scribbled out) • Copy of the UKPC Rejection of Appeal letter to me (personal info scribbled out) Could you please assist me with making the best possible POPLA appeal for this case? I had an appointment for dental treatment last week. I parked the car, with a blue badge and 'clock' correctly displayed, on the opposite side of the road. This is an area previously covered by double yellows and had, 12+ years ago, been a service bus stop. I am fully aware that no service buses have used this stop since the opening of a new Interchange down the road in 2006. It is a popular parking place for blue badge holders as it is a quiet stretch of road since the buses stopped running through there, other services with stands in the next street stopped using this area of town last year when a gap in the dual carriageway was plugged and traffic lights removed as part of other works taking place. But, the council have since marked out a 'Bus Stop' at one end of the parking area and claim this is for a community transport minibus for the disabled. These minibuses have run for some years now and my understanding was they went a different way, dropping off and picking up on the other side of the road to where I was parked. I contested the ticket. They've written to say no, I was parked in a bus stop and therefore have to pay. I disagree. I accept that they have marked out the 'Bus Stop' and put a thick solid yellow line against the kerb, which I didn't see when I parked between other vehicles already there as it was raining heavily. I have checked, this work has been done in the last year. I used Google street view to see how it was marked last year, just double yellows although the whole stretch had green tarmac. Before I appealed the ticket I checked with https://www.askthe.police.uk/content/Q388.htm and there is a single line which says under PLACES WHERE YOU CANNOT PARK, 'A bus stop during hours of operation;'. So as part of the 'informal appeal', as they term it, I had said "I have challenged (the council) to tell me the hours of operation for this stand". They have not supplied this information. I am not against the disabled persons bus service, being a blue badge holder myself, but I question the legality of the stand being there. It is not for service buses and therefore would not have 'hours of operation' in that respect, meaning I complied with the information I obtained from the Police website. The community transport service is pre-booked, so by definition not a 'public service' bus as we know them. The 'bus stop' is therefore not in use for service vehicles and I was parked there outside any known 'hours of operation'. But where do I get this sort of thing verified so I can make a formal request to the council for repayment of the PCN on the grounds I was parked legally ? I am paying it under protest as they double the amount if not paid within 14 days. -
Some advice please. My severely disabled daughter (uses an electric wheelchair) and her carer used a car park in Exeter in a Smart Parking car park, but the carer only entered the last 3 letters of the car reg. This is most probably because in our local council car parks you only need the last three letters. The letter states we did not purchase a ticket or it was insufficient time. I still have the ticket and photographic evidence that we paid and parked, so I appealed on their behalf. The appeal was on the grounds that we did not enter the full reg and they are upholding the PCN!! Today we received a letter from a debt recovery company DRP. Any advice as to how to proceed would be appreciated as I feel that this is really harsh. -
Hello everyone, Yesterday I received a Penalty charge note for a parking offence in Budapest in month of August 2016. It is about 6 month ago. The company which is representing the charge is called Euro Parking Collection Plc or epcplc.com I do remember visiting Budapest and staying for few days but I did always paid for my parking but unfortunately I do not have the parking pay and display proof after 6 months of time. They also send me a link for viewing pictures of my caddy parked in the street and had a penalty charge note placed under my wiper which I never found it. My question is if they are are any legal to present parking ticket 6 month old from a different state of Europe. The pictures they sent me does not show anywhere if I had parked there illegally. In one of the picture does show a parking pay and display ticked but up side down or printed side was turned by an accident. As I mentioned that I did went to Budapest but I paid parking where it was required and I also paid the motorway vignette. Shall I pay them, ignore them or file an appeal mentioning the pictures does not show if I was parked illegally. Please help as I really do not want to pay for something I believe is wrong. I have also noticed that the pictures are not on their website anymore. -
My son visits a local car park to pick up a manager of a local business adjacent to the car park, takes her to Bookers Cash & Carry and then brings her back to the same car park with the few items she has purchased for the business. The car park backs on to the rear entrance of her business and there is an HX Car Parking notice there which says it is OK to stay for up to 10 mins without a requirement to pay for a ticket. After one of these occasions he received a parking charge notice from HX accompanied by a photo of his car entering the car park on his first vist and another of his car leaving the car park on his second visit, total duration 79 minutes. He was only there for a few mins on the first visit and the same on the second which is within the rules stated. The charge was £120 or pay now for £60. We thought this was a simple ANPR technical error and wrote to HX stating this and advised them to re-examine their photos and find the two missing pictures of him leaving and returning which would be the solution to the issue - no response except for another letter stating that the charge had gone up to £125 (not the £120 stated?). We wrote again with the same explanation with no response except for a further letter from their solicitors (Gladstones) giving one last chance to pay the full charge. Upon research I find that HX, Gladstones and their arbitration service are all part of the same group and operating a cash generating machine. We ignored that letter and have now received a county court claim form inviting him to give a response before being taken to court. Any advice appreciated on how to proceed with this. Do I need to get him a solicitor and if so can I counter-claim for the expense? Is there any way of derailing this procedure before it reaches court? -

It alleges the driver overstayed the permitted 2hours by 11 mins I now live in England but as the alleged offence happened in Scotland am I correct that Scottish Law applies, so pursuing the keeper is illegal? -
Hi, Just after some advice regarding parking on my local road. A business operates on my road, it is generally a quiet road with about 15 terraced houses on each side. During opening hours of the business the customers literally use both sides of the road to park leaving very little space for residents who live on the road to park their cars. It has causes so much traffic on the road and stress to the residents. I have spoken with the council and they have said there is nothing they can do. Does anyone have any experience in dealing with this kind of issue?

I was visiting a friend in Blackpool and parked at the rear of their house as i have done many times before. He has two parking spaces included in his tenancy agreement and he gave me permission to park there. I recieved a ticket and a £60 charge for "parking without permission" Should i appeal or just ignore it? I used to know a bit about this stuff but i believe the law has changed??? will i need to pay it? -
Hi, It's been a while since I've been on these forums, I used to give advice but I don't know how much has changed in the last few years. My girlfriend today got a "Parking Charge Notice". "Reason(s) for issue: Restricted Area". She parked over yellow crosshatches (aka graffiti). She has a permit but there were no spaces. University website advises people to follow the instructions on the "Parking Charge Notice". "Amount due: GBP 60.00". (30.00 if within 14 days). I know she should do nothing and wait for the NTD comes through, which they have 28 days to send. How enforceable is this? Have they ever taken anyone to court? -
Hi, I would like some advice please and wanted to find out what my options are as I feel this parking charge is unfair and from other threads I feel these enforcers are petty criminals preying on the venerable! I’ve been parking at the leisure centre for a couple of years I buy a book of parking tickets that my partner and me use when visiting. On this occasion I was in a rush and filled in the correct registration, correct date, but rubbed out the 10pm, not the 10am as I had meant to. Obviously, the car park is closed at 10pm, its an obvious mistake, but they have issued a ticket for invalid permit. After reading your advice I waited until the NTK arrived, which it did on time. There is no code associated with the offence. They also said that they recently contacted me, which is untrue. The only thing I have had is a fine on the windscreen. I am hoping that someone can advise on the best cause of action from here? For a windscreen ticket (Notice To Driver) please answer the following questions.... 1 The date of infringement? 14th October 2018 2 Have you yet appealed to the parking company yet? No have you received a Notice To Keeper? (NTK) [must be received by you between 29-56 days] what date is on it. 16th November 2018 Did the NTK provide photographic evidence? Hello! I received a PCN Code 26 for parking straight onto a single yellow line. This is a quiet section of road in front of the Windmill Pub in Clapham Common. I've lived in the area for 6 years and park here every saturday morning, and always pull nose into the spots, as all the other cars do as well. I received a PCN code 26 "Vehicle parked more than 50 cms from the edge of the carriageway and not within a designated parking place." However as the pictures show, i literally could not have been closer to the yellow line. The parking as been done this way for years and years - and it feels odd that i received the ticket at 8:35am on a saturday morning, when the parking is only restricted Monday - Friday. I saw the parking attendant later on giving more unsuspecting car owners tickets for the same thing - i asked him why i have received one when i've been fine parking there for over six years. He said that it was because my wheel is more than 50cms away from the yellow line. I have searched the highway code but can't find anything that says this must be done. I did refute the ticket initially, however Lambeth council upheld the charge. Do i have any grounds for fighting this? Thank you in advance! -
I request your assistance for dealing with DRP (Dept recovery plus ltd) who are acting on behalf of Empark UK Ltd operating on ground of Mount Vernon Cancer centre. I had a letter on 12th April 2018 that my vehicle was issued with a penalty charge notice on 12th February 2018 for the reason of 'parked in marked ambulance bay'. I disputed the matter in writing that; 1. My vehicle was never parked in the bay 2. No where the location states 'Ambulance bay' rather at one point it says 'Authorised vehicles'. The parking area is used by Ambulances, private hire vehicles (who are contracted by hospital to pick up/drop off passengers) and also for people who pick up and drop off passengers. My mother is a cancer patient. On 12th she attended hospital to see the consultant, due to some internal issues she continued to wait for over 4 hours and her condition deteriorated, started vomiting i drove the car from the car park which is fair distance to the door of cancer centre (never parked in the bay), i then walked in, pushed her wheel chair to the car. Within this matter of minutes, the parking attendent issued a ticket and had gone to avoid confrontation. I went back to the reception and explained the matter, showed them the parking ticket i had paid. I left the parking notice with them and was assured that this matter will be taken care of. After few weeks I received letter demanding the payment. I wrote on 29 April 2018 back with all the details as above. I then had rejection on 22nd June 2018 and that i can write to POPLA. I must admit at that time, my mother wasn't well and I was struggling to look after her full time and also concentrating on my full time degree course that i did not spend time to attend to that matter. Now on 17th Dec, I received letter from DRP (Dept recovery plus ltd) demanding £145.00 by 26th December. I had a look to see if i can appeal but POPLA only accept appeals within 28 days which i missed.. what options do i have? anything i can do?? I have been in full time studies and out of work for over a year now.. can't really afford to pay.. -
Hi Between myself and my partner we've had 5 parking notices from a problem with a railway car park. In all cases we have paid a fee using the app but a couple of problems: 1. Due to poor internet connectivity and busy trains we were unable to pay whilst on the train - we got to work to try there but after distractions forgot to pay BUT paid on the day and before we returned to the car. However due to the way the app works it charged the off peak rate and wouldnt allow a backdated payment on that day - we even phoned but they said couldn't be done - but we made sure we paid. Every other day we use it (3-4 per week) we have a good history of paying the right amount 2. My partner paid a fee on the app but selected the wrong vehicle So a combination of user error - and poorly designed system we couldnt / didnt pay the correct fee - the difference is appx 70p My partner has appealed to her 2 because they were for the wrong car so her car didnt have a valid ticket - my car was at home - but they got their fee on the day On the ticket machine the fee is £4.00 on the day - we paid £3.70 on the app - both facing fines of £100 each - escalating to £170. I'll post all the details here shortly using the questions but what are my options? I've read up on Byelaw 14 - no real financial loss - and were prepared to go to court as the difference in what we paid and what was due is minimal. I also had another fine for my car on the same day as my partner. I have proof I paid (which I've now sent them) and my partner also paid (it's one of the tickets described above) because she used the default car on the app. So even though 2 x tickets I still got a fine and intend to use that in defence of the other fines that their system is flawed. If we had failed to pay I would have fewer issues but we did our best on a system designed to trap you Advice greatly appreciated

There was an article in todays paper that sums up what is wrong with charging for hospital parking. A private security guard has been jailed for stealing with others over £200k from the parking machines at Wythenshawe Hospital over a period f just under a year. To pick through whty this is a particularly rotten endictment of what is wrong lets start with his employment, he worked for a subcontractor security firm and he was stealing £30k a month in cash he was handling for the parking co/hospital. He was only caught because a student working part time there dobbed him in. Now that means the cashiers and accountants hadnt noticed a shortfall of £7.5 k a WEEK in their cash takings, the security staff were not supervised in any aspect of their cash handling and it took a volunteer to point all of this out. A hospital spokesmand said that the money could hve paid the slaries of 6 nurses blah blah.- NO IT COULDNT, that wouldnt be allowed so not only do the management of the hospital not know what they are doing they then tell lies to try and deflect their dreadful greed and incompetence into some sympathy for their plight. The obvious point is what was happening to all the money in the first place then if no-one noticed it had gone missing? Why charge for parking in the first place. At the time this was going on the Chief Exec of the hospital was in a court battle with his own trust over plans to cease certain functions and he was forced out of his job. Well, that says all you really need to know. Anyone suffering demands from the parking co there should just claim they paid cash to the the security people and the parking co can find the money in a box behind the telly of their employee. That will see them laughed out of court -
Hi, Appreciate any advice with the following please. Driving from Kent to Tyneside stopped at Leicester Forest East at 6pm had a coffee fell asleep and left at 9pm. It was dark so no recollection of any signage being displayed. I have now received the first letter asking for £100 but discounted to £60 if I pay within 14 days. I feel miffed as it was late and I was as tired and the car park was empty. What is the best couse of action? I fear that making an appeal to PE will just be rejected or should I just ignore the enevitable PE threatening letters which will follow. Regards Brassica -
Hello. I’ve today had a ‘PCN’ issued by NE parking Ltd in Blackpool town centre (Adelaide court, a car park behind some flats). Last night I went to a gig in town, I drove as I wasn’t planning on staying late but I ended up having a couple of drinks so had to leave my car overnight. My friend used to live in Adelaide court so I would always use his space should I be nipping into town, and have never had any problems before - until today when I’ve gone to pick my car up and been hit with a £60 charge. The reason for the charge is ‘parking without a valid permit/ticket’, and I know 100% permits were not issued to residents of Adelaide Court 6 months ago as my friend didn’t have one and never had to use one himself. Unless this has changed recently? However, the other cars parked there did not have permits on display either! I know a lot of people say to just ignore private parking charges, but can someone advise me what’s the best thing to do from now? Do I acknowledge? Pay up? Or just leave it? Thanks in advance! -

Yesterday I received a county court claim form from Gladstones Solicitors Limited on behalf of ES Parking Enforcement Limited and genuinely this is the first I have heard of this matter. It states they are claiming: Amount Claimed: £166.18 Court Fee: £25 Legal Representatives Costs: £50.00 Total Amount: £241.18 I don't know where this has arisen from and cant recall parking where they said I had "breached their terms of parking". The actual wording is: "The Driver of the Vehicle Registration XXX XXXX (the vehicle) Incurred the parking charge(s) on 09/05/2018 for breaching the terms of parking on the land at Seymour Grove Retail Park Manchester. The Defendant was driving the vehicle and/or is the keeper of the vehicle. AND THE CLAIMANT CLAIMS £160 for parking charge(s) / Damages and Indemnity Costs if applicable, together with interest of £6.18 pursuant to s69 of the County Courts Act 1984 at 8% pa, continuing to judgement at £0.04 per day." Firstly I am not the registered owner or keeper of this vehicle as the vehicle was my wife's company car and what evidence do they have that I was the driver. I am very stressed out about this as £241.18 is a lot of money to be burdened with just before Christmas and any help would be appreciated as to how I should deal with this. Feels like these cowboys can almost make charges up as they deem fit and then bully people into paying them what can only be deemed a lucrative sum. The claim form is dated the 10th December 2018 and was received on 14th December 2018.
