  1. Sent a debt collection agency the letter with regard to "a formal request pursuant to s.77/78 of the Consumer Credit Act 1974 etc". They have written back asking for my last three addresses to confirm who I am. Any suggestions what to do next. Thanks.
  2. Advice please - I parked in NCP Barnet on 27.12.18. No barriers and am not local, but local friend I was meeting assured me it was pay to park...….thought I'd take a photo of the location number, finally found a machine - weren't any notices, and then tried to pay at the machine. Was as number plate one and despite several attempts could only pay £1.50 ……..then received PCN to keeper last week. Anything I can do - I think I prob underpaid by £1, and I know its my fault, but £60 seems a bit steep! Where exactly [carpark name and town] Spires Barnet For either option, does it say which appeals body they operate under. It says complain to NCP There are two official bodies, the BPA and the IAS. If you are unsure, please check HERE- BPA If you have received any other correspondence, please mention it here I have not received any other information but the letter does say that if payment is recieved within 14 days then I could pay £60 instead of th £100 they intend to charge. The letter also says that if I want to appeal I must do so within 14 days.

(NTK) [must be received by you between 29-56 days] YES what date is on it 10/6/16 REC'D 13/6/16 Did the NTK provide photographic evidence? YES 3 Did the NTK mention Schedule 4 of the Protection of Freedoms Act 2012 (PoFA) [Y/N?] NO 4 If you appealed after receiving the NTK, did the parking company give you any information regarding the further appeals process? [it is well known that parking companies will reject any appeal whatever the circumstances] 5 Who is the parking company? EURO PARKING SERVICES 6. where exactly [Carpark name and town] did you park? HOME BARGAINS, BATHGATE, EH48 2RA The PCN asks me to pay up or to provide them with the name and address of the driver, otherwise they "have the right to recover" from me. I didn't reply, but I wasn't driving.

  5. Hi I’m after a bit of advice please , my wife had to visit an emergency doctors practice last week , she parked purchased a ticket but over stayed by 14 minutes, she has received a parking notice for £60 , is there any thing we can do ? Thank you
  6. Hi. I had a problem with a PCN from Indigo a few years ago and received excellent advice from here to "sit tight". Was successful. Thanks. However, we now have another similar case and someone told me that recent case law has changed things, so I wanted to check that sitting tight is still the right course of action. My wife parked at a Southern Railway station car park recently and used the automated phone response service to pay for a day's parking. Unfortunately, the regstration number used on the automated system was incorrect - one letter was accidently missed off. There was no windscreen ticket, so I assume control was by CCTV. We have now received a PCN from the PCN Admin Centre (29 days after the event) acting on behalf of Indigo requesting payment of £100. It's a "penalty notice by post notice to owner" quoting byelaw 14. In the time between the incident and receiving the notice she has parked there twice more, so I assume we will receive more notices in respect of these dates. So, should we just sit tight? Would it be better to write to Indigo explaining what the mistake was? They could check their records and see that they did receive payment each time. Also, I don't think the registration number used actually exists. Thanks for your help.

I have received a PCN for an alleged offence at the same location, https://www.consumeractiongroup.co.uk/forum/showthread.php?487668-G24-Parking-charge-while-shopping-B-amp-M-Stores-Falkirk&p=5170354#post5170354 dating the parking offence as 30th November. It alleges the driver overstayed the permitted 2hours by 11 mins I now live in England but as the alleged offence happened in Scotland am I correct that Scottish Law applies, so pursuing the keeper is illegal?
  8. Noting the branding on a cinemas car park, I parked to watch a film. Not noticing any clear notifications to pay, they clearly are there. Naturally this is a Br2ttaN3a managed carpark. I now have two letters. 1. Letter before action from the dubious BW 2. A final 16 day demand before court. I have done the following but have had no response. 1. Recorded delivery letter to parking management company, asking for evidence, print outs, and offence. 2. Recorded delivery letter to BW asking for data restriction. ( they replied saying not applicable ) 3. Letter to my MP 4. Letter to the cinema asking for them to make their signs to the car park clearly state you have to pay - and to step in and make contact. I enclose the two letters. I have sent a follow up email to the cinema stating I will write to the board and the local press - and that my complaint is under unfair contracts. Shall I post the letters here, obviously edited?
  9. Hello all. Regarding there being no £10 fee for SARs, I want to send HSBC a SAR (because I know that I had loans with them that had PPI but they've previously said that they don't have records that go back that far), other than there being no fee, is there any change to SARs, please?

Where exactly [carpark name and town] Abbeywood Retail park (MacDonalds section), Bristol For either option, does it say which appeals body they operate under?   11. Hi Between myself and my partner we've had 5 parking notices from a problem with a railway car park. In all cases we have paid a fee using the app but a couple of problems: 1. Due to poor internet connectivity and busy trains we were unable to pay whilst on the train - we got to work to try there but after distractions forgot to pay BUT paid on the day and before we returned to the car. However due to the way the app works it charged the off peak rate and wouldnt allow a backdated payment on that day - we even phoned but they said couldn't be done - but we made sure we paid. Every other day we use it (3-4 per week) we have a good history of paying the right amount 2. My partner paid a fee on the app but selected the wrong vehicle So a combination of user error - and poorly designed system we couldnt / didnt pay the correct fee - the difference is appx 70p My partner has appealed to her 2 because they were for the wrong car so her car didnt have a valid ticket - my car was at home - but they got their fee on the day On the ticket machine the fee is £4.00 on the day - we paid £3.70 on the app - both facing fines of £100 each - escalating to £170. I'll post all the details here shortly using the questions but what are my options? I've read up on Byelaw 14 - no real financial loss - and were prepared to go to court as the difference in what we paid and what was due is minimal. I also had another fine for my car on the same day as my partner. I have proof I paid (which I've now sent them) and my partner also paid (it's one of the tickets described above) because she used the default car on the app. So even though 2 x tickets I still got a fine and intend to use that in defence of the other fines that their system is flawed. If we had failed to pay I would have fewer issues but we did our best on a system designed to trap you Advice greatly appreciated

Good afternoon fellow forum users, apologies in advance as I've never posted before and want to give as much info as possible but there is a bit to tell and I don't want to bore you all to death so I'll try to be as brief and concise as possible. Yesterday I received 4 parking notices from a company claiming to be PCS and one penalty parking charge from the London Borough of Newham for a 52m - failing to comply with a prohibition on certain types of motor vehicle contravention. In total the bill is currently standing at almost £500 ( 4 counts of £60 from PCS and £130 from Newham). All these offenses are claimed to have taken place between the 1st and 5th Dec 2018. All of these documents claim to have visual evidence of 'the vehicle' and it's true that there are attached CCTV grabs of a car of the same make and model as mine and a matching number plate although I have never been to Newham, and not really sure where it is? So am assuming that these are cloned plates. Have already contacted the Police and they have given me a crime ref no and will also be contacting the DVLA as they advised so I'm pretty sure I can sort that issue out with Newham. However, the so called 'parking charges' issued by PCS parking collection services. PO box 271. Ashton Under Lyme OL6 0DL are more of an issue as having done some digging online and through this website I am now under the suspicion that these may not be legit as the company appears to have a somewhat suspect reputation in what I can find and I don't particularly relish more lovely envelopes dropping on the mat. the salient points in this matter are 1: of the four offences they claim, they can only provide me with pictures in two instances out of the four dates involved. And two of the claimed offences are for different dates but same PCN no and times, although same company ref no. 2: It is clear from these pictures that there might actually be two different cars involved with the same plate as mine as two of the sets of photos provided for two different dates appear to show one silver like mine and then one light green 3: The number plate displayed is marked different to mine in so much as it doesn't appear to be held on my screws at all and definitely doesn't have any other writing, such as a dealer name or post code etc or a visible crack down like mine has. 4: Having done all the necessary via the police, taking pictures, noting colour change etc It should be quite straight forward to lodge an appeal online but their website just will not let me and after two attempts I got suspicious and gave up. I do apparently have the option to download and submit a written form but I decided to go do some more digging before that and what I have found on PCS - albeit somewhat earlier dated by some time - doesn't show them up well and I;m now wondering what else I can do or investigate before I do commit to a postal appeal? I will Deal with the Newham issue directly, but have no intention of, admitting any liability, paying any monies or giving any more details than necessary to PCS, but Can anyone offer any advise or other information before I proceed any further? thanking you all in advance.
  13. Can anyone help. In 2016 we received a letter from Park With Ease to say we were being fined for failure to pay for parking at Ferry Meadows in Peterborough. After contacting them to inform them that their letter was outside the 14 day period and therefore not legal the matter was closed. 18 months on on and we are now receiving letters from Equita regarding the matter, telling us we owe an substantially increased amount and will be taken to court etc, drawing our attention to a 2015 case in the Supreme Court. I’ve tried calling but just end up on hold for ever and now my other half just wants to pay it because she’s worried about CCJs etc? Surely this can’t be right, can it? Can we argue it? We didn’t pay for parking on the day in question (a 40 minute stay during our lunch break) because neither their machine nor website recognised our number plate! Based on normal rates it was about £1 and we always pay to park if the machines allow us to!
  14. OFCOM have upheld a case against Channel 5 regarding the TV series Can't pay, we'll take it away. This case starts at page 41 of the OFCOM bulletin http://tinyurl.com/ycwlnaev In this case it would appear that although consent was given, OFCOM found that there was no 'Informed Consent' meaning that the complainant had not been given sufficient information to make a concious decision.
  15. Hi Looking for advice. Family members were visiting friends and paid and parked for 24 hours in a SIPs car park. placed the ticket on display several people could of been the driver of the said car, and then left before the 24 hour expiry. Today a a letter has been sent to the household house, from SIP stating the who ever was diving the car didn't pay or display a the ticket. NO notice was placed on the car on their return so this is the first that anybody was aware. infant the section on which they were parked its not even clear if SIPs have any right on this section. However there are signs on the entrance so a ticket was purchased. We are hopeful we still have the ticket in the vehicle but given its over 30+ days since the alleged "offence" took and this is the first notice of parking fine! Any advice on the next steps. As 2 of 4 potential drivers are students so £100 fine is a lot!
  16. This is the second case from the OFCOM bulletin and starts at page 78 http://tinyurl.com/ycwlnaev This case is (in my opinion) more serious than case 1 in that NO consent was obtained. Also it has disclosed that the Body Worn Cameras transmitted live audio/video to the film crew. The BWC were supplied by the production company so all copyright material belonged to Channel 5 rather than DCBL.

This time it's one that was stuck on his car I haven't seen any photos of the situation yet - I think they will be uploaded tomorrow at the earliest as he only received the PCN today. I was trying to upload the pdf but this website says that I have the incorrect file extension Is anyone able to help me understand what I've done wrong?   18. Hi guys, I'm new to this forum and I am not sure where to begin but I am a tad confused about a PCN I received on 18/11/18. I found myself at the Peel Centre in Stockport (first time I've ever been there) and there was an A4 sheet of paper over the parking meter that stated it was free parking on a Sunday. I thought to myself top banana and carried on with my shopping, after an hour or so I find this red notice from MyParkingCharge.co.uk plastered on the windscreen of the vehicle in question. I deduced that rather than walking away maybe I should have entered the reg of the vehicle but the signage didn't seem to stipulate that hence I thought nothing of it. Now, I'm assuming I'm going to get some letters in the post to declare who was driving. I have been looking for similar instances of cases such as mine to no avail so can someone please shed some light on this matter. Do I dispute the PCN? or Do I ignore any correspondence ? Any help would be golden. Ta
  19. Hi All, I hope someone will be able to help me, as we got ticket and I am refusing to pay it, as we did nothing wrong. Back in May, 5th of May 2018 we went to Willen Lake (this is somewhere where we go at least once per week, this time, for some STUPID reason, we have parked at Napier Willen Lake, North Car park, which is a new carpark and not our usual parking spot. we drove in, went to pay, but seen that at this particular car park we need to pay on our way out, as such. we went to park for just under 3 hours, came back, went to the ticket machine, entered our car registration, got the fee, paid with card, and machine just went blank after that, which didn’t bring any suspicion as the machine was working fine (so it appears), 2 weeks later we’ve received the £100 FCN, but if paid within 14 days then we “ONLY” need to pay £60. Well, needless to say, we refused this and have put in the appeal, stating the above and also adding that they can probably check their cameras at the machine, and see that we have paid (our opinion at the time). Our appeal was turned down. After that first letter we have received the second letter that says “Final reminder” on it and yesterday we have received the letter stating that our account has been passed to their legal team. I have attached the mentioned letters to this “cry for help/advice” thread. I hope I have hidden all private information, I did check it 5 times.  Many thanks for your help in advance. Napier.pdf

A recent report claims that the costs of alcohol use to the government in England – including the NHS, police, criminal justice and welfare costs – amount to just under £4 billion a year, while tax revenue from alcohol comes to over £10 billion. So for all the deaths, misery and ruined lives they still manage to make a 6 billion pound profit on this drug, no wonder its legal, now if the country wants to get back up on its feet here is an idea. Legalise a far safer and less anti social drug namely cannabis. Allow people to grow cannabis in their own homes so that can they sell any excess to the pharmaceutical industry, this will spawn a whole new cottage industry in itself which this country desperately needs. It will have multiple benefits, huge savings on the police bill, it will create thousands of jobs and generate a huge amount of money through taxation, it will also deal a massive blow to the criminal gangs who take advantage of the situation.

  22. Hi Please, can you help me? I got into terrible debt many years ago. Abbey tried to repossess my house after a court hearing, but I sold it in time for not much profit. I had loans and credit cards outstanding and I got a CCJ for one of my credit cards who charged me a lot of PPI. It is seven years down the line and my Experian credit score shows clear. What I want to know is, can I reclaim PPI on all my mortgages and loans and credit cards from over the years? I know my CCJ is still enforceable, but this card was the main offender. Thanks

If anyone could help I’d appreciate it, We went to Birmingham to collect a friend and driving down to the 30 minute free wait the car started to jerk and pull the engine management light came on. Which forced us to pull over as was not safe to continue. We clocked their sign saying no stopping to collect or drop off. We never did we in fact stopped for two minutes maximum. Enough time to switch the engine off an start it again. The engine management light stayed on but the car seemed a slight rough but wasnt pulling or jerking. We drove up an down for a while then entered the premium set down to collect as they had to wait around for us. We kept the ticket also took a picture clearly showing the enginee on with engine management light on and also a photo of their sign post. As we had not done any of what they said we couldn’t. A week later we received a parking charge notice to pay 50 within 14 days or 100 after. I myself appealed to APCOA never heard anything I got a demanded letter to say the 14 days had now gone and I needed to pay. I challenged them on the phone and was informed I had lost my appeal. But never got a letter I said to the man it was an emergency he said I’d have to appeal to POPLA I did an today I’ve lost. This was a genuine emergency an we literally stopped for 2 mins. To switch off an back on. Will we have to pay can anyone help???
  24. Please help, First time I received my salary and my outgoings monthly payments are bigger than amount received. I have unsecured loans and pay day loans and this Month I won’t be able to pay 3 of them, I read all the 10 steps but I am still panicking, I have more payments than my salary and I need at least 3 Month to back to "normal" when my paY day loans will be paid in full but this Month and next one I have to stop some payments. Please help and let me know how to go the creditors and what I can ask TO HELP ME, WHAT should I tell them? Can I ask to freeze 2 Month instalments or just offer pay a little? Many thanks

I'm doing this on behalf of my other half (she's not on here) and if you have to move feel free Now I don't know the exact history of the account but her brother had a credit card (at least I think it was) Lowell have constantly been on the phone to them telephone harrassment bla bla the usual drill their solicitors (the so called solicitors) sent a letter apparently saying they we're going to go for a CCJ (but not sure if that's just a theratogram) the few other problems the person getting harrassed by them does have special needs (which won't be curable obviously) my other half went to the bank today and did find out that the account was closed on lloyd's end May 2012 so the last payment was god knows when also she said (I not sure) she said she signed a waiver last week apparently adknowledging the debt (which at the moment stands at 2376.32) The family don't have a lot of money so they would not be able to offer lowell a great deal per month (the account was sold on to them and lloyd's not taking anything to do with it)
