  1. Wow so happy to have found you CAG. Fingers crossed I can beat this. I am devastated, treated myself and a friend to a theatre show tickets were about £7 each. We are both pretty skint and I have now had a charge for £60-£100 quid!!! Theatre Delicatessen (voluntary run theatre) had just moved to the address above when I went to see the show which was on the 24th October 2017. Yesterday 6th Dec 2017 I received a letter asking me to pay £100, or £60 if I pay within 14 days of the date of the letter 29/11/17. (Why have they taken so long to respond but yet I am pressured to pay so quickly just before Christmas and I have two small boys!) The building they have moved into is a retail outlet which used to be a Mothercare outlet. Next door to staples. The show was at 7:30pm. I checked to see if there were any pay and display machines but did not see and other signs (tempted to go back to check where they are) The letter shows registration recognition (but does not show the driver) points out that I stayed 152 minutes and the maximum time of free parking is an hour. I can understand why this is in place as I guess some people could take the mick and go into town but I was visiting a building that the carpark was for and the rest of the carpark was pretty empty except a few others which expect will also have received a charge. I have rang the theatre who sypathetically said that I'm not the only one and that there is nothing they can do about. She pointed out some other places I could park in future and that they have got signs inside the theatre. These were not there when we visited as as it had just opened my friend and I had a good look around. She said they are trying to sort something with the council which is a bit strange as the letter I have had says "Private land" and is from Vehicle control services who are accredited by the IPC. I think I probably ought to call back and ask about this. Could the council have employed VCS. Please can anyone advise me what to to for the best. Should I ignore? Appeal? Contact the company direct and explain the situation? I sense they would not show goodwill. Have I got a leg to stand on???   2. I have been issued with a a PCN for parking at a local council NCP CAR PARK. I have been photographed leaving the parking site without paying for a valid parking ticket. I DO have a parking ticket for the time of parking but it does not display my vehicle reg number, I could not remember my reg number when I got the ticket,couldnt be bothered to walk all the way back to car, so just entered a series of 1111111 in order to obtain the ticket. I have appealed the charge but am expecting in to be rejected, because thats what they do. what will happen if I refuse to pay up.
  3. Today I received a large pile of documents from Prestige Finance, with whom I have a second mortgage. I have identified 10 unlawful charges of £35 each. But this account was previously held by lenders GE Money. Either they went into administration and "became" Prestige Finance, or GE Money simply sold my account to Prestige Finance. I have identified seven unlawful "administration charges" of £40 each while the account was with GE Money, before I found my account being handled by Prestige Finance. So my question is in two parts. 1. Am I entitled to recover the £280 unlawfully charged to me by GE Money before Prestige Finance aquired the account (and if so, who do I get the money from? Prestige? Or GE, who may no longer exist?) I had always assumed that if a going concern such as a lender was aquired by another going concern then the buyer going concern would also be buying the seller's liabilities as well as its assets (in which case Prestige would be liable to refund me the money that GE had stolen from me). But I may be wrong in this case. 2. How do I get my money back from Prestige Finance? Do I just ask for it back or do I need to take them to court? Can I charge interest at the statutory 8% and how can I calculate that? Can I add on anything else such as the time it has cost me and also the stress? Thanks in advance.
  4. Here's a new one, probably.... I went to a show on Tuesday. We placed our belongings in a void near our feet. Unbeknown to us there was a mechanism in the void and it damaged our belongings. The void was covered by a black curtain. I would like to claim for the damage, but I'm unsure if either: a) I was negligent in putting my belongings there, or b) The production company were negligent in leaving the void accessible or not having signage. I kind of feel that with the close proximity to the stage it was negligent to have the mechanism easily accessible and/or no warning. I spoke to Front of House at the interval and they agreed they would put a sign up. The belongings were our shopping, so we have a receipt. Photos of the proximity to the stage and the void.   7. Hi, I had a previous bank account (but not old enough to be SB) with HSBC which was overdrawn by a large amount. Negotiations to sort things out with HSBC broke down and I've not heard anything from them for 3 years, and have since moved. I came home yesterday to a claim form (dated 29th August) from MKDP LLP who now appear to own the account. I presume they have traced me, but I have had no prior correspondence from them. The amount claimed is a lot higher than the overdraft was, so will doubtless include countless fees. The particulars of claim are 'The Claimant claims the sum of being monies due from the defendant(s) to under a bank account facility regulated by the Consumer Credit Act 1974 and assigned to the claimant on . The defendant(s) account number was . It was a term of the bank account that any debit balance would be repayable in full on demand. The defendant(s) has failed to make payment as required by the demand for payment sent by . The claimant claims the sum of and costs. The claimant has complied, as far as is necessary, with the pre-action conduct practice direction'. No other supporting documents are included, which I suspect is because there aren't any - the overdraft was originally agreed back in 2001 entirely over the phone and I never signed anything or was sent any specific terms before having it. I'm think defend is the way forward as I definitely do not owe the figure claimed, but I don't know what the actual figure should be so I can't really claim partial admission since I don't know how much to admit, which leaves full defence as the only option, and if they don't back down, a full & final settlement offer to try and avoid a CCJ being issued. I understand that section 77 requests are not relevant to an overdraft, but do I have any other rights under the CCA to demand supporting documentation for the claim and would I be able to use failure to supply this as a defence as you can with a failed section 77 request? Some advice on the best way to approach this would be appreciated!
  8. Hi there, Just a quick question which I hope someone may know the answer to. I have a few debts with debt collection agencies which I am paying monthly to. 2 of the debts are with one agency but only one of these shows on my credit file as the other 'dropped off'. My partner settled the account showing on the credit file in full using the agencies online payment facility. The question is will this account/debt show as paid in full on my credit file or will I have to settle both accounts with this agency first? kind regards Robert

  11. When I was travelling on the train this morning, I was using my laptop. I wasn't paying much attention to what was going on around me, when I noticed that the train was almost in the station. I quickly rushed to put my things away, when the ticket inspector decided to start doing his rounds. While I was in the middle of putting my stuff in my bag, he asked to see my ticket. I explained that I was about to get off the train. I continued to put my stuff away and as the train pulled into the station, I flashed my ticket before alighting. I barely made it off the train in time. As I left, he shouted out to me that I was on CCTV and he would be taking action against me as, even though I eventually showed him my ticket, I didn't show a valid ticket when asked. I don't think anything will come of this but, if it does. Is there anything they can do here? At the end of the day, the ticket inspector waited almost 20 minutes to start doing his rounds. Had he done them at the start of the journey, I would have been able to show him my ticket. Waiting until the train was about to pull into the station was inappropriate and I wasn't the only one in the carriage who was unable to show him a ticket due to his timing. Had I stopped putting my things away to show him my ticket when he originally asked, I would have missed my stop and had to travel to the next station to catch a train back. I would then have been travelling without a valid ticket.
  12. It was with some annoyance that I discovered that Cirque Du Soleil's head office is in Luxembourg. After having our show (Amaluna at Royal Albert Hall) ruined by double-booking of my seats at Valentine's Day (of all days - myself and my date were appalled) I have decided to go after them for a full refund of the £150 I paid under the Goods and Services Act 1982. We basically missed the first 15-20 minutes due to their bungling of our tickets and jilting us into inferior side seats. I emailed them at their 'customer services' email (info@ ....) and have not had a reply. Like as if that's an actual customer service email address. there is no other contact for customer services. Another sneaky way to get out of dealing with annoyed customers. Mainly it's the principle. They think they can go and create some dummy office in Luxembourg and try and sneak people out of their consumer rights here in the UK, well they can think again. I have never claimed refunds from businesses based outside the UK but I imagine the process is similar, send letter asking for refund...wait 3 weeks, send final warning (however on this occasion I have already emailed them so they don't get another warning)....apply for European Payment Order....send bailiffs into the London venue if they do not pay with possible shut down of show due to health and safety because the bailiff took the show props and show equipment to recover costs. Anyway, I have written them a letter as of today which will be posted to their Luxembourg address: 16 Avenue Pasteur L-2310 Luxembourg Grand Duchy of Luxembourg I will give them 3 weeks from today before making my application for a European Payment Order and then possibly get to send the bailiffs in to Royal Albert Hall. Does this sound reasonable?!
  13. Insurers could be forced to come clean to their customers on how much they paid the previous year, to make it easy for households to check if their premiums have been pushed up significantly. Up until now, insurers have not had to tell their customers how much they have been paying when it’s time to renew, so it is difficult to tell whether the new premium is competitive or not. A study today reveals that few customers can remember off the top of their heads what they had agreed to pay a year earlier and many just agree to roll over and pay for another year. The proposal by the City watchdog is designed to tackle concerns that loyal customers see their premiums rise if they stay with the same insurer, particularly for a long period of time.   14. My partner bought his bungalow end of 2013. Prior to the purchase a Private Search of Local Land Charges was made. We have concerns about the search because we received a letter recently from Hampshire County Council saying that they are install double yellow lines outside the front of the bungalow. This has been called a Traffic Order proposal. We objected to this immediately, the Council wont install a disabled parking bay outside the front of the bungalow claiming its too close to the junction, we disagree. They wont allow us to park the car in the garden again claiming its too close to the junction. Again we disagree. If we had known about this before purchasing we would have pulled out. We are a blue badge holder, and we feel the council is beyond uncooperative. We have contact the local mp to see if she can help but to also find out exactly when the traffic order was approved. We understand its been in the pipeline for years. Surely this should have been picked up on the searches? Can anyone please give any advice, we are distress by this as we wont have anywhere to park.
  15. just watched the one show ,with reference to the barry beavis case, it was very misleading watching someone screw up penalty charge tickets, and then explaining as to the demise of barry and the" private parking charge notice" supreme court case awaiting the result in September, which had totally no relevance to penalty charge notices given out by the police and local authorities.

  17. Hello, I entered a DMP 12 years ago which still has another 8 years to go. Most of the debts defaulted me over 6 years ago so the records have fallen off my credit reports although I am still paying them through my DMP. The remaining debts I am attempting to get removed. Due to family issues money is very tight at the moment and I am starting to begrudge paying my DMP as I feel that the DCA's have probably had more money off me than they paid for the debt. I also regret not going bankrupt or simply not paying as either way I wouldn't have these payments hanging over me now as the bankruptcy would have ended long ago or the debts become statute barred. I wanted to "do the right thing" but now I am wondering what would happen if I simply stopped paying my DMP now (after I have hopefully got the remaining defaults showing backdated and therefore removed from my record). Could the DCA's get a CCJ ? If they did would it show on my credit report given that the debts have already fell off ?
  18. Do you have to show write down savings on application for contribution based JSA( I know it doesn't affect getting it), but curious. Also, is oine of those letters similar to the housing benefit's green letter come through post? If you live in a shared house people you live with will then know. Also, how people know who is on benefits-e.g. how would you know if your neighbour was on them?

The BBC plan to screen a "Hunger Games" style game show will make unemployed people and low-paid workers compete in a series of challenges and tasks in competition for a cash prize. Only the UK’s lowest-paid workers and the unemployed will be invited to compete. At the end of each episode, those who have produced the least will be eliminated and by the end of the process, just one worker will remain. The winner will receive in the region of £15,000 which is estimated to be a year’s living wage, outside of London. This is the next rung down the ladder in the disturbing trend of voyeuristic "poverty porn" made popular in programmes like 'Benefits Street'. Unemployment and poverty are serious social issues and should not be the subject of a cheap game show format, designed to exploit some of the most impoverished in our society for the purposes of dubious "entertainment". Not even the cheapest and tackiest of the cable or satellite channels have stooped to this level.   20. Can anyone tell me what evidence to gather for this? This is not for me but for a member of my family. Having worked for four years the union is happy to take it forward but we would like to put as much information together as possible and I would like to be as helpful as I can.

Train companies are being forced to offer commuters the cheapest rail fares possible, following criticism that passengers can pay an excess of £100 when purchasing tickets at self-service machines instead of paying at a ticket counter. The changes, which are expected to be implemented by March, are aimed at ending the anomaly in prices available at the counter, where staff have access to a complex database of fares, discounts and promotions, and the more limited options in a self-service machines. Some machines have been found to promote expensive fares, bury cheaper options and do not apply discounts for groups or families, leading to a difference in train prices of up to £100, according to the Daily Telegraph.   22. I understand fully if this post is not allowed to remain, but hope it will be. It is not intended to be in any way inflammatory. However, I would like to offer a public show of support for Bailiff Advice (previously Tomtubby) who seems to have another site now hell bent on discrediting her excellent advice and reputation. This treatment is not only unfair, but is often highly inaccurate in what it states. It must be very distressing to be targeted in this fashion, so I just wanted to pledge my support for the superb work she does not only here, but in many, many places. Thank you.
  23. I recently found out after a SAR request to a DCA that at least Experian provide more information about credit applications than we can see on our reports ! There was info about Employment Status, Number of Dependants and Property Value - none of this is shown on the credit reports Anyone know how they get this info and why it isn't shown on a typical report ?
