  1. Hello all. Regarding there being no £10 fee for SARs, I want to send HSBC a SAR (because I know that I had loans with them that had PPI but they've previously said that they don't have records that go back that far), other than there being no fee, is there any change to SARs, please?

  3. Hello everyone Unfortunately, my husband has gone and got himself another PCN. This time it's one that was stuck on his car I haven't seen any photos of the situation yet - I think they will be uploaded tomorrow at the earliest as he only received the PCN today. I was trying to upload the pdf but this website says that I have the incorrect file extension Is anyone able to help me understand what I've done wrong? I tried following the instructions about uploading files. Thanks
  4. Hi all, my first post here so hoping I am in the right place Its a bit long winded but I will try to be concise as possible. I work in local authority in care centre. The same group has a number of similar centres throughout the County. We have recently been subject to management restructuring and additional responsibilities have been added to my role and other staff who do the same role as me in the other locations. We also have regular review meetings where we get together and share ideas to standardise our policies and operating procedures throughout all the centres, so we all work the same way. However, at these meetings I have discussed working hours with other staff doing this role, and find that whilst my contracted hours are 18, most of the others are on 25hrs/week. I raised this with management several months ago, both verbally and in writing, requesting that my contract be reviewed to align me with my peers. This was verbally acknowledge with a "we will look into this" but I have heard nothing more since. I have also recently discovered that when I was recruited, I was put on a higher pay grade than my peers, through employer error, which I had no idea. I suspect that they are holding off increasing my hours as they are already paying me more than everyone else for the same role, but that does not give me more time to complete my work so is not a valid reason. I am struggling to keep up with my daily tasks and finding it very stressful that I have to rush and make mistakes/forget things due to time limitations. I am looking for alternative employment as I feel I cannot continue doing this job successfully on the hours given, but feel I shouldn't have to go through this upheaval if they just agreed to increased hours. I also suspect that should I leave, my post will be re-advertised at correct pay and 25hr contract to sort this anomaly. What are my rights here? It is their mistake that I am higher paid for the same job, but that doesn't enable me to complete the work in less time, so feel I am being discriminated against. I feel its verging on constructive dismissal, but I know the terms needed to apply this are very specific. Any advice appreciated, thank you
  5. Myself and a friend entered into an AST in 2008 with a private landlord where I was the lead tenant. Our deposit was placed with the DPS. Although we had a good relationship with the landlord throughout the tenancy, when we gave notice to quit in 2011 he seemed to take the matter personally and started being very standoffish with us. On our moving out date, the landlord did not attend the property. When we called his phone to find out where he was, it rang with a foreign dial tone and the call was rejected, so he wasn't even in the country and decided to ignore us. We ended up posting the keys back through his letter box and were never properly checked out. Since the landlord had essentially absconded we did a stat dec and sent it off to the DPS to get our deposit back and assumed it would follow. A couple of days before we would have had it, the landlord opposed the stat dec and would not consent to ADR. This left it in limbo and our only remedy was to take court action. We mulled it over at the time and in the end made the stupid decision not to pursue him and put it down to experience. Eventually we got over the matter and I'd not given it any thought for several years. Until today when I moved into a new property which also used DPS and when I checked my account I found two tenancies were shown, and was amazed to find our old deposit from 2008 is still there, now with the status 'suspended pending review'. What is the legal position on this deposit now? Neither us nor the landlord can take civil action against each other as more than 6 years has gone by, but the money is still held with the DPS, and it is our money. Any chance of getting this back after all these years? And if not, what will eventually happen to it?
  6. Hi, Having aggravation with a second hand car purchase (in another thread). Feeling a bit of financial pressure. Need to get to Stansted Airport so I thought I'd give a One-way for a £1 rental a go. No luck here either it seems. Booked and paid for a £1 one-way rental from Europcar. Online booking was a bit slow but seemed to go ok. Got a confirmation back and all looked fine. 48hrs before I'm due to pick up I get 2 emails saying don't forget to prepare for your rental and please remember your driving licence etc. 3p.m. today, (19hrs before) scheduled pick-up I get a call from an unknown number to my mobile. It's from the pick-up location for the car and the woman says, 'we don't have a car for you tomorrow, so we're cancelling your booking". I explain that with less than 24hrs notice I'm not impressed and can she please give me a written explanation as to why this is? She refuses and says, "I've told you twice we don't have a car for you". So, I call Customer Services which wastes more time. They say 'It's nothing to do with them and you need to speak with "reservations". Another call and more waste, and yep you guessed it, they say, 'nothing to do with us, you need to speak to the branch.' They do say that the branch should be sorting it out and organising another vehicle, but I'm not sure the call agent has got a full understanding of the problem. So out of interest, I go back to the online reservation and find that there's a vehicle available under the same scheme, with the same destination drop off, for the same dates, but from another not too distant branch. Call Customer Services - No use at all. Can't do anything about it. Verbal acknowledgement that it's not good Customer Service, but they can't do anything. So, I book the vehicle from the alternate location via the web site even though it will be more time consuming for me. Then I go back to the reservation system and there it now shows a vehicle available from the original location for return to Stansted. Just like the one that was cancelled a couple of hours earlier. (I have copied all of this information) Oh. In case anyone else is trying to use this system. It comes up with a "How can we Help You - Web Chat/we'll phone you back" dialog. - This goes to Barcelona and a very nice call agent who is absolutely no use as they can't do anything with these bookings. Question then please: The rental agreement - I believe it's only binding after you have signed at pick-up? , but does a contract exits before this and are they in breach of contract? Certainly their T&C says a whole lot about what the bailee can and can't and how if you don't show for your rental they can charge you £85. Which rather suggests they would like to impose a 'fine' for a customer breaching a contract or have I got that all wrong? Have help greatly appreciated.
  7. hi all, I used halifax website to submit my ppi complaint. they correctly discovered my old loan and credit card 2004/6 and sent me a 7 page questionaire to complete and gave me six weeks to do so... I just had a text msg to say three weeks later they are still waiting questions: can they really give me timescales to complete their form? do i really need to complete their form... can i send them a completed fos form which requires much less information? shouldnt i send them one sar for full statement for each acciunt? any help would be gratefully received zubo
  8. I had my home repossessed in 2009 due to a change in circumstances. The mortgage was with HSBC who marked the debt as 'settled' on my credit file in 2011 although I owed them money. This was removed from my credit file at the start of last year since it had been 6 years since the settlement date. I am certain that I had PPI on this mortgage. If I try to reclaim this PPI will it awaken the debt? I have seen the rule of 6 years for standard credit card and loans but wondered what would apply to the mortgage?
  9. What exactly happens under Universal Credit if you work part time, are you still expected to attend fortnightly signing so if I were working lets say 24 hours per week under UC, would I still have to go to the JCP each fortnight to make a declaration ?

HELLO PLEASE HELP, I have a car insurance with XS direct, during summer mid-July I was involved in an accident. the other party claim against my insurance the cost to repair their car over £5000. it was a really minor incident. I don't understand the huge cost. Unfortunately, at the time I have taken my insurance I didn't really understand what excess was and meant. so I sign up for a car insurance with £3000 excess because the premium was cheap. BIG MISTAKE. NOW, my insurance is claiming that I pay them the £3000 excess to compensate for the repair. I drive a BMW X3 54' Plate currently worth over £1300. I dont understand why I should pay them that much money. Please help. I use my car on the daily basis as well AND THEIR THREATING TO CANCEL MY PREMIUM. PLEASE HELP
  11. Hi - my wife recently applied to a local hotel for work as a housekeeper/cleaner. She now works full-time for the agency that supplies cleaners to that hotel and lots of other hotels. They pay only minimum wage but even so, I thought her wages were a little low considering how many hours she is working. On checking her own record of hours worked against her payslips, i found that nothing tallies at all and after telling her to confront one of her bosses about it, she was told that although her payslip tells her she is paid by the hour, in fact she is paid by how many rooms she cleans. 2 rooms = 1 hour. However, each room can take her up to 45 minutes so I think that she is therefore being paid less than MW. The company is quite big, i think, and employs a large number of Moldovan/Romanians (my wife is Romanian) i am concerned that they are exploiting a large number of people. Now i am unsure about who to approach and of course, if I am right at all - as a large company, perhaps what they are doing is completely above board? Any help at all would be very much appreciated. John
  12. Hi I own a small company with 3 employees only been running since April this year I had booked a holiday and 4 days before I went away one of my employees left without warning. I had no choice but to contact my local agency to employ a temp worker to cover the period I was away 10 days in all . It was quite a straightforward process with just a couple of forms to fill in and sign one of which was thier terms of business . All done over the telephone with the forms being emailed back etc . I queried the hourly rate whilst on the telephone as it wasn't written anywhere (I have never used an agency before ) and the administrator put me through to another lady whom I assume was the manager she told me that the hourly rate was £12.80 for a min of 8 hours a day and then after that it was time and a half. The ten days would include 2 saturdays and a bank holiday . The agency asked me to pay up front as apparently they take a line of credit to ensure that each worker is paid but thier credit company wouldn't lend agaginst my company as it had been newly formed . I thought this was a bit strange and said no I'm not prepared to pay upfront but would pay for the first three days after they had been completed and then the remaining 7 days a couple of days after they had been completed which they agreed to . Due to the nature of the work I insisted that I must have the same person for the duration of the contract which again they agreed to. The agency worker turned up as arranged and I went on holiday.... after the first three days I received an invoice from the agency as promised but to my horror they had charged the whole of sat as time and a half. I queried this by email as I was away and corresponded with the lady who had told me about the hourly rate. When I asked why the whole of sat was charged as overtime her written reponse was sorry I didn't mention it but this practice is common knowledge within the industry everybody pays sat and bank holidays as overtime otherwise they wouldn't get people to work.so I replied that she knew I was a new customer she knew I was having the worker over the weekend and bank holiday so why not mention in the telephone call that sat and bank holidays are classed as overtime ?? To which she apologised again for not telling me but she thought I was not new . Thier terms of business says hourly rate etc to be agreed in writing I have nothing from them in writing stating what the hourly rate would be just the verbal confirmation during the telephone call backed up by her email apologising for not telling me about the changes on sat and bank holiday . I'm away on holiday and am panicking that if I kick up about the invoice that she will pull the worker and leave me in the right brown stuff. So against my better judgement I pay it but send an email complaining I'm not happy .To which I get no response So 4 days later I get a phone call from the agency saying the original worker is leaving today but he is going to be replaced by another worker who will be doing the rest of the week (3 days remaining )....as you can imagine I kick off big time especially after I'd gone to all the effort of insisting that I needed the same worker for the 10'days apparently the worker had been contacted by another employer that he Temps for and wanted to go and work for them apparently the agency can't stop him from doing this which again I was not told about especially as I had lengthy conversations with the agency about this . So I eventually agree to having the replacement guy and then when I speak with the new guy on the telephone in the evening he tells me that he can only do the last two days as he has commitments on the last day which apparently the agency knew about !! That is the final straw so I have cancelled the work for the last day as don't want to use the agency again as too much grief . I will be getting the invoice for the last period of work soon so would like to know if I can deduct the rate increase that I paid originally whilst I was away from the new invoice ,and go down the line I wasn't told it's not written down anywhere etc and can I do anything about having to cancel the last working day and being mucked around etc with different staff etc this company are a joke and I will never use them again Any thoughts greatly appreciated !!
  13. the other week I checked my bank and realised I hadn't got enough in to cover the insurance that was coming out the next day cancelled it with a view to ringing and paying and reinstating, forgot about it, went away for a few days came back to a letter ring us by this date etc and sort it I did all be it 3 days after the date on the letter. Yesterday I get in and have another letter from More than dated 4th July(10 days to deliver??) i.e. the date they wanted me to call them by. Enclosed a Default notice served under under s87(1) of the cca. It just says I need to call them by the 27th July to reinstate the direct debit to avoid action which is all sorted. The 1 and only thing I care about here is whether they can do anything to affect my credit file?, they have never added or updated it before so my gut instinct would be no. I presume in doing what they asked I have not defaulted it and the only thing they could do would be a ccj. Can anyone clarify? The default looks legit, whether its correct is another story but it certainly looks like something a creditor would send after 3-6 missed credit card payments. Would seem brutal if they were doing anything more than following due process for canceling the policy.

I used to send complaints to the OFT, Consumer Credit Fitness Department, now everywhere just seems to refer you to make a complaint to the Debt Collection Company themselves, then after months of waiting for a final response go to the Ombudsman. Can the Ombudsman fine them, revoke their license or order them to comply with something? If not, who can now the OFT isn't dealing with this? Who monitors if they are behaving lawfully and in accordance with their license terms etc.? I have found the Ombudsman to be a joke in the past and they usually just return everything to me and tell me to wait for the company who is ignoring me to reply. This is no help. Can local Trading Standards do anything? They usually fob you off and to go to the Ombudsman too. Maybe the local MP can do something but we don't have one now for 3 weeks. I am not seeking compensation. I want someone in Authority to be informed as to how the DCA are behaving and adding fees unlawfully to accounts and other dodgy practices.
  15. Received 2 NIPs from different police forces after being caught by speed cameras, one in one force area, the 2nd in another force area. Was continuing a journey on the same motorway in the middle of the night, temp roadworks - unmanned - speed not excessive but over the limit, but each one was within the speed thresholds. One force offered me a speed awareness course, but the other refused and instead issued me with the more severe *Conditional Offer Of Fixed Penalty*, i.e. £100 fine plus 3 points. I did the course, cost me £76. I contend that the other force should not have issued me with the conditional fixed penalty and that both offences were only seen as separate because - unknowingly to me - the 2 speed cameras were in different force areas, even although I was still on the same motorway. Seems excessive punishment and a technicality is being used in order to deny me another speed awareness course offer, i.e. that only one can be done every 3 years. I've checked all the guidelines and the force in question has apparently breached them. I now stand to get a court summons because I've refused to accept the *COOFP* and would claim that both offences should not be separate but ought to be seen as one only. Seems like they want two bites of the same cherry? A tricky one where it seems as if their guidelines can't cope with my circumstances, so instead of either treating them as a continuation of the first offence, or taking no action, they seem hell bent on prosecuting me. Any thoughts ??
  16. Good Evening today I have been the recipient of a nice little piece of paper requiring me to pay £50 to the council for a parking infringement. The PCN states it was contravention 30, parked for longer than permitted. However I was not parked in a limited waiting area, i was actually parked on DYL which should be an 01 offence however i also had my blue badge on display.... so the question is can i appeal this pcn on the basis that the ticket was incorrectly issued on the basis of the wrong contravention code. cheers lets ps was parked for longer than the 3 hours on the badge

So i'm having a bit of a dispute with our house insurance, long story short, my husband didn't close the shower screen properly and left the bathroom with shower running for a period of time, I walked into my kitchen to find it had all collected into a bubble and burst through a hole in the ceiling causing damage to the walls, floor and plaster. Insurance told us we could claim through our escape of water and had to give them two itemized insurance quotes. We massively struggled to get these quotes with several traders not turning up or wanting to charge a fee to produce them, we asked if the insurance company could send out someone to quote and fix - they said no, we asked for a list of their preferred suppliers and was told they didn't have one. Eventually they told us they would send a loss adjuster out with a view to offer a cash settlement. Whilst waiting for the loss adjuster we had another leak when using the shower and it became apparent that the bath was coming away from the wall when we were using it causing the seal to break and the water to escape down the side, this was confirmed when we got a plumber out through our boiler cover insurance. So we resealed the bath but again the bath would move so in order to prevent more damage whilst waiting for the loss adjuster we stopped using the shower and stuck to baths only. We're still having to do this months later. The loss adjuster came, had no details of our claim as his system had crashed, he spent 5 minutes in the kitchen looking at the hole went into the bathroom, didn't ask us to remove the bath panel or look under the bath. He took some photos and left. We were then offered a settlement of just over £600 out of which a £250 escape of water excess was to be deducted. None of the works included in his scheduled involved fixing the issue with the bath. So we queried it. They've taken our query as a complaint and issued us with a final response claiming the loss adjuster took photos of the toilet which he claims was the root of the leak and we were negligent in fixing it hence as it must have been leaking a lengthy period as evidence by rust on the pipes (our pipes are all plastic so zero rust and 100% never been a leak) so they are refusing to pay out for any bathroom works. We've subsequently had 3 different plumbers out to the house for quote all which have been in the region of around £1700 and all the works listed are the same, all state that no evidence of a leak to the toilet and that significant removal and refitting of the bathroom suite and wet-wall will be needed to remedy the bath issue and the joist which has been soaked along with the fixing of the ceiling and flooring. The insurance company won't entertain these quotes or letters of evidence nor will the entertain the photos i've taken myself of the damage in particular behind the toilet which clearly shows plastic pipes and no rust anywhere there or under the bath. They've refused to let us see the report written by the loss adjuster or the photos taken and refuse to comment on how he could accurately know the issue when he didn't even look under the bath. They wont enter into a dialogue with us and have told us as they issued their final response we have to take it to the ombudsman if im not happy. Does anyone have any experience of this or words of advice on how to approach it with the ombudsman? what more evidence should I need or be gathering in order to support my complaint? I'm quite sure the insurance company are taking the **** in their offer but i've never had to make an insurance claim before so i'm not sure if this is normal or if i'm expecting too much?
  18. I bought a Jacket from 'Trespass' of Glasgow online advertised for £24.99. When I received it it had a price tag on it of £19.99. I contacted Trespass who said they would investigate. I sent them a photo of jacket with price tag attached. I have had various emails stalling, asking for photo again etc. Do I have any legal rights here to claim the £5 difference?

  20. Hello helpful people. First off a huge thanks to all who have posted here, you have helped this long-time "lurker" to a successfully upheld claim with the Halifax for my credit card PPI. My card has had a largish balance on it for nearly all of its 15 years and my average PPI payment per month has been £28, with many payments £30-£35. My situation is thus. The SAR came back with ALL statements and payment details going right back to the issuing of the card in June 1999, so there should be no guessing or averaging on the part of the bank. I painstakingly input all the details into the spreadsheet posted on this forum (The running credit one titled "FosRunningPPI v102.xls") twice! and got the same settlement figure order of £26K both times. Halifax have now written to me upholding my complaint and made a final response offer of almost £16K. They are saying that I have 28 days in which to accept the offer, or to call them if I am unhappy with the decision. How accurate is that spreadsheet above in terms of how the account should be reconstructed? Could there be any other reason for such a discrepancy? I'd would like to contest the amount if it is wrong but don't want to end up like that guy who was offered £22,000 and ended up with £3,500!! Thanks for any help and advice. Much appreciated.
  21. I will keep this brief... New Peugeot C3 about 10 months old, rear bumper came loose and flew off of motorway, Morethan say I cant claim as there was no third party involved in the incident. Peugeot refuse to repair under warranty. Any thoughts highly appreciated. Thanks Scott
  22. Hi, on the 13th August I was referred to Ingeus by my JSA Advisor and told to expect a call off them. On the 15th August I had a severe epileptic seizure caused by stress and was given a sicknote for 12 weeks by my doctor. He thinks, due to me being severely depressed and prone to more seizures, that I should be on ESA. I closed my claim for JSA on the 17th and opened my claim for ESA on the same day. Later that day I had a letter from Ingeus telling me to attend on the 27th. There were no mentions of sanctions or anything like that, but it caused me to become very agitated. I called the number on the letter (their general enquiry number I think) and the man, without asking for any details, told me I still had to attend. Is this correct? My JSA claim is now closed and my ESA claim is being processed. I've never met nor spoken to Ingeus before, so do I still need to go? I'm very ill at the moment and this might make me worse I fear. Obviously in 13 weeks if they put me in WRAG, that's a different situation but right now I am very ill. Any info on this would be very very appreciated!

  24. Hi I work for a small business which has no HR department. It's a combination of the administration manager and the finance department who deal with any HR related matters. I'm leaving the company and have asked for a note of my remaining holiday entitlement. They are saying I have no remaining annual leave as I've taken it all. I haven't. I've only taken 5 days. They say I've taken 16 days (I wish). I can prove that I was in the office on the days they say I was on annual leave but it's a proving to be a battle. When I first handed in my notice I was told I had quite a bit of remaining leave. As soon as I say I want to use some of it, it disappears. Can they take away holiday entitlement? What are my rights as an employee if they refuse to correct their records? The holiday year starts on the 1st April, I'm leaving in October. This has happen before but with sick leave. I was reprimanded for taking too much sick leave after being off for 3 days with the flu. When I asked to see my sickness record they had me off for 8 days. Again I could prove I was in the office on the additional 5 days. They only corrected their records when I threaten to get the union involved. I don't want to do this again, I want to leave peacefully. It's a great company to work for, it's just a shame that the HR side is in a shambles. I'm the only person who carries out the type of work I do. It does create problems when I'm not in the office. Holiday requests are a chore and when I do finally get a holiday my line manager is constantly on the phone and e-mail asking me to do work. Booked holidays are cancelled at the very last minute. Same with sickness. Those 3 days I took off, they were constantly checking on me each day. Even when I was sat in the doctor's reception - every 10 minutes, "have you seen the doctor yet?"!! My theory is the additional sick leave was a ploy to ensure I didn't take anymore sick leave in the fear I would lose my job. Needless to say, this disappearing holiday entitlement does not come as a surprise. Thanks B
  25. i hope i have posted this in the right section. Paypal in January limited my account (for god knows what reason), and have been holding onto £900 ever since. They said it would be released after 180 days, however it still has not been released, are they legally allowed to do this? I have been conversing with them on facebook but they take forever to respond to messages, there seems to be no other way of getting hold of them! i have tried calling a couple of time to no avail. i just want to know what to do in the instance they tell me they will not release the funds. because its very strange that after this long period of time has passed they are STILL on hold.
