  2. Hi, this is my first post on this site and I would like to thank you all for help and guidance I have recieved. This is my history so far;- 9th October sent 2 x DPA letters to Barclays Bank 9th October sent 2 x DPA letters to Barclaycard (only got reply on one) 9th October sent 14 day letter to Barclays requesting £1180 refunded 14th October recieved letter from Barclaycard stating files on microfiche "not readily accessable" Asked for £3 per statement 17th Octboer recieved 2 x lots of statements from Barclays 24th October issued small claim against Barclays (£1180 increased to £1482.75) 24th October sent 14 day letter to Barclays for refund of £3535.00 I will keep you all posted, thank you.

  4. Hi, I have a question about last wills and testaments. I am a dual French/British citizen married to a British citizen and we have lived in the UK for almost 20 years. We own a house in the UK (as joint tenants). We want to write a will that will say to whom we want our respective share of the house to go to once we are both dead. We have no children and won't be having any. In my case, I want my share to go to my husband but I want to make sure that when he dies, if I'm already dead, my share goes to my siblings in France, who are French citizens, and not to my husband's family or new partner for example. Could someone please help me and let me know how I can make sure that his happens? Are there specific types of wills for UK people who want to leave their assets to someone in Europe? I have received very conflicting advice from some solicitors. Thank you very much in advance! Sonia G
  5. Hi, I have accumulated some relatively large charges from HSBC Business over the last few years, mainly for unauthorised overdrafts. Is it possible to have any of these refunded? I am in quite a bit of financial difficulty at the minute. I dont have any lending on this business account. I would also like to keep the account open, so dont want to do anything to harm that if possible. Thanks for reading! Jamie
  6. Hi guys I searched the forum but couldn't find any info on the situation I'm in. I was on JSA from October to mid November 2017. I got a part-time job which guaranteed me 12 hours a week. I started that on 14th November. They gave me a contract until 31st December. However, they cut that short as work had diminished. i left my job on 14th December. In the four weeks I worked there, I worked 24 hours in weeks 1 and 2, and 12 hours in weeks 3 and 4. After week 3 had finished, I called JSA to see if I could get extra benefit money as I had only worked 12 hours, and had been looking for a second job with more hour or a full-time job. I had an interview booked for 15th November. When I went to the interview, I explained that when I initially called them about low hours, I was not aware that my contract would be cut short, and explained that I had now left my job the previous day, and showed them proof of my termination letter due to diminished work. They came to a conclusion that I was entitled to £10.19 for week 4 and could not backdate as I had not shown enough reason for the delay of my claim, even though I explained them during the initial conversation that it was not possible for me to do so, as I could have been handed more hours towards the later end of week 3, since we did not have fixed hours of work. I decided there wasn't much point in arguing about not being paid £10.19 for week 3. I assumed I would start getting JSA from 15th December as I continued to look for work. I was asked to show my last payslip which I sent it. I got a call saying as I had earned £545 as shown on my payslip for the month of December, I would not be entitled to JSA until a month after I got paid. I got paid December 21st, therefore thy said I would not get any JSA support until after January 21st, as they expect me to use my earnings of £545 to get me through December 21st - January 21st. However, they expect me to keep signing on and continue to look for work, otherwise there would be sanctions. my question is, is this all correct? They're saying that after I was forced to leave my job on 14th December, I should use my earnings to cover a 1 month period, without getting any JSA support. They also expect me to continue looking for jobs and signing on. It all seems wrong as I'm seeking a job, and not getting job seekers allowance. In fact, I actually don't get my first JSA payment until 8th February as they pay 2 weeks after the month up to 21st January has finished. Any help would be useful.

I've been contacted all of a sudden after a 5yr gap of silence regarding a Barclayard they believe was mine, from my calculation it would be a few months off 6 yrs since this would be defaulted on. First letters were to say it had been transferred to Robinson Way and was quite nicey nicey, second was to say get in touch we could wipe off a quarter of what you owe, today's was we have looked at your account and believe we have enough to go for litigation and MAY pass this to Howard Cohen and co in 10 days and then it may go to court blahdy bla ~Is this a last gasp effort to get me to pay back or are they being serious about going for court ?

  10. Hi all, first post. Just got a little question about CCJ defense response times. I filed my defence today (Sunday) online. Today is the last day I have for filing the defence. I should not of left it till the last day but I was waiting for a response from the claimant which only came the previous day. I had 33 days from the day of service in total to file my defence. My defence will not be processed by the court until tomorrow which will be the 34th day after the day or service. So my question is does the defence have to be processed by the court within the time you have to file a defence (in my case 33 days after DOS) or is it that as long as you have uploaded it before the time runs out you are safe? No. Hello everyone, first time here but I have read a few threads on here and seen the great work you guys do. I`ve got this county court claim that came through (22/07/17) as stated above I have gone through the necessary steps as stated in previous cases, that is Acknoweledgement of service (26/07/17), CPR 18,(27/07/2017) and now I am preparing my defence. My question is to do with the reply for the CPR I got from Lowell Solicitors, I received, the cover letter, the notice that they bought my debt and the notice of assignment from orange( very dodgey). Will post attachment if needed. My first question is, in the cover letter they state that my last payment on 26/04/12 was for £60.72 but in actual fact I paid £120 on that day, as backed up by my online bank statement for that month, should I mention this in my defence and if I should how would I word this properly? Secondly because of the nature of the notice of assignment (no official logo, no traceble name, not very professional) is there a way to dispute the disingenuous nature of the letter. Your assistance will be greatly appreciated .Thanks Mike

In 2010, a warrant for repossession was suspended on my property under the condition that I pay of the arrears which I did earlier than expected. last year I was having a problem with my business and fell behind with payment. I informed my lender and we agree to that I should continue with paying the mortgage with a little extra on top. All of a sudden my lender changed their mind and were asking for a huge sum that I can't afford when I refused they have applied to the court to re-enforce the old warrant which is over 6 years old. I am in arrears of £5000 and the property is worth £400k I have 17 years left on an interest only mortgage. can anyone please advice.
  16. We had a credit card with a debt of around >10k when we moved to Canada. It was transferred to Apex and we asked for a CCA in 2013, they did not supply it so it was no longer enforceable and we stopped paying it. In 2016 it was transferred to a DCA and again we asked for a CCA, they did not supply so we carried on with not paying it. My questions are: a) How do I find the data of our last payment and acknowledgement of the debt. Do forums like this constitute acknowledgement. b) How do we go about requesting our Credit Reference from the UK as we have not lived there for over 10 years and is there any benefit if so what c) Is it worthwhile asking the original credit card company for their records to see if their were any PPI or spurious charges or should we let sleeping dogs lie.   18. Got a sudden issue with HMRC who have sent me a nastygram for what looks an error I have made on my 2015 self assessment return. I was made redundant and had a few jobs tying me over (as an employee) until I found a good new employment. To support my income I also did some catalogue selling for one of these door to door companies plus some selling on ebay. As this extra income needs to be taxed I did a self assessment. I entered all the details as requested online and submitted. My tax liability was adjusted through my next PAYE code and all seemed fine until a few days ago when I received a letter from HMRC stating that they were investigating my return as there was some income missing and they wanted me to call them by the 13.06 to help with their investigations. They are alleging a company gave them an additional income figure of £3110.- which was not showing on my return. They say the company told them tax of £160.- was paid against this to HMRC. They say I still owe an additional £500 off pound in tax plus they may fine me. I was totally perplexed as I had no idea what this was all about. The company named on the HMRC letter (let's call them M) was one of my previous employers in the period when I had a few employments after my redundancy. I left them end of May 2014. Before I started another employment (with company P) which only lasted 6 months or so before starting my current employment (with company L) Going back through my records I have a P60 for the tax year ending April 2014 from company M. Then I have a P45 from company P and all other records are from my current employer, L. I have now realized with shock that I do not have any P45 from company M covering the time from April to May 2014 in my records and that the amount in the letter from HMRC must be the wages for those two months April and May 2014. As I have no P45 in my folder for those two months I obviously omitted those eight weeks of employment from my return when I completed it in 2015. I tried to phone HMRC but they are closed by the time I get home from work. Although it would appear I made an error on my return, what I don't understand is, why HMRC calculates £3110.- of salary at a 20% rate of income tax. I have never paid 20% income tax as my income was never that high. (Always below 20 K pa) So why do I owe £500.- in tax on £3110.- of wages which have already gone through the PAYE system at the time. I am totally confused about their calculation.
  19. I just bought a 2007 Mazda MX5, 42000 on the clock and in good nick. After having it a few days - I called the guy as its pulling to the left on acceleration. Also - Diff noise is audible too. He picked it up - took it to Mazda for a health check and the report says: Front tyres are low changed battering in key fob slight corrosion to front discs and I was spot on about the Diff so when he's back from hols in 10 days time - he's gonna get the diff fixed and sorted. to be honest - I'd be expecting him to put 2 new tyres on it at £100 a piece for Bridgestone tyres (recommended) Does that sound unreasonable? L.

Hi everyone I found out this year that my father (who I'd never had contact with) had died over 2 years ago, and had left me £25,000 in his last will and testament (I have a copy of the will from public record). However, the executor is my brother (who I've also never met) who inherited the majority of the estate, and after some difficulty in getting a response out of him, he has responded saying that I was removed from the will as a beneficiary. The copy of the will that is on public record does have codicils on it, but they do not relate to the money I've been left. My brother has now stopped contact, and I'm unsure of what the next step is! The document is a high court document from the district probate registry at Oxford, but there is no contact details for anyone other than the executor (my brother). Any advice please on how to proceed?
  21. Hi! I have used the break clause in my tenancy contract to terminate it. It required a 2 month notice period, which I gave and was accepted by the landlord's agency. This means that my tenancy agreement ends by the 25th of August. Nevertheless, my rental period usually runs from the 8th of each month. I have assumed that, if the tenancy contract ends by the 25th I would only have to pay from the 8th to the 25th but the letting agent is asking for a full month rent... He says the overpaid money will be returned and that they do this to protect them from tenants not leaving at the end of tenancy. Is this legal? Do I have any obligation to pay over the end of contract period? Is there any protection for the overpaid money? What happens if I only pay for the period of 8 to 25 of August? Any help would be much appreciated! Thanks!

  23. I came from EU to London in November last year, 2015 and i was working as self employed for 1.5 months in that year. I was waiter through an agency working for minimal wage, now i am employed already but I am concerned about those several weeks that i worked as self employed last year, i haven't submitted any documents about the salaries i received and i don't know if i should and what documents i need to have, i don't have all of my pay slips either. Today I was in the agency that i worked for to ask these questions, and they told me not to worry about that, since I worked for a short period and for little money. I haven't received any letters from HMRC either so what do you suggest i should do ?

If you've been enjoying Tesco's Clubcard Boost events, where you can double the value of your points and the like - bad news - the last one is imminent, as the supermarket are scrapping the scheme. The last boost will be held from 16th May until 26th June, so don't dither. The idea is to make these schemes easier to understand, and to make Clubcard points simpler. Clubcard Boost events have given the opportunity to swap points online or in stores, in multiples of £5 for £10 vouchers which you can spend in specific departments. However, over on their website, they've said that these events will be axed after they'd heard customers requests to make the whole Clubcard system easier to digest. Tesco said that they recognise that the scheme 'needs to be simpler to understand and easier to use'. Instead of sporadic boosts, now, savings will be offered throughout the year.   25. Hello, I've been paying off Bailiffs monthly for unpaid council tax. I was late paying last month. I thought I'd paid off the last instalment this month and all was fine. That was until I got a call saying they'd been round again ~£350 charges for the late payment. This is obviously extremely frustrating, the council tax debt has been fully paid off, these charges are for nothing. I've phoned the agent and he's saying there's nothing he can do, he needs the money now and if he doesn't get it, he'll be round my mums house to remove her goods because the debt is registered there, he's saying he'll take what he wants because it'll be on her to prove that the stuff isn't mine. I don't have the money, he's saying he can't wait the 2/3 weeks til pay day and although it's a stupid reason, the reason I was late paying was because Chandlers got a new website and I couldn't find the payment line number, I was at work so couldn't spend too much time looking for it and didn't look again for a few days. Is there anything I can do here?? I've paid the debt off, how can they legitimately charge £350 for a late payment, it's insane!!
