  1. It appears a number of Gas & Electricity Companies will not offer the best tariff if you do not have a Smart Meter.....Blackmail FS
  2. we have always had pre-payment meters as they are easier to run being on a low income a year or so ago, could be longer, we had an eon smart meter put in for the electric, at the time we had the old style key that you had to take to a shop to top up, the key goes back into the meter and that tops it up so a smart meter was in, and we could "top up" online, pretty good. around two weeks ago the smart meter was just showing "000s" everywhere, for the time, and all readings over the last couple of months the eon website was really terrible to use too, payments were being made but not going to the meter etc we tried to make a top up last night, just got a circle while the page was loading, nothing happening, we checked the online bank and payment went through then this morning the electric went off after ages on the phone, they gave me a code to enter into the meter, this got us back on but smart meter display still showing no info my other half the account holder rang them this evening, we need a new smart meter, and how stupid is this........ we cant have one meter swapped for another they have to install an old type meter with key first and then come back another time to put another smart meter in SO MUCH FOR PROGRESS!! its a good exercise in time wasting though I think more than likely, we will stick with the key meter.
  3. My energy supplier is Eon Energy. They have been very aggressive to try to provide me a smart meter. They come and visit me and want to talk to me but they never make an appointment. They call me all the time. I am most upset that they also decided to get in touch with my psychiatrist. I have no idea how they even know the name of this person and the contact details. Needless to say that I am horrified. I have sent Eon Energy a SAR request but no reply at all. I have contacted them by sending them letters and complaining about their behaviour but no reply. I have chatted with them online and I got the transcripts. All Eon Energy wants to do is to talk to me. But I don't like talking. I feel that my privacy has been violated. I don't think Eon Energy needs to contact any medical professional and get my medical records so that they could provide me a smart meter. I don't think I even need a smart meter. How would I handle this matter? Information Commissioner's Office? Energy Ombudsman? Or something else?

The driver was in the ten pin bowling alley, which the car park is outside, with son for his birthday. Just wondering how I, the registered keeper, will go about handling this. 1 Date of the infringement - 10/2/19 2 Date on the NTK [this must have been received within 14 days from the 'offence' date] - 18/2/19 3 Date received - 20/2/19 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [Y/N?] post it up - N 7 Who is the parking company? - Smart Parking 8. Where exactly [carpark name and town] - Havens Bank Retail Park, Exeter Appeal: I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a formal complaint about your predatory conduct to your client landowner and to my MP. There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require ALL photos taken and an explanation of the allegation and your evidence, i.e.: - If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it. - If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner. If you fail to evidence the actual grace period that applies at this site or suggest that only one period applies, this will be disregarded as an attempt to mislead. In the absence of evidence, it will be reasonably taken to be a minimum of twenty minutes (ten on arrival and ten after parking time) in accordance with the official BPA article by Kelvin Reynolds about 'observation periods' on arrival being additional and separate to a 'grace period' at the end. - in all cases, you must include a close up actual photograph of the sign you contend was at the location on the material date. I have received a parking charge - I had no idea I need to pay there, as it is a retail park and those are usually don't charge for parking - I am never shopping there again, that's for sure! We have been in the shop for about 35 min. And now they are asking for £54 or £90 if I don't pay by 14th October! So I take care of Gas/Electricity switching for my grandmother, so her account is linked to my e-mail address as I submit meter readings online for her and such since she's basically a technophobe for anything more than a TV, and when I checked my e-mails this morning I had one from EDF saying "Thanks for booking an appointment to have Smart Meters installed" I hadn't made any such appointment online, and my grandmother had made no such appointment on the phone either, so EDF had simply taken it upon themselves to book a Smart Meter installation for her in 2 weeks time. Fortunately I was able to login to her account online and find the not very obvious link to cancel the appointment (When you go into the appointment, there's huge buttons for rescheduling it to another time, but the link to Cancel is somewhat hidden. It's basically in a sentence that said "Or if you'd like you can Cancel your booking" with the word cancel just being a Hyperlink), but it's certainly worrying that they're now just forcing appointments on people without even asking and, had I not been able to check my e-mails due to being on holiday or away with work then in 2 weeks time some stranger would have just turned up at my grandmothers door telling her he was there to change the meters. The main reasoning behind not having smart meters at the moment is simply due to the number of stories I've seen in the past year or two about poor installation jobs leading to gas leaks, boiler breakdowns, electricity surges damaging equipment, etc. Last thing we want to risk right now is for someone barely trained turning up, rushing a meter swap and leaving asap and then a woman in her late 80s being left with no heating in the current weather conditions. Just thought I'd post this as a word of warning for anyone else with EDF to keep a lookout for.
  7. Some advice please. My severely disabled daughter (uses an electric wheelchair) and her carer used a car park in Exeter in a Smart Parking car park, but the carer only entered the last 3 letters of the car reg. This is most probably because in our local council car parks you only need the last three letters. The letter states we did not purchase a ticket or it was insufficient time. I still have the ticket and photographic evidence that we paid and parked, so I appealed on their behalf. The appeal was on the grounds that we did not enter the full reg and they are upholding the PCN!! Today we received a letter from a debt recovery company DRP. Any advice as to how to proceed would be appreciated as I feel that this is really harsh.

Hello. today i received a letter from zenith collections saying they want me to pay £160.00 for an unauthrorised parking charge. the address this was sent to is my old address not where i am living now as me and my wife separated in June 2017. i think the other letters from smart parking have also gone there, which ive never seen or been aware of. they are asking me to pay the £160.00 by 17/12/2018 or theyll start court proceedings and ill have to pay solicitors fees court fees etc. i parked by a local health centre not knowing it was smart parking for the health centre as itss not inside actual car park reason i parked there was my blood sugar was low as i am diabetic and it was the nearest place i could stop to go get something sweet as i did not have anything with me in the car. i would like anyones advice on what is the best thing for me to do ? thank you for reading Geddy1961
  9. Father in Law received the PCN (speculative invoice) through the post. The date of the alleged offence was 22/09/18, date of PCN 01/10/18. Interesting scenario. In Laws are Blue Badge holders and have used the car park before with no issues. They remember seeing signs on the wall saying where disabled parking were and parked there. When the PCN came through they went back to check signage to find they have all been removed. Interesting article from their local paper about the car park. Article and redacted PCN attached.   10. After parking in the rooftop park of the Gateway Shopping Centre in Trowbridge (Boots, New Look and Next), my wife received a parking charge notice from Smart Parking. At the time she parked there, she went looking for a machine, and found one with a cover saying "not in use". She went further and found a second, identically covered. She assumed all the machines were out and without walking the full area of the car park trying to find another machine, went about has business in Next for about 30mins. The charge would have been 80p. I appealed the charge to SP on their website (as her). They unsurprisingly rejected it. Two points here: 1) in the appeal text submitted online, I referenced Ref Prendi - v- Camden - Case 2100346960 "...the Enforcement Authority cannot expect motorists to tramp [around] trying to find a machine in working order". 2) In their reply letter, they say that all 4 of the original *council* machines were covered, and that there were another 4 SP machines, *of which only two were working*. Let me repeat: Of 8 machines total, 4 were covered and marked "not in use", and 2 of the remaining 4 were not working. My wife then appealed to POPLA who have rejected her appeal: Summary from POPLA: Given that the majority of the machines at the site were not working or were covered the appellant deems it reasonable of her to have assumed the paring[sic] charges were on[sic] in place on the date of contravention. The appellant states that as there were no signs pointing out where or how to pay she deems the parking charge to have been issued unfairly. The relevant sections of the response (they also state the signage meets requirements - which we must accept): Even if a motorist presents extenuating circumstances setting out reasons why they did not keep to the parking conditions, POPLA cannot allow an appeal if a contract was formed and the motorist did not keep to the parking conditions. While I appreciate the appellant’s comments and have no reason to doubt her version of events the terms and conditions of the site, require payment to be made when parking. On review of the signage in place at the site I am satisfied that the operator does clearly offer a cashless payment option for motorists at this site. Fundamentally, it is the motorist’s responsibility to check for any terms and conditions, and either adhere to them or choose to leave. The appellant chose to stay, therefore accepted the terms and the parking charge that the operator subsequently issued She's very annoyed about this because fundamentally, she wasn't trying to get away without spending 80p! Her "fault" appears to be not noticing and pursuing the cashless payment option (she didn't see any signs offering this, but does accept she may have missed them). Should we pay up or push on?! I presume the next step pushing on would be writing to SP telling them we intend to challenge?

Hi all had a charge from smart parking for insufficient fee , i showed my ticket via email , they then said incorrect reg mark , i entered the numbers not full reg, now they sent debt recovery plus letters saying if it don't get paid they will issue court proceedings. Im currently trying to remortgage and don't want any ccj on my file which my hamper my chances , is this their scare tactics or are they genuine , this happened on fantasy island car park in skegness back in may this year thanks for reading
  13. Hi everyone Having recently returned from a lovely holiday in Devon. I have received a parking notice charge from those lovely people at Smart Parking! After pulling into the car park at Haven Banks in Exeter I was handed a paid parking ticket by another motorist which still had one and a half hours left on it which i gladly accepted (What a mistake) Unbeknownst to me not being a native of Exeter the car park is covered by APNR cameras showing entrance and exit times of the vehicle. I was parked there for 1 hour and 5 mins according to this. Having been handed the ticket by what i thought was another considerate fellow motorist we went into the Range outlet store not reading any car park signs thinking the vehicle had a valid ticket. It was not until we returned to the vehicle after an hour that I noticed you have to put the vehicle reg into the ticket machine when you purchase it!! Now it seem's to me although not 100% sure that the cameras are linked to the ticket machines which must have registered a non-payment!! Therefore I think Smart Parking have got me by the short and curlies on this one and will have to pay the £58 charge. What are your thoughts people? Thanks in advance Gunner10
  14. Hi there, I'm new to this site. I received a parking charge notice of £90 for parking there on the 27th April 2018. I only received it today, and it says I need to pay this by 28th May 2018. I'm not sure what to do about this as I think its quite excessive, and from what I have read elsewhere, they are not the council so can not "fine" me. However, I would like some advice from here as to what I should do about something like this? the penalty is under my mum's name, but it was me who had taken the car to Exeter.   15. Appealed online against a Smart Parking PCN - I emailed asking them to confirm they'd received the appeal. They responded. I emailed again to inform them I was travelling so could they email me the outcome. A month later I emailed them again enquiring about the outcome. They confirmed it was still in the process of being reviewed. Heard nothing. Then I was contacted by the debt collection agency 2.5 months later requesting £160. I contacted SmartParking. They claim they emailed me the outcome a day after my last email enquiry to them. I told them no email was received. They essentially said tough. You owe us £160. They refused to give a new POPLA code saying the one they issued when the appeal was rejected had now expired. I even offered to pay the original charge but they refused that too. Is there anything I can do ?
  16. Hi Every one, Please help/Advise. I was photographed entering the haven banks car park on the 22/dec/2017 at 11.42am. Paid £1.00 for 2hrs /120mins parking at 11.46. Was then photographed leaving at 14.03pm on the same day. Unfortunately I entered the last two digit's of my registration wrong ****LKX when it should of been ****LXK. So received a parking charge letter on the 01/01/2018 stating that I needed to pay £54.00within 14 days ,if I was to appeal and fail this would go up to £90.00. I of course contacted Smart Parking and forwarded on the parking ticket which I paid for hoping they would see scene and cancel the charge.(Ya Right!). There letter arrived on the 27/01/2018 ,stating that as the motorist and that there are signs clearly stating not to make mistakes it was my fault. Also I was over my paid 120mins by 20mins.(I understand that this is the 5mins entering the car park parking and paying for ticket and the 15mins leaving). I again appealed To POPLA, stating that I was in my car within my paid time ,but due to the excessive amount of vehicle's entering/leaving this car park over the xmas period ,I was unable leave hence the 10 to 15min wait ,but didn't realise I was over my time when I eventually drove out. But on the 5/3/2017 while POPLA agreed the wrong reg details should cause the fine my overstay still did. So the charge is £90.00 Sorry that there's so much to read , I have all letters and the £1.00 parking ticket so can forward them on . haven't paid the charge yet ,hoping there's some one that will advise me.   18. Hi there, My pregnant wife and I parked in the Haven Banks car park in Exeter on a Sunday afternoon and paid the parking charge for 2 hours. We have subsequently received a Parking Charge Notice showing images that say we left the car park 2 hours and 15 minutes after entering and so we are required to pay up to £90 (£54 with early pay discount). I am new to all this but see from the forum that this is not the first time their charges have been brought into question. My wife is over 6 months pregnant and so is obviously slower at moving than normal and also takes time to get organised and comfortable in the car and so a fine of up to £90 for 15 minutes in a fairly quiet car park is excessive. Furthermore, the signs are not very clear so we almost missed them when we first arrived. I have not yet responded in any way to the letter as I have just received it in the post, but would be grateful for suggestions as to how best to approach this situation. Many thanks in advance.

My disabled wife parked in a disabled bay displaying her blue badge She received a PCN from Smart Parking Place - Havens Bank retail park Parked on 05/05/18 received the PCN (dated 04/06/18) today June 6th 2018 Photo entering site underneath typed time 11:25:19 Photo exiting site 13:52:06 PCN states smart pay manage but does not state anywhere who the owner is but they have the right to seek payment It states my wife breached terms and conditions - which they have not supplied It states by either not purchasing the appropriate parking time or by remaining at the car park longer than permitted , IAWT&C set out in the signage the parking charge is now payable to smart parking lots (the creditor) Now I believe this is illegal and I am not going to respond nor identify my wife On the back it states Data protection This is subject to the DPA - I thought it is now supposed to be GDPR as the law changed last month They say they have applied to DVLA for the details of the registers keeper Appeal managed by POPLA Daft Parking R.pdf
  20. Hi all, we were Future Energy customers, before they folded last year. Shortly before the collapse, they fitted our home with smart meters. Now I was never happy with the gas meter and how it didn't fit in the existing box, resulting in the lid being left unlocked and open (see photos). Now we have been moved over to a new supplier (Green Star Energy), I am wondering whether they are liable for rectifying the problem? If not, who is? Thanks,
  21. I received a PCN for spending 21 minutes in a car park in a town I don't know well. I had pulled into the car park to answer a phone call on my mobile - I was in my daughters car so didn't have hands free. As I was then pulled over I rang home to check on the kids, and then rang my husband to see where he was _ I was suppose to be picking him up from town. He didn't know where he was so said he would find a road sign and ring me back. I drove round the car park a few times - tried to get my bearings - find the exit, work out what road I was on. He finally rang me back, gave me instructions about where he was, I explained where I was - we arranged where I would pick him up - 21 mins in total as it turned out. As I didn't actually park up ( what is the definition of parking?). I didn't buy a ticket, and also only meant to pull in whilst taking/making a calls which was the safe thing to do. Didn't think to buy a ticket ...stupid I know. Now I have a PCN. I wrote back , enclosed a cheque for a pound to cover parking. Fine was £90!!!!! Didn't lodge an appeal with POPLA. Now gone to a debt recovery and have 28 days to reply. Do I let this run-on to county court?? Do I put a late appeal in? Help. I was ignoring it and judging by the other posts it was better to try and resolve it again. What do you think please?
  22. Hi I'm hoping that you can help me... A few days ago, I received a PCN from Smart Parking as the registered keeper of our vehicle, relating to an "unauthorised parking" of our vehicle on 24/01/2018. There are photos of the car entering the car park and leaving the car park. It seems to be fairly standard to come on here and ask about not paying the fine etc. but I have a slightly different enquiry - we actually have the ticket from Havens Bank car park on that day which shows that my husband paid to park in the car park. The ironic thing is that it's known to be notorious for this and I'd only said it to my husband the previous day, "keep that ticket just in case they send a funny letter!" Do I just appeal it online, sending photographic evidence of the ticket and then it will be sorted? Or is there a better way to sort this? You've all given such helpful advice to others regarding their issues at this car park, I'm hoping that you can help me! Thank you! Sam
  23. Hi On 27/1/18 I parked in this car park operated by Smart Parking. The closest machine was out of order so I walked across the car park to obtain a ticket, which I am sure more than covered the period that I was parked - BUT, I no longer have the ticket. I received the attached notification on 2/2/18. I have no intention of paying this but I'd be grateful if you could advise of next steps. Should I raise an appeal or leave to run its course ? If you are unsure, please check here Yes – I can go to IAS if they reject my appeal Further info: I was in a courtesy car from a garage whilst mine was in for repairs. It was outside a bowling alley in Exeter. I attended with my son and his friend at a Scout bowling evening. The bowling alley refund parking costs so why would I not pay? I cannot show the ticket I bought as it was so long ago! The courtesy car went back to the garage on 1 Dec 2017. I would have cleared it out and thrown all rubbish inc parking tickets away. The notice doesn’t state what I did wrong?? It says I may have not purchased a ticket or stayed longer than the permitted time… . How can they not tell me?? Any help appealing this gratefully received!
