  1. I have a Capital One account which has for some time been with Robinson Way, in November 2008 I sent Robinson Way a CCA request today I have received this. It looks very similar to other Capital One agreements I have seen posted I assume they are claiming that the two pages are front and back of the same document, however, I have some questions If the lines on the first document are folds and not evidence of a cut and paste why do the not show on the second page? The first page shows two barcodes top right and bottom left, they have completely different code numbers does this indicate a cut and paste? If I thought this was sufficient evidence to make a complaint of fraud I would love to do so, but before I make a fool of myself does anyone have any advice? Would it be normal for a single document to have two entirely different barcodes? In the unlikely event that they are front and back of the same document is this enforceable? Any advice would be much appreciated.
  2. Don't know if we are allowed to mention names here, but here goes anyway. Interested to know if a letting agent can legally switch energy suppliers on a house up for rent without notifying or seeking authorisation from the Landlord/owner? Discovered that Countrywide 'sold' the contract to E.on, (who incidentally have a whole department dedicated to that company). Countrywide get a fee (although E.on would not say how much this was) and E.on get a new customer (we know how apathetic most people are on changing their suppliers) on any tariff they choose to set. E.on said they took the contract on in good faith (ie. that is on the understanding that the Landlord had agreed). Clearly no checks and balances on E.on's part, but then scruples are always thin on the ground when money is one the table.
  3. Hi all. A very good friend of mine has had to resign from his job at the local council department (planning) due to the extreme stress he was put under. He raised this isuue many times with the department running up to his resignation but they did not offer any help at all. My question is if he were to send them an SAR, would this cover internal memos/emails about him? If so, please can someone help tailor one to cover this as I only have a standard SAR letter for bank charges era from years ago. Thank you in advance for any help offered, Buel10
  4. Theoldrouge…. Ever so slightly concerned you quote. If the lender or owner has been in regular contact with the customer during the limitation period, the firm may continue to attempt to recover the debt. Clearly they have contacted me on many occasions I just have never made any payment or formally acknowledged the debt?
  5. Almost on a daily basis I receive an enquiry on this subject from either a debtor, solicitor or a police officer. Hopefully this thread will assist. Under the new bailiff regulations an enforcement agent has a general right without a warrant to enter debtor’s premises to search for and take control of goods. The legislation is Paragraph 14.1 of schedule 12 of the Tribunal Courts and Enforcement Act 2007 In cases where a Controlled Goods Agreement has been previously signed, the bailiff may have re-entry rights into the premises under Paragraph 16.
  6. This is my first post on here. Any help will be greatly appreciated. I seen a house that I liked so I arranged a viewing, when speaking to the estate agent who showed me around she said the property had been on the market for around a year with very little interest and that the property was for sale because the owner went bankrupt whilst he was renting this property out. Taking these few things into consideration I thought I would make a cheeky offer of 100k hoping that they would want a quick sale due to the bankruptcy situation (the property was on the market for 117,950). Two days later I rang the estate agent to see if there was any news she said she hadn't heard back from the trustees yet and in the end it took them a week to decide to reject my offer and make the decision to take the property off the market due to the property being in negative equity. If you've got this far I thank you for your time and basically what I want to no is what do you think they will do now? Will they file for repossesion and therefore the property will be up for sale again shortly? If so how long would it take before its back up for sale? Or will they do something different? Obviously the mortgage company want as much money back as possible therefore the only way I can see this happening is by them selling it. One thing I've thought of is will the trustees possibly take charge of the property and rent it out until the property price increases until they case sell it for what they need to take the property out of negative equity?   8. Hi My Son has gone away for weekend, driven through a ford. Water has gone into exhaust and car cut out. He got pushed out and managed to restart engine, let it run for about 5 mins to blow any water out but suddenly The airbags have deployed and broken windscreen and hurt his arm. He will call AA in morning to get him and car home. My question is.... will his insurance cover this. He has fully comp.

  10. Had a good job, career, home, money, etc. Then had a prolonged period of inactivity, debts piled up, not opening letters, spiral of anxiety and stress. blah, blah. Now, for past year or so, been earning, and getting back on feet. Looking to start paying back, and deal with all my debts. Have done as much due diligence as I can, and need some pointers. I have a number of creditors, with debts totalling around 45K. Have been paying token payments of £1 to most, some more. Looking to get StepChange advice and help. But also need some idea of full and final offers to really motor down the debts. So, as a starter, here are some of my most pressing questions: 1: I am having difficulty filling in my Income and Expenditure, as my income fluctuates. (I am working freelance, as am probably too old to be employed by a company.) I am wary of entering payment schedule and failing. Prefer to keep paying token amounts, then offer surplus every 6 months or so. Would creditors go for this? 2: I understand the first step may be to get CCAs from my creditors. Are there any downsides to asking for CCAs? Would creditors sense that I am trying to wriggle out, and go for asking for more, or get heavy-handed? 3: Are CCAs only for debt companies, or even the Originating creditor? (some of my debts have been off-loaded to debt-companies.) 4: What is the purpose of SARs? How does that help me? I understand they might be for finding penalty fees, etc? I know I accrued a lot when I couldn't pay any amounts when I started my downhill slide. 5: When offering Full and Finals, do I go for the biggest first? 6: I have been sold from one debt-company to another on some debts, I dont know what I am paying for on some of the payments!! Can I just phone them up and ask where the original debt comes from? (I have signed up with noddle, and got my list of creditors and credit file, so I have a starting point. I have been reading this forum for a few days, and have built up some knowledge, and seen how helpful this site can be. I would like to ask for some help in taking the first steps for an eventual bright future. PS: would it be ok to list my debts (with some fudging to protect myself) as a starting point?
  11. Hi there, I just got a letter about a very old debt account. The original lender was Lloyds TSB, but that was so long ago I cannot remember what year it was. the account was sold to another bank (whose name I didn't recognise on the letter), who then sold it to Allied International Credit. I sent off £10 by way of CCA to AIC and received nothing in return. So there is no original documentation for this debt (which will surely have been written off by now by the original lender). Despite having the account now in dispute (because of no documentation), AIC then sold it on to Apex. (I thought it was illegal under the 1974 CCA for accounts in dispute to be sold on to other debt spivs, er .. . I mean debt purchasing companies AKA Purchasers of Receivables.) I went through the whole CCA process with Apex (another £10) with the same result (no documents were found) and then Apex sold the account to Cabot. (But I thought it was illegal under ... etc.) Cabot wrote to me last week about the account, but then this week I had another letter from Cabot and one in the same envelope from Marlin. It seems that Cabot sold it to Marlin within only a few days. So now Marlin want me to cough up money for an alleged debt for which no documentation can be found. (But I thought it was illegal under ... etc.) It is possible that I will spend the rest of my life sending off CCA letters with £10 postal orders enclosed, while this useless undocumented account does the rounds of debt spivs over and over and over.... Isn't there some way of stopping this insanity?
  12. Hi All, Seem to find myself on here everyday at the minute ! I am cancelling my car insurance as presently have no valid driving license and recently learnt the insurance isnt worth jack while I dont have a valid license, but am keen to keep hold of my No Claims Discount (I have the maximum 9 years). Can anyone confirm that the NCD is valid for at least 2 years while it sits in situ and not tagged to a policy? I've got this 2 years from various googling, but all the posts are years old so I wanted to check this is still the case. Also, when I cancel, what should I do - Ask them to post me my proof of no claims, or should I leave that until I actually need it when I take out a new policy later this year? Thanks, James
  13. I took my PPI claim to the FOS back in April and had a letter from them asking for clarification on some points that I had to respond to by 30th June. I assumed that a decision would then come not long after but it is Sept now and still nothing. On their recorded phone message it does say claims can take 12-18 months so should I just forget about this for now? I am in some serious debt and really need the claim to hopefully get my life back on track.
  14. Will keep it brief for now - I received a PCN for parking in a residents bay (my bay) but the permit not on display. However on the ticket they have got an address that doesn't exist, ie the car was parked in a road with a completely different name. However the parking ticket company has now claimed this is not important as the address on the ticket attached to the car matches the address they have specified in their contract with the landowner !! It appears to be a generic name for the whole area as opposed to the actual road name. They have sent me photos of the car - so would this stick in court ? Could the court argue I am being pedantic given I have been given the photos or can I state that the address has to be accurate else I cannot recall the events. Thanks for any help

I lost an appeal in November last year and costs were applied £750 - I appealed and this hearing was heard within another hearing Civil Case on Jan 4th 2014 - The Judge awarded the claimant £7,123 - off which £5,000 of this was costs. He mentioned something about only allowing certain sum of costs. I could not pay - single parent on benefits and offered £5 a month - this was refused so I applied for a redetermination hearing which was heard in March 2014. I informed Judge I had a caravan old tower 1997 that I could sell worth about 2k. Advertised on 8 sites including Ebay and no interest. Went back to court on Monday 23rd June to update situation and offered £25 a month (payable by my BF) this was again rejected - again given another 3 months to sell caravan then other party intends to get a high court writ. The upshot is unbeknown to me this debt has gone up - I thought the £750 for previous hearing was already added to final judgement of £7, 123 - the other party have now added interest and further costs on both amounts. I managed to sell some furniture and jewellery and paid £1,000 in April - thinking the debt was now £6,123 but the debt has now increased to £7,300 thereabouts. Impossible situation. My question would be - how do I query this £750 additional ? no mention of this in the final judgement so assumed £5,000 in costs was total. Can I question the interest side of things? if I managed ( family member) to pay off some and get it under the £5,000 does interest cease? The Judge mentioned any debt over £5,000 interest becomes payable. So would it be worth my while loaning the funds from a family member. Thank you for your help in this matter it is all very confusing.
  16. Hello everybody, I've googled so much and found your board to be very helpful. Hopefully, you are able to help a friend of mine as well. The issue is the following: My friend was in London in 2009 with his car (German). As there were bikes on the back, the car did not fit in any of the car parks. And as there was no parking on the street, he eventually ended up using a parking lot that was for residents only. Upon his return, he had received a parking ticket for that. After he returned from his vacation, he had also received a further ticket via post. It said that he had a) not paid the London city toll and b) entered the restricted area (environmentally) without the "green sticker". Each would have cost 1,000GBP (or 800?!) but they said one they wouldn't charge as they would accept that a foreigner wasn't aware of that. He doesn't remember which of the two he should have been aware of and was thus fined. So one ticket was 800-1,000GBP, the other one around 240GBP. A google search informed him that it was not possible to execute the fine for a foreigner, so he did not pay. At the beginning, there were a few letters from debt collectors and the amount went up like crazy, but after two or three letters, they stopped trying. He was in London in the summer of 2009. He avoided travelling to the UK as the only info he had found was a summary of statutes of limitation in the EU where the UK was mentioned and it said those fines were expiring after 3-7 years. But he doesn't know which number applies to the UK. The problem is: He will travel via Heathrow soon. On the way back, he had planned a longer stop-over to see a friend (half a day). Could they still make claims for the tickets? For both options, i.e. also just stopping over in Heathrow, or only when leaving the airport on the way back? He had totally forgotten about this. It will have been 5.5 years by then. Would he risk anything if travelling or is he safe? Thank you SO MUCH in advance!
  17. Hello everyone, I have been working for a big Pizza home delivery company from last 5 years. Last year my manager started giving me less and less hours, despite knowing that this was my main and only job. The situation continued for a few months and I was forced to get another part time job as self employed. In my self employed job I was given generous hours in certain shifts but I decided to keep my first job at the same time have enough hours. Since August I have not been offered any hours at all and at end of September I received a letter saying that I had not attended a meeting with manager and that I was therefore sacked and have right of appeal. (I had never received any notification from my employers asking me to come for the meeting) I appealed and in two weeks the area manager chaired the appeal hearing. He explained that because I had not worked for some months and they have a automated system, that a letter is issued automatically and had been sent to my address. I explained my position and I was promised that I would get at least 30 hours a week in future. I contacted my store manager and informed him of my availability and the hours I can work. I was told that they would answer back soon. I also told my manager that I would be away for three weeks to visit my parents abroad and would return on the 25th. Yesterday I came back and I found a letter saying that they could not guarantee hours because my contract says that I will be given hours according to the business needs. I called the manager and he started asking me question when I received the letter and did not reply to my answer about getting hours. I have a feeling that they will sack me again and will skip all the disciplinary process. I called head office and asked the HR that I want to file grievance against my manager and area manager. They asked me to send details in writing and they will take action. I have been working there for 5 years now and never ever gone through any disciplinary. Have always been punctual and hard working during my shift. They are still hiring people for the same position I had, but they are not giving me any hours (they have window posters for hiring staff) They also have some staff members getting over 60 hours a week. Also in five years I have never been trained for health and safety at work, food hygiene, or fire and safety at work. In the past 5 years I was never paid my full entitlement of holidays. They do not pay us from September till end December (not allowed to take holidays) and the holiday year finishes en December means we cannot claim holiday pay. They will have all this on record. I need some advice from someone on how to proceed. Can I ask them to provide me all the information they hold of me through freedom of information or data protection law? Or I just send them a letter asking for a meeting? I personally think they are picking on me and I have not done anything wrong. I have also worked in same field for more that 25 years in UK and abroad and do not understand why they are treating me this way. I feel frustrated that instead of benefiting from my past experience, they just want to get rid of me for no reason.
  18. I know a woman that has been fraudulently claiming tax credits using her mothers house for 3 years now. I have reported her about 10 different occasions during these past years as has another friend of mine.. Absolutely NOTHING gets done. She lives 200 miles south in a cottage with her working boyfriend and three children. With the Tax Credits and the Child benefit money She's pulling in close to £900 a month. Before the predictable "you're mistaken" replies come in i'd just like to emphasize the fact that i KNOW without a shadow of a doubt. I have a mutual friend who has also reported her, and she's also tried to get her to help her with more benefit fraud - Asked to falsely "rent" her house and split the housing benefit money. I can only imagine how many other people out there are doing this and getting away with it. Apparently they only investigate 5% of fraud reports - I can believe it!! If the DWP/HMRC employed more people to combat this, i'm certain they'd make massive savings from lost money and fines etc.. Anything else i can do? Write to MP maybe? I'm so annoyed seeing her holiday pictures from Jamaica on facebook
  19. Hi, I would really appreciate some help on this. I took out a loan around October 2008 from Santander (£25K). I made regular payments till April 2010 sadly my career took a nose dive and I was unable to continue payments. I have not made payments since and I was unable to get any credit anywhere as a result s I never looked at my credit file. Since then I have had various communications from the bank as well as letters from various debt collection agencies (around 10 different ones) saying that they have taken over the loan. I was hoping that after 6 years the debt would fall off my credit file. Yesterday I got a free credit report from Noddle and it seems that every month I am defaulting on that debt. My question is, since the debt is now 6 years old, will it and the 4 years worth of defaults magically disappear, or will this follow me around for the rest of my life? The defaults are updated every month. Any help will me much appreciated. krem
  20. As above really. I did have an agreement but unfortunately broke it, I do owe them £158 which I will be paying on wednesday which will clear the balance in full. Checked Experian today and the last update was 9th September and shows 2 payments in arrears. Called orange collections this morning and said i'll be paying wednesday and she put a note on file. The contract has just ended also. She seems to think the account is not dead despite being disconnected etc but was unable to help regarding its status with the cra. I know phone companies are notoriously brutal with defaults and don't send out notices. Just wondered if anyone knew how quick they tend to default customers?, I have been with them for about 8 years and my bills this last 2 years have been £120-160 a month so they have done well off me, would just be annoyed to default it now as I'm 3 years from being clean default wise. Is there any manual intervention or do you think it all done automatically?. Are they likely to still default me even after the account has been cleared?
  21. Currently I am receiving Attendance allowance as I am disabled and require care. The company that handle my care are independent organisation who were provided to me by my local council. Presently, I receive care from the company twice a day, however I am unhappy with their workers and the level of service in general. What I would like to know is whether I can withdraw all or part (i.e. receive care once a day) of the service from this care company without affecting my 'Attendance Allowance?' Additionally, would it be possible for me to cancel this care service and select another private organisation of my choosing? Do I have to inform the DWP? Will my attendance allowance be affected? Thanks
  22. Just a quick question, I haven't had a ticket yet. I was looking for somewhere to park while my girlfriend popped into a local shop. I drove right up and down the street, but roadworks were covering up all the places to park. So I stopped on a corner, which has double yellows, while she got back in. not a second later, I see a camera car crawling up the road, they definitely wouldn't have found anywhere to stop, so she jumped back into the car and I drove off. My question is, would they have caught me while they were moving, or do they have to be stationary to take a picture?
  23. Had a one off payment from csa from backdated csa, and there wont be any other payments other than this, its a large amount and we get child tax credit, working tax credit and a little help with rent and council tax, does anyone know if this payment affects any of the above benefits?
  24. I am really needing some help. I have a house valued at £110,000 and a mortgage of £105,000 which I may need to sell. The only problem is I have a secured loan of £34,000 on my home through Picture (or whoever they are now) which has arreas of £650 and they will only get bigger as I am no longer able to afford the loan. What I am wanting to know is am I allowed to sell my home even though the secured loan won't get paid off. I am intending to rent if I can sell my home. Any advice would be much appreciated. I don't want to sell if I don't have to but will Picture?? take my home even if they won't get any proceeds from the sale.
