  1. Hi guys the same has happend to me, I stole 50 pound worth of stuff, should I pay rlp
  2. I am a pensioner and full-time round the clock carer to a close disabled relative. I receive no benefits apart from the usual state pension. The disabled relative I care for has severe care needs and is unable to work, they receive PIP and ESA. Upset and frustrated by lack of interest on my life savings I started reading info on savings on the Martin Lewis website. To maximise interest it is recommended to open several of the top interest paying current accounts - which I did. I had money over so accounts were also opened in the person I care for's name (all my money, paid directly to accounts from my bank account). The relative I care for has now been called for compliance interview with DWP, no reason given. Could what I have done have triggered this? I didn't even know about the savings thresholds and can't believe what I have done and how stupid I have been. I feel ill, my anxiety is through the roof and I have felt ill since the letter arrived. I fully understand this was a ridiculously stupid thing to do, there was absolutely no intention whatsoever to cheat the benefits system, the benefits system wasn't even thought about! We're talking about maxing out the current recommended currents acounts. Could someone please advise the least damaging way to explain this to the DWP?
  3. JAMIE OLIVER is imposing his own levy on sweet drinks sold in his restaurants in protest at the government’s refusal to introduce a “sugar tax”. Oliver, the celebrity chef and restaurateur, will add a 10p charge to every drink with added sugar in an attempt to highlight the dangers of too much sugar, as well as sending a message to government to take urgent action on childhood obesity. He's thought up a way of making extra profit on the backs of kids. If he was really that concerned, he would stop selling sugary drinks altogether. Will you fall for this and pay extra ? I wouldn't even step inside one of his rip-off restaurants, £11 for beans on toast.
  4. Hello again, Yet again something absolutely stupid has happened to me. My car has been stolen, but it couldn't be that simple. I have a red Alfa Romeo, SORN and uninsured, I took the engine out of it an transplanted it in my car, and took a few other bits and bats so it was just a rolling shell full of junk (became our skip as we knew we were getting rid). We towed it to the local scrap yard this morning (on an A frame which wasn't really legal). When we got to the gates, we realised we had forgot the V5. So unhooked the car, drove home and got it. When we got back to the scrap yard they were closed and the car was gone. It has no engine so it cant have been drove and the sod was heavy, on space saver wheels and with partially seized brakes so couldnt have been pushed. You can see the full scrap yard and it isnt in there, what do I do? It was towed illegally by my friend so I dont want him to get in trouble if they see him on CCTV. We also technically abandoned it to get the V5 so dont want the 2.5k fine for abandoning a vehicle. But I also dont want it to crop up a few months down the line when its found burned out, or dumped somewhere. So I cant really report it stolen can I? Also what do I do, just keep sorning it every year??
  5. hi, I have been very stupid and opened a catalogue in my mums name I tried to order something but the order was declined so I stupidly rung the company and they said are you sure this is you because you sound very young, I then replid by saying no this is my mums account I am ringing on her behalf, they asked why she couldn't do it, I then replied saying she isn't very good with computers and ordering ect so that is why I have done it for her. they told me that only my mum can ring and she will have to ring back herself, I am now very worried that I am going to get in trouble ??? the order has been cancelled and I certainly wont be trying to order again !!!
  6. Hi, First of all, unlike a lot of people on this site, I did shoplift. I knew what I was doing, I made a stupid choice, and I don't really understand why I did it. Just was trying on a bunch of stuff, and then thought I could get way with it, and walking out of the shop was stopped. I knew I was doing something wrong, I felt guilty even before I left the shop but wanted to see if I hd done it (and whilst it was a one off, I had previously taken small things - to see if I could- I think 2 other situations both a while apart. A scarf once, and a hair product once. In this situation, I put stuff on and put stuff in my bag- about 50 pounds worth. Not that it's relevant to the wrong doing, I had had some pretty awful stuff going on - my brother's girlfriend comitted suicide not ages before this, and I was waiting on a hospital appointment for an MRI scan, as I was in pretty major pain at the time and on some pretty funky pain killers (I had an operation not long after that sorted that). I don't think it's relevant, but the security guards and the police kept saying who put you up to this, is something wrong, why do this etc (I suppose they didn't expect someone like me- at the time mid twenties, polite, and super regretful - there was a woman in there swearing and saying they couldn't do anything to her etc.) Anyway, I answered every question I could as best as I could, no one was rude to me (I emptied my bag out for them, and while they questioned a necklace I had, they accepted the receipt I had for it, even though it was from a pound store and those receipts just say 'item', (I did buy it.) The police gave me a caution, as it was a first offense etc, and I co operated. (Actually, it's Scotland, so they said they would recommend that I be given an adult warning but because I tried to take 50 pounds worth this may not be allowed, and it might be referred to the Procurator Fiscal, in which case it was likely that a fiscal warning or fine would be recommended. They said a police adult warning would be on police records for 2 years, but not on criminal records, and I have been struggling to find out about the fiscal warning, but a fiscal fine apparently stays on your records for 2 years as well and is meant to be worse. {I'm not allowed to post links, so I'm including in blue information to allow you to find the data yourselves, but I can post them once I've made 10 posts.) Adult warning info: ask the . scottish . police . uk Q562 Fiscal stuff info: victimsofcrimeonscotland - alternatives - to - prosecution I offered compensation at the time, and the store staff gave me a letter saying notice of intended civil recovery. Like others, I do feel I owe something as I did do wrong, and god I wish I hadn't been such an idiot. It makes me feel sick that I did it. I'm old enough to know better, and I don't even understand what was going through my own head. At least I can be relieved that I'm awful at breaking the law- in a weird way I'm glad I was caught, I'll certainly never be tempted again! Weirdly they didn't ban me from the store. (Not that I've been back, far too embarrassed by my own idiocy). They just said they'd be watching me carefully if I ever came back. (I wish they had banned me - might make me feel more like I was being punished.) Anyway, the letter received (a few weeks ago) includes the following paragraph at the bottom: "In principle the Data Protection Act 1998 does not prevent the use of data for civil recovery and employment screening purposes provided that the data protection principles are complied with. You are notified that the personal information held about you may be passed to the Police for criminal proceedings and to Retail Loss Prevention for civil recovery proceedings. Your personal data may be stored and used by prospective employers within client companies to make employment decisions and for the purposes of crime prevention and detection including verifying details on application forms and protection of the rights of this company and other companies as appropriate. We will pass this personal data to Retail Loss Prevention Limited and it will be shared in accordance with data protection law with appropriate commercial organisations and crime prevention bodies. The use of this data will at all times be in compliance with the Data Protection Act 1998." Soooo, the crux of my questions relate to the fact I think I've stuffed my future up by being a complete moron. I am a (mature) uni student, and I had thought to either go into teaching, or a management role, or library work (which usually means spending time with vulnerable adults or children), or possibly social work or if I stuck on the finance ish side of things, becoming an accountant (some friends recently became accountants, they say you don't need a degree in accounting and that you get a great introduction to business.) All of the professions I was considering are probably ones that (understandably) don't want to employ someone who has shoplifted. I looked further and found that in Scotland they have a system called disclosure Scotland. ask the . scottish . police . uk q642 And that the disclosures for the jobs I was considering are all eligible for (I think) standard disclosure, which show spent and unspent convictions (hopefully not relevant) and cautions. (are these the warnings? Does that mean they don't go away, ever?) disclosurescotland information standarddisclosure If you click on the 'eligible positions legislation' the link comes to ssi 2013 /50 / schedule 4 This lists a load of professions who are excluded from the 'rehabilitation of offenders' legislation per the explanation at the start of the thing which says "5. There is excepted from the provisions of section 4(3)(b) of the Act— (a)any profession, office, employment or occupation specified in Schedule 4;" I found the act and section 4(3)(b) says: (3)Subject to the provisions of any order made under subsection (4) below,— (a)any obligation imposed on any person by any rule of law or by the provisions of any agreement or arrangement to disclose any matters to any other person shall not extend to requiring him to disclose a spent conviction or any circumstances ancillary to a spent conviction (whether the conviction is his own or another’s); and (b)a conviction which has become spent or any circumstances ancillary thereto, or any failure to disclose a spent conviction or any such circumstances, shall not be a proper ground for dismissing or excluding a person from any office, profession, occupation or employment, or for prejudicing him in any way in any occupation or employment. BUT:- I am confused. I understand that this means, that (if the above does not apply) failure to disclose a spent conviction or any other circumstances SHALL be ground for dismissing or excluding me from an office/profession/job etc, but is this the case as concerns an adult warning? I don't understand the difference between an adult warning and a caution per disclosure scotland. (I still haven't received anything from the police so don't even now if it will be an adult warning, a fiscal warning or worse.) I think I will ask disclosure Scotland this, but post it up here anyway. Also, this leads me back to the letter from the store RE RPL (the abbreviation I've seen around this site). I have highlighted the bits that ring bells for me. "Your personal data may be stored and used by prospective employers within client companies to make employment decisions and for the purposes of crime prevention and detection including verifying details on application forms and protection of the rights of this company and other companies as appropriate. We will pass this personal data to Retail Loss Prevention Limited and it will be shared in accordance with data protection law with appropriate commercial organisations and crime prevention bodies." Obviously, my concern is not with re-offending, so, whilst I'm unsure of the use of them passing my data to crime prevention bodies, I'm less concerned about that (though I don't understand what that means). As it says specifically "within client companies" does that mean just the retail companies that employ the firm, or anyone that might want to do pre employment screening? What do they mean by "appropriate commercial organisations?" A lot of the work I want to do is within the public sector, not commercial. I'm not to concerned about not being able to work in retail at the moment - I would be crazy to apply to the company this happened with, anyway, and I would hope if I end up in retail in a few years, that it didn't come up? I didn't know that only the police had the legal right to all my details, so they have my full name, address, date of birth, everything. I had to give it again to the police later. I'm basically wondering if I should write off ever getting one of the jobs I'd like, because of this stupid thing. I think the social work registry goes through disclosure scotland, teaching definitely does, and I don't know if accounting or more commercial things. And, as I'm nearing the end of my degree, I was looking at applying now, so everything would definiitley be within 2 years, so even if the warning goes away after 2, it would still be on my disclosure now if they do it, if it's a fiscal fine at least. And that's before even considering if they are letting anyone willynilly check their data which according to the website ( integrity screening uk) they do. (Though I don't know if any of the areas I'm working in would be checking whether I'm subject to civil recovery proceedings.) I also checked the company name (cireco) and it is not on the data protection public register, although rlp is. Interestingly, the 'purposes' for data processing are listed as "We process personal information to enable us to provide investigatory services, to trace debtors and purchase debts and to collect on behalf of creditors. We also process personal information to maintain our own accounts and records and to support and manage our employees." None of the above purposes relate to my situation, or this 'integrity database' being maintained to sell details of my integrity. What they say they will do with my data id not what they say they are doing with it per the register. Additionally, I understand from reading this site that I am not a debtor - that they cannot charge me a fixed fee for my wrongs. (I would be much happier paying the company directly an apology piece of compensation.) They also say they share the data in this way: We sometimes need to share the personal information we process with the individual themself and also with other organisations. Where this is necessary we are required to comply with all aspects of the Data Protection Act (DPA). What follows is a description of the types of organisations we may need to share some of the personal information we process with for one or more reasons. "Where necessary or required we share information with: voluntary and charitable organisations ombudsmen and regulatory authorities business associates and other professional advisers associated companies suppliers financial organisations credit reference, debt collection and tracing agencies police forces private investigators courts and tribunals government traders in personal data family, associates or representatives of the person whose personal data we are processing; current, past or prospective employers examining bodies" I think this is a misleading statement. They say "Where necessary or required" but I do not see any circumstances where it would be necessary or required for them to share the data with traders in personal data, and I think sharing it with anyone who might be a prospective employer is highly irregular, they're obviously making money off of a horrible situation, and why have a disclosure system if someone can not be found guilty of a crime and have their whole future wrecked anyway? I don't know what to do. I think I need to write to the information commissioner about this as well as disclosure Scotland. As concerns the credit statement issue, I know I'm going to need a credit card at least temporarily as I have an overdraft that will be reducing following graduation, and at least at the moment I have not got a job that pays enough to cover my rent. As you can tell this has been bothering me for ages! I still haven't decided how to respond to RLP, and I'm so worried about the possible implications. Some of the jobs I've applied for already are ones in the public sector etc, but no one has asked me for a disclosure, and I think you need to give permission for a disclosure to go ahead. I have kept applying for jobs in areas I'm interested in and I have kept volunteering for kids groups for which I have already got a PVG (this is a disclosure to work with kids and vulnerable people) but I think I should tell someone about this, or it might get worse. I don't think I'm a danger:- I mainly help tidy up and split up arguments and suggest games for the teens and kids to play. I certainly would never suggest anyone break the law. I'm wanting to wait to say anything to find out whether I get a warning or a fine... and to work out what the implication would be for all of this before I say I can't volunteer anymore! I also do office work - and I don't remember there being any disclosure for that job, but we do look at financial info sometimes (for paying for services and buy goods) but I don't do any processing of the payments or anything. I know that if I was convicted they would fire me as even if I don't deal with stuff, it would look bad on the company to have me there. But obviously I'm terrified that if I don't tell them and leave that retail loss prevention might contact them and I'll be fired, even if I do pay them the money. Please help with any advice. I would really appreciate it. I can't believe how stupid I've been.
  7. I am really needing some help. I have a house valued at £110,000 and a mortgage of £105,000 which I may need to sell. The only problem is I have a secured loan of £34,000 on my home through Picture (or whoever they are now) which has arreas of £650 and they will only get bigger as I am no longer able to afford the loan. What I am wanting to know is am I allowed to sell my home even though the secured loan won't get paid off. I am intending to rent if I can sell my home. Any advice would be much appreciated. I don't want to sell if I don't have to but will Picture?? take my home even if they won't get any proceeds from the sale.
  8. just had a phonecall on my landline asking me to confirm some details I said ok (i was expecting a phone call about something anyway that would require some details) when he asked if where i was living I told him only for him to then go I'm so and so from something location services and we have a client who is trying to track you down I asked who was after me and he wouldn't say but asked to confirm an address I haven't lived at for almost 5 years. I said I couldn't remember he said ok and hung up. I googled the number and it was Wescott debt collection. The address he was after was one I had when I was a student in a different town to where I am living now and I did screw up financially while I was there. I had a hsbc overdraft and credit as well as a natwest overdraft and credit card. Now I have paid off the HSBC credit card and theNatwest overdraft a couple of years ago and the last payments I made on the other 2 were through a debt management service and the last payment that I made to them was January 2009 (I think). I didn't pay the last two off because I lost my job at the time so cancelled the management plan. I don't know which debt Westcot are after but do I need to be worried? especially now since I have stupidly confirmed my current address
  9. A chap in Bromsgrove decided to take his family out to lunch, they parked their car in one of the council-run car parks and put a £I in the machine for the privilege. When he returned to his car there was a penalty charge on his windscreen for £25. He was 7 minutes late, when you have a couple of kids to control it can take you a little bit longer getting back to your car. (but that is beside the point). This he felt was very hypocritical when, at the same time this car park was taken over by a group of (so called) travellers who were camping in the car park. He thought it would be interesting to see what sort of parking fees or fines they have paid.’ So he wrote to the council and asked them why should motorists be fined for over staying by a few minutes when travellers can occupy a car park for months without having to pay a penny? This is the reply he received. ‘There appears to be some confusion regarding the basis upon which the travellers were on the car park in question. ‘The position in respect of any normal user of the car park is that, by entering and parking their vehicle, they are entering into contract with the Council to pay a sum of money in return for the Council allowing them to leave their vehicle for a specific amount of time. If the vehicle is left for longer than the paid for time, no payment is made, or there is a failure to comply with parking regulations, there is, in effect, a breach of contract which entitles the Council to make a penalty charge. This is the bit I like!!! ‘In the case of the travellers, they were on the car parks as illegal occupiers and, as such, there was no contract with them as the purpose for which they entered was not permitted. ‘In the circumstances the appropriate course of action was not for “breach of contract” but for “illegal occupation”.’ So here’s a plan. Since councils will ignore all attempts to stop them screwing the motorist, next time you get a ticket refuse, to pay it on the grounds that you’re not actually ‘parking’. Say that you’re ‘illegally occupying’ the bay for half an hour and therefore the usual rules don’t apply. Let the council’s lawyers pick the bones out of that. Better still, swap your car for a Toyota 4x4 and a caravan and park where the hell you like. Full Story ...
  10. Hi I work in an office and stupidly borrowed some money from the accounts safe with no authorisation and had every intention of paying it back. I had 75% of it today to replace. I have went into work and I have been found out and now have been suspended on full pay. I have admitted i took the money and did not deny it and paid the money I had and said I will pay remainder this week. I am worried in losing my job, I have no one to talk too as I feel too embarrassed to discuss with my family...... I would like any advice is to what I can say in my disciplinary meeting, I am unsure when this takes place, I am waiting for a letter Thanks
  11. Hi all, Despite the people at rossendales being given a cease and desist over the phone, and verbally when they called (this was filmed, and yes the bailiff did discuss in public confidential details without ascertaining who I was, and no I didn't give any info whatsoever) I also informed him that he was trespassing (which he denied) and asked him to leave the property (which he refused and said I could call the police if I wished, I said thankyou and goodbye, walked back into my home and he left reasonably quickly - I never called the police), they called again and I just didn't answer. I've now sent a cease and desist letter to there offices by tracked recorded signed for royal mail (I also have cease and desist notice in front door window to them, should they approach the property again). My partner completely goes into a total shaking crying wreck everytime there's a knock at the door, I also have children who I feel are threatened (despite my assurance that they have no power), I am also under the care of the local hospital psychological outpatient department as i'm currently recovering from two nervous breakdowns/major depressive episodes and am on extremely strong anti-depressants, courtesy of idiots harassment. What i want to know is 1- can I physically remove the bailiff from my property? 2- can I get a restraining order against them? 3- can I sue them for harassment? Anne 4- can I sue the council as I believe they are responsible for any agent they employ/subcontract's behaviour and conduct? Many thanks to all.
  12. First off, let me explain that I am in Shetland. So other courier services like DHL or FedEx is not an option. I had some documents I need to send to Philippines very urgently for a visa application for a honeymoon. I walked into the local Post Office on Friday, 7 June 2013, and got it sent by Parcelforce Global Express service, which is a "guaranteed" service. I paid £60.60 and was told it will be there on Tuesday, 11 June 2013. Standard Global Express service to Philippines takes 2 days but being in Shetland, it takes an extra day. Saturaday is counted as a working day, so a Tuesday arrival sounds right. So imgaine my horror to get home from work yesterday (Monday, 10 June 2013) to find the package sitting on my door mat! Instead of making its way to Philippines, it went 10 miles the wrong way! So I have to take it back to the Post Office today and was told "this shouldn't happen". The address on it was clearly typed and on the customs form, the "from" and "to" address are both correctly filled in. What do they mean by this shouldn't happen? Clearly it is not the mistake of just one party as it will have to go through sorting before being handed to the postman to carry to my door. I as told by the manager he will make sure it will go correctly this time. However when I just checked (10 hours since handing it to him), the tracking number is still not registred on their system. While I know I can claim back the postage I paid for late delivery (not hopeful as there are many stories of failed claim against Parcelforce on the internet), there is no vaule to the contents and thousands loss if the visa cannot be approved in time. I had emailed them a few times today, but I got no response as well and strangely Parcelforce is not regulated by Ofcom, so I cannot even complain to them.
  13. I have no idea how much UK Plc is in debt... I do wonder why we need to borrow from private bankers though? A sovereign state can issue its own debt free currency so why borrow? Who are these trillions owed to by every nation? This debt owed by so many to so few is a [problem], it has been engineered to enslave us all. Once the control of money was transferred from the gold standard and was handed over to private banks we were screwed. Private banks such as the US Federal reserve literally create money from nothing without having anything to back it up with such as gold. This fiat currency is a huge con and I wish people could see it. The deficit is a globally engineered con perpetrated by generations of one or two families. Rothchilds are one. The ultimate aim seems to be a one world government with the majority living in an orwellian society with a very few feeding off us all. It's social engineering of the highest order and with the darkest motives. Get out of the EUROPEAN Union all together. They are taking our sovereignty by stealth. The Late Lady Thatcher was well aware of the objectives of the EU... I hated her at the time btw but she was right about that. That's why influence was used from outside to shove her out... She wasn't voted out, her own ministers got rid of her with more than a little help from outsiders. We should demand a global return to the gold standard for currency a day prevent the any private company from controlling a nations finances.

  17. Please before you even start to read please dont judge me! Im not a criminal and would neva intend to harm anybodies life but i would just like to know if anybody has been as daft as me? Big gulp ....here goes.... I have just been sentanced for being drunk in charge and got a 12 month ban fined £620 and 150 hrs! Its now going to crown court as my solicitor has appealed.. It all happened afta a domestic at home...a big one, so silly me left the house sober and just needed to get away...i parked up in a layby and then got totally wasted just wishing all the problems would go away! I had no intention of driving and had even taken my footwear off and the keys out of the ignition...the car was going to be my bed for the night! Dont know what i was doing but i was half in the car and half out of it when the police arrested me...can only think that i must have needed the loo! In my eyes what i do to myself is my business....i lost a good career due to redundancy and the rest just snowballed! Never been in court before or had any convictions for motoring offences....i so scared about going to crown court! Could my sentance be increased if i lose my appeal? Your all probably going to think im stupid but i need to get it off my chest! Everybody makes mistakes:-( Jan
  18. 19. I have been incredibly careless and stupid and never properly checked my Child Tax Credit Award or renewal form. I found it all very stressful & all I did was fill in figures & sign, and all my partner did was sign. So it turns out I have been getting the Severe Disability Element of CTC for my child for several years when I shouldn't of (do get DLA so I do qualify for the first element) All I can say in my defence is that when I first notified Tax Credits I was receiving DLA for my son I was asked what level he was receiving. I said I didn't know gave them a reference number and was told "we'll check that out" What has happened now is I got a Compliance letter which quirried my child's elegibility for the Severe Disability Element for Tax Credit Award to 5 April 2012 saying their information did not confirm it. I was asked to contact them by 5 July 2012 if I disagreed and to finalise my Tax Credit Award by 31 July 2012. I contacted the Child Tax Credit Helpline earlier this week changed my details and did confirm income details for end of tax year. I am now totally terrified as to what I should do. I know the overpayment I have had will be huge, and it will take a very long time to repay. Will the compliance department have already picked up that my claim has be wrong for so long? Is it best that I ring them and admit my fault? My partner is oblivious to this, he has work issues at the moment and I am really worried that this will push our relationship over the edge and I will be homeless on top of everything else. I know I have been totally irresponsible and I am sick with worry as to how this might end up. Me in prison and my life over, my son in foster care and all the pain hurt and embarrassment I will cause my family. If it wasn’t for my son suicide would definitely be my answer. I know contacting CAB would have probably been a good idea, but circumstances meant it was difficult. Please help any advice will be gratefully received
