  1. Hi All My partner received a windscreen ticket for parking in a disabled bay. As per the advice on this forum, we have waited for the NTK, which arrived 34 days after the ticket was put on the windscreen. I am planning on writing for a POPLA code but wanted to clear up a question I have on the POFA Act 2012. Under section 8, which (as I understand it) is the section applicable if you have a windscreen ticket, the act says: (4)The notice must be given by— (a)handing it to the keeper, or leaving it at a current address for service for the keeper, within the relevant period; or (b)sending it by post to a current address for service for the keeper so that it is delivered to that address within the relevant period. (5)The relevant period for the purposes of sub-paragraph (4) is the period of 28 days following the period of 28 days beginning with the day after that on which the notice to driver was given. Does this not mean that the notice to keeper must be received within 28 days starting from the day after the windscreen ticket was received? It's just that advice elsewhere says that the NTK must be received within 28-56 days.

  3. Hi, hoping someone has some advice. While visiting family last week, my husband parked up in a disabled bay in a council car park while we took the children to the park. Parking was free for up to three hours. Blue badge and time clock displayed clearly. he drives a WAV, he has to be careful about how to park, very few car parks have spaces that are ok for WAVs. This particular car park layout meant for safely and to not cause an obstruction, he was within two BB spaces, ie making a 'through' space. We've parked there before with our previous WAV. He got out the van from the back, two of our children were with him and they noticed a traffic warden nearby, he checked the sign, and went off to meet me in the park. He came back to the WAV alone just over two hours later, got in the back, got into driving position and realised he'd been given a ticket! He called over another traffic warden, who said the first one had told him she'd ticketed him for occupying two spaces and she'd called her supervisor to ask if she could do it. My husband asked to speak to the supervisor himself. 2nd traffic warden refused. My husband asked him if he were not a power wheelchair user, and could park up without alighting from the rear, if he would have got a ticket. The 2nd warden said no. 2nd warden also said if he'd purchased a ticket from the machine as well, he wouldn't have got a ticket. The sign says disabled parking free for up to three hours, nothing about parking a WAV and alighting safely, or having to buy a ticket for having a WAV. He told him he couldn't cancel it, so to appeal, gave him a number to ring for the supervisor as well. My husband asked how he was supposed to get the ticket off the windscreen, he couldn't reach from his chair. Bearing in mind he was alone, the vehicle is obviously a WAV with no drivers seat, and the blue badge is directly in front of the drivers seat anyone checking that could see it clearly, the 1st warden would have looked directly into the space to place the ticket. The 2nd traffic warden had to hand him the ticket. The time on the ticket is 15 minutes after he got there, and is for parking over a line. He told my husband he should have parked in one space and caused an obstruction. There wasn't actually room for him to deploy the ramp to alight from the rear of the vehicle if he'd done that. By this time, my husband was really stressed and upset, getting chest pains, and called me, the traffic warden left before I'd got there. We waited about 15 minutes till he'd calmed down and felt better but the warden didn't come back. My husband didn't get a choice with motability about the size of the WAV, it's because of the equipment, ramp etc, in the back and adaptations. He's had it for almost two years, we park in car parks every day. On the advice of our local police, we also carry cones to place behind because we've had a couple of incidences of people blocking the rear doors so he can't get in. My husband parks in the safest way possible so not to get run over when getting out, to avoid causing an obstruction etc. He's never had a parking ticket before, especially not for being a wheelchair user with a WAV, can't believe he said that! The children confirmed they'd seen the first traffic warden as they'd parked up with their dad. She could have come across then and spoken to him, the car park wasn't busy, but instead she decided to ticket him. I bet she told her supervisor it was just a van with a BB, not a WAV with no drivers seat. I messaged the local council that evening, and they're supposed to be looking into it. He has 14 days to appeal, it's now day 7. The council say it's an unusual situation and apologised but they haven't yet cancelled the ticket, apparently the team who'd look into it were away last week, no excuse yet for this week. I checked their 'other rules' for car parks online later on, and it mentions nothing about parking WAV's safely, without causing obstruction. If he'd parked like they wanted him to park, he wouldn't have been able to get out at all. We took photos of how he was parked, of the sign and how the 2nd warden thought he should have parked. Their sign said people 'may' get a ticket, suggesting they should use some common sense :-/ Not sure how ticketing a BB holder parked in a BB space is common sense at all, or to anyone's benefit really. Seems like a massive waste of time for them and us. I'm emailing the council again today, to find out if they want him to go through appealing or what. It's 200 miles away, so we can't just go in, or we would! Very much feels like he's been ticketed for needing a power wheelchair and adapted vehicle though. He's never got a ticket where we live, or anywhere else actually, and he parks up for work every day in a BB space. Any advice on how to handle this?
  4. on Wednesday morning i found out Facebook had disabled my Facebook page! :o it seems to be because my real name is XXXXXXXXX, but my Facebook page [& everything on the internet] is called XXXXXXXXX. Apparently it's against Facebook's rules to use a name that isn't your real name! i have got my real name on my page's info section & as my nickname [which only my FB friends can see] but that's not good enough i guess. i've used xxxxxxx for my Facebook since i joined in 2009 so i'm shocked & angry i suddenly got disabled now. if Facebook would un-disable my account then i could change my name, but i can't change my name if they wont let me log in! ;( so far all i can do is fill in Facebook's stupid [automated] forms online. no actual human being. so far they're asking for ID with xxxxxxxx on. which i obviously don't have cause it's my nickname, not my real name. Facebook don't understand that some people like to be under a nickname/false name, especially when you have mental health issues & an abusive ex-husband. even the police advise a fake name for certain people. what happened to anonymity? i can't even tell my Facebook friends why i'm missing because my profile has disappeared. :/ if i could actually contact a human being that works for Facebook...rather automated stuff...then i could get this sorted. anyone know if there's a way to get to a human? i know not everyone likes Facebook or social media, but it's my lifeline; so any help would be appreciated.

  7. We have several concerns about our current landlord and current house. 1. two windows smashed due to a fault. There has been a product recall in which the company who installed them will replace all of these windows. Our landlord response is to come by with some gloves and a box. Only the ones which already broke, the others are still at risk of spontaneously shattering. 2. no current gas certificate. no gas certificate since we moved in, if there is one it is fraudulent. 3. black mould, my asthma has increased from mild to severe. 4. I am currently disabled and been told by doctors to move out of the property. We had seven months left on our lease. Our landlord insisted we stay to the last month even if we offered to pay the remaining months. 5. He set up our next landlord on our behalf. We decided not to go with them, but he brings the landlord we rejected around to our house on the pretext of making repairs while also asking us about where we are moving to. Feel pressurised. 6. We gave three months notice so we could relax and not be bothered during the move. (due to disability) he had the estate agent bringing people around for the whole three months. 7. The latest is he is pressuring us to move out early but also pay the rent when we aren't living there. Now that the estate agent found interested people. For example, we expect to move in one week, but we are paying for another 2 months. We haven't had the all clear, credit checks etc but he wants to know NOW what's going on. (we had a delay due to the landlord he set us up with. so instead of having a relaxing three months we had about 10 days.) 8. Had doctors letters saying the house isn't suitable, need to move. The house cannot be adapted for my needs. My question really is we are tempted to go after them, for the potentially dangerous window (two have broken glass overhead, plus one in tact but same brand that shattered already), the lack of gas certificate, our deposit being in their bank not protected, black mould growing where a pipe was leaking for two years. The thing is we are disabled and any retaliatory actions or stress would increase health problems. Scared that calling environmental health will spark a chain of events when the whole point is we want to be left alone to peaceful quality of life. However, it is nagging at me, the potential dangers to the next tenant. Where do we stand as well due to the other issues with paying the rest of the contract? I.e after we move out we will still be paying about 6 weeks.
  8. Hi, I've just bought a car from a private seller. Very happy with the car but when I went to tax it before picking it up I noticed that it is classed as disabled for tax purposes. It is currently SORN. I have the new keepers supplement but the seller retained the rest of the V5. I have the MOT certificate. Can I change the tax class at the post office and pay for tax at the same time?
  9. Both of my sons are registered disabled. My eldest is almost 18 and autistic. They have both been home-educated since the age of 11 and we have received DLA, Tax Credits and Child Benefit for both of them up until now. However, I received a letter yesterday that my eldest will no longer be eligible for Tax Credits as he is not working towards a recognised qualification. I have checked the government website and nowhere does it say that he needs to do so, simply that he needs to be in full-time education, which he is. I immediately called the Tax Credits office and asked to speak to the person who wrote the letter, as the letter states 'I have decided...' and 'I have done such-and-such'. Strangely, I couldn't get to speak to the actual person, but the lady I did speak to informed me that since the decision has been made, they can't overturn it. I've been in receipt of Tax Credits for my son for almost 2 years since he was 16, so can't understand why they've suddenly decided to stop them. That's a loss of over £100 per week starting immediately. and I have no idea how we're going to manage without it. The letter also stated that I provided them with false information, which is a lie, as I have been very honest about their home-education and have given them the same information over and over again from the time he was 16. They also say I will need to pay back all Tax Credits I have received since last April! What can I do about this? We are at our wits end and have no idea where we stand legally. Any advice would be most welcome.
  10. I wonder if anyone can help? I received a PCN for parking in a disable bay at a private residential underground car park. I challenged this through both the appeal routes (parking operator and The IAS) based mainly on lack of clear signage at the bay. The ground markings are small and painted in red which were not visible while reversing in to the space and not visible once parked. There was a sign on a pillar however this was high up and to the side of the space and again not visible when reversing. My argument is that signage should have been directly behind the space in keeping with signs at other disabled bays in the car park. There was a perfectly pillar immediately behind the bay that a sign could have been attached to. I believe the current signage is unsatisfactory and amounts to "predatory tactics". What are people's thoughts? I also wonder what thoughts people have on on terms and conditions signage at the car park stating that the parking operator is a member of the BPA and appeals are heard by POPLAR when it transpires that they are not as they a new members of the IPC who use the IAS to hear appeals Does this incorrect signage have any baring on the arguments I can make at Court?

Hi all, I hope you can help with this question as I'm unsure and can find no information about my particular problem on the DVLA site, nor can I actually get through to a human being for advice... Their IVR system is a complete and utter joke. For the last 5-6yrs I have been using my car to transport my disabled dad around. He lost his license on medical grounds in 2009 and his motability car was returned. We then found out that he could nominate me as a designated driver/owner of a vehicle and have it registered for disabled use and get the road tax for free. Over the years I've changed cars a couple of times, getting a larger one to accommodate a wheelchair and so forth. I'd take them on trips and holidays, to the doctors and hospital appointments and shopping... ect, ect. The car was last taxed for 12 months at the beginning of July. Sadly my father passed away towards the end of July, and although the car is still showing as taxed online... I am uncertain as to whether I will be required to register the car as normal use and purchase road tax or if the tax will run it's course until the end of June 2017 and I will have to do it then. I have literally spent hours attempting to research the answer to this, along with half a dozen calls to the DVLA and their IVR system simply doesn't have an option to select for my query and I keep ending up at dead ends and there is zero options to be put through to an actual person... I've wasted 3-4hrs on the phone alone listening to their stupid system and it's driving me nuts. It's a simple question... do I need to re-tax the car or not. Typical govt bureaucracy makes that all but impossible to find out.

Previously loyal disabled customer harassed, bullied and ripped off by Amazon Unfortunately our trusty old laptop was failing and needed replacing.As this was a desktop replacement we required something of a suitable size and standard.This does not come cheap. As this was a considerable investment for us and having been a previously loyal Amazon customer for many years, we decided to purchase from Amazon based on (an apparently incorrect) perception that if there was a problem with the purchase then we would have good support and come back if required.We did however have reservations due to Amazon’s seemingly increasing controversies (taxation, employee treatment, PRIME etc). We decided on a particular laptop model and specification but unfortunately it was out of stock new.It was however listed as available from Amazon Warehouse in ‘very good’ condition with ‘original packaging’.Having not purchased from Amazon Warehouse before, we were concerned by the low customer rating of 89% but could not access any actual reviews of them.The website did claim that the purchase came with ‘all the benefits of Amazon.co.uk fulfilment and customer service’ and ‘All of our products are backed by Amazon's satisfaction guarantee’.Unfortunately we were mislead by these false claims and made the purchase. At time of purchase a ‘not before’ delivery date was agreed in writing with Amazon.According to logs this was ignored/not actioned and attempt to deliver was apparently made by Amazon’s contracted courier Hermes. Because we were away, Hermes apparently proceeded to trespass around the property and attempted to gain access to various locked outbuildings. Apparently after failing to gain access, Hermes abandoned the expensive and fragile laptop in an outdoor area at the back of the property – exposed to the winter rain and cold.A crossed out ‘Next Directory’ calling card was later discovered through the letter box (despite this being an Amazon purchase). When I learnt of this attempted delivery through online tracking, I emailed Amazon customer service but they did not seem to understand and instead attempted to send Hermes around to trespass again.With considerable concern for both the security of the property and of the expensive purchase, I had to write a formal complaint to Amazon ‘complaints’ in order to stop this.We received a basic response from a Paul Grech of ‘Executive Customer Relations’. When we later returned to the property and located the abandoned delivery, it was completely soaked through with water and just collapsed when we tried to move it, and all the loose items fell out.At this point we realised that the item had also been falsely advertised.It was not in its original packaging at all (with the extras and value that entails), just the basic laptop loose in a brown box. An update to Mr Grech was supplied with photos and evidence (including the ‘Next Directory’ calling card).We reasonably expected the matter to be suitably resolved. To our disgust instead of a resolution, we received a rude, sarcastic and dismissive response from Paul Grech.He did not take the matter in any way seriously (ignoring the facts and evidence) and seemed to show an utter contempt for us.He also apportioned blame to us for only selecting ‘economy‘ delivery in an apparent attempt to up sell PRIME.He refused to allow us to return the item by suitable means, he refused to provide any replacement or alternative, he then attempts to bully us into keeping it as is. Paul Grech either has no knowledge or no concern for statutory rights, property rights, or disability rights. I then attempted to escalate the matter to the respective heads of Amazon; Mr Christopher North [email protected] and Mr Jeff Bezos [email protected] both Mr North and Mr Bezos did not feel that we warranted a response.To my surprise all we received was another dismissive email from Paul Grech claiming that ‘Chris and Jeff have requested that I respond to your letter and e-mails’. It is not clear why Paul Grech has directly targeted us, whether he has a problem with all disabled customers, or whether this is Amazon’s attitude to all customers now.Either way, as Paul Grech is apparently the highest level contactable person at Amazon, other potential customers should be aware of the terrible level of service to be expected from him. Due to these problems we still do not have a replacement laptop and have had to stop all courier deliveries due to security concerns.This has caused us considerable difficulties and will need hundreds of pounds spending to stop unauthorised access again. I hope this serves as a warning to other potential Amazon customers as we have not received any refund, let alone redress or ‘goodwill’.We received no redress or apology from Hermes management (if Amazon ever contacted them at all).All we have for our huge investment is worthless, unsafe, falsely advertised, unusable junk. Any help or advice appreciated.
  13. BACK STORY - The wife received a letter in the post about parking in a disabled bay with no badge back in november. (the wife said she was in a parent child space) this was the first we had heard of anything so after reading up and seeing alot of literature saying not to ignore it I replied in appeal stating no notice was placed on the car etc this got rejected after further correspodence that has now resulted in solicitor letters in which they have sent photographic evidence which show that the dizzy cow was actually in a disabled bay (next the parent child) and that if the find isnt paid within 14 days it could result in court action i think i know the answer already but just thought id ask after finding this site is she liable to pay? if no payment is made do you think it is likely to go to court? if so what are the reprecussions of this? has anyone had any experience thanks in advance
  14. I have a legal document which gives me authority to deal with any and all of my disabled son's financial affairs. Lloyds TSB denied having seen the document but I have proof they knew about it following an unrelated incident some years earlier. Without my knowledge or permisson they mis-sold my son various insurances, let him overdraw his account and lent him THREE loans. The second loan to pay off the first and the third loan to pay off the second. In all, they are charging him a monthly fee for the privilege of having overdraft, charges for unauthorised overdraft, charges for the loans and other fees. He is due them anout £12,500. Due to some of his medical problems, insurance bears a loading of 75% ! (They STILL relished forcing him to take!) After much complaining, the admitted the mis-selling and gave full refund of all the insurances and token compensation. (I got them to give another 50% after further complaints about their incompetence.) HOWEVER, notwithstanding their admission of mis-selling, they refuse to admit the overdrafts and loans were mis-sold! Even more astounding, the Financial Ombudsman is letting them get away with it! No wonder the net is full of allegations about The FO being corrupt ALSO! Any ideas what avenue to go down to force these EVIL people to admit full responsibility? My Member of Parliament is now involved and I intend to advertise these EVIL acts in every forum and elsewhere on the net. I will explore the possibility of contacting the press and television. It is SO blatant and yet they reckon they have got away with it! NO EWAY, EVIL, INCOMPETENT LLOYDS, YOU ARE GOING DOWN!!!!!!!!!!
  15. Good morning all! Basically after a bit of advice. The company that i work in has been taken over and we all got TUPE'd over and after reorganisation of the company I am going to be made redundant in the near future. Being disabled I am only fit enough to work about 22 hours a week and I get enhanced rate in both the Mobility and Care components of PIP (as well as Disabled tax credit which will end soon after I am made redundant). I presumed after being made redundant I would be able to go on JSA whilst I found another part time job. But then I discovered that like most areas single claimants are now being told to claim for Universal Credit. However having looked into UC (and testing the waters by applyiing online) I see I can not apply for it because I am on PIP. So what benefit am I meant to apply for?
  16. Hi all. Its been a while since I posted on CAG but I am concerned about the LA and the DFG. My uncle is in his mid 80's and suffers from dementia and severe arthritis in his knees so walking is a major problem for him. I had to take over his finances because a young nephew "stole" all his money and left him struggling. Social Services got involved and got him to go to a day centre which he had to pay for. His condition has deteriorated and now has care in his home. At first he was paying for all this care and it took me some time to persuade Social Services that he could not afford this. My uncle then had a financial assessment (he owns his home but has an equity loan on it) and it was decided that he could get financial help with his care. The problem being that him firstly paying for his care had drained his bank account. (Sorry for going on a bit) His deteriorated condition has led Social Services to insist that he needs a ramp to his front door, so a DFG was applied for. (All going well). Another financial assessment was done and it turns out that he has to pay over £2000 towards the cost. He does not have that kind of money. It has taken me more than 2 years to get some sort of order to his finances but all that Social Services say is that we (SS) with go to court and get an order to take over his finances. I have explained to them all of the above plus other points but they are not interested. I do not have Power of Attorney, when I realised that PoA was needed it was too late because of his dementia. Can SS do that (take over his finances) without any input from relatives.
  17. Hi, hope this is the most relevant forum, if not please move. Try as might, attempted to find out answer to my query but my LA does not give any details on this subject. Nor does there appear to be any legal website giving law surrounding! However,as the title says, due to parking problems some years ago, our road/close/avenue, is a residential parking permit area. In addition, each resident is allowed to apply for upto 2 visitor passes. Parking, even with permits, now seems to becoming a problem again. My question is quite simply, is it possible to apply for residential disabled parking bay within a residential permit parking area? Different LA seem to have different approaches to this, but as previously mentioned nothing on my LA website, merely blue badge information. I am in possession of blue badge, as are a couple of other residents, but the added difficulty is our next door neighbour who, if the opportunity arises, parks his vehicle over 2 spaces (there are no marked parking spaces), causing us to seek at times a parking space 2 or 3 times distance from where we are normally able to park as close to our flat, although still within residential parking area. Wondering if any readers had/have similiar problems ways or resolving. Grateful for any responses and advice.

Issued today (again to 'er indoors), and altho there are 'mitigating circumstances' for her egregious lack of consideration for those less mobile, I don't wanna offer them at the moment for fear of appearing to excuse her reprehensible behaviour. It was a Morrisons car park, free to use for 2 hrs, and I'm the RK. I'm going to await the NTK as usual, but at this stage (at the risk of being a bit previous), just wanted to know the current position regarding disabled bays in private car parks, and the extent of driver ID disclosure required by law. So, 1. Is it still the case that disabled bays on private land are not legally enforceable (so presumably no locus standi?), and 2. When I get the NTK, am I obliged to tell them who the driver was at the time of the alleged infraction? If no to 2., then presumably my response to the NTK will be the usual 'please take the matter up with the driver, and I'm only giving you 3 guesses....... .....etc'?
  19. Hi I wonder if anyone can help. My wife has mobility disability. I parked at Iceland Hemel Hempstead, on 21 April 1016, in the disabled bay, and badge displayed on front dash. We shopped at Iceland then went home. Subsequently we got a PCN for parking without paying. I appealed to Excel parking, and wrote to Iceland customer services. The latter were unable to help. Today I received a letter stating that the appeal was rejected. I can now pay the fine or appeal to IAS. I am considering appealing as I don't think the signage at Iceland IS ADQUATE. There are two to 3 large signs on entering the car park saying that parking must be within bays etc, and that disabled badges must be displayed, but they do not state that badge holders must pay. There is a smaller sign by the pay machine which does indicate that disabled badge holders must pay. We have not had to pay at any other supermarket and the signs at the entry did not state this, so I did not go near the pay machine to read the sign which stated that disabled persons must also pay. I believe the signage to be in adequate. Will this be good grounds for appealing. I have taken photographs of the signs and of course I am now not going to shop at Iceland again
  20. Hi, We (the family) are undertaking a project to convert an attached brick building into a utility area and a wet room for use by a disabled member of the family. The contractor (who is non-vat registered) has requested that we purchase and supply the wet room fittings that we would like. We are happy to do this and in fact would prefer to do so. But we would like to claim the VAT Exemption on the eligible items. I know that in order to claim the exemption that we would need to provide a letter from the contractor confirming that the wet room is for use by a disabled person and also a HMRC VAT Exemption form completed by the person concerned. I have contacted various suppliers about how to claim the VAT Exemption and been amazed by their responses. Wickes responded with: "I can confirm that full prices including VAT must be paid through Wickes however once you have made your order you can claim the VAT with receipts through HMRC directly." Wrong, HMRC website specifically states that they will not refund VAT. VictoriaPlum responded with: "In order for you to claim your VAT back, we would require proof of disability from HMRC and also a plumbers report to advise items have been fitted for a disabled person". How the hell would HMRC know whether someone was disabled? Top Marks to ToppsTiles, who got it right. "To claim back disability relief VAT, you will need to complete a 10.1 form. This form will be located on the Hmrc.gov website. We will also require a copy of your sale receipt and written evidence from your builder. The written evidence from the builder must include that the goods and work being undertaken are used in the adaptation of premises for a disabled person." My question is: Has anybody else had to go through a similar process and did they find suppliers who were able to deal with this (online and in-store) and if so, who? Many thanks, Jedicris
  21. A SIX year old disabled boy from Swindon is receiving letters from the courts and the threat of bailiffs – for not paying a penalty charge notice. Brandon Blades, is autistic and can’t cope with crowds, public transport or unfamiliar spaces – he has been provided with a car as part of his disability allowance to help him get around.   22. Please advise! My 7 year old daughter is severely impaired and she has a blue badge. We use a wheelchair adapted car. We usually park in disabled bays. On 20th of Apr 2016 we received Parking Charge Notice from Gemini, parking operator ar Rivermead Centre Reading. The PCN states that the car exceeded the 30 minutes free of charge parking with 3 minutes. They've asked a payment of 100£, 60 payable in 14 days. My opinion : 1. I thought disabled parking (public or private) are free of charge. 2. The PCN was issued on 20th of Apr for a civil offence committed on 20 th of march - is thus corect? 3. The signs displayed in the parking are ambiguous without any mentions regarding terms & conditions. 4. I've sent an email to the Rivermead Centre asking for the terms and conditions that apply in their car park with NO answer back. When my daughter is not in the car we don't use the disabled bays nor her blue badge. I didn't find any other post with the same situation and I open this one. Hi, I parked in a bay marked only with a wheelchair symbol on the floor as I had taken an elderly gentleman out who uses a wheelchair, there was no other signs saying that you had to have a blue badge to park there. I bought a ticket but when I came back and I had a fine for not displaying a blue badge. I immediately got in contact with the council and explained the situation, they have refused my request. Do I continue to dispute or just pay up?

Blue Badge holder Cherry Clarke says she was physically removed from her Toyota Yaris by an officer before it was towed away from her home in Perry Barr in Birmingham. She has now been told she has days to pay the fine, which has risen to £93, or her car - her only means of transport - will be sold to pay the debt. Birmingham City Council claims it sent numerous letters to her address and that no Blue Badge was on display when the Toyota was taken.
