  2. Good morning A bailiff attended my mother in laws address to retrieve payment of near £1200. The debt is owed by her step son for driving offences. We only know this much because we read about it in the newspaper. The step son used to live at the property over 2 years ago - and hasn't since. The family no longer speaks to the son, and the bailiff visit came as a bit of a shock. The bailiff was rude, arrogant and happy to shout out repeatedly that he was going to take goods if she didn't pay - making a scene presumably for effect - he even threatened to ring the police... My step mum was frightened and didn't know her legal rights - and reluctantly paid £500. It was 7am and she had work and just wanted them to clear off. Just under 2 weeks previously, they had posted a leaflet with a contact number on - which father in law called and explained to the bailiff that the debtor was no longer associated to this address - and hadn't for some time. We have since contacted the courts - and they have told us that we shouldn't have paid. The court also told us the bailiff had a Warrant of Order - and should not have threatened to take stuff or call police once informed the debtor didn't live there. From what I have read up - this is the typical bullying behaviour that Marstons are seemingly licensed to employ. I have contacted Marstons and been fobbed off with an email address to complain to - interestingly they did tell me that their agents wore body cams - however I'm betting that this agents probably 'malfunctioned' during this visit as he certainly did not conduct himself appropriately. Where do I stand with this? The likelihood is now that they have had a payment - they will return for the rest. Is there a way I can challenge their initial visit and reclaim the money paid - purely because of their threats rather than culpability? Any help is greatly appreciated. Cheers
  3. Apologies if this is a common theme on this board but I haven't found an answer that fits my case. I've worked in a factory on a temp contract for a couple of months with the expectation of working there about six months. The first month all was great. My colleagues are all all seniors over 55 who have worked together and never had any temp colleague to deal with. At one point one of the manager pointed out that I could fit as a permanent replacement for one the seniors (which I don't want by the way). One of seniors did not take it well and since then has started taking exceptions at pretty much everything I do, in doing so he verbally humiliated before my colleagues. At one point I couldn't take it anymore and I verbally complained to the manager, which minimised the issue and didn't do anything serious to make it stop. Now my other colleagues have started complaining to the manager about me for petty issues. In other words they would rather want me out. The manager says he's on my side but refuses to take sides and said the workers have been there long and I shouldn't kick up a fuzz. The company is very small and there's no grievance procedure. I don't think I should be bullied into leaving but it looks like it's going this way. What can I do apart from walking out and sucking it up? I was thinking of writing a formal letter but I don't know what I should write. I'm at loss. If I leave I'll get no benefits and never mind any good references. Thank you.
  4. Previously loyal disabled customer harassed, bullied and ripped off by Amazon Unfortunately our trusty old laptop was failing and needed replacing. As this was a desktop replacement we required something of a suitable size and standard. This does not come cheap. As this was a considerable investment for us and having been a previously loyal Amazon customer for many years, we decided to purchase from Amazon based on (an apparently incorrect) perception that if there was a problem with the purchase then we would have good support and come back if required. We did however have reservations due to Amazon’s seemingly increasing controversies (taxation, employee treatment, PRIME etc). We decided on a particular laptop model and specification but unfortunately it was out of stock new.It was however listed as available from Amazon Warehouse in ‘very good’ condition with ‘original packaging’.Having not purchased from Amazon Warehouse before, we were concerned by the low customer rating of 89% but could not access any actual reviews of them. The website did claim that the purchase came with ‘all the benefits of Amazon.co.uk fulfilment and customer service’ and ‘All of our products are backed by Amazon's satisfaction guarantee’.Unfortunately we were mislead by these false claims and made the purchase. At time of purchase a ‘not before’ delivery date was agreed in writing with Amazon.According to logs this was ignored/not actioned and attempt to deliver was apparently made by Amazon’s contracted courier Hermes. Because we were away, Hermes apparently proceeded to trespass around the property and attempted to gain access to various locked outbuildings. Apparently after failing to gain access, Hermes abandoned the expensive and fragile laptop in an outdoor area at the back of the property – exposed to the winter rain and cold.A crossed out ‘Next Directory’ calling card was later discovered through the letter box (despite this being an Amazon purchase). When I learnt of this attempted delivery through online tracking, I emailed Amazon customer service but they did not seem to understand and instead attempted to send Hermes around to trespass again. With considerable concern for both the security of the property and of the expensive purchase, I had to write a formal complaint to Amazon ‘complaints’ in order to stop this.We received a basic response from a Paul Grech of ‘Executive Customer Relations’. When we later returned to the property and located the abandoned delivery, it was completely soaked through with water and just collapsed when we tried to move it, and all the loose items fell out.At this point we realised that the item had also been falsely advertised. It was not in its original packaging at all (with the extras and value that entails), just the basic laptop loose in a brown box. An update to Mr Grech was supplied with photos and evidence (including the ‘Next Directory’ calling card). We reasonably expected the matter to be suitably resolved. To our disgust instead of a resolution, we received a rude, sarcastic and dismissive response from Paul Grech. He did not take the matter in any way seriously (ignoring the facts and evidence) and seemed to show an utter contempt for us.He also apportioned blame to us for only selecting ‘economy‘ delivery in an apparent attempt to up sell PRIME.He refused to allow us to return the item by suitable means, he refused to provide any replacement or alternative, he then attempts to bully us into keeping it as is. Paul Grech either has no knowledge or no concern for statutory rights, property rights, or disability rights. I then attempted to escalate the matter to the respective heads of Amazon; Mr Christopher North cnorth@amazon.com and Mr Jeff Bezos jeff@amazon.com.Unfortunately both Mr North and Mr Bezos did not feel that we warranted a response. To my surprise all we received was another dismissive email from Paul Grech claiming that ‘Chris and Jeff have requested that I respond to your letter and e-mails’. It is not clear why Paul Grech has directly targeted us, whether he has a problem with all disabled customers, or whether this is Amazon’s attitude to all customers now.Either way, as Paul Grech is apparently the highest level contactable person at Amazon, other potential customers should be aware of the terrible level of service to be expected from him. Due to these problems we still do not have a replacement laptop and have had to stop all courier deliveries due to security concerns. This has caused us considerable difficulties and will need hundreds of pounds spending to stop unauthorised access again. I hope this serves as a warning to other potential Amazon customers as we have not received any refund, let alone redress or ‘goodwill’.We received no redress or apology from Hermes management (if Amazon ever contacted them at all). All we have for our huge investment is worthless, unsafe, falsely advertised, unusable junk. Any help or advice appreciated.
  5. Hi, I'm hoping to take on the HSBC as they are crippling me at the monent with charges on top of charges.
  6. Hi all I will try to keep this brief but basically my partner has been off work due to work related stress for 4 weeks. He is being bullied by his boss so much so that he got ready for work as normal one morning and then just broke down, crying and physically trembling and could not go out of the front door. I got him to the doctors the same day and he is now having to go for councilling because his stress and anxiety is so bad. He is in his 40's and this has all had a very bad effect on him. Most days he cannot even speak to anyone from work as the stress of it just sets him back and he breaks down so I have had to speak to them on his behalf but either my partner or myself have kept in constant contact with them with updates. His boss is fully aware that my partner is ill because of his actions but he is insisting on a welfare visit next week. We said we didn't have a problem with the visit but requested that it be with my partners Service Manager and someone from HR. He received an unpleasant letter from his bullying boss yesterday basically saying that he is aware my partner has refused to see him but he has got to have the meeting with him and the Service Manager. Instead of it being at our home his boss wants the meeting at a venue close by and will contact him with the details shortly. He has also made reference to the contact by my partner and wants an explanation why he is not contacting them. Even though he has been, either himself on his better days or when they have phoned I have spoken with them. There has been contact at least 3 times a week. It was made clear that a meeting with the boss would be detrimental to his health but he is willing to meet with a different manager and Hr but his boss has totally disregarded the well-being of my partner and since the letter came yesterday he has been in a right state and he now has to worry about the meeting until it happens next week. He is just not strong enough mentally to have a face to face meeting with this person. My questions are, can I attend the meeting with him as my partner has admitted to me that he is scared of him and also is there anyway that we can insist his boss does not attend? We are currently drafting a letter to raise a formal grievance against his boss.
  7. Hi, I have worked for a company for under a year and I am being bullied and harassed by my boss, I have been undermined in-front of my staff that I manage and made to look stupid in front of other managers. Our HR department is not being supportive and they are closing ranks and through my conversations with them they make me feel that this is my fault. I confided in another manager about my concerns and he informed my manager, now my position is now untenable. I am currently signed off with stress and feel that I have no choice but to resign. I have no job to go to and I am worried about money. I need advice, should I resign?
  8. Hi, I have worked for a department store for the last 6 years. I have been Senior Management for all these years and Full Store Manager for 3. My store is performing to all the given targets (sales, shrinkage and salary) and the standards of the store are high. I am contracted to 42 hrs a week and never do less than 46 hrs (overtime is unpaid) I got a new boss a few months ago and since then problems have started. Although nothing has actually changed with my store standards or sales dropping. Those senior to me are taking a lot of interest in my store and myself. There is a new roll-out on Management training and I have been told I have to go away on a months training (although the standard course is a week) There is no other Manager in the Region being told they have to go on a months course. I have been told I need the 'extra help' but there is nothing to back this up. I have had no warnings or performance meeting and no disciplinary action taken against me. It seems my face doesn't fit at the moment. I belong to an 'enforced' but unofficial work group on my mobile and this seems to be used for my immediate Manager to bully me. If I respond (in a rational manner) then I just get comments like 'Boo Hoo' and 'Work Harder' etc. Is there anything I can do? My immediate Manager is obviously not interested in what I have to say and I imagine his Manager feels the same (judging by recent conversations) and above that is really just the owner of the company and he is just of the 'If you don't like it, f*** off' type (in fact they all are - they laugh about the fact you cannot go to tribunal without paying up front any more and so much more) What can I do? H.R will just refer it to the owner and all hell will break lose. Thank you in advance
  9. Hello again Everybody, After a long absence I have returned to the site. I have two questions. How do I make a donation please? I received advice a long time ago and could never afford a donation. Not much better now, but a bit:) And I am being bullied at work by my line manager. She has extended my probation period under the guise of poor performance, but it's she who has prevented me from doing my job by saying no all the time. Has anyone else been bullied by a charity? I would appreciate any thoughts.
  10. A month ago i was assaulted by a pupil in school who has been charged with GBH (and admitted it). My husband works in the school as a teaching assistant. I have been working for them for 13 years, no disciplinary ever and up until this assault been told i am their best teacher. I would say that although i am not qualified i have been working as a teacher for the last 10 years. The school is an expensive private school and my bosses (a married couple) were furious that i reported the assault to the police. They said i shouldnt have as they were going for a contract that they wouldnt get if the education authority found out. They also said i shouldnt have gone to the hospital as this brings attention, the lad broke my cheekbone whilst headbutting me! The lad is bailed and cant come into school atm. They have been absolutely vile to me and my husband since this and trying to trick me into wrongdoings since. They didnt get the contract which they blame me for and indeed have said they have been threatened with an emergency ofsted inspection as they clearly tried to sweep the assault under the carpet. My husband and I have just turned up to work and done our job and put up with the dagger looks etc. They have sent references to bible verses saying we should forgive the lad and just generally being nasty. As we have refused to be intimidated they have now upped their efforts to unsettle us. This morning they sent us this text:- Hi guys, you know we think the world of you and, when you are working on all cylinders, you are great with relationships and interactions. However, it has come to light that some very serious things happened when we were away at the conference (this was early May when they were away for a few days) which need to be discussed immediately prior to you returning to school. We are available this weekend and can fit in with you (we could meet where you want to meet) If you cannot meet this weekend, we ask that you stay off school until you can meet us off campus - God can make a way. Absolutely nothing happened that either of us can think about and it was weeks ago so surely if there was anything they would have spoken to us about it. I know they are just trying to intimidate us and will probably try to either fabricate something or blow something small out of proportion to discredit us in some way. Any advice how to handle things, it would be very difficult to meet them anyway due to existing commitments. Can they ask us not to go in and if we dont, surely they have to pay us. I have joined a teachers union this morning but all other avenues of advice are shut over the weekend. The stress they are causing us is untrue, I am on heavy painkillers not just for the injury but also the headaches that the stress is causing. My doctor wants to sign me off but i cant survive on statutory sick pay an besides, why should I when I havent done anything wrong at all. Please advise, thanks so much.
  11. I placed my shop counter on eBay for 'Buy It Now' for £40 with the clearly identified condition that the buyer must collect the item. An eBay buyer [EDIT], won the item and duly paid for it. However, in the end, the buyer decided that collecting it was too much trouble for her and she opened a complaint against me to eBay that she hadn't received her item. The item remains here and has been waiting to be collected for 3 months. I made every effort to assist her to collect or have the item delivered for her item but she was too lazy to be bothered. eBay, in their wisdom, have decided that because the buyer hasn't collected the item, then she hasn't 'received it' and found in her favour, they themselves refunding the buyers £40. I am refusing to reimburse the £40 to eBay out of principle and as a result have had my buying and selling priviledges withdrawn until I reimburse eBay the £40. We are still storing this item and insist that eBay have transgressed their own regulations and contract conditions as a sale is a legal contract and I have done everything I was contracted to do. I submit that as eBay have 'paid' the buyer her £40 without my permission or accepting any remaining liability in any way for this item, they are now the owners and I am pursuing them to collect the item from me and settle the 50p per day storage charges they have incurred. They in return continue to regurgitate the same incorrect 'facts' and send steriotyped 'DEMAND' emails every day! eBay. consider. that because they hold the ability to suspend the trading powers of members who they don't agree with, can bully those members into surrendering and agreeing with their 'judgements' no matter how illogical, unfair and nonsensical those judjments are. Colin Lewis. I am also seeking out other blogs upon which to air and spread my complaint. Any suggestions?
  12. A friend has 7 year old twins. One of them is deaf and wears hearing aids. The children in his class are pulling them out and breaking them. He can't hear without them. She's spoken to his teacher who has said "we can't watch 35 children at the same." His aids have been sent off to get fixed and he has nothing in the meantime. He will struggle in the meantime. He's not profoundly deaf and receives little / no help and won't receive help whilst the aids are being fixed. The teacher replied that as children who are in year 2, (6 & 7 year olds) they should be taking responsibility for themselves. School claim he doesn't have a problem as he lip reads. She's rung the school and is hoping to speak to the head later. What are her options, please? He can't reach his full potential because the other children are pulling out his hearing aids, meaning he can't hear properly. I have told her to mention the Equalities Act - he can't reach his potential due to the lack of support.
  13. Hi, I worked for a company for nearly five years, I used to love it. Then the last few months, the company started to struggle and the boss was hardly around. Out of the blue I got handed a long list of 'evidence' constituting in the whole to gross misconduct. Earlier we had been given a contract to sign which had changed and I hadn't signed it and written a letter stating I wasn't happy to. I think it was this that angered the boss who then knocked my hours down and spent the time I wasn't in trawling my computer and printed off so called evidence. Silly things like joke emails and banter, that sort of stuff. I'm pretty sure it's not gross misconduct. I was the hardest worker there. And I was accused of being a detriment to the companies success. I feel victimised and bullied, and because of my treatment all the other staff members left within the space of 2 months. There isn't anybody there anymore. Both disciplinary and appeal hearings seemed to have already predetermined outcomes and the sheer tone of voice in all the letters I have received is extremely upsetting. I logged it with the tribunal as unfair dismissal as I believe whole heartedly that I have done nothing wrong. I am now currently going through the process of case management orders. I have met all the deadlines and adhered to them. The bundle of documents has been sorted, even though I had to make the respondent aware quite a few of my documents had not been included but listed, and both parties have exchanged witness statements. It has been a month now and the respondent has suddenly decided to add an additional set of documents to the bundle. I suspect he is only doing this now as he has read my witness statement and is trying to cover himself. Is he allowed to do this when the date has passed for the case management orders? It seems a little unfair as he could just keep adding more and more up until the day itself, and I have to prepare myself for it all. It's messy enough as it stands without any extra in there. The message has come through his solicitors who basically say in no two words they are adhering to the respondent. I'm surprised a solicitor would allow it. I would have thought the dates on the case management orders are there for a reason. Any help on what to do would be most appreciated. I don't have a solictor, I'm going this alone as I can't afford one sadly. Mainly because I'm out of a job now due to all of this. I'll be glad when it's all over to be fair.
  14. Hi, I've moved to UK nearly 4 years ago. I left a very good, managerial job in my country to join my british husband. After 4 month intensive job hunt I have found an admin job in one of non profit organisations. I accepted the fact my employer ''didn' recognise'' my previous experience asking me to gain some British office experience, and it worked pretty well. after one year I was given more responsible role but then I left for my maternity leave. The organisation underwent loads of changes while I was away, the role given to me before I left was terminated. I am now working part time since nivember. I didnt get my new contract yet, they never gave me my new role name so decided to put an admin assistand in my emails just because I thought it's nice to have a role within the office. . I feel like a thing. People (other workers) are comming into the office asking my manager if they could ''rent'' me for half a day, day or so ,just as though I am her personal belonging. I am never asked if I am busy at certain moment, I am just given an order. When I refuse my manager is ignoring me for the rest of a day. If I am not helping other people I am usually given tasks like: shredding, cleaning up cupoards, addressing envelopes also carrying boxes. When I am asking for more responsible tasks and more work i am given some data to entry. The unfortunate thing is that I've started to believe I am useles and not qualified enough to work in this country which, makes me feel terrified to loose this job even though I hate it. I used to be a manager in a busy office working with some of the biggest factories in Europe and now im cinvinced I am not good enouth to shred a piece of paper in UK. although people are friendly their actions towards me makes me feel worse than they are. there i loads of jokes about my nationality which started to bother me now as they are usually said in front of visitors in the office. what do you think about it? Am I just being dramatic?
