  1. My partner has a CCJ against her which we found out about when applying for a mortgage recently. The CCJ was created by Vehicle Control Services Ltd. PCN at St Andrews Retail Park because she alledgedly parked incorrectly or for too long. We still don't know which. She changed address a month after the parking occurred in November 2014. She didn't receive a ticket at the time (in fact we think she was in her shop at the time of the 'incident' and not even in the St Andrews retail Car Park), she hasn't had any communication about being taken to court and she hasn't had any notification of losing the case either. We think all correspondence must have gone to her old address. The 'offence' occurred on a Monday at 4.19pm. Her shop is a mile away and doesn't close until at least 6pm. BW legal must have sent the forms to her old address and not bothered to check if the address was still valid even when they took her to court in September 2016. I'd be grateful to hear how to remove this CCJ without paying the £255 to contest it. Surely a person can't be issued with a CCJ without any written information whatsoever? That can't be legal can it? There was no parking ticket issued either.
  2. Hi everyone Babbling on behalf of my boy as hes not too good at asking for help Hes late 20s. He moved out of his home in January to rent. His ex asked him in August to move in with him temporarily, he said no, she whined on that she couldnt go anywhere else as her friends had said no too she moved in with him for a bit. He gave her a deadline of the 20th to leave, she didnt. Shes not on the tenancy and the police were called. they told her they would return to chuck her out but havent since come back. She is now claiming she cannot be removed, as she saw it on telly about some 28 day period and she was invited there that she has rights. Questions Can she stay there? Has she got these rights to stay after some 28 day period? Has my boy got to confess to his landlord and possibly get evicted to boot? Any help would be grateful Bravo Zulu!

  5. Asking for a friend and any advice appreciated. She is on universal credit with her partner(female) and two young children and had a job working early morning shifts whilst also trying to earn money self employed (all declared). She has suffered bullying, humiliation in front of colleagues and sexual harassment from her boss, the owner of the business. She is also disabled and in receipt of mobility DLA. One of the children is also disabled. Yesterday she had enough and, in tears, walked out and refuses to go back to work. They have been trying to contact CAB for advice but are worried that she will now face sanctions for leaving her job voluntarily, although, as I understand it, she seems to have good reason and will be pursuing legal action against her boss. (Sanctions are only imposed if you leave your job WITHOUT GOOD REASON as far as I know). Can someone advise, is she likely to be sanctioned? How difficult is it going to be to get redress for the harassment and bullying? Thank you.

The tale told was quite shocking and I was surprised that the coroner reckons that neglect was not a contributory factor into their deaths !. I think I would rather go to Switzerland and take my own life than end up in a care home. I guess you cant tar them all with the same brush, but even those where residents pay very high fees are coming under scrutiny !
  7. Hi, folks I recently had a PIP assessment and was shocked when the HP admitted that she hadn't bothered to read either the form or the supporting evidence, prior to the "assessment". I was wondering how this will play out at a tribunal? I recorded the whole assessment on my wife's phone
  8. I have not earned enough to pay back my student loan for the last ten years. I now find I am slightly above the threshold, if indeed it is a monthly threshold. Over the course of the last year I have earned less than the yearly threshold. Over the course of the last three months I have earned less than the threshold (divided by 4). However, the fact remains that my monthly salary is currently above the threshold and has been for the last two months. How is the threshold calculated? Is it on the previous years earnings divide by 12? On this months earnings? Thanks

Hi i have had a similar experience with a child minder She took me via MCOL to a county court over a debt the claim was struck out but now she has instructed bailiffs.(correction -a dca - DX) What I need to know is if the claim was struck out how come she can instruct bailiffs , has she broken any laws in doing so and can i now counter claim?
  11. Hi, My good friend has been on sickness benefit for a long time at one point she was on dla too. It may have change and she may just be on a pension now, I do not know but will find out. she was taken very ill and is in hospital. However they say they will release her soon. However there are some urgent functional problems in her home that have not been repaired that need repairing plus lesser urgent but equally important work needs doing maybe costing altogether £5,000 upwards. This is aside from cosmetic re decorating that seriously needs doing too. I recall a lady on the programme 'benefits street' got a benefit loan of a £1,000 which she pays back in small amounts, to redecorate her house from orange to purple. What benefits, emergency funding etc. is available? I can pitch in and help, but sadly I can not pay for the work to be done which I would prefer to just be rich so I could just have it all done in a few days for her! Thanks in advance, Clear33
  12. Our Landlady has constantly dropped hints that this 3 bedroom house should be for a family not a couple so my Mrs and I are looking for somewhere else (daughter left home). Talking to Landlady yesterday she said she'd give us back the deposit 10 days after we leave. She's a tight bitch so I don't trust her. 1. Is that even legal? 2. Whose to say she wont just walk around the house making up stories to diddle us out of our deposit money?
  13. Hello. My Mum lived all her life with her sister who bought their house under the right to buy scheme. Sadly, my aunt died prematurely last November leaving no will and an outstanding balance on the mortgage of 70k. House is worth about 120 approx. The mortgage company are Amber Homeloans and are notoriously dreadful. They have merely sent letters saying she has 12 months to sell. In the meantime she is paying the interest only. My Mum is sole executor and has been granted letters of administration. Under intestancy rules she is only entitled to a 6th of the estate as there are 6 siblings (all comfortably off, married, secure) but 3 of them think they are entitled to their share despite my Mum being left with hardly anything to secure her future. Just wondered if there was anything I've not thought of that would allow her to stay in her home
  14. My mum has been in her Private Rented house for 13 years. Her landlord is a local company who has several managers covering different areas. The house is in a dire state and needs lots of work. The toilet in the bathroom is leaking (been reported but nothing done), the leaking toilet has caused some of the ceiling to fall down in the kitchen and the rest is sagging, the bathroom floorboards are rotten, the downstairs toilet doesn't flush, the back door is difficult to open and close (made of wood), most of the window frames (wooden) are completely rotten and my mum can't open several of them, My mum never wants to make a fuss so I contacted the Landlord Manager by email. He told me to get my mum to contact him which she has now done (although she is not happy with me. Manager told her that she is responsible for the leaking toilet and the kitchen ceiling which I don't think is right. He also said that he has sent someone out several times to measure up for new windows but there is never anyone home (this cannot be true as my disabled father never leaves the house) and that the bathroom is getting replaced (but he told me this last year) and still has not been done. Can anyone give me any advice on what I can do?

  16. My daughter has just finished being a frightnight actor at an attraction. She was asked by the boss to be at work for 8.30am every day, for make up but was told that she wouldn't paid until the place opened at 10.00am. She was told that she had a two hour unpaid break in the afternoon from 4.30pm to 6.30pm. BUT she was expected to be in make-up getting ready during this two hours break. Question is, is right that she doesn't get paid for those hours even though they form and integral part of the working day? If he's asked that she be there early, does he have to pay her if he's requested her presence? All thoughts gratefully received.
  17. two weeks ago a vehicle hp agreement was voluntary terminated after reaching the settlement figure {1/2} the direct debit was then cancelled before the next payment was due. there is a seperate agreement liabilty of £1,392.55 for ppi, yesterday she was told that she must keep paying the full monthly agreement of £342.29 until the ppi is cleared. is this correct as the statement of price reads payment protection 48 months at £57.43. I believe she has been mis sold this ppi on a couple of major issues. {1}she holds 2 jobs both over 17 hours a week and the finance was given on the added figures of these jobs, she would have to loose both jobs for the unemployment part to kick in. {2}She is a civil servant 35 hours a week so gets paid while sick so there was no need for sickness part {3} she was told it help her case for finance if she took out insurances does she have a valid case for claiming back the ppi thanks for any help peeps
