  1. Hi, I am hoping someone can help. I got home today to find a letter from High Court bailiffs, stating that they had called to seize goods and would be calling the following day to seize them, whether I was home or not. The problem is that it is for a CCJ I did not know I had until three-four weeks ago, as the CCJ was given to me at an address that I had lived at, but did not live at at the time they did court proceedings (I hadn't lived there around six months when it was granted). I only found out when I got my credit file that it had been given just over a year ago. I phone the high court office, and the lady said I needed to fill out an income and expenditure form which she would send in the post, and that I should ring the bailiff to tell him I had spoken to the office. I am on income support and disability benefits (DLA, SDA) as both I and my partner are registered as blind. I phoned the bailiff on his mobile, and he said the fact the CCJ was put on me at the wrong address is 'by the by', and that he would put the claim on hold for ten days. The amount is nearly , and was from university where I was receiving a scholarship but had to leave due to ill health. They had already paid me 3 months in advance, and I left after a month (not a month into the PhD, I was in my third year, but a month into that particular payment), on their request, as I got very ill and couldn't study any more. I couldn't afford to pay the money back, as whilst they were paying in advance, I was having to pay back debts in arrears, so the money had all gone. A big chunk of the debt is in court costs and interest etc. The university were paid in big chunks by the people that held the scholarship, and them paid me every three months (they got the lump sum at the beginning of the academic year). I just don't know what to do, if I had known I had a CCJ I would have been paying it, but \i am scared that they will not accept my payment offer, which is going to have to be small, and they will come and take my stuff. The weird thing is, I got a letter in the post this morning from a debt collector, telling me I owed 3100ish to this place, and if I didn't pay within seven days they would apply to get a court judgement against me. I'm scared and don't know what to do. Please help.
  2. We have been chasing Capital One since March 2012 trying to get PPI money back but to date no success. Because of my ill health and poor postal service in my area, even the FOS has decided not to help us Everything was down to time limits and when I got ill, all timings got put aside. Now, Neither Cap One or FOS want to help. Cap One have been charging us PPI since 2002. Has anyone got any good ideas or should I just forget the whole thing
  3. My brother is a colossal idiot who ran off from a taxi without paying fare, has since not bothered to pay the fine, and it has rocketed up to £1000 + over the months he's been ignoring it. He doesn't live at home with myself and my mother any more, and hasn't since last year. However, Collectica don't seem to care despite being told this on more than on occasion. This morning I heard a car engine idling outside at about 6:30/7.00. No knock, but when I went downstairs later there was a 'Notice of Removal' through the door (with no time on it, the time/date space has been left completely blank.) 'Please note that the amount now due is £1043.13 inclusive of charges for today's visit. If this amount is not PAID IN FULL, IMMEDIATELY, a further call with be made, WITHOUT NOTICE, to take control of goods and potentially REMOVE FOR SALE by public auction. Such action will render you liable to further substantial costs. Please see reverse for schedule of fees and costs. To avoid such severe action, please contact me on TODAY to arrange payment.' I'm frightened to be honest, I can't cope with situations like this as I am on ESA for severe anxiety and depression. I don't know where my brother is or how to contact him, as we don't get along, and if I told him about this he wouldn't do a thing. I phoned Citizens Advice this morning and was kept on hold until my phone credit ran out completely. What can the bailiffs do? My mother is the tenant and she's currently away so I'm the only one in the house besides the dog, I don't like the thought of having to face this alone. Can they break in if I leave the house, or take things that belong to myself or my mother if I don't have receipts for them? (The only things left that belong to my brother are a few clothes.) Do I or my mother have any recourse to stop this?
  4. I recently had an offer of £700 as a full and final payment accepted by Barclaycard. This was paid and I received a letter from them stating that the account was now settled. Today I got a statement saying I had a balance of £541.38 and that includes £18.75 in interest. What should I do? Should I just ignore it or call them? Any advice greatly appreciated.
  5. Hi there I am looking for some help/advice please I returned to the UK approx 18 months after living in Australia for 4 years in NSW. I had a couple of credit cards still owing when I left. I received a phone call from Credit Corp this morning chasing $7500 on one of the cards (ANZ credit card). They were really horrific to me on the phone demanding payment in full by Friday this week. I told them that I couldn't pay this and they eventually offered to set up a payment plan of £400 per month again which again I said I couldn't afford. The guy got very angry saying that he needed to secure a payment plan with me today otherwise they would consider handing the debt over to a UK agency. He finished by saying he would email me my options and needed an answer in 24hrs after I had looked into my financial situation. Realistically I cannot afford to pay more than £100 per month after reading some threads on here I wonder what the best course of action can be. Would they hand this over to a UK firm? Is this legal if it is an Australian debt? He also said that if I offered less then £300/month on the payment plan they would need to see my UK bank statements, pay cheques and outgoing etc. ...Are they allowed to ask for this? Thanks guys for any help you can give me.
  6. Hi All, Ive been able to get Lowell off my back previously through this website I am hoping I can get some quality advice this time around as well. Im being chased by Lowell for an old debt with HSBC. I had an account with HSBC and back in my stupid student days ended up withdrawing some cash over my over draft limit. This resulted with a balance of £742 with over half of these just being bank charges . The last time I used my HSBC account was January 2009 , however, Lowell has got an account Default date of September 2009. I believe that this gives them some extra time to play with the statutory limit of expiration. Recently, they offered me a small discount but I also contacted them by email with an offer to settle the dispute that they turned down and are now demanding the full amount. I have not paid any part of this debt since it became defaulted. I don't want this issue to escalate any further and especially for Brian Cater to get involved. What do you guys think are my best options? Should I try negotiating for a full and final settlement or just agree to a payback agreement of the full amount? Secondly, should I challenge that this account is in fact statute barred? But I don't know at what point the clock starts ticking for this account. Would it begin from the last time that I used this account or are Lowell correct with the default date of sept'09? Thanks in advance for your help. I really want to get this issue resolved as this is the only issue impacting my credit report and any future mortgage applications I may need to make.   7. Hi Took sky out last year as when i lived at my previous address it was a non virgin area so i could not install my staff rates discounted services as i work for Virgin. So i ended up taking a contract with sky, 11 months down the line me and my misses decided to get our own place together and was very pleased to see our new property was in a Virgin Media cabled area so i could benefit from the £12.50 a month staff pack. So had sky installed upstairs in the bedroom and installed my virgin staff services downstairs in the living room, had nothing but hassle trying to get a signal with sky, (bad place to put my dish) so i called them out engineer comes out checks it all ok so he says, i tryed explaining when the bad weather picks up the signal drops and can go off from 1 hour to all day, he said there isnt much he can do apart from book the dish in to be relocated i declined as i said i was cancelling next month anyway so he never bothered. My sky went off for 4 days straight due to the bad weather so i phoned up saying i want releasing 11 months into my contract as im not paying for a service i cant use, the lady on the phone cancelled with no questions, i then got an email 3 days later saying sorry you have decided to leave sky. Got a letter few weeks later saying i owe them £22.49 and if i dont pay within 14 days they will refer it back to sky to take court action against me. Do i have anywhere to stand here ? i know its only £22.49 but dont see why i should have to pay them money for nothing

  9. Hi I need a bit of help, Back in 2007 I joined Roko gym which I stayed at for 2 years no problem. November 2009 I decided to give notice to leave as I wasn't ever using it. I wrote to them dated 1st November stating my intention and giving 3 months notice. The last day of membership should have been 31st January 2010. They wrote back saying I was to pay until the end of February as they received my letter after start of November. I was so annoyed by this I cancelled my DD and wouldn't pay them any more money. My last payment was 1st November 2009. What followed was the usual from Roko and CRS. I sent CRS a letter from this site in March 2010 saying I have no contract with them, I would not acknowledge any debt and would have no contact with them. After that they sent me a few more letters last one being June 2010. I haven't heard a thing since then until about 6 weeks ago I started getting texts again and 2 letters went to my old address (I could tell by the return address) which I sent back. Now they have found my new address and it's all started again!! Are they allowed to chase me now seeing as I haven't heard from them in so long? Should I resond or continue to ignore? The latest letter threatens legal action or passing to another DCA. Thank you
  10. my sister received a demand from intercredit international demanding payment for £1283.16 from her previous address that she moved out off in march 2006. with a start date 1/4/2005. she phoned south staffs water and authorized me act on her behalf because she is disabled and i look after all her affairs i explained that there is an error because all her bills are paid by direct debit and the facts are she moved into the property in May 2003 and a direct debit was set up and moved out March 2006. i myself called them up and stopped the direct debit and set up a new one for the new address still with south staffs. were payment has been taken ever since with no arrears. she told me that they were unaware she had moved out and continued bill the old address as the new tenant did not register themselves at the address. i asked why they had not sent any letters out as i redirected the post for a year. she said she did not know but confirmed there was not arrears on the account until the date of moving out. and would get credit control to call back. credit control called back and said she had readjusted the bill and wanted payment of £144 as she said that whats outstanding. she said the direct debit was cancelled about 10 months earlier. i told her that i,m not going to argue about it because it was a statue barred debt and its paid any way this annoyed her and said not its a statue barred debt as they have been trying to trace her and makes it enforceable. i said well your 3rd party debt collectors found the new address. why couldnt you, she got quite irritate and said they will now use the county court to enforce it if she doesn't the amended bill any thoughts

Hi everyone can anyone help or give me some advice please. i took usenext out, the yearly one in july 2013, it expired in july last year and ever since they have been trying to get me to pay another years subscription, which i never wanted in the first place, its gone to some sort of collecting agency since and they are now asking for 165 euros due to costs, i dont see why i should pay and there terms and conditions they use stink. obviously i havent been able to use the service due to this bill problem so dont see why i have to pay for a service i cannot and dont want to use, below is a copy of the email, any advice anyone, can i get out of paying for this somehow. sounds like a very unscrupulous company?   12. A marston agent attended my property and wrongly executed a warrant that had been dealt with by the issuing court. The court in question had not relinquished the warrant but I had all the relevant paperwork to prove it had been dealt with but the bailiff refused to take that s proof or let me call the court for them to clarify. I was not at home at the time but my heavily pregnant partner was, by the time she called me she was hysterical and in floods of tears. The agent had terrorised her with threats saying that he was going to remove goods unless payment was made in full and that he was not going to accept the paperwork that proved the warrant should not have been executed. I spoke to him and explained that it had been dealt with in court and a call to the court would get it rectified but he point blank refused and said that if I didn’t make payment now he would get the removals van. I felt that I had no choice as I was extrememely concerned about my partner’s condition being so heavily pregnant. I paid over £1000 over the phone and when I got home a quick call to the court proved I was right. It has now taken since January 12th 2015 to this day, still with no proper investigation or response from Marstons directly answering my complaints that I find myself at my wits end with them. I have 2 active complaints which are currently being ignored by their ‘customer care’ team, I have written and emailed their board and I am still to get any kind of response. I have notified CIVEA and they are fully aware but won’t act until Marstons have exhausted their 3 stage complaints procedure. I really do not know what to do now. All I want is my money and compensation for what I have reasonably incurred due to them not refunding my money and the financial distress it has caused me and my family. Can anybody help?
  13. Can someone please help with this. I and my husband have received letters from pcs saying we owe £1007 in overpayment. We haven't had wtc for a few years and don't believe we owe anything. What do u suggest? Friends have said to ignore it because if we respond we are admitting we owe it. I'm at a loss as to what to do I hope you can help me please. I am on disability pip payments at moment and this is causing me to have panic attacks

Hi all, Familiar theme here, my partner and I have disputed an overpayment of £3500 from 2010, we have refused to pay despite being hounded first of all by Advantis, who passed it back to the HMRC and now Rossendales who have sent a final demand before they return it back to HMRC. My worry is that I have heard that HMRC can take the money out of my wages, Is this true? and if so is it something that can happen quite often? Thanks in advance

Hello Please can someone advise me, a few years ago I had a parking ticket from Excel Parking, I initially ignored it, but then a company called debt recovery plus threatened to take me to court so I paid them in September last year, I have a copy of the cheque I sent and my bank statement showing it was cashed , but I don't have any other letters I didn't keep them as I had paid. Today I received a letter from a company called Rossendales Collect, chasing a parking charge from Excel. There is no date or place of the offence, but it has to be the same ticket I have not had another one, the letter today says they have 6 years to recover the debt and they are going to commence recovery action. What should I do, I don't want to call them, I have no paperwork and I just know they wont accept that I have already paid even if I send a copy of the cheque. I only paid last time to make them go away and now another company is back. so unfair, can any one advise me, I don't know where to turn, do I need a solicitor? Many thanks for your help
  17. I have a number of outstanding debts that have been prt of a dmp for the last 3 year. I was horrified to discover I have paid in £4300 and £1800+ has been taken in fees by immediate financial. Although 3 items have been settled at a reduced rate. I got into debt 4 years ago when I separated from my ex husband and he left me with 3 children, no financial assistance and I was only working prt time. my dad has offered to help me with this (he got £5000 from my gran when she passed) and try to pay things off myself with a lump sum part settlement. I contacted the people I knew I owed and sent a standard letter. Lowell have come back to me with 3 accounts they hold. I know about 2 and don't dispute them - the 3rd is not on any credit file I have checked them all apparently for shop direct - and there is one missing for £300 that on my crf it advises the debt is with Lowell but I'm not sure who it was originally for. The debt I'm not sure of was an old catalogue last used in 2010. Lowell said this balance is £5500 a which is way more than I ever had on it. I cannot check as it isn't on any crf so I'm not really sure what to do? Any assistance would be gratefully appreciated.

I have made absolutely no contact with Vanquis, Cabot or Marlin in the 5 years, the account went SB on the 31.07.2009 Marlin are very intimidating by their wording!
  19. Hi Guys, Apologies if i've posted this in the wrong section. Looking for advice on a letter we received today from Rossendales regarding a liability order granted on 26/01/15 re outstanding c/tax of £1786.26 + £75 compliance fee. We had a notice of enforcement 30/03/15 - I called them up to set up a Standing Order of £50 p/m, they refused this and said minimum i could pay would be £155 p/m - when i stated i cannot afford this (I work full time and my Husband is a stay at home dad for our 2 children) and £50 would be the maximum i could afford he stated i should write on paper my incoming/outgoings and 3 months bank statements etc and send via email. I haven't done this as don't think they're allowed to request my bank statements. Today i have received a letter from them stating a notice of enforcement agent will be visiting as i have ignored all correspondence ( no mention of the 10 minute phone call and offer i made??) I don't know what the next best stage is, i only take home after tax £1250pm and months rent is £800 plus other bills, debts and living costs means £50 is the highest i can afford. What shall i do now? and does this mean a bailiff will be coming to our home? Any help would be very much appreciated Sam

Firstly, I live in Scotland and know that after 5 years a debt is statue barred and after 6 years it drops off your credit report. Six and a half years ago I had a 2nd job as an Ann Summers Party Rep. I didn't pay off the rest of my account with them when I finished parties in Nov 2008. Now this company has started to chase me for the money. This account has NEVER shown on any of my credit reports. I received first letter and as I knew it was over the time frame, I replied with the statue barred letter from this website. I today received another letter acknowledging my letter and they have asked me to confirm details with them. What should I do next? I have attached the letters Thanks for any help.

    Hmrc chasing paye

    Morning. We closed a Ltd company down late last year and had the confirmation it was officially ceased trading in Feb this year. I now have HMRC chasing £1000 in unpaid PAYE. Can they chase me as old director of a ceased company??? Many thanks. Gary
  22. Hi all I'm in a right mess and would be really grateful of any advice. I took out a mortgage 4 years ago for £42k but didn't have enough with just my wages so was advised by mortgage company to get my son to come on it with me. God how I wish I hadn't! Things changed so quickly about 16 months ago with me losing my job and my son moving away. After a long battle my home was finally repossessed last April and sold the month later for £45k. I had tried to sell it privately and the original valuation was for £70k but I dropped it a few times for quick sale but sadly no buyers. It was an interest only mortgage so nothing had actually been paid off the original debt. I've now had a letter from the solicitors of the mortgage company claiming there was a shortfall of £9,543.18p and enclosing a form for me and my son to fill in with regarding our income. Due to ill health I'm now claiming ESA and have no idea of my sons income. I'm renting from a housing association and have nothing. I'm at my wits end as my son knows nothing about this. I've also started getting letters from various debt collection agencies demanding payments on credit cards ect and not sure how they have managed to get my address as I haven't registered my name on the council registration form. I did speak to someone about going bankrupt but they said I can't do this as the court wouldn't accept it because I have more going out than I have coming in? Sorry for such a long post but I'm desperate and don't know where to turn.
  23. I know that this isn't a big problem compared to most of the problems on here but I could use a little knowledge on the subject. My partner moved in with me in January after cancelling his BT broadband account, he paid his final bill but did not pay the £30 cancellation out of principle as he was unaware that was in his terms and conditions. They do not know where he lives and have no phone number for him but they do have an email address which has been passed to Walker Love (correspondence below). He is tempted to ignore the email but I am concerned as to where this could lead if anywhere. I have heard of unpaid debts mounting up over years and I do not want it to come back and bite him so I'd like to know what the real consequences could be? 'We've passed your debt of £37.50 to a collection agency. We've sent you several reminders but you still haven't paid us what you owe. So we've now passed your debt to Walker Love Collections, an authorised debt collection agency, to get in touch with you about paying it off. We've also added a charge of 25%, included in the outstanding balance above, to cover the cost of us handing over the debt.'
  24. Hi All, i was after some advice. I have an outstanding debt with NPOWER, and since the 8th March 2015, have had 3 different letters off 3 different debt collection agencies over this same debt. One of them has even called at my house. Is this legal, can 3 firms chase the debt at once? I am not sure which one I should be paying because in a 3 week period, 3 companies have chased me over this debt. The companies are:- 1)Wescot 2)Fidelite Credit Management 3)Moorcrofts Thanks for any help.
  25. HI, I would like to ask for some help from you all, as I'm a bit confused.. I've been reading on this site and looking at several others to get the best course of action. I had a mobile contract with Orange years ago, I had long disputes with them about not getting appropriate service where I lived at the time, they said it was my fault for moving to that area and not checking before moving (I had no choice), even though I couldn't get service.. long story short is they wouldn't offer me anything to exit the contract and and so stopped paying.. Account start date 11/10/2007 Opening balance £ 160 Repayment frequency Monthly Date of default 04/08/2010 Default balance £ 160 Now, this debt has bounced around from one DCA to another, the last DCA I can't even recall... But now Lowell have it.. I've not received anything from Orange, or the previous DCA about the transfer to Lowell. The only thing I've received recently is a Pre-Legal Assessment letter stating the usual "pay now or CCJ action" etc.. .. They claim they have sent previous letter/s (???) Firstly, Where do I begin? Do I ask for a Notice of Agreement or a CCA? Secondly, I'd like to also highligt to them about their use of threatning language according to OFT guidelines: Letters presuming the awarding of a Judgement (e.g. stating “when Judgement is granted…” as opposed to “if Judgement is granted…”) Lowell uses the language 1. "you WILL receive a CCJ for the amount outstanding" 2."the CCJ WILL be registered against you unless you file a genuine defence" Please help with your thoughts and how best to approach this meagre £160 debt.
