  1. I do most of my self employed as a buyer for second hand cars and machineries and sends them to clients outside EU who also banks with Barclays. I had a barclays current business account that I've been using for the last 8 years got closed a month ago for 1 year dormancy without my knowledge. So un-aware of this, I gave the client the account number that was closed and when the money came to UK I couldnt access it. When I explained this to my business manager he suggested that the money could simply be transferred into my Business saving account that I've never used. So the other Barclays had to send amended SWIFT to Barclays UK with new instructions (the money should simply be paid into the Business Savings) In the meantime Barclays apologised and offered to open a new business current account which I accepted under condition that once I get the funds then I shall deal with opening a new bank account. So far its been 4 weeks back and fourth between making calls to the international payments, sending e-mails and of course being spoken to like a kid by my business manager and branch managers. In the end (two days ago) i found out that they were all giving me the same standard answers as to why they money isnt into my account. Apparently Barclays is withholding this money as they are investigating the source ( the gentleman works for an International Organisation in that country and banks with barlcays) and he sent the money through Barclays. So the most I could think of is money laundering, but I've received more money into my business current account that they closed than what's been sent into the savings. So far he says he is losing £2500 per day this issue delays as I cant buy him the equipment from here in the UK. He has presented the Invoice and additional information and also has confessed that Barclays at times withholds his own salary upto 2 months for no apparent reason. As it is, I'm aware I can easily report this to Financial Ombudsman as I'm also losing money every single day this money is withheld by Barclays and my business reputation with customers is also on the line. Can anyone advise me on legal or otherwise options, and how best I should handle this matter.
  2. Would anyone be able to advise me what dongle (or mobile broadband) is best for business in the West Sussex area. I have an O2 3G but it will not let me connect to a work vpn in Chichester or Midhurst. The company will get me another but I don't know which would work. Be grateful if anyone can help, have tried to search the internet but can't find the answers. Many thanks.
  3. Natwest made the "assumption" that I no longer required the overdraft facility on my business account before attributing to me that I had requested it's removal. They acted on an instruction I never gave, and even wrote to me stating that I made the request to remove the overdraft knowing (and later admitting) that I did not. After realising their mistake they explained that they assumed I gave the request. How can an action be assumed on an instruction that was never given? Surely the bank can only know a request was made or not made, not assume it. Natwest have not given me a satisfactory explanation. My business has been crippled. Money I could have potentially earned has been lost. I estimate my total loss of earnings this year to be £8000. I am now starting to receive default notices on debts amounting to £12,500, which I am no longer in a position to pay. That brings total damages in financial terms to £20,500, and it's all attributable to the action taken by the bank. I have been unable to finance projects I was working on for 2012/1213 and my credit rating has plummeted. I complained to the Financial Ombudsman Service and was shocked when they rejected my complaint. Can anyone advise a way forward? Thank you.

Having a very small loan means i regularly go over my limit which is very good news for barclays sadly it puts a lot of stress on my finances when each 35 sterling is half a tank of gas in real money (what world do they live in?) can i reclaim my charges - i know personally its in the courts of doom for the forEseeable however does the forum know where is at on my business account??? I also have a loan repayment and i hear they were mis sold too - can anyone enlighten this green monster oh mighty forum all hail !!

  6. Hi there, im creating new threads for all our individual debts totalling nearly £100k. This one is about our Sole trader business account which is £26k overdrawn. We linked it to our paypaln and are v slowly paying it off. From what i have gathered CCC are not applicable for currents accounts. The autorized overdraft was £15k. But we lost control and it spiralled out of control to the levels stated. We now trade as a LTD company. so dont trade under this name anymore. People have stated that getting charges and interest taken off is very hard unless you are in receipt of benefits. Are we within are rights to reduce payment to £1 and hope to do a full or final settlement at major discount. What are HSBC likely to do and there options?. I know that it is sitting with there inhouse collection service Metropolitan. Your help and adivce is really appreciated.
  7. I was having difficulty with my debts which are around £12K. I am on benefit, and so I foned up Debt Free Direct to see what they could do. I am very upset that all they could offer me was an IVA - 7 years paying £130 a month. Naturally I had to sign up because I was getting constant harassment of one of my creditors Halifax who kept foning me up every day demanding money I didn't have. I am now wondering if the IVA really was the right solution; they didnt offer me a Debt Relief Order which is what I would have prefered. Is there anything I can do besides letting the IVA fail (which I dontwant to do because Halifax will harass me again). Very distressed by the whole thing; Debt Free Direct knew I was on benefits; I really cant see myself paying £130 a month for 7 years, especially as I could loose my benefits at any time anyway, they failed to take this into account. Because of being on an IVA no company would give me advice as I have rung around several this morning; they said the IVA would have to fail before anyone could help me!! NOT happy can anyone please help

Since my "proper" business went bust five years ago I have been basically playing at getting going again, by which I mean starting slowly with very little capital and barely taking any money from it.I use my home pc to run Sage and just answer the phone if anyone calls. I have a bit of stock in a storage unit. I want to claim Council Tax reduction on low income grounds but the form asks whether I am self employed and I have said yes.I imagine this will get them wanting to assess for Business Rates but I would have thought that I'm hardly using my home for business......what do you think? I don't want them coming back at me saying I have been conning them for five years.BTW I onlt became "legit" in April when I registered as self employed.
  10. Hi, I sub leased a warehouse, for a year and never paid business rates as couldnt afford to plus i never got a letter or anything during occupation. After i had left my landlord has started sending me letters to pay the bill but the bills are on his name and nothing is on my name? I have contacted the business rates people through email but they are asking for bills etc... Do i have to give them bills by law isnt the lease enough?? I want to pay the amount its no problem but they wont let me unless i proof them bills etc.. which i dont have any off. Need help urgent!!
  11. Recently received a renewal notice for the electricity supply for my small business from SSE. This stated that I would need to pay 19 weeks supply charges up front, and may also have to pay increased unit cost charges. SSE claimed that the reasons for this was due to my failing a credit check, but when I contacted them on the phone they were unable to outline the reasons for my failing, or to explain why I had passed the 3 previous checks with no problems (all since reference checks started). This seemed to like SSE clawing extra profits out of hard bitten small business customers, and in my case the fact they had been providing me with electricity for 13 years, with no issues related to payments, did I felt have some bearing on the situation. Over the course of a couple of days I spoke to several SSE droids about this situation, with one of them claiming that charging deposits, and increased unit costs did not result in higher profits! A customer of mine works in an executive position in one of the smaller energy companies, and I discussed this with him. It would seem companies such as SSE are dumping higher risk small business customers, by far more stringent credit checks, which mean customers either pay the deposits required, and in some cases unit cost increases of up to 30% higher. The reason for the use of this strategy, is down to the fact they cannot lawfully refuse to supply a customer, so are encouraging them to go elsewhere using the method outlined above. I wonder have any other forum members running small businesses got one of these notices? Seems to me that the greed of these people is astonishing, and bearing in mind the current economic situation, and the enormous profits the energy co's posted last year, that the press might be interested in what seems to me an obvious way of sidestepping the law, to ensure even higher profits?

I need to be able to use a template that they generate themselves, but also give me the option to change the colour of the background and the text. ie. Red background with yellow text. Thanks peeps (ps. I have tried Vista print and Moo, but I can't see how you can change the colours of their templates).
  13. Hi, NW have terminated my business account and are demanding their 3.5 K overdraft back. In the first instance, I need to get a new business account asap in order to process payments owed to myself. I also have a current acc with them, but no notification of termination of that yet !! Termination due almost certainly to the 13.5 K credit Card disputesI have with RBS.( unenforceables imho and 3 years down the line). Seems I am now a High Street Bank no no. Any advice appreciated.   14. Hi In 2007 I had a successful business as a sole trader and was also a director in a limited company which dealt with similar products. My business was on line and the limited company was a shop and online. Mid 2007 the limited company folded due to problems with the rented property it was based in. I continued my business as a sole trader. In 2008 I really started to feel the effect of the recession and orders started to dry up. By the end of 2008 it was clear I was in a position that I could not recover from. I ceased trading and found a full time job. The bank was aware of this. To "Help" me they offered to consolidate the money I owed the bank into one secured loan. Through desperation I accepted this. The bank set this up as a flexible business loan even though they knew I had ceased trading. The loan was shown in my insolvency paperwork, along with all other out goings. I was officially discharged from bankruptcy at the beginning of last year. During my bankruptcy and up to present day I've struggled to find the money to pay my mortgage, bills and the loan. I have recently been informed that the bank may have breach guidelines when they started the loan. I have been told they may have failed in the following areas (and possibly more) :- They were supposed to have an independent valuation of my property to ensure I had the equity to cover the loan. They have a figure which is approximately £50K above the figure the receivers had (the same amount as the loan ). We were never aware of anyone other than the receiver's agents carrying out a valuation. They were supposed to act in the best interest of both parties. By adding a £50K (less than half the money remaining on our mortgage) loan, they doubled the amount we were paying to bank per month. We asked for it to be added to the mortgage but they said that was not possible. The bank "Bullied" me and my wife into taking the loan explaining that the house would be at risk if I didn't take it and with my current credit rating it would not be possible to get finance else where. It may seem strong to describe it as bullying but it wasn't the first time it had happened at that branch. I had complained about my business manager and had the complaint upheld by their manager. When I stated that I was considering approaching the ombudsman over the matter, the senior manager stated that whilst I was entitled to do this, if I did it could damage the relationship between the bank and myself and this would mean that the want would cancel all the credit they were offering me. My wife has submitted two SARs to the bank with no success. After reading this forum I've got a better idea as to how to apply the SAR and so I will be doing this in the next few days. My wife has also asked the bank to investigate how this loan was drawn up. They have said that they will investigate within 24 hours. This was two weeks ago and as of yet there has been no reply. Does anyone have any thoughts on this matter? Do you think the bank have acted inappropriately ? Thank you for taking the time to read this.
  15. Hi there, I thought I'd let you know about my own consumer campaign against the evil Vodafone. I had my business phone stolen on the 1st of November... it's now the 30th and I've probably spent about 5 hours in total on hold to various elements of Vodafone that have fobbed me off, ignored me and even down-right lied to me about who is responsible for replacing the handset. As far as I'm concerned, I took out the account and the insurance with Vodafone so it's their responsibility to sort it out, am I wrong? If they've chosen to independently outsource their operations, without my consent then that's not my problem right? I just want a phone. Anyway, fortunately I run a small online marketing blog and am active on twitter, which has given me a soapbox for my discontent. As this is the first time I've posted on this forum I can't link unfortunately but if you type 'Vodafone UK Business Account Scandal' into Google it's number one - the site is Have a read for the full story of their incompetence and deceit. The worst thing is that even after taking a day off work yesterday to do all of this, I still have not even had a call from Vodafone to apologies or explain what's going on! It's incredible. Has anyone here had a similar issue? And got it resolved??
  16. Hi, I ran a briefcase company for some time now which slowly fell into debt. THe debt reached about £3000 and as a responsible director I stopped trading as I didn't want this to go any further. Having not traded for quite a few months and having been takend to court (the lImited Company), it how has a CCJ. Since then I had a HCEO appear at my residential address? (Which is nothing more than a postal address for the company) with a letter stating that they wanted to gain entry. Luckily enough, she was a nice woman, and we stood outside speaking in the rain and she made it clear that she could not gain entry anyway as it was a residential address. Anyway, I explained to her that I personally was unable to afford liquidation formalities as these will dig the company a few more 1000 into the red so I explained this to her and she was on her way. The next day I contacted herfirm and explained this to them too, they acknowledged this and left it there. Yesterday whilst I was out, I received ANOTHER unstamped letter (hand delivered I assume) stating that I have 48 hours to pay or they will FORCE (in red) entry and retrieve salvageable property. Can they do this? 1) None of the goods in my house belong to the company at all? 2) It's a Limited Liability Company registerd at my accountants, not here at home, this is a POSTAL address 3) There are no assets which belong to the company apart from a rickety old printer I have in the cupboard somewhere and a bit of stationary? This was my reply to them today (via email as requested in the letter): What else can I do? It's coming up christmas and the last thing I need is to go away to my family worrying that some 'above the law' company will break in and clear my house of everything :-/ THanks adridude
  17. Hi all, Wondered if anyone can give me some advice? I was director of ltd company - company in liquidation and as such im redundant - (now actively seeking employment) Company had secured loan - 2nd charge on my house I received a letter immediately after liquidation from lloyds calling in the loan for me to pay in full (almost 60k) I would have to sell house to try and raise this money as i have no savings and i would not get another mortgage to buy a smaller place. I wrote them a letter just to buy me a wee bit of time to think straight .... I asked them to provide me with the documents as i had misplaced them also asking for details of any PPI that may have been charged. That was 21 days ago and I have had no response. I heard the section 77 request gives just 12 + 2 days to supply documents, is this right or have I miss understood it? any help much appreciated, can they make me sell my family home? x
  18. Evening all, largely the same question as a number of other posters. I have a dormant limited company with a Barclays business a/c. the account was in credit (around £100) and I received statements once every 6 months. Over the past 12 months statements arrive virtually every few weeks and guess what? the account is O/D by £850. Not bad considering there has never been a transaction? Barclays advise as the a/c is unused it will be closed end November. Can I reclaim? Or should I SAR them firstly to fully establish charges? Seems to be a grey area!
  19. Hi i have an issue with my mortgage which was taken out in 2004 and hope that someone can clarify my position for me. When we took the mortgage out we had a self cert flexible options mortgage as my husband is self employed and inevitably there are times when he is not working so we decided that this mortgage was the best option for us. Since taking out the mortgage we have "drawn down" on it twice once in about 2005 for £5000 to put new bathroom and kitchen in and again for £13000 in 2009 to put an extension on. When we drew down in 2009 i was told that the flexible options had been removed as we had had arrears on our account. This was not a problem though as they sent out paperwork for us to sign and the money was released. However we are at the end of a long road of renovation and the last thing that we need to do is put new windows in so i called The Mortgage Business to request the final draw down to be told that the flexible options had been removed so as this had happened before i asked to have then reinstated. The answer was no as they were a "closed book". I asked when this had been removed and they said it had been removed in 2008 correct but they have been reinstated since then so they then said 2010 but they also said that Flexible options were still showing on my account at the beginning of this year? My next question was why i had not received written notice that this was going to happen. Next question was had my interest rate been reduced to reflect this being removed as i pressume i must be paying for it in some way but again they will not answer this saying they do not offer mortgages anymore. Furthermore after this was raised to a complaint the letter that i recieved said that they did not know why they had been reinstated in 2009. All very confusing. Any advice? I just seem to be going round in circles with them

We had a limited Company and have had to stop trading as landlady didn't renew lease after 13 years. all our income stopped and the Company owes money to the dutch flower supplier. i thought we were safe as we were a limited company but in their extremely extremely small print it states that any debt is personally guaranteed for the limited company. they want to reposses my house - i have 2 small children and my husband has had a kidney transplant - help!! we are seeking legal advice but interested to see if this small print would stand up in court. we were bot served with a statutory demand last night. they said they had to serve it to both of us even though i've never even spent one penny with this flower supplier. any advice very gratefully received....... we have known the guy for 20 years and the bailiffs just keep telling us that they will force the sale of our house.

Hello I am considering setting up my own business - I was wondering to avoid breach of contract claims etc do I have to have an employment handbook provided or would I be in breach of contract if I employed anyone? I am just trying to avoid making mistakes if I set up a company and I do not know if this is an important thing or not.
  22. I had a business account with NW and recently sent them a SAR (and £10 cheque) which they received on 16th August now well in excess of their 40 day requirement I have also now sent them the letter before court action, time period also expired without any contact. Wherer do I go from here?
  23. Hi, I will try and cut a long story short!! I stopped making full payment on my Isme and Littlewoods account over a year agodue to the loss of my job, I have since had a baby who is now 6 months old and not working although my husband is. I contacted both catalogue companies advising of my situation and they couldn't come to an acceptable arrangement as we literally had no spare money so was offering £5 p/m on each account. At the time the balance on the Isme account was approx £2,000 and the Littlewoods one was £400. Both accounts went over to NDR which is understand is part of the company and again they could/would not agree to my offer - I still made a few payments of that amount anyway to show willing. Since then charges have been added to both accounts, the Littlewoods balance is now approx £700 and the Isme one is a whopping £3,800 due to interest and charges. Isme have now sold on the account to Capquest. I have had the initial letter from Capquest requesting full payment which I know is pretty standard. I'm not sure who will be taking the Littlewoods account yet but NDR managed to get a further sneaky charge on both account before selling them on. I was going to write to Capquest and advise of my financial situation and offer the £5 per month I have been trying to pay over the last year or so, I am guessing they will not accept this due to the balance. Can anyone advise if they may accept or if they will request a higher amount, also am worried about going to court etc. Can they add even more charges? I am so worried about everything and also about harrassment from them as have read a few things about Capquest - none of them at all nice. Lastly, a family member may be able to help me out a bit but couldn't afford by any means the full balance they say is owing, does anyone have an idea if Capquest may accept a settlement figure and if so roughly how much I would need to offer, do I need to pay low payment first before offering anything? Thanks so much and sorry for the long post - this is my first one so am not familiar with abbreviations.

  25. Hi Guys, My other half had a business but it had to be shut down a year ago as she has breast cancer. The current overdraft debt is £11,800, agreed limit was always £10k and i have just come off the phone after they have refused to issue a plan as my income and expenditure has not come out favourable to them. We have a debt management plan in place for some personal debts and that has worked great as my partner has not been working. We could afford about £80/month for this business debt but they want £229! Over the last year they have been piling on the charges which equate to about £2000 and we have paid in very little. They basically just said legal action will now be taken. Hopefully early next year my partner can start work again and we will be in a better position. Anything you can suggest?
