  1. Hello, I've found that I had kept every bank statement from mid 1980's to 1998 with Nat West. I had a couple of mortgages, several loans and what appear to be excessive bank charges, I will send an SAR, but it is likely that I have more information than they hold, unless they're very good at archiving. During the course of reading each one I found various bodies who had received money regularly from me, but I don't have a clue who they were/are, some seem to be directly connected to the bank account. I would appreciate any help with identifying the following, I have tried googling but haven't had much success.:- MSD Premium Funder. Forward Trust. Lombard Tricity. Fredrickson IN Ltd. Bishop Court IBA. Bradford Insurance.

  3. Hello again, Is anyone else having real problems with Nat West credit card PPI? I filled out the online form to enquire if i had been missold PPI on two credit cards. A few weeks later i got a letter saying they had nothing on file and couldn't find an account number for me. Got back in touch and said i had specifically asked about credit cards as i don't have a bank account. Absolutely nothing from them. Filled out the online form again and highlighted it was credit cards only. Again nothing. sent letter and money requesting SAR, a few weeks later got a letter saying they had assigned my request to someone and the request only gives me access to my personal data etc etc. 12 may got a phone call from nat west saying they couldn't send the SAR because their carriers don't deliver to Cyprus but they had sent me a secure SAR via the banks internet. I received 38 documents of old statements, 2 letters from me about change of address and 1 bank info saying i had paid extra off my credit card. i did not receive the initial credit card agreement, nor a copy of the letter they sent to me saying they had no information from me. I emailed the chap back via the secure service and it was received the following day and asked him for a full printout of my history, plus the Notes on the Nat west archive and asked what was their data retention policy regarding credit card details. Also asked why they couldn't deliver SAR to me and who were their couriers? this was on 16 May and to date nothing! Any one with any ideas how i should proceed. apologies if this is long winded but I'm stumped and wondering if i should put in a Plevins case if possible. thanks for reading
  4. I have been playing snail mail ping pong with Nat West for several months now. I took out a gold card/ current account with them at the beginning of the nineties and closed the account in 2004. I was involved in bank charges litigation with them up to the end of 2006. I'm unsure whether I had PPI on this account and so I sent a letter to their PPI complaints department. They said that they weren't able to locate any account details and that I should send a SARN to their data protection department. They were unable to locate any data either. I supplied them with address data and details of where I held my account. Nat West have suggested that they would routinely destroy data six years after account closure which means that they would have done so in 2010. Given that PPI claims entered the mainstream in 2008, I am surprised that NAT West and presumably other banks have been able to destroy data that could well have been used as evidence. I would be interested in knowing whether anyone has recently been able to obtain credit card/ current account data more than six years after account closure.
  5. Ukaviator has advised me to post here so here goes. Data has arrived from West Brom and I have only just realised that I can claim back 12 years. Luckily I moved my mortgage 2 years ago. Some of the entries have me puzzled. I am fine on "arrrears" "positive interest" etc. Can I also claim "admistration costs" "increased rate adjustment" "costs". "Interest for year" at the end of the financial year is fine isn't it. I'm assuming this is how they legitimately make money. And I thought an old mortgage account would be a good way to start. Guilty of reading the wrong threads m'lud- should have left banks alone at the moment. Has anyone got any advice?
  6. I know Chris very well and have done for many years. Sadly it seems I'm another one of his victims. I paid Chris £600 upfront in January this year to repaint my mk 4 golf anniversary. He stated that as the body shop side of his business was quiet over winter he could do mine between other jobs and it would be done in 3-4 weeks from then. Nearly 6 months later and I'm still waiting. The car is sat in the same place I parked it back in January. Last month (April) I had a talk with him and told him I wanted the car and cash back and that i would get the work done elsewhere. He promised to crack on with it and days later the bumpers, lights etc were removed, now we are back to square one with my car sat rotting away. It's been there that long there's 3mm of tree sap caked on the car. Chris avoids replying to my texts. I've been told by a very good friend of Chris's that he has over 40 cars waiting for extensive restoration work the majority of customers having paid upfront all to lavish Chris's lifestyle. His friend admitted he doubted any of the cars would ever get done and that it was only a matter of time before he 'Did a flit' back to his belovied Cornwall. His working week consists of 3 days now. Tuesday, Wednesday and Thursday. On Thursday evening he travels down to Cornwall returning Tuesday. He's well aware of the comments on this forum and reckons most is liable and that he's tried several times to get it taken down but to no avail. Posts claiming people have served court papers on him are also false according to him with most of the negative comments coming from a disgruntled ex member of staff that was sacked - the guy lives in fairy land. I don't know how the guy has the brass neck to continue taking money off people.
  7. Firstly, if my post is in the wrong thread plese feel free to move appropriately and advise. Now, I know that this is likely to touch a nerve with a few caggers but I'm like a dog with a bone so please bare with me. My Nephew (for the purpose of this thread we'll call him John) was researching various traders for a vehicle and having previously been wary of [problem]mers, had successfully turned down previous vehicles because of suspicious activity on said websites. However, unfortunately, he has fell fowl to a vehicle [problem] on Auto Trader (online) to the tune of £7000. Now, please dont state the obvious, he already realises how stupid he's been transferring the funds before seeing the vehicle but the said vehicle was in London and he works long hours. going on past transactions, he's purchased vehicles like this previously with no bother, and all has been ok. On researching this topic I came across a similar fraud https://www.consumeractiongroup.co.uk/forum/showthread.php?469945-Defrauded-by-bank-transfer-by-a-Barclay-s-customer-should-I-sue&highlight=fraud+[problem] and can relate to some of the information contained there in. Action Fraud have been advised, reference etc provided. Auto Trader advised, and during the conversation have advised us that the 'Seller/[problem]mer' had multiple vehicles 'for sale' and they have taken all adverts down because of suspicious activity. Now, my thought is: Wouldn't it have been better if Auto Trader could 'tweak' their website to make it look like the adverts were still live to the [problem]mer but not actually available to customers to prevent anyone else being caught out? Whilst the police/fraud squad did there investigations and even visited said [problem]mer's home address (from the banks records) to retrieve as much money as possible? And even shut them down? We've spoken to DVLA to alert them that certain registration number is involved but they naturally will only liaise with the fraud team/police. We've spoken to Nat West and they won't divulge their policies and processes which they follow in these circumstances (even in a generalised scenario) but considering the vehicle was supposed to be in London the bank account is held in Leicester! Which is not a stone throw away from the link above thread. [problem]mers do not differentiate when it comes to obtaining funds by deception, a drone or a vehicle....... So, moving this a little futher down the line, assuming the police apprehend culptits and retrieve assets through crime. What happens to the cash recovered, property sold whether it be house, car, fancy watches etc? Can the victims not lay claim to a portion of the recovered assets, even pro rata amounts? Where does this money go to? I am in the process of drafting complaint letter up to the bank as like the cagger said above, banks are not protecting its customers sufficiently via bank transfers and just blaming the customer. The banks have a duty to apply due diligence when customers open new bank accounts and I dont think bank staff are trained sufficiently enough to spot fraudulent documents, they should have major training in spotting fraudulent documents and carry out further checks with relevant organisations before permitting funds to be released, and lets face it if you saw an account with transactions of transfer credits being received into an account of multiple thousands, several times a day, surely they can have flags on the software system to alert a fraud team? Would anyone like to suggest how I could draft a template letter to the bank to complain in this regard? Or your thoughts please?
  8. Another one that slipped past me.. Did you take out a joint loan with a partner - then later you divorced? Was there PPI on that loan and did your partner claim and get all of the money back.. with you being non the wiser? http://www.thisismoney.co.uk/money/saving/article-3871798/Thousands-divorced-women-deprived-PPI-payouts-NatWest-Royal-Bank-Scotland-receive-compensation.html Other banks apparently complied with rules and shared the pay-out between separated partners.
  9. Good day all, I'm in a bit of a panic here. I have a £4500 season ticket with SWT. I managed to lose it about 1 month into the ticket and was interviewed by revenue protection and subsequently given a replacement. Last night as I got up to let a lady off I folded the tray back with my season ticket in there and forgot to take it down again before getting off leaving my ticket on the train. Realising my mistake I tried to call the guard and SWT 30 mins after. However there were no numbers I could get through to. I spoke to the guard this morning and he advised that I wouldn't be given a duplicate and I would have to buy a new season ticket as I'd already had one replacement. My current season ticket had until June to run, so about £1500 worth of travel. I've got a new daughter being born soon and I can't afford the travel to get to work. Surely SWT can't refuse to let me travel? I've paid for the service not the ticket right? Is there anyone who can offer me any advice on how to go about coming to a resolution which doesn't end up putting me into debt or losing my job! Any advice greatly appreciated!!! thank you T
  10. Hi, I was driving back from London home to Somerset, and due to a long day pulled over to the service station to take a rest. I fell asleep in the car and stayed there for 3 hours 22 minutes. They have sent me a charge notice saying I was parked over and above the time allowed without payment and have sent an £80 charge notice for this. However, the notice has a photo of my car arriving, and my car leaving, but no photo of me actually being parked. Surely there is no actual evidence that I was ever parked in their car park, and that I could for all intents and purposes have been driving round the car park for 3 hours. Without an actual photo of me being parked on the land owned by MOTO, surely they cannot enforce this notice.
  11. afternoon all, after a bit of advice. I have got a PCN and im thinking i may have to pay this one but as always, i like to get your advice before doing anything around parking tickets. I overstayed by an hour in the services at MOTO swansea west and ive been sent a NTK in the post. I hold my hands up, i overstayed. Reason being im a fireman and i was lift sharing with my mate as we only needed to drop some stuff off at the station, thought we'd be an hour tops and we ended up being longer because there was a call. I think if i appealed this one id be relying on the POFA and just chancing it. what is the expert advice? I think my defense would be shaky if this one went to court but i do despise paying these people so much money when they have incurred ZERO loss. It was an empty motorway service car park. I will as always rely on your advice. Regards
  12. My partner has a bank loan which unfortunately due to the Recession and being self employed has been unable to make the monthly payments. Wrote to bank and they agreed monthly £1 payments till things picked up. They have asked for an update on finances and so we sent them a Personal Budget Sheet with a letter explaining that circumstances have not improved and this could be seen from my income and reduced expenditures sheet. They have written and said that because of excessive spending on my phone £45 per month and £250 per month for travel and vehicle costs that they cannot accept the £1 offering. How can this be so ridiculous. He has to use the phone to get any work and the fuel cost is only £60 ish pounds a week. This amount has to cover repairs on my 7 year old Van, RoadTax and Fuel which he obvioulsy has to spend in order to get to do the work as an Electrician. Any advice would be greatfully received ASAP PLEASE.
  13. I have recently had 5 claims against RBS/Nat West upheld thanks to a CMC. One of them is for £9400 but Nat West have informed me (by text message) that they have paid the money into my Nat West current account. This account was frozen in around 2003 after I deposited £10,000 into it (at Nat West's insistence) following a remortgage. The reason for this was as I recall to offset against a loan that I had defaulted on (balance at the time unknown but obviously £10k+). At the same time I cleared an overdraft of approximately £5k. For a while I received statements for this account but then they stopped. Shoosmiths chased me for the outstanding loan for a few years on their behalf. I have heard nothing for about 4 years or more. I rang the Nat West today and all they could tell me was that the balance of my current account is now £8400. When I asked where the difference between what I deposited (£10k) and today's balance had gone they had literally no idea! My questions are: 1. Do they have the right to offset when for the past 13 years they have held £10k in an account that I have not been able to access? Should those funds not have been immediately applied to the outstanding loan? 2. If the Nat West acted unfairly can they be brought to task over our subsequent repossession in 2008. A small proportion of the £10k that they were holding could have easily prevented us from losing our home at the time. I have long been of the opinion that Nat West were indeed acting unfairly and this latest escapade and their subsequent apparent incompetence in not being able to supply me with accurate information about my accounts just smacks of a shoddy and couldn't be bothered attitude. Granted the first port of call is a complaint to Nat West but I am reluctant to escalate to the FOS because of their toothlessness! Any advice would be most welcome.
  14. Myself & my wife had up until April this year, a limited company which ceased trading at the end of October 2015 & was dissolved in April this year. South West Water have obtained a County Court Judjment for outstanding charges for water usage before the company was dissolved, and they are adament that they are going to push for payment, even though we have informed them of the companies status. We used our home address as the Registered address and it was the address for correspondence, but we traded from a different address, and it is the trading address which ran up the debt. I am confident that they would be unable to pursue us personally for the money, as we are not personably liable, but would love to hear some reasurance on this, as I really don't want a bailiff calling at our home with threats etc, I think they are trying to call our bluff. Any advice would be welcome. Cheers
  15. I've just been reading through an old thread on here regarding Carmel Butler's Memorandum to the House of Commons Treasury regarding mortgage securitization, which I have referred to in my skeleton argument for my defence in a possession hearing I have tomorrow. Does anyone such as supersleuth or enoughisenough or Smarterchick have any updates on how they got on, as the other thread seems to have dried up? If anyone can tag/link them in here as I don't have enough posts yet, that would be very good of you.
  16. Hi, New here, would appreciate a good advice! Received a 'CHARGE NOTICE' from something called CP PLUS limited. The letter states there are BPA member and the postal address is PO BOX 3573, Barnet, EN5 9QA They sent a photo of me going in and out the private car park (that's heston west services to do with costa, travelodge, etc.). They say I overstayed by 50 minutes. They provide a photo of the sign saying that parking charges apply after 2 hours, how to pay post 2 hours and that camera enforcement is in operation. Few questions: 1) Along with phone (03339390104) and address, they also provide a link to appeal: APPEALPCN.CO.UK This looks VERY dodgy, and besides it is an unsecure form. Is this legit at all? 2) I can't see their company website address anywhere, is that normal? Searching cp plus online doesn't give much info either. [problem]? 3) They demand £100 to be reduced to £60 if paid within 14 days. Is that a reasonable charge at all? Any advice? Many thanks
  17. I had several accounts with Nat West, personal and business. When requesting statements do I need to send £10 for each account or £10 for the whole lot?
  18. Borrowers whose monthly payments doubled when their lender increased the rate on their tracker mortgages are hoping a Court of Appeal ruling might allow them to claim back thousands of pounds. About 6,000 West Bromwich Building Society customers are expecting refunds after last week’s ruling that the lender was not justified in changing the rates for buy-to-let landlords on tracker mortgages. In December 2013 the lender increased the rates, despite the fact that the Bank of England’s leading Bank Rate, which tracker mortgages are typically expected to follow, had not changed at all. These borrowers will now receive a refund and be returned to the lower rate. The lender is expected to pay out £27.5m. But West Brom was not the only lender to increase rates for its tracker borrowers Thousands of customers of the Bank of Ireland, which provides mortgages sold by the Post Office, and Skipton and Manchester building societies were also affected when those lenders increased rates on their tracker or mortgages or other loans subject to rate caps. http://www.telegraph.co.uk/personal-banking/mortgages/after-6000-borrowers-get-mortgage-refund-could-you-be-due-money/
  19. Dear All, In June 2014, my partner and I arranged an overdraft with our business bank (Nat West) as match funding for a government loan scheme. We were asked to sign a personal directors guarantee and, at the same moment in time, signed the waiver to legal advice form in the bank's office. Sadly, our business has now been declared insolvent and the bank are now calling in the personal guarantee for £20k. Originally, we did not believe we had signed a guranatee but the bank have now come up with the evidence (although that was never originally forwarded to us so we had no copy until now). We have also never received a copy of the overdraft agreement signed in June 14 although we have one signed September 14 with a pp signature from the bank. We were also asked to sign a debenture (again, we have no signed copy) and also a postponement of directors loan account which we definitely didn't sign as they were still chasing us for that in February last year and I know we never signed this. I recently wrote to the bank asking for copies of ALL signed security documents and they only sent me the PG and waiver. I have written to them again today asking for the other security documents. Nether my partner nor I are ones to shirk our responsibilities but I would like to come to an arrangement/agreement with the bank to either pay a lesser amount or a small monthly payment. I have already lost 200k personally from the business failure and hoped that was the end of it. I have phoned several companies who state they deal with these types of issues but not one has come back to me. My question is How is it best to start the process of negotiation with Nat West and what should I say initially? And is it feasible that the guarantee could somehow be unenforceable? I should say that I had another company (Credit4 - beware!) took me to court re another directors personal guarantee for the same failed company and got a ccj and a charging order against a property I owned. i have had to sell that property (my main income) to satisfy their debt and have a small sum left over which I really want to keep to buy somewhere else to live now. Another £20k will add to my losses even more and will dent that small sum. I can't get a mortgage now due to this ccj, even though it is settled, hence why I need to keep as much as I can to buy somewhere to live without a mortgage. My partner now has a new job but has to live away as its not local. We cant afford to buy anything where he is working. Feeling really fed up and just wondered if anyone had some sensible advice on how to get a settlement agreed. Or to know someone who can help at a reasonable cost. A little light at the end of this dark tunnel would be so nice. Thank you in advance to anyone who responds to my request
  20. :-)Hi Have 2 NatWest credit cards taken out about 1995/1996 - on which I have been making token payments of £2 per month which just jogs along. £1400 outstanding on one card - £2200 on the other card. Token payments commenced about 2 years ago as lost job due to illness and have not worked since. I am 65 and now have heart failure problems - so trying to sort out affairs in case of further problems. I know I should CCA them - but what then. Do they write off debts? My GP can confirm my health position. It's crazy really - we all bailed out NatWest during banking crisis to the tune of some £20K+ each - so in effect they owe us! Your advices how to proceed would be greatly appreciated. Would it help to go through Citizens Advice or similar? Let me know what you think.
  21. Have read the other threads on site and else where about this car park. I read the parking notices like others and to be fair if it says for site users I missed that. The Biggest part says 1 hr only. Came back in less than 20 min and a ticket saying I'd been observed leaving the site, not sure how but I'm guessing there using CCTV as there were about 5 or 6 cars ticketed. Pay £100 fine but only £60 for paying quick. Well not much chance of that. There were only 10 cars in around a 100 space car park. Don't see that I have caused any inconvenience or affected trade for Staples and Maplin's which are the only shops on site; so I intend to just ignore it and not even appeal. Anybody think I'm misguided????? Comments appreciated.
  22. Guys, The wife and I have each received claim forms from South West Water after missing 2 payments which were missed because the direct debit was cancelled (but not by us!!!). We've had no correspondence from them whatsoever regarding the arrears which we're more than happy to pay but they're claiming for the whole year's payments upfront. Now I'm not sure what to do about this claim, I can't afford the full year in advance so I presume I'll have to fight this. I've acknowledged the form so have to think of something soon. Any ideas gratefully appreciated.
  23. I purchased a ticket before travelling today, only to discover that my train was cancelled and the next one wasn't due for an hour. I went to a member of station staff, asking who I should speak to about receiving a partial refund due to the delay. My ticket was then taken from me and they wrote on the front of it that it wasn't valid. I looked for the station manager to complain, but I was told that I would have to purchase another ticket if I wished to travel. I was then told that, as my new ticket was purchased after the cancelled train was due, I would no longer be entitled to a refund. I have been delayed by an hour and have had to pay twice as much for the privilege of waiting over an hour for a train. Is there anything that I can do from this point?
  24. Hi Background... I had a loan from nat west in 2006 funds paid to me were £9400 Nat west own statement confirms this. They say the loan was for £22400 ( or thereabouts). I had problems with my finances .. the bank account went overdrawn, got divorced, house went to the ex. In 2009 i snet CCA request for the loan agreement - they coudl not find it. They tried and failed to take me to court ( because they coudl not find the agreement) I know there was an loan but acording to what the bank statement shows it was for £9400 not £22400. Nat west of course argue that its the higher amount. Since 2009 ive been on a DMP with payplan and I have to keep arguing about the nat west loan amount. What I want to do is get the amount of the loan confirmed, they ( N west) say ist £22400 i say whats left is about £2200. Llast contact I had with nat west was to confirm that unless they proved otherwise i will treat balance as what i say it is. I want to look at doing some final settlement offers in about 2 years ( when i can get some pension money) Couple of questions ... How should i approach this ? - write and complain to NW ? then go to FOS ? I was looking to complain that the lack of the £13000 plus missing funds from the loan have put me in the debt situation im in .. ( at the time i took out the loan i had debts with multiple cards. ) any help appreciated Rob
