  1. Forgive me if I seem a bit angry but I used to be a member here asking for advice on how to avoid a sanction from my JSA signing. I got what I thought was great advice at the time. I implemented that advice. I got sanctioned. Is there any way I can sue CAG for giving bad advice? Reading around the threads now with the "benefit" of hindsight, It seems that most site team and contributors are actually on ESA and divorced from reality and the world of work. If I'd realized this I wouldn't have followed their advice. I'm now left without money for 3 months. Thanks a lot. Do I have any recourse for suing you people? I guess if you actually knew what you were talking about then you wouldn't actually be on benefits to start with. My bad then. But you've really ****ed me over. Who can I sue for bad advice please?
  2. In january 2015.I applied for car finance with Fowlers finance as i didnt have any spare money to purchase a decent car with cash. I applied online and a person from the company called me went through an application and after about 6 hours contacted me to say that i had been approved and that i could go to manchester to get the car. Originally i wanted a Vauxhall Insignia but when i got to Manchester i was told the car had been sold by another branch but they had a citroen C4 7 seater i could have a look at. I have a large family and i liked the car so i accepted that one instead. There was some scuff marks on front bumper and other little bit to bodywork and i commented on this and was told dont worry we will get someone to come to your home and repair them. I was ok with that so didnt think much else of it. They took me into the branch to fill in the paperwork for the car and i asked if i could test drive the car and was told this wasn't possible as the car was getting a device fitted to it and would take approx 30mins so after the paperwork i could do it then. I thought ok sounds reasonable , went along with it. After i did the paperwork the guy shook my hand and said thanks and we went to the car it wasn't there it was over the road getting valeted by a garage we went to there and the garage even tried to charge me for the valet in which i declined and laughed but fowlers told me dont worry we will sort it. They gave me the keys and then left. I live in Durham and car was in Manchester and it was around 1pm in day and needed to get back for kids school run i started to drive home. After about 100 miles the car cut out on me and the display started showing."AIR POLLUTION FAILURE, HANDBRAKE FAILURE ,OIL PRESSURE FAILURE" amongst other faults i pulled over on hard shoulder the engine management light was on but after about 10mins it went off and car was fine so i drove home. when i got home i rang fowlers and told them what had happened they told me not to worry its more than likely a sensor and it got some dirt on it. The next day i did a full inspection of the car and these are the faults i found. A BIG ARCH IN DRIVER VIEW ON WINDSCREEN AIRCON COMPRESSOR GRINDING AND MAKING LOUD NOISE. 2 BALD REAR TYRES 3 NUTS ON 1 WHEEL BRAKE PADS NON EXISTANT DRIVER SIDE WHEEL CALIPER SEIZED THE REAR SEAT WAS DAMAGED OFF RAIL AND COULDNT BE MOVED NEVER MIND PUT DOWN 2 CENTRE SEATS DON'T MOVE NOR FOLD DUE TO CABLE PROBLEM. I contacted fowlers with the problems listed they told me that they would put me through to after sales and no-one answered this went on for 2 weeks never getting through. After a while i contacted my finance company telling them the problems and they told me they would look into it after months of complaining and still making my payments i contacted the ombudsman and they did what they do and also contacted a company to come and examine the car only 3 weeks ago remember i bought car in january and inspection in december . The guy was really nice and told me that he had to be honest with me and ay there is no way of knowing if this happened last week or was there when i bought car and would be hard to prove. This made me kind of upset as i have been complaining for months .Now the ombudsman is saying that they got report and in the engineers opinion there faults were not there at point of sale but they were. I contacted The car finance company at start of march and i they have them logged recently i asked them if they record calls and i was told no only log them and i asked for a copy of all logs they have with time and dates to back me up they stated that i would be charged for this. Also i forgot to mention that the car had no service history at all i did not get an MOT was told they mislayed it and would be forwarded to me and the ombudsman told me that the milage was something like 90k on mot but when i got car it was 98.5k i feel there is a major coverup going on i just dont know i need your help to see if theres anything i can do .I know about the watchdog program regarding them too this happened 6 months after i got car. Any advice would be greatly appreciated. ah yeh report also said that the arch in driver side should of failed MOT this was on screen when i bought car.
  3. I had an Indesit washing machine delivered on 10th November but when I went to level it for use, I discovered that the 4 rubber feet were missing. I have called their helpline, messaged them on facebook, posted on their facebook wall and emailed, yet I am not receiving what I need. They sent 1 single foot 3 weeks ago and then promised to send the rest on next day delivery, they sent me 4 springs. I was once again promised next day delivery and I got 1 more foot!! I don't know what much more I can do and it's really stressing me out. I have a family of 5 and not washing in this weather is driving me crazy. I really hope someone has some advice for me.
  4. Colleague's boyfriend took the car and was speeding. (If it at all matters, he took out temp cover with another company). The insurance company Policy Wise has now sent a letter to say they want £250 or they will cancel the insurance policy. Just checking that they are able to charge this amount? Surely they have to have a breakdown of costs otherwise it is seen as a penalty?   5. I find the media a fickle bunch, who change their views depending on the wind direction. Tom Watson MP was seen as a hero for pursuing allegations about child abuse, but now that some of the alleged victims have had their allegations questionned, Tom is being criticised. The Police have not finished their inquiries yet and it is a bit too early for friends of alleged abusers to start demanding apologies. Because the newspapers keep going on about such stories for days on end, digging at the information, it must put the Police in a very difficult position. And it is not just newspapers, but some TV programmes as well. Let the Police complete their investigations without unhelpful media involvement and see what happens. If any cases get to court, media coverage of victims and alleged abusers, may hinder any chance of a fair trial. If politicians want to be helpful, perhaps they should pass laws that require abusers and victims to be anonymous until after the alleged abuser has been formally charged, with a court date set for a hearing. The Judge can then decide on whether identities should be revealed, to help serve fair justice. We want an independent robust free press in the UK, but they must remember that they should look to serve the public interest and not act in a way that disrupts the Police or courts.

Hi all, I have had a recent run in with a bailiff and im posertive he hasnt followed the correct rules for taking control of goods, im not wanting to debate whether im right or not! i would just like to know the correct way of complaing about it. the complaint would be at the bailiff and possible his company as they were aware of his actions? thank you.
  7. Hi all My first post. My son banks with NatWest and as done so since he was 16 (Now 22) he went overdrawn by £0.58 back in April this year. He had not used his account since then as he wasn't working just studying hard before going to University. Anyway long story short 3 weeks ago we went into the branch to change his account for a Student Account as he needed an overdraft facility and his normal account had no overdraft facility. This is when we found out he had gone £0.58 O/D and since April had put charges on his account totalling £146.00 so as you can guess shocked was an understatement They have now withdrew the charges as a matter of "Good Will" however they will give him a Student Account with No Overdraft. We also have found out they have marked his Credit Rating, this as stopped him opening a Student Account with any other bank. They also REFUSE to remove his mark from the Credit Rederance Agency. My question 1 can they do this? If so how can we get his file clean so he can get an Overdraft as he is going to need it while at University. Sorry for the long post but any help advice really would help my Son Thank you all in advance
  8. Hi, I received a faulty phone from Vodafone (sometimes it displays nothing even though there is "life" in the phone) where i have been a customer for 2 years. I received this phone on the 6th went on holiday come back and started using the phone requesting that my number change (because of PPI calls), they happily arranged this. Once i reported the faulty phone they said that they would send a courier to switch the phone for a brand new one which i was pretty happy with. Then the customer service assistant discovered i had changed my number and that this switch wasn't possible and told me that a courier would have to come and pick the phone up, take it for repair then have it sent back to me. I asked for some times scales as i need my phone as part of my job and she couldn't give me any and the earliest the courier could get to me was the 25th. So not only am i sat with a broken phone for 6 days I also don't know how long im going to be without a phone. When i pressed on the issue of weather its going to be a week, month or year she still couldn't give me any sort of indication. To top it all off i get a faulty phone that's been refurbished when surely i should be entitled to a brand new phone. Surely I'm entitled to a better service than i received I'm just not too sure the best way of going about it. Could somebody suggest the best way? Thank you.
  9. A supplier has written off a number of invoices as Bad Debts, and reclaimed the VAT element. He has then issued a claim for payment in Court at a later date, and added interest at well above base rate. Is this permissible?
  10. So essentially, I'm just going to provide a little bit of background information and then I'll get to the question at hand. I'm a University graduate with a 2:1 honors degree in Web Systems and Development (i.e. A Web Developer). I finished University in 2013, I worked up until July 2014 and have been out of work since that time, I have had freelance jobs here and there to help me along the way, but essentially, I have been out of full-time employment since July 2014. Without trying to toot my own horn here, I'm portraying this across to simply imply, I have a lot of qualifications and I have a fair amount of job experience, I have worked with over 5 individual clients, had jobs with 3 different people (from July 2013 - July 2014), so it's not as if I'm in short supply there either. So to get onto the actual topic. I've been on JSA since July 2014, but recently when I went to sign on, one of the advisors there informed me that because I had been on JSA for 12-months, I am now being transferred to "The Work Programme", she didn't tell me much about it, nor did the person who I had my interview regarding the appointment to set-up TWP interview. The sad thing that I happen to see reoccurring all the time is that, The Work Programme is a pile of crap, essentially. I have read no good stories about TWP, no advantageous results of being on TWP, it just seems like it is a gigantic waste of my time and it's going to be more hassle than it's worth. So I guess my question is this, typically what does TWP entail? Has there been any benefits of being on TWP and as someone with a heavy Computing background, will that help me with TWP. I've read that despite your qualifications, you are usually thrown into retail work (shops or whatever) just stacking shelves for 2-4 weeks, you then have a 2 week gap and then you're back on the next job, rinse and repeat until you eventually get a job out of it. I just don't really see how I or anyone else currently on this programme can take it seriously knowing that you're going to be in a place surrounded by other full time employees knowing that they are getting paid minimum wage while you're there working for close to £1.2 p/h? It just doesn't make sense to me. If anyone could fill me in, help me understand this a little bit more, that would be great.
  11. i had a bad debt on a credit card from about 2002 that due to a real bad relationship split went unpaid. since being single i have never been more than 20p overdrawn since. i'm now in a position where i need to purchase a reliable car for work and dare not apply for credit. would it be possible to get car finance with this sort of credit history ? thanks in advance

  13. Sent my Samsung off for repair. Pretty standard repair job with that type of phone. Was told that it would be back within 10 days. Been longer than that now so thought I would chase it up. Tried the website but didnt have the job number so tried the store. Recorded message saying that they are closed for refurb and that any repairs would be sent to another store even further away. Tried the new store. They didnt have it. I asked for my job number so I could trackit myself. They said cant do it. No reason. I asked if the repair copany could send it to a more local store to me. They said cant change it now. No reason. Really was as simple as that. They managedto change the store address when it suited them but wont do it for me and will have to drive further now. Just seemed like the person just couldn't be bothered as I am sure they could get a job number for me and contact the repair company to get it sent to a different store as its been done once already. Anyway. Know much cant be done and just blowing off some steam as Vodafone have been generally good. Just wondering how long other Vodafone customers have had to wait for repairs
  14. Hi, First post here, but lurking for a few weeks! Brief outline: I have issued a claim for compensation against a car dealer. The notice has been served. After about ten days, they filed an acknowledgement of service (I know this doesn't mean anything specific will happen), but they have also notified the court of a change of address. Is it likely that they have changed the 'contact' address so that if it came down to it, they would not have the bailiff in their showroom, and / or, the address is that of say their accountants, so that a bailiff cannot either remove any property as it doesn't belong to the defendant, or there's nothing of value in the registered office?   15. Hi Guys i had a default on my credit report for £455 from shop direct which was opened in 2013 i would have been 17 at the time so there was no way i could even obtain credit. I have sent my passport details in to shop direct for proof and they have taken the default off my account my only problem is now my credit score is 208 which is very poor the only two things i have on my credit report are my phone contract and my credit card. I pay these every month and on time my credit card is paid off as i only had a £200 limit capital one offered to up my limit but i dont need it i turned down their offer. Why is my credit report still the same as when the default was on there also when i go on to closed accounts it shows shop direct would that still be having an affect on my credit report. I dont know what do as me and my boyfriend were planning on buying a house this year and by the looks of things that wont be happening now.
  16. hi there, looking for a bit of advice, or to know if something could be possible.... my partner and i (unmarried, 4 kids, been together 20 years) currently have a joint mortgage which has recently changed from being fixed to being on a tracker. we can happily afford the payments at the moment but we're worried about rates going up in the next few years and would like to be on a fixed rate again. the flat we own we are currently renting out, the mortgage company know this but they haven't changed it to a buy to let mortgage as yet. we are renting the house that we currently live in, been here for a year and a half. so, we want to remortgage, but we have issues with our credit history (hence why the current mortgage supplier won't let us have a fixed rate again at the moment)....looking at experian/equifax, my partner's credit score is fair but mine is "really poor". there are some ccj's (5) on there and some late payments for a mobile phone, last late payment is 24 months ago, the most recent ccj is 2012 and been settled. what i'm wondering is, is it possible to remortgage only in his name? as we have a joint mortgage now are we financially tied and they will still check my credit history? we are now in a better position financially, house is worth approx. 175k, mortgage will be for 100k. he earns about 1.8k after tax and we now have the rental income which is 1k a month, the rent here is 745 a month....not that i want it taken into account but i earn 600 a month any advice, point of view welcome the ccj's are in both our names thanks, claire
  17. When I was at the checkout and ready to pay for my groceries the cashier said: "Strip down, facing me." Making a mental note to complain about this security rubbish, I did just as she had instructed. After the shrieking and hysterical remarks finally subsided, I found out that she was referring to how I should position my debit card. Nonetheless, I've been asked to shop elsewhere in the future. They need to make their instructions a little clearer for seniors. I hate this getting older stuff.
  18. Hi all, Just looking for advice on where I stand with the following. I had cracked the screen on my iPhone 5S, so working from home yesterday, I took the opportunity of popping to a local repair shop. The phone was working absolutely fine, the screen damage was in the top right corner. They said "leave it with us for an hour", and so I popped off for lunch. When I returned I paid the bill and took the phone, it was powered on and connected to 3G, so all looked good. The finger print scanner wasn't working but I figured I would need to set it up again. Once home (couple of minutes walk), I entered the passlock and went to add the fingerprint ID again, the phone went black, then blue screen, then black with Apple Logo, and then went into a cycle of that. I wandered back to the shop for help and they said to leave it for half and hour and they would replace the screen. Back I went, to be told they had a problem and I would need to speak to the manager. The manager informed me it was still blue screening and that it was nothing they had done but was a handset fault. He had apparently Googled Blue screen iphone and it is common... really? I said it had functioned fine until they had taken on the work - the call logs would show it in use up until I walked into the store! Anyhow, he said to leave it until today and they would try a screen from a new batch, but if that didnt work he would refit my original screen, refund me the £75 and I could take the issue up with Apple - indicating Apple wouldn't know the screen had been removed. (I guess he knows his work would invalidate the warranty.) Now I am not an expert, but surely under the provision of goods and services, he cant take in a working phone and hand me back a paperweight and a refund? Can he? Where do I stand on this? I really appreciate any advice as I am a bit unsure. Many thanks in advance, Johnny
  19. Trip Advisor couple 'fined' £100 by hotel for bad review A couple say they have been "fined" £100 by a Blackpool hotel for leaving critical comments on travel review website Trip Advisor. Tony and Jan Jenkinson posted the negative comment after being unimpressed with the one night they spent at the Broadway Hotel. The couple, from Whitehaven, later found £100 charged to their credit card. The hotel said its policy was to charge for "bad" reviews. Trading Standards are investigating. Officials believe the hotel may have breached unfair trading practice regulations.   20. Hi all, and thanks in advance for any help. I have been having issues with my useless landlord for a while now. He's very hesitant to carry out any repairs, and eventually, when /if done, are to a very poor standard. For a year I have been asking him to sort out damp issues, drafty windows, broken back door. Now it has all come to a head. My 8 year old son has been hospitalised with pneumonia. All of a sudden, he wants to get all the work done. Too little too late in my eyes. I am wondering if I have grounds to sue him for causing this health problem with my son? Any advice would be well welcomed. Many Thanks

I have a problem and went out of the country for a while, on my return I have my company with a proposal of strike off flag, so as i wanted to keep operating with the company I called Companies house and asked what do I need to do. They reply this and I am scared, what are my options please? I still have time to fix this? --------------------------------------------------------------------- I can confirm that the following documents are outstanding: Accounts for year ended 31/07/2013. Annual Return (Form AR01) for period ending 15/07/2014. As the company is required to remain on the register, the proposed strike off action has been discontinued. Failure to file accounts and annual returns within the statutory times allowed is a criminal offence and due to the seriousness of the defaults, we are commencing prosecution action against the directors immediately. Conviction for these offences will result in a criminal record and a fine of up to £5,000 for each document not delivered on time. As these accounts are already late, a civil late filing penalty will automatically be incurred when they are received and accepted at Companies House. The amount of the penalty increases with the length of delay in delivery and is separate to any criminal proceeding being considered against the directors. Failure to comply with the filing requirements of the 2006 Companies Act in consecutive years will result in the penalty being doubled for the current year’s accounts. You may be able to deliver your annual return and certain types of accounts online via our Web Filing service, which has in-built checks to ensure that you get it right first time.   22. I keep getting bad service from post offices. Some are completely fine, but in particular, the one around the corner to me where I work is terrible. I sell an item in particular on eBay which is 50g, and comes under the 'Large Letter' size. I either post them 1st class, or 1st class signed for, depending on which version is sold. This is the dialog that happened last time, but usually have to deal with it every time, no matter how many times I say 1st class signed for. Some times they don't tell me they have decided to send it using a special service and bill me for it anyway. Another time my girlfriend went for me, and they actually wouldn't let her send it using signed for, they pushed her to send it using the next day by 9AM service costing something like £9! Me: "Hello, could I send this one 1st class signed for please?" Them: "Yes, when do you want it to arrive by?" Me: "Tomorrow." Them: "That will be £7.68" Me: "1st class signed for is usually £2.34" Them: "Yes I know that sir [sarcastically], but next day is £7.68". Me: "I said I wanted it 1st class signed for." Them: "That is not next day." Me: "I just want it 1st class signed for." Them: "Ok fine, that is £2.34" Me: "Thanks, how long does 1st class take then?" Them: "It's between 3 and 4 working days." I have never had a single parcel sent first class arrive more than 2 working days after posting. Are these idiots trained into pushing people to pay the higher prices??
  23. Hi I recently had a dispute regarding a outstanding balance which had been accrued whilst travelling abroad in Hong Kong. I had questioned the usage (£3000) as I had no idea where the usage had occurred as Im only a casual web browser and received limited email during my trip. I am a Engineering Manager for a Marine company and constantly travel and use data and had never had any troubles with large charges but obviously not to the extent of the disputed debt. I contacted the Ombudsman and the case was referred with the outcome favouring Vodafone. Obviously not happy but believing that i had no more avenues to progress my argument I contacted Vodafone to pay the outstanding debt by use of my company card. As my account had been restricted I spoke to the assistant at Vodafone who deals with collection and asked about how to settle the debt and he advised that I could pay 50% upfront and the remaining 50% would be deducted in 6 weeks from the first collection date and money was debited from the company account. I went abroad again to Australia for 2 months where I never used my phone apart from wireless on Airplane mode. I returned home and found that my services again had been suspended as they had not collected the outstanding 50% on the 6 week period as agreed. They had sent a letter to my home address asking for me to pay the outstanding balance but I had not been home to even see the letter. They said that they had to give me a bad credit mark as I had not responded to there letter even though id never seen it in time. I again contacted the Ombudsman and explained but again they ruled in favour of Vodafone saying that it was my responsibility to check the payment. I had at no time any idea that they had not taken the payment that i had authorised with the assistant. Very frustrated as it was Vodafone who suggested I pay in instalments and just because the assistant did not process the debit procedure correctly, it is myself that is in breach. Some advice on how I should proceed would be appreciated. I have told the ombudsman that I do not accept there decision and was wondering what to do as I seem virtually helpless. I can now not remortgage my property due to the bad credit score just due to this incident as I have never had any money issues ever.
  24. My mate is getting a place of his own (lucky guy). But he is in overdraft of £1,500. He got a loan out of £2,000 last oct and feb of this year and is still struggling. But does that mean that he won't be able to get a place of his own when he gets a credit check? I said I will ask this form as I ain't got a clue myself lol. I mean surley if he pays it back fully won't that be enough? :/ thank u all
  25. Hi everyone I have had a Vodafone contract for 17 months now and for the past 2 and a half months I have had little to no signal. Ive been ringing every couple of days but unfortunately its getting to a point where I feel im being fobbed off. I just recently began adoption proceedings and I have missed calls from social workers. Im paying 29 a month for a useless machine. I would owe hundreds if I cancelled my contract and went to 02 and I just need advice
