  1. Sorry guys but its me again with another one of our cards...... This one was originally Halifax and like my others we started having financial problems back in Jan 2010 and still are. I initially came to an arrangement with Halifax to pay £27 back in 2010 but then on 11/03/11 had a letter from Blair, Oliver & Scott and after speaking to them (silly I know now) I arranged to pay £105 pm which was way to much for us but we agreed out of fright. Now looking at my credit file I can see that the card defaulted on 22/02/2011. I continued with these payments up until jan this year when we realised that we had become more and more overdrawn at the bank and finally sat down and really took a long look at our I & E and realised that there's just nothing coming in to pay these creditors but we can just about manage to pay all our priority bills. On 16/01/13 I wrote to B,O&S and sent them an I & E form and asked them to write the debt off as we just can't pay any more. Response back on 22/01/2013 saying they can't accept nil payment asking me to contact them on the number but I had already requested all correspondance be in writing as because we have so many creditors it really made me ill in 2010 trying to speak to them. I sent another letter 31/03/13 stating again that we just have no spare money and listed all my other creditors and once again asking them to write it off. 05/02/2013 I had a really nasty letter from B,O&S saying "you have failed to respond to our requests for full payment of the balance and you have not contacted this office with acceptable repayment proposals" .... then went on about further action etc but I HAD been in touch with them. They then rung me on 11/02/2013 and I explained I wanted to deal with it all i writing and they advised me get in touch step change etc. 05/03/2013 I sent of a request for the CCA and breakdown of account to B,O&S. This was signed for on 11/03/2013. 15/03/2013 I had another call and I just said that I want to deal in writing and that I had sent another letter. Now for the scary parts ... yesterday I had two letters waiting for me when I got home:- One from B,O&S dated 13th MArch (yeserday was 20th but I have kept the envelope) and this is a Notice of Intended Court Action..saying I could have a charging order put on my home etc. Another from Halifax themselves sending a reconstituted copy of my agreement and is really quite nasty. I think Halifax have sent a letter intended for when a third party is dealing with the matter but I have scanned and attached all the letters. There was also two sets of typed out terms etc one is a duplicate of the scanned form and the other is an up to date version. Now I've been full of bravado starting my campaign to try and sort my and my families life out once and for all but these really scare me.... Please Please can some of you experts on here help me in the right direction x
  2. Hi guys, I need advice. I got a letter from nciuk.com and they called to my house the other day. I told them I didn't have time to talk to them but they called last night and I arranged a meeting tomorrow. Have I done the right thing or should I cancel? I literally have no idea about these people. He keeps telling me he cannot discuss the details of the account and that they are just a 3rd party hired by banks to do a report about why my debt hasn't been paid rather than there to collect the debt. When I asked if it was to discuss payment options for paying it back he again said no, he could not discuss this and was only there to feedback to the bank as to why I had missed payments.   3. This is debt 4/5. Really annoyed at myself for getting this additional default. At the time I thought "oh well, whats another default going to do..." Silly boy. Type of Debt: Credit Card Collecting: Moorcroft (Only 'Acting on bahalf of' Halifax) Status: Default (19/10/12) Balance: £705.00 (as per credit file). Last Payment: August 2012 Penalty and interest charges already reclaimed. 28/12/12: Letter received from Moorcroft offering a discounted offer of up to 20% depending on my personal circumstances. I did not respond to this letter. 06/01/13: Letter sent to Moorcroft requesting CCA. 09/01/13: Received an acknowledgement of my CCA request. Letter also asked me to "provide an indication of the information you would rely upon, when giving evidence to the court or information to the relevant statutory authorities in relation to the alleged subject matter of this account." - I thought this was a very strange request and did not respond to this request. 29/01/13: Sent another letter reminding them of CCA request deadlines and offered 25% F&F. 02/02/13: Received a counter offer of 90% of the outstanding balance valid for the next 10 days. No mention of CCA request. - I did not respond to this letter. 09/03/13 Received a letter advising me that I have 'defaulted on the agreement we reached' and that I was now in arrears of the sum of £159.00 along with some "doorstep call" threats. 14/03/13 Today I have sent them a letter putting the account formally into dispute as they cannot comply with CCA request. I also noted that any form of communication other than written, would be seen as harassment and reported immediately. This one seems strange. They lead with discount offers, now cannot produce a CCA and claim I have breached a fictitious agreement made with them! Any suggestions my forum friends?
  4. Hi, I put in two claims with Halifax, one for my CC and one for 2 loans. I received phone calls from the two separate departments within 2 days of each other approx 6-7 weeks ago. I had my claim upheld for the CC and have received the payment but haven't heard anything else regarding the loans. I left it until it reached the 8 weeks and then phoned them but the woman on the phone wouldn't tell me anything, she just kept saying that they were still investigating the claim and that they would contact me when it was done. She wouldn't tell me why it hadn't been dealt with or where it was up to so I requested a call back from a supervisor, which I have never received. Where do I go from here? Should I contact them again or go straight to the Ombudsman? Thanks
  5. Halifax have charged me £30 for a returned direct debit which was due to pay my car insurance. Is this considered excessive and should I try to claim it back? I paid money into the account (cash) on the same day at lunch time but the DD had come out in the morning which I did not realise. Due to credit history I only have the most basic bank account with them which has no overdraft and an electron card. Andy
  6. I have recently changed my mobile contract to a different supplier and got a new number. I notified Halifax of my new mobile number through the internet banking service. I got no acknowledgement of the change by post to my registered address or to my registered e-mail address. All they sent was a text to my new mobile number to inform me to ring a number if I had not changed my mobile number. After about 4 days then it hit me if someone had hacked my account with Halifax and changed my mobile number I would not have known as they only notified the new number of the change. What would happen if someone hacked my account and changed my address e-mail address and mobile number would they inform me through any of my real contact details or would the first I know be an empty account. You can bet if someone had then asked for a replacement card and pin it would be my fault not Halifax. When I rang Halifax they say this is their procedure that they only contact the new number to check. I think I may well be moving my accounts from Halifax or are they all the same. dpick
  7. The Financial Ombudsman agreed that the Halifax should refund my 'Total Mortgage Protection Plan' (TMPP). I worked it out to £6K but the bank sent me a cheque for £1.5K. They say that the TMPP is broken down into Life Cover, Critical Illness Cover and Payment Protection (All of which my wife and I felt pressured into buying). My question is... Should I cash the cheque or go back to the Ombudsman for help reclaiming the whole TMPP which was one plan. Thank you.
  8. HI new to this site, so hello everyone! My husband and I took out a mortgage with the halifax in november 1994 for £42,515. With this was added asu for both of us, my husband was self employed and I was just about to start maternity leave. Also we think building and contents along with other indemnity insurances were also added. This was all added in with the mortgage and interest was added each year so much so that when we had enough of the halifax and moved in march 2002 we still owed £42,510.35 was the final settlement figure. When we spoke to the staff at halifax on the day of closing our account the man looked at our account and said he thought that the halifax had a case to answer over the way the account had been set up and ran. this mortgage was a repayment type. I have asked for a sar request and have uploaded my first couple and last statements to see if you can help. THANKS KELLY.
  9. Hi Just wondering, been informed i am entitled to ppi compensation on a Halifax loan, taken out in 2006 runs to 2031, £25200 taken out, £130 per month still active, anyone know what i would be looking at settlement figure wise? Thx in advance
  10. Can anyone advise please; I have been paying BOScott £26 per month since 2006. I get a letter from them on a fortnightly basis saying I'm one month in arrears (not) also they threaten to take payment from any money in my account even if it is my Husbands. I was made redundant, illness etc & till now have paid up BUT the letters never stop. I have sent a letter asking for details of the debt agreement as I had read on a previous thread. This morning I have received the usual letter Plus a letter from Bank of Scotland telling me they are trying to obtainthe original CCA docs but if that if I'm using a claims Mgt Co. they have quoted a warning issued by OFT re 'even if an agreement was to become unenforceable customers will sill owe any outstanding balance to the lender' etc they cannot have it both ways, who do I owe Halifax or Blair Oliver Scott? I have put up with phone calls, letters etc since 2006 & have letters from Bank of Scot. apologising for any harrasment. I give up!!!
  11. Re: Halifax One card Hi, can anyone please advise. Sorry for the long thread. To cut a long story short after I thought Halifax agreed to freeze interest on my card I found out before Christmas that they had decided to just lower the interest. I was originally paying £100, (£70 of which was interest) After they lowered the rate I was paying £50 (30 of which was interest) As I had sent them an income/expenditure form and it was clear that I was struggling as my rent had gone up and I was falling behind with lots of payments I decided to just stop paying them and let them take me to court. After being hounded by them, (they were even calling me on Sunday mornings), I decided to answer their call and an arrangement was put in place on 2nd Feb whereby I would just pay £20 a month and the interest would be frozen. I offered to pay £30 but the woman said I had to pay £20 otherwise the arrangement could not be set up. However, I tried to make a payment this evening over the phone as Halifax won't accept a BACS payment from another bank and I was told that there is no record of this arrangement and my case has been referred to a claims company who asked me to pay the whole £3000. I called Halifax again but I couldn't even give them the reference number that was given to me when the arrangement was made. They just said they couldn't discuss it with me. Who can I complain to about this? The telephone conversation must have been recorded. I feel like I just can't cope anymore. I'm a single parent and have always worked but I just don't earn enough to make ends meet.
  12. I took out a Unsecured Personal Loan with Halifax online in December 2011. I was NEVER asked questions like, can you afford the payments, are you employed/unemployed, and I certainly was not asked about my income. This have got so bad I am currently on an IVA - Halifax increased the IVA from 5 years to 6 years forcing me to pay for longer. I am now wondering if bankruptcy is the best option. Do I have a claim that Halifax lent to me irresponsibly without going through my finances first?
  13. Hi, Just wondered if anyone has any experience similar to mine regarding separate claims with same bank. I have today received a letter from the Halifax upholding my claim for PPI on my credit card, its not a massive amount but I'm just happy and surprised that they are paying out as I wasn't expecting them too. I have also got a claim in with them for 2 personal loans from around the same time, my circumstances and reasons surrounding the claims were the same but I know that a different department are dealing with it as I received separate phone calls, are they likely to uphold my claim for these too or is there a chance they'll still reject this one?   14. Hi guys I am enquiring for a friend (no, really!). They went to Stepchange (back when they were CCCS) about four years ago, multiple debts with different creditors. It's just the Halifax I want to get some help with. Stepchange managed to get Halifax to freeze the interest, but then they started putting it back on again. Friend was a bit too frightened to deal with it, So asked Stepchange to step in. Stepchange recommended friend contact Halifax themselves to plead their case for freezing the interest. Several letters were sent over the last 4 years, asking to freeze the interest, which has sent the debt spiralling out of control. No responses from Halifax. The initial debt (from what we can work out from the Stepchange statements) was £6400. Friend has now paid Halifax £5600. With the interest, Halifax are claiming friend still owes £6100, in comparison to the £800 on the Stepchange statement. This has my friend at their wits end, and prompted them to write a letter to the complaints department, outlining how this was out of control and affecting them both financially and in terms of their wellbeing. Halifax wrote back(!), explaining that they only ever agreed to freeze the interest for 12 months (friend was not aware of this), and offered to refund the last 3 months interest and overdue penalties to "help". My friend has an opportunity to try and borrow some money from family, but it won't be anywhere near what they're asking as there are others to pay, too. Is there any mileage in asking the Halifax to remove the interest from the figure in order that my friend can offer F&F? Any official way they can put it that carries weight? Any advice you could offer would be really much appreciated. Many thanks!

I took out a pre-approved credit card with Halifax bank in 2007 because the cashiers kept trying to sell the card to me every time I went to the branch, saying it was already approved and all I had to do was to sign some papers. I did decide to take out the card as I didnt have any credit card at the time. Three months later, I became unemployed. I didn't get back into employment until June 2010 and that lasted for 6 months until I had to relocate outside the country. Sometime in July 2012, I received a letter from Halifax advising my payment protection policy was been transferred. I then contacted Halifax saying I never knew I had ppi on the credit account and that if I knew I would have claimed since I was unemployed and was at that time facing serious financial difficulties with keeping up with payments. I was then told by the customer service person that the ppi policy had already been cancelled as I wasn't keeping up with payments. So that meant I never knew I had a ppi policy and didn't get a notice of cancellation.I was then asked if I wanted to make a complaint or do I want to make a claim which I replied to that I didn't know what the complaint process is? I was given refernce number and was told I will be contacted in due course. Then received a letter dated 1st sept 2012 stating ppi claim wasnt upheld and they had tried to contact me even though I never received a call or letter. Letter stated complaint was CONSENT TO COVER and findings was: '' Sales process at the time required additional consent to confirm you wanted a PPI policy to be added to your Credit Card. I am persuaded that this would have required a verbal explanation ensuring that you were made aware of what you were purchasing'' ''It can therefore be concluded that you knowingly consented to the addition of a PPI Policy to your credit card'' After receiving that letter, I then decided to let it rest as I didn't know how to go about fighting the decision. It would be 6 months since the receipt of that letter in March. Hence since I discovered this website, there is not enough time to do a SAR request as that will take 40 days or follow procedures stated. Please what do I do now. Should I write to the Financial Ombudsman Service and what should be the content of the letter!!!
  16. Received my SAR from Halifax and have all the statements from 2000- 2008 and a copy of the credit card application. For the first 14 months there was no PPI added but after that it was. The application states that I ticked NO to any kind of PPI. Added up the PPI and it totals almost £2000 without interest. I'm sure I can make a claim but after having little success in the past claiming back contractual interest should I just claim the 8%?
  17. recieved a letter from halifax basically saying they are not upholding my claim for a return of mis sold PPI, this followed a telephone call from halifax which the lady asked if I remember as far back as 2002 when I took my mortgage out, I cut the conversation there and I advised the Halifax lady to speak to The claims guys reference my claim, can any body advise weather the Halifax are playing hardball or is this a process that they follow in order to try and stop or delay my claim? Oh they did enclose the FSO booklet and the letter seemed A-Typical bog standard letter that I am probably n ot the only person to haqve received? any wisdom would be most welcome. Thank You:-x

Halifax mortgage. never missed payments until last year. my deal allowed for a repayment holiday. went into branch explained in difficulties, was given 3 months 'off'. may, june, july. my situation hadnt improved so then missed August. Saw their field agent [charged for] who took full statement of particulars etc; and i asked for help via interest only option. i made the payment for September. Eventually got letter confirming a reduced payment for oct, nov, dec. i took this for an interest only due to the figure offered. however struggled so hence the reason for Court possession hearing. based on their Court papers and then Witness statement, i have communicated via email with the solicitor stating i dispute the amount claimed [they have included the 3 months holiday and also the full amount rather than interest only amount for the oct-dec]. plus they state they dont know my circumstances etc, yet they have the field agents report, so they were inaccurate in their claim. i also stated that i felt their 3 month interest only offer was short sighted and not dealing with my request for long term help; as discussed with the field agent. additionally i was getting arrears letters and new payment amount letters during the oct-dec [harassment?]. i asked for the arrears to be added onto the mortgage [plenty of equity] and an interest only option for 2 years to allow me time to get back on my feet. they said no. they now say the 3 months holiday was just an 'arrangement' and not a formal payment holiday and the reduced payment was not an interest only option, just a reduced payment arrangement. hence how they have arrived at an arrears figure of c£6k based on the full monthly amounts, where I calculate it at approx £3k based on the holiday and reduced agreed amounts. their own criteria as i have now found out is that they can offer such a facility, interest only, but only if 6 months of full regular payments have been received., and only after another income/expediture provided. i have stated they have one from end august, paid for, and nothing has changed !! hence why i am in this financial position and asking for help. i then asked if i was to make 6 months payment at the full amount, knowing that financially it will be a burden, would i then be allowed to drop to interest only for 2 years and the arrears added onto the term. the response from the solicitors was that they would accept that proposal, but ask for a suspended possession order and also want a full inc/exp before confirming acceptance. BUT for any interest only and arrears consolidation i would have to discuss direct with Halifax.!! [they are on a direct computer link with halifax/BoS]. Additionally in their witness statement they state they have followed protocol to assist blah blah blah, including offering reduced payments and consolidation of arrears. I have replied stating that i am unhappy as there is no guarantee after financially struggling for the 6 months to comply with their own criteria for qualification for an interest only mortgage, they will be any more helpful than at present [words of that effect] due to their lack of flexibility. Also they have NOT offered consolidation of arrears, as they claim, even after my requesting it through my own proposal. Therefore i have advised them that the more sensible proposal is that which i originally asked for, 2yrs interest only with arrears consolidated/added to term., as that is a more financially viable, sensible and sound option and I will be attending Court to reiterate that offer. So.......... if you got this far !!! i have no faith in the court system [even longer story] to the point they make me physically sick but obviously have to go on friday. all my emails were marked without prejudice and i also referred to my right to produce/use as evidence in Court. Tomorrow i will print out [x2] copies of all my emails etc and create my own witness bundle and hand deliver to the Court so that the judge has it on file - i will email copy the solicitors also. If any thoughts or advices as to any case law i can refer to etc etc, i would be grateful for....... sorry so long winded but just decided to share this worry.......... THANKS !!

Hi, back in 2009 I did a CCA request with Halifax and after them failing to supply me with the relevant documentation I was passed on to various collection agencies who in turn failed and returned it back to Halifax for resolution. 1st Credit however have failed to pass the dispute back to Halifax and have now lodged a default on my Credit file, surely they cannot do this, I have informed them numerous times that Halifax have failed to respond to my requests. How would I get this removed? Thanks
  20. Hi all, I'm writing this on behalf of a friend. I've done the usual by applying for my original credit agreement from my credit card that i've had with halifax since 1990, sent the £1 and i got a response. I have been self employed all my life which i believe is one main point to use against the PPI reclaim, now - on the letter from them they state they have attached reconstituted terms and conditions and a copy of my original signed application form together with a signed statement of the account. I need your expert help and to find out if i have a claim here, the one box which i believe relates to PPI is point number 12 of the attached: CREDIT CARE, it says: If you do NOT want to participate in credit care please tick here...which i did not. What do i need to do to reply to Halifax and the application is old but still should mean something?? All your help would be appreciated. Files: [/url]
  21. Hello Forum, I have received a letter from Halifax credit card notifying of arrears on the accounts and demanding £1,006.61 before 6th Feb or all hell will break loose it would seem. This is an account that I took out many years ago at 9.9% and they have rate-jacked me many times to current 24.9%, this is why the debt has become unmanageable. I want to contact them to discuss options but I want to be armed beforehand, doea anyone have experience in how best to approach etc? I do not deny the debt and want to pay it off, I just need some assistance and a degree of Halifax accepting that the rate hikes are a factor. Thanks.
  22. long story very short... ...Halifax cc taken out in april 2006. Can't now afford it. My credit file is shot so i'm not bothered re-defaults. I asked Robinson Way for a copy of the cca, they got a photocopy from lloyds, the prescribed terms are all there but it is unsigned in the box which requires the lender's signature and date. Can i contest this or should i just offer them a pound a month. The debt is £2500 and i'm currently self emploed, i earned £150 last month £300 this month. My house is charged upto the hilt, £55,000 to the bank £70,000 to a relative. It's worth £100,000. I have no assets. Any advice would be great. Cheers
  23. Hi, I have too much debt to cope with at the moment, and have a CC with Halifax with a limit of 2500. In November I couldn't afford the minimum repayment so set up a payment arrangement with them of £20 which they said would last until May. I've been on time with these repayments since then. I've now got a letter from them saying my account is in default and if I don't pay £225 by the 30th then they will take me to court (I don't have £225). I don't know what to do I have other debts of £1000 with Vanquis (yeah, I know)... around £1800 of a £2500 loan with Natwest and around £440 of a £500 Natwest CC. I'm struggling paying most of these and don't know where to turn next and I'm terrified.
  24. Hi Eveyone, I'm sorry in advance as I'm sure you get a lot of posts similar to this one. Im sat here at 1:40am worrying about a Car finance application because of an only halifax default on my credit file. I know my credit history is fantastic except for this one thing. I need advice. Apologies but i am dreadful with approximate dates. The History Around 2005, Halifax gave me a £1000 overdraft, eventually i over a year i filled it up and was just paying the interest of about £15pm. I did this for 2 - 3 years without any issues. Then halifax changes the OD rules meaning I would be charge the £1 per day i was overdrawn and since I was in the full £1000 I knew i was going to be paying £30 per month from then on and that was to much. I went into my local branch and pleaded to an adviser. I asked her if they could freeze my account and I would continue to pay off the OD, she informed me the only time they would freeze the account would be if I went considerably un-agreed OD where it would then be enforced as a debt as such. So i asked if i could apply for a credit card or loan to pay off the overdraft and then just pay the loan. she declined. The lady stated that "halifax have to be seen as responsible lenders, and if I cannot afford to pay £30pm for the overdraft how could I repay a £30pm loan" to which I replied, "I could just afford the repayments on a £1000 loan but at least that £30 would be paying off the debt, with the overdraft I could be paying £30 for the rest of my life and still owe you £1000" The lady told be that she was very sorry but there was nothing she or I could do. being young and strapped for cash I thought "well stuff you, I've told you I have a problem, I have asked for help and you wont so i'm not paying it." i ended up un-agreed OD of £1500 with charges before they froze the account and sold on the debt. then I was contacted by the debt collection company. I explained the situation to them, Obviously they didn't care. I explained that I would be happy to begin paying off the £1000 but would not be paying the £500 charges as those charges could have been avoided, the lady became very rude so I have ignored them since. Which brings me to now...... I know that the ONLY bad thing on my file is that one default from halifax but it is affecting my wife and I massively. I just managed to scrape sub-prime car finance 6 months ago at a rate of 79.65% apr Its killing out income. Is there anything I can do. It seems crazy that I should have plenty of credit with places like littlewoods, vanquis, Landline, ect ect. but for things like a small loan or car is a NO GO, for one small thing that happened years ago. I'm sorry for the huge message, I just needed to get the entire picture accross. Mike.
  25. hi, very worried as I had missed a payment early on after getting the possession order then been paying on time and missed a payment as I had changed my card details and couldn't afford the payment by time I realised it hadn't gone through. Been having non stop calls for past few days as I am a student nurse I was at work and missed the calls. I called tonight to be told it had gone to litigation that morning and although took new payment details he said he would speak to manager in morning but it would prob go down lines of eviction. Total arrears 7000 and of those the 2000 are under the possession order. I don't know what to do or try. I want to keep my house and can maintain payments even though its hard I am not ready to give up. I also have suspended possession order on my first mortgage but its much less and am managing that. The plan is to remortgage in a few years when I can finally get out of arrears and the possession orders and improve our credit rating. Please help Please help they are calling me tomorrow
