  1. Hello all and thanks in advance for taking the time to read this. I am a business seller on ebay and instructed UPS (via P2G) to deliver a £240 pair of speakers to one of my customers based in the UK. It was fully insured and tracked but did not require a signature. On the scheduled delivery day I received a message from the buyer saying they had returned from work to find a card through the door which said that the parcel had been left on their doorstep but no parcel was there. The on-line tracking confirmed delivery to their doorstep. I did not specify that their doorstep would be a safe place so i'm rather surprised they just left it here, especially as the area crime rate is 2 the national average for theft! I advised my customer to look all around the house, in bins and to check with neighbours but to no avail, it just wasn't there. I have made a claim with them but it has been rejected, they just say it was delivered to a "safe place" as per their T&C's and are washing their hands of it although they have offered to pay the cost of carriage as a "gesture of goodwill" I am just wondering if there are grounds for me to bring a case in the small claims. I don't see how a doorstep can be described as a safe place especially when I haven't specified a safe place. I have looked on Google maps at the delivery address and it's a small terraced house with a small front yard which fronts onto a busy road...not exactly hidden from view or protected from the elements for that matter.   2. Hi Guys, Just checking something out and was looking for clarification. On my Equifax report, it states that an overdraft I had with HBOS. First late date payment was July 2011, then subsequent months late and then shows as defaulted in January 2012. I'm assuming as it shows, this means no payment since June 2011. The debt appears to have then been sold to Arrow Global as they have listed the default on Equifax in January 2012. I have never once communicated with Arrow Global on this. I obviously haven't made any payments to HBOS regarding this. Today I received a letter from shoosmiths asking for payment or even a partial payment to clear the entire amount in full and final settlement. It looks like to me they are clutching at straws and this will become statute barred as of June 2017. Can you confirm if I am correct? Thanks
  3. Hello Im not even sure where to start. But a year ago me and my boyfriend tried to rent a house and he was declined because they said when they run the credit checks he had a CCJ. This was done with Experian. He was not aware. He knew he had some arrears with housing benefit but he thought all was sorted. For the last couple of months I start nagging him to try and get his stuff sorted out. We contacted DMC who sent us to another DMC and said our way out would be an IVA. When we got the IVA draft I saw several companies that my boyfriend owed and because I had no papers of anything I decided to get some letters out and ask for loan agreements and even check for PPI myself. One of them already sent us a letter saying that his debt has been cleared and he owes them no money. Other for a Barclays credit card debt that has been taken with another DMC has said they could not find him in the system. Although when I contacted Barclays PPI they said he was still a client there. So unsure he owns them money or not. Now the last one in this draft is the CCJ. That is two companies claiming he has this CCJ. But because I am a bit afraid of contacting the court and get bailiffs in the house I am renting, I run a credit check of him on Experian myself. I have input all his data and addresses that go back to 2008 and he has checked this and there are no typos or mistakes. He is also registered to vote at my/our address (he is paying all his bills and his current accounts all have this address) Voila He actually has a good score but none of the debts or CCJ I described above are in there. There are credit cards and all but it is all accounts he is paying and although at high interest he seems to be ok in this check. I decided to check Trust Online as well. Paid £8 for the England and Wales orders & judgements and also England and Wales Fine Defaults. He came back clean! There is nothing in there too. My question on this is Should I have put the address from when we think he had his CCJ in this Trust online website? I input his current address which is the house we are renting. was this a mistake? All the addresses in question at the time of his CCJ are in Experian thought and nothing points out. I havent used his middle name on Trust online because it didnt ask but used on Experian. Should I? I have been reading some of your posts and it seems these companies find a way to put old debts in. I contacted the guys who drafted the IVA to clear that account. But they keep nagging us to sign into this. But I have my doubts and I am trying to get as much information as I can on everything. And until I am sure he has this CCJ I am not going to tell him to sign anything. I was the one asking him to try and sort this out, but now I am afraid that if he signs the IVA will be worst. THe Experian I run seems legit. Has all of his info so why no CCJ. And why no CCJ on his register? Should I actually be celebrating because I can get a proper mortgage, get married, have kids? Or should I go and try and contact the court risking the fact they can realize they havent chased him and they will start now? Can you please let me know your thoughts on this?
  4. Early last year my husband received a county court summons for £11,500 for a credit card debt sold on to a DCA. He replied and defended the action on the basis of the limited information on the summons and that he was awaiting a reply to the CCA letter sent to them on the day the summons was received. He never received a copy of the CCA, just a letter from them saying the debt was no longer enforceable and they could not proceed any further through the courts, but would he please call them to discuss a repayment plan. They also promised to forward the copy of the CCA. That was over a year ago and we are still haven’t received the CCA, but what he did not advise them was the debt would not really be statute barred until last October , three months after their letter. Move forward to now, and I have received a letter from the same DCA and they are chasing a debt for £8.250 for a card of mine. This will become statute barred in the middle of August when it will be 6 years since the last payment. I received a letter from them dated 6 April but not received until 12 April, saying if I did not contact them within 14 days they would commence legal action. My understanding of statute barred debts is they expire six years after the last payment or admission of the debt and the creditor has until this time to obtain judgement. Is this correct and can the DCA request to the courts an extension this period for the time it takes to transfer to a local court and to a hearing? The default for this will expire soon and I am l keen to keep as clean a record as possible after eight years of financial misery. I appreciate I am morally wrong but this DCA will have purchased the debt for peanuts,
  5. I took out a Unsecured Personal Loan with Halifax online in December 2011. I was NEVER asked questions like, can you afford the payments, are you employed/unemployed, and I certainly was not asked about my income. This have got so bad I am currently on an IVA - Halifax increased the IVA from 5 years to 6 years forcing me to pay for longer. I am now wondering if bankruptcy is the best option. Do I have a claim that Halifax lent to me irresponsibly without going through my finances first?

Hi guys I have an outstanding debt with Tower Capital in Bournemouth which is one payment away from being closed (£35) But ive tried to contact them and they seem to have disappeared from the face of the earth!! :O Ive got their number but it just rings out....   9. Hi guys, So I made a personal loan to a friend for £2,500 on March 8, 2012. There was a contract for repayment in full after 2 weeks with no interest and was witnessed by a third party. This friend was moving cities and opening a new business, so he needed funds for housing/expenses etc. Repayment time comes and apparently his business has failed terribly. He's moved home and nowhere to be found. Won't answer my calls. Will respond via text sporadically saying he will pay in 3 days, then not respond for two weeks. What do I do? In another thread it was suggested that I start with a tracing agent? Then what? My concerns are: 1) I don't have his address or know where he is 2) I know he is dodging his ex-wife for child support, so will most likely not have many assets in his name 3) I've heard he has setup a new company, using his father's name as a Director and paying himself out through the company what do i do?!?!?
