  1. In the middle of April last year my car was hit while on display at a car meet. The guy who drove into my car was sorry and admitted full liability. The next day I rang the local main dealer and asked to be put through to the body repair department. I explained what had happened and was told that someone would contact me to sort everything out. Within the hour I recevied a call from what I assumed was the garage. The chap on the end of the phone took some details of my car asked if it was roadworthy,which it was not. He said that I would have a replacement hire car at my home address the next day. The following day a car was delivered.That evening I sat down and read some of the paperwork left with the car.This car was £500 per day to hire!!!! I was unable to contact anyone over the next four days due to Easter holidays. On the Tuesday I rang the guy who hit me insurance company and told them about this car and the cost of it. I then explained to them that I was able to source a similar standard of car from a garage in the village I live in for £125 per day.The insurance company agreed to this and confirmed this in an email. I cancelled the first hire car and started to hire the second. At the end of July I was doing a charity event with my make of car for a childrens hopice. I rang the insurance company and explained the situation. They supplied me with a hire car of the same make and model for that weekend,they also rembursed most of what I had paid out on car hire up to that date. It took their assessors three months to come and look at my car. It was agreed that a new nosecone was required. I have been paying out for the hire car for the last five months[a now eye watering amount of money]. I have been in contact with the insurance company recently regarding payment of my costs and they have started to fob me off with excuses.One of them being that my car is fit to drive!!!! The car is still in the same unroadworthy state as it was before.[part of the damage to the nosecone has made it impossible to fix the indicator or sidelight to the car] They even mentioned could I try sticky tape to fix it on!!!!! The car is quite bespoke and I am lead to belive by the bodyshop that we are on the final leg in regard to obtaining the parts. My question is what can I do about recovering my money????? Your thoughts and sugestions will be greatly appreciated!! Sorry for the long story and spelling mistakes

So they sent me a court form today from Northampton, I've already cca'd them and they admit they don't have it, what's my next move, the court form came after the CCA was acknowledged as not being present, it may be a cross over but I dont want to ignore it. What should I do next? Acknowledge service? Or defend.
  5. Hi guys, I recently went to open a business account to start a new busines . I was rejected so joined experian and found out I had a ccj dated back to 2013. Couple of things. I wasn't aware of this ccj which is registered to my old address (which my ex wife lives at). I didn't get my post for the first year or so due to bad relations with her (2009-2010) but since 2010 I've been getting all my post and have no recollection of this. Should they send the ccj paperwork recorded delivery? I contacted Northampton county court and got the details. Then called the solicitors. They gave me some details saying it's for a credit card and the amounts etc. I said I don't think this is mine can you get me a copy of the credit agreement. Roughly 8 weeks after my request and many many phone calls I got a copy of statements (just plain and no details or specific marking of original creditors) but no agreement. I spoke to them again and they said they have requested agreement and are still waiting a response. I also received a letter from a dca saying they have put it on hold due to my request and won't chase till I have received relevant paperwork. I know in hindsight I should have really done all this via letters but was panicking and trying to sort quickly. If they can't find the agreement do I have a chance if setting this aside? Should I send a letter stating about the phone calls and again requesting the agreement, giving them a time limit? How can I prove I haven't received any paperwork? What are my options? Sorry for being long winded and hope someone can help. many thanks.
  6. Hi, I have a 16 month iPhone 5s, on the three network, and until recently the battery on the phone was ok at best. However, more recently I have noticed that my iPhone will power itself off when the battery power is low. I have noticed the battery power at 38% and it has done this. It would also turn off if I had around 10% power and I attempted to use the camera. Anyway, the only thing I could think of that had changed was an update to the IOS that could potentially cause this. I tried to phone three uk today but their system was not available so I could not speak directly with someone. I managed to have a 4 hour conversation with three uk via a series of tweets and when I eventually explained to them that the phone battery was not working as I expected it to they asked me to contact apple directly. I replied back saying The Sale of Goods Act makes reference to 'the seller', this is the shop, the retailer, or the individual you bought it from, and this is who you made the contract with.   7. Hi, As per the title of the thread, I have been sent a form for a debt to Next Directory for £453.57. It gives a date of on or about 31/03/2008 and says it was assigned to them on 15/10/2010. I have never had an account, as such, with Next. The only thing I can think of is that I ordered six or seven items from them online in the after Xmas sale in 2007 and only two arrived. I remember phoning them and being told that the other items were being sent separately so to just pay for the two which had been delivered, which I did. An invoice arrived which stated that the other items were out of stock so, obviously, that was the end of the matter. The out-of-stock items would have come to about £400 pounds. It was a pain in the rear because these were "deferred" Xmas presents - we had just exchanged token gifts on the day so we could get the things we wanted half price a few days later. If that counts as having an account with them then yes, I did, but I never bought anything else from them, I paid for the items I received, never signed anything and do not owe them anything. What should I do now? It was nearly seven years ago so I don't have any paperwork and I am only guessing that this is the cause of the problem, if it isn't then I am stumped. I have a long running dispute with Barclaycard and have had lots of threat-o-grams so it is possible that Cabot have written to me in the past but I don't recall anything about this alleged debt.
  8. I really need some advise. I moved into a flat in Jan 2014, and was a full-time University student until June this year when I graduated. I received a 'summons' letter from the council in May regarding non payment of CT. I sent them my student exemption certificate in May. They received this, but failed to add my student discount. I lived alone in the flat. It was a 'studio flat'. I didn't know they hadn't applied my discount until I received another summons letter in August. I phoned them about this and they apologized and have now applied the student discount. However, they have not removed the summons charge and it is apparently £200!, it had increased from £60?. They basically said if I don't pay it, it will go to a company who will keep adding more money onto it. I called them a few days ago and they said to enter into a payment plan in order to stop the charge increasing. I agreed out of fear of that charge increasing but I will NOT be paying anything when I don't owe that council tax!. How do I dispute this summons charge?, surely it has to go to court before they can keep increasing the charge?. I'm very confused about it all. I'm currently receiving JSA and have very, very little money. Is there a way I can make this go to court?, surely the court will agree with me?. I have all the evidence from my University stating that I was indeed a student during that period. I also have all the letters that they sent me. If anyone can advise me on what to do that would be really helpful Thank you

I can't stress this enough, under no circumstances can FIRST TRUST BANK be trusted, they admitted a massive breach of data protection leaving everything avialible for other customers to see, to which I took a photo, this included bank statements, cheques etc.... They then poss forged my partners signature for a credit card application... [removed] They left my partner stuck in Paris when their systems went down.... When we complained they made us wait the full 8 weeks, admitted the breach of data protection, told us we had no right to contact them again, here's 500.00 and told us to leave the bank. This bank already has a large history of dishonesty, please don't use, remove your money and bank somewhere else.
  10. I originally had debts of nearly 60k, mostly on c/c's. I did have an advantage in that the cards were taken out late 1990's, early 2000's. With the help provided by CAG, I fought of every attempt by these to reclaim including threatened court action by the dreaded Restons in 2 cases. Turned out that 3 creditors could't find the agreements, the other 3 agreements would not stand up in court. As stated without the advice from CAG, I would have be paying these forever. As it was the companies were reduced to endlessly bouncing the accounts from DCA to DCA. Checked and double checked today, they are all now Stat Barred. Only adverse left on my credit file is a default from one of them (the company waited the full six months before defaulting), however that falls off in Sept this year. What I am saying is don't give in to pressure from the OC or the DCA's but fully check out the claims made against you and never believe the outright lies they tell. David

  13. Hastings Direct They might be cheap, but that counts for nothing if you have to endure the way they treat you if anything goes wrong. I added my housemate to the policy, which was a tortuous process. Then without permission, they kept her bank details and then took money out of her account, (not mine) just before Christmas last year, which left her financially knackered. This would have been bad enough. They then claimed that they'd informed us this would happen in a letter, and despite us reading the letter to them over the phone, would not admit they were in the wrong. They eventually gave us some nominal "hush money", but I didn't ask for or agree to this. Then, they messed up my renewal again (penance for causing a fuss?), and because they didn't act on it when I asked them to, they then tried to stiff me for an extra £500 quid "the next cheapest quote". Hmmm... Forgot to mention this earlier, but when they didn't act on the renewal, rather than telling me they hadn't done anything, they informed DVLA who wanted to take legal action. Of course HD didn't think this was worth mentioning to me. This prompt from DVLA meant I found out that HD had done nothing and that's when they said they wouldn't honour the original quote, even though it was their fault. They did in the end, after more 0844 calls and misery. On top of all this, they have now sent me a renewal quote for.... £500 more than last year. They are fully aware of the stress and financial injury they've put me and my housemate through, yet still try to fleece me at renewal. I've asked for them to comment on the legality of holding non policy holders bank details and taking monies with no authority - no response. They informed me in a letter that they'd deal with this complaint - no response. They told me that someone senior (above a gentleman called John McGrath) would call me - no response. A customer services member of staff wrote to me, informing me that if (!) I was unhappy, on top of the complaint, I could take this to the Financial Ombudsman, details enclosed - no enclosure. I've asked the Financial Ombudsman for advice. They ask that I exhaust my complaint with HD first. What do you do if they promise to call and deal with it? Learn from my and others experience. Run a mile from this lot.

  15. Hi all I've been suspended from work on full pay, pending investigation and without prejudice however I am not sure why. The reason given and the reason in their letter is for misusing social media and breach of data protection but I'm not sure what they're referring too. I've tried twice now to find out specifics of their allegations but they're not telling me. I was suspended at 5.35pm on Friday and I've been asked to attend a investigatory interview on Monday lunch time which gives me no time to seek advice from anyone. Does my employer have to give me the specifics of the allegations? I really don't think it's fair that I'm expected to attend an interview without having a clue what it's about and would like to prepare myself prior to the interview. Also - have they given me enough notice to attend a interview? Bearing in mind that I cannot get any legal advice during a weekend and it would be extremely difficult to speak to HR prior to the interview on Monday.   17. Hi all, I couldn't find an appropriate forum to post this in. A friend of mine set off a smoke alarm in a hotel a couple of weeks ago. She said (and I can verify this as I visited her room) that there were no no-smoking signs in the room (or any that she saw outside of the main lobby). Her room was booked and there was no mention of the room being non-smoking. She apologised when the manager of the hotel arrived at her room and thought that was the end of it. The room was booked for a wedding. Now, the hotel are demanding a £100 'fine' and are saying that if she doesn't pay it, then they will bill the bride's credit card that they still have on file. Can they actually do this? Firstly, she signed nothing apart from the card that she filled her address on when she checked in - there was no mention of the room being non-smoking and no mention of a 'fine'. Secondly, even if there is an implied contract (which I would guess there is), would this not be considered a breach of contract therefore rendering this 'fine' unenforcable as per the 'Dunlop v New Tyre Co' argument? ...or should she simply pay up as they have her over a barrel?
  18. Hi, Well all my debts are now behind me with Lowell the last ones to acknowledge it was game over and sent me the letters to prove the accounts were now closed....well they were 10 years old. I bit the bullet and decided to see what my Credit File was like as for a couple of years things have been steady for me and I have been able to get credit. The reason I decided was I was offered credit at a good rate last year but this year just out of curiosity when I did an online cost checker at my bank, the interest rate offered was 29.9 percent..... My Credit score 783, showing as fair and I wasn't showing on the electoral roll so I queried this with the council and this was corrected. My score then went up to 838 which according to Experian is still only Fair. I have no defaults, all payments up to date going back several years with no late payments and still a fair amount of available credit left. The only possible thing I can think of is I had a Wonga loan 20 months ago as I had just had a big unexpected bill which would have meant an unplanned overdraftso in this instance, Wonga was cheaper than the fees. According to Experian I have no adverse info, all good accounts yet still only a fair score. Anybody any ideas on how this works ?
  19. So, the wife and I needed new laptops, and we saw the offer of £100 cash back. To be doubly sure that the offer applied, I rang their customer service line to ask if I could click and reserve both computers in one transaction, or whether we had to buy them separately to get the full £200. I was advised that I would get £100 off EACH laptop and only needed to do one transaction. I therefore went ahead and reserved the laptops, and went down to pick them up from Currys/PC World Derby. "39 Bruce" served me, and I again checked with him that it was okay to put both laptops on one transaction. He assured me that it would be fine, and duly processed the sale - issuing me with TWO claim forms with separate cash back reclaim numbers. He pointed out the dates for claiming, and seemed to fully understand the terms of the offer. I now come to make the claims, and have had one rejected as there is a maximum of ONE voucher per person. It appears that I should have gone to the store with my wife, and bought the laptops separately. So, a word of warning. DO NOT ASSUME that CURRYS / PC WORLD staff know what they are talking about. If they are unable to properly advise on their own promotions can you really believe what they tell you about other companies computers or electrical goods. I have all the paperwork, and will be taking legal action against them for a clear breach of CPUT 2008. I just wonder how many thousand's of pounds they have squirmed out of paying by the mis-advice of their staff, or making customers go through hoops to make their claim?

  22. I moved into this 3 bed house in March, and immediately told the landlords that the windows in the house don't open. The only windows that open in the whole house are the one in my bedroom and in the bathroom. My children and grandchildren and in the other 2 bedrooms, and they bake in there, especially now that we're getting into the Summer. The kitchen windows don't open, so cooking is always difficult. I've told the estate agent many times, and she's even sent someone to have a look, but hasn't done anything about it. I'm really annoyed, and just want to know how I could make them sort out the windows. I pay £800 per month in the house, for goodness sake. Any advice would be greatly appreciated.
  23. I don't wish to attend my disciplinary meeting. I've suffered from anxiety/depression for years and I don't feel up to it. I am expecting to be sacked anyway and wouldn't go back even if I wasn't sacked. They've not given me much notice. Can I send them a letter which they'll likely receive on the day of the planned meeting saying that I am unavailable and that they have permission to go ahead without me? Thanks.
  24. i purchased a sim and dongle to use with my laptop from t-mobile for £7.50 per month about 15 months ago. At the time i was told that it would have a price cap and stop me using up more that £7.50 per month. I've been getting emails telling me when i've nearly reached the limit and when i've hit that limit, i cant download for the rest of the month. the device has been a bit slow of late and i went to check for an upgrade and to my horror, was told i was paying betweek 30 and 50 pounds per month. I was shocked. feel like an idiot. how do i get m y money back? has t-mobile done this to anyone else?
