  1. For 2yrs and 5months have been getting calls from SWEL and 3 DCAs trying to recover circa £1200. for some sort of service to a property in Portsmouth. Tracing by SWEL, EOS Solutions UK Plc, UK Search Ltd, and Ruthbridge Ltd. My wife was unlucky to marry into the same Mrs Firstname Lastname as a Miss Firstname Lastname (I believe a widow) and from what I can deduce same DoB. SWEL was notified by email and replied that they would remove our address from the account. There should therefore have been no need to respond when DCAs sent bills, as SWEL will have provided them with correct information wouldnt they? Lol. A month trial of Experian in 2013 showed no alias information on credit report so that was not worth the paper it was written on. My telephone number is listed in my name and whilst I don't answer witheld CLI calls, nor unrecognised callers; the calls are still logged and made available by my provider. The typical behaviour is to call weekdays and Saturday mornings witheldCLI chain dialed up to about 35 calls in a day, plus 1 or 2 calls with a false CLI number such as '678965' or '0000000000' which surprisingly weren't answered or went to voicemail with or without message. The harrassement therefore also creates the extra work collecting the logs, and any voicemails together. The DCAs send out letters and bills threatening to send someone to visit, but sadly they never seem to get around to any action that could have counterclaim. FOI Information from SWEL reveals that SWEL do not check customers identity prior to providing credit for services. This means that they do not actually know which firstname lastname was provided with services. The question therefore arises why pay their bill if you are moving anyway. I spent half a day in 2013 tracing the actual debtor. This took a little time but was quite easy; and I would be prepared to sell the information for decent fee. It became clear that the tracing done on behalf of SWEL amounts to nothing more than searching the CRA databases. In view of the above I am looking to blacklist the calling numbers but there are difficulties - not least is that their numbers benefit from the privacy settings of CLI system which rightly protects the x-directory numbers of individuals; but these companies and Telemarketers should forfeit by the nature of what they are doing. Using Asterisk software, - "If there is no Caller ID received, then the LookupBlacklist has no effect." and to blacklist a false number would be to little avail as the target is moving. Calls having witheld CLI can be normally rejected. We need laws against the presentation of false CLI numbers. We need to allow access to phone numbers used by DCAs and Telemarketers, and Telesurvey companies. We need to be able to communicate with the CRAs without fear of providing ANY information which might be used to add to their collected database. We need legislation that DCA bills or threats MUST be followed up by court action within 1 month or be withdrawn. == Oz
  2. Having a bit of fun with the above who deal with my waste water. They had been sending lovely red coloured bits of paper every month becasue I had missed one payment of £25, so by their account I was behind with my payments as per my "payment plan"? Confusing as I have never had any such payment plan in place previously, as they have sent me the bill, and I have always set up a standing order to pay them over the year, monthly, no payment plan or agreement/contract has ever been signed by me or them? So the latest letter is now another brightly coloured "Notification before default" informing me that if I do not pay or set up a payment plan by next month then they will mark my credit file with a default which will stay on for blah blah blah, and make obtaining credit yadda yadda yadda, yawn yawn! They are demanding the full years bill, which is never going to happen, if they're lucky £15 a month at most, but my question is how can they mark a credit file without any such agreement contract being in place? I'm not in the slightest bit bothered by this credit file lark, so they're threatening the wrong person, I'm just spoiling for a fight.
  3. I am currently renting a four bedroom property from Melin homes. The property is just over three and a half years old, I have been living at the property for around two and a half years. The house was built directly in front of a rugby field, all that separates my garden from the rugby field is a fence and a huge bank full of overgrown ferns and nettles which apparently is owned by the rugby club. The back garden gets flooded frequently and despite my numerous complaints, Melin homes has done nothing to rectify the problem. Melin has told me that " we've had a word with our legal team, and its not our responsibility to maintain a water logged garden" I've attached some photos, the last photo is from next doors garden on the same day and as you can see, there is no flooding in their property despite their garden being behind the rugby clubs bank. Can anyone point me in the right direction as to what my rights are regarding this situation, or am I just stuck with a swamp for a back garden? Thanks for you help.
  4. Hello friends, First post so please excuse my very minor knowledge in the matter I need help/advice with. Lat week a bailiff from Crewe county court knocked on my door stating he had a warrant from the court regarding a ccj issued on behalf of United utilities water plc, I said I had no knowledge of the issue and he left, he left a mesage on my answer machine the following day asking me to call him. After reading information from various sites I decided not to call (unsure how I should have proceeded or what I would say) I came home last night and a letter had been hand posted through my door that is essentially a photocopied template with details filled in by hand. It contains yesterdays date (hand written) a claim number (hand written) a warrant number (hand written) the claimant (hand written) the amount of £1,192.08 (hand written) and a stamp that says the bailiffs name, bailiff, Crewe county court and below that a telephone number and a second stamp saying 'URGENT' The writing states that the warrant has been issued for the payment...... ....or removal of your goods to the saleroom unless within 24 hours the above amount is paid into the court office, you will leave me no alternative but to carry out the warrant by re-attending your premises with the auctioneers van and porters to remove your goods to the saleroom to satisy the warrant. You will have to pay additional removal fees and auctioneers costs. The bailiff has never been into the property to levy goods, can he simply turn up to collect goods, especially if I am not there? I feel i must say that this situation is not come about because I simply refuse to pay, it is the net effect of family seperation, and 2 redundancies within the same year that have compounded financial issues. I am a single father of two kids that live with me, I work full time but earnings only cover basic living costs....there is certainaly no lifestyle to talk of. I have a number of other debt issues but this is an immediate problem I am worried about. My car is an old banger and probably has a value of £200 tops but it is essential that i keep it for work commuting and hospital appointments (my youngest has a heart condition and requires regular visits to liverpool chest and heart hospital and alder hey) Could someone please tell me how to proceed, I have almost no assets, live in rented accomadation, and wages dont cover the cost of living ...i have nothing left to pay off debts and they are compounding badly. Last year I let a bailiff in and he levied goods against a council tax bill which I am paying £112.50 a month for to stop him taking items away which means I cannot afford to pay the current tax.. ...as an example of the situation getting worse. I hope this makes sense. Thank you for reading. Mark
  5. Today I called Cymru Water because we have a £300 credit on our bill (we pay £50 a month direct debit) and wanted to adjust our direct debit since we had such a large credit. The rep immediately said our meter must be slowing down since we have 7 people in our house and were apparently using too little water for that many people. (possibly correct) So they are going to replace the water meter. Oops, darn, but oh well. Our problem is this: They say that once the new meter is installed, they will check the readings every few weeks and then use these numbers to 'correct' our past bill (up to 7 years). We are arguing over this because we do not feel they should be able to guess what our usage was for the past year or two and make us pay for their meter possibly slowing down. They have no way of going back in time and knowing exactly how much water was used. It was their mistake and while we have no problem ensuring that we pay what we use from now on, we are angry that the company can just say 'we think you used this much water while your meter was slowing down so give us the money.' And since we have a £300 credit, they will take it from that. The rep said they would generally not make a customer go negative on their bill. I asked for a refund of our credit then and they do not appear to plan on giving it to us. Can Cymru Water back bill us on guesstimate of water usage and not an accurate reading of the meter?
  6. Hi, I'd like to introduce myself im a new member to the forum but I have been reading for ages as I have a few credit file issues that I would like to get some advice on and I will post them in the relevant sections. My 1st problem on my credit file that I have checked about a month ago relates to an Essex and Suffolk Water Bill dating back to 2003. I moved in with my mother sometime in 2004 when I was 20 years old, and these were the times when you still needed a utility bill to open any kind of account so my mother said as I was living there and of the correct age I could put the water bill in my name. This was sometime in 2004. I then moved out of the house into another place with some friends and set up my own new accounts, including council tax which I still have bills for, and for the last 11 years I have been living at various different rented accommodations. My mother recently moved out of the address and informed me she couldnt remember ever paying a water bill there even though it had been over 10 years since. The last time Essex Water had been contacted by anyone at that address was the name change I done in 2004. And now in 2014 I have a default registered for this address for £3500 with a default date of late 2014. So they have defaulted the account after 10 years. Could someone give me some advice: 1) I have not lived there or had any contact with them in over 10 years is this default fair and correct? 2) Essex Waters own website says if you dont pay a bill after 90 days they will issue a default, this is some 10 years. 3) Should Essex Water have closed this account ages ago after no contact? 4) How do I go about sorting this out? I am willing to do all it takes to remove this from my file as it is a joke. I am quite competent when it comes to writing letters or filling in court forms so if I have to take this further legally I am quite willing to do so. Could anyone tell me where I should start, should I start by writing to them directly and asking that they remove the default on various grounds, and re-issue the bill in the correct name which would be my mother. She has health issues but would be willing to pay as it was her house. I think it could be sorted out with a bit of common sense but I know that these companies can be unwilling to even discuss common sense. I also have access to tenancy agreements for myself on other properties at the time I was allegedly liable, the landlords of the said address would be willing to testify that I was not living there, as they were regularly in the house, council tax bills for the address with me not on there as I wasnt living there etc etc. Any advice or info is greatly appreciated...and I look forward to talking to all members who are interested in this.... Thanks
  7. My Mom seems to be in the early stages of dementia or has had mini stroke. She is 72 and has always been active until late 2013 when she became ill with a rushed diagnosis of a urine infection. She hasn't been the same since, not cooking, forgetting things, frequently repeating things and not eating much. My Dad has his own health issues and has tried to get her to see a Dr. I've also tried, several times, but she gets angry and doesn't want either of us to say anything or go in with her when she does see a Dr. She says she won't go if we do and thinks everything is ok and that her memory is good for her age. I have power of attorney over finances but not health, and she is still not at that stage if I had. As a family we are concerned but the Dr. will do nothing without her consent and Mom agreeing to let us in on it. I've been as gentle as I can and told her that it's nothing and it's pretty routine to get tested, plus the GP gets a bonus, (she likes them). Has anyone else been through this? My sister in Canada is coming over to try to help but I think she will be disappointed with how stubborn Mom is. I'm cooking meals for them and just trying to look after them. I'm not claiming anything for their care, ( just in case you wonder!). I give them meals but worry they aren't reheating them properly or storing them in the right way. They are always ready to eat when I take them but Mom doesn't want to eat anything other than crisps and bananas most days. I know I have to be patient. My Dad is not, and gets frustrated at having to repeat things. As an example Mom was insisting that the bills had to be paid at the Post Office. Great stuff but on New Years Day? Any suggestions are very welcome.
  8. My daughter has received Court papers from Anglian Water for her water usage. I looked at the Particulars of Claim and submitted a Defence. The claim is for £2050. I found that they were claiming charges from 2011 to 2015 even though she moved into the property in 2013. There is no account number on the POC. To me this seems a very amateurish attempt to get payment. After AW received her defence she received a letter from their legal department explaining in more detail their claim. (I do not think this was sent to the Court) The letter explained that the debt referred to her previous address from 2011 and her current address even though her previous house was not detailed on the POC. She has a letter from AW dated April 2014 stating that she was £20 in arrears. This letter was submitted as part of her defence I cannot see how they can claim money through the Court for services up to March 2015. Any advice would be appreciated.
  9. Hi I'm new to the forum and hope someone can help. I discovered today - following a leak through my ceiling - that my water tank has been illegally installed - the engineer isolated it immediately and told me what would need to be done to make it safe again ( in summary a pipe that should have been fed to outside wall was just cut and left in cupboard to drip - hence the leak) we have been in the house since it was built - a few years ago now - and so I called Cala (the builders) who advised they would send someone out to write a report on it and then they would advise if they would fix it. I don't think they are going to deny that it's their responsibility but they just don't seem to be in any hurry they won't get someone out until next week and then who know how long it will take to process report etc. in the meantime I am left without any hot water and 2 small children. What kind of pressure can I out on them to hurry up and would paying for the work to be done myself and then pursuing them for compensation be an option or more hassle than being without hot water for a while Many thanks
  10. In the course of examining our church accounts I noticed that there was a huge difference in water charges for the 2 Anglican churches in our Parish. The lower charge is for the church without mains drainage. The other church has meters water and used only 9 cubic metres last year. As a domestic consumer I use about 110 cubic metres. Because it is classed as non-domestic the church pays a standing charge of £144 pa compared with £87 for me. This seems grossly unfair. Can we challenge this charge?
  11. Marstons, acting with a High Court writ, have amassed over £500 of additional costs on top of the bill for £1,300 (water I never used, faulty meter no doubt but I can't prove it). I have simply been unable to pay - about 8 eviction attempts over the last few years from hideous rip off mortgage lenders and since all my money went to clear those arrears, now an Attachment of Earnings for Council Tax as they want their money now. I have absolutely nothing of any value and I have emailed Marstons to tell them that. No car, 14" TV that I bought secondhand for £25, no iphone, no sound system, no jewellery. Nothing. They have been once (neighbour says a guy knocked on the door) and that cost me £295 more. Should I just let them in to see that I have nothing? Otherwise every time they come back it will presumably be another £300. I am happy to pay a little, but simply cannot afford more. AW refuse to take the debt back. So they are giving money to Marstons which they could have had. Makes absolutely no sense whatsoever to me. And as a woman alone the whole process is terrifying.
  12. I wonder if someone could kindly advise what to do regarding and outstanding debt my brother has with Thames Water. The gist of it is that he has fallen behind on his payments with Thames Water and now owes about £500. He advised me that he keeps getting letters from Robinson Way threatening legal action / doorstep collection if amount is not paid. Well he got home from work this morning and there was a card left for him to call someone at power2contact within 24 hours to avoid any further action. He is worried sick on what to do next and does not want the debt to increase and to be cut-off. He was also considering getting a high interest loan to pay it but I managed to talk him out of it on the understanding that I would seek some advice first what to do. Any urgent comments would be very much appreciated.

  14. Lowells must be short of money with all these Court Cases they are losing thanks to Andyorch & CAG:lol:
  15. I hope this is the right place to ask this question because it is quite complicated. Last year I received a water bill from anglian water for a buy to let property I use to own, the bill was actually dated 2013 but the property was apparently sold by the mortgage company in 2010, I say apparently because their was no formal repossession and i was never signed anything they just gave control to an lpa receiver who managed it badly and it was then sold. I would like to know if anyone knows how anglian water go about getting information on properties and why they haven't got the new owners information. I have emailed anglian water but they take 10 working days to get back to you.
  16. I received a letter from the county court in Northampton that Welsh Water had decided to take a CCJ against me for over £2000 without warning. I have been away and I only have until Saturday 7th to respond to the CCJ. I lost my job a while back and trying to get another was hard to do and I ended up further in debt and my bank cancelled all my DD to stop me getting more bank charges. I do have just started a new job but it's poorly paid and long hours. With other debts I can't afford this. I hope to defend it. Any advice would be helpful
  17. Water and sewerage bills will fall after April 2015 and even more help will be available for customers struggling with cost of living pressures. The average water and sewerage bill in England and Wales for 2015-16 will fall by £9 (2%). In this period, companies will provide a package of measures worth more than £40 million to support customers struggling to pay or in debt, for example through trust funds, debt matching and write-off schemes, debt advice and water efficiency measures to help customers on meters reduce their bills. http://www.water.org.uk/news-water-uk/latest-news/water-and-sewerage-bills-falling-201516 Most companies are cutting prices, but a few are increasing them. See here: Forecast average household bills 2015-16
  18. Hullo, I have just received a letter from a DCA (EOS Solutions) and needless to say, I'm a little irritated... When I moved in this flat, I was paying for an unmetered supply. However, a few months later, it emerged that the flat was actually on a water meter, & all my payments subsequently transferred. No problems there. However, a few weeks back, I received a tetchy letter from Southern to "The Occupier", asking for details regarding the current occupants in relation to an unmetered account. Rang them, and they said "Oh, just an automated mail run. Please disregard". Today, I received a letter from EOS Solutions enquiring as to the occupancy at my current address. Obviously I have no intention of getting in touch with them (I have no relationship with them - as far as I see it, this is an issue for Southern Water to resolve). Also, they don't have my name or any other details. But I thought it best to be safe rather than sorry and check with the experts on here... Would I be right in thinking my best way forward is to ignore the DCA letter entirely, and speak to Southern Water and point out they need to get their bloody affairs in order. Is there any chances of this being linked to my credit rating or anything like that? Any other advice? Thanks in advance all! EDIT: Just saw the DCA link. Letter seems mostly in order as they identify their customer as Southern Water. But they did address the letter to "The Occupier"...
  19. Hi each and all, I have just checked my Credit File on Experian, it is squeeky clean APART FROM a default from Northumbrian Water, now granted I have never paid water, nor have I ever communicated with them regarding my bill(s) they even started sending letters addressed to the present occupier, I have signed nothing, agreed to nothing, never spoke with them, nothing, yet they have placed monthly defaults dating from the 8th month 2014, i have cicles with "8" inside which states: " The account is in 'default'. You failed to keep to your credit agreement and have not responded satisfactorily to requests to bring your payments up to date, so the credit agreement has ended." How the hell can a company I have never had any dealings with, and not signed any credit agreement forms do this? is there any way round this as it has completely obliterated my Credit File, they claim I owe them £1709, this is like not paying your garage bill or paper bill and them placing a default on your credit file? is there any way round this joke or am I done for? Kind regards, Darren...
  20. I received a letter from Anglian water threatening recovery action as I 'haven't paid my bill' even though I requested a payment card so I can pay what I can afford and am currently making payments to them. I sent a email of complaint to them (their offices are closed and I'm currently working shifts during their opening hours which is convenient) along with a copy of a letter from my gp stating that I suffer with anxiety and depression. Any extra help/advice would be good as this is causing me a lot of stress which is a shame as I was starting to get back on my feet and start getting more work.
  21. Had a quick forum search and found only 9 posts regarding Wessex Water been served Court papers so need to sort this out. Firstly the debt is for £1752 built up from them not billing us for 3 years due to an error in their system we have called these people only to be told pay more to clear the debt. We have made regular monthly payments since receiving the bill 15 months ago now they have issued court proceedings. when I say regular payments I mean it started at £50 per month then we had to up it to £75 a month but they are not happy with this. Do I send them a CPR 31 request or do I deal with these people in a different way, thanks
  22. Hi all I owe £167.08 to Southern Water Services. This is for the full year. It has been passed on to DCA and I am not sure what to do. Option: ring southern Water pay off the ammount and not even bother contacting the DCA and leave them hanging for their so called 'admin' fee of 45£. Not had this situation before and any help appreciated Attached is the letter received today 25th dated 22nd thanks BB
  23. so i have had the gas disconnected permanently because the standing charge has got too expensive, i still have a water supply and electricity, how can i make 100 litres of 40 degree hot water in 20 minutes? i cant change the instant gas water heater thats screwed on the wall to an electric one bcause i dont own the property
  24. Hello just hoping someone might be able to help me out here anyway Been living in a property for around 6 yrs always paid sewerage and water bill sewerage charge was roughly £260 per yr on talking to a neighbour who has lived here in excess of 15 yrs and we have only just found out, that we should not be paying the sewerage charge or surface water charge as apparently in the village it all goes out to a drain or somewhere after asking anglian water they have agreed to drop the surface water charge (they must have looked at sewerage maps ) and have come back and said yes they will not charge us for the surface water or sewerage But will only backdate to 2013 ??? As per Thank you for your recent email. The backdating policy as per Anglian Water to apply the reduction on your account is as follows: If the property is built after 2000 the customer is entitled to the SWD reduction from their occupation date or 6 years (whichever is later). If the property built before 2000 the SWD reduction should be applied from 01 April 2013 or the start of occupation date whichever is later. As your property is built in 1978, which is before 2000, we can apply the reduction only from 1 April 2013 as per policy. If there’s anything else, please have a look at our website. You might be able to find what you’re looking for with the help of our virtual assistant Amanda. You can also call on 08457 919155 or email us at Regards Customer Services Now how can this be correct they obviously know when the property was built and have obviously looked or know about the incorrect charges that were applied and my neighbour has also got loads of old bills showing that they knew about this but still charged me ??? Can anyone suggest what i can do ?? please
  25. Hi, I'd be grateful for your advice regarding an issue I am having with my downstairs's neighbours. A leak from my bathroom has caused damp/mould on my neighbours bathroom ceiling. The plumber found that there was a gap in the sealant by my shower which he resealed. The damaged area is approx 3 x 2cm & 8 x 3cm. Last week I emailed my neighbours and offered to do the repairs myself however, they have refused my offer and want to get a professional decorator to do the work to a "high standard" and obviously for me to pay for this work. Do I have to pick up this cost?
