  1. Hi all, Just received a Notice to Keeper from Gemini stating that the vehicle broke the following condition, parking in a disabled bay. The registered keeper is disabled and was receiving treatment as the time within the hospital, to the best of knowledge the blue badge was displayed. is it worth appealing given these circumstances? The notice also says that they contacted the keeper recently, they didn't this is the first we have heard of this. Any advice would be appreciated. Date of infringement 18th October 2018 Date of the NTK 21st November 2018 Date Received 23rd November 2018 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? Hi All, I hope I can get some help on a situation, unfortunately I was caught speeding on the motorway the letter I received from Essex police is to identify the driver "application for the identity of the driver" i was clocked at 108mph on a 70mph - no previous, no points clean drivers license - what should i do?, fill the document in and sent over? i mean it was me driving, also it was at 5.14 am in the morning. what could i be looking at as its the first time/offence? cheers Red11

  4. Hi all, my garden has been flooded for two whole days with raw sewage, I called Essex and Suffolk water, who directed me to Thames water to report the issue. Thames water visited my house to look at the problem, they explained that they had a sewer collapse, which they were repairing, they have said that when they have done the repair, they will be back to do a clean up. I have had to leave my house for the last two days because the smell is unbearable, especially in the recent warm weather,my lawn and path are ruined. Is there grounds here for a claim against them for what I have had to endure these last two days? Many thank for all and any answers or help Moonlandings

Hi, I'd like to introduce myself im a new member to the forum but I have been reading for ages as I have a few credit file issues that I would like to get some advice on and I will post them in the relevant sections. My 1st problem on my credit file that I have checked about a month ago relates to an Essex and Suffolk Water Bill dating back to 2003. I moved in with my mother sometime in 2004 when I was 20 years old, and these were the times when you still needed a utility bill to open any kind of account so my mother said as I was living there and of the correct age I could put the water bill in my name. This was sometime in 2004. I then moved out of the house into another place with some friends and set up my own new accounts, including council tax which I still have bills for, and for the last 11 years I have been living at various different rented accommodations. My mother recently moved out of the address and informed me she couldnt remember ever paying a water bill there even though it had been over 10 years since. The last time Essex Water had been contacted by anyone at that address was the name change I done in 2004. And now in 2014 I have a default registered for this address for £3500 with a default date of late 2014. So they have defaulted the account after 10 years. Could someone give me some advice: 1) I have not lived there or had any contact with them in over 10 years is this default fair and correct? 2) Essex Waters own website says if you dont pay a bill after 90 days they will issue a default, this is some 10 years. 3) Should Essex Water have closed this account ages ago after no contact? 4) How do I go about sorting this out? I am willing to do all it takes to remove this from my file as it is a joke. I am quite competent when it comes to writing letters or filling in court forms so if I have to take this further legally I am quite willing to do so. Could anyone tell me where I should start, should I start by writing to them directly and asking that they remove the default on various grounds, and re-issue the bill in the correct name which would be my mother. She has health issues but would be willing to pay as it was her house. I think it could be sorted out with a bit of common sense but I know that these companies can be unwilling to even discuss common sense. I also have access to tenancy agreements for myself on other properties at the time I was allegedly liable, the landlords of the said address would be willing to testify that I was not living there, as they were regularly in the house, council tax bills for the address with me not on there as I wasnt living there etc etc. Any advice or info is greatly appreciated...and I look forward to talking to all members who are interested in this....   6. The Able Group - Unable to fix anything & unable to refund... I need to vent a bit about this emergency call out plumbing service. I booked them to investigate hot water flushing back into a cold water storage tank. They sent an obviously unexperienced plumber, who ignored the requested job, & fitted a ball cock instead. The tank flooded again. They sent another plumber who turned down a thermostat, & ignored the original job. The tank flooded again. They billed more than was agreed to my credit card. They refused to refund & I'm having to request money back via chargeback & go through small claims / trading standards. Terrible customer service, terrible quality tradesmen, terrible experience.
  7. Greetings... I'm new to these parts having just come over from Austin, Texas to live and work in UK for the foreseeable future. I seem to be making poor decisions regarding these silly parking tickets so I thought I'd stop the bleeding and consult y'all. I've waded through the stickys and quite a few of the posts and still a bit unsure of my status/next steps, so I thought I'd engage you good folks for some friendly advice. Basically, on 19.05, I was heading into London for work and staying over night. I parked and paid/displayed in a NCP parking lot (Mark's Tey Station) for 2 days, only to find the trains to London were shut down indefinitely. I decided to drive past the problem (engineering works in Colchester) and catch the train. Shenfield Station was the first point trains were working so I drove to Shenfield. Upon arriving in Shenfield Station park, which is run by NCP as well, I noticed much open parking along the fencing. However, there were signs on the chain link fencing posted that said "reserved parking". I avoided that area, and found parking in the middle portion thinking all was good. I paid and displayed for 2 days of tickets and caught my train. When I got back on the 20th, I was stunned (and SUPER angry) to find 2 stickers on my car (see attached). £75 / day for each day for a total of 2 days offering a reduction to £50 if paid within 14 days. Turns out, the middle sections were "reserved" parking as well. I looked around for signs... and saw none. I looked down, and sure enough, I saw painted on the pavement "reserved parking". As soon as I got home, I went to the NCP site to look up my fines. There were pictures showing 1) my NCP Shenfield 2 day parking payment properly displayed on my dash 2) a pic of my car showing the "reserved parking" on the pavement. I immediately chose to appeal both tickets separately and pled ignorance. In the appeal, I explained my situation, that I had paid properly in Shenfield AND in Marks Tey. Basically I played the dumb yank card but did point out, that the "reserved parking" signage was NOT obvious on the ground (when you are heads up driving/looking in a parking lot (car park) and begged lenience/forgiveness. Within a couple minutes, in my infinite intelligence, I decided to do what I should have done first, and google/research it. I found this site claiming if it's NOT from the council, you aren't legally bound to pay it. It's now been over 14 days and I haven't heard a peep. My guess is to ignore it as many other claim. However, I don't need any legal problems as I am over on a work visa and trying to establish good credit. I should have come here first! Any thoughts?   8. Hi Today my partner had a visit from Marston to collect on a warrant for a water bill. The bailiff has hand written the attendance letter listing fees but was not able to access the house nor did he speak to my partner. judgement debt £710.68 judgement cost £0.00 Execution costs £111.75 interest to £0.00 officers fees £351.10 TOTAL LEVY £1173.53 I have had a look but cannot find out if the fees are correct or if the officers fees are too high. My partner doesn't know if this is a county court warrant. no other paperwork was left Can the officers fees be almost half the judgement debt?
  9. I have a bit of a conundrum with regards to a missing PCN and NTO, plus their website showing the wrong car. I will give you the run down, please be patient I have a motability car and I have a designated driver to ferry me about when Im not well enough to drive it myself, They take the car home which they are allowed to do with in a few certain radius which is ok. This particular driver lives in a permit zone, so he calls up Parking Partners and lets them know, they tell him that its fine to use his own permit and that they will inform the local Traffic enforcement team that this is permitted. No problems, I am now able to drive myself so the car is back with me. I get an NTO yesterday basically telling me that I now owe £50. Im a little confused at this as I wasnt aware and neither was the driver aware that a PCN was placed on the car, this was in the road where the driver lives and was issued at the time the driver had the car. I can make representation with regards to this NTO on line via their website, so I did. It shows photo of the car and where the contravention happened. When I looked at the photos, it wasnt my car, the reg was no where near what mine is and the car, although the same colour as mine is a totally different make, plus the car is parked in a different road, two roads down to where my car was parked. It showed the tax disc of this car, plus a CD on the dash and a photo showing that a PCN had been placed on the car. There are about 7 photos and one is of the sign stating it is a permit area, but this was also in a different road to where my car is parked. However the last photo is my car but taken at a distance where a permit can barely been seen in the front screen on the drivers side where it is meant to be. No PCN on the car showing at all. The car was not parked there unlawfully. I have made the representation, but Im not quite sure if they can make me pay the PCN at the £50 or if at all based on them showing the wrong photos. Can anyone throw any light on this please. This parking company is council run and not a private firm, however they have been making many mistakes lately.
