  1. I was recently shopping for sofas with my family and went to a number of sofa shops all closely located along one street. I didn't realise at the time but the car park for the first shop was exclusively theirs and enforced by ANPR parking restrictions. The limit was 1h 30 and we stayed 2h, leaving 15mins before they closed. The car park was almost empty. We did end up buying a sofa but not from the shop we parked outside. a week or two later and I've received a PCN from ParkingEye wanting £70, £40 if paid within 2 weeks. I'm going to complain to the shop and inform them that if I have to pay this I will never buy anything from them again, is there anything else I can do about this? For the sake of £40 it's not really worth the hassle of going to court, my time is worth a lot more than that. Thanks!
  2. Evening, What a quality football! Got a PCN from Newham council / Temple Mill Lane for 'disobeying no entry restriction' (no entry sign). Never happened to me before! Here is the situation: 1) It's a regular two way street with sudden 'no entry' signs for BUSSES AND CYCLES ONLY (pls see attachment from google maps) 2) The driver driven past the sign for about 7-8 meters BUT then put on reverse gear when it was safe to do so and driven back 3) Upon driving backwards the driver noticed an unmarked vehicle parked on double yellow lines with a camera and a grumpy person inside; obviously filming. 4) Got a PCN. Put together a long appeal and got REJECTION as follows: 1) DRIVER: As can be seen on the video, the driver pulled back when it was safe to do so and to prevent any potential accidents. COUNCIL: We sent you a PCN because our camera evidence shows your vehicle disobeying a 'no entry' restriction. The relevant sign is round, red, and has a horizontal white line across it. 2) DRIVER: There is no prior warning and thus a very strange layout when suddenly the street terminates with 'no entry' signs. COUNCIL: Whilst it is appreciated that sometimes coming up to a no entry restriction can seem sudden to a motorist especially if unfamiliar with the road, it is very clean in this instance that you had lots of time and space to turn around with no other vehicles in site at the time. 3) DRIVER: No safe way to reverse: two way street, cycle lane, busses, and traffic emerging from a car park. Hazardous traffic. COUNCIL: I note you stated there was hazardous traffic, but it should be stated that this does not mean that a motorist can drive through a no entry restriction 4) DRIVER: As per freedom of information act, requested a brakedown on much money they make on that spot, arguing that they prefer to keep it that way to make money rather than put a proper layout in place. COUNCIL: Please direct such requests to the information governance team using the details xxx.... 5) DRIVER: Enforcement officer has been parked on a double yellow line in an unmarked vehicle: does this mean any motorist can park on double yellow lines in the borough? COUNCIL: I note you have stated that the enforcement officers car was parked inappropriately. Please not that whilst our enforcement officers do their best to make sure that there are not causing any inconvenience to others, it can be difficult at times to achieve this to the maximum. However please be assured that our enforcement officers always do their best to avoid any inconvenience whilst enforcing. I disagree with these answers: clearly council is making money here and is not interested in putting things right. And clearly they do this by compromising safety of drivers/pedestrians/cyclists and ignoring the normal rules (unmarked camera vans parked on double yellow lines). Do you think I have good chances of appealing to Parking Adjudicator? How do you suggest to do this? Many thanks PS. On the google screenshot attached another driver is caught with the same 'offence', they are making millions there!!!
  3. I have today received a code 27 PCN for parking adjacent next to a dropped footway This does not appear to be a valid code. I was parked next to a chained/locked walled entrance to a small parking area (2 cars ) of private business. This area is never used and is seperate from the main car entrance. The entrance exits directly onto the road/carriageway. There is no footway, pavement or similar at all. Do I have a valid appeal? I have also read that the CEO can only issue the PCN if an official complaint/request has been made by the owner of said property and that complete records must be made of the request? Thanks in advance.
  4. Need a help. The bailiff visit is for unpaid PCN. The last letter from Magistrate's court is for Remainder of unpaid fine dated 25th feb 2016. Other letter was Notice of fine. This morning a lady came by door from Marston and handed over the letter. She left and we tried to work out the reason for visit. We went to online and paid the original fine of £150. The lady returned back after an hour and we told about the payment. But she said it's too late as we still have to pay the fine which totals to £460. We've no problem of paying £75 for compliance stage. But the agent said it's been to enforcement stage and the letter that was handed in morning was handed on 18th April. The letter was dated 18th. We tried to dispute this and even the lady who came in the morning was different person to who turned up. Called police and after explaining everything, we let the agent into property. I enquired about warranty with officer and he confirmed it's a valid warrant. As the lady didn't have any details of previous correspondence, I called Marston customer service. We were told that the 3 letters were sent before today by royal mail which obviously failed to get delivered. Issues I've is: The letter dated 18th was handed to us today morning. But the agent kept on insisting it was handed on 18th. The previous correspondence from Marston group were never received and we were unware of their involvement until this morning. I've no problem with first stage ie compliance fee of £75 or even the later stages fee but the thing is we never recevied any of those warning letters. Things the agent took x bike key. Bike is parked somewhere god knows where but I'm had enough of the boy. So, to summerise, where do we stand? Should we pay the bailiff's fee and done it or there are procedures we could follow. ATM my temperature is at high hearing too many lies from these so called bailiffs. Thanks in advance.
  5. Can anyone offer advice please on my receiving a Court Claim for a parking charge notice from an alleged parking infringement in October 2011? Briefly the details are: In Oct 2011 I loaned my car to my brother to shift furniture for his friend. Over the years since I have received threatening letters from Excel Parking services which I have ignored as I was not the driver. I shouldn't have ignored them but I saw no reason to respond. My brother was a disabled badge holder but I am unable to determine if he used it at the time as he died in 2014. A company 'bwlegal' started chasing me for various sums of money late 2016. Their last letter stated Excel were going to issue court proceedings for a sum of £258 made up of various items. This raised concern with me and I wrote to them a few days before their deadline to advise them I was not the driver. I did not mention who was the driver as there was little point in doing so. I have never been taken to court before and appreciate any advice on how to proceed. This has been going on and on and I wish to see the end of it. I intend to defend their claim in court and have until 28 March to respond. It looks like I have to return a 'Acknowledgement of service' to gain 28 days grace to prepare my defence. My questions are: As the alleged contravention took place before 2012 am I correct in ascertaining that the Protection of Freedoms act, specifically 'clause 4' which holds the registered keeper liable, is not valid in this case? The response from bwlegal to my letter states that I have been given opportunity to disclose who the driver was and quotes 2 further legal cases which I will have to argue against. Elliot V Loake 1983 and Combined Parking Services V AJH films 2015. I believe I can argue against these points with some more research. Advice please on how to proceed. Thanks in anticipation.
  6. I have received a 'Parking charge notice' from Britannia for staying over the 1 hour time. This is the first time I have ever been charged in 3 YEARS as Costa themselves said before that the parking restrictions were not acted on. The car park is based at J16 of the M4 and is shared with Subway, Greggs, Londis and Costa (+drive through). There is no option to pay for extra time or at all.
  7. a description of the issue: Blossom St, York, Car Park, the amount of money involved £160.00 any relevant dates: 27th July. I parked behind the old cinema on Blossom St York, bought a parking ticket for £1.50, which I though was for 2hours, didn't check the time on the ticket, as I was in a rush. However I was 10 minutes late, the expiry time on the ticket was 11.51 and I got to the car around 12pm, I was therefore late. I was there due to work commitment, an exam at a local dental practise which over ran, I was under the assumption that I had parking until after 12pm. then 2 weeks later I received a PCN from Minster Baywatch LTD, which under some advise I ignored, however those letters have now accumulated and I received a letter from Gladstone Solicitors, I have received a letter before claim- demanding £160. 00. Has anyone else received anything of this nature, and will I be taken to court, it seems really unfair, considering I was only 10 minutes late. Please advise? SR
  8. My son got a pcn (ANPR) in a supermarket car park . He was there for 10mins and never got out of the car , he didn't think he even needed a ticket (wrongly) He never acknowledged it and has since moved out and is at university . We have received a letter before action , saying he must reply within 14days or the matter will be taken further. Apparently there is an appeal process , but it looks like that's to late . They are now asking for £140 .... what is the best course to take at this late date......... Thanks for any help
  9. Hi all, First time here so please let me know if anything in this post should be changed. Backstory: I was in Bulgaria on business in June/July and had no knowledge of my PCN before leaving (turns out my mate moved my car out of his drive into the parking area for a couple hours where I received this PCN). Upon arriving home I find two letters, one being a final reminder sent mid June by VCS and then a debt collection notice sent by ZZPS in mid July. As I was out of the country and couldn't access my mail, I had no idea any of this was happening in my absence and had no chance to appeal the ticket in the allotted 28 days. The ticket was for £100, to be reduced to £60 if paid within two weeks and is now at £160 due to the debt collection agency add on. I haven't received any other letters regarding this claim. What I've tried: I have tried to go through the various appeals process, but when searching my ticket ref on the provided websites (namely myparkingcharge.co.uk as noted at the bottom of the VCS letter and the IPC website itself) it comes back with nothing, meaning that I couldn't have appealed it regardless. I even tried POPLA, and they can't find the ticket either. After contacting an ombudsman, they suggested to complain through the companies. VCS said that it was to go through ZZPS as they now were in charge of the debt , ZZPS replied as follows: "We must inform you that you have now passed the time frame in which an appeal can be made as appeals can only be made within 28 days of the Parking Charge Notice being issued, our client maintains that all correspondence received has been actioned accordingly and that the correct procedure has been followed. The balance of £160.00 remains payable on our systems, please refer to the back of our letter for the payment options available to you. In the absence of payment this matter will be referred to solicitors to resolve and further fees may be incurred." What do I do? If none of the appeals agencies even agree that the reference number matches any ticket, has a ticket even been issued against me? The collectors are refusing to provide evidence. I am not exactly inclined to pay this "debt" until the relevant parties prove their claim. Any advice would be appreciated as I feel like I'm about to get strong armed out of £160 Attached are the letters received, along with the website response when I search the reference. Personal info along with refs blacked out for obvious reasons.

Hi I got a PCN code 40 for parking in a disabled persons bay which i did not know was there as you will see from uploaded pictures the bay was not clearly marked, i challenged the ticket and lancashire county council disagreed and have refused the request to cancel the ticket, i explained that i would never knowingly park in a disabled bay and that the road marking are barely visible, it as fell on deaf ears and a notice to owner is to be sent. the council said that the road markings dont need to be there as a post sign was there this was 2 spaces down i did not see this sign at the time or even notice the markings, any help. As per the msgs before, ive acknowledged the MCOL and sent the CPR 31.14 Request to the solicitors today. When would i need to send the defence to the court?? straight away or wait?, and what to do i need state on it? Any help would be greatly appreciated Thanks

Hi, firstly thanks for reading this post!! i'm gonna try and keep this short and simple and skip why its been this late.. the car overstayed in BP petrol station Hatton cross for 11mins from 13:53 to 14:34 on 05/03/17. I received two PCNs from ECP (double dipping?), both identical but with different PCN numbers (my dad did say he left and came back to buy something else). i've been away (dad has no english to deal with this) came back to find a Notice to Keeper from ECP, and debt recovery letters from two different companies. Again, both compaines have sent two identical letters but with only different reference numbers. I've only included one copy of each as they are identical. Here are the dates (each of these have identical letters with different reference numbers): - 10/03 first PCNs received, "pay £60 within 14 days for reduced amount.. or full within 28days etc.." - 30/03 Notice to keeper, "£100 payment should be made within 28 days of the date of this letter" - 09/06 debt collector letter from DRP, "£160 reduced to £136 if paid by 23/06" - 24/07 debt collector letter from Zenith, "£160 reduced to £99.99 if paid within 14 days" see attahced images for more details. A few points: - The evidence is the number plate which is just a black rectangle with the number plate. Is this sufficient? - DRP in their letter saying, "they're [ECP] willing to accept £136 instead of the full amount of £160", but ECP never stated £160. - Zenith also stating, "able to pay reduced amount £99.99 within 14 days or will revert back to £160". ECP have never stated £160 in their letters. Is this something to argue? I've challenged many PCNs before so i had no intention to ignore.. but its come to this stage and i don't know what to do / where to start.

  14. I received a PCN through the post (arrived today) for an offence committed on 29th July. I lent my car to my Mum for a weekend so she was the driver not me. She insists she paid but as it was a machine that asks for your registration she may well have entered it incorrectly, Im wondering if I can appeal on the grounds that the PCN wasn't issued until 15th August (17 days later) as stated on the letter. Can anyone advise please? Further details below... 1 Date of the infringement 29th July 2 Date on the NTK [this must have been received within 14 days from the 'offence' date] 15th August 3 Date received 17th August 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [y/n?] No 5 Is there any photographic evidence of the event? Yes, of her driving in and out of the car park. Total stay 1hr 2 mins. 6 Have you appealed? {y/n?] post up you appeal] Not yet Have you had a response? [Y/N?] post it up 7 Who is the parking company? Civil Enforcement Ltd 8. Where exactly [carpark name and town] Custom House Quay, Falmouth in a Tesco car park I believe.
  15. Hello I live in a cul-de-sac and my house is the last house on the road and I have my own drive at end. Today, I received a PCN code 62 while parked on my own Drive. It states 'Parked with one or more wheels on or over a footpath or any part of a road other than a carriageway'. My car was parked with the back wheels just on the edge of the footpath, something I have been doing since 1988 but for some reason I have received a parking ticket today. The footpath ends at my house, although a neighbour whose garden backs onto my drive has put a small gate in his fence so he can leave his house from the back. What can I do in this instance as I will have problems parking on my drive in future? With the back wheels close to footpath, the back of the car stands over the footpath by a foot or more depending on the car that is parked. I would appreciate any help or suggestions
  16. Hi, any help appreciated. Just received a PCN , contravention 51J, failing to comply with No Entry Restriction (camera enforcement) in Temple Mill(s) Lane. We travelled to London to pick up a disability buggy for our neighbour. Being unfamiliar with the area we used our sat nav which on the return journey took us down what I now know to be Leyton Road. As we approached the end of that road it told us to 'Turn Left'. Back seat passenger was talking to hubby who was driving and initially he didn't hear sat nav and went to turn right. Sat nav says Turn Left Turn left, turn around when possible so hubby backs up, careful of other road users but bit awkward with trailer and buggy on the back and turns left. None of us in the car noticed the No Entry signs, because they face up the road they are not noticeable when coming down Leyton Road, in fact the one on the left of the road is slightly round the corner and would be well above the level of the car when you reach the end of the junction. As far as I'm aware there wasn't a 'No Left Turn' sign facing Leyton Road, there was nothing written on the road surface saying no entry, buses only, or anything else that may have indicated you can't turn left. However, as we turned into the road we did notice the sign giving priority to traffic travelling in the direction we were and the arrow in the road pointing in the direction of travel. We had no idea until we received the notice that we had entered a No Entry strip of road. As yet I have been unable to find an up to date picture of this road junction, most only show the signs from face on or the road when it was closed off due to roadworks. Having browsed this site it seems that some have had success with appeals in this particular area, also the road name discrepancy being Mills or Mill as on the fine, can this really be a cause to appeal? We wish to appeal this PCN on the grounds of insufficient signage but wonder how we stand
  17. Hi everyone, I'm new to the forums. On Sunday 30th July I attended my baby nephews baptism and celebration, which was in the town centre. There is nowhere for disabled drivers to park near the venue so I parked on a single yellow line, which I believed I was allowed to do for 3 hours. I left the car at 12.56pm by the clock in the car and set the timer for the blue badge at literally just before 1.00pm. One of my family went to move the car for me at 3.45pm and found a PCN stuck on the window screen. The contravention on the ticket says, "Parked or loading/unloading in a restricted street where waiting and loading/unloading restrictions are in force." The thing that annoyed me most is that the Traffic Enforcement Officer must have seen me leave the car as the ticket was issued within seconds - apparently observed between 12.54pm and 12.55pm. I have viewed the images....the blue badge can be clearly seen on the dashboard but looking at the image showing the timer it is difficult to see that the arrow is set to just before 1.00 because of the angle it has been taken from. What annoys me is that the TEO has taken a close-up of the badge but not the timer....that has been left out of the picture. I had three other people in the car with me who can all verify the time we left the car. Any advice on how to deal with this would be much appreciated. Thank you
  18. dear all I have read this thread http://www.consumeractiongroup.co.uk/forum/showthread.php?440374-Capital2coast-PCN-Lewes-Clamform-received&p=5045522#post5045522 with interest as I am still lumbering on with so called debts from Sussex Security Solutions Ltd who issued PCN at Eastgate Wharf, Lewes in August 2016. Sussex Security Solutions Ltd being owned by the same dodgy dealer as One Parking Ltd (trading as Capital 2 Coast). Having appealed as standard to SSS I heard absolutely nothing, not even a letter to confirm my appeal had not been agreed. Then followed debt recovery letter from DRP in November 2016. Silence until June 2017 when I received a letter from the notorious ZZPS LTD and finally in July a letter from Wright Hassall solicitors acting on behalf of ZZPS acting on behalf of SSS!! I am just penning a letter to Wright Hassall as I am getting to the point of being tired and angry that I keep getting harassed by every parking conman/woman in the land. I didn't even park (as such) on the so called private land I wasn't trying to get away with free parking whilst I shopped. Merely picked up my daughter who was waiting on the pavement at that spot (it looked a safe place to collect stop and let her in the car rather than on the high street!!) I guess the reason for my rant/post is just to check there is someone out there who is still holding up the flag by not paying up. ..It feels a lonely battle and quite intimidating at times.

Our client confirms that this Parking Charge Notice has been issued correctly, all previous correspondence has been sent out and the correct procedure has been followed. Upon reviewing our client's system, I can confirm that a Parking Charge Notice was sent, via post, on 22 May 2017, to the details provided to them by the DVLA. These are the same details we hold on our system. This site is private land. The landowner has employed our client to issue these Parking Charge Notices on their land. A motorist will be made aware of the terms and conditions of parking at the location by way of the signage located at the site. All of your client's signage is approved by the British Parking Association (BPA) and this site is audited regularly to ensure it complies with the BPA's Code of Practice. As advised above, we have been instructed by our client to pursue payment of the outstanding balance. Please arrange payment of this. One Parking Solution Ltd 8. Where exactly [carpark name and town] This information hasn't been provided although I have requested it. The information on the DCA letter states Plough Lane, London, sw19 8gt. This is a public highway to my knowledge and doesn't have parking spaces as it is a busy main road. The postcode and road name also don't match up when entered into google maps For either option, does it say which appeals body they operate under. No but the BPA logo is present in their letter If you have received any other correspondence, please mention it here Only correspondence received is from ZZPS posted above. I should probably also add that I have no recollection of this event ever happening and the letter from zzps states that the time of issue was 20:57 and checking my calendar against that time and date I was at work. I have checked my clock card with HR and they confirm I clocked in for work at 20:34 on that date. I should add that I work around the corner from the vague location given on the DCA letter.

I have received Parking Charge Notice from Euro Car Parks. I will try to answer question posted by "silverfox1961" to explain what happened and what I did. 1 Date of the infringement On 1st July 2017 I parked at Solent Retail Park in Havant to go with my wife for shopping. We were there few times before, but never noticed any information that there is a maximum stay time. because I am not from Havant I cannot check right now what is the allowed parking time, but I assumed it is 2 hours. From the letter I received I see that I exceeded this time by 45 minutes. They are asking me now for £90 or £50 if paid in 14 days. 2 Date on the NTK [this must have been received within 14 days from the 'offence' date] Letter was issued on 12th July. 3 Date received Because I leased the car form my company letter from ECP was sent first to them and then I got an email and printed version on 14th July (I think my company received it at the same day). 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [y/n?] Yes. 5 Is there any photographic evidence of the event? Document encloses only pictures of car's registration plates. 6 Have you appealed? {y/n?] post up you appeal] Have you had a response? [Y/N?] post it up No, I have not appeal yet. 7 Who is the parking company? Euro Car Parks 8. Where exactly [carpark name and town] Solent Retail Park - Havant -Car Park 2 4-7 Solent Retail Park Solent Road Hampshire PO9 1ND 9. For either option, does it say which appeals body they operate under. There are two official bodies, the BPA and the IAS. ECP is a member of BPA. 10. If you have received any other correspondence, please mention it her. No other correspondence. I will be very grateful for help, what should I do now. I can attach pdf of a letter from ECP if needed.   21. Hi all, my first speech.. I,ve got a County Court Business Centre claim form. In guidance notes it says take or send money to Claimant. Can the Claimant refuse to accept cash? Also...........What does the terminology "in Court" mean with regard to the Claim Form. Having sent it out ,does this mean it is subject to being "In Court" advice please
  22. Hello, I have a problem regarding PCNs and hope someone would be able to help! Received PCN regarding a driving contravention ( crossed a road the wrong way, but it was a quiet residential side street and i was lost!) dated 26th April sometime the week of 15th May. ( mail mix ups are common, it's a relatively new block of flats, mail from a similar sounding block beside us tends to end up with us at times) Appeal deadline would have been 26th May. I tried to appeal online, but the website wasn't working. I have screenshots from several browsers. I called in and spoke to staff who advised a written appeal although it would be close to the deadline, I also emailed them the same day with the gist of my conversation & email copy of appeal. (email appeals are not allowed though) . (all done before deadline) Written appeal received by council on 1st of June, in the mean time, charge certificate dated 26th May sent out informing me that cost now increases from £130 fine to £195. Letter from council dated 8/6/2017 received, informing me that the appeal window is closed hence I am no longer able to appeal. Wrote back saying I effectively did not receive the notice in a manner that gave me sufficient time to appeal. Even then, I had tried the website, called in to speak to staff and emailed before the deadline on 26th May. My written appeal was received 6 days after the deadline which I thought shouldn't be invalid given I didnt receive the PCN on the 26th of April! I asked them to please reconsider the matter, allow an appeal, consider it, and if rejected I should be allowed to pay the discounted £65 charge . To expedite matters I reattached my original appeal letter and a cheque for £65. I also asked the council to show me proof of postage that they did indeed send the letter on 26th of April. I also wrote that if they continue to reject my right to appeal, then to please advise me on the next step/ escalation to county court. The council wrote back thanking me for my payment of £65, advised that there is a remaining £130 left to be paid ( total £195), and that appeals are no longer possible/ not considered/window has passed. The council's letter states that if I don't pay the remaining sum, they'd apply to county court to recover the £130 plus court costs from me. That the letter is signed by a "Business Processing Officer" only makes me more annoyed. No proof of postage/ no response to the content of my actual letter. Just a generic "postal delays are beyond our control". Plot twist - even when I go to the website to pay the fine, it says the penalty has already been paid and payments are no longer accepted online. I'm guessing I'd have to write another cheque or pay via the phone. All in I've felt this is very unfair. I received the PCN late, I tried the appeals website which didn't work, I spoke to staff, I emailed. I've really engaged with the whole malarkey. Do I really need to pay and additional £130 or has this been unfair by the council ? Thank you in advance.
  23. I parked my car on 27th May at 20:28 Purchased a parking ticket and displayed it on my dashboard. Returned to the car at 21:55 to find a PCN stick on my windscreen. The Notice state the following ‘ Enforcement officer XXXX had reason to believe that the following contravention had occurred and that a penalty charge is now payable: Contravention: Code: 83 Parked in a car park without clearly displaying a valid pay & display ticket or voucher or parking clock. Time of contravention: 20:39 On further checking, I noticed the ticket had been blew off the dashboard and on the driver’s seat! I do have the original ticket. And have not appealed or done anything yet. Would be grateful for your views & informed advice, please. Thanks in advance
  24. I have had a "pcn" from one parking solutions through the door today, I actually happened to be at the hospital waiting in intensive care at the time of the pcn, but that's irrelevant... What am I in for, what can I ignore etc etc This morning I had a pcn from one parking solutions land on my doormat. I have no idea as to what to ignore and how to proceed with dodging the money grabbers As shown in the pictures my van isn't clearly shown in a restricted/double lined area but is that enough?
  25. Hi Everybody. I'm new here so please go easy on me if I've missed anything. I live in the Olympic Village and pay £75 a month for a number allocated parking space in the underground car park which is managed by Gemini Parking Solutions. Last Monday (Bank holiday Monday 17th) I found a Parking Charge Notice on my windscreen and a ticket attached for £100 or £65 if paid within 14 days. I also found that my parking permit had fallen off of the dashboard onto the footwell. I emailed my managing agent who asked for a photograph of my permit + a photograph of my ticket and they would ask Gemini to cancel the ticket. I received an email back today stating that because the permit wasn't on display they can't cancel the ticket.
