  1. Hi there, it's been a while I received a shiny PCN in the post today for NO WAITING after I pulled up at the side of a bank doing a favour for someone. I'm a blue badge holder and didn't get out of the car any help would be gratefully received For PCN's received through the post [ANPR camera capture] please answer the following questions. 1 Date of the infringement 24th August 2018 2 Date on the NTK [this must have been received within 14 days from the 'offence' date] 05th September 2018 3 Date received 06th September 2018 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [yes] 5 Is there any photographic evidence of the event? yes 6 Have you appealed? {y/n?] post up your appeal] Waiting for advice from here Have you had a response? [Y/N?] post it up 7 Who is the parking company? Park Watch 8.   2. I parked in a no through road which leads to the entrance to a supermarket car park and a derelict building site, which after many years of standing empty is finally being redeveloped. The road is accessed from a main road, where there are normal road markings and no signs stating that you are entering a private road and there is No Parking or any charge if you do park in it. Shoppers often park in this road for a short time whilst they go the supermarket, even when there are spaces available on the store car park. One day I parked in the road because the supermarket car park was full. I parked for less than 10 minutes behind a car that was already there and didn’t think anymore of this until I received a PCN in the post from a private parking management company. I was shocked that this stated I had parked in an un-adopted road which was no parking allowed and had a £100 parking charge. The council confirmed the road is un-adopted whilst the site is being developed. The company had taken photos of the car I was driving, which was parked alongside a derelict building in the road. The signs stated Attention Private Land – The site is managed & operated for No Parking at anytime and that there is a parking charge of £100. These signs are not in the line of sight of a car driver and when you leave the car to go to the entrance of the supermarket they are behind you and there are no signs in your line of travel. You might see the signs on your way back to your car, but that is obviously too late. The signs are on the perimeter of the building site, which the derelict building is part of, and they refer to “Land” and “Site”, so you would assume they refer to the building site being developed, and not the road. If the road is included then there should be a sign at the entrance stating this is a Private Road and the terms and conditions that apply, as was in the Supreme Court case Parking Eye Vs Beavis. To make matters worse the signs on the derelict building are not illuminated and are less visible at dusk when I parked and when it is completely dark they cannot be seen at all! I disputed the charge with the management company because there were no signs at the entrance of the road and the ones on the building alongside which I parked had not been visible and referred to the building land/site. This was rejected because the IPS had approved the signs and location of them. I tried to appeal to the Site Owner/Director of the company who are developing the site, but he ignored my letters. His company finally did respond after my Father wrote to them. They confirmed that they had appointed a parking management company to control misuse of their land. I and other shoppers, unaware of that this is a private road with no parking, are hardly misusing the land by parking here for a few minutes! Even Police have been seen parking here and I am aware that at least one unmarked Police car was issued with a PCN. The management company have had many requests from the Supermarket store management and people like me to improve the signage and/or paint double yellow lines, to remove any ambiguity, but they have repeatedly refused. One store manager even complained that an employee of the Management company was parking by the derelict building, adding further to the misleading situation. In fact I am sure it was one of their employees whom was parked in front of me when I was issued with my PCN. It certainly was the same type and colour of car that I have seen driving around checking for parked cars. My Father did a study and saw 13 cars park there in one hour one lunch time, including an armed Police woman! I foolishly tried the IAS appeal process, knowing that I only had a 20% chance of being successful, because it is well known that this is not independent at all. True to form my appeal was rejected, even though I had pointed out and given proof that the evidence given by the management company was incomplete and the site plans and photos showing the signs were over two years old and not what were in place when my alleged parking offence took place. The Arbitrator dismissed these facts and still rejected my appeal and asked me to pay the charge within 14 days. I informed the Parking Management Company that I did not accept the decision of the IAS and the reasons why. I stated that I would not be paying the charge and requested that they followed the correct legal process and take me to court and not waste time and money passing this onto a debt recovery company. My letters, including to the MD were ignored and the charge was increased to £160, to cover admin charges. I heard nothing for four months then out of the blue I received a letter from a Debt Recovery company asking for the £160 to be paid. I have denied the debt, and asked them to ask their client to take me to court, so that this can be decided fairly. Their response states if the account remains unpaid it will progress to the legal stage and be passed to the solicitors. I would welcome further advice to what I have already received. This situation has been very upsetting and stressful for my family and I, especially when I am an honest, law abiding citizen, who has not committed any parking offences before. In the meantime, roll on the passing of the Private Parking Bill!

Hi, I received a parking ticket for £60 if I pay it in 14 days and £100 if I pay it in 30 days from a PCM (Parking control management), I have a permit however it was on the floor of my car but visible through the windscreen, I still got a ticket, I appealed the ticket and I still have no reply. I got a letter in the post stating I now have to pay £160 because I haven’t paid, however I was waiting for the reply from the appeal I called and apparently if I hadn’t heard in 14 days from the appeal I should of called them and I was made aware that it said this on the back of the parking ticket, however they claimed to have sent a letter declining the appeal on the 2nd of February which I still haven’t received, I appealed on the 1st of February and the ticket was issued on the 30th of January. What shall I do? Thanks
  5. He has contacted my mother and my sister via the phone and appears to have my mother's address. My sister asked him what he wanted, and it appears that he is trying to track down someone who has a similar name to me and whose wife has a similar name to my sister (although she has a different middle name). She did not give him any information about my whereabouts. It is in regard to an unpaid debt to the tune of thousands of pounds. I am still in contact with all my creditors and am not in trouble with them, and there is no way that I have incurred any debt with anyone else, so this is clearly a case of mistaken identity. The person he is looking for's last known address is a place where I have never lived. According to my sister, his manner was very intimidating, as he fired off a load of questions before he even revealed who he was. I think he is legit as he has given his number and the name of the company he's working for. Since he contacted my sister, he has repeatedly attempted to phone her, but she has now blocked his number. I do not want to be contacted by this person, as he clearly has no lawful business with me or my family. As I have long term mental health issues, the thought of the possibility of being under surveillance is somewhat distressing, although I'm keeping calm about it for the moment. I'd be grateful if someone could give me some advice on how to deal with this person, assuming he hasn't already moved on with his investigation:|
  6. Hi, First of all, thank you for the support you all provide through this site. I have received a Parking Charge Notice from CPM (UK Car Park Management) for 'Unauthorised Parking' in a small car park. The bays are unmarked and the signs are barely readable attached high on the walls in small prints. I am the registered keeper but not the driver of the time. The issue date was last year June 17 and was for £100 or reduced to £60 if payed in 14 days. It was sent to me in post with two pictures of my car in the letter. The reason was 'unauthorised parking'. Since then, I received another letter called 'Formal Demand' roughly after 40 days of the first letter where it says to pay £100. Then I started receiving 3 DRP letters (2 in sept and 1 in Oct 17) asking to settle payment of £160. Following that, I received a letter from Gladstone Solicitors in Nov 17 asking me to settle payment of £160 and then another 'Letter before claim' in June 18. Taking advice from other forums, I decided ignore them and I never contacted or reply to any correspondence thinking that they will stop. Now (Sept 2018), I have received a Claim Form from County Court Business Centre, Northampton asking to pay CPM £174.67 + £25 court fee + £50 legal rep fee total of £249.67. I have kept all evidence of letters and pic of the car park including the sign they have up. I need advise on what to do next. I have read different threads and you tube videos and all saying this is fake court. The court logos are blurred out and looks like the letter has been copied. Is this a actual court? The letter contains moneyclaim.gov password. Please can you offer me advise om what to do next? I have 14 days to acknowledge of service then submit my defence. I can upload pics of letters and photos upon request. Please speak to me in layman's term as I don't fully understand the process.   7. Hi guys I bought a car privately for £1500 cash for my girlfriend to use. She will be the registered keeper as this also makes the insurance cheaper. She will be the registered keeper and main and only user of the car. I withdrew the cash from my bank account and bought the car without any kind of receipt. How can i prove ownership in the event of a break up and i want to keep this car that i paid for? My girlfriend is aware of this so im not doing anything sneaky. If necessary i could ask the previous owner for a written receipt. thanks
  8. Dear all, I wonder if anyone could help me please. I received a letter from Gladstones Solicitors for a parking charge that was apparently dished out last year (16/04/2017). They recently sent a letter before claim but the letter was not even signed and did not include any evidence of their claim, this being the case I just ignored it thinking they were taking the mick. I have now just received a Claim form from the County court business centre. To be fair it looks like a document someone created on their PC and photocopied... again unsigned by a Kirsty Ann Jenkinson. The form is addressed to the keeper of the vehicle who has never visited the site at any time in their entire life. They are claiming that £248.69 is owed. I think this is ridiculous and feel like I should report them to the Police for attempting to gain funds via deception. Is anyone able to offer any assistance please?? I'm not sure what I should do and I do not want the keeper of the vehicle to be held liable for a charge that is blatantly undue. As far as I am aware, no contract has been made because the keeper has never visited the place where they claim the parking charge was issued. It says "The driver of the vehicle xxxx xxx incurred the parking charge for breaching the terms of parking on the land. The defendant was driving the vehicle and/or is the Keeper of the vehicle. I'm not sure what to do... I would appreciate any assistance that could be offered. Thank you kindly in advance,
  9. Hello everyone, I've recently received a Parking Charge Notice from Park With Ease Ltd (PWE) and I'm looking for some advice. On the 30th December I parked at Ferry Meadows in Peterborough for about 50 minutes and completely forgot to pay my parking fee... that was until yesterday when I received a parking charge letter (dated Thursday 15th February 2018) from PWE - see attached pdf titled "Park With Ease PCN Letter". I've had a little browse at other cases and something that keeps getting mentioned is that they have to send the letter to me within 14 days of the 'offence'. Am I correct in thinking that I would have a good chance of a successful appeal (perhaps with the Independent Appeals Service rather than the initial PWE appeal) based solely on the fact that the letter is dated 33 working days after the 'offence'? Just looking to get some advice before I decide whether or not to appeal the charge. I have no real defence as I completely forgot to pay, so I'm just curious as to whether the 14 day notice period means I don't have to pay. Thanks in advance for any help/advice. Mike.   10. hello everyone i am currently receiving job seekers allowance and have a quick question about advisers requesting to access my data. today i was asked to bring in my passwords and login for indeed.com and the site 'find a job' to my next (i'm assuming to prove i am applying for the jobs i tell them and also have a sticky beak at my job search history). do they have the right to ask this of me? i know i have to provide proof of applications by way of printouts (which is what i intend to do but i'm not sure they have the right to access these sites with me at the job centre during my signing. thanks in advance and apologies for the unnecessary capital letters in this post.
  11. Hi All, I need a little advice. I have received a CCJ letter from a private parking company called CPM. The CCJ has been put together by Gladstones solicitors. I have already submitted an acknowledgement of service however due to a holiday have only now a few days to file my defence. I noticed that the CCJ has spelt my name wrong on the summons letter for example by one letter - Joe Bloggs Would be Jje Bloggs. As I understand the court process they are all about the details - so surely this is enough to use a defence? Any advice would be greatly received. TIA
  12. Hi all, I am new to this site so please forgive me if I have posted in the wrong place. I have been fined £1200 by a magistrates court around 2 months ago. At the time I was not able to pay and was instructed by my solicitor to state that I could pay in instalments once I had an income to avoid a harsher punishment by the judge who was not in the best of moods on the day. I was advised by my solicitor and court staff to contact the collections department for fines to offer an amount I could pay monthly, every offer I ever made was refused for a payment plan but they kept telling me I could still make payments if I wished to do so. To this day, I genuinely have been unable to make any payments. Since becoming unemployed prior to this fine, I had to find a way to create an income. I set up a private limited company in August 2018 working from home selling goods online. I am the director of this company and 100% shareholder. My question is, now that I have started to receive letters from the court stating that further collection acticiry will take place, can bailiffs or court officers take control of assets/stock belonging to the private limited company which I am the director of? Any help would be appreciated as I am expecting a knock on the door any day now. Every week any money I make is being reinvested into existing and new stock, packaging, supplies etc. I am not yet paying myself a wage. I started this company with a surprise tax refund cheque and through selling my personal belongings as I needed to create a source of income as I was struggling to find work. This has paid off as my business is now getting somewhere so to speak. If I have missed any crucial information please forgive me and I will reply asap to any questions or requests for further information. I want to know whether what I have now finally built could be taken away by bailiffs / court collection officers!! Kind regards Hks91

Smart Parking 8. Where exactly [carpark name and town] Exeter, Haven's Bank retail park My case is a bit weirder than the usual. I got back from work around 19:30 and in my street they were having a BBQ party so cars parked and no where for me to park. Good natured I asked them when will they finish and they said about 15 mins I went in the nearest retail park in our place about 30 sec drive and parked there, no other cars where parked (not knowing it was private). I then left the car park after 13 mins to go back in our street and the cars are still parked I gave them another leeway of 10 mins in which i proceeded to go back to the empty retail park (2nd time now) from 20:00 to 20:13 Got back and saw the party over and proceeded to park in my own street. Now 1 month later i received 2 parking charge notice from a private company called Smart Parking asking for 90 quid or 54 if paid within 14 days. I made an appeal stating what I said here but I haven't gotten a reply yet. I was going to contact them through the phone but they are not opened on weekends. Having revealed that I was the one driving the car, have I still got a leg to stand on? I can possibly survive the £54 parking charge but having to pay £108 for not even 30 mins max of parking on an empty car park is a bit too much I think. It also doesn't help that I didn't even see the sign that night stating it was privately owned I thought it was a bit misleading. The letters too small especially not visible when dark.   14. Hello everyone Last August (2017) I parked in a small carpark outside a parade of shops and went to have lunch with family. There was no pay & display machine and I genuinely thought it was free parking. Some time later, I received a letter telling me that my registration number had been detected on the way in and out of the carpark and I had overstayed the allowed amount of time. They wanted me to pay a fine. I ignored the letter, believing that it was not enforceable, and also ignored one or two reminders. A few days ago I received two pieces of correspondence. One was a Particulars of Claim from the parking company, filling two pages, quoting a Claim No. and with an accompanying letter saying that a copy had been filed with the court. The other was a Claim Form from County Court Business Centre. This also included information in the Particulars of Claim box but, interestingly, this particulars of claim was different and very much briefer than the one sent to me. I'm not sure if that is significant. The longer Particulars (the one sent direct to me) mentioned such things as "failure to adhere to advertised terms & conditions", "breach of contract for failing to adhere to the terms & conditions" and that their terms & conditions were "accepted by conduct" (ie presumably by me parking). They are claiming £160 plus £25 court fee, plus interest. My contention is that, no matter how obvious they claim the signage to be, if I didn't see them then they were not obvious enough. Surely it is their responsibility to make sure I see it, not mine to look for it. If I didn't see a sign then I couldn't have agreed to their conditions and no contract was made. Unfortunately, the carpark is nearly 100 miles from where I live and I cannot easily go back and check the signs. I have seen a sticky thread (with the confusing title 'CPR 31.14 Request to use on receipt of a PPC') which suggests I should ask the parking company for a copy of their contract with the land owner. Surely that is confidential and they will refuse/ignore my request? The same with asking for copies of planning consents relating to erecting signage. What if the documents cannot be secured in time for me to use them in my defense? Is there any way for me to ask the court to suspend action while I wait to receive requested information from the claimant? I am up for fighting this, if you guys think there is much chance of winning, but I am not very confident about this sort of thing. If anyone is prepared to hold my hand and walk me through it, I'll have a go. Can anybody help me? The issue date on the court Claim Form is 21 May 2018. Thanks, John
  15. Hi guys I have an issue similar to a few others on here, involving the Swansea based Millennium Parking Services. My vehicle was parked in a residential area in Swansea, totally oblivious to any signs advising it was Private Property and Permit Holders Only. Received the PCN stuck to windscreen upon return to the vehicle. The original ticket charge of £100 has not been paid. As the registered keeper, I received the NOK a month or so later and have retained it. It has not been acted upon my me. More recently, I received a demand for £160 from Debt Recovery Plus. I have ignored all requests for payment so far. I'm quite comfortable going through the court process if it comes to that, but would you advise on any action I should take now that might help prevent being taken to court, or even assist with the defence if that day does come? I'd be keen to save myself on the hassle and time wasted in going to court if I can help it, for the want of a well worded letter of dispute. Cheers, Sham
  16. I have an issue with a drain that floods the area outside the front door of a property I rent. The drain is in a private road, owned by a local church. Every time there is a heavy storm, the drain overflows and creates a large puddle up to 4" deep outside my front door. As cars come down the road to attend the church, water is pushed over the door stop and floods into the basement. I spoke to Thames Water last year and they informed me that the ownership and responsibility laid with the church. I contacted the church but no action was taken so Thames Water agreed to send someone to try to deal with it. The upshot is that the drain is not blocked but is badly constructed, so is unable to cope with large volumes of water. Both myself and the Landlord have repeatedly contacted the church but nothing is being done to fix the problem. Is there any legal action that can be taken to force them to address the problem?
  17. ive had a ticket from the same carpark and im being taken to court at the end of september, are you able to update as to how you got on and what defence you used? am i able to use your pictures? i parked at night time and was visiting Khans, didnt realise i would have to pay at 9pm, plus it was dark so missed the signs. im really hoping that at the very least i just pay the parking charge of £60 as now the charge is at £300 and i just think that is disgusting!
  18. I have lost appeals to dismiss a PCN and am now receiving letters demanding £160. I have been told they will keep increasing this fee until it is over £600 when they will take me to court and I could have to pay court fees. Is this true? My appeal is for several points of mitigating circumstances including that when parking I thought I was a patron as I was waiting for my passenger who told me he was entering the business and then didn't and that my passenger is my perpetrator and myself his victim of domestic abuse and I was forced to park where he told me as to not have done would have put my safety at risk. I can prove that I am a victim of domestic abuse. The harassment for money for this PCN is reminiscent of financial abuse I have suffered. I was going to write to them to tell them to stop harassing me and that I am not paying for the above reasons. I am a single parent on benefits due to Complex -PTSD as a result of abuse. The mitigating circumstances didn't get heard until stage 2 of the appeal process and the judge who dismissed my appeal said he could not consider mitigating circumstances at stage 2. What is likely to happen if I don't pay this. If they send debt collectors they will not find anything of value.
  19. Heathrow airport drop off though this could apply to any airport I expect.. Heathrow airport is private land and I have a response from the Met police stating that and that they are paid to police the land by Heathrow airport.. Now I accept a need to police it for security reasons and because in motoring terms a lot of traffic uses the area daily. However on occasions the Met police decide they will clamp down on people picking up from the drop off areas which by the signs posted is an offence some signs state its an urban clearway no stopping allowed except for dropping off so its fine to stop and unload but if you stop and load up thats an offence. I had a friend (taxi driver) dropping off and loading up at the same time 1 in and 1 out and he was threatened with a ticket as according to the officer its an offence to pick up.. Its clear this is all about money for for the car park.. Would the police issuing you a ticket in this case be classed in the same way as private company ticket or would it be classed as a criminal offence given that its on private land and would the matter differ if the ticket was issued by an airport employed operative such as the parking wardens they employ. I havent had a ticket but in some ways Id like to test the case in court as in my eyes its a private land parking matter and one the Police should not be involved in.
  20. My daughter parked in my private parking bay and viewed the visitor permit in the windscreen rather that the permit with the bay number. When we returned she had a parking ticket. I wrote to UK Car Park Management Ltd advising this was an error and that she had my permission to park there me being the resident for that bay and provided photographs of both the visitor and bay number permits. She still received letters requesting payment which rightly or wrongly i told her to ignore as i believed we have the proof that she had permission to park there. She has now received a letter from Gladstones Solicitors stating 'Letter Before Claim' The initial ticket was for £100 which increased to £149 and the latest letter states £160 My daughter has never responded to the letters in respect of this ticket by my advice as i gave her permission to park there. Should i or her respond to the 'Letter Before Claim' or ignore it? Any advice would be gratefully received
  21. Help Required I have received a Pcn fine from a private car park in Blackpool NE Parking Ltd. I have received a letter from above company on the 17.12.17, Saying that was parked incorrectly and not within the parameters of the bay, they have supplied a photo of my vehicle with one wheel on the white line of the car parking space (not actually outside of the bay) they also have a picture a parking ticket on the windscreen of the car. Which wasn't on there when i returned to my vehicle. The fine relates back to 22.10.2017. I have responded to the company by email To whom it may concern. I have today received a notification of a fine issued by your company stating that my vehicle was 'not parked correctly within the markings of the bay and it also stated that I had been issues a penalty notice at the time. my vehicle is on the white line (which is not outside the parameters of the bay.) this was only one wheel as shown by your photographs. you photographs also show a yellow package on the window screen however there was no notice on my car on my families return to the vehicle (if this was the case I would have contacted you prior to the letter I have received today.) I feel this is an unjust letter / fine that I have received. I will also endeavour to seek further advice if this matter progresses. Response from NE Parking Ltd Thank you for your email we received on 17/12/2017 Unfortunately you are out of the timescale to appeal you were given 28 days To appeal from the day after the pcn was issued to the vehicle which Was (22.10.2017) The amount which is now payable is £100.00 I have replied saying how do you respond to something which you where unaware you've received.   23. Hi whilst getting advice about a different ticket, my husband now received one from Smart parking. We were away for a weekend somewhere we don't know and parked outside a bowling alley. Didn't even occur to us we'd have to pay (even in London we don't pay in such locations!) It was pouring we rushed inside without looking at notices. Is this another dodgy private company or not?   24. Colleague at work bought a car from a private seller on Friday last week - 2003 BMW for £750. She needed car to get her 4 kids to school and her to work etc as previous car had conked out completely. Seemed nice old guy, had all service history etc. Saturday morning a warning light came on for coolant so she went to a petrol station, bough some and put it in. Same thing happened again on Sunday and Monday. Took car to a garage yesterday and it seems cylinder head gasket has gone. She has contacted the guy who says there was nothing wrong with the car when he sold it and won't entertain any sort of refund. I know you have very little protection when buying from a private seller but I feel so sorry for her- she's only had the car 4 days, just wondered if anyone knew if she could do anything about getting at least half of her money back which would pay for the repair.
  25. Hi, I am looking for some guidance. My partner who has a private hire cab stopped outside a restaurant and went in looking for a customer (not realising that it was in fact a loading bay). Came out to find a ticket on the car. The PCN states that the offence code is 02 'Parked or loading/unloading in a restricted street where waiting and loading/unloading restrictions are in force'. This is under s78 civil enforcement of parking contraventions under the traffic management act 2004. The time the contravention was observed was only 1 minute. I am just wondering if he has any grounds to appeal this. The time was 17:52. We will go past and look at the signage tomorrow but this is what is showing on google street view (realise this may have changed since).
