Hi, First the details of the alleged 'offence'... 1 Date of the infringement - 01/07/2017 2 Date on the NTK [this must have been received within 14 days from the 'offence' date] - 21/07/2017 (20 days after the 'event') 3 Date received - 23/07/2017 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [y/n?] - Yes 5 Is there any photographic evidence of the event? - Yes, images of the vehicle entering and leaving the car park 6 Have you appealed? {y/n?] post up you appeal] Have you had a response? [Y/N?] post it up - No, thought I'd ask for advice here before doing anything. 7 Who is the parking company? - Parking Eye 8. Where exactly [carpark name and town] - Premier Inn, Deansgate Locks, Manchester For either option, does it say which appeals body they operate under. - The notice only mentions POPLA in respect to appeals but it says they are a member of BPA. My son and daughter-in-law used this car park and my son paid for a ticket for considerably longer than the time they actually parked for. He can't remember the exact period he paid for (and they've lost the ticket), but as they were going to an event they didn't expect to finish until after 10pm, he knows it was for considerably longer than the time they spent there. Having said that, the Parking Charge Notice/Invoice makes no mention of why the charge has been issued, we're just assuming it's for staying too long. Is it normal that the 'offence' isn't mentioned on these charge notices? If it is, how is someone meant to appeal or defend themselves against an unspecified transgression? I've read in other CAG posts that these notices must be received within 14 days of the alleged 'offence' (it's termed an 'event' on Parking Eye's invoice) - does that apply in this case as well because it turned up 22 days later and was issued 20 days after the event? I've attached a copy of the PCN as a file - can't seem to figure out how to add it as an image like others on here are doing, hope that's not a problem.   2. I find myself in murky waters like many others claimming this new benefit. Having worked most of my life, and cared for family member, then returning to work following the loss of family member, my GP signed me off work and to cut long story short, I resigned from my job due to employers pressure. I was only on probationary period so cannot claim unfair dismissal. I investiagted my entitlement to benefits and was directed to claim ESA which I did. 3 weeks later receiving a letter rejecting my claim, not returning my 'fit notes' and advised to claim UC. I immediately claimed UC and attended first security appointment. I was handed my 16 digit security number (which I feel breaches data protection having it printed, but wouldn't remember it anyway) and requested my claim be back dated to 2nd September due to the above. As UC is all dealt with online, via the journal process I have found this process confusing and frustrating as I am unable to speak with someone initially to find out what benefits I could claim. The 0845 numbers in my area charge additional fees when calling from mobile phone, fees which my provider advise are not charged by them, but are charged by DWP. The rejection to back dating my claim will obviously cause severe hardship and arrears with rent /council tax. I am genuinely looking to return to work and have been applying for many jobs which I am more than capable of doing, without success but in the meantime I am totally stressed about my current situation and do not know how I am too proceed, not having been in the position before of having to claim JSA/ESA etc. I'm not wishing to sound derogatory but I have never lived off benefits and find myself in unknown territory, but extremely scared of the prospects ahead. I have done some research about benefits and it mentions 'Mandatory reconsideration', prior to appealing their decision but I have no idea how to go about doing this, as it appears the wording of the rejection letter (via UC Journal) seems to be coming across as saying 'ignorance is no excuse'............................ I have a meeting with my workcoach at the local jobcentre this afternoon and would like any information you can help me with to go armed with to get this MR moving along please. I have requested an interim payment but the UC Journal advises that I call them to apply for this! If they will take phone calls for interim payments then why can I not talk to anyone regarding UC on the phone about benefit matters? This is so confusing and frustrating but surely they can't reject a request for back dating of claim when all their rules are so complex? Or can they? I will be homeless by Christmas if they don't agree to back date this :-x:-x:-x Any help or guidance would be very much appreciated.
  3. Can anyone offer advice please on my receiving a Court Claim for a parking charge notice from an alleged parking infringement in October 2011? Briefly the details are: In Oct 2011 I loaned my car to my brother to shift furniture for his friend. Over the years since I have received threatening letters from Excel Parking services which I have ignored as I was not the driver. I shouldn't have ignored them but I saw no reason to respond. My brother was a disabled badge holder but I am unable to determine if he used it at the time as he died in 2014. A company 'bwlegal' started chasing me for various sums of money late 2016. Their last letter stated Excel were going to issue court proceedings for a sum of £258 made up of various items. This raised concern with me and I wrote to them a few days before their deadline to advise them I was not the driver. I did not mention who was the driver as there was little point in doing so. I have never been taken to court before and appreciate any advice on how to proceed. This has been going on and on and I wish to see the end of it. I intend to defend their claim in court and have until 28 March to respond. It looks like I have to return a 'Acknowledgement of service' to gain 28 days grace to prepare my defence. My questions are: As the alleged contravention took place before 2012 am I correct in ascertaining that the Protection of Freedoms act, specifically 'clause 4' which holds the registered keeper liable, is not valid in this case? The response from bwlegal to my letter states that I have been given opportunity to disclose who the driver was and quotes 2 further legal cases which I will have to argue against. Elliot V Loake 1983 and Combined Parking Services V AJH films 2015. I believe I can argue against these points with some more research. Advice please on how to proceed. Thanks in anticipation.
  4. Hi, Could you help me with a Northampton county court claim dated 13 sep 2016 which is for £935.50 + interest. I have acknowledged it online and the issue date is 13 Sep 2016. Claim History A claim was issued against you on 13/09/2016 Your acknowledgment of service was submitted on 22/09/2016 at 20:20:43 Your acknowledgment of service was received on 23/09/2016 at 08:01:36 I want to dispute the whole claim which I have told the court online as im not sure about this credit card or when it was taken out as at that time I had so many debt but im not sure which one this is. Which forms do I need to send off to the claimant and the solicitors. CCA and 31:14? Any help will be appreciated.
  5. Hi I feel as if I should know how to do this by myself but age is catching up with me & the brain's not as sharp as it once was so any help will be greatly appreciated. I went bankrupt in 2010 & was discharged in 2011. When checking my credit file with Equifax - all ok but Experian have a default with Provident marked against me, dated 2011 ! Prov were definitely included in the BR & I know they are wrong to have marked the default after the date of the BR so I wrote to them demanding they rectify the information they provide to Experian, posted recorded delivery & good old RM didn't get a signature to show whether it had been delivered ! What do I do now ? Do I send the same letter, this time by Special Delivery ? Do I do nothing & wait for 28 days then if no response from Prov, complain to the ICO stating s7 Interpretation Act ? Do I send the same letter, this time by Special Delivery but pointing out the 28 days started from the date of the original letter ? As I said, any help will be greatly appreciated. After 6 years of waiting, it's a pain in the proverbial not to have a shiny clean credit file

I received the N1SDT from Cabot/Mortimer Clarke as I have been working away so only saw it yesterday morning, I have already Acknowledged it via MCOL I chose the option Intend to defend all. the Particulars of Claim as follows:- By an agreement between LTSB & defendant on or around 15/10/1998 ('the Agreement') LTSB agreed to issue the Defendant with a credit card. The Defendant failed to make the minimum payments due & the Agreement was terminated. The Agreement was assigned to the Claimant. THE CLAIMANT THEREFORE CLAIMS 3830.31 At the total cost Amount Claimed 3830.31 Court Fee 185.00 Legal Rep Fee 80.00 Total 4095.31 My question at present is as there are no account numbers on the form What should I put on a CCA in the Account number Reference to Cabot. Also sending CPR31:14 to Mortimer Clarke To clarify I do accept I had a card through Ltsb and also have been a bit of an ostrich in the past, due to various reasons I also have not been good with repayments since Jan 2015

Hi there, Looking for advice on how to handle & respond to the following: Received NIP today 10th March 2016, the NIP was dated 9th March 2016 with the alleged offence occurring on 13th December 2015. Offence was 41 in a 30 zone. The wife was driving at the time. The wife has been the registered owner/keeper for about 4 yrs. The vehicle and plate have been registered at the current address for over 12 months. I've seen comments and advice about NIPs needing to be served within 14 days of the offence, which this is clearly outside, but what I wanted to know is what is my/wife's positon here, who should we write to and what should we say Many thanks in advance for any help Mr P

  9. The new landlord of the property where I live is seeking eviction of all tenants in order to gain possession of the property. The other tenants have various types of tenancies such as Assured tenancies and AST type tenancies. The attempted eviction is served on us under section 21 of the 1988 Housing Act. The Assured and AST tenancies were introduced in the 1988 housing Act which came into force on January 15, 1989. Now, my tenancy began in 1988 and I don't have any official document to confirm my tenancy status. However I do have several post mark dated letters addressed to me in various times of 1988 and in further years up to the present time. On it's own would these post mark dated letters addressed to me be firm evidence of being resident at the property since 1988 and thereby not being subject to the section 21 notice for possession of the property?
  10. Hi can anyone advise how the payment system works for back dated pip. My son got a letter to state he was awarded enhanced disability and low mobility, after 7 months. Unfortunately it was paid to a closed account on 12 Dec. No warning that he was getting a payment, or to check if details were correct, my son has autism. I rang to give an account number it could be paid to, and they said it will take a week for the payment to be sent back to them, then my son and I have rang practically every day to see if it was back, my son has extreme anxiety. After getting a load of tripe off call handlers, eventually a team leader advised the payment had been received back to them and was with the case manager who has to resend payment to the correct account. Are the payments made by chaps?bacs?He's very upset it's taking so long, has not been out of his room he's so depressed. Can it be paid quicker, he is 22 and was only diagnosed this year after assessments from age 4 years, misdiagnosis also, there's another story.Thankyou

  12. We parked in Asda car-park in Brighton Marina from 19:05 hours until 23:09 on 17/11/2014 as clearly shown in the PCN photos of our number plate. We have we received a PCN from Smart Parking dated 02/12/2014. I understand that the PCN has to be sent by the 12th day in order to be valid. My question is, is this 12 working days or 12 days? And .. where do I find that information please? Incidentally, neither of us saw any signs indicating that parking was time-limited. I have looked at Google Earth, and you can drive in without seeing any signs. You successfully helped me get a PCN from Parking Eye cancelled, so I am willing to try again!
  13. Today my wife received a package from Drydens with a copy of an application to remove a stay and proceed in court. It was stayed on the 28th Dec 2013 after they never came back to court following sending our defence. Brief outline wife got cancer credit card unhelpful when couldn't pay so didn't pay. Sygma bank wouldn't supply information asked for and issued default. drydens also wouldn't supply info but eventually supplied copy of agreement which we noticed although signed by my wife it was unsigned by the bank. I am defending the case under POA as my wife is still having treatment and is suffering from depression. We were defending on the agreement unsigned by the bank and not being supplied with evidence of the debt. Today I noticed the copy of the default notice drydens enclosed is different to the actual default notice we received. They are even dated 2 days apart. Also does a default notice have to tell you the outstanding balance?. I have attached both notices.
  14. Dear All We have recently been hit with a back dated demand for Gas of £9500!!!!!!!! As you can imagine we were absolutely go smacked. It all started when we transferred our energy supplier five years ago. Every time we transfer our electric transfers but not our gas. We constantly tried to resolve this with SSE, to no avail, by constant telephone calls but it was never sorted. 18 months passed and they suddenly picked up the supply. We were quite happy with this, as their rates were good, and moved our electric supply to them as well. We sent a meter reading, set up a direct debit and everything seemed to be ok. However a month ago we received a back dated bill for five years of £9500. I noticed that the meter start was on 1034 and their last reading was 34000!! We disputed this and they reduced the back bill to £1600 and stated that their estimate had been to high. It also appears that they have not read the meter for five years!!!! They are currently estimating that we will use £2300 of gas per year. What I have done is taken and average over the last month, after this started, and I estimate we will use £1200 per year. My question is this. We can demonstrate our usage and have sent meter readings ourselves in the past, although not every time I will admit. really using the twelve month back billing rule we must be up to date if not in credit, can they make this stick? After sending a greatly reduced bill they are now putting pressure on by saying we must contact them immediately to agree! Surely this can be correct practice? Can anyone help?
  15. My OH has checked his credit file & found that an unpaid debt to a catalogue company for £270 has been registered as a default on 01/02/14 despite having not made payment at all since 2009. Clearly it has been sold on to a DCA but no contact has been made yet this default has now shown. Should he: a) ignore the date of default ? b) question the default & if so, with whom ? c) will it matter what the date is since, if I've got this right, it should drop off his file after 6 years since last payment activity on the account ? He has other debts that he's made arrangements for so already has a trashed credit file but wants to at least have the trash being correctly applied ! All help appreciated AARGHHH !!! On reviewing the file, I note that it is only the updated date that has registered as 2014 - the actual default is 2009 !
  16. Hi, I have an account that was made into a CCJ in 2007, it has now been removed from my credit file as the 6 years has been and gone. I have checked my file and the account is still showing on Noddle and Equifax, it is in the closed accounts section but it has a default date of 09/09/2008 so it will not be removed till this September. From what i have read the CCJ should be the final outcome of this account and the default date should of been dated before the CCJ date and thus already left my credit file, I also went BR in March 2008 and this was included so i am assuming the date of this default should be the CCJ date or my BR date at the very latest, is this correct, should i be writing to the company to get this changed? How likely I am to get disability element on top of my working tax credits, based on the tax office guide lines, I think I would be entitled to the disability element, but dont know what the tax office would think I work 16+ hours per week Due to my health, I am unable to work, 5 days per week, or any long shifts now, so I only work 4 days ,and 6.5 hrs I have a secure job, in asda, so for me to find a new job, I think I would have some difficulty in doing so My health is poor, due to slow heart rate, high cholestral, and angina, easily get tired, and exhuasted. Have been in and out of hostipal getting tests done for last 2 years Because of my health I have had to take time of sick, and the way my days of sick work, does not allow me to get ssp, as it is my day off Since my health has got poorer, my earnings have been vastly reduced; 2008-2009, £12,600; 2009-2010, £9500, so my gross earning are less than the year before If I didnt get disability element then I would have to work more hours just to meet outgoings, but in doing so, I may very well make my self more ill, as I realy need to rest
  18. Hi, Wanted some advice around being caught with a train ticket that had a false (future) date penciled over the original expiry of the ticket. The person has been called into a police station for voluntary questioning about this. I suspect the police will want to know the facts, then decide whether there is sufficient evidence to potentially prosecute for fraud and have a court issue a summons. This interview with the police will take place over the next couple of weeks. What are their options? To admit liability to the police? To hire a costly solicitor and maybe draft a letter to the train company to settle out of court if possible? (I know court is just a future possibility but I'd say highly likely). How "fraudulent" will this be seen by the court? No previous convictions, can provide evidence of immediately prior to this incident of paying for monthly tickets for perhaps the last 5+ years via bank statement evidence. What is the best course of action if this does go to court? Have them represent themselves, admit liability, show evidence this was truly a one-off and hope to get away with a fine + court costs?
  19. Hi I have recently been sent a County Court Summons from an old landlord. I was awaiting their response to a query I had regarding old rent arrears now they just want to take me to court without me making an offer based on the final figure. The Summons they had showed the date of issue being 30th April this year. Stamped across it says 'Date of Service 3rd of May'. To my knowledge surely the Date of Service should be 5th of May? I know it's only a couple of days difference but why would they have already stamped it with the wrong date?
  20. Never heard of this one before from a bank, but can someone just bring me up to date on this? Mate of mine sent a post dated cheque to Lewis Debt Collection Agency for a payment towards a late filing of accounts on behalf of Companies House. It was dated 9th or 19th May (Can't recall exactly) I just got this email from him after Lewis presented it for payment and his bank cleared it despite the post dated date...: "According to the bank post dated cheques can now be cashed anytime and they are not responsible for when they go through. It is now merely a “gentleman's agreement “ between the debtor and the creditor whether the date on the cheque is honoured. I did point out it was a post dated cheque on the correspondence I attached with it." (to Lewis) He was asking me if that was correct and I didn't think it was, but then it's a while since I have had much general day to day dealings with banks per sa....mine has been a trifle more confrontational ....anyone any thoughts on this?   21. I apologise if this is posted in the wrong forum. Further to my last posts I have now had my Capital One debt referred to CapQuest. There was a standing order set up for Capital One for the sum of £1 pound as instructed this is still in place. I have had no telephone conversations with CapQuest, not that they have not stopped trying. I recieved a letter from them this morning stating that Capital One are happy to accept a reduced amount of £1088.41 to be paid in full or over a 3 month period. I am still in no position to pay this amount of and cannot see this changing in the near future. But my belly is full and my bills are all paid so happy days, well not so happy but life goes on as they say

I'm confused as it looks like I got issued with a default notice today, according to my credit file my account is two payments behind and the notice states that if i dont pay by the 23rd September no further action will be taken. Does this mean the default will only be applied if i make a payment?
  23. Hello Im wondering if anyone can help me please? I made a claim for ESA In november but only had my medical on the 9th july 2012, if i pass my medical will i get my money (the extra money you get from 13 weeks) back dated?
