  1. Hi all, I was hoping one of you good people could help. My Dad has received a letter from Chester County Court with part of it hand written stating that a warrant has been issued for collection of a debt. He advised me that this is from around 10 yrs ago and not paid a thing since. Am I correct in thinking this is statute barred? The letter looks a little dodgy to me, almost as if Arrow are trying to scare him into paying. It mentions a warrant has been issued, but no copy of the warrant was enclosed, also there is no date to pay by before the bailiffs visit. I believe a CCJ was issued many years ago. The envelope used also looks like it could have been reused. I have attached the letter and envelope below. This is all that was enclosed with the letter which arrived Friday.   3. Hi im not the best at explaining please bare with me. A few years back, I was declaired Bankrupt Afterwards i struggled getting a Bank Account. Long story short. I saw Gregorry Pennington in the paper offering bank accounts for 14.50 a month. They didnt have to manage me with anything. I was just desp to have an account and GP said id struggle after going bankrupt. I had health issues lost a friend and had a breakdown over the last ten years. Only now able to go out about due to anxiety Ive had a support worker out whos gone through all my paperwork etc. Realising several DD s had came out of my account over the years. One i remember canceling because i got my card canceled the same day. And explained. That id contacted the police due to items going from my home. Police had infact changed locks and the persons were taken to court for doing quite abit of Fraud. It was dealt with in the Crown Court. On ringing up my bank(new name Think Money) after explaining everything. They rang me back saying as its over 12 mrhs. They wont accept it under fraud. Due to the lengrh of time going back 2009. Even health issues. Me having the break down. And police ref. made no difference , i also had a call around the time i opened the account with them. From them offering me home insurance cheap with them. I agreed as is be thinking of getting it anyway. Set up dd with them. Going through all paperwork my Support Workers come across 2 Policies. One is Think Insure Client 13.00 amonth. Other is 6.99. For Key Insurance?? Neither i know of. And theyre Rolling Contracts. With Millenium Insurance Brokers plc. I believe the bank gets the ok were interested in insurance. They then pass details over to Millenium who then pay rhe bank a percentage for it. The brokers charge me per year for agreeing to the credit. It then gets referred to Think Insure. Who go s through Ageas insurance. When supprt worker first noticed something wasnt right. Payments to Millenium were canceled, letter wrote. Phone call made. Going through papers now. The only policy stopped was the 21.00 home insurance. The 2 rolling ones are atill being taken to Think Money my bank. Theyve now sent a letter saying im no longer welcome to have a bank account with them. Because of recent issues. Giving me 8 wks to find alternative. I cant believe they can do this. Any advice. Help please. 14.00 a month over ten years to get treated like that
  4. Hi guys, I recently went to open a business account to start a new busines . I was rejected so joined experian and found out I had a ccj dated back to 2013. Couple of things. I wasn't aware of this ccj which is registered to my old address (which my ex wife lives at). I didn't get my post for the first year or so due to bad relations with her (2009-2010) but since 2010 I've been getting all my post and have no recollection of this. Should they send the ccj paperwork recorded delivery? I contacted Northampton county court and got the details. Then called the solicitors. They gave me some details saying it's for a credit card and the amounts etc. I said I don't think this is mine can you get me a copy of the credit agreement. Roughly 8 weeks after my request and many many phone calls I got a copy of statements (just plain and no details or specific marking of original creditors) but no agreement. I spoke to them again and they said they have requested agreement and are still waiting a response. I also received a letter from a dca saying they have put it on hold due to my request and won't chase till I have received relevant paperwork. I know in hindsight I should have really done all this via letters but was panicking and trying to sort quickly. If they can't find the agreement do I have a chance if setting this aside? Should I send a letter stating about the phone calls and again requesting the agreement, giving them a time limit? How can I prove I haven't received any paperwork? What are my options? Sorry for being long winded and hope someone can help. many thanks.

Hi everyone I would like your views on this as I am not sure where I stand so here goes, I had a phone contract with Vodafone and I was coming to the end of my contract I received a letter of which I will add to this post and it states outstanding balance £90.66 and potential termination fee £13.20 and I quote from the letter "We need to make you aware that if you do not pay the outstanding balance within 7 days, we will end your agreement and no longer provide the services to you. You would still need to pay the line rental the line rental for the minimum period-the potential amount is shown above. Outstanding balance :£90.66 Potential termination fee:£13.20 I never paid the bill and have received a debt collection letter from FREDRICKSON asking for £197.35 as outstanding balance I have got 14 days to pay or start legal action with additional costs: Outstanding Balance to pay now:197.35 Court Fees: £25.00 Solicitor costs :£50.00 New Balance if proceedings are issued :£272.35 On top of all this, I belong to the Experian Credit Expert site and have looked at my file on Vodafone of which was updated yesterday (21/9/2014) as defaulted and owing £157.00 which is a completely different figure. my question is what should I do, I am going to add this Vodafone letter and any feedback will be much appreciated i feel the bill should be no more than £90.66 + £13.20 = £103.86 Please help thanks Paul
  6. Hey guys, really was unsure if I was going to bother posting this, but here goes. I purchased a used iPhone 5 from a Game high street store last July 2013. It is obviously now out of the 1 year warranty they give you. I purchased the phone for the sum of £380 & I was sold the phone as "unlocked". I had been using the phone since July 13, initially with a "giffgaff" simcard (I believe is run on the o2 network, but for the past 4 months or so, I have used a "3" sim card in it. This week i decided to sell the phone & I selected "Erase all content and settings" on the phone prior to its sale. To save myself any hassle, I took the phone to a local highstreet store to sell, but they informed me the phone is locked to Vodafone. I can now confirm the phone will only activate with a Vodafone sim card & will now not accept my 3 sim I had been using in it for the previous 4 months. This has really annoyed me as I paid GAME a premium for an unlocked phone, which turns out to be locked to Vodafone after I had reset it back to factory before selling. I contacted my local game store (not where I purchased it) who were totally dismissive as it was outside the 12 months warranty. Manager didnt come near me but also wiped her hands clean. I phoned the GAME helpline in London & was told "well, youve been using a 3 sim card in it & it was unlocked when you bought it, so contact Apple,, its outside the 12 months warranty. Youve been using it for 14 months havent you?" This is the first time I have had cause to "erase all content and settings" which has bought this problem to light. Personally I belive I have been missold a phone by GAME, I cant belive how dismissive they have been. Should i just put this one down to experience, I don't want to as I feel ripped off, but I believe it will be extremely difficult to go anywhere with. Has anyone any thoughts?

  8. Could do with some URGENT advice please. I received a court claim from Lowell's in January, & completed acknowledgement of service as requested. At the time, I stated that I would defend in full. Deadline being tomorrow 28th Feb. Unfortunately, family bereavement & my own health (which tend to affect concentration & memory) have led to me lose track of time-scale, & unable to prepare any defence. This claim is for an amount outstanding from 2008 on an old catalogue. From the paperwork in my possession, I last made a payment in Sept 2008, with a balance of £333.49. It would appear that with admin charges, and "peace of mind plan" this had escallated to £545.95, by the time Lowell's took ownership in Jan 2013. The amount with court costs now total £718.83. As I'm unable to present any case, I feel my only option now is to come to some payment arrangement. Can anyone advise me on how to proceed with this. A) Do I contact or email the court & say I'm not submitting a defence? B) Do I make contact with the claimant & sort out a payment plan with them? I know that a CCJ will be entered against me, as there isn't any way of paying amount in full. Hope some kind person will advise. Grateful thanks, Leyla
  9. Hi all , I bought a new car on the 25 july. from evanshalshaw I traded in my Ford focus which had a settlement figure of roughly £6400. They gave me £4800 for it and put me on a negative equity loan for the rest. then got a vw polo on Hire purchase. through motonovo finance. Now before i went ahead with anything I explained I cannot afford the first payment with the admin fee on top. as its basically a double monthly payment. the person that was selling me the car said it will be all ok and promised they will contact motonovo and explain this and get the admin fee spread over 12 months. I thought ok and signed all the stuff. but I checked with them and phoned motonovo to ask about this and they said the dealership hasnt done anything of sort and I will be paying the full first payment with the admin fee . So I went to the dealership and they have admitted the salesman gave me the wrong information and basically I will have to pay the full first payment plus admin fee. I then explained Ive had enough and spoke about cancelling it all . which they then replied I cannot. because if I phoned motonovo and withdrew from the finance I would still have to pay the polo by getting money from elsewhere. Where do I stand in this situation . its really stressing me out. thanks
  10. Hello, I had car finance back in 2002 (apprx). I was with Welcome finance and was paying monthly. We fell on hard times and i could no longer afford the amount I was paying. So Welcome got me to sign a new agreement that was over a longer term and a less monthly amount. I've stopped paying it now but it went on for years before it was settled. I no longer have the contract, so I cant see the details of the accounts. I have no idea how to go about claiming ppi? I've had a good look round but I'm just getting more confused. Do I just call up Welcome and ask for my account details? Is there a link for a step by step guide to claiming back? I've had a look round but cant find it. Any help would be appreiated.
  11. I wonder if anyone can help me? It was 20:30 in the evening and dark. I was driving along a side turning and stopped at a T-junction at the end, intending to turn left. I had my headlights on dipped beam. I looked both ways and was clear so I started to pull out. A white Transit van coming along the road I was turning into from my left, pulled out to the centre of the road to straddle a speed bump which was the middle of three across the road. The van was travelling at a speed I would estimate to be 50 mph or more. The speed limit in the road is 30 mph. I had pulled out about 2 feet and stopped to wait for the vehicle to pass as it was straddling the centre white line, was travelling so fast and was half on my side of the road. It went over the speed bump but continued steering to the right, straight at my car. The van hit the front of my car to the right of my nearside headlight, ripping off the bumper, radiator grill, off-side headlight, etc. The driver steered the van to the other side of the road and stopped. The Transit van has damaged on the offside part of the bumper and on the front offside wing. As you can imagine, I was very shaken but, luckily, was not injured in any way. I was lucky that I had not continued to turn because I would have been hit head-on. The driver of the van got out of the driver's seat and said "What was you doing on my side of the road?" I said I was nowhere near her side of the road and was not even near the centre white line. She then said that she did not see me. I said "Why was that because I have my headlights on." She then said she would lose her £500 excess. I said that was her fault. She gave me her name but refused to give me her address and initially also refused to give me her mobile phone number as she said she did not know it. When I suggested she phone my mobile her memory returned and she told me the number. As the van was from a hire company, I wrote down the company's name, address and phone number. I still asked the driver for her address, but she refused to give it and, while I was ringing my wife to bring me a camera to take some pictures, the driver drove off. An off duty police officer, who was walking his dog, also stopped and knocked at one of the nearby houses to borrow a broom and he cleared up the debris from the road. He did not see the accident but could see where my car was positioned, etc. and gave me his badge number in case I needed anything from him. I was nowhere near the other side of the road and was not even halfway across my side. And looking at my damage and the damage on the transit van was it is evident that the van hit me from the left, across the front of my can. I think that because of the speed the driver was driving at she lost control of the van when she went over the speed bump. My insurance company are saying they are accepting 100% liability because the other driver had right of way and I was turning into her road. I am saying she was driving too fast and should not have been on my side of the road. How could she have right of way when she was on tghe wrong side of the road. The photos I provided show me sticking out of the side turning by about two feet and my insurer suggested I could have reversed my car back into the side turning but it is obvious from where the debris is that I hadn't. Can somebody please give me some advice/ Did she have right of way?

  15. Hi Hope some one can help me on this. I sent santandar a CCA request for a credit card. They've responded by saying that they do not hold a signed copy as it was an online application and have sent me terms and conditions. Can i send them the default notice now are they in default? Can they enforce this now as they have no signed agreement. Many many thanks in advance...LLew

Help needed for a newbie i was told a week ago that my job search record was not good enough and she did not believe that what i wrote was true. in other words she called me a liar without saying it. she then said have i signed on the new job match site which i said yes. she then said can i have your login details so i can see what jobs that you have looked at. i then said no to which she replied in that case i am sending your job search record for referral. and you are not getting a new sheet to fill out you can do it online. i then left. today which is the day that i get my JSA payment i find out that no money has gone into my account. is this normal without telling you first. thanks in advance for any help.
  18. hi, called d&g today to book an engineer to look at my servis fridge freezer. i thought it was covered but it appears the plan details are for a zanussi fridge that i have never owned The chap at d&g was very helpful and sorry but alas i am not covered i bought the fridge freezer from my sister approx 10 years ago who had taken out extended warranty on it so contacted the policy holders and transfered the details to me and have continued to pay these up to date. the chap at d&g said the policy was taken out with them in 2007 through comet. but as a say i never bought a fridge from comet. first i realise sometimes these policies are not much good but d&g have just sorted me out with a new dishwasher and cooker (replacements for appliances that i also bought from my sister at the same time) second, yes dopey me should have checked the plan details properly instead of paying £60 odd quid a year for nothing third, i never kept any paperwork for previous years so i have no papertrail to follow and find out what went wrong. i dont think i will get anything back from d&g or from previous policy holders but if anyone has any useful suggestions then please help thank you

  21. Hi, I'm in dispute with my car finance company at present over the amount stated on the agreement. However, in the process of going over the paperwork, I've noticed that the original agreement is missing 3 pages of terms. I am able to prove that I have never been provided with these missing sections as everything was done electronically. On that basis, is it possible that the HP agreement is void? Thanks, 1970
  22. Hi, I recently asked for a S.A.R from Welcome Finance due to receiving a DCA letter asking for way more than I think I owe. Anyway, it came today (bang on the 40 days allowed) and I am sure my original agreement has been doctored! What if anything can I do?? I distinctly remember telling the guy on the phone when I applied that I did NOT want any insurances or P.P.I and he said OK after badgering me for ages. I remember it well because I said to my husband, gosh that took a lot of saying no. Anyway, a photocopy of the agreement has come and it shows my signature and then just below another signature (I think I remember them saying I need to sign both lines but just leave tick boxes clear as they don't apply) Now next to the signature at the bottom, the boxes have been ticked NOT BY ME and the ticks are nothing like I do they are like ticks that a left handed person would do. It has been ticked on yes I wish to purchase accident cover yes I want to purchase accidental death and yes I wish to purchase P.P.I And is added to the agreement at over £1,500 What do I do now and how do I prove that I didn't want them and that I didn't tick them. Strangely, there is no mention in the S.A.R of the phone conversation I had with them telling them I did not want this!!!
  23. Hi I've been out of work for nearly a year, have done supply teaching in that period but very infrequently, 2 or 3 days a month (often less). I've been lucky enough to have secured an interview with Ingeus as an employment advisor, helping the long term unemployed, I've already passed the telephone interview part and so now have face to face interview coming up. I would love this job, I'd be VERY, VERY HAPPY to never see a classroom again!!!! I'm a bit worried about the CRB check though. Last year I received a caution, I'm actually really angry with myself for accepting it, I guess I took the advice of the young solicitor who spoke to me, but wish I'd fought it. I wont go into too much detail but basically I had a sports bag with me when I entered a football ground in England, inside were 4 cans of lager, I was told that I'd committed an offence. To cut a long story short, I've a police caution: POSSESSION OF INTOXICATING LIQUOR WHEN ENTERING A SPORTS GROUND (SPORTING EVENTS CONTROL OF ALCOHOL ETC) ACT 1985. If this wasn't on my CRB I am convinced that I would have a very good chance of getting this job, but pretty much as the last 5 years have gone since qualifying as a teacher it seems this may thwart me. How shall I play this in the interview. I've also got a letter from the solicitor which corroborates my version of events as I type here. Thank you
  24. Please excuse the rant, but I have just come off the telephone from HSBC and I am sooo angry! I just wanted opinions really. We have had two mortgages with HSBC for over 15 years - We have always paid the full amount on the 24th - or next working day, of each month on both mortgages, as this is the date I get paid. However, about this time last year, my husband was made redundant, and we fell into arrears, almost to the point of losing our house -we had not one ounce of assistance from HSBC, apart from being constantly hounded, even though we were making token payments of £100pm (on 24th) on both mortgages. Luckily, just in time my husband got a job (May, this year) and we paid the arrears on 25th May, we were then told we had to make our monthly payment also on 1st June. We made the payments plus £50 extra off each account and have continued to do so on 25th of both June and July. Great you may think, we are paying excess on our mortgages each month and also paying a week early on each account! It would seem not! We continue to get letters each month telling us we are falling behind with our payments - because - we are paying too early and it is coming off the balance - and showing as arrears! Payment due £XXX.XX on 29th July (Sunday) - Payment made, plus £50 on 26th July (Thursday). Arrears letter sent 31st July, arrears letter sent 3 August - plus numerous phone calls - within ONE day of an apparent missed payment!!! I have been spoken to like a child on both of my hour long querys on the telephone, and basically told, if I continue to pay early, I will continue to get arrears letters! (This was after we had spent half an hour discussing the wrong account, on one call!) As I am paid on 24th of each month I asked for my payment date to be brought forward - but they can only push it back which will incur 20.00 extra in daily interest. I feel this is ridiculous! Either I pay my morgage at the correct, exact, amount, on the correct, exact day or I am harrassed - either that or put more money into HSBC's grubby little pocket - which I will not do! It feels that we are being penalised for working hard, to try to ensure that we dont end up in the same situation in the future, and am now in a different catagory having had recent arrears - despite 15 years of paying regularly! Even after all they have done, the banks really do have us over a barrell and I just wondered if you had heard of such rigidity before, and, if so, what your take on the situation is? I am so frustrated and upset and I dont know where else to turn. I have had another letter today requesting full balance payment. Even when in credit, still I cannot get HSBC off my back!

I live in 1 of 4 privately owned flats that all have shared garden and driveway etc. Although my neighbour cuts the grass and trims the trees regularly and claims to love it shes let it go a bit lately so i recently trimmed a tree or two blah blah blah theres not a sniff of a mention of who owns the trees grass weeds in the deeds yet she is now accusing me of vandalising her property as the said now trimmed back tree and weeds apparantly belong to her because she usually does it??? i catch her all the time spying on me in our shared garden and more recently she takes photographs of me gardening clearly without my consent....is this legal?
