  1. There are many reports of debtors being arrested for obstructing a bailiff (Section 68.1 of Section 12 of the Tribunal Courts & Enforcement Act 2007) or more commonly; for removing a car clamp but it is rare to read a report about a debtor being injured during a bailiff visit. This particular press article featured on SCOOP yesterday. The background to the matter is that the debtor (a young mother) had been fined for using a TV without a valid licence. The balance of the court fine was £200. For reasons that are not known, she did not deal with the debt at the Compliance stage (when the fees were just £75) and accordingly, the debt was passed to an enforcement agent. It would seem from the article that bailiffs were attempting to apply a wheel clamp to her vehicle and upon witnessing this, the debtor admitted that she started 'running around' her car 'like a crazy woman in a panic'. Foolishly (in my opinion), she then picked up one half of the wheel clamp and flung it across the garden towards the gate. Following this, a struggle broke out between her and the bailiff and it was later discovered that she had suffered a broken bone in her wrist from the incident. Police are investigating and examining footage from the bailiff's body-worn camera.   2. I have found this forum whilst searching the internet for some advice concerning a shattered shower screen. I went away at the start of August and left my keys with a builder to refit my bathroom. We ordered everything through him. While we were away there was a leak but it seemed to have been repaired. We came back mid August, and there was still a lot to be done and then a fair bit of snagging. It was finally finished and we paid him on Friday just gone. 1 hour after payment, there was an almighty crash and bang. The new shower screen had literally shattered and exploded all over the bathroom. The builder came round and cleared up the mess and said he would be back with a new screen. I was so shocked by the incident that I didn't inspect the bath with him however upon closer inspection, there appears to be over 25 areas of damage in the bath, from gouges to scratches. It's an absolute mess. I let the builder know yesterday but I haven't heard anything from him as yet. I was wondering if anybody could offer advice as to whose responsibility this is? I feel that having spent £5k on a new bathroom that it surely can't be mine but I don't really know what my rights are. Thanks
  3. Hello, on the 12\05\15 i purchased a VAX vacuum cleaner from my local Argos store. I set about cleaning yesterday to find that the brush roller had seized up, the drive belt was starting to melt, there was no suction whatsoever & it made a loud screeching noise when switched on. I took it to the Argos store today with the intention of obtaining a refund, or credit note, as i had decided to buy a more expensive model. I was told i must contact the manufacturer & that they would not refund......basically they did not want to know & the person i spoke to was arrogant & had a nasty habit of talking over my words. Can anyone give advice on how to proceed? Thank you.
  4. Hi, hope somebody can answer this for me. Been driving for nearly 20 years with no fines...until last year, my dad is the registered keeper of my car, he received the letter and sent it back advising my name. Sent it back, paid the fine etc, job done...I thought. 2 months ago I got another, did the same with the letter but didn't hear. The other day my mum rang me and she was fuming, said that she rang the number to find out why nothing has happened and they told her my licence was revoked for failing to send my licence back last year. This was the first I knew of it, I thought points were automatic and didn't receive letters from the DVLA. However what I need to know is, did they have any right to disclose such personal information to my mum? Surely this is a DPA breach? This has caused massive arguments...surely they can't just disclose this info can they???

Hello, I privately rent my house thought a letting agent and told them on their last inspection last month that the lock on our garage was broken and the goods in side were not secure, the garage is not attached to the house but about 30mts from the house. we moved everything we possible could from out there to the house but could not fit in all my sons expensive fishing gear as the rods were too long and a moped (for obvious reasons although it had a lock on ) About 5 month ago we had stuff stolen from our garden, about £1500 worth of profession fishing gear that was soaking wet and had been propped up against our patio doors to dry out, they were there for all of half an hour before being stolen , we have a 6 foot fence and also a gate that locks. so this was why I was anxious the landlord fixed the garage asap. As to if the letting agent passed this on to our landlord I do not know. Am I wrong in thinking that the landlord has a responsibility to repair and make secure the garage ??? I feel he should compensate for our loss from the garage this time......we claimed on insurance for the theft last time as I guess we were responsible for leaving out even though the garden was secure. Any advice is appreciated. I am thinking they will keep coming back so am in the process of looking for another house and I can't sleep well because of the worry and anxiety.
  6. Totally let down by whirlpool... their product quality had fallen beyond expected standard. Bought a microwave from ao.com on 15/10/2013. After 2 days it arrived... and FAIL... won't turn on. (no power, fuse ok) After that got a replacement which on 3/12/2014 stopped heating food (probably faulty magnetron... looked up and the part alone is around £100). Now it won't even switch on. I hope that you agree that £245 appliance should last more than a year... so I mentioned them SOGA. also offered to do an independent examination/repair if they agree to reimburse the cost of it (this one they just ignored) this is what I got on 16th dec: I'm writing to confirm our Manufacturer Liaison Team have contacted Whirlpool and they are unable to offer a free of charge repair as the microwave is now out of it's warranty. They can offer you an additional warranty, there are two options for this, you can pay £14.99 for 12 months and this will cover you for any repairs during this time. Alternatively, you can pay a one off charge of £135.00 and the engineer will come out and repair the appliance for you. for that money I can buy new same size panasonic microwave... feels like a ripoff so I refused that ''generous offer''... next day got this email: I am sorry that you were unhappy with my response. I can understand your disappointment at losing the use of a microwave that is just two months outside of the warranty. We have spoken with Whirlpool again but unfortunately, they are still unwilling to provide a repair free of charge. We are also fully aware of the Sale of Goods Act 1979 and how that applies to this situation. The Sale of Goods Act is designed to protect the retailer as much as it is designed to protect the consumer. However, on this occasion, as a goodwill gesture, we are willing to contribute towards 50% of the call out charge. If you’re happy to go ahead with this, we will contact Whirlpool and arrange for an engineer to repair the appliance. They will charge you for the callout and the repair, at which point you can send us a copy of the invoice. At this stage, we will refund you for half of the callout cost. Please let me know if you are happy to go down this route so that I can get things started with Whirlpool. ..... to sum up: 50% call out charge... still leaves me to pay for labor and parts back to square one? how to proceed? been busy at work so it took a while to get back to this issue
  7. Hi, I have made a bit of a mistake. I have an agreement with BS to pay £5pw I was supposed to pay £5 20/08/14. I broke down out of area so couldn't pay until I got home which was 02:30 (am) 21/08/14) I have emailed then to apologise that my payment is 2 hours late will they now say that the agreement is broken? Even though it doesn't make a difference to them because its out of office hours either way? If I have broken my agreement what happens next? I hate it all of this for a parking ticket and I feel like these people have control of my life. I wont sleep no worrying about this payment being 2 hours late.

I rent a flat and the door to the balcony has never been in operation, I am concerned that it is a fire hazard and I would like an extra exit from the property in case the stair well is out of action for some reason. I have never bothered to ask the landlord about fixing it until now as I was sure he would refuse. Is there any legislation regarding safety regulations in rented property that may help to back me up when I do ask him? I am hoping he will be reasonable and see the fire risk but if he doesn't I would like to have some information to fight my case with. (My flat is in such a position that on the left hand side of the house all the windows open up to a steep drop as it's a first floor flat, but on the right hand side where the balcony is there is a bank and a wall that runs directly under the balcony that you can hop down onto safely in the event of a fire).   9. October 2012 we bought a Logik brand LED TV for £199.99 All was fine until April2014 when the start up failed. NORMALLY there's a red light which comes on and you press either the button on the TV or remote to switch on. The light goes blue and the TV comes on. Now it just stays red and no start up happens. We went to Currys where we bought it and they said they could send it off to their repair centre and have it checked but it would cost us £95 which would be refundable if they find a fault. They also said if we wanted, we could have it checked by an independent engineer and get back to them. Now we thought 18 months is NOT an acceptable time for a TV to last so I emailed their customer services who just said the same. I got some advice from the citizens advice who have a template letter which refers to the Sale of Goods Act. I sent this to Currys head office (registered post) and they have taken two weeks to call us with the same information, plus claiming they do it everyday and people easily have their £95 back. Really, EVERYDAY? Is that really a selling point? We have since purchased a Sony TV (went halves on a special offer in Tesco), so we don't have £95 to spend on a repair. We could get a quote and report from an independent engineer but it's more money, which we don't have. I still have the Logik TV, well packaged and tucked in a cupboard. What I need to know is, is there any point in getting an independent repair? Has anyone done this themselves and been successful in receiving either a refund or exchange from Currys?
  10. Hi, I'm hoping someone could advise. I have been a Vodafone customer for 6yrs and thus far had 3 seperate contracts. The 2 previous contracts I had insurance and up to now thought I had insurance on my current contract. I dropped my IPhone earlier today and now it won't turn on. I rang Vodafone Customer Services and got through to a very abrupt unhelpful CS rep who just told me I had no insurance and they couldn't help and was told to sit tight till September and I could upgrade. I argued the point I've had insurance on all other contracts and I had specifically requested insurance on this phone also, I was paying £42 on this phone when the contract which was sold over the phone by a Vodafone sales person was £35 so i assumed insurance was included (stupid to assume I know) and I have also brought my wife over to this contract and she has her own Iphone WITH insurance which again I specifically requested. I currently pay between £80-£90 pm for both contracts. I feel incredibly let down by Vodafone and feel like being a valued customer is non existent these days. Is there anyway around this? Or am i infact left paying upto £42pm for the next 5 months for nothing?
  11. Hi, I dont know how but my daughter was touching a statue at a restaurant and it came down and it was beheaded. It was made of stone. When I lifted it up it was really very heavy. When I put it back it was a bit wobbly. I told the manager that it doesnt seem to be very stable , there should be a sign of some sort to warn but she dismissed it as saying that its not a hospital they dont need a sign that it wasnt wobbly in the original position. I tried fitting it in few different positions but still didnt feel very stable. I dont understand how a 6 year old girl managed to bring it down, she wasnt even climbing on it. the manager contacted the owner and she asked me to pay £175. I left my details and they took £50 as payment from my card. Then I got an email from her asking for the rest of the money as I asked her what kind of statue was it, if it really was costing her that much to replace. I found a few similar ones for about £125 ext VAT so i thought i might offer her that but she said those are resin ones hers was pure stone and she said similar ones cost around £40-60 but their weight is about 80kg and hers was no way near that weight. She also threatened me that if i dont pay the remaining amount of £125 she shall take legal action and recover more than that. When this incedent happened no one was there. as it was outside. The staff were all inside. The owner was informed by her manager. There didnt seem to be any cctv camera. Some people i talked to said I should have walked away , also it should be covered by her insurance. I was willing to pay her but after that legal threat i really dont want to pay. Have already paid 50 , one of my friends said i should ask her to even return that. Had it fallen on her or the other kids, also had a newborn nearby it would have been a totally different case. I dont know what to do . What can she do, what kind of legal action can she take especially if she doest have any proof, or is it the case that because i already paid £50 and gave her my details does it mean i accept that it was my daughter's mistake. At that time she was shaken and crying and standing next to the statue i assumed it was her fault but i didnt really see myself what happened. Any advice would be appreciated
  12. Hello lovelies, I'm here for some help again, if you wouldn't mind? I'm a regular Arriva bus user because of the location of my house. The bus service on the route is the most unreliable service and more often than not, the bus is late or doesn't turn up. Just to give you an idea, so far this month on the one route I take, the buses have been 89 minutes late! So of course I make a complaint every single time. Each time I put email contact only. They have previously rang my phone number that's been on their system but after telling them email contact only, they've been pretty good about emailing me. They have offered to send me free travel tickets as an apology for the delays, which I have accepted and emailed my address across. I made further complaints via email, and one was made over the phone. During the phone call, I told the man that I wanted a response in email only. I have come home today to find that someone has taken it upon themselves to write and send a letter to my address! As you can imagine, I am absolutely fuming! I've spoken to my sister about this to see if she knew who I could contact as I am not happy at all. She's informed me that it's a breach of data protection. Is that correct? And if so, who do I now contact? I'm not really happy to let this slide, since I've made it clear every time that I do not want to be contacted in any other way.   13. My wife received a fashion catalogue from Afibel Ltd last November promising a luxury coat allegedly worth approx. £80 in return for an order over a certain minimal value. The ordered goods arrived after an extended interval and only after several premium-rate progress enquiry phone calls. However since then we have been fobbed off and downright lied to as to when the coat might be coming. First we had to wait for a claim form (which never came), then we had to write a letter to say we never received the form, then we had to wait for the end of the promotion (31st January), now we are told that they have no idea when the coat will come as it will be despatched by their French parent company. In the meantime we have had a series of catalogues of the Damart / Readers Digest type - each offering a ludicrously expensive free gift in return for a very small order. The most incredible of these came yesterday, offering a Singer Sewing Machine worth £179.99 in return for a modest order. My wife has today posted a letter given them a 14 day ultimatum to deliver the coat, with failure to do so resulting in the seeking of Trading Standards and Media assistance. Have any other forum members had similar problems with this company?
  14. Hi all, I'm really hoping someone can help. I have had a laptop with BH for two years. It was sold to me as refurbished however the store manager who sold me it claimed it was brand new and there was a stock inbalance. Alarm bells should have rung and I should have insisted on a brand new laptop sold to me as a brand new laptop. I didnt have the OSC but I do have DLC. I previously had a problem with the screen and it was sent off under DLC and repaired. Great! Now days after this it began to switch itself off, then it completely stopped working to the point it will not even switch on. I bought a new battery, tried that. No luck. Spoke to BH who told me there was nothing they could do as I don't have OSC! My responsibility, meanwhile I have to continue paying for this item until Jan 2015. I took it myself to see how much it would cost to be repaired and was told it needed a new motherboard. Something that was not cost effective, it would cost in the region of £200-300. I'm just wondering where I stand, is there anything I can do. I have read and read, this forum has been great but I also now realise that because it was sold to me as refurbished, my rights are limited. Can anyone advise me on this? Thank you!
  15. Hi, I have bought Toyota Corolla Verso, 54 plate on last week of Decemeber 2013. Within Feb 2014 first week it broke down. AA recovered it. (Air Con compressor Pulley fallen off and with it Belt came off) Spoken to the seller, he asked me to tow to his Garage, Spent £60 to tow it next day... Seller calls me back saying it's not covered on Warranty., He's looking for second hand replacement kind of.. from then on I was spending on public transport around £40 a week for family and by this weekend it costed me £160... However whichever email I send him to know update he does not reply., from last week he stopped answering my phone calls.. So After spending £2800 on a car and traded in my 51 plate Suzuki Liana (Which was still good runner for £300).. I'm now left with no car no information. Not sure what to do., As seller agreed to repair but making me at his mercy!! I need car desperately. Any suggestions how to approach? Anvesh.
  16. Hi all, a friend has just brought her Iphone 4s for me to look at, her wifi has suddenly stopped working and this is after an IOS update, the wifi is just grayed out. She tells me that the phone was bought from BH and its just over a year old now. I have tried all the so called fixes (no freezer or heating though) just reset networks, restore IOS all with no luck, still grayed out wifi. Can she claim off BH for this repairing since its now a known fault, blown wifi chips and her original purchase was from them. A phone should last a lot longer than 1 year though normal use. Apple have quoted her £160 for a replacement phone. George

Hi all Need some info on emergency etc just got home and the house is freezing, we have two children one who is almost 2, and a new born who is less than 5 weeks old. we havent got a emergency contact number for our letting agent, so looks like we will have to go without heating tonight and hot water which to be honest the house is a old terraced house with a cellar and gets bad at night people have said call our gas supplier however they aint going to be able to help as far as i know they dont cover our boiler. so any ideas? if we have to wait till tomorrow should they get someone out same day due to childrens ages? thanks Steve

My Daughter took her car to Halfords to buy new wiper blades and have them fitted by their staff. when she was driving home shortly afterwards she noticed an hairline crack in the windscreen about 12 inches long my wife went with my daughter to complain to Halfords as the crack was not there before. They spoke to their customer care care centre and said its a stone chip which must have already been there. We spoke to the manager and he said he will try to call in some favours to get it fixed is there any course of action we can take if they cannot resolve this?
  19. im wondering if anyone can help i was renting a property from a letting agent, not long after moving in i lost my job and so started to organise housing benefit, the landlord was not happy with this and kept showing up. The owner of the house is the letting agent sister, they served notice to quit. then i got a message they wanted to do an inspection i said that i would be home and would let her in. 24 hours before the inspection i was called away for a family emergency and told the landlord i would not be there and would like to make another time, to which i received an email from the owner stating she didn't care and wanted me at the house for the inspection, i said this was impossible as i was around 300 miles away and wanted to do another day. The next day the day when the inspection was meant to take place the owner rang me from outside the house and informed me that if i wasnt there in 10 mins she would enter the property using management keys. I told there was no way i could be there and i wanted to have the inspection another day and she said tough basically it was her house and she entered the property she also threatened over the phone that she would change the locks and i said she couldnt do that to which she replied she could it was her house and hung up which then left me wondering that when i returned would i be able to get in. We then got our moving date and 2 weeks before we were due to leave she started emailing me saying that she would be at the property on the 24th december out move out date was the 27th, she said she would be at the property on the 24th and would stay with us to make sure we packed and left and if we had not gone by the 27th she would hire some people to throw all our stuff out of the house. Throughout the tenancy we have had to deal with unexpected visits, calls and nasty emails threats from the owner. Has she broke my rights as a tenant
  20. Hi all. Around 2 weeks ago I recieved a letter from Jacobs bailiffs due to non payment of council tax 2 and my previous property. I called them promptly and we agreed, over the phone a payment plan of £20 a week. This was to be paid by standing order and I would await confirmation of the payments and the necessary info to set up the payments. I didn't receive any such info and tried to call a couple of times to no avail. I have now recieved the following notice. BROKEN ARRANGEMENT AMOUNT DUE £694. you have not maintained your arrangement to pay 20 every 7 days. Your arrangement is therefore cancelled and WILL NOT be reinstated. If full payment is not received in 4 days a bailiff will attend to recover full payment or remove goods. I had an arrangement around half a year ago with items levyd at my old property. That agreement was fully paid and settled. So am I right thinking there is no current levy in place? No bailiff has attended my new home. I intend to pay what I owe yet cannot without the right info and confirmation of our agreement so how have I broken a contract? Help! I'm desperate and really worried now..
  21. Firstly, thank you for reading my post.... Secondly, I'd like to ask everyone who can help for a post on my thread. I sold a car which, few weeks earlier had a new campbelt and a water pump done. The car was driving well and was in constant use. I sold the car as I don't need it anymore due to a job change. A couple who decided to buy it traveled about 120 miles to get it (on a train). They had a test drive, we agreed a sale price and they ended up paying via internet transfer. They left with the car and over an hour later they called to say they cannot drive faster than 40mph, one more hour later they called to say the car broke down completely and there is plenty of smoke coming from underneath the car. As I agreed to keep the insurance until end of the day for them, I rang the breakdown cover who attended to the vehicle, took them to a nearest safe place and left them. I found out from the insurance company that the recovery team suggested a broken campbelt (!?!) and that the car has been left on a petrol station and the couple rushed to the nearest train station to get back home which was 30 miles away! I texted the couple in the morning urging them to ensure they take responsibility for the car as it's their own property now and they should move it asap to not be issued with parking charges etc. They texted back saying they are giving me 2 options - 1 to take the car and give them the money back, 2 to deal with the dad of the girl who is a lawyer. I texted back saying that as far as I'm aware I have fulfilled my legal obligations as a seller and from now on would like to be contacted in writing. So, I have now received two emails asking to provide 'honest description of sale activities' and was given a deadline of 24 hours to do so. Everything I put in the ad was truth, at the moment of sale I was sure the car is in a good state and was absolutely shocked with what happened. I replied to the email with a very brief description of the events from that day stating that my knowledge as to what happened after the buyers drove away in the car is limited and I requested a full explanation as to why they want to take the case to court. I now have to deal with the person who claims to be a lawyer... Although I think I have done nothing wrong, and what happened is just a pure bad luck, I am afraid that there is a chance for the buyer to force me to take the car and give the money back! I actually don't know what happened with the car, I only know what was suggested by the recovery team.... I'd appreciate help and suggested course of actions as I am 100% sure the case will end up in court, with the difference that I don't have a dad - lawyer who can defend me for free...

I bought 2x2 seater sofas from a merchant on ebay 13 months ago...The items were bought new and as a 'buy it now' purchase and the purchase was made through paypal. 13 months on, and in one sofa the leg frame (a metal bar attached to the wooden supporting frame) has snapped away from the supporting frame at the base of the sofa and on the other sofa the leg frame is bending inwards and will soon give way. Do I have any comeback against the seller to either 1) repair the sofa's, 2) replace the sofas or 3) or refund?......Is it worth entering a paypal dispute or is it simply to late.....I spent £400 on these sofas and feel thoroughly hacked off!   24. Hello guys. I need your help on this one. I went to 3 store, and complaint about my device. the camera was not working properly. It is a well known issue for Sony devices, and guys in Sony center know about it. But here is the deal, manager in 3 store wrote down all my complains and issues that i had with the phone, i even showed him exactly what is not working properly! So here i am 2 weeks later. Got my device back. and a beautiful letter saying. "You'll be glad to hear that we've now fixed issue you reported on your phone. this repair work is guaranteed for 90 days over and above any cover provided by the manufacturer. "Our repair centre engineers carried out a software upgrade,to make sure that your mobile is working properly,we ran i through a thorough quality check" But this is all BS. because nothing was fixed. as soon as i turned on the device, a saw that all the issues are still there. So i was waiting for 2 weeks and they have done nothing! They told me to speak with a manager tomorrow, since guy who was in the shop could not explain to me what exactly was doe to fix the phone. Now i really don't want them to say that i need to send the device again. jut because i don't want to wait for another two weeks. This is crazy! Could you guys advise? Thank you!
  25. ]Hi guys. I'm hoping someone can offer me some advice. In April, I bought the brand new Xperia Z. Sony's flagship model of mobile phone. Waterproof, dust proof etc. After just 4 months, the phone developed what I can only describe as a hairline crack across the digitiser (not the actual glass itself), thus rending the phone absolutely useless. After not much searching on Google, I've found a multitude of other users reporting very similar issues with their Xperia Z - all of whom are being quoted upwards of £150 for repairs. There is currently a 16 page thread on the Xperia forums, which Sony have yet to respond in. I'm currently engaged in two battles to try and get this phone replaced; one with the retailer and the other with Sony themselves. So far I have sent the phone back to Sony's authorized workshop and the retailers. Both are informing me that it is user damage and that is not covered by warranty nor SOGA (on the retailers part). I can well understand that they must have people trying it on all the time attempting to get phones replaced but there are absolutely no other indications that this phone has been damaged. There won't be, because it simply hasn't been misused and I'm convinced it's a manufacturing defect. If I could find no further supporting evidence of this, I would be in the mindset of accepting the outcome - but given the numbers of people I've read complaining about similar issues, I'm simply not prepared to accept a repair cost of £150. To muddy the waters further, Sony have agreed to replace the phones, free of charge, of at least 2 people with the same issues and when I queried why Sony had agreed to do that in my most recent email to them, they simply stated they weren't prepared to discuss individual cases. I have a copy of a letter Sony have sent to one customer agreeing to replace their phone, free of charge. I attempted to upload but it just presents a small thumbnail but if anyone need's it, please let me know. To be quite honest, I feel awful trying to the force the issue with the retailer as it simply isn't their fault but I feel I would have more success than attempting to take on Sony. Any help much appreciated.
