  1. ve just registered with Noddle to check my credit file out and couldn't quite believe what I saw. ( I cannot post a picture yet) so I have added a censored version below: Active Securities LTD Address Mark _________ Is A F**king Dead Man Cheshire WE'RE COMING I'm going to hit the "something wrong" button, but surely they shouldn't be able to post stuff like that on there? And just because I''ve got some finacial problems they shouldn't be able to threaten my life. just shows what low life **** were dealing with. Should I report this to the police? if so how?
  2. My mother died in May of last year, she has left a property to me and my sister. There was no will. I was living with my mum and have decided to stay in the property, but I needed a mortgage to pay my sister her half. My mum had taken out a homeowner loan (endowment) which matured after 10 years in September 2014, but the Royal Bank of Scotland have not been in contact with Aviva for the money yet. Now my conveyancing solicitor is telling me he needs the deeds to change the property into my name, but my probate solicitor is telling me he shouldn't need the deeds at all. Which makes me wonder if he's taking me for a fool as I'm a 25 year old single girl with no parents to tell me he's wrong!! The conveyancing solicitor is telling me he can't get hold of the deeds and is according to him sending out letters - which is costing me money. When surely its easier to pick up a phone. Me and my sister have done some ringing round and we found out in the same day the RBS do not have these deeds. There is plenty more to my story, but I was just wondering if any body out there knows if he indeed needs these deeds to transfer to me or not? And if the fact my mum had a homeonwer loan has anything to do with it or not? Thank you Hannah:wink:
  3. Morning all, Just wanted to put this question to people to confirm what is the normal process. What do most motor insurers do when the main policyholder dies part way through a policy year but there are named drivers on the policy. For example, policyholder dies mid January but the policy was not due to end until the end of April. Insurers were informed of the death the day after and stated that they would auto cancel the cover in 30 days and charge for time on cover. They also agreed to issue proof of bonus for the first named driver on the policy. They have now back tracked on the bonus less than a week before the end of the 30 days stating they will only issue bonus to the named driver if the reinsure with them. My understanding from when I worked in the motor insurance industry was that the vast majority of insurers would allow the policy to continue until the renewal date with the named driver bumped up to main driver status and then insist on a new policy being entered into at renewal. Most insurers will also extend full no claims to the named driver at this point. To be honest this is such a major hassle at a difficult time I wish I had not informed the insurers of the main drivers death. What are peoples opinion. The insurers are Elephant on this occasion.   4. Hi, just want to say you guys do an amazing job with all the information and advise you give. To cut a long story short, my parents have a property portfolio of a few properties with Natwest bank on a commercial loan. Unfortunately in 2010 we lost my mum, Natwest have wanted to breakdown the contract due to my mothers death and want to increase the interest rate to a much higher rate almost making it impossible to make repayments. Our previous lawyer has managed to delay the case up until now, we havent signed the new contract as of yet, however natwest are pressurising us even more with threats to default our account. We have kept up with payments as stipulated in the initial contract. we have recently spoken to another solicitor (quite expensive lol) who has drafted two letters one to Natwest and one to Vince Cable MP out lining the situation as natwest have taken advantage of our tragic situation and made a business opportunity out of it. I appologise for some lack of informarion as my father was dealing with this but has been stressed and overwhelmed by the situation. I am trying to sort this out the best way possible and would appreciate any help and advise. I feel natwest have morally done wrong and taken advantage of the tragic loss of my mother.

Hi has any body contacted watch dog on this problem as we just got told by BMW that a noise coming from the engine was a hole in the flexi pipe and needed to repair it ASAP having done this we now a light on the dash board ( engine management light and now they're saying it's the timing chain ?? I have had the car 3 years and is only done 58,000 miles and I drive it 20 miles monday to Friday for work and I have put more in to this car than its worth really I think I was sold a lemon as am for ever putting money in to it I spent over £2000 last year in bills on it and now this I read that all US mini have been recalled why haven't the uk followed ??
  6. Hi, Long story but we moved into a flat in approx 2004 and lived there for 2 years. We paid a £400 deposit. My father in law moved in with us (landlord knew about this) and after 2 months we moved out and the tenancy was signed over to my father in law, with is as guarantors. Our deposit was transferred over to cover my father in laws deposit. So from 2006 until now my father in law lived there. Unfortunately just before Christmas my father in law died unexpectedly. He left no will and had no real money, (a small pension, very little in his bank account). He is not married, he had 2 children my husband and my sister in law. The police have put my husband down as next of kin. My husband found out whilst going through his fathers paperwork, letters regarding his father paying an extra £50 every 2 weeks to the landlord to cover a water bill he had got into debt with. The landlord had agreed pay it for him. The latest letter my husband found was from the landlord saying the water bill had finished and there was one more bill of £100 to pay. When my husband questioned the landlord he said my father in law had kept paying it even after the bill was dealt with. My husband has worked out this would have been £600 over payment. So the landlord has £400 security deposit and £600 Of my father in laws money. The landlord has told us he is just working out the money and the cost of cleaning the flat (it was very dirty, no carpets just laminate flooring everywhere). We have now received a letter from him saying In relation to the deposit and fathers overpayments I can confirm I have most of the information in hand. I need to get the figures accurate so am just awaiting the cost of cleaning. Please do not feel I am being awkward with you,(as I also wish to resolve this quickly as possible) but I will require information on who is the executor of your fathers will, or the licensed administrator of his estate (if he died intestate). This may well be yourself, a family member, or a nominated person but we are only permitted to discuss this with that person. As any monies must go to your fathers estate. Please supply this at your convenience so the matter can be resolved. Regards Xxxxx What do we have to do, to sort this. We agree there needs to be cleaning but now he's asking for a licensed administrator. I've tried looking this up and am unsure whether you have to pay for this. Do we need to go to a solicitor or does my husband write back and say there is none as next of kin all monied should come back to him? It's not a huge amount but it is what will help with the funeral costs. We not after the money for ourselves just for the funeral costs. Any advice would be most appreciated. Thanks
  7. A friend of mine passed away in September, the day after (23.09.14.) the DWP I.B. ESA and PIP offices were made aware of his death. A payment for PIP was made into his bank account on 26.09.14. and ESA on 30.09.14. Now the DWP are asking for the money to be returned. Is this money recoverable as they were informed of his death prior to them releasing the payments? Any advice would be grateful. Thanks, Joe
  8. Good evening, My auntie used to own a timeshare with Sunny Coast Malta and died over 4 years ago. Since then her sister (my auntie) and my dad have been receiving debt collection letters for the annual maintenance fees for the timeshare. They were not aware that the timeshare would become their responsibility in the event of her death and have not signed anything in respect to the ongoing fees or use of the timeshare. Since her death they have been ignoring the charges. Just recently they have now started to receive letters from Network Credit Services threatening further debt collection. Please could anyone advise what steps they should now be taking? Should they just continue to ignore? Any advice would be fantastic as it is getting to a point where my auntie is starting to feel ill with it all. Many thanks in anticipation
  9. My mother passed away a few days ago. She was a protected tenant in a large housing association / housing trust. An officer of the trust has informed me that she was in rent arrears prior to her death, and that until the flat is cleared rent will continue to be charged. She had been living in the property (and another property in the same HA) from the early 70's. She was the sole tenant, there was no-one else living with her & no-one stands to continue the tenancy. She was a hoarder therefore it will take some time to clear her rubbish & belongings (little of value). She had very little of value, and i've found recent credit card statements indicating she was in thousands of pounds of credit card debt. There may be other debts. She was in receipt of pension credit & housing benefit. The rent included heating & hot water, therefore the HB would not have included that, so the HB was not for the full amount. There may be other HB deductions. I am her next of kin (sole child). My questions are : 1) is the HA right to claim a) rent arrears prior to her death b) to charge rent while the flat is unoccupied but being cleared of her belongings after her death ? given the amount of stuff she has hoarded, this will probably take a month or so. they have verbally offered to allow 'approximately two months' if needed. 2) re the credit cards she owes money to (the one i saw was ' m&s credit'). and other loans she may have. What happens following someone's death? I suspect her estate will have very little value. Do the CC companies claim it from the estate, chase the next of kin for the debts owed ? or are they written off ? any help appreciated i have never been in this situation before.

Hi, really sorry but i don't really know where to turn at the moment, i have received a letter today from local compliance service/ part of the job centre to attend an interview to discuss change in 'circumstances', however, i'm not aware that there are any? i sent off an application for maternity grant, signed by my midwife last week, and this is the letter i have recieved, i have googled it because it sounded serious and benefit fraud comes up or that someone has reported you? i really do not understand any of this and i'm a little worried and confused i may be doing something wrong? my current situation.. i'm 20 years old, i'm 34 weeks pregnant, i finished my nursing course in june to go onto university but now with a baby i have had to defer the year, i have a boyfriend but he's always lived with his mum, and since september of last year i was homeless, until november when i moved in with a 'host provider' which is someone who rents a room (social services organised) which i claimed housing benefit with, i moved to a different host provider in february and then left to live in supervised supported housing until june. i found out i was pregnant in the middle of april (i have been pregnant since feb) despite being on the contraceptive pill (because i have my future to look forward to and had only been with my boyfriend since christmas/new year so did not want a baby), i found out i was pregnant. i did not want to throw myself into living with someone i had been with a few short months as i have already been unsettled and unstable as it is, he lives with his mum, i live alone, he comes to stop once or twice a week, but does come after work some weeks, stops over if i'm ill (pregnancy related) i go to stop at his mums some days or they all come for tea or i go to theirs for tea, we don't see each other a lot because he works but i provide for myself, i've never taken a penny from him until i know myself that i'm in a good position to be stable enough to live with someone and rely on someone (ie when i go to university) it sounds horrible to say i didnt plan to have a baby but it really could not be helped, i wanted to wait until i was registered as a nurse with an income to support children should i want them, but this has happened and i have struggled to come to terms with it but i just couldn't get rid of a baby it just wasn't the right time so this is my only choice really, should my boyfriend not be staying over? or not coming to my house? i know its both our fault but like i said i don't want to rely on someone and then everything be thrown upside down should we decide not be together some months down the line with a baby to worry about. sorry for such a long post, please if you have any advice or insight please share, thanks

  12. hi . my father in law died suddenly last week ..and going through all his paperwork we found he owed over 15k to various things provident. shopacheck various mobile phone companies virgin media ... gas and electricity . . when we phoned electricity company to say he had died they said we were liable for the debt .. is this true ? i always presumed to debt died with the person . .. bad enough we have to pay for his funeral let alone all this any advice will be helpful
  13. Hi, My father-in-law received an overpayment on his private pension just before he died last year. Unfortunately he left nothing in his estate (apart from about £6k of debt). Now the pension company is demanding repayment of the overpayment from his widow, who was part of his scheme. I realise that a wife (or anyone else for that matter) is not responsible for her husbands debts when they are solely in his name. However, as she is receiving part of the pension, they are demanding that the overpayment be taken from her pension payments. I`m a bit stuck, as the pension is "sort of" linked between them but as far as I can see she shouldn`t be penalised, as the overpayment went into the black hole of his debts when he died. As you can imagine, my mother-in-laws finances aren`t brilliant either so, although it`s only about £100, it`s going to be a bit of a knock. Are they able to demand this or are they just trying it on in the hope that she accepts the debt? Any advice gratefully received. Thanks, Paul

  16. On Monday, something happened in the House of Commons that should cause electors to wonder what parliament is for. The motion before the house was that “a commission of inquiry be established to investigate the impact of the government’s welfare reforms on the incidence of poverty”. At the vote the government was defeated by 125 votes to two. The result: nothing at all – it wasn’t reported and the government is ignoring it. http://www.michaelmeacher.info/weblo...of-parliament/ So we have what is virtually a Conservative led coalition dictatorship, accountable to no one including the members of it's own house. A government that thinks nothing of retrospectively changing legislation to suit it's own agenda. Quite Mr Meacher, unfortunately the public are only too willing to have the wool pulled over their eyes by this unelected government who's actions have no democratic mandate at all.
  17. On Sunday afternoon, a very good friend lost his wife. (I only knew her slightly, so am upset for my friend and his children). She was 27, and they have 8 children from 13 down to one year. She felt ill in August 2013, with swollen neck glands and extremely sore throat. The GP told her she had a throat infection and would be fine in a week. No anti-biotics. In September she went back as she was worse. Told the same. She then had a period of feeling slightly better. Come November, bad again, back to the GP, still no help. She got through Xmas somehow, seemed to pick up slightly again, although this was probably the whole Xmas thing with the children that cheered her. Bad again, and now whole head swelling up, so hubbie took her straight to hospital. Diagnosed with cancer (not sure but believed to be a Hodgekins type thing in the lymph nodes?) and given a week to live. End of story, charming. Children had to be told last night and I'm sure you can imagine that. Now, I know the poor man is in complete shock, disbelief and disarray and that right this minute is not the time to be thinking about legal action, and this I have told him. But, when he is on some sort of keel again (I doubt if it will ever be an even one again) he wishes to pursue this if for no other reason than discovering what the hell went wrong here. So, can anyone point me in the direction of anything I can read up about on this sort of thing, where to get medical records, info etc, so that when the question arises in the future, I can point him in the right direction? Or even, just where does one start? Many thanks to you all.
  18. i so need some help and the internet is a minefield and just giving me headache i wondered if you could advise My husband died 30 aug 2013 very suddenly had heart disease and didnt know aged 44 we have 3 children 20 18 and 6 the older two not being biologically his my husband had got hiself into trouble before dying with money i didnt know he had cancelled life insurance house insurance everything in a effort to pay bills the mortgage is solely in his name and my husband had also ( not known to me messed with my credit rating too ) his bank the halifax gave me a little break after he died to allow me to pay for funeral ( did NOT advise ) this would incrue charges so mortgage would go into arrears now they wont change property into my name due to these arrears 2300 worth i need house in my name as i cant afford the mortgage as it stands mortgage 69k value 87k and term while my husband had it 18 yrs all i want is it extending to 30 yrs to bring the payments down so we dont loose our family home i moved in here with my husband in 1998 and have paid through i just didnt go on mortgage as it was his mums old council house and the mortgage at first was him and his mum ( for the disc) and then a few years later he remortgaged and put it solely into his name what can i do anything ???
  19. Hi all, after any experiences, advice etc. My mum suddenly passed away last week leaving my dad on his own. She left a will - making my dad executor. There was no insurances, pensions, savings just a mortgage - converted to tenancy in common a few years back. Looking at the debts there are 3 cards solely in my mum's name. M&S £5k, Nationwide £7k, Band of Scotland £7k - none were covered by any insurances. My dad is retired, 71 years old on the state pension. It was my mum who was a few years younger who provided most of the finances. After a hectic week its down to dealing with the debts. What I need to know is how do I go about proving to the companies concerned there is no estate? My dad has written a letter to each company with a certified copy of the death cert and a copy of the will showing him as executor. I can't see the company's accepting this and wanting payment - but as the debts are solely in my mums name and no estate how do we go about showing this to the companies concerned. Any advice greatfully received. Many thanks

  21. Hey I hope somebody can provide some advice, I am posting here on behalf of my farther who sadly lost his brother around a month ago. He was in a care home for the last 23 years of his life, he was severely mentally disabled and was unable to look after himself or any of his own affairs, my father let the care home manage his finances, my farther only needed to sign when something major was needed to be bought (eg specially adapted bed) but other than that everything seemed to be fine, around 12 months ago the care home manager showed my farther a copy of the statement of account which had around £10,000 but they needed him to sign to buy some things which he did. My father made a phone call to the head office to check the status of the funeral payment as the funeral director advised it had still not been paid. They advised they are paying it today but after that there will be around £700 left because there has been a benefit over payment which until now nobody had mentioned to my farther until now. The over payment has been taken back in full since my uncles death just looking for some advice on what we can do and who to contact about this as it seems confusing that nobody mentioned a word of this until now. Thanks
  22. I am an executor of a late friend's estate, after her death, I found a written note stating that she owed Cash Choice £450. I now regret it but I went on line, found a number for Cash Choice acting as UK Lenders Advice, and told them that she had died and sent a copy of her death certificate. That was over a year ago and I have not heard from them. Should I contact them if they have not contacted me? Does the fact that they are now called UK Lenders Advice mean that debts owed to Cash Choice UK are no longer outstanding ( the web page doesn't work)?. They have exorbitant interest rate charges fees I am worried that if I contact them to pay off the borrowed amount that they will chase me for the interest. If I don't contact them, I fear that as they have my details that they will chase me one day. I don't what she agreed to when she borrowed the money; I assume that it was all done over the phone or via the internet. Does anyone have any experience of similar circumstances?

My husband has recently died leaving a large amount of unsecured credit card/loans debt.......we have a joint mortgage on a joint property.I am sorting out affairs and I personally have a ccj in my name secured on property.I am taking over the mortgage payments and am in process of getting my husbands debts written off as he had no sole asset over £5000...........today I am told that because I have a ccj on the property that effectively cancells the tenancy of the motgage so thereby releasing 50 % of the property into an assett for my husbands estate..................I have read the landregistrey papers etc for ccj and there is no mention of this and also have spoken to mortgage provider who are also unaware......help needed please ......there is no money and I am on a dmp ..........

  25. Hi, Just a quick question. Is it legal for a company to continue to charge interest on a secured loan after the person who took it out has died and they have been informed of this? Thanks in advance.
