  1. What type of a phone is it? In general both standard Apple & Android is fairly secure, it starts to become a problem if you unlock the operating system and install apps outside of the intended app store. If it is Android you can get the normal PC type virus checkers that would offer more protection if you feel the need, personally I just watch which sites I go to and don't open suspicious email links or attachments
  2. There may be a fixed base location, but he is still classed as a mobile worker. The company apparently require him to go direct to the first job, not go to the base in the morning. The downside of fighting too hard is that they may insist you are at the base for start time and that travel will be unpaid. It would seem they consider the first 30 mins as an 'average' time to base, but I don't think that is covered in the mobile workers section of the directive, hence fine line!

I would say they are walking a fine line, this is from ACAS Working Time Directive - Mobile workers - September 2015 The European Court of Justice, in a recent case gave the judgement that mobile workers who have no fixed place of work, and spend time travelling from home to the first and last customer should have this time considered as working time. The Court added that because the workers are at the employer's disposal for the time of the journeys, they act under their employer's instructions and cannot use that time freely to pursue their own interest. Acas is assessing the impact of this judgement on workers and employers in Great Britain and will provide more detailed guidance when it is available. Employers and employees should be aware that this may have an impact on breaks if the working day is extended as a result of travelling time. It is also worth checking employment contracts to see what they say about travelling time.
  4. If the OP can find the company who registered the design for them, then they could possibly challenge them as they should have carried out due diligence before arranging the registration to be processed.
  5. That's not quite correct. If you can prove that you have been selling that exact design since May and they registered later then you own the intellectual property of that design, you don't need to register it to own it. Have a read up on intellectual property and go from there. As said eBay are correctly covering themselves, so you would need to get it sorted with the other company first, then update eBay on the outcome.

  7. I would say if it's something that you had no control over or input into then it's not your problem. It sounds like the fixings were not set deep enough and the plaster has dried around them. If they want someone to pay for this, suggest they try whoever plastered the walls I would not expect they would have a leg to stand on trying to charge you for poor quality in the building.
  8. There is a comment on the policy wording that says about the £30, but is very unclear using the words "if you have selected a policy..." It does not clearly say if you have selected one of those! I would expect you have a strong case for cancellation, but they may not play ball, so as suggested get as many screen shots as possible before they fix it.

  10. I can't help much other than to say you are not alone having issues with sofology and both their quality, then service when it does go wrong. Have you tried tweeting it to their accounts? I don't think you will get far, but others will see it there too
  11. If you are contracted for 37.5 hours over 5 days then you need to work 7.5 hours per day. Lunch is normally unpaid. Assuming your lunch is at the "normal" time then there is no requirement to get additional breaks. However if you work on a production line where you leaving for a comfort break would be an issue, the company may give a break to minimise the impact. Those breaks are usually paid. The down side for you is that you have only been there for 9 months, so if you stir things up, you may find you are surplus to requirements!
  12. It does depend upon how it is designed, for example if you manually open the pressure relief valve on a central heating boiler, it will have a tendency to drip from then on. However I think that locking gates effectively closed must be a potential safety issue and I don't believe they could categorically state they only fail open, the last event proves that point. Personally if they were locked closed and I wanted out the bolt cutters would be coming into action. I would give the fire brigade a call (Not 999) and see what they say.
  13. Do you have evidence to confirm they are actually noisier than the old ones, eg dB measurements. It could be an illusion that you are now listening for noise rather than ignoring what was there. Were the old ones double glazed too, are the old and new both PVC?

  16. Have they said he literally was moving for 13 hours, if so they need to look at it more closely. I doubt if the car could hold enough fuel to do that nevermind anything else. Also is the car physically capable of doing 130mph, if it's say a 1l fiesta then no it could not, so again needs challenged.

  18. What are you hoping to get from a smart meter other than having to go into the cellar? They don't do much and if you switch suppliers they don't (for now) transfer.
  19. If you go to land registry, you don't need to know the address. You can describe the location, it takes a little longer to get a reply, but they did it for me

It sounds like there is only one official meter, which would be the one before it was sub divided, they should have had meters installed in each flat when they did the works, but I suspect they have gone for the cheap option. So no electricity company will take you in as it stands. But 55p/kWh that's terrible, mine is about 12p. But as been said if you drive this through I would expect you to be either dropped it get an increase in rent.
  21. It's not really your concern, did you put the milage on the V5 when you returned it?, Also the mot should list it too. In reality the engine may not be the same one that was in the car when you sold it.
  22. Hi Just an update on this and to clarify, The event did run from 08:00 to ~16:00 at which point it was cancelled. However from various reviews it seems to have been chaos across the time it did run, people waiting in a queue for 4 hours to get on a booked time slot car ride etc. Anyway, personally my thoughts were that unlike say a football match which has a set start time / end time this experience was flexible in that you could go anytime between 08:00 and 20:00 and see what you wanted to see, similar to an exhibition. Well that was my argument with Groupon and it worked. I'm happy to say the money arrived back in my account (bank not groupon) yesterday So going from the comments above Groupon have been very fair Thanks all for your comments
  23. Hi I just want a quick sanity check before pushing Groupon further. We purchased tickets to a car event that was due to take place last Saturday. The event is clearly listed on their site as 8AM to 8PM. As it was a bit wet last Saturday we waited until it cleared up a bit and arrived at the location around 6pm to find it was closed and everyone had gone. (Further searches suggest it got cancelled about 4pm) I came back and contacted Groupon to ask for a refund, eventually they came back yesterday and said that we could get Groupon credit. Am I being reasonable pushing to get the full amount credited back onto my card? Thanks

  25. What's more annoying is that my daughter's school was open yesterday (Easter Monday) meaning we could not go away as a family for the Easter break that the rest of us had off work!
