  2. Hi All I've received a letter from Monarch, a debit collection agency, stating that they are pursuing me for a debit of £12 (yes £12!!!) on behalf of an old Talk Talk mobile account I had. I haven't used the mobile number or sim for at least three years. The sim came free when I joined TT for one of their broadband, TV and phone packages about 6 years ago. I contacted Talk Talk in December by phone and they said that the monthly charge I was liable for had been introduced from July 2017. Unfortunately they had my old email address and they sent notification to that old email address about the new proposed charge. I did contact TT when I changed my email address but apparently my TT mobile account was a separate account and they weren't notified. If I had known that I was now going to be charged for something I no longer used, I would have asked them to cancel the account. The person on the phone at TT was not very helpful or sympathetic after I explained the situation and only offered me a reduced payment of £9. I don't feel that I should have to pay this amount especially as I haven't been using the mobile account for three years and I'm considering ignoring it as it's such a small amount. Do I have to worry about this debt or does anybody know if they will take any further action via small claims court? Any help or advice will be gratefully received. Many thanks Bachingmad
  3. Hi. I ordered talk talk broadband contract £20 over 24 months on 16/10/18. The talk talk connection went live on 30/10/18. The broadband was not working at all for hours and so I decided to cancel the contract on 30/10/18 as I was within the 20 days cooling off period. The customer service representative said she will escalate the situation and confirmed no cancellation fees as I was Within cooling off period. I phoned talk talk on 5/11/18 and spoke to the customer service manager Rodney who said no cancellation fee and all charges will be waived. He said account will be closed on 11/11/18. I received letter from talk talk customer service confirming account termination on 11/11/18 also received Jiffy bag for talk talk router return. On 7/11/18 I received email thanking for sticking with talk talk and my account will not be terminated. I received email late in the evening and was unable to contact talk talk until 8.00 next morning. I had very stressful night as I was worried talk talk will not close my account. I phoned talk talk at 8:00 in the morning and the customer rep said I was under contract for 24 months. I said I cancelled on 30/10/18 and gave Rodney ref number. I was put through to manager Megan who said there was Mistake by the back room staff and she said the cancellation will now be on 13/11/18. I received email confirming this. My first bill of £20.93 is due on 12/11/18. Rodney told me I don't have to pay this as it will be waived. Do I pay this first bill of £20.93 in order to get account terminated?

I was sure I had 28days after acknowledging service ( Your acknowledgment of service was received on 09/10/2017 at 08:02:21) but now realise after a panic that it is only 14days Thank you in advance for any advice you have, I am looking now for opther threads to see what I can put as a defence. Sorry Hi I recently received a claim form from the County Court Business Centre in Northampton, by Moriarty Law on behalf of JC International Acquisition for a Talk Talk debt. I have seen a similar problems on here to mine but I am not 100% sure what to do next! Is this the kinda defence I want to be submitting, obviously editing point number 2. I now know that immediately after acknowledging service I SHOULD or done a thing called CPR 31.14 to the solicitors............... so how should I go about approaching this now? 1. The Defendant contends that the particulars of claim are vague and generic in nature. The claimant's’ particulars of claims disclose no legal cause of action as the claimant's statement of case is insufficiently particularised and does not comply or even attempt to comply with CPR part 16.2 The Defendant accordingly sets out its case below and relies on CPR r 16.5 (3) in relation to any particular allegation to which a specific response has not been made. 2.The claim is denied. I am unaware of what debt the claimant refers to.I have requested information pertaining to the claimants claim by way of a CPR 31.14 request sent on 06.10.2017 and wich the claimant received it on the 09.10.2017 The claimant has failed to respond. 3.The claim is denied the Claimant has not served a Notice of Assignment pursuant to the law of property act 1925 and the Claimant is put to strict proof to: (a) show how the Defendant has entered into an agreement; and (b) Show and evidence the nature of any breach;and © show how the Defendant has reached the amount claimed for; and (d) show how the Claimant has the legal right, either under statute or equity to issue a claim; 4.Notwithstanding the above should the alleged amount claimed include an early termination charge(s) amounting to the entire balance of the remaining contract. OFCOM guidance states that any Early Termination Charge that is made up of the entire balance if the remaining contract is unlikely to be fair as it fails to take into account the fact that the provider no longer has to provide and pay for their service. 5. As per Civil Procedureicon Rule 16.5(4), it is expected that the Claimant prove the allegation that the money is owed. 6. On the alternative, as the Claimant is an assignee of a debt, it is denied that the Claimant has the right to lay a claim due to contraventions of Section 136 of the Law of Property Act and Section 82A of the consumer crediticon Act 1974. 7. By reason of the facts and matters set out above, it is denied that the Claimant is entitled to the relief claimed or any relief. Should I send this CPR request off to Moriarty today by Special delivery? CPR Template removed If I dont get a response (which is understable because I have left the matter so late), I will go ahead and just file this as my defense (Send the above CPR 31.14 off tomorrow) and hope for the very best 1. 5. Hi All, Today I have received a letter from Moriarty Law: Our Ref: xxx Acc No: xxxx Amount Due: £185.88 Claim No: xxxxx Original Lender: Talk Talk Limited Dear Mr. X, Following our earlier letters regarding the above outstanding balance we have now issued proceedings in the County Court at Northampton to effect repayment of this debt. You will shortly receive a County Court Claim from Northampton County Court along with an information pack containing details on how to respond. It is still not too late to amicably resolve this matter and therefore please call our offices within 14 days on 02031264544 where our litigation executives will be happy to help and explain the options that are open to you. Yours faithfully, Moriarty Law I believe this "debt" relates to my previous house where I lived with an ex-wife. My ex took out a restraining order against me and so I was effectively kicked out of the house. I contacted Talk Talk who supplied the phone and broadband and told them I was no longer living there and they sent me a change of ownership form. I filled it in, sent it off and thought that was the last of it, and cancelled my direct debit. Until today, when I received the above letter. I have access to my Experian credit report and nothing mentioned on there about it either. After checking my emails, I signed up on 10/11/2012. After checking my bank statements, it seems the last payment I was for £10.11 on 04/07/2013. Will I definitely be getting a claim form or is there a chance they are trying to scare me into paying up?
  6. Hi I received a claim form about an alleged outstanding debt with TalkTalk from 23/03/2012. I have not replied to the form as i only received it today. They claim on the form that i agreed to pay in monthly instalments on the 21/03/2014, This is the first time i have ever heard of JC International and i have defiantly not agreed to any sort of payment plan with them. Is this one last dig for them to try and recover the debt as it is now statute barred. How do i go about fighting this as i really don't want a CCJ on my record.
  7. Hi, I'm really not sure how to fix my problem with Talk Talk and am reaching out to people here in the hope you might have a few ideas. I recently switched to Talk Talk after I was promised a "seamless" switch and no interruption to the broadband service in my house. I specifically asked this question during the sales process and was assured this would be the case. An engineer visited my house 8 days ago and since then the internet hasn't worked. I have repeatedly contacted Talk Talk and they have said (every day for the last 8 days) that the service will be restored in 3 to 5 days. I'm obviously deeply unhappy about this and have asked for my complaint to be escalated. Unfortunately, however, this has just provided them with a get-out-of-jail-free card because now, every time I call, they simply say the issue is being attended to by senior management and they can't interfere in that process. It is impossible (I've tried repeatedly) to be connected to this so-called senior management. I've now discovered that I'm still paying the previous internet provider (PlusNet) even though their service hasn't worked since the Talk Talk engineer visited my house. I honestly have no idea what to do now. I simply can't live without internet access and the last week has seen me camped out in coffee shops and similar. I'm considering buying a MiFi device but really don't want to enter into a long-term contract for something that Talk Talk promised to provide over a week ago. Any ideas will be gratefully received.
  8. I had a 12 month residential Broadband account with Talk Talk several years ago. After the term was up I moved house. Two years later my bank account went overdrawn for the first time ever, triggering a 1/3 strikes warning letter and overdraft charge from my bank. (I do not have an OD agreement). On investigation I discovered Talk Talk had resumed talking money out of my account to the tune of £250. I immediately stopped the direct debit, and have since been deluged with harassing letters and emails from a debt collection agency. What can I do about this? thanks DS

  10. HI My partner has just received a county court claim form in respect of an old Talk Talk account. He terminated his agreement with Talk Talk as he was moving home and no longer required the service. Talk Talk then advised he would be charged for the remainder of his contract. My partner disputed this and has not paid. The initial required payment was around £150 and this has now escalated to £242.70 since Lowell took over in January 2017. The claim form states that *the defendant failed to maintain required payments and the service was terminated* This is incorrect as he contacted Talk Talk to advise he was no longer living at the property and no longer required a service, meaning he terminated the service. The total on the claim form is now £336.05. The last letter he received prior to this was on August 11th 2017 offering a reduced payment by 40%. I would just like some advice about this. Does he need to accept the claim and pay the full amount or is he able to dispute the hefty amount?

You will shortly receive a County Court Claim from Northampton County Court along with an information pack containing details on how to respond. 12. Hi there, today I received a claim form addressed from the county court business centre in Northampton, which has been filed by Moriarty Law on behalf of JC International Acquisition for a debt on behalf of Talk Talk Limited. I have seen a similar problem to mine posted on here but I can't seem to follow it, so I need help step by step to get me through this maze!! The particulars of claim state: THE CLAIMANTS CLAIM IS FOR THE BALANCE DUE UNDER AN AGREEMENT WITH TALK TALK LIMITED DATED 13/10/2011 WHICH WAS ASSIGNED TO THE CLAIMANT ON 26/03/2014 AND NOTICE OF WHICH WAS GIVEN TO THE DEFENDANT ON THE 26/03/2014 AND WHICH IS NOW DUE AND PAYABLE. THE DEFENDANT AGREED TO PAY MONTHLY INSTALMENTS UNDER ACCOUNT NUMBER 100*****43 BUT HAS FAILED TO DO SO. AND THE CLAIMANT CLAIMS THE SUM OF £167.12. THE CLAIMANT ALSO CLAIMS INTEREST THERON PURSUANT TO S.69 COUNTY COURT ACT 1984 LIMITED TO ONE YEAR TO THE DATE HEREOF AT THE RATE OF 8.00% PER ANNUM AMOUNTING TO £13.36. So with the amount claimed being £180.48 the court fee of £25.00 plus Legal representatives costs of £50.00 the total amount is £255.48!! My response to all this, is that I have never agreed to make monthly instalments because I have never spoken to them regarding this debt and have never responded to any letters. At the time I took out this deal with talk talk I was in a very dark place in my life, not long coming out of a rehab and I was not working! After coming to my senses that I could not afford this because I didn't have any money for food, I contacted talk talk to say I wanted to finish which I believed had been stopped. I made payments to them for the amount which I believed I owed to finish the contract, and unplugged the device not to use it again. I also moved address not long after. I have now got my life on track with work and have got what I believe is a good credit score with nothing against me, so to have this rear it's head against me is a bit of a shock! So please please give me advice on how to tackle this and what steps I need to take!! The issue date of the claim was 29/09/2017 and I received it on 04/10/2017 Thanks in advance for any advice you give.

  16. Hello CAG Readers I was looking for friendly advice on what I can do or how to go about my situation. on march 21st 2017 my mum changed provider to TalkTalk, who guaranteed a strong and stable Broadband and phone line Since day 1 we have had a broken package. We were members for 6 months and since having it we had issues with everything. For starters the internet would constantly disconnect for no reason, turning itself off when the phones rang or when it rained (living in the uk meant practically everyday) , not reconnecting for potentially hours. The home phones would cut out mid call, one of the 4 phones never worked since Day 1 and we kept getting phone overuse charges despite having 24/7 international on our packages. The Biggest pain was the inability (Or hatred towards the consumer) of the staff, They lied to us several times, promising engineers, call backs and a new phone set but none ever showed up, I even had to take time off work because engineers were to arrive but the following day when I phoned to complain about the lack of engineers, they stated no engineers were ever planned, the women on the phone didn't know what to do so she went to see a manager, said they were busy and id get one of their infamous call-backs that id come to experience all too much . we must have called every week asking for help but they never even tried to remedy our situation. It reached boiling point after we went 6 out of 12 months without a working package and no support from staff, despite paying them for these services every month , we demanded to speak to a manager After explaining our situation, She said that we were allowed to leave without fear of a exit fee even thought we were only 6/12 months into the contract. Finally some progress... Since then We have moved to virgin (really good so far) and all was well until yesterday TalkTalk Sent us a exit bill for £300+ plus Late fees and extra Bills for House phone calls. I'm under the impression this is fraudulent as my mother agreed to void the contract with no exit fees which was consented by a TalkTalk agent, however the company have went back on this agreement. if possible any advice would be appreciated and if anyone had any similar situation I would not recommend TalkTalk Based on the service I have received however I hope we were an anomaly and not the norm for TalkTalk customers

What was the date of your last payment? circa April may 15, I will have to check Was there a dispute with the original creditor that remains unresolved? not to my knowledge Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management planicon? no Hi there, as the title implies, I have received a claim form from Lowell's, I hope you can give me advice, I have not done anything as yet but realise I need to respond to the claim to avoid a judgement against me. Any advice on how to defend would be fantastic. cheers Dave

  19. I enquired about joining BT in December. While I was still with TT they kept sending me 'don't leave, speak to our loyalty team to see what they can do' messages...so I did. 28 Dec - agreed a new deal 10 Jan - not heard anything so rang them. New deal hasn't been processed because I'd 'missed Jan's payment' (it's DD so it's their fault they didn't take it!) made me pay Jan's bill there on the phone. Couldn't talk about new deal because payment hasn't been processed 12 Jan - they rang me back & agreed new deal. Later that day I received confirmation email of package....it's completely different to what we agreed on the phone!! 14 Jan - they stop my internet & phone. Turns out they've 'processed a cancellation' from the beginning of all this mess.. .even though I stayed with them!!! I've paid Jan's bill for them to cut me off!!!! The new deal I've agreed starts on 26 Jan - and I keep getting letters emails about the package I'm having and they're all different!!!!!

  21. Him All I have recived a county court Paperwork for a debt for my limited company and my self as a named debtor, this is from a company called Talk Uk. I owed them a debt from My company and agreed to an upgrade to pay off the debt which according to them left an outstanding balance of around£200. also I agreed to take on the lines in my own name as long as I got the bills sent to me and I could pay by direct debit. They sent me terms claiming this was the contract, I have spoken to them today and they say that the terms they have sent constitute a contract and that they did not need a signature. I have never had a bill in my name all bills including the final bill including early termination and administration are in the company name . at no time have they ever sent a bill to me personaly , also all the bills that have ever come through from Vodafone have also been in the company name. They are saying that they are going ahead with suing me as well as the company. their admin fee has been charges at 22 * £30 inc vat, and the termination fee is 108 + Vat please not the Vodafone bill is 108 including vat. I have put in a defence saying that the limited company was struck off in june of this year and that I have no copy of a contract with Talk uk in my name and that the terms letter they sent me does not count as a contract in law. Please help
  22. Hi caggers, Please could you advise my next step, absolutely at the end of my tether!! We had TT installed at our new house approximately August 2015 and also had broadband . . . alas there was a crackle on the line from day 1 and after a few days i contacted TT to tell them . . . they sent an open reach engineer out and although his report was credible it didn't resolve the problem and so it continued, month, after month, after month until now when finally they appear to have sorted the problem out!! After paying them approximately 50.00 per month for calls, broadband (which also includes an upgrade which is a joke), and a telephone package to make the various calls cheaper etc (blah, blah, blah) The latest bill they have charged me a 65.00 BT Engineer charge, which of course i'm disputing with them . . . tonight on live chat they've offered me 67.00 compensation, which of course i flatly refused and informed them i'll be sending them a letter before action notice and will let the courts decide on true compensation . . . and here is my request please guys . . . what steps do i need to follow to ensure I get what I want, which is a decent compensation and not a token fob off and the cancellation of the contract as it's left a bitter taste in my mouth and I no longer want them to supply our household . . . thanks in advance guys . . .
  23. Hi there, Looking for some help if possible I was a Virgin National Broadband customer and some time ago they wrote to me to advise that TalkTalk had bought out my contract. I was with Virgin for about 2 years and TalkTalk a year after that. I had never signed a contract with them and effectively out-of-contract with both companies. As I was fed up of the lack of customer service from TalkTalk I cancelled my contract and advised them. I received a letter from a debt collector on their behalf asking for £300+. I was blown away. I phoned TalkTalk who advised it was a cancellation charge and there's nothing they can do. I asked for a copy of my contract to which they refused. I asked for a call back from a manager which never happened and they have advised they have no complaints procedure to resolve any problems and my only option was to pay £300!!! Can anyone help as surely I would be out of contract in spite of having never signed one with TalkTalk in the first place
  24. On 15th February, Talk Talk were informed that a phone line needed repair and the phone line was essential due to the 82 year old who relies on the landline to operate his emergency call system (the pendant around his neck). Response from Talk Talk: This fault will be repaired next day. Members of the customers family repeatedly phoned Talk Talk. Family friends repeatedly phoned Talk Talk. I also repeatedly phoned Talk Talk. Talk Talk gave me false information, or lies, on 4 different occasions as to when the repair will be completed. Talk Talk manager also said that the repair would be completed the following day. Another Talk Talk manager said account had been marked that day to be a welfare / emergency account and that repair would be prioritised. When asked why this had not been prioritised during my earlier phone calls explaining the situation of vulnerable customer, I was told it could not be prioritised because it had not been passed to Openreach. After a few minutes, I asked why had there been a delay of 6 days in passing account to Openreach and same manager said account had been passed to Openreach 6 days earlier. I then reminded manager about her earlier response and the fact that she had contradicted herself, adding herself to the list of lies previously told by her colleagues in this company. There is also a data breach by Talk Talk. On one occasion, I confirmed my name and that I was not the account holder. The Talk Talk employee than asked password which I didn't know. The Talk Talk employee bypassed this password (they have done so on several occasions with myself). One Talk Talk employee made me authorise an Openreach charge in respect of the landline repair. I had to authorise this charge on someone elses account when no permission had been given for me to authorise the charge. Talk Talk has left a vulnerable 82 year old man who relies on his landline for his security, safety and independence. Talk Talk was made aware of the situation and in return have provided nothing other than false expectations or lies as to when repair will be completed. Not only have Talk Talk staff told myself lies, but also 2 managers have also lied to me. I visited here last week with intention of staying for a day, waitiing for phone line to be repaired. The customers family are away on holiday. This is now a new week. I don't want to be here and have no choice. Talk Talk are just telling me lies as to when I can expect a phone repair for this vulnerable person. Apparently, there is nothing Talk Talk can do apart from tell me to wait for a phone call from a manager. My complaint cant be escalated as it is already with the manager. This is one of the 2 managers that had also lied to me which does not give me much hope. I want this phone line repaired ASAP so I can go home. I have had enough of dealing with Talk Talk as all that does is waste my time whilst they spout out their same script, their same apologies, yet do nothing. Any ideas please? This is for an 82 year old man... and for myself, so I can leave here and go to my home. Desperate.
  25. Hi my dad has been with talk talk now since August last year and has had hardly any service, engineer several times nothing done but charged £65 per visit and countless excuses he wants to leave but he's breaking his contract doing so he is 79 yrs old and him and mum are getting fed up with the ordeal and causing a lot of arguments. he's not getting what he is paying for and the customer service people he can hardly understand and appalling is there any way he can leave them without paying for the rest of his no service contract?
