  1. A friend of mine bought a car recently from a very reputable firm After buying the car it broke down within 24 hours, he has then found out that the car was in a previous accident (not recorded) Its a 59 plate Fiesta by the way In fairness the garage took it back and replaced the head gasket, water pumps, cam belts and radiator The problem is the bonnet is still unaligned as well as front bumper slightly off too They said he can pick a replacement car, but how about cancelling everything, can he do that? he took the car on finance through them Thank in advance
  2. Hello Guys, Yesterday I caused a car accident in most stupid way. It was raining, I was in rush to get to work on time and did not estimate correctly distance in between me and car parked behind me. I have stopped and within minute the owner of the car was there. Not a problem, I have given her my details, insurance policy number etc. She said she will get quotation so I can decide if I want to pay for repair in private or if I want to go through insurance. Sounds cool so far. Today at morning she did call me saying that the quote for repair is £260. That is not a high amount but anyway I decided to go through insurances. Called my insurance company, reported accident was done in few minutes and send her text with reference number. So far so good. Few minutes ago I received call from her husband saying “Hey, my wife just told me you want your insurance to pay for the repair. I did call the garage and have been told that if it will go through insurances the price will not be £260 but few ground. Are you sure you don’t want to pay in cash?” Yeah, I am definitely sure I want to go through the insurances. Not a question from now on. But my concern is – since when is the repair more expensive if paid through insurances? Especially from £260 to few ground? Think there is something fishy about it. Now my question is, what should I do now? Suppose few thousands will have worst effect on costs of my insurance than few hundred. Should I let my insurance company know that something is not right or just to let them deal with it? P.s.: It was my first car accident in 10 years I have a driving license. Feel really stupid about it, especially because it was my fault
  3. Hi All I have an unusual problem so i'm going to state all the facts: I called a cab to pick me up from home to take me to my local tube station as i was running late for work. The cab pulled up to a nearby set of traffic lights and was in a line of traffic waiting to turn right (it was a red light). There are two small lanes on the approach to the traffic lights, one to turn left and one for right. the left lane was empty. I asked the driver if I could get out there and cross the road to the station instead (I was in the rear passenger side seat). He said yes and in fact that was more convenient for him. I paid him and then opened the door to get out - I keep running this through my head and i definitely looked first and did not see anything coming - . Just as I was about to step out I looked out of the open door and saw a car coming down the left lane at speed. I leaned back in and tried to pull the door shut but was slightly too late and the other cars wing mirror hit the cabs door edge. He obviously didn't see me either. The was no visible damage to the cab door. the was quite bad scratching to the other drivers mirror. We all pulled over and got out. The cab driver started swearing and looked at the damage to both cars and said 'I've got to get to another job, sort this out between you' jumped in his car and drove away before anyone could stop him. The other driver managed to get his license plate number. I was completely confused about what was supposed to happen the other driver said 'I'm not bothered with you, you're a passenger' and started getting into his car. I stopped him and said 'at least take my number' which he did and drove off. I realised later that didn't have any details or pictures of the damage. The cab driver has since got my number from the cab office and has said 'its your fault but I am willing to pay half the damage and but I don't want this going through my insurance' he was a little arrogant about it saying that he thought he was being more than reasonable to which I replied that I think I am too for being willing to pay the other half as I could have just walked away. He then started threatening me with the small claims court. So the situation stands at this. I have no way of contacting the other driver and I imagine he will just go down the insurance route and there is nothing I can do about it. The cab driver shouldn't have driven away. Can the cab driver actually pursue a case against me? Don't cab drivers have insurance for just this sort of thing? Thoughts welcome please!
  4. Any general advise please. I was involved in an accident whilst coming towards a Keep Clear Box. The road had filtered into 2 lanes and as I arrived at the KCB a 7.5 truck was on the inside lane. I noticed a vehicle suddenly pulling out from a Ford garage and the driver looking left then suddenly pulled out turning right and straight into my offside. He claims that I was in the KCB . He was potentially obscured by the truck but should have shown more caution . My point is I was not in the box and though he claimed I was this meant that I would have had to be hit then decide to reverse backwards with traffic behind me. What I would like to know is even if I was in the box moving forward or stationary am I at all culpable? Without the box he has pulled out of a side entrance and hit my car on the main road. The fact that 2 of his colleagues said they saw me in the KCB when they work in the garage 50 metres away makes little odds to me. Also the garage manager refused to give me the drivers details ; stating that " all my insurance company want to know is that he was a Ford technician". I have asked the Ford Admin Dept to verify if a police report was filed within 24 hours as I did not receive the details. Any views thanks. Also just received a response from Ford Unfortunately I cannot comment on the circumstances as we do not yet have the completed accident report form for our driver. I can advise that the drivers name has been given as J>*** *******r. We are not obliged to give his personal address, as he was an employee driving in the course of his duties the business address is sufficient. All correspondence should be directed to the address below. As I understand it, the vehicle belongs to a customer and therefore once again I cannot give you their personal details. The insurance company is *******. However they will not be aware of the accident until we receive the form and forward it to them. I will chase up the form today. Now I do not have the driver details but they are refusing to give owner details. No mention of police report also.
  5. hi there, i need some help please. My son (student) signed up for membership at DW Gym. After making the first two months payment via DD, he was involved in a car accident, (non-fault and car written off) and we have a medical report to show injuries sustained from the accident. DW Gym have been called and emailed requesting that the membership be cancelled as he is not allowed to go to a gym (he has a sports scholarship so that's been messed up too). How can we get them to cancel the subscription? A third payment was taken from his account only this morning, after a two month period of suspension. HELP!!!! Thanks
  6. My husband suffered an injury at work in October. He has been unable to work since and has recieved SSP which will run out this week.His employers (a public school) have not accepted liability for the accident and to be honest have been quite nasty. He works 3 days a week as a general maintenance man. He read somewhere that he could have holiday pay rather than SSP so he asked for 2 days from last year and 4 days accrued for this year. He received the following reply. Holiday entitlement can be requested at anytime during the holiday year but it is the employers decision when it can be taken. It would be quite unusual to pay holiday entitlement unless the contract has come to an end when we would of course factor in any accrued holiday not taken' Is this true? I cant see any reason for refusing other than making life difficult for us.
  7. hi all, first time on here! how do i find out if my ex is declaring an accident (he had it when using my car) when he is purchasing new insurance at the time i was the policy holder and he was a named driver. every time i purchase insurance i have to declare it and it pushes my premium up even though i was not in the car at the time or driving the car. id like to know if he declares it? hope someone can advise, thank you
  8. Hi, my neighbour has just received a letter requesting that they attend an ATOS medical for ESA at the end of the month. Only 2 weeks ago they attended and were awarded x amount % for industrial accident benefit. Surely they won't have to for another pain staking medical when they've only just had one. Seems pointless but of course now it's a long weekend they can't contact them to find out. Has anyone else had or heard of this before and had to attend a second one in such a short space of time?

I was involved in car accident Tuesday 23.4.13 at 5-40pm , a car drove straight across a give way junction/cross roads, and slammed into my right side, I have suffered concussion and bruising, I do have good insurers, they use Minster Law, who are acting on my behalf to make a claim against the 3rd party, my car was write off, and is being taken away by a company called Copart, who are taking car away today, I believe I am at home recovering at mo, please can you advise what I need to do regards DVLA, I guess they need informing some how that the car has been write off, also any other advice welcome, wrt claims in this situation, I am keeping log of expenses incurred, photos of injuries any other advice welcome from those been in similar situation thanks

Hi,I was recently in a car accident on the way to work..I was going through a roundabout and a car,which was stationary to my left,suddenly pulled out a drove straight into me..The driver admitted responsibilty there and then and I also have 2 witnesses,my passenger and also a lady who approached me and gave me her contact details regarding being a witness.My car was written off in the accident but I have received a hire car until a monetary agreement and payment is made in respect of my car. The car that crashed into me was a hired vehicle,hired from Sixt...I receive a letter from Active Fleet Solutions,who are acting on instructions of AIG(the other drivers insurance company)and also acting on behalf of Sixt:|anyway, I then receive a letter from a Solicitor firm called Brodies who have been instructed by Active Fleet Solutions to pursure a claim against the third party on my behalf..I then receive another letter from a firdm called Accident Advice Helpline Direct Limited,whom I have no idea as to how they got my information,the offer a 'no win no fee' injury claim,but in turn,want 25%+ VAT of claim amount..Now,Ive no idea where this firm got my accident details from,it certainly wasnt from me.. I am now a bit confused as to which path to follow regarding a claim,as far as I am aware I have legal cover with my own insurance company but if I use them to pursue damage will I lose my no claims?they are not protected,also would I need to pay an excess before my insurance company would deal with it.. I was sent home from work around 3 hours after the accident due to headache and neck pain,I contacted my GP the next day and was informed I had whiplash,I have since been off work and have been instructed by my GP now to return until at least the end of the month.. I'm basically just asking for some expert advice on here as to which route to take,all advice would be welcomed

Hello All, My partner, kids and I were in an incident back in June last year whereby a large scrap-metal truck crashed into the back of us coming onto a roundabout as he had not been paying attention. He wrote the car off. Complete mess. His insurers (NFU Mutual) have been unable to contact him as he is ignoring all attempts. My partner and I are both using separate firms of solicitors to claim for personal injury as it was quite a severe incident and resulted in my work terminating due to pain in neck and shoulders. My partners solicitors (Wheelers) and insurance firm (Ageas) have both stated that her case has gone "stale" due to NFU being unable to contact the defendant and gain information. However, my own solicitors (Bird & Lovibond) have received notification from NFU that because they are unable to contact the defendant they cannot defend the claim and have admitted liability. I've emailed a copy of this information to my partners solicitors and insurance company but Ageas is claiming that until NFU make a payment to cover their payout (£1200) they will be unable to release her no claims bonus. Is this right? Is there anything we can do? It seems very unfair. I've just bought us a new car but without NCB the insurance is ridiculously high. Has anyone got any thoughts about what we could do to get the NCB back or reduce insurance costs? Thank you!!

I START MOVING IN FIRST LANE ON ROUNDABOUT WHEN I FINISH MY MOVEMENT AND ROUNDABOUT WAS FINISHED AND THEN SILVER CAR COME FROM NO WHERE AND TRY TO GO IN FIRST LANE BUT IS NOT WAS SPACE FOR HIM BECAUSE IT WAS JUST ONE LANE NOW AND HE HIT ME ON MY DRIVER SIDE I STOP GET OUT FROM MY CAR BUT THAT DRIVER DON'T STOP HE DRIVE OFF FROM ACCIDENT. I FAST GO BACK TO MY CAR AND TRY TO CATCH HIM AND STOP, WHEN I STOP HIM I ASK WHY YOU DRIVE OFF FROM ACCIDENT AND HE START SCREAM ON ME WHAT IS MY FAULT BUT I SAID TO HIM HOW IS MY FAULT IF MY DRIVER SIDE IS DAMAGED AND AFTER THAT HE CHANGED MIND AND START SAYING MY FRIEND WAS WITTINESS AND SEE HOW I WAS IN WRONG LANE. AND AFTER I SAID TO HIM I RING TO POLICE WHEN I GO TO PICK UP PHONE FROM MY CAR HE JUST JUMP IN HIS CAR AND DRIVE OFF. I JUST REMEMBERED CAR NUMBER PLATE WHEN HE WAS DRIVING OFF....."" I report to my insurance about this accident i give number plate number and report to police about this....today i ring to my car insurance ask about this think because now like 3 months i waiting from answer but nobody give me and my car insurance saying what that drive saying i was in second lane and he was in first lane but my driving side is damaged.... Don't know what to do because i so sick of this every time i ring to insurance don't have answers for me Maybe somebody can help me this think or tell what i need to do Thank you for your help
  13. Hi Eveyone, Has anyone successfully reclaimed Barclaycard FAP (Family Accident Plan)? I was pressured into buying the cover, even though I lived with my parents at the time and had no dependants. I gave in after about half an hour and agreed to have the free trial. The lady gave it the "you can cancel it in two months" line, and being young and weak, I agreed to it, really just to get her off the phone. I remember being asked "how would your family cope paying off your debts if you died?" The only debt I had was my Barclaycard, and that only had a limit of £300. And my parents were pretty secure financially anyway so I'm sure could have paid for my funeral. I cannot think of any one else that would have needed financial assistance had I died. In addition to this, I also believe that I received some cover through work anyway at the time. Admittedly it was about 10 years ago, but I don't remember beng asked about any existing medical conditions, or if I had any other cover through work etc. I do remember it being a very pushy persistant phone call. It was also a real nightmare to cancel the policy. Even though it showed on my Barclaycard statements as Barclaycard FAP, they would not let me close my account until I had cancelled the policy directly through the insurer. It would be great to know if anyone else has reclaimed this cover successfully.
  14. Hi people could anyone give me advice on this issue please....... In 2009 my car was parked outside my house no one was in it at the time.I was stood in the front room watching Gillette soccer Saturday as you do when a bus pulled up at the bus stop which was right outside my property,when the bus pulled away it managed to scrape the full length of the drivers side and smash the wing mirror clean off.Any way after speaking with my insurance my car was taken to coach craft in Preston. The next day I was contacted by accident exchanged who said they were organizing my courtesy car, at the time I thought they must have been instructed by my insurance company.......but they were not!!! They get the details of accidents from the garage. I had the use of a Bmw 530 diesel m sport for three weeks which I was assured would be payed for by the bus company. Anyway later on that year we moved house and I did`nt hear anything else about it..........................until the other week that is. There was a knock at my door so I answered it to find an accident exchange employee standing there saying they had been trying to contact me because they needed my authorization to pursue the case further with the bus company, It did cross my mind that they might be trying to get me to pay for it but after reading the document he wanted me to sign very closely I could not find any mention of this so I signed the paper... So tonight when I came home I found a letter from accident exchanged basically saying I owe them £6,789.86 for the hire of the car for three weeks.........WTF!!!!!! They have also sent me photo copies of the documents I signed at the time 4 years ago and very quickly I might add two guys dropped the car off rushed into my house and said theres the keys if you could just sign there,there and there we be on our way no mention of clauses or anything like that.......I know I should have read it thoroughly but I just thought it would all be sorted by the bus company.... HELP!!! Have I got a leg to stand on,can the bus company just refuse to pay the bill...can I refuse to pay it...its extortionate!!!! The sneaky underhanded ******s Kind regards jonni
  15. Hello all, I'd like advice on my situation if you'd be so kind as to indulge me. Forgive me, I've written an awful lot! Last Wednesday (20th Feb), after work I went casually browsing for bargains in TK Maxx, which I do about once a month. At the time I was also distracted with organising an event via my phone. I found some pants I liked the look of so picked them up and off the hangers before making my way over to the shoes. Upon looking through and seeing something I liked, I absent mindedly put the pants in my bag to have my hands free to investigate (which is something I've started doing since the introduction of bag charges in Wales. I then exit via the till, and so negating the need for a bag). On this occasion though, I completely forgot to pay for the items and walked out, whilst still fiddling about on my phone. A security guard followed me out, got my attention and promptly 'arrested' me for shop lifting. My response was utter shock and my first re-action was to get my wallet and the pants out and wander over to the till to pay. The guard said 'It's too late for that love' and escorted me to the rear of the shop whilst in constant communication with other guards (saying he didn't require further assistance) via his wallkie talkie, which was very loud and totally embarrassing in front of the other shoppers. He then sat me down in a back room, accompanied by I'm assuming one of the girls from the till, and asked if I stole those items. I explained that it was an accident and I'd forgotten to pay (which sounded totally stupid as soon as the words came out of my mouth), to which he said 'you need to admit that you've stolen those items or I have to phone the police'. At this point I completely panicked as I've never been in this situation before and my mind flashed to being made redundant for the third time in two years (last one in, first one out policy both times before - the burden of the freshly employed graduates of today), to which I replied 'I guess I have no choice but to admit to this then'. He then asked to see photo ID, which I showed him (driving licence) and asked for my address, telephone number, national security number. I wrote down my address as best I could (I was shaking like a leaf). He then said he didn't believe my story, which I found so belittling; as I'd been watched via CCTV removing pants from hangers and stuffing them into my bag, acting shifty and walking out. He passed me a banning form which I was to sign, and told me to expect an unknown figure regarding civil recovery...'probably twice the value of the pants' (£40) and said 'you'd better not try and come back in as I work in all the shops within the south Wales region and you will be caught and arrested' I had the presence of mind to ask what I was to do regarding items I already owned, which needed refunding; to which he looked at his colleague and didn't know what to say. He eventually passed me the stores number in order for me to arrange a time to come by when I'd be allowed to enter the shop under supervision. I did not have the presence of mind to ask to see aforementioned CCTV footage. Before signing this form, I tried to explain again that this was an accident due to me being distracted with the phone and whilst shopping I'd quite often put items in my bag before taking them out at the till and paying. He agreed that he did see me utilising the phone like I'd said, but at this point; the till girl piped up with 'so you pinch things quite often then?'. Responding to her contempt, I just replied with 'well, when you put it like that, I guess I do'. I'd already realised it was pointless telling the truth to these people, they had already made up their minds. I was still in blind panic and just wanted to get out. Upon further pondering once I had calmed down and had discussed it with close friends, I thought it would be wise to ask to speak to the store manager to explain the situation; as by now I felt terrible for what happened (ultimately, I was totally in the wrong for being stupid and walking out of the shop, therefore stealing), embarrassed that I was banned from all TK Maxx and scared of the prospect of an unknown figured fine. I also thought that if I could speak to them, they would see it was a genuine mistake and accident. I rang on the Friday (22nd) to arrange a time to come in, for my refund and to speak to them. She (Miss X) couldn't tell me when she was working until the Monday. When I rang her again on the Monday (25th), it was agreed that I'd be able to come in and speak with her. I took a friend in with me as so far I've found this to be a horrific ordeal. I explained the situation to Miss X, apologised for my stupid mistake and asked if I could have my ban removed and fine revoked. She appeared to believe me, but said it was outside of her jurisdictional. She spoke to her area manager - who happened to be upstairs, who gave me the number of Miss Y and I was to ring her to see if there was anything she could do. Wednesday (27th) I rang Miss Y, found she didn't answer in the office, rang the number back and was then put through to her mobile. Upon speaking with her, I found she wasn't in work, and so i've arranged to ring her again tomorrow (Friday 01st) after 10am to discuss things further. Upon arriving home this evening (28th), my doorstep has been darkened by a lovely letter (dated the 25th) from RLP, saying I've won a prize, but to claim it I need to pay £147.50...So, after reading a good few other threads on here with similar tales of woe, that seems to be a familiar figure. My current plan is to see what Miss Y says to me tomorrow, if there's a magic wand she can wave; or any way I can take this further and get some sort of written letter from TK Maxx absolving my sins, that I can bat back to RLP and close the case. My question to you... is this a futile gesture? Am I just wasting my time? In reality, I am in a position to pay this sh1tty ' fine' and have it out of my hair; it would just mean that I struggle for a few months for my idiocy. A price I'm willing to pay for my sanity and lack of stress. Anyhoo, your wise words of wisdom are eagerly awaited.
  16. Hi I was just wondering if anyone has had a similar experience. To cut a long story short my parents (both elderly) were involved in a minor car accident a few weeks back, it was snowing, my parents were waiting in traffic and someone went into the back of them. The other party has admitted liability and my parent’s car was repaired and returned. Both my parents are claiming for personal injury through a solicitor, more so my father as the accident aggravated a previous injury. The other day they received a phone call from someone working on behalf of the insurers, he wants to interview both my parents separately regarding the accident. This is not just a couple of quick questions over the phone, he visiting their home to interview them at length, he said it will take upto 3 hours each!! The person who hit them is also being interviewed. Could anyone in the know tell me if this is normal? It seems a bit excessive as they were stationary, someone hit them from behind and that was it. I don’t know how you could string it out into 3 hours of questioning lol
  17. Back in November 2012, a Romanian HGV collided with my car. Basically, as I finished a left hand bend, I was faced with the third party driving in contraflow, and I took evasive action, steering to the right, at which point the other driver was moving to the correct lane, hitting my car on left hand side, leaving it with severe suspension and body damage. Given that they didn't speak any English, I called the police that arrived 30 minutes later, and managed to get their details and of their insurance. Since my policy is only Third Party without legal protection, the onus of recovering uninsured losses rests with me. So on the same day I got in contact with the representatives of the third party's insurers in the UK with supporting evidence of the third party's liability. To this day, I've only had confirmation of third party cover, car inspected on behalf of the third party's representatives and it was deemed a write off and a valuation supplied. It has now been more than 90 days since the accident and there has been no statement of the third party's liability, and my patience is running out. Should I take them to court, and if so how do I do that. Any help is greatly appreciated.
  18. Hello, I've found the website as I just dont know where to turn and any advice is greatly appreciated. Last thursday I drove to a cross roads with traffic lights. It was on red on approached so waiting around 30/40 seconds before the light turned green and carried straight across, when a car hit my from the right hand side. My car did a 180 spin and ended up in the middle of the left hand turning (from where I was approaching facing down the road) and the stationary traffic (2lanes). The first thing I rememeber was a man at the window asking if we are ok and helping us out the car (i had 3 year old daugher with me) He said he was behind me at the lights and saw everything and I had nothing to worry about as the I definatly had gone on green. I was an emotional wreak I obviously had to check and look after my daughter. The police came and took my details, then a kind lady pullled over and took my daughter out the cold to her car whilst paramdics came to check us over. the police came to me and I was breathalised and joked that the other guy wouldnt have the puff to be breathalised. I had no seen nor did she the other party involved. The office also said to me at this point there may be a problem with the lights, as the guy as a witness to say his light was on green also. The police asked for my keys to move the car and advised it was undrivale and I would have to tow it home, but they towed the other guys car becuase he lived a far bit away from the accident. I waited an hour for more info on what to do, but no one came to me, all the time was spent with the other party. My dad came and went over to the police but the police told him to take me home and they would come and see me later. I went to A and E as I was and still am in pain, and to get the little one checked over. By 9pm nothing from the police I had no details at all of witnesses or the guys details no reference number so my dad took me to the police station, where the police officer was fairly rude and couldnt answer any questions He gave me driver details and said hes putting in a report and I'd have to wait. He was also adivsing dvla that this 90 year old man is unfit for driving and assured me with no car he wont be driving again. He said we both have witnesses to say our lights were on green, but he stayed for 15 mons to checked the light sequence and there was no faults with the lights. I contacted my insurance but as I was borrowing the father in laws car I'm only on 3rd party and then phoned his insurance who wont talk to me or advise me on the best route to go ie which repair place to us or loss adjuster that they use. the officer isn't taking my calls and on his answerphone says from tonight he is off on a course until the 1st Novemeber. I have no idea what to do next, I didn't take legal cover on my insurance althought I was fully comp just thought this covered other vehicles too.
  19. my sons car was involved in RTA police taped his car and insurance company was to come out to asses damage 10 days later he recieved call from police asking about car they were told insurance still doing work etc yesterday he returned home to find to tickets on his car. local PC cannot understand why PCSO booked car once let alone twice does anyone have any suggestions as to solving this many thanks

  21. Hi all. I pulled over outside near my son's school this afternoon, and was sat on a single yellow line. A taxi was on the other side of the road waiting to turn and a lorry tried to squeeze through the gap, scraping my driver side wheel arch and ripping off my bumper. He got out and admitted he should have waited for the taxi to finish moving, gave me his details (parcel force lorry) and off he went. I'm worried now that because I was parked on a single yellow, I will be liable. I was pulled right over and there was literally enough room to get a big bus through, but because the taxi was turning in, the gap narrowed and he thought he could get his truck through. Does anyone know the law on this situation?
  22. Hi Guys, First time poster on here, but have been reading the boards for a while. Wondering if anyone can advise which way to go with this: *Employed more than 12yrs by current employer *Had accident at work 13 months ago (employer admitted liability, PI claim in hand) *Unable to work full time since *Paid for all Injury Assessments myself (Employer refused) *Harassed to see the reports (i was happy to if they covered the cost to me) *Told in a meeting in Nov'12 I would be dismissed if I 'didn't get myself right' and would receive a letter the next day ( I had no idea what the meeting was to be about) *Took 5 wks of me asking, to actually receive the letter (which was different to what was mentioned in meeting) *Verbally dismissed 3rd wk in Dec (I asked for this to be confirmed in writing,still waiting!) *Have started me training in another role,less money,to run concurrent with notice period, then 3 months in that position but only as sickness cover, then 'who knows' I'm aware I may have one or two grounds for unfair dismissal. Would appreciate some advice from you guys. Also would a tribunal only hear one claim, or if there are several grounds would they be heard in the same case? Cheers
  23. Hi All, I was travelling on a dual carriageway which has a speed limit of 60mph. The road conditions are wet and it is raining. It has gone past sunrise and visibility is good. As a precaution, I drive between 40-50mph taking these conditions into account being fully aware of braking distances / aqua-planing etc etc. As I go round a bend, some 700 yards up the carriageway I see queing traffic and decide to apply the brakes, not firmly but enough that I will know will bring me to a slow speed safely before I reach the traffic. However, the brake doesn't want to work and I now have my foot glued to the pedal and the pedal to the footwell of the car. I feel the ABS kick in yet it is having very minimal effect and the car is only slowing down as we are travelling slightly uphill and the fact I am no longer accelerating. I keep the brake pressed but to no avail, I hit a staionary car in front (which was unavoidable) at now 10mph whereby his car moves about 2 feet forward. Had he have had his handbrake on, it probably wouldn't have even moved. The 3rd party hasn't hit anyone in front, at the moment it is just between me and him. I get out of the car, pulling up my handbrake and switching on my hazard lights, he kicks off and starts becoming very aggressive. I have called the police at this stage. However, I inspect all round the front of my car and the rear of his where the impact has happened and I think, thank God, not even a scratch. No damage at all, as if the accident never happened. Whilst the other driver is calm, I offer to exchange insurance details. However, another car now ploughs into the rear of me, sending my car forward once again into the front car. This time, not so lucky. Both the front and rear of my car is extensively damaged. The 3rd party (front driver) that I initially hit has had his boot cave in but his vehicle is drivable, and he later proceeds to drive home in it. My car and the car that has gone into the rear of me look like write offs. Police arrive and by this time everyone has realised that there is a diesel spillage further up the road which has caused the accident to happen. The queing traffic I have seen was also due to an accident further up who had skidded on this diesel. The police put it down to a damage only RTC and obtain insurance details and exchange them with all parties. No one is complaining of any injuries and the front car (that I hit initially) has a boot that will need replacing leaves to go on his way. The driver at the rear who has hit me is showing INSURANCE NOT HELD on PNC and produces a motor insurance certificate insurance showing that he is insured. He gives an honest account of what has happened and seems like a decent bloke and signs his account as a true statement in the polices paperwork. However, 48 hours later, this bloke is reported for summons by the police as it has been established that he does not hold any valid insurance covering him for the vehicle he is driving. This is confirmed by my insurace company. Where does that leave me then? I was under the impression that if the insurance speak to the front car and he confirms that there was no damage on the first impact, and damage only occured when the second impact happened, me and him would claim of the guy at the rear. But the guy at the rear is uninsured. I have a fully comp policy witha £400 excess and my car looks like to be a write off. Any advice anyone who has been in a similar situation? I could claim off my own policy but I lose my NCD and have a "fault" claim registered on my name. As for the dual carriageway, it was closed off until Highways Agency could attend to grit the diesel and the reopened some 4 hours later. Thanks
  24. Hi all, I recently had the misfortune of a stray dog jumping in front of my car, whilst the car was at 70 miles per hour, with no room or time, whatsoever, to maneuver to avoid it. The dog appeared from the crash barrier guards, literally about 3 meters in front of the car and jumped onto the path of the car. I looked to my left, there was a car, so I couldn't swerve left, to the right was the crash barrier so couldn't swerve right. I instinctively, slammed on the foot brake, but at 70 mph all you get is the ABS preventing wheel lock and you cannot stop within that distance. The inevitable happened, almighty bang, severe vibration as the dog was dragged under for a few seconds until it managed to pass under the car, I eventually came to stop as I was on emergency brake and looked at the rear view mirror and the dog was dead. Where I was stopped I saw cars swerving dangerously to avoid the dead dog and my car so I moved over onto the left lane then onto the hard shoulder where I stopped. I called the police. My car has serious damage, broken left head lamp/indicator unit, damaged bumper, leaking radiator, broken, hence, leaking power steering cooler, damaged aircon condenser(aircon radiator) and bent frame behind the bumper and registration plate damaged. I am without a car now as I managed to drive it home but now all power steering fluid and coolant has leaked and radiator fans won't turn as they are jammed against the radiator. The police managed to trace the dog's owner as the dog was chipped and the police gave me the dog's pet insurance details - direct line pet insurance. The police said I was lucky as it could have been worse and it was good I didn't swerve as that would caused a very bad accident on the motorway. Now, I called direct line pet insurance a few days ago to claim for the damage on my car and they are telling me that I cannot talk to them directly because I am not their customer, should they do that? They are saying that I should either, contact the dog's owner so that the dog's owner contacts them or claim from my insurance so that my insurance claims from them. The dog's owner is liable here as the dog shouldn't have been running astray on the motorway and I don't want to claim from my insurance as it is not my fault and if I do I will have to pay £600 excess. What should I do? Is direct line's pet insurance division trying to be difficult so that they don't pay?
  25. Hi, sorry if this is in the wrong forum but any advice welcomed. Here is the issue, a car with 20k finance goes missing after a company enters administration. The finance company utilises a trace company to locate, which they sucessfully do. They find the car imobile, abandoned in a back street garage after a severe accident. The vehicle is clearly a total loss. Does anyone know what the legal obligations that the finance company has to comply with? i.e. safe disposal transfer of ownership for salvage Assessment of condition Or is it that they can dispose of how they see fit. I thought there where laws about safe disposal of accident damaged vehicles Does anyone know? Thanks
