I think it's always been a tick box copy & paste exercise , put in place to deter, delay and cause hardship -

https://www.gov.uk/access-to-work/eligibility Who is going to work for even less than what pittance is paid in benefits? If worked full time 5-6 days a week the cost of taxi's would be probative , and depending on where the workplace was could mean someone is out of pocket costing them to go to work, IBS would love that -

A lot of smaller companies would simply not employ someone who has such limitations , because their building maybe too small, and who is going to pay the employer to make said adaptations , ? then there is what if they don't own the property a landlord may prevent them making structural changes , being in a wheelchair is going to seriously limit a persons ability to find work as well as the type of work they are able or more importantly are happy to do -

Yes it's a health and Safety rule that if you are unable to negotiate stairs then you can't be expected to attend on an upper floor, as the lifts will be switched off in the event of a fire, But the likes of atos and maximus will still give appointments at places were their located on above ground level be that 1st or 2nd floors, or below ground level, (these will usually have ramps) It's then up to the their intended victim to re arrange the appointment to a different location that is ground floor or is disabled friendly adapted -

A reply from an on the ball case worker ,But whilst it's all very well a wheelchair being stored at this fictitious work place ,it is of no use to the claimant when they are at home, or to enable them to commute from home to the workplace ,or do our brain dead DWP not consider this? they apparently used this case law http://www.osscsc.gov.uk/Aspx/view.aspx?id=4245 -
DWP - 0345 6088545 - Long Times Holding - Do They Ever Answer?
tommy456 replied to tommy456's topic in Benefits and HMRC
Well they have managed to out do themselves not only do they rarely answer the phone within a reasonable time-scale, but when they do answer their IT system isn't working , the DWP is broken, and i haven't been paid as i should have been So it was a pointless exercise taking the fit note to the local job centre , it would of been easier and i would have saved money on the bus fares as well they have had my fit note for over 1 week how can this not be on the system? useless shower not fit for purpose, -
When does the fit not expire, and is UV being paid? If not they need a new fit note sending in , also they would be best checking with DWP to see if they have been transferred to ESA as i think the limit for sickness on JSA is 13weeks AKA extended period of sickness

DWP - 0345 6088545 - Long Times Holding - Do They Ever Answer?
tommy456 replied to tommy456's topic in Benefits and HMRC
I was only trying to check to see if the fit note that handed in to the local JC to be scanned/emailed to ESA had been received and was on the system, So i know if i'm going to be paid on Friday or not, Though i may as well just wait and see now, good job it wasn't more important eh? Not sure about a cheat code, but the voice thing seems to be hit and miss, in that if i re dial it isn't there , also the announcement at the beginning re: referendum , Do some people really believe that the benefits would change, because vote leave won,? It's a further delay imo extending the recorded bs longer than needed -

Rang back computer servers still down, wont be online till tomorrow , they should return back to the old method , ring your local jc who used to deal with claims -
Page 54 i see they are still using mystic meg's crystal ball, to imagine that everyone they question is in peak health

DWP - 0345 6088545 - Long Times Holding - Do They Ever Answer?
tommy456 replied to tommy456's topic in Benefits and HMRC
Just rang again and someone answered within 10mins, But their computer systems are down so can't access my records, asked to ring back later(when they don't answer) I'm also not happy about the waste of over 1min every time it uses the voice recognition to tell them why you are ringing (that doesn't work very well) having a choice of buttons is quicker and not as expensive -

ESA Can't find who to complain to about the call centre , only the jc ect, and guess which number they list, you couldn't make it up you really couldn't they must be doing half days or something waited from 15:50 till around 16:25 today they are a joke , the older system was better and i would bet more efficient local JC numbers who sorted out claims Local MP's around here are a bigger waste of time, even the local Limp Dumb MP voted for the benefit cuts Even though they apparently are said to work for us, i think someone got that bit wrong -
Yesterday and again today i have tried to ring these people spent over 1hr on hold listening to that hideous music on repeat, and god knows only how much it has cost me for the privilege why isnt their number a 0800 free phone number if they can't be bothered to answer the phone? or they should have a system where you don't get put on hold being charged for nothing for unreasonable amount of time, who do we complain to?

You should be able to claim hardship payments from the DWP for the period of the sanction, and if you don't agree with being sanctioned you can request a Mandatory reconsideration (MR) supplying any further evidence and why you feel that being sanctioned is wrong, the rules are 2 periods of sickness in any 12mths period, the 12mths period would start from the previous sickness period , About the work programme provider informing the DWP i would be surprised if them informing the DWP wasn't normal practice TBH

I have been doing this on and off for the IBS issue, i think the letter from my GP although helpful will be more helpful for my pending esa appeal , as the criteria is different for pip But i may be able to do a new claim for pip with a new or worsening of an existing condition , I wasn't expecting to get an award really, at the most it would of been standard mobility It will be interesting to see their reasoning , to see if they still believed atos on the distance from station to assessment centre and not my version, in which case that would be an error of fact , Though the medical member on the panel was the same member that caused an error in law at a previous ESA tribunal , I bet they are getting sick of seeing me,lol well I'm going nowhere, and will keep on coming back But my mobility problems are starting to impact my general health , as i have gained around 4-6 stone in weight which has in turn cause a significant increase in my BP at the gp's surgery the other week it was stage2 160/104 so gp requested full blood count came back within normal ranges , had 24hr bp monitoring and there were some worrying results that i saw, but good normal results when lying down on the couch watching tv , But exercising is going to be difficult and painful , swimming was suggested but i'm no swimmer i couldn't manage half a length of a pool never mind several, the last time my weight was impacting my bp i reversed the effects by diet, and being referred to a supervised fitness course at a gym for 6 weeks, as well as walking everywhere (before my knee started locking up)

A Having problems getting ESA85 Statement from recent WCA
tommy456 replied to tommy456's topic in Benefits and HMRC
First time i have heard of this happening without claimants having to initiate the process , I only found out Wednesday that my JSA claim had been closed from the beginning of the month after phoning them to check to see if they had the notification from HMCTS and was on their systems, so i could close the JSA claim and then restart my ESA until the tribunal hearing , i took my fit note in to the job centre and got them to scan/email it to ESA? i can be paid next week, there maybe no break in payment again, which is good, ( ESA>>JSA no break in payment only a delay due to a different pay day) but if the reverse JSA>>ESA goes smoothly I'll get my next payment early or back how it would of been if they removed the useless MR process , nice to see them getting their act together, though I'm not sure what triggered the cease of JSA , unless the work coach at the jc had something to do with it as she knew that i intended to re start claiming esa asap I can recall the last time i had to claim JSA what a nightmare that was iirc some 4weeks without a payment , had to declare no income to the council as well , and had my landlord on my case because they had stopped rent payment ,- 389 replies

Well had the PIP tribunal hearing the other day and as i anticipated i lost 0 points, awaiting the statement or reasons to see why they agreed with ATOS and DWP My Cab adviser thinks it maybe down to not having when my knee affects me written down in a diary to help prove that it affects my mobility most of the time, as he thinks that will be the reason for their decision

ESA - Lost Tribunal - Upper Tribunal Awarded...UT Postponed!!!!
tommy456 replied to Max1968's topic in Benefits and HMRC
According to the latest stats from the DWP it's down to 11% of decisions that are overturned at MR , it was 40% when MR first was introduced , So it does appear that those who were sceptical were right in that the MR was no more than a delaying tactic by the DWP As for the DWP telling DR's that further fit notes: I have had one GP obey them, most don't and if you need a fit note for the 13weeks EPS for instance they will write one out .- 395 replies

News on the UN investigation on benefit reforms
tommy456 replied to tommy456's topic in Benefits and HMRC
As would the bbc, you would think, maybe they are a different kind of left winger, who's own people don't count, or it doesn't git their paymasters agendas unlike the covering this type of thing the one sided bias bbc http://www.bbc.co.uk/news/uk-36692990 -
Not appearing on the news as yet they are too busy with the brexit stuff sadly http://www.centreforwelfarereform.org/news/uk-in-breachhuman-rights/00287.html I wonder if the government will obey them
-
Yes it is apparently still alive and well, though the A4E has re branded to people plus , And unless they have just re located offices they are no longer in my town , but their web site isn't listing my town

severe premium disabillity ,could i lose it?
tommy456 replied to house3's topic in Benefits and HMRC
Only one thing incorrect with what you have said, and that is following a unsuccessful MR ,You cannot be paid esa assessment rate until the HMCTS has sent the DWP notice of the appeal and they have input that onto their systems which can take 4-6weeks from them receiving the SSCS1 and a copy of the MR decision notice assuming no backlogs exist, as to if that will affect the SDP i don't know- 5 replies

They apparently don't like you taking notes, nor do they like you asking them about their qualifications as a HCP There is some case law on it, CE/62/2016 Failure 'to submit' to a medical examination when a health care professional refuses to divulge details of their experience http://www.osscsc.gov.uk/Aspx/view.aspx?id=4850
