  1. Hi there, i'm in need of some advice. I am a current student in Cardiff and Just moved house at the start of July. My previous tenancy agreement ended on 31st June. In my tenancy agreement is says; "2.5.1 The Member (letting agent) will tell the tenant within 10 working days of the end of the tenancy if they propose to make any deductions from the deposit" On the tenth working day after the end, i received my closing inspection which stated; "If there were any issues found on this inspection that could be deemed tenant responsibility, we will firstly review evidence such as previous inspections / inventories and correspondence throughout the tenancy that might concern the item/issue. This will allow us to ascertain if there is any tenant liability and if so, to ensure that a fair and accurate charge to your deposit is proposed. We will contact you if this is the case and there are any charges to apply to your deposit." So they have not proposed if they are making any deduction or not within their stated time scale. Where do I stand or what can I do? I did question the letting agent about this but they said any contact including the closing inspection counts as a proposal?!   2. hi I took out a 24 month contract with carphone warehouse in december 2012, with which i got a HTC one X. After a few weeks with the phone, the screen began to mess up so they replaced the handset with another HTC one x. Everything was fine up until a few months ago, bare in mind my contract has only been active for 6 months. Where the headphone jack started to mess up and stopped working. Also the the phone would freeze time to time. I sent the phone of for repair and the problem with the freezing still exists. Is there any way that I can get a new phone from this. I have been very frustrated with this model. I still want to stay on HTC as i like the interface, however maybe a different model.. Any advise? Thank you

I've been directed here as unfortunately I have been left in the mire by 3 mobile and their horribly incompetent, unwilling, greedy "policies" over broken handsets less than two months into a 24 month contract...! The contract: £27 pm for the One Plan and getting a Sony Xperia S from end of Feb 2013. The usage: I received the new Sony Xperia S in the first week of March. However I did not open, unbox or examine it for three-four weeks as I was extremely busy and continued to use my old Nokia E5. On Sat 6th April I finally commission the new X-S phone and get my SIM changed over etc. I thought I might even like it...! Sunday 7th April: A visit to a steam railway museum sees me using the handset as a camera. Unfortunately a jet of superheated ['dry'] steam is sent at me and I and the phone are in its way for about 1-2 seconds before I dodge out of its way. Phone is still working. Sat 13th April: 10:30am - phone decides that it is going to reboot, delete my data but the tocuhscreen is still working. I now have a phone back in factory condition. It asks me to restart again after the setup. Sat 13th April : 11am - phone has rebooted and the touchscreen has completely died. Refuses to respond in no way whatsoever. Even 'emergency call button' option will not function. Only way to shut off the phone is to use the two physical bttons emergency lockdown. Not good. After this, I report the loss to 3-mobile. I receive a package and get it sent off for repair or replacement. I then receive a somewhat snarky letter telling me that the device cannot be repaired due to "liquid damage". I am sent a crappy, blocky image of the so-called damage and then a blank space where "good device" example should be! Since then I have waged a somewhat-losing war of attrition on the telephone using my old and on-its-last-legs Nokia E5 with their ill-trained staff, having had three escalations through their poor excuse for 'customer resolutions/complaints'. My argument is that if both of my handsets die, I will not be able to USE their service and so why should I be paying? Secondly, they provided the damn handset and it has not even been three months since the failure. Thirdly, when I spoke to the last complaint handler a week ago, after a so-called 'investigation', they could not supply WHAT the liquid damage was[broken microprocessor, fused circuit board?] [all they could parrot was "liquid damage! liquid damage!" nor WHAT liquid had CAUSED it! Mention was made of the steam incident. However, I ask the following:- 1)A jet of steam for less than 2 seconds on a handset that would have been shielded by my hand. 2)It takes SIX DAYS for any such damage from it to occur? SERIOUSLY? Even after the cold April we had and condensation? Since then they have shipped the duff handset back to me with no work done. They had the bloody cheek to try and extort £360 out of me for a replacement X-S and then offered a number of cheaper options, the least being £100, all of which I politley told them to go to hell regards. I am not paying anymore money to these people! Fourthly, no matter what they say - the provision of the handset IS part of the contract which they are now, in my view, breaking. Afterall, why does exactly the same plan in terms of mins/texts/data cost £25 with x handset but £34 with y handset?? After several calls, I laid down a number of options. Given that ultimately in my view they would not be able to honour the contract, they could do the following. 1)Replace the handset. No can do. Liquid damage! We're not going to tell you any specifics either. 2)Allow me a lesser handset free of charge. I even asked for a new Nokia E5 just to settle this. We don't do the Nokia E5 anymore. And the least we can do is £100 for the Galaxay Ace. 3)End my contract mutually - WITHOUT paying 20months worth of 'early termination'. They can't do this either - its a contract afterall. [funny how they cannot abide their side of the contract] 4)Reduce my contract to £22-24 to compensate as I'm back on my old handset. We could set you up a new contract but we can't reduce anything. [] After 7 years of customer loyalty, I am somewhat shafted by this disgusting practice. It gets better [worse?]: They are now offering a superior handset for a pound less each month on the same plan as I had! I then also find that they are practically Throwing Away new Samsung S4s in a bid to promote their awful, awful service in competitions! So they could afford to dish out S3 Minis to clear out the stock, and throw out handsets costing £400+ but cannot even take into account customer loyalty and replace ONE lousy midrange handset? I have had to purchase a secondhand E5 on Ebay and still have the broken X-S as at least I managed to claw it physically back off them. Sadly once this contract is through I will be ditching them no matter what - it's when things go wrong that a company's service is put to the test and sadly 3 have reacted badly in this occasion. Is there any advice CAGgers could lend or am I totally up the creek with this? Many thanks for your time

Hi all, my wife's engagement has broken, it's the 2nd time the exact same problem has occurred one of the claws holding the stone has broken and the stone has fallen out. the 1st time this happened it was covered by the extended warranty & the ring was replaced as it couldn't be fixed. unfortunately it is now out of warranty. Im wondering what is the best way to try and get the ring repaired / replaced, would i be covered by the sale of good act? as its the exact same problem that happened to the last one? Just trying to get prepared before i go into the jewelers. Many Thanks in advance
  5. My laptop has broken and won't turn on. Now my son spilt some liquid on it yesterday, I was wonder how easy would it be for me to get it fixed by apple. I have applecare on it but have read that apple refuse to fix any laptops that have been damaged by liquid. Will the sales of goods act help me or am I already fighting a losing battle?
  6. Hello there Got a bit of a problem, we've received our December-March bill for £350. Our previous bills were £50-120 throughout the year and we've been away for two weeks over christmas and a further two weeks in February. I immediately rang E-on to tell them there was a discrepency they asked me to check the meter. This is where it gets interesting the meter reads 21229. E-on informed me they have an actual reading taken November 18th that is also 21229. I didn't take that reading or give it to them, but it is recorded on my November bill. I was home that day and didn't see anyone read the meter. So now the meter reads 21229, but since I cannot verify what the meter read in November I can't be sure it isn't broken. I checked the meter at 4pm today and it read 21229, I read it again at 7pm and it still reads 21229. Is this normal? Electricity usage wise we are a couple in a small flat that only uses electricity. We currently have on the heating (low), the dryer, the fridge/freezer. I spoke to E-on today and refused to pay the £350, they are sending an engineer to check the meter in April. But where do I stand on payment if the meter is broken? Thank you for taking the time to read this
  7. Hi, This is a bit complicated but bear with me. I had a Co-op bank credit card for many years with a £500 limit. Whenever i used the card I always paid in full each time a statement arrived. I have for some years been on ESA. Last summer, due to being on £71 assessment for over a year awaiting an appeal i had to use my card for living expenses. I withdrew up to the £500 limit. I intended repaying the minimum payment each month by making a payment then withdrawing £10 for the following month. I realise the balance would not go down much but I would be making payments. However the card expired and they refused to send a new card. The insisted I repay them first. Is this legal? They entered into a contract to renew my card and operate my account. I needed a new card to be able to withdraw £10 each month to cover the minimum payment. By refusing to renew they effectively closed the account. Am I within my rights therefore to say they broke the contract and not pay them back? I lost my appeal and am living on limited savings so cannot repay them anyway. Also I moved abroad, outside the EU. Are they likely, or even able to pursue this debt in a foreign court? Surely it would cost them far more than £500 to do so. Any help or advice would be very welcome.
  8. hi. scared and confused, dont know whats gonna happen and when this is gonna happen! please help! had this agreement with rossendales to pay £25.00 per week for about 3yrs now after allowing them in and signing a walking possession to set up payment plan. this was for a few liability orders for couciltax. never missed a payment but think i made a late payment in jan/feb. on 28th feb i went online to make payment as usual but wouldnt accept payment saying i had to contact[EDIT] on the number given. rang stright away but [EDIT] was rather grumpy sayin he had not looked through paperwork n to rind back in few days. i then tried making payment on automated phone line which was accepted. on thurs 7th march i recieved 3 bailiff removal forms hand delivered noted- no further arrangements are acceptable and payment is required in full. - no contact will be taken as your refusal to pay. baliff in charge [EDIT]. i rang [EDIT] got thru to answerphone so left message. rang again on fri morning..no answer. again in afternoon and finally spoke to him. asked for my name ect and to call back so he could get paperwork. was at work so asked if 5pm was ok. this was ok but when i called him aft work i kept getting disconnected so sent him text message explaining. dont know when hes coming for my things, i dont have money to pay in full which i think is £504.00 + £795.00 +£817.00. just want it to end so think ide rather him take my things cos they have no value to me, not worth anything really.
  9. Could really do with some advice. I took out a 3 year car finance and have paid 2, and has full service history. The past few months I have had problems with the car, and taken it to 4 mechanics now and it still isn't sorted. They think one of the problems is the turbo, which is hundred's of pounds! Just wondering where I stand as it's finance and bought from a dealer. Would it be better for me to get the car fixed (if they can) and carry on paying the finance? Can I go to the dealer and ask them for help? Do the car finance company have any obligation? Can I part exchange the car and transfer the rest of my finance to a new car? I just don't know what to do for the best. We have 3 children and really need our car, but we just can't afford to keep paying out on top of the car finance. Any advice would be great. Thanks
  10. hello, I broken my thumb and I went to emergency department.I had x-ray but my doctor didnt give me sicknote and he said I can do my job.I work in warehouse where i have to lifting and picking products.I told him about my job that I use my both hands but he refused to give me sicknote.I dont feel I am fit to work.I stay at home now and take painkillers.I can stay at home up to week by selfcertificated.Do I have to go my GP and ask for sick note.Any advice thank you.
  11. Hi all, I have a PCN for parking on double yellow lines which are broken. Thats the reason I parked there as as far as I knew this meant they were inactive and certainly advice I've seen on here in the past supported that. When did that change and what is the regulation that says they do have to be continuous and barred at each end? The council recently repainted all DYL's around the town that were broken or worn and painted in all the gaps that had been left where repairs had been made to the road. Some of these were only 1-2 feet! The lines where I parked were not re-painted and are in a service road under a shopping centre which does not have a street name. Does this make a differance? I asked the council what they meant by 'Parking in a restricted street during prescribed hours' and was asked if I had parked in a residents only parking bay. Only after my 'Informal appeal' are they refering to DYL's. I have questioned whether the council have jurisdiction over an un-named service road, they say they do. They say it was obvious there were DYL's but not being joined it was obvious to me they were inactive. The road quoted on the ticket is the shopping centre above the service road. Lastly I read on another thread that the ticket should say 'Date of issue' as if it doesn't then it is contrary to RTA 1991 section 66(3). My ticket says 'Date of contravention, time of contravention.' Thanks for any advice you can give me.
  12. Hi all, A friend of mine had a payment arrangement with Jacobs Bailiffs over Council Tax Arrears. The arrangement was to pay £40 per week. Just before Christmas she broke her leg and has been unable to get out of the house. This has caused her to miss 3 to 4 payments. Yesterday she received a letter dated the 03/01/2013. The contents of the letter are as follows; *************************************************** Dear Miss * ********* You have not maintained your arrangement to pay £40.00 every 7 days. Your arrangement is therefore cancelled and WILL NOT be re-instated. If FULL payment is not received within four days, a bailiff will attend at your property for the purpose of collecting the full payment or removing goods for sale a public auction, which will incur additional costs to you. PLEASE NOTE: If this matter is now out with our bailiffs there may now be further costs to pay in addition to the balance above. *************************************************** She telephoned Jacobs explaining the situation and offering to pay £100 immediately. The person she was speaking to said it is to late now and that the amount can only be paid in full. They want her to pay £575.04 in full, this she cannot do. I have advised her to only deal with these people in writing. I am also going to draft a latter explaining the mitigating circumstances and an offer of payment to catch up with the missed payments. Any advice appreciated. Regards
  13. Hie. Just wanted to find out if i could ever re-apply for a bank account with Barclays after they closed my account in 2006 due to defaulted Barclaycard? I did not pay or akcnowledge the barclaycard so that default has just come off my credit file last month. My credit score has improved thanks to good management of my vanquis card and running a marisota account. I nolonger have any defaults on my account and never had any CCJs.
  14. I was brought a new phone from Amazon for Christmas. The phone was broken so I sent it back for a replacement. However, the company are not sending me out a replacement. They are saying it would be quicker to give me a refund. However, the company are still selling the same product on this listing. However, it is for more money than we paid. So it appears they don't want to send this replacement because they are now getting more money for this product. Do I have any rights in this situation? Thanks
  15. Hello all I have had a problem with my laptop, I bought it 19th December 2011 and Its broken a few times. The first time was the hinges were lifting the bezel up from the plastic, making it creaky and dangerous, I phoned lenovo up and had them bits sorted out in April 2012. On 26th September My lenovo just wouldnt turn on, I took it back to where I bought it, and they sent it off to Lenovo for the second time this year to have it repaired. I got it back 15th October 2012 with a replacement motherboard, but they forgot my battery.I went back to the shop who sold it to me and they phoned lenovo up and asked for either my battery back or a replacement, as it was sent away as a whole machine. Yesterday (23rd) the shop phoned me up and said my battery had arrived, it wasnt a new one but I werent fussed as long as I could use it. Popped it into my computer, and it werent recognising it. Now this morning (24th) I turned my computer on after leaving it on charge and it wouldnt turn on. Took it back to the shop, and they said it's the motherboard again, as it's exactly the same issue as before. Now my main concern is Lenovo want to book it in for repair AGAIN, and the last time they had it, it took 19 days to repair, and as I do alot of database work, I cant afford to keep losing my computer for a fortnight.Plus that's two times the machine has died on me. Is there anything that I can do to tell them that Im fed up of having my business lost due to their faulty machines? I dont particularly want to buy a new machine if this thing breaks as soon as my 12 month warranty expires.. Any help or suggestions would be amazing, Im not all too smart with this stuff!
  16. Hello everyone, i was hoping to get some sound advice regarding the purchased of a car which has now broken down. I apologise as this is likely to be a lengthy post. I purchased a used Kia from a main dealer (not a Kia dealer but a main dealer for a similar brand) in September 2011. The car had covered 40k and was 5 years old. The main dealer was over 300 miles from home however the car was exactly the specification we were after so we considered the journey worthwhile. The car was advertised with full service history and sold to be with 6 months road tax and a 12 month warranty. The warranty was an aftermarket one. Fast forward to July 30th 2011 when the car started making a strange noise from the engine area. We immediately pulled over and called the AA who diagnosed a faulty timing belt tensioner and towed me to the garage of my choice. I was aware from reading the warranty booklet that the garage labour rates had to be under £50 per hour for the warranty to cover it so I took it to a small independent garage. The garage contacted me a day or two later to advise that they suspected it was the oil pump and not the tensioner as per the AA diagnosis so advised that they had removed the sump. On removing the sump they found lots of metal swarf in the engine and have diagnosed that the crank shells have worn very heavily to the point where the engine requires rebuilding or an exchange unit. Thats OK i though i have a warranty........ The warranty company are refusing to pay the claim stating that the car is 5000 miles over its service interval. This is despite the salesman at the time of the purchase advising me that the car only needed annual services and it wasn't mileage dependant (I rather naively believed him) as i had not had the car 12 months i didn't get it serviced. Sure enough after 11 months the main dealer texted my phone and advised that the car was due a service. It gets more interesting that when i gave the warranty company the service history they stated that it had also gone 5k over the service interval before i had the car and so therefore wouldn't have been covered anyway. I have been in touch with the garage who sold me the car who after 3 days of deliberating have decided to tell me the same story as the warranty company that they wont help as the car is 5k over the service interval. I am not sure what to do now. In my mind the garage sold the car with full service history despite it missing a service by 5000 miles, now that i have let it happen as described above they decide that the service history is not good enough..... I paid for the car partially on a credit card and partially on a debit card (both visa) although I am aware that to reject the car now i would have to prove the fault was present at time of purchase. I am more than happy however to have the car repaired either by the supplying dealer or the warranty company. Currently the car is in bits in the local garage and i have asked them not to continue work on the vehicle until the above is resolved. I have informed all parties that the car is available for inspection. I am not sure where to go from here, the last communication was an email sent by me to the dealer asking him to reconsider their stance on this given the above however i am not sure they will. I have also been in touch with Kia customer services who agree that the car should not have broken down in this way and advise that going 5k over a service interval wont cause the wear described however they cant help as its not one of their dealers. Any advice on how to handle this from now would be gratefully received. Thanks Sam
  17. Hi all, my name is Donal I live in County Down Northern Ireland. I am 30 years old and still live with my parents, I should be in my own place but that just doesnt happen in this day and age. I have four younger brothers all in their 20s and we are all on the same boat, my parents are happy with us at home and have never forced or asked us to leave. My dad is a carpenter and has worked his ass off all his life and my mum is a nurse who also has worked quite hard to keep our large family ticking over. My parents have got them selves into bother with swift and owe them over 40 grand because of charges, now I dont know what these charges are or how they came about but this is the way with these cold hearted **** bags. They have been threatened in the past with court action and have also had people from the courts out to the house to talk things through but nothing has ever came of it. My mum got a letter a week or two ago from these cretins to say they wanted to work out a deal so my mum went through the online application of budgets and all that, they got back to her on Monday past and told her they were willing to negotiate a deal if they paid 5 grand up front and then said there will still be a chance that you will lose your home. Today is the first day that we have truelly started to pack up our belongings and move to our rented property, we have to be out by Friday 21st or there will be people at the door asking us to leave. So rather than cause a scene and embarressment we are just going to pack up and go. If only I knew sooner about this board then things might have been a little bit different or maybe not. I dont know. I just thought I would share with everyone how sadening and soul destroying this is and I know my dad will never get over this, they have turned him to a broken man who has always been so happy and proud. My Galaxy S2 is currently with T-mobile for assessment as a result of a broken screen (under the glass) and the view of the shop was that as it was a broken screen it was automatically my fault. I am at a loss as to how they can know this without even seeing the phone. Hence why I was unprepared to pre-authorise a repair without knowing the cost first. I have no issue with paying if it is my fault (like I did when I put a phone through the washing machine or when I dropped one on a sharp stone and shattered the screen or when I left one on the car roof and drove off only to see it bounce in the rear view mirror!) but this time it was very different as the screen went black as if power had gone and it needed to be switched back on - i initially thought it was a power fault. The next day I discovered a crack in the screen. Following research I have found that there are issues with some Samsung phones overheating and this cracking the screen and, as my phone has gone very hot on a few occasions recently, think this was the problem. Any advice on how to respone if, as I expect they will, they say its down to me. For reference this is the first problem I have ever had with a Samsung Phone (apart from the self inflicted problems above) and up to now have been very impressed with T-mobile's customer service.   19. I bought a Beko WM6355W washing machine from Currys on 14th November 2009, less than 3 years ago. It's been used sparingly since then. We are pensioners who live alone and don't have a mass of washing to do on a daily basis. In fact quite often we don't even have a full load for a couple of days. today I put a wash into it and set it going. That is, I pressed the button to set it going, but nothing happened. I switched off and tried again and still nothing. On another restart I pressed down both the cancel/start button and the on switch at the same time and a message of E08 came on the display. I presume this to be an error message. So, a knackered washer under 3 years old folks.... Is this likely to be considered to be an unduly early demise under the sale of goods act? The last washer I had, an Indesit, lasted me almost 9 years. If the SOGA could be invoked how do I go about a complaint? I'll call Currys but I doubt if I'll get far. I mean, it's out of warranty isn't it, and doesn't have an extended warranty. For the sake of it, I will mention that I have bought all sorts of things from the group including a 3D TV for my son, a tumble dryer, an Ipad thingy etc. I doubt if this will swing any favours but it should point me in a new direction if not. _______________________________________________________________________________________ The Sale of Goods Act requires a durability factor which is generally determined by a recognised body. So, I've done a bit searching and found that the Product Life Institute of Geneva gives a household washing machine an expected life of 10 years. 3 years is a long way short of this. As a concession to the use so far obtained from the Beko I would be prepared to accept a discount of 70% against a new one.
  20. My car broke down on a busy road - while I was on the phone trying to arrange my breakdown service, I got a ticket. I explained that I had broken down, but he still issued it. He said I should have been next to the car. I told him I'd gone 50 yards up the road to try to find a street name to give to the breakdown service, but to no avail. I feel like contesting this, but is there any precedent anyone knows of for this type of situation? Thanks
  21. Sorry if this is in the wrong forum mods, please move it to relevant forum if so Some time ago (under 12 months though) I bought a Lenovo G570 laptop. After about 3 months the left hand hinge came loose. I took it back to the retailer who replaced the screw in the back that was holding the hinge in. All was good for about a couple of months until it happened again, this time it damaged the case. I promptly returned the laptop to the store for someone to take a look at. I was contacted by the store a couple of days later, they told me the damage was caused by me dropping the machine(which I have not). I suggested that there was a design flaw resulting in the hinges coming loose, only to be told "no it isn't a design flaw, you don't know what you're talking about". I was disgusted, but tried to be ultra careful with the machine. Now, over the weekend the same problem has occurred with the hinge at the right hand side, this prompted me to google "Lenovo G570 hinge broken", this search threw up quite a lot of results(near 9000). It does seem that this is a common fault with the laptop. Others have tried to contact Lenovo but have been fobbed off by them. Before 12 months is up, I would like to know where to go from here. Any help/advice would be gratefully received.

I was smoking on an outside/non enclosed section of the overground platform (something i didnt know about) and was approached by two transport officers. after two months I received a letter about court proceedings asking me to respond in 14 days notice. I responded about there being confusing or limited signs, the sign at the entrance was actually the no smoking circle and was placed the wrong way around (there was no text and I have a photo of this on the day) they’re doing renovations on the station and believe that they had removed the signs for some time. I since received a court summons and am unsure if they received my original letter. I know that there are laws on proper signs and in the summons it says that 'near which there is a notice indicating that 'smoking is not allowed'. I read that businesses not displaying the proper signs can be fined. also what is the best option, is it possible to settle out of court or pay a fine (used with money for quitting smoking) should i get a solicitor on this. any help, thank you.
  24. I am new to this site so forgive me if I make mistakes.... I have a 2008 vw Fox with only 20,000 on clock now (had approx 10,000 when bought in June 2009). The catalytic converter has broken (been on two diagnostic machines,vw and another reputable company) due to it being out of warranty VW say it is down to me as I did not use their service dept (it is too expensive for me), so I am not a loyal customer, although my last two vehicles have been bought at the VW, so surely I am loyal to the brand? can anyone please advise Thanks delahunty
  25. hi i bought a laptop from a catalogue campany ,i have had it 7 months ,this morning i opened it up and turned it on and it looks like it is cracked from the inside and has black ink stains on it,it has not been droped or damaged,i contacted the catalogue,and they said to phone the laptop company,i phoned and they said they dont cover screens on laptop,iam left with a broken laptop and still have to make the payments for it,is catalogue company responsible.thanks
