  1. Hi Every one, Please help/Advise. I was photographed entering the haven banks car park on the 22/dec/2017 at 11.42am. Paid £1.00 for 2hrs /120mins parking at 11.46. Was then photographed leaving at 14.03pm on the same day. Unfortunately I entered the last two digit's of my registration wrong ****LKX when it should of been ****LXK. So received a parking charge letter on the 01/01/2018 stating that I needed to pay £54.00within 14 days ,if I was to appeal and fail this would go up to £90.00. I of course contacted Smart Parking and forwarded on the parking ticket which I paid for hoping they would see scene and cancel the charge.(Ya Right!). There letter arrived on the 27/01/2018 ,stating that as the motorist and that there are signs clearly stating not to make mistakes it was my fault. Also I was over my paid 120mins by 20mins.(I understand that this is the 5mins entering the car park parking and paying for ticket and the 15mins leaving). I again appealed To POPLA, stating that I was in my car within my paid time ,but due to the excessive amount of vehicle's entering/leaving this car park over the xmas period ,I was unable leave hence the 10 to 15min wait ,but didn't realise I was over my time when I eventually drove out. But on the 5/3/2017 while POPLA agreed the wrong reg details should cause the fine my overstay still did. So the charge is £90.00 Sorry that there's so much to read , I have all letters and the £1.00 parking ticket so can forward them on . haven't paid the charge yet ,hoping there's some one that will advise me.   2. Help Required I have received a Pcn fine from a private car park in Blackpool NE Parking Ltd. I have received a letter from above company on the 17.12.17, Saying that was parked incorrectly and not within the parameters of the bay, they have supplied a photo of my vehicle with one wheel on the white line of the car parking space (not actually outside of the bay) they also have a picture a parking ticket on the windscreen of the car. Which wasn't on there when i returned to my vehicle. The fine relates back to 22.10.2017. I have responded to the company by email To whom it may concern. I have today received a notification of a fine issued by your company stating that my vehicle was 'not parked correctly within the markings of the bay and it also stated that I had been issues a penalty notice at the time. my vehicle is on the white line (which is not outside the parameters of the bay.) this was only one wheel as shown by your photographs. you photographs also show a yellow package on the window screen however there was no notice on my car on my families return to the vehicle (if this was the case I would have contacted you prior to the letter I have received today.) I feel this is an unjust letter / fine that I have received. I will also endeavour to seek further advice if this matter progresses. Response from NE Parking Ltd Thank you for your email we received on 17/12/2017 Unfortunately you are out of the timescale to appeal you were given 28 days To appeal from the day after the pcn was issued to the vehicle which Was (22.10.2017) The amount which is now payable is £100.00 I have replied saying how do you respond to something which you where unaware you've received. Can anyone help me and tell me where I stand with this. Thanks

[y/n?] No 5 Is there any photographic evidence of the event? Yes ANPR of car arriving and leaving the car park 6 Have you appealed? No 7 Who is the parking company? Smart Parking Ltd 8. Where exactly [carpark name and town] Havens Bank Retail Park, Exeter For either option, does it say which appeals body they operate under. BPA My intentions are to ignore as per the other threads (been doing my research before posting). Grateful for any advice. Please find attached the NTK
  4. Hi there, My pregnant wife and I parked in the Haven Banks car park in Exeter on a Sunday afternoon and paid the parking charge for 2 hours. We have subsequently received a Parking Charge Notice showing images that say we left the car park 2 hours and 15 minutes after entering and so we are required to pay up to £90 (£54 with early pay discount). I am new to all this but see from the forum that this is not the first time their charges have been brought into question. My wife is over 6 months pregnant and so is obviously slower at moving than normal and also takes time to get organised and comfortable in the car and so a fine of up to £90 for 15 minutes in a fairly quiet car park is excessive. Furthermore, the signs are not very clear so we almost missed them when we first arrived. I have not yet responded in any way to the letter as I have just received it in the post, but would be grateful for suggestions as to how best to approach this situation. Many thanks in advance.
  5. I can see a few things against UKCPS however I thought I'd start my own thread. Someone driving my car today receiving a "Parking Charge Notice" on the car for leaving the site, of £100 or £60 within 14 days. I've attached photos of the PCN and of the sign at Bristol Abbeywood Retail Park. I'm the keeper of the vehicle however I wasn't driving the car (I was at home!) so is there anything they can actually do?
  6. Hi whilst getting advice about a different ticket, my husband now received one from Smart parking. We were away for a weekend somewhere we don't know and parked outside a bowling alley. Didn't even occur to us we'd have to pay (even in London we don't pay in such locations!) It was pouring we rushed inside without looking at notices. Is this another dodgy private company or not? As we are going away this Thurs need to deal with it asap. Many thanks.

LIDL are unwilling to cancel the charge and are now ignoring emails 7 Who is the parking company? Athena Parking 8. Where exactly [carpark name and town] LIDL Manchester - Ashworth Street, Denton M34 3LJ Appeals Body says the IPC. I have been reading a few threads on here and a few other places, and I was under the impression that emailing LIDL direct usually killed these things off ? I had had a few replys but they are unwilling to cancel it, and are now ignoring emails on the date in question my Aunt was an occupant in a vehicle that is registered in her name . She is partially disabled and walks with the aid of a stick. There was also a Blue badge on display if that matters. The charge is because the vehicle overstayed by 30 minutes. The occupants of the vehicle did shop in LIDL on the said day (No till receipt though unfortunately). I am thinking next course of action to write direct to LIDL head office ? Just want anyone's thoughts before I do.   8. Daughter (not the registered keeper) parked 25mins over the allowed time at Lidl Clapham Junction car park. Did some shopping and mostly browsing at Lidl Clapham but also went to other stores. Got sent Civil Parking Charge Notice. Was intending to pay within 14 days but forgot and now it is over 28 days. Any advice would be helpful Many thanks
  9. Hello, I have Entered Crawley NCP carpark Opposite TAJ. Which is pay and display car park without any entry and exit bariers . After entered i got a phone call it's took 8 minutes the reason i need to park my meeting was canceled i got a phone call from them then i left car park i have stayed just 11 minutes 30 seconds. After 13 days i have received a parking charge £100 and if i pay within 14days i have to pay £60. Please kindly advise me what i have to do ? shall i need to pay or i can ignore it?   10. Hello all, I have been directed your way from an advice thread on reddit. I received a letter in the post from NCP the other day stating that I now owe them £100 (reduced to £60 if paid within 14 days) for parking in their car park without paying. However, the kicker is that I didn't actually park there. I entered the car park to pick somebody up and left 15 minutes later. I've logged in to check what pictures they actually have, all they have are pictures of my vehicle entering the car park and leaving 15 minutes later. They don't have any evidence of me walking off into town for example (they wouldn't, because I remained in my car the entire time). it seems to me that they can't claim that I parked there without paying if they have no proof of my car actually being parked. I would like some help with appealing this and any suggestions would be appreciated

I've learnt a fair bit I hope someone would be so kind as to give me a little bit of additional guidance. Here are the details from the Notice To Keeper ---------------------------------------------------------------- 1 Date of the infringement 16/04/2018 2 Date on the NTK [this must have been received within 14 days from the 'offence' date] 20/04/2018 3 Date received 24/04/2018 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? Yes 5 Is there any photographic evidence of the event? Yes - ANPR entering and exiting 6 Have you appealed? {y/n?] post up your appeal]No, not yet Have you had a response? [Y/N?] post it up n/a 7 Who is the parking company? Parking Eye 8. Where exactly [carpark name and town] Cedar Court Hotel, Bradford For either option, does it say which appeals body they operate under.I think it is BPA as the second appeal will eventually go to POPLA ------------------------------------------------------------------------------ On the Notice To Keeper, under "Parking Charge Information", it says "On the 16 April 2018 vehicle entered the Cedar Court Hotel, Bradford car park at 10:00 and departed at 17:45 on 16 April. The signage which is clearly displayed at the entrance to and throughout the car park, states that this is private land and that the car park is managed by ParkingEye Ltd. In addition the signage states that, as a hotel patron only car park, a Parking Charge is applicable if the motorist fails to enter their full, correct vehicle registration into the terminal in reception. The signage also contains further terms and conditions associated with this car park by which those who park in the car park agree to be bound. By parking without a valid permit, authorising the vehicle to park, in accordance with the terms and conditions set out in the signage, the Parking Chanrge is now payable to ParkingEye Ltd (as the Creditor)." I believe the driver of the vehicle is classed as a trespasser because the car park is a Hotel Patron Only Car Park and therefore prohibitive to anybody who is not a hotel patron. The driver did not use the hotel facilities at all. From reading other threads, it seems this is a trespass issue and therefore no breach of contract can occur. Also, I do have evidence that shows there is inadequate signage. Since my first appeal will go directly to Parking Eye which will be rejected immediately, I was just going to put "insufficient signage" as my appeal reason rather than the trespass reason. Any advice is greatly appreciated.

Coporate services have sent a parking charge notice to a friend of mine, after 5mins of parking there. they state that the reason for the charge is because they didnt use the premises. im wondering do they need to prove that they didnt need to use the premises of KFC, in order for them to charge this invoice? if so will a simple email stating that they did indeed use the kfc on the day in question and its down to them to prove that they didnt in order for them to pay.
  13. Hi Everyone Im new to the forum so firstly I would like to say Hello. I have attached a photo of a car park sign next to our yard. This is a company that allowed us to park in their car park and has since gone into liquidation. The director who is managing the liquidation has erected the attached sign. The problem is we currently have no alternative to park. Is there any issues with the attached sign? flash signs.pdf
  14. My wife has received a Parking Charge Notice for a hotel car park, she was meeting a friend in the car park, her friend went into the hotel to use the toilet but that was it. The notice states 38 minutes onsite and has photos of the car. She cant remember seeing any signs on entry but I will check later as its quite local. She never actually left her car, the keys stayed in the ignition and the door remained open, so technically was the car actually "parked" The fee is £100 reduced to £60 if paid by tomorrow. Can anything be done about this?
  15. 0n 29/11/17 I received a parking charge in Aldi, Heswall wirral. The date of the the first notice through the post was 14/12/2017. I appealed (on line) on the grounds I was not the driver of the vehicle. It was rejected. I was given 14 more days to pay. I appealed again (on line) using a template letter from this site, asking for a breakdown of charges etc etc. I received none of my requested info, simply a rejection of my appeal. They continue to pursue me and the charges have now increased from £40 to £70. What should I do next? They provided photographic evidence and mention shcedule 4 of the protection of freedoms act. The appeals body mentioned on the documentation is IAS (POPLA) All responses greatly appreciated.
  16. Hi everyone, Got a PE ticket through post back in Dec 17, appealed to PE and received their standard fob off appeal not accepted. Didn't appeal to popla and then received a PE Letter before County Court Claim. After reading up on the thread about this I sent a letter " Please therefore provide a Letter Before Claim which complies with the requirements of Annex A Para 2 of the Practice Direction on Pre-action Conduct as below: Received an email stating they looking into the matter then a today stating that Annex A of the practice direction (pre-action conduct and protocols were no longer in force and amendments were made on 6th April 2015. They state that their LBCCC is fully compliant along with their Reply form and information sheet attached to it. Finally, they state that they require further information to be able to understand my position and for them to provide a response. If I wish to dispute the charge please clarify the reason for this or make a payment. Not sure what to do next as clock may be ticking in their favour for the LBCCC. Cannot appeal to POPLA as the number given is invalid, probably date barred. Any advice greatly received please? thanks

  19. Hi - I have also received two sets of letters from ZZPS, relating to parking notices issued at Brighton University on behalf of Ethical Parking in October and November 2015! Whilst I remember receiving the notices and not really doing anything about them (I've checked back over old bank statements to see if I paid them - and I didn't), I have not received any correspondence since then. Same address and same car as the date of the original PCNs. The only thing I think that has happened is that these letters have been sent to me since I recently parked in the university car park again on a weekend when it is free for a particular event. I assume the cameras picked up the registration plate and it has triggered some kind of recall at 'Ethical'. I received one set of letters at the end of April 2018, and ignored them. I've now received two more. ZZPS are claiming that if I do not pay within 14 days they will pass this to QDR Solicitors. Both letters demand £130. Do you think it worth ignoring them still - there is no mention of a fine but of an 'outstanding debt'? NB: During the time of the original PCNs, I was a student at Brighton University with a valid parking pass. The two incidents relate to my apparently being parked in one parking area which I wasn't entitled to, and the other to being 'parked in roadway'. The latter relates to my squeezing my car into a space in the car park which wasn't intended as a parking space, but as there was no other available and I'd seen others do the same, I decided to park there. It's odd that they've suddenly decided to pursue this but I wonder if they are purging their database of unpaid PCNs or they hold them until a certain point then escalate it? This is my first post on this forum, so apologies if I've hijacked any one else's but thought if might be worth adding to this, as it seems like ZZPS may be purging their database of unpaid notices and perhaps just seeing what they can get. OR is there a shelf-life on unpaid PCNs and subsequent debt collection before it has to be escalated? (doubting that last point somewhat).
  20. Hello CAG members I wonder whether anyone could help? I recently received a parking charge notice from G24 that refers to a date roughly three weeks into May for the car park outside B&M Stores in Falkirk (Scotland), with an issue date a week after. The car park is free but timed seemingly to 2 hours and in this case a 20 minute overstay has been flagged. I haven't as yet responded. Although I own the car, the driver, a gentle and vulnerable person who pays their taxes and wouldn't bother a fly, could easily have picked this letter up before I did, which really bothers me. And as I'm dealing at the moment with same person being bullied in bereavement by the BBC licensing people, I'm really not a happy bunny right now. Then further down it says: I'm not very familiar with law stuff so obviously I'll be having a search around the forum but my initial questions for now are: - Is this really enforceable? - As of 2018, do they really have the right to get my details from the DVLA? My disabled wife parked in a disabled bay displaying her blue badge She received a PCN from Smart Parking Place - Havens Bank retail park Parked on 05/05/18 received the PCN (dated 04/06/18) today June 6th 2018 Photo entering site underneath typed time 11:25:19 Photo exiting site 13:52:06 PCN states smart pay manage but does not state anywhere who the owner is but they have the right to seek payment It states my wife breached terms and conditions - which they have not supplied It states by either not purchasing the appropriate parking time or by remaining at the car park longer than permitted , IAWT&C set out in the signage the parking charge is now payable to smart parking lots (the creditor) Now I believe this is illegal and I am not going to respond nor identify my wife On the back it states Data protection This is subject to the DPA - I thought it is now supposed to be GDPR as the law changed last month They say they have applied to DVLA for the details of the registers keeper Appeal managed by POPLA Daft Parking R.pdf
  22. Hi, I am writing this on behalf of a disabled friend, who has received a Parking Charge Notice through the post from Civil Enforcement, mid last week, around the 26th of Feb. Some info: Date of infringement: 15th Feb 2018 Issue Date 22nd Feb 2018 Date Received 26th or 27th Feb 2018 No photo evidence mentioned, but possibly auto cameras. Cannot see any Section 4 mention on the letter. Just says Maximum Parking Allowance Exceeded. Not appealed yet, we will, and I will detail in a moment what we are thinking to say. Parking Company is Civil Enforcement Spinning Gate, Leigh. Says they have appeal procedure, and if unsuccessful, then Popla. So most importantly, the car park in question is shared by Cineworld, Tesco, and several other food chains such as Frankie and Benny's. The entire car park has a 3 hour parking time limit. We were parked at the side of the cinema, and during the 6 hours we stayed, we went into Tesco, and into their restaurant, and stayed well in excess of an hour as the disabled person was not feeling well (Primarily pain). Once she recovered sufficiently well, we then shopped in Tesco for around 45 minutes to shop. After that we attended a screening of the new Black Panther film. We went into the cinema early so that the disabled person could sit a while. This was around 45 minutes, including purchasing tickets, and getting sweets. We then watched the film, which has a running time of 2 hours and 14 minutes, but including trailers and advertising was closer to 3 hours, for the film alone. As such the film alone would have taken much more than the three hours allowed, inclusive of obtaining tickets, food and seeing the entire film, so on the basis of this, we would have incurred a parking charge, simply for attending the film at the cinema and parking in their car park! Given my friend is disabled, I thought to provide proof of her disability, with a copy of her blue badge, numbers redacted. The letter they have sent already has her name and address in full so they know who drove, and she is the sole driver. I also intended to provide a photocopy of the cinema ticket to prove our attendance. This and a covering appeal letter stating exactly what I have written here. Should we appeal? I figured CE will just decline it anyway, and likely Popla too. What happened if it is declined, and we don't pay? Surely if they took her to court they would lose, simply based on the fact we were parked to see a film in their car park, and in order to see that film we would have to be there longer than 3 hours, or miss the end of the film Given the person being claimed against is disabled, obviously she is slow to move around, and needs a lot of help and support. She is naturally very upset about all this absurdity. Any advice on how to proceed would be most welcome. Thank you.
  23. Hi, Hope everyone had a good bank holiday. I (and three others!) missed crap signage and got a Contractual Breach Charge from Ethical Parking on my windscreen over the weekend. Just double checking that it is currently still best to do nothing until a notice to keeper arrives (between 28 and 56 days) before I take any action on one of these? Then if it (NTK) arrives on time post photos of it and signage on here for assistance? Just don't want to get it wrong! Thanks!
  24. Hi need some advice on this please. I'll try to keep this brief basically we don't have allocated parking, you can't park close to the house as there's no road up to it so I need to park as closely as possible. I have asked the housing association many times for disabled parking and they've delayed and now their latest excuse is they need to survey the other tenants, why they need to ask other tenants when i'm the one asking for what I think is a reasonable adjustment? I'm not in a wheelchair but I do receive both elements of PIP and I do have a mobility scooter, some days the difference between parking as close to the house as possible and in the normal car park is whether I can leave the house or not (or possibly be able to get in the house when I get home). The HA have been fobbing me off since December and they claimed they would ask other tenants in January and they still haven't done so. Am I being unreasonable? I'm not asking for allocated parking just a yellow disabled parking bay. I have complained and written to them etc but nothing ever seems to happen, any advice gratefully received.
