Hi Ren....But it is outrageous that they participate within this type of harassed collection activity, Red lettered threatograms just don't float my boat, yet I am embarrassed for them

They hope you give in and pay. Simple as that.

Fully agree. But as we all know, DCA's exist solely on threats and harrassment, and sadly many tens of thousands of people pay up because they dont know any different.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

If my advice helps you, click the star icon at the bottom of my post and feel free to say thanks

Nope. Theyve been doing the same old crap for years. If they were going to take any form of action, then it would have been done years ago.

Ok so nice letters from them go like this.

We have reduced your (alleged) debt by 50% so pay us now in full

Pay us £30 per month till settled.

Call us to make a payment plan

HOWEVER IF YOU DO NONE OF THE ABOVE...WE WILL...send a doorstep type non existent commission based liar to your home.

Arrest yr wages.......

Obtain a ccj, ( even though the one above should be below this one) if you get my drift.

We have checked various records and note that you can afford this repayment .

Now bearing in mind this particular acct was put into dispute 4 yr ago, and there it shall remain until the request for paperwork is adhered to. so yet another Worry free night knowing that the fools are phishing and /or tr ying it on, because we all know that if they had 'anything' then I would have received a claim pack a long time ago, don't you agree ?

Hi. I was reading somewhere here that when the wrong info is entered by a dca with the cra that this could be defamation and the perpetrator taking to task by way of suing them? now what if a dca enters info such as an alleged debt from a cc or similar without knowing the 'truth' say one dca purchases from another pond life, then assumes their info is correct?? food for thought or not ?

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

The responsibility for the data shown on CRA files falls upon the company providing the data, and complaints should be made to their data controller, you can place a notice of dispute on any 'problem' entries

Hi Brig

I made complaints re their data a few weeks ago and the can of worms have opened, such as accounts that were mostly inactive have came alive again with 'reduction offers' spose the complaint prompted them yet non of the dca, managers etc have contacted me re a response, only that of threatograms and reductions.

Did you mention about a CCJ in the original post?

Wonder what "records" they check to see if you can afford it?

Its not right that they think they can peer into your finances without your permission... :Sigh:

  • 6 months later...

Hi All

Bit of help needed for a mate.

he owes a company circa £1100 for approx 3 month accumulative supplies of food for his shop.

The company sent a debt collector (Regional Collection Services) who say they have account copies

and authority letter are acting on behalf of the supplier and subject to Late payment of commercial debts act etc,

they have added a charge of over £500.00.

The collector is abusive in his activities and threatens to remove goods ?

My mate is worried at the title of this company ie. debt collector , qualified Bailiff and authorised HCEO.

What is his best option here? bearing in mind that he is paying the full amount to the supplier on Friday, even though they say pay the collector?

They need to check the terms and conditions because it can say that ownership of the goods are not transferred until payment is complete.

Pay directly to the original supplier, your friend should be able to use the normal payment route, otherwise bank transfer but do not forget to add his account number so this payment can be traced.

Because the account is then paid in full to the original creditor, if RCS want any fees for their services, tell RCS to contact the original creditor because it was them who intialised RCS so they can now go & play on the Transporter Bridge!

Just re-read, RCS are in Sunderland so a tad of a drive to the Transporter Bridge!

In the future, the supplier may refuse to deal with your friend or insist on cash paid in advance of goods, this could also add to your friends cash flow issues.

Stigman

NEVER telephone a DCA

If a DCA rings you, refuse to go through the security questions & hang up!

just remember a DCA is NOT A BAILIFF

and has

NO SUCH LEGAGL POWERS.

if money is owed

then liase with the original supplier

NOT the DCA

they can add nothing either

no court order so no bailiff.

Letter of authority is not the same as assignment of debt so no interest in the debt is held by DCA

Lastly, cannot seize, add to debt or threaten anything.

If they are certified bailiffs record them and report.

Your friend would be wise to see if the supplier wants the money or residue of goods back plus balance in cash

and then ask if they want to cease business relationship or start afresh with new business terms.

Many companies cannot afford to turn down business, even if they are late payers so it is probably in the suppliers interest

to start afresh and these clowns arent helping in that matter.
