  1. Hi everyone, my friend had an accident in his car. He lost control going round a roundabout and crashed into a lamppost. After checking his car he drove home and put his phone on charge as it was flat and fell to sleep as he was on his way back from visiting his mother. Next morning he was woken by the police at his door, when he went out his car was missing. The police said they thought it was stolen and dumped so took the car away. He lost his job because of not having his car. He asked why they thought it was stolen and they said they assumed it was because it was involved with an accident with a lamppost and wasn't at the house it was registered too. He is separated from his wife who is still living at the house in his name and he lives with friends. They also said he left the scene of an accident, to which his reply was no one else was involved and the car wasn't damaged enough to make it unroadworthy, and as this is the first time it had happened to him didn't realise he had to. Plus it happened outside the garage his friend works at and assumed it's on CCTV, which it was, that's how the police got his number. Accident aside, can the police take his car like that, then say he has to pay a hundred odd pounds and twenty pounds each day they have it? His wages were low and he couldn't. All this happened on the 23rd of December where he hasn't heard anything about it until two days ago when a summons to go to court and a charge of due care and attention is being charged against him, even though he said to the police on the 23rd of December he doesn't know why or how it happened? It's been four months now and it's come out of the blue?

Hi guys, I have a car on finance and due to moving I have not been able to get letters for the car and apparently I have missed 2 payments, I had a phone call today from a 'warrant officer' saying the finance want the car back immediately or the full balance and the finance company is failing take my calls. I spoke to the warrant officer and they said if I don't give him the car he would report it stolen to police who would arrest me? He also said I could get up to 7 years for it!! Surely this can't be right.. Also I am not refusing to pay or give the car back as originally he said I have a week but now I don't for some reason and I though a week was reasonable to get it sorted. Any advice much appreciated and if you need any more details pleas let me know.
  3. The following news story featured this morning and concerns an area of law that I am not too familiar with regarding bailiffs seeking to evict squatters. As you will see form the 'word' version of the story, police arrested the bailiff for apparently "not having the sufficient order to enter the building" http://www.yourlocalguardian.co.uk/news/11025731.Squatter_threatens_to_jump_from_rooftop_during_police_standoff/?ref=var_0 A squatter staged a rooftop protest and a bailiff was arrested after a stand-off in Richmond on Wednesday afternoon. The bailiff, a 30-year-old man, was arrested after letting himself into the commercial building, 127-133 Sheen Road, by putting his hand through a letterbox to undo a latch. The arrest came after the road was closed in both directions, causing major traffic problems, after a squatter locked himself on the roof of the three-storey building, threatening to jump unless people left. Police arrived at 3.54pm to find squatters and bailiffs in dispute. Squatting in a commercial property became a civil matter under Section 144 of the Legal Aid, Sentencing and Punishment of Offenders Act 2012. The one-man rooftop protest took place at 4.30pm, with police closing Sheen Road in both directions within minutes. London Ambulance Service and London Fire Brigade were both called. A Metropolitan Police spokesman said: “The squatter came down from the roof by 5.30pm and told police he had not really intended to jump. “The bailiffs from Kent did not have a sufficient order to enter the building and were asked to leave by police. “A bailiff who accessed the building via the letterbox a few hours later was arrested at 7pm for entering by force. “He was taken to Kingston police station and has been bailed to return at a later date.” The road closure caused major disruption to traffic and buses. The squatters presently remain inside the building, according to police.
  4. I am a litigant in person and a defendant in a civil claim in the high court. The judgment went against me based on a witness statement of Mrs X in support of the Claimant. Mrs X was not present at court and her witness statement was only made available to me 30 minutes before the hearing on February 3rd. During the hearing, the solicitor of the Claimant informed the court that he had made contact with the witness. Following enquiries at the address supplied and at the place of work stated in her witness statement, Mrs X is not known at either. A check on the voters register revealed no such person. I've written to the solicitors and questioned them about this new development and they've failed to respond. My obvious and only conclusion is that Mrs X does not exist and the witness statement of Mrs X was indeed made up. Should this matter be reported to the police or to the court? And if reported to the court what is the likely process involved? I Thank you
  5. Hi guys, So I attempted the most stupid thing in my life which was to shoplift from waitrose. The stuff was £9.99. I was caught after I exited the shop and was taken to the camera room by a guy dressed in civil clothes. They told me that they'll resolve it in the office so they did not call the police. I was asked my address ,name and date of birth but they didn't ask me for ID or make any scans of my ID. They gave me a document which banned me from waitrose and another which was from RLP. They told me I will receive the fine in the post. They took a picture of me and sent me home. My question is, since the police was not involved in any way and they didn't take my ID details, will this case show up on an enhanced CRB check? I am extremely worried and cannot get this out of my mind. I just want to pay the fine and make it a part of history. Any help would be welcome! Thanks!

  8. Thought I would post this recent video that was added to Youtube. Hounslow Police working with bailiffs to stop vehicles with outstanding PCN's. I can understand that the Police have an interest in this, because they will be indirectly funded by revenues received from PCN collection. i.e the Police are funded by councils that issued the PCN's. However, I would question the legality of this. Although the Police have the legal right to stop vehicles, surely they are restricted as to the purpose of such stops ?
  9. after many months of anguish we reported our next door neighbour to the council for noise as she has 4 Chihuahua dogs and they are constantly barking and yapping for extended periods of time on a daily basis. About 2 weeks letter we get a telephone call from a Social worker saying that my next door neighbour has reported my 15 year old son to the police for exposing himself to her 2 young daughters who are 5 and 7 years of age during mid summer. The social worker stated that the police will be coming out to our home to speak to us and our son regarding the allegation. We have questioned him and he denies it outright we have warned him of the seriousness of the allegation and the potential consequences yet he still is adamant he has done nothing, my son is one of those who finds lying incredibly difficult so we are convinced he is telling the truth. My question is what should my next course of action be? Can we ask the police for the interview to be recorded? should we need it later down the Line. Can we arrange for it to be done at the Police station instead of our home?
  10. Hello, i am totally new to CAG and need advise. I am currently Nader police investigation for alleged piece swap where tkmaxx has CCTV passed to the police showing I bought items and returned other items under same receipts. I recently had a baby and as soon as I could get out of the house I went on a MAD shopping spree period over a couple of months where I was buying on credit card loads of items then return majority of them. On some occasion I would take the price tag off and then return the items within the allowed time having changed my mind. If some price tags were changed it was done completely innocently with no intention of wrongdoing or causing the shop a loss. One day I was at home alone with mu baby and the police came to search the house, they asked for Ll items I had purchased at tkmaxx recently and they seized them together with credit card statements and purchase receipts found. Same day I was interviewed on tape by police where I was finally told what the allegations were, I denied any wrongdoing and told them that any wrong price tag swap was due to the large amount of items bought and not remembering which one went where. They had a list of about 10/12 items for which tags may have been swapped at a loss for tkmaxx of approx £260, some of which tkmaxx are saying they were either not purchased from them or they are not fit for resale. About a month or so later I was called at the police station again for another interview when they showed me the CCTV and told me they could not understand how someone could make such mistake so many times! I continue saying I did to do any intentional wrongdoing and that the stress of having a baby, tiredness and being disorganised had caused this possible mistake. On both occasion the police told me to wait to hear more about their decision (I was told it could go to court). The items credit card and receipts seized are still in their possession. In the meantime while I'm still waiting for a deliberation by the police, I have receive a letter from RLP banning me from tkmaxx for like and asking compensation of £487. I have lost a lot of sleep over this and I'm starting to become ill with worry, I went to the CAB yesterday and told me to reply denying liabilities to the claim and seek legal advise. I have since spoken to a solicitor who told me to reply to RLP making an offer of part payment as they/tkmaxx could take me to civil court as there is also the possibility I can be taken to criminal court by the police due to the number of items... Over a week has passed for the date on the RLP letter and I still don't know what to do, threads I read seem to suggest to ignore them but my husband is scared they would pass this to the bailiffs. I am on maternity leave at present and instead of enjoying my time with my baby I cannot focus thinking of what could happen to me. I have never been involved with the police, my credit score is immaculate and have no debts. Can RLP access my salary and bank details to see if I can pay them, can they tell my employer to sack me? I have a very good job and cannot afford to loose it when I return from leave. Thanks so much to any advise you can give me, I'm totally confused with all different angles I have been given/reading.
  11. Hello, I have been a customer of "PerfectHome" for about a year now. I have just missed 2 weeks payments due to being out of work and now have them knocking at my door. I have buried my head in the sand and avoided them as they have put a note though the door saying that they are going to contact the police as the goods still belong to them. Are they allowed to do this and what rights do they have? Thank you in advance

  13. Hi, I need some advice. I had a PCN that was unpaid and lead to baliffs being assigned. I contacted the courts on Friday 25th October as I had not received some mail regarding the PCN's and they placed a hold on any further action being taken until they could investigate. I was advised that the balifs would be called off until the courts could look into the issue. On Saturday night at approximately 9.30pm I was stopped in my car by police who advised that the car I was driving had been reported as stolen. I showed them proof that the car was mine and that I had not reported it stolen. They advised me that the car had been reported stolen by the Baliffs company as a clamp had been placed on the car and removed. I told them that no clamp had been placed on my car and explained that even if one had been on it, it would not make the car the property of the bailiff. I tried really hard to reason with the police officer but he did not want to to listen. He said that "I am going to have to arrest you for theft of a motor vehicle, but won't hand cuff you because you have been reasonable." I was read my rights and placed into the police car and driven to the police station where I had my finger prints and DNA taken. I have never felt so humilated, even other officers were saying they did not know what i was doing there as it was a civil matter. I was held in a police cell for 11 hours, whilst there the police went to my home knocked on the door and gained entry, my bedroom door was locked with a key so they kicked it in and searched my room. They took photocopies of the PCN notices in my room. During the interview they tried to tell me that they could do me for criminal damage as the clamp had been removed (according to the baliff), they found no clamp in my house and no eveidence that a clamp had ever been placed on my car. The clamp was supposedly placed on my vehicle on Friday night but I have never seen a clamp on my car, according to the courts all action should have been ceased until further notice as of that friday morining. I left the police station at 11am Sunday 27th and was told that the were going to hold onto my car until the 15th November for a court date. I called Sunday evening and was told to come for my keys and that they were going to throw the case out, I was told that if I had a spare I should just take it as it was parked across the road from the police station. I thought this rather odd. On arrival to the police station i was advised that they could not find my keys and this was case until Tuesday 29th, when i finally got my keys back to take my car. I have all the paper work from the police station stating that I was arrested for car theft and I am really unhappy about my treatment. I know I have a case but any advice on how to move forward would be very much appreciated. Thanks in advance whe
  14. Hi people I need help . I have TV from bayv and been with them for over three year payed off other items ( only ever missed few payment right at beginning through misunderstanding but sorted years ago ). Due to tax credit cut we had to make list of who get payed so we pay ele gas TV licence rent council tax all at reduced rate and the rest of debt had to but on hold until we got sorted . Well this week since 9am Monday we have had bayv rep at our door 2-3 times aday demanding money (£12) I told him from start what had happened but he just said so we want paying and I will come until you pay . I asked not to he keeps coming at 9 am and 3 pm just as school at just over road is opening and closing shouting we own £12 ( very embarrassing ) . Well yesterday he came again 9 am told him to please leave us alone and that he is now staring to course us a lot of stress he said so I want money now I just closed door . He cam back at 3 pm this time more threatening my wife was in bed as she work late nights I asked him to please stop calling he said no I asked him to leave my property he said no I said if not i will remove him and if needed with reasonable force . He replayed I call the police at that my wife shouted out bedroom window to move and get in car . He the phoned someone and said me and my wife threatened to assault him ( not true total lie ) with in 5 min a seconded rep turned up and parked right across my parking bays (remember at his time lots of people about picking kids up ) there stood like mafia out said my door so I phone the police there said someone will come as his is not rite . As I put phone down police came so guess he phone too . I went out and said to officer I will talk to him and him only at this he said get in side in a very horrible tone . Five minutes later the officer just walk into my house with out invite I have very small dog that love to play and like to be fussed the dog jumped at officer and he started shouting at my little dog and push her away and made a kicking motion I told him this is my house and is her home too and not to treat her like that he said he get dog section to take her away . My daughter who's dog it is started to cry . So we could sort this we put dog in garden at his the officer said HE was taking my TV if we didn't pay the £12 now I said we don't have it he said well am taking TV I said he as no right to do that he said I do as I have this uniform on and can do what I like and if I want can use force and arrest me I said he can not and asked what law as been broken and what law was he using he said he dose not need any . At this my got very upset and got £11.40 ( my daughter dinner money and bus fare for next two day for school ) at this the officer went out side and said if we don't pay he getting back up and if needed will force entry . I asked him what law was he using again no reply I asked this many many time with no reply . My wife came out in bits and give rep £11.40 the rep said its £ 12 or nothing at this I took money back . The officer said right am taking TV I said no you not . The bayv rep said he can take TV as we have payed less then a year on it . I said no way it's over two year he went on his little computer and said opps you RIGHT at this there change tack very quick . The officer jump in van with rep and talked aw by way officer refused his name and kept moving his shoulders so could not get number properly . While all this his going on in street all the neighbours came out very imbarassing . I went inside my wife asked what was the officer going to do he just laughed at her blow her kisses wink and drove off laughing . The rep move up the road and stayed there for around 15 min . This as to stop I now have no conferdance in Cleveland police and will never ever again let them in my house not that I let them in this time . We are now very upset stressed and my daughter would not go out last night scared that her dog was going to be took away ( more worried them if I was getting took away lol ) .   15. Hello everyone Thank you in advance for any information you can possibly provide uswith in our time of terrible stress and worry. The 'scenario' and subsequent journey of events and processes we have takensince. On 5th of September 2013 my wife was driving our family car with our 2children out of town in the early evening and was stopped by a marked policecar (I believe a traffic car). The officer informed my wife that they hadstopped her due to their computer registering the car as uninsured, this wasobviously at the time a complete shock, and of great concern and worry shewas apparently uninsured. She explained that we had 'taken out insurance' on the 9th of May2013 with esure (via the internet search engine Moneysupermarket). Theofficer immediately asked my wife how she/we had paid for the insurance(obviously thinking we had paid one installment then cancelled the policy andcontinued to drive, guilty until proven guilty!!!) my wife informed him we hadpaid for the insurance in one single upfront payment, and asked himto please check again. He did return to his car begrudgingly andfor a good 10 minutes we can only assume spoke to the insurance company. He finally came back and said the insurance policy had been cancelled andtherefore the car and thus my wife driving were no longer insured and so thecar would, (and was) immediately seized leaving my wife and 2 childrenaged 7 and 4 by the side of the road (to add to the situation it was my son’sbirthday and they were coming back from a cinema treat, both were in floods oftears and very traumatized by the whole incident) They would not take my wifeand children home but did stay with them until a neighbor could collect them. Due to the lateness everyone finally returned home we couldn't do anythingthat evening regarding contacting insurance companies etc, so the following hashappened from the 6th September. Due to the way esure work everything seems to be done via the internet/emailso the very first thing we have done is check all correspondence we have hadfrom them in this way. We have received ONE and only one email Dated The first two paragraphs read Thank you for choosing esure brokerfor your car insurance policy. Your cover will start from: 00:00 on 09/05/2013and your reference number is 6847 - ******-**** How much is my premium? £***.** has been taken from your creditcard ending ***** Thank you It then continues You just need to wait half an hour sowe can create your documents, including your Certificate of motor insurance,policy schedule, policy wording and key facts. Reassuring we had hoped? We have used their ‘online account viewer’ to see what documents we couldprint/download in our defense, and very worryingly they have denied access andremoved the certificate of motor insurance? We then contacted them by phone and had the following (condensed for yourreading) phone conversation Has our car insurance been cancelled? Yes Could you tell us why? No Why not? I’m not obliged to tell you Why did we not get any warning this was going to happen? We did warn you via your postaladdress We didn’t receive anything in the post where did you send it? Answer the wrong address, they hadsomehow (and they say through moneysupermarkets information) sent it to our oldaddress which we have not lived at for over 2 years!!. Why did you not contact us through any other means ie email? or phone? Nothing, they then very oddly unpromptedoffered a full refund and basically didn’t want anything else to do with us andwere very very rude and aggressive towards us. Theystill have our full initial one off payment, I don’t want it but I do want to stillbe insured!! Everythingto do with the car I.e. V5 registration, tax and my wife’s driving license, allstate our new address. The car has been insured at our new address previously.What is very strange is the police officer told my wife she does have a golf insured, my wifecorrected him and said we did butthat was over 3 years ago?? We arenow without a car, my wife especially is facing a very worrying and verystressful time with police and court processes to deal with, we have aninsurance company that don’t want to talk to us and the prospect of points onher license and financial penalties now and when we try to reinsure a new car. Aboveall this it has really affected our 2 children as they witnessed were involvedin the whole procedure What dowe do now?   16. A month ago I stole £12 of make up from Boots and was issued a fine through RLP which i have paid. I was told at the time that the police wouldn't be involved but they rang me up today saying that i needed to come into the station but i won't be taken to court. I am 17. What will happen and why have they been informed?
  17. HI, I was wondering if anyone here would give me advice on how to deal with the bailiff. I got a fine from the Magistrate Court and I had an arrangement of paying the £318.10 fine in instalments. I started paying my fine (£20 a month) since December 2012 up until June 2013 when I stopped getting money. I am a care leaver and I was supported by social services until I turned 21 in June and I am not in full time education which therefore means that they couldn't support me anymore and I had to apply somewhere else which am still in the process of doing. I got a letter saying that I had to pay £283 in 14 days or else the bailiff were coming to my house to collect goods that are equivalent to the outstanding amount. I called them and spoke to at least 3 people trying to explain to them that I had no other ways of paying for my fine since I wasn't getting any money at all and none of that helped. I even got my social worker to explain it more but that was a waste too. yesterday they put a letter through my door that said they will be coming to my house with locksmiths and the police and this time the money has gone up to £498.10. I live with my aunt and she is on benefits herself so she has no money to pay for me and I don't own any goods at all. When I called the bailiff who put the final notice through my door he said he'll come next week and he can take anything unless we show a receipt to prove that its not mine. we have no receipts. So please if anyone knows anything about what to do in this situation, your help would be greatly appreciated.
  18. For reasons that will become obvious I cannot name the debt collection company or the retail company. I have dealt with a number of D.C.A,s in the past. (with lots of help form this site). A friend of mine asked if I could help a young woman who had received an assignment letter from XXX. I had not heard of this company before but after careful research into the people on the letter one of them was well know to this forum, so I decided to see what i could do to get them off her back. My first action was to get a copy of their assignment letter and details of the woman's account with the retail firm the the D.C.A had used. The woman stated that she had no account with the retail company. Via e-mail I sent a copy of the D.C.A,s assignment letter and the womans details to the retail company stated in the assignment letter. They Gave me an answer within 10 minutes and clearly stated that the woman I was helping was not in any way connected to the company, did not have an account and they were very angry that this D.C.A was fraudulently trying to claim that they representing them. they asked Me to provide them with more details. When talking to the woman she told me that her ex partner had an account with this retail company and after looking at some old statements found that the amount that he owed was the same amount that the D.C.A was after. after some thought I e_mailed the D.C.A And asked them If they could chase a debt for me. I cannot go into the specifics of their reply but for £12.45 and no questions asked they would send three letters and make three phone calls (door step calls extra). I did not need no proof of debt Just a Name. I sent what I had learned to the retail company thinking I had proved that this young lady had no debt and that was the end of the matter. However the Company have now informed me of the crime numbers given to them by the police. The company reported the actions of both her ex Partner and The D.C.A. Since the police issued the Crime numbers the D.C.A has gone from the net all you get is error 404. the phone line are also gone I,ve checked. The Police want to speak with me! I dont want to be involved what can I do
  19. Two days ago my niece asked me to look at her 9 year old daughters laptop as it had locked up and was asking for money to be unlocked. She said it happened while she was watching a YouTube video of Britains Got Talent. What she had was a particularly nasty virus known as 'Ransomware'. It locks the computer and demands money to 'unblock' the computer so it can be used again. Like most, this one came in the guise of an official site with lots of police badges and the name Metropolitan Police, it accused her of distributing child porn and wanted £100 to be paid by Paypoint. Luckily at her age, she isn't aware of what kiddie porn is but the police references and the menacing voice demanding over and over that she must pay £100 fine did scare her. I class this as Fraud and Blackmail, but the authorities aren't interested. There are at present a couple of men in the North in prison for doing this sort of thing. On contact with the Police, they weren't interested and said 'we don't have anything to do with that any longer and to ring Action Fraud. I rang Action Fraud, who is the government sponsored department that deals with cyber crime and was given a crime number and then bye bye. No attempt was made to ID the culprit nor any questions asked or requests made to send them details. That brings me to make the statement that this, (like most other Government departments), is useless and not worth the money they are costing us.
  20. A police force must stop using number plate recognition technology after a warning from the UK's data watchdog. The Information Commissioner's Office said Hertfordshire Constabulary's use of cameras in and around the town of Royston was in breach of the law.   23. My daughter had a hired car from her work place whilst a mechanic worked on hers, on Saturday night she drove into a car park to go to a local store, it was closed so she then left. Today 1 CID officer and 1 in uniform turned up at her work and arrested her, she had phoned the police this morning when she had found out they had contacted the garage and offered to go to the station after work, she was told that was not acceptable, as a HUBCAP (1) was stolen off a car in the car park. The car she was driving was seen on CCTV entering the car park, they phoned her work to find out who was driving the car hence arresting her at work. They came to the house to inspect her car, as her car was the same as the one who had their hub cap stolen, she has plastic hub caps and the one stolen was metal. They then took her to the police station where she was kept for 3 1/2 hours being questioned about this 1 hub cap which would probably cost £20-00 to replace. She is now worried about going back to work in the morning in case she gets sacked for being arrested at work. The police eventually released her with no further action. Whilst I agree if you have items stolen then it should be investigated but I am just after an opinion if others think this was a bit over the top. She is a young girl who if she wanted hub caps as she works for a garage would get them from there. She has just cried herself to sleep over the embaressment of being arrested at work.
  24. I need help.... The other month I was driving around a roundabout in Essex and went past 2 police officers on motorbikes. I was followed by one officer and he pulled me over and the officer said I was on the mobile phone. I explained that the van has hands free kit fitted as standard by mecsedes (2012 Mercedes vito). the officer still charged me with the offence by the road side, I said I wanted to go to court to defend that I was not holding the phone. as a mobile engineer I spend a lot of time driving from site to site contacting customers and the office, and was chatting hands free at the time of being stopped. after a few week the police witness statement was sent to my address, and the statement says that both officers was about 15 meters from the road side. they said the both was able to view me drive by for about 2 seconds and had a clear view. but one officer says he saw me with my right arm holding the phone to my left ear!!!!. the other officer says he saw me hold the phone with my right arm to my right ear. I have been back to the site where the police officers was parked up and measured the distance from the road and if they was 15 meters from the road would have been set back behind a gate and a mud bank. their view would have been of a side view as passed them. they would not have seen a clear view up the road. I have checked the tracker on the van and shows that I travelled from stationery start and covered 200 meters and the average speed was 28mph . I would say that I must have passed the officers at over 30mph. I have to attend court at the end of this month and both officers are to attend and give evidence of what they both see. CAN the officer change his statement in court after he has signed his first statement saying he saw something different to his colleague. a minor note: when the officer at the side of the road said he sew me on the phone I said I wasn't and when I said the van had hands free the officer had a 2 second pause for thought before saying "your still getting done for it"

My brother died last year and because he died alone and was found by me thepolice took some of his things (PC, 2 x Memory cards & his mobile phone).13 months on and the inquest was held in January and no suspicious circumstanceswere found, we are still waiting to get his things back. I spoke to the coroner’soffice today and they have lost his property (except the PC) during a move atthe station. My mum, who is 68, is distraught as the memory cards had photos ofhim on them that were not on his computer. If anyone knows where we stand orwhat we can do about this I would be very grateful if you would let me know. Thanks
