  1. hi i was pulled for using phone whilst driving, i went to pay fine at court and was told i cannot pay fine as police officer had not correctly filled in ticket, she had not put 3 points next to fine amount, court clerk took photo copy of my ticket and said he will contact police and if i dont hear from them within 4 weeks i was to contact police. where do i stand is ticket invalid and can i escape prosecution. incident happened in scotland. thanks for any info .jim

    Driving License

    Hi all. I hope you can help me. In November 2009 i lost my driving license for drink driving. Hands up i committed a crime paid my fine served my 23 month ban and hoped to continue with my life. 2011 took DVLA medical and got license back for one year Passed medical again the following year and got license back again for a year. In May 2013 i went into a rehab clinic as drink was starting to become an issue in my life and have not now drank for 6 months . This morning i received a letter from DVLA to inform me that my license has been revoked as im not 12 months alcohol free. Can this really be the case and do i now have to lose my license for simply trying to put my life in order ? Thanks
  3. Hi My provisional is registered to a flat I still own but don't live at; test is booked for 2 weeks time, have filled in the counterpart but not sent it off, will I be able to take the test having amended the change of details section? Please help!
  4. My Brother in law, has just been caught driving on a provisional license. The circumstances behind it are. He owns a car, in which he practices driving with a qualified driver, it is fully taxed, mot'd and insured. He was asked by a disabled man, whom he has known for a long time if he could take him to a local shop to collect a washing machine as his had broken down, this man had held a driving license for a number of years and to his knowledge still held this license, it was only when they were stopped by the police the man told him that he surrendered his license under medical grounds a couple of years before. Obviously when questioned by the police, he explained that he did not have a full license and why he was driving, while sympathetic their hands were tied and they had to impound his car. My question is, is there any point in him trying to plead mitigating circumstances? I (and he) knows that ignorance to the law is no excuse, but he just presumed that because he had seen this gent driving daily since he was a child that he still had a full driving license. In reality all he wants to do is avoid the points on his license so he can continue to learn to drive and get his full license. (6 points for driving without insurance - insurance invalidated due to not having a qualified driver) Many thanks in advance for any advice.
  5. Does anyone know the full list of medications that the new law will apply to. I know that the stronger pain killers, and anti anxiety medications are included but there are a great number of both over the counter and prescription medication which can effect driving ability. I have already stopped driving because i feel unsafe. My wife is on a number of medications that warn of possible effects. How will this law be implemented because the effects of the same drug vary greatly from person to person.
  6. Hi all, I was wondering if anyone could offer some advice. A few weeks back I got an NIP in the post asking me to name the driver for a speeding offense, (79 in a 60 zone), which is fair enough. My car could have been speeding. However, the problem is I don't know who was driving! It could have been me or my wife. We're named on each others insurance and often share the driving. I'll drive there, she'll drive back or vice versa. The thing is, we don't know the direction of travel when the offense took place and given we'd been on the road where we were caught several times that week, we genuinely can't remember who was driving as we have no set pattern. Sometimes I'll get the car keys first so I'll drive, sometimes my wife. Other times we'll ask the other to drive there and I/she will drive back. Neither of us saw anyone at the road side with a speed gun and we didn't see a van parked up so nothing stands out to identify the driver. We both accept that we could have been speeding but it boils down to a question of who was driving at the time. Even the direction of travel wouldn't help as neither of us can distinctly remember who drove there and back. Add to this we both carry our keys on us which on the bunch has keys for her car and mine so having possession of a key doesn't help either. I've filled out the NIP naming my wife as the driver and offered a covering letter explaining the above. What's the likely outcome of this? I know this could be used as an excuse but at the end of the day my wife and I do share the driving a lot and the road we were caught on isn't an unusual road for us to be on, we're on it several times a week and have been known to travel to that town two or three times in one day sometimes. What's the best course of action to take here? I'm happy to take the points and fine if I was the one driving as is my wife if she was driving. But we honestly can't remember who was driving.
  7. Hello and thank you in advance for any advice you can give me. Last year my son recieved a driving ban with a fine of £475. He was ask to wait to make a statement of means. This never happend and after asking several different people was told to go home, Which he did. Because of personal problems ie splitting from partner and spending time on different cousins sofa's the paper work never got to him. On Thursday 1st August a letter for my son came to my address, He has always told me to open his letters incase they are urgent. It was a Further Steps Notice dated 16th July giving him 10 days to reply. As you can see from the date that time ran out on the 26th so the letter did not reach us in time to act. I rang the number on the letter and was told it was to late to pay as it was already sent to a bailiff. I would have to deal with the bailiff, Whose number she gave me. I should put here it was Marstons. I rang Marston's who said it was not yet in their system and to ring back on Monday. They said when it did show they would want the money in full. It has now occured to me that because the letter came here the bailiffs will come to my home to get the money. I own the house and all it's contents, My son has no belongings here because it was all left at his former partners house when he left there, All he had was his clothes. I have two questions , 1st What can I do if they come to my house? apart from not letting them in. 2nd Can my son still apply to the courts to have a means hearing or make a statment of means so he can clear this debt. We do not have the money to pay this in full, So I can't pay it either otherwise I would and he could pay me back Hope you can advise me Lilly.
  8. Hi folks, This is my first ever visit to this site so please be gentle My Mums rather stupid ex partner was caught drink driving (driving from pub to his house) a couple of weeks ago. I dont know what he blew, my Mum never asked him, but they went through all the normal procedures-he was arrested, charged and was up in court last week. He told my Mum, who by the way has never driven and has had her mind warped by this guy for the last 8 years, that he had NOT been banned and only received a fine. She believed him until friends and family told her otherwise. He HAD been banned but was still drink driving and the idiot got caught AGAIN 4 days after he had been in court for the same offence! Does anyone know what kind of sentence/conviction/penalty that can carry? Also is there a forum on here where i can get advice for my Mum re harrassment as the guy ive mentioned has been following her for the last 3 years since they split and is aggressive and controlling and getting worse. Shes been nice to him just to keep the peace because she scared to death of this man. She found him snooping around the outside of her house the other night and the police are involved but she is scared of any repurcussions as hes a very nasty piece of work. Thank you in advance
  9. Hi all, i am new on here just need some advice please. I took an 18 ton lorry down a 7.5 ton limit and got caught, this was on 25th jan 2013. Have got court date of 20th august 2013. This is 7 months, i have been told they only have 6 months to get you into court is this correct. Any advice greatly appreciated. Thanks.
  10. I work backshift, driving for a total of 5 hours, It is not possible for me to have a break during my 'run' which starts 2 hours into my shift. Am I entitled to a break before my 'run' starts.
  11. I was seen by an off duty police officer using my mobile phone and no seatbelt. They sent me a letter stating I can goto court or plead guilty in writing and without going to court.. Does anybody know what the maximum penalty/points this could carry? Somebody mentioned that if you are convicted of more than one offence you'd get points for 1 of the 2 offences, whichever carries the most number of points? Is this correct?
  12. I was driving on a country road when my drivers side tyre burst. All my tyres were in good condition. After a violent swerve along the hedge, it was too dangerous to stop on the narrow winding road so I drove on for half a mile, then changed the tyre. the original tyre was completely stripped and the wheel damaged. there was major damage to the wheel hub and the garage have just told me the supension is damaged too The insurance company are implying that the tyre was illegally worn and i am very concerned that they will not pay but the damage to the tyre was due to driving too somewhere safe to change it. did i do wrong?
  13. Hi there, wonder if anyone out there can help me. I had to report my counterpart driving licence lost and to register a change of address a week ago. I thought that going through the local DVLA office would make the process a little bit quicker. I could not do it online as I do not have a passport. The member of staff at the DVLA office said 3 weeks but said that they say 3 weeks to cover themselves, however, I have had stuff back from them an awful lot sooner In the meantime, out of the blue I have a job interview with more than a good chance of getting the job, in a couple of days with an agency who insist on using my driving licence for an identity and address check, I have been told that if I don't produce the licence, I don't get the job. I phoned DVLA in Swansea today explaining the situation and they were quite unhelpful, I was told that there was nothing on their system and there was nothing they can do about it and to wait the 3 weeks. I'm sure that there must be something on their system especially as a week has gone past as I handed everything into one of their offices and I know of people that have got them back within a few days. Anyone have any idea of what I can do? I don't want to lose the opportunity of this job as I have been unemployed for 8 months and jobs are harder to come by these days. I explained this to the DVLA person and she could not have been more bothered even if she tried. Many thanks in advance.
  14. hi all i am new to this so please be nice right i will start from the beginning i sold a car to a lady on the 30th september 2012 got the cash for it thought end off filled out the V5 log posted to the DVLA job done. i contacted the DVLA after 3 weeks to inform them i never received anything from them they said i should write a letter detailing the date i sold the car who the new owner was etc etc which i done. i got a letter back from the DVLA with copies of the letter i wrote to them they sent me a letter confirming i was no longer the owner of said car from the 30th september 2012 and i thought that was the end of it. i then received a penalty notice from TFL with 2 pictures of the car that was clipped by a camera driving in a bus lane on the 9th of october. I immediately contacted TFL to inform them i sold the car and i was no longer the owner the of car from the 30th september so there is a mistake they replied there is not a mistake and i should pay the fine or appeal. i appealed the case and informed them that i sold the car etc etc. they denied my appeal stating as far as they are concerned i am the owner of the car at the time of the offence and doubled the penalty fare to 160.00 i immediately phoned them and said i was not paying i am not the owner i have proof from the DVLA that i sent into them copies they replied on the phone and i quote "we contacted DVLA and they informed us that you were the owner" these are lies i pointed out and the DVLA would not give confidential information like that over the phone to anyone i was told you either pay or it can escalate. i then called the DVLA to confirm what i was told and they informed me they would never give any details to anyone TFL were only trying to scare me to pay the fine and the advised me not to pay. yesterday i had a letter left by a bailiff regarding this demanding that i either pay an outstanding fee of 557pounds or they will seize goods at that value this has totally shocked me i called the bailiff as he left his number informed him of what i have been told informed him i have written proof from the DVLA that i was not the owner he rubbished that and said he hears it all the time people buy cars get caught then sell them on write to the DVLA saying they weren't the owners at this date etc etc and that i need to pay him i told him to go and take a swing and jump i am not paying as i am not in the wrong if i was genuinely caught fine i would pay , but when i have proof from DVLA in writing and on the phone that i sold the car on the 30th september and this car was caught on the 9th October then i clearly am not the driver. my question is what should my next step be to get this resolved i am not paying a penny to him he can go get lost. also i am in two minds to complain about TFL harassing me with this stressing me out and more importantly liying to me down the phone can i sue them or who can i complain to about this
  15. Hi interested in comments of an incident. My 17yr old grandson was passing a row of slow moving traffic approaching a roundabout when one of the cars turned right into a cul-de sac, without any indication or obviously checking their mirrors causing my grandson to collide with the car throwing him over the car and hitting a wall. When the police arrived he was put in the police car to say using bullet answers as to what he thought happened and was as we found out later charged with this offense even though he cannot really remember what was said in the car. We have had no contact with the police officer until the summons came through 4 weeks later surely the PC should have contacted him at home and taken a proper statement from him bob

  17. I was stopped last year for driving without insurance. This was partially my fault, as the insurance company did not send a notice to when the insurance had expired and it was a matter of ONE day. My licence was revoked under the new drivers act and 6 points were given to me. I received my provisional with 6 points on there and have retaken my theory test and am now waiting to take my practical test. Now I did a dumb thing today and drove the vehicle alone. I was also speeding, doing 54mph in a 30mph zone (about 20 other drivers were also pulled over) by traffic police with radar guns. They did not question me on the licence part which I am glad about but they seized the vehicle again for having no insurance. Now here's the tricky part. I am the registered owner of the vehicle, but the insurance that the car had was under a family members name as I have not been driving it. How do I get the seized vehicle out of the impound and what will happen to me? I am due to retake my driving test in June, but I may postpone that until this is all sorted out. I know this is my fault and I acknowledge that and it was a really idiotic thing to do, but any help and input would be greatly appreciated.
  18. hi, this is quite a long story but i will keep it brief. i split with my ex at the end of January. when we were together i got a new car and i had no problem with her driving my old car while we were together as hers had seen better days. I continued to pay the insurance on it and also the loan on it.. so all she had to pay was for fuel. When we split she said she would pay me an amonut per week to cover what i was paying on the loan for it (this loan ends jan 2015). However, and as of today, no payments have been made to me despite me chasing her for it. This lead me to inform the police of the situation as i felt technically she is now driving a vehicle without my permission. I also cancelled the insurance on it when we split, but gave her notice of this to allow her to insure it herself. When i contacted the police and explained, their initial enquiries showed it looked as though the vehicle was not insured and they said she admitted she was driving it but that i had "gifted" her the car (which i hadnt, id only let her use it while we were together to give her time to get her own). the police advised that this was irrelevant as the log book and loan for the car were in my name. However when the police heard an "agreement" was in place where she would pay so much a week for the car they withdrew the legal support saying this was now a civil matter as technically because she wasnt paying this had caused the problem. Although not the ideal thing to hear, it leaves me wondering what next.. I want to cover myself legally, i dont want to let her have the vehicle as im already paying catallogues which were in my name for goods which she has kept in her house (this i dont mind). this exceeds the value of the vehicle. But the situation is this.. I have a vehicle in my name, im paying an outstanding loan every month on it, and it appears (according to the police) that it isnt insured. How can i either get my car back, or get it scrapped or something so that it is off the road? The tax runs out end of september so could i declare it SORN then if all else fails and let DVLA know of the situation? PS i also dont have a spare key so i cant just go and take the vehicle. Any advice appreciated.
  19. I received a summons for a careless driving charge, which is due to be heard this weds. It relates to an incident last November, where I was speeding & did a stupid undertake-overtake on a dual carriageway. I was subsequently pulled by a Traffic car, who had video'd the whole stupid incident on an ANPR camera. I've been charged with "due care & attention", with the speed tacked on as aggravating - the speed mentioned in the coppers' statement is "in the region of between 100-115mph".This is not VASCAR, but ANPR - Now I intend to plead guilty by post, the charge mentions "this offence carries penalty points". I'm aware this could be a lot worse, but I can't afford a solicitor, & would appreciate any help with my statement. The copper's statement basically explains that he observed me join the carriageway, & accelerate at speed. He then mentions the above paragraph's range of estimated speed, then documents the undertake of a vehicle in lane 2, & then overtake of a LGV sightly further ahead in Lane 1. I really don't have much excuse for the driving, I am mentioning my previous good character, clean driving record, & lengthy NCB etc. Here's my intended response: Statement On (date removed) 2012 I was driving along *** Road, towards the A**. The road conditions were dry, & the temperature mild. On joining the carriageway, I unwisely accelerated, & inadvertently exceeded the posted limit for a short period. As I proceeded over the ***** Bridge, I approached a vehicle in Lane 2, which was about to overtake an LGV ahead in lane 1. I adjusted my speed to match the vehicle in lane 2, which I estimate to be 60mph. I decided to pass this vehicle in Lane 1, this maneuver was executed within the posted limit. I Then left the A** at the ******* Junction, when a following traffic Police car illuminated it's blue lights & sirens. I immediately pulled in. At no point did my actions cause any other road user to adjust their position. I was in full control of the vehicle at all times. I accept this was the wrong thing to do, & I regret my actions on this evening. I have been driving for 17 years, & have driven many hundreds of thousands of miles. I have a clean license, 17 years' No Claims Bonus, & I'm normally a careful, considerate driver. Now, this was a stupid lapse of judgement, I had been tailgated just prior to this & was p***d off about it, & drive stupidly for a brief time afterwards. I genuinely do regret it. I've had advice from another forum suggesting I leave that out, as it's not good mitigation, but I have NOTHING else. Any help much appreciated
  20. Long story short, someone stole my card uk driving licence. Now the police arrested the person and got me my card back. Unluckily for me the person snapped it in half, but the police taped it together and returned it to me. It's that destroyed in the middle that I look like dracula or frankenstein. i've got some points coming off in august and i got told that i'd have to pay and send in my licence then to get the points removed. is it worth me just waiting until then to send the licence back? Just i'm going to spain on the same day and ideally wanted my licence so that I could hire a quad with my friends there. i just wondered would I have any other options ? or is paying for a new 1 the only way.

It started issuing photo-card licences 15 years ago and more than 30 million drivers now have one.   23. Hi I had a fine that has now been passed to Collectica and when I spoke to them they told me I have to pay £30 fortnight, I am disabled an unemployed and cant afford that but they told me it is not means tested and thats what I have to pay please help
  24. Friend of mine bought one of those driving experiences for her boyfriend (for Christmas) then split up with him a couple of weeks later. I've been given the job of figuring out if she can get a refund, and since I don't have a clue, I'm delegating the job to you lot: She bought it online in the form of a voucher, which the recipient can then redeem. So at the moment no car/course/date has been booked. The site's T&C say: The DSR cooling off period is 7 days anyway, isn't it? Seems a bit harsh trying to charge 30 quid for something that is already your legal right. Anyway, she's had the voucher for about 2 weeks now. Anything much she can do please?
  25. Hi, I'm after some advice. Yesterday whilst driving home I was stopped by the police for having no insurance. I wasn't aware I did not have insurance, it had been cancelled due to a default payment and me having moved house missed the letter. My car was seized, and I now require insurance to get it back. I have stated IN10 and 6 points and £200 fine for yesterdays date on the online form, but there is nowhere to say it has been seized. What do I do? I have found insurance, whilst stating these offences do I need to do anything else? Many thanks
