Hi I have had problems with Fifty plus so I sent them my £1 PO and requested an original copy of my CCA They have responded saying When responding to a section 78 request, a lender does not have to provide a photocopy or other literal copy of the executed agreement nor provide a copy bearing or some other proof of the customers actual signature. There is no legal requirement to provide you with a copy of the deed of any assignment. A notice from the assignees, is sufficient under the Law of Property Act 1925 to require you to pay the assignees. This will not carry your signature, as debts are freely assignable without this. So is this correct that they do not have to send a signed copy of my CA your comments please bob
  2. my Daughter 2 years ago used dfh to sort her finances out. She had problem after problem with them over not making payments and sorting her debtors out it got to the point of one of them arranging to put there debt as a secured loan on her house. She gets no statements from them her creditors still contact her but she is still paying dfh. My question is should she cancel her contract with dfh and go with someone else. and is there anything she can do about the dreditor who put the charge on her house as the debt on that loan has gone from £11k om £19k but dfh has said nothing about it can anyone help please with advice as my Daughter is going frantic bob

  4. No what I am saying is my grandson was on a single lane road riding alongside very slow moving traffic,when the car turned right without checking her mirrors
  5. Hi interested in comments of an incident. My 17yr old grandson was passing a row of slow moving traffic approaching a roundabout when one of the cars turned right into a cul-de sac, without any indication or obviously checking their mirrors causing my grandson to collide with the car throwing him over the car and hitting a wall. When the police arrived he was put in the police car to say using bullet answers as to what he thought happened and was as we found out later charged with this offense even though he cannot really remember what was said in the car. We have had no contact with the police officer until the summons came through 4 weeks later surely the PC should have contacted him at home and taken a proper statement from him bob
  6. Hi need some advice my Daughter some years ago got into financial problems due to a broken relationship. My Daughter and my self have a mortgage on the house we live in. she set up an Iva with dfh and is paying them £300 per month plus £30 for doing absolutely nothing and in fact most of her debts are still accruing interest so in the last 5 years of paying this her debt has gone up from a start of £12k to about £22k. I thought that when she took out the Iva the interest should have stopped. it has been suggested that she declares herself bankrupt but my only concern is would we have to sell the house because of this. Or would she be better of contacting her creditors herself and sorting out a payment plan with them. your advice would be most helpful as she is getting very distraught

  8. Hi I am having problems with theses companies due to the cut in government payments due to being a pensioner. I contacted them and sent a financial statement and a letter of offer of £5 per month. I have had lost of calls from premier man sometimes 3 times per day,so sent a letter regarding harrasment there reply said they are not harrassing me and has totally ignored my request. I then sent a PO for £10 for all info on me so I can check and reclaim charges this was sent on the 27th nov by recorded, so when they call I just tell them untill I receive this info I have nothing to say to them. How long have they got to reply to my request and what can I do about the constant calls,any advice would be helpfull bob
  9. I recently paid a large deposit on a suite that was in store,in fact it was an end of range suite,the company agreed to store it in there warehouse until I was ready for delivery. The company has now gone into liquadation and I have had a formal letter and phone call asking if I still want the suite as they have now got to empty there warehouse. The reason for me delaying delivery was a) we where having building work carried out and b) it gave me time to save to cover the balance. Is there anything I can do to delay the delivery as I do not have the full amount available yet and if I tell them I do not want it now will I get my full deposit back As a pensioner I cannot afford to lose money saved. bob

Hi thanks for the advice have looked at the various articles on distant selling sent emails explaining the distance selling regs He is now taking advice on these laws yes he does sell most of his cars on the internet,thats where I seen it I have also been to my bank and requested a charge back which they are looking at bob

  13. hi just a quick question I spoke to a dealer on the phone and paid a deposit of £100 in the morning to hold a car but due to" we buy any car" renegading on buying my car I had to phone the guy the same afternoon and cancel the purchase. even though I phoned just a couple of hours after paying the deposit he says my deposit is non refundable. As a measure of good will has offered to give me a credit note against another car bob
