  1. Through their error they took money out of my credit card account and sent it to someone else's credit card. They have admitted it was their error after three months. They refuse to give me the money back! They haven't received it from the credit card company they erroneously sent it to so they won't pay me back. Do I have rights?

Looks like i've been stung here Took out a car insurance policy on 1st Jan 2015 with Asda money, not realising that my existing car insurance with Insurance factory had in fact rolled over from 2014 to 2015 therefore i was already insured and didn't realise it. Once i realised the error i cancelled the Asda money policy within the 14 day cooling off period, and returned my insurance document to them, expecting that i would be refunded the £125 i had given to them as a deposit, less any cancellation fee which i didn't expect to be much. On April 4th still hadn't heard anything. so emailed them so see what they were playing at as it had been 11 weeks, and 5 days since cancelling the policy without hearing anything from them via mail, phone, or email. They sent me an email stating the following; Hi XXXXXX Policy number: AMXXXXXXXXXXX Thank you for contacting me regarding your refund. The necessary calculations have now been completed. Please find below the breakdown of how this has been calculated: Paid: £125.21 Deductions: Days on cover (inclusive of Insurance Premim Tax of 6%) £30.67 Direct Debit Set up Fee £27.50 Cancellation Fee £45.00 The return Premium due is £22.04. Thank you again for contacting me, if there is anything else I can help with please let me know. Yours sincerely So there you have it. £22 refund for a £125 layout for a policy that was useless and not needed and ran uselessly for 12 days. Two questions spring to mind; Firstly, if i had an accident within that 12 days would i have been able to claim on both policies, if not then it was useless and may have been an invalid policy from day one Secondly i recall that during the PPI thing that one of the reasons for refund was if you had adequate insurance elsewhere aside from the policy you were being sold. Thoughts anyone ? Ombudsman maybe ? Does the ombudsman still charge the company that you lodge a complaint against, and if so is the charge more than the amount that i am looking to get back ?
  3. Hi everyone, On 15/11/2014, I over stayed the set 3 hours set out by Smart Park. Although to my knowledge there is no signage indicating a min/max duration of stay at the car park entrance. Although I may have missed it as it was dark. I have stupidly taken advice from elsewhere and have binned the letter. Yes, I still have the Charge notice reference. I have now received a letter from DRP (Debt Recovery Plus Ltd), with a total demand of £120 or court action. I am now concerned how I stand regarding this matter. Can I still appeal to Smart Park even though this matter has been handed over or do I now need to deal with DRP? I have read a few posts (which I am unable to link) concerning the matter. One of them was actually on this site with a standard copy/paste response for them. Posted by havinastella on 12/2/14. I planned to copy/paste the response as my appeal. However, unsure how this will work now DRP are involved. Can someone please advise? Thanks Chris
  4. Hello everyone, i am currently in a very worried state. Today i was banned from asda for shoplifting. They took me to a quiet room on the side with CCTV which they said took my picture. No Police were called, they simply made me sign a form stating that i was banned from all ASDA stores. They took my student ID and i assume they wrote down some details from it, and told me that my university would be notified of what had happened. The goods were returned to the shop and i offered to pay for them anyways, which the manager declined. I remained very appologetic and cooperative during the whole ordeal. The total item value was £13. For which i only paid £0.70 at the self checkout by falsely weighing it as a different item. The £0.70 was obviously not refunded to me. I am now very worried of the following: -That i will be expelled from my university course. -That it will have an impact on future employment due to criminal record. -Will i be fined (by the RLP according to other articles here?). They asked me for my address but i only gave them a basic street of the student flats where i am living now. They said that it wasn't showing up, i then gave them the postcode for the area which i am unsure the lad even attempted to write down, and it is a pretty large area that the postcode covers. So overall, i am somewhat positive that they dont have my address. I have learnt my lesson and i will never again do anything like this in my life. I am absolutely terrified. I would appreciate any advice or counsel that anyone here could provide. Thank you. EDIT: I have just read that ASDA uses a company called Drydens for their civil recoveries, but i am still unsure if it will apply to me?
  5. Hi, Just after christmas I received 8 Parking tickets due to parking on a supermarket car park during the day, it's across the road from where I work. The car park was free but it seems that Asda contracted Smart Parking at the end of November and my car has been picked up via ANPR. I received most of these PCN notices together delivered all on one day and then several more the day after. In my defense I visit this Asda all the time on every day that my car is parked there, it is convenient as being so close and are not supermarkets supposed to be for that very reason, convenience of shopping.... My visits to the store are throughout the day from the morning, sometimes mid morning and then again once or twice in the afternoon and the last visit around 5.00pm when I finish work. We also use this store for our company stationery/misc. items that I also visit the supermarket for on a regular basis. Unfortunately I have no receipts but I do have proof of all the transactions at the supermarket on my bank statements as I usually pay with one of my bank cards, sometimes cash unfortunately. The amount of spending at this Asda on my bank statements (for the last 3 months) show in excess of £300 a month and some months more. My other main argument is that the first contravention stated on one of the PCN's was on the 26/11/14. However, SP did not dispatch that letter until the 23/12/14 (dated on PCN) and I did not receive it until the 29/12/14. Therefore, how many people keep their receipts for a month after purchasing groceries at the supermarket. If I purchased a bag of a perishable item such as fruit for example at the end of November I would have no reason to still retain the receipt until the end of December as that date had obviously passed the expiry date for consumption on the product. There were not any SP signs displayed anywhere in the car park before xmas that I could see and other people did not notice them also. On the 5th of January when I returned to work they were on every lamp post. Finally, this particular car park has always been free, it has never had barriers or any ticket machine for parking and still does not, it employs the 2 hour limit on loyal customers. If the fee charged by SP should only reflect the loss to the trader then if the car park is free then surely my liability to SM/Walmart should be nil as how would Asda prove that the car park was at full capacity on the dates of contraventions and my parking arrangement cost them money. I would be very grateful for any advice on this matter please and will of course answer any questions very truthfully. Kind regards,
  6. Hi, i'm new here... I've just received in the post today (18th October 2014) a letter from Smart Parking... a Parking Charge Notice saying that on Wednesday 1st October, my vehicle entered the Asda Sheffield site at 08:52, and exited at 16:46... with a picture of my number plate on these occasions. It says I have 14 days from the date of the letter (16 October) to pay £40, then it goes upto £70. Obviously, this is a load of rubbish, as for whatever reason they've not recorded that I left the Asda car park at approximately 09:00 (having purchased newspapers for my next door neighbour... after this I went (in the car) to work, and was at work until approximately 16:30 - on the way home, I popped into Asda again to pick up something else... I didn't keep any receipts (as I don't usually expect to have to return newspapers, and had no reason to expect to get this stupid PCN). I then left the car park again at 16:46. Between 9:30 and 12:00, I (along with around 100 work colleagues) were at our company's Quarterly Employee Meeting at the local Holiday Inn for 2.5 hours - i've got a number of people who can confirm I was there if needed. I was then back in the office and I have work emails I sent out between 14:00 and 15:55 showing I was in the office... and there is absolutely no way on earth I would have parked at Asda all day and then walked down Sheffield Parkway, rather than parking in my own spot in the office car park! So, I know that this is either an error or a con on their part, I just want some advice on how to proceed... having read someone else's response on another thread, it appears ignoring it is not the best option (though on some other sites some people do just say to ignore!). I haven't had any involvement with this kind of thing before, so don't know what POPLA is (that was mentioned on other threads), or what I should and shouldn't say. I had been tempted to go back upto Asda and goto Customer Services, saying something along the lines of if they don't do something to get this cancelled ASAP, I won't be shopping there again, and that'll cost them a darn sight more than £40 a week! But as i've already been upto Asda this morning to do some shopping (before I got the letter), i'm wary of going in there a second time today... in case their camera is 'faulty' again. Any advice greatly appreciated - and just a warning to others who may visit the Asda twice in the same day, keep your receipts!
  7. Recently I went to Asda to do a bit of shopping. I noticed the notice board upon entry to the car park clearly limiting the parking duration to a maximum of 2 hours. I drove around the car park until i found a spot and then parked. I wondered off for an hour and a half or so to do some shopping elsewhere. I came back to the car and changed my son's nappy (in the back of the car) whilst my missus went into Asda to pick up some groceries and essentials. I then realised that i had been parked for 5 minutes short of two hours. I therefore drove out of the space and circled around the car park for a few minutes, drive behind the superstore, drove back and finally picked up my missus from the front of the store (on double yellows) before driving out of the car park. Approx 1 week later i have received a 'Parking charge notice' from Smart Parking on behalf of Asda. This shows the time i drove into the car park, and the time i left. (being approx 2 hours 15 mins). They want to invoice me £40 for this, or £70 if i don't hand out my money quickly (14 days). Normally, i would file this in the bin and ignore completely as a 'speculative invoice' with no grounds for the claim. However, i notice more recent advice on CAG is to not ignore. I have emailed Asda's Executive Relations team asking for them to get this claim ceased. They have asked for a copy of the charge letter and a copy of the receipt from that day, which they will then get in touch with the store to discuss. I've sent them a photo of the letter and a receipt from my shop in Asda today (i haven't kept the receipt from the shop on the day in question). What is the best next steps if the Exec Team don't come back with the answer i want? I take it that ignoring is not the way to go anymore? My mindset is that the car was parked for less than 2 hours and therefore no contract was broken. The car did enter and leave the car park with more than a 2 hour gap, but the signage clearly stated that the 2 hour limit was for parking and not for being in the car park. Hoping someone can help or advise. Cheers.
  8. I'm in the UK, specifically Scotland. Where do I stand here? Bought FIFA 15 for PS4 from Asda yesterday, and it's basically unplayable for me, I have a BT Home Hub and the game lags non stop, even in the menus. Apparently the only fix is to disable UPnP in your router settings. On the basis it's not fit for purpose I took it back for a refund, but they refuse to do so, saying it's company policy to only offer exchange like for like on games. Surely this can't apply to faulty products??
  9. Hi, wonder if anyone can help. I parked at Asda in a different town to mine where you don't have to pay for parking to shop and I didn't realise you had to pay to park. Hold my hands up that I didn't even see the signs and I didn't get a ticket to display. My question is the ticket I was given is so scrunched up I can't even read what the fine is! Is there any come back on this? Many thanks for any feedback.
  10. In my usual weekly online order from asda, I ordered their cheapest vodka. When the order arrived there was no vodka and when I telephoned the store to ask why no substitute had been offered, I was informed that under new government guidelines, they are unable to substitute more expensive alcohol. I contacted Tesco and asked if this was the case with them too and they told me that they hadn't heard anything about this, and they would have substituted. I'm still waiting for a phone call from Asda to quote the legislation on this as I can't find it anywhere and surely, if it's EU law, as was suggested, all the online supermarkets would be aware? I've been given a number to call, 0800 9526060, by Beth on Twitter to discuss this, but I suspect that this is the SA call centre who knew nothing about it when I spoke to them yesterday. I'm still waiting for them to get back to me and I have always had good service from them in the past but, if this is true, I'm considering changing to Tesco. Has anyone else heard of this?

  12. Hi Quick one. Received a letter a week ago saying that I had parked in Asda for too long. This is true! I thought it was 4 hours free whereas it is actually 2 - my fault. But there was nothing on the car and just got the letter through. Basically do I pay? Read lots but all seem conflicting. What do you suggest? Thanks
  13. Hi All..been directed to this site to try and solve my problem. I replaced 4 tyres on my car and bought the exact same size that have been currently on it for the past 3 years (only difference was the brand). I ordered the tyres from ASDA tyres and got them fitted at one of their approved garages called kingsway tyres Once the new ones were fitted and i paid for them, as i was traveling down the road i noticed a noise.. I found out that the new ones were rubbing the arch so took back straight away (max 1/4 mile in total). Kingsway said "not my problem", and to contacted ASDA Asda said "There what you ordered" - its your car at fault Told them about the sales of goods act etc but i think they just laugh at me now when they dont ignore my emails Finally found out that a 265 tyre can be up to 282 in width....nearly an increase by 2 tyre sizes and still within spec!!!!! I now have £400 worth of rubber in the garage and stuck with them and cant get a refund Over 3 weeks ive been arguing and getting the same response and still out of pocket Am i stuck with these tyres for is there something i can do?? Thanks All
  14. Hi Today I received a notice to owner from Smart parking ltd for £70 for unauthorised parking on 23/4/2014 I have several problems with this. First of all there was no ticket on my car that day when I returned to my car. Second they state that the discount period has expired although i have had no notice before today. Also I have only received this today no other letters. I have contacted manager at asda who has told me that the parking attendant wasnt there and would speak to them tomorrow and get back to me. .I wont hold my breath. He said they take photos but as I said I had no ticket on my car. Is it possible they put a ticket on my car then took photo and then removed the ticket. I shop in asda everyday as I dont do a weekly shop but I have no receipt as I don't keep receipts for food shopping. My question is how do i tackle this. All help greatly received.

Hi, I would be grateful if somebody could give me some advice on the following Retired relatives were parked in a disabled bay in the local Asda (Correctly), one relative has a disabled badge however it had fallen off the windscreen and on to the seat before they left to go shopping in Asda. A few days later(25/03/14) they received a notice from New Generation Parking stating they were being fined £100.00 as (no valid disabled badge displayed) although £65.00 would be acceptable if they paid within 14 days. No ticket was left on the windscreen. Could anyone let me know if disabled bays are anything more than advisory in car parks such as these as surely they cannot hold any "legal" status and are, again, surely advisory only. Could somebody also point me in the direction of the template letters for responding to the Parking Company please and offer some advice on the best way to tackle this "Fine" Thanks in advance Adam
  16. Just looking for some advice. On Saturday I filled up at Asda using the Pay at Pump, filled up with diesel costing around £57. Prior to filling up we had around 80 miles left in the tank. Afterdriving to a few places my husband began our 30 mile drive home from my parents. While driving the car became sluggish, no power and wouldn't go above 60mph. I called our dealer on Monday and it was booked in for checks. Apart from a leak on the water pump all seemed OK with car but they said they suspected fuel contamination. I called Asda and was read a brief over the phone and was told there had been no other complaints about the fuel and that there was no way to prove contaminated fuel. I have had to now pay £324 to the garage for a tank drain, clean fuel line and a new fuel filter. I have contacted consumer direct who have informed trading standards. I have been advised to write to Asda where i filled up and Asda Head Office. So far I'm out of pocket by around £380 inc the lost diesel. Does anyome know what I can do or do I just leave it and take the hit. Many Thanks
  17. Hi there guys, I wonder if you can point me in the right direction... I purchased a pram from Asda direct back in march 2013, over time it has developed a number of faults. I rang asda direct and explained the problems, I was given the choice of a refund or a direct replacement...due to the nature of the faults I chose a refund. We were told to package the pram up and we would receive an email with all the details and the arrangements for the manufacturer/courier to collect the pram. We never received the email. We rang again around 22nd January and we were told the adviser hadn't put it through properly, so again we would receive an email the next day. Guess what?? No email! So again we rang on Thursday 23rd January and we were told the previous adviser had again done it incorrectly. She managed to arrange the courier and said they would collect the pram on Friday 24th January between 8am - 8pm. So I arranged to be there all day....Guess what??? Nobody turned up...I'm sure you can see a pattern arising here! So obviously very annoyed and without a pram for my daughter for a whole week now I rang that evening asking for an explanation and they told me the adviser had forgotten to forward the reference number to the manufacturer so the courier could not be arranged! WOW 3 different advisers were unable to their jobs properly! She said that the manufacturer/courier was closed during the weekend so she would arrange for it to be collected on Monday 27th. I asked if they could confirm on Monday via email for peace of mind. Again I arranged to be there on Monday and waited in all day, I did not receive an email so I rang around midday to confirm that the courier was still coming...I'm sure you can guess what happened next...that's right, the adviser I had spoke to on Friday hadn't even put the request for the courier through! So another wasted day and even more time without a buggy! The adviser then said she would send the relevant email through to them to arrange the courier and it would take between 24-48 hours before I hear back from then. I told them this was unacceptable and this was going to be the last chance. I asked to log this as a complaint and she said she would. On Tuesday 28th I managed to email the courier/manufacturer...they are a company called Obaby, they emailed back the same day and said due to asda directs strict policies they were unable to arrange collection until they receive the correct details, she said she would send asda direct an email again requesting they send over the info they need. In the meantime I had rang Asda house and they explained they were unable to help with Asda direct problems...I also sent an email to the head office CEO of asda but they failed to even bother to reply. I rang Obaby again on Wednesday 29th to ask if they had received anything back from Asda and surprise surprise they hadn't! I explained to them that I will give Asda until Friday 31st and if I hadn't heard anything then I would be sending the pram to the manufacturer myself using a signed courier service and once they are in receipt of it I will give Asda direct 7 days to make the refund before I will be starting proceedings in the small claims court for refund + costs + compensation. I also rang asda direct making them aware of the same thing. I spoke to their legal team to collect the address for making such claim. I have made so many calls and wasted so much time on this...meanwhile our 8 month old has had no buggy at all and we have had to pay additional transport costs. I have just ordered a new pram today as we cannot do without any longer...needless to say we did not buy this from Asda! What I wanted to ask is am I well within my rights to do this? What sort of things can I claim for under the small claims court? Is there a template letter I can use to send Asda threat of legal action? I would appreciate any input anyone can give on this matter. Thanks for taking the time to read this!!
  18. Hello I have to just realized that I have just eaten 14 day old lactose free cream made from cows milk (use by date 12/01/14). I just checked my receipt I purchased it two days ago 24/01/2014 from ASDA. Not sure what is going to happen if I am going to get ill was only now as I was about to put the cream in the recycling bin and noticed the date and realized it did taste a bit funny but I just ignored it. I am worried that I am going to get ill now and getting a more and more parnaode so probably going to make my self ill now.
  19. Heres a copy of an email I have just sent to ASDA "Firstly I know as a CEO of a large company you cannot micro-manage everything that happens. But I am sure you would be interested in a dreadful piece of customer service provided by your company. I am a single dad and have been using your home delivery service for almost a year now. I must admit there were dreadful problems with the first couple of deliveries but they were handled well. As I believe your products are generally superior and better value we stuck with you and things settled down. Until today. We had a delivery Order number: xxxxxxxxxx on Saturday which initially came to £79.70. This was taken out of my account today which should have left me with about £70 (I get paid Thursday). After work I had to pop into Sainsburys (its closer to home) and spend £5.51.To my horror it was declined. After a couple of phone calls to my Bank xxxxxxxxx and your customer service team it turned you had a further "pending" charge of £76.20 which meant I had no money. I was told by your service team it was a mistake on your part but I had to deal with it ! Thankfully xxxxxxxxx were superb and sorted the money very quickly. Apparently they dealt with it so quickly because they are often faced with this problem with Asda. I would welcome your comments." Anyone else had similar problems ?
  20. Hi, My colleague at work has received a parking charge notice from Smart Parking, for parking on double yellow lines at Asda whilst she went to the cashpoint. I read the forums here regularly, so understand that we may be able to successfully defend the legitimacy of their parking fee. Can anyone outline, step-by-step, the process to challenge the ticket, or is it a case of 'Ignore' until/if they move to take it to court? Edit: Just read updated advice on 'Ignore' and will pass that on.

  22. Hi, I hope I'm posting in the right part! My husband & I have had an ongoing problem with a security guard in our local Asda store. My husband worked there when it opened in 2005 for a brief period, the security guard and my husband never had t work together but had a mutual, distant dislike of one another. Nothing was ever said. Cut to last June, we were going camping & my husband was buying gas for the stove, he was alone & chatting to the young girl behind the counter, looks up to see the security guard glaring at him for no reason. on his way out of the store my husband winked at him, patted his stomach and said something like "alright big boy" so the guy rounds on him and tells him hes banned. my husband left with no further exchanges. End of July, my husband, myself & our children, aged 4 & 6 go in, do a bit of shopping, only to be confronted by the same man shouting 'youre banned, you cant come in here get out i told you you were banned' he squared up to my husband, who had a child in each hand and was very aggressive, which upset my children a lot as you can imagine. we left after a few more heated words and we didnt go back until november (this store is literally round the corner from our house so its convenient for quick emergency dashes, i usually shop in sainsburys) When we entered the store on 4th november, we got about 20/30 yards into the store only to be confronted by a young, but very tall and aggressive looking, new security guard (the original one is standing behind his podium thing with his arms folded looking quite smug) so this lad, standing right over my husband says "he says youre banned, get out" so my husband tries to give me the basket and i refuse it, I'm not shopping in a store where im treated like a criminal, by a silly little boy so this lad squares up to me instead, presumably because i called him a little boy, despite the fact i was clearly pregnant at the time. I told him we were leaving, he walked so close behind us he almost took my husbands shoe off, the police were called and we left. i tried contacting the manager who couldnt be tracked down for almost a week. when we did pin him down he was evasive & hung up when i said i was recording the call for future reference. no further contact. this morning, my husband needs to buy his sisters birthday present (he forgot) he took our now 5 year old son, gets the cd, goes to chose a card & the original security guy comes over AGAIN with a female colleague and tells him hes banned, he is once again very imposing and agressive and once again upsets my son. As far as im aware to ban you for more than 2 weeks they need a notice of ban or something? I dont intend on ever going back but I wholeheartedly intend on getting an apology for being made to feel like a criminal when i want to buy some apples, and for my children being upset by a grown man whos on a power trip. I'd understand if I was shop lifting or something but we havent done anything wrong.
  23. My friend's BF has just had a bailiff appear on his doorstep, asking for £450 for a ASDA (colchester) parking fine or they will take his car. The parking fine apparently occurred in march, no fine , notification was ever received by the BF, but my friend suspect's it relates to this time in march. the bailiff mentioned this had gone to court, but also the BF had no notification of this (the BF had never had any notification of any parking fine). The BF is unemployed and couldn't pay the £450, so in the moment he got his mum to pay the £450 which she did. At the moment i am trying to ascertain whether this was on a Credit Card or Debit card. My question is this 1. if the payment was on a Credit Card, can this payment be disputed and withheld , as technically the CC issuer at this point has made the payment. The disputed payment being based on further investigation into the charge. 2. By definition , the BF has had no documentation, is there a way to find out from the Court about any judgement 3. £450 seem's excessive I suspect this is a Bailiff [problem], that there was no court judgement, and being on a Private car park , they are trying there luck and well it worked. I've asked my friend to photograph the Car Park signage and determine whether it was a Credit Card as i feel as the charge has been paid, the only practical way to get this back would be via the CC disputed payment. thanks
  24. Hi Folks, I was made redundant a few years ago and defaulted on my Santander/ASDA credit card. The debt was passed on to a collections firm and i then paid this in full as I had found a full time job. (£1200 iirc) As I paid the ballance in full, i would like to appeal to them my hardship at that time and request the default be removed/changed. I now have full time permanent job, 2 kids and would like to resolve so i can get better rate on morgage. I sent a generic letter on 19/08/13 as follows; I have recieved today the following; Where should I go from here ? I am unsure on what the legal requirements are for time scales on responses etc ?   25. I'm dealing with my elderly parents' debt troubles and have a complaint currently with the FOS in respect of the above credit card. In the meantime we sent a SAR in April to see what charges and increases to credit limits/ rates etc had been applied to the above account. We did not receive a reply to the SAR but when we queried it a letter we have now had a letter stating that a DSAR was issued in April "please accept my apologies if this was not received. I have enclosed a copy of the report" The information they have sent is a copy application signed but completed in unknown handwriting with an inflated income figure (presumably to ensure a card could be issued). The page of terms and conditions are too small to read even with glasses and magnifying glass! There is one page of abbreviated notes in the form of a "word" document There is a list of transactions from the account opening but it ends in 2010. On 15th of each month since October 2006 there are two separate amounts noted as "Interest charge" I'm not clear why there are 2 separate amounts on the same date each time and I have no transaction records for the past 3 years. Please could someone advise what I should do next?
