  1. I'm a freelance HGV driver, now self employed but at the time of the alleged offence I was paye with an agency. It was brought to my attention today that I have started paying, through deductions on my invoice, for a parking ticket I allegedly received whilst working. On questioning the agency, it seems that the client I was working for have paid the ticket, and I'm expected to reimburse them, although I am not happy and wish to contest the ticket. Is this possible, considering I am alleged to have been the driver on the day but I am not the vehicles keeper and the fine has been paid? Now, some details. The ticket was issued by Proserve Enforcement Solutions, allegedly at 15:08 on 02/12/13 at BP Service Station, Anzani Avenue, Felixstowe. There is no mention of what offence I am supposed to have committed, bar a mention of the vehicle having breached the landowners terms and conditions by parking/waiting/stopping without due authority or permission. Furthermore the vehicle committed an unauthorised trespass. The charge is £300, or £180 if paid within 14 days. There are cctv stills of the vehicle (44t Artic and trailer) parked at the back of the garage on double yellow lines, these images seem to have no time or date stamp, although the copy I have is photocopied and I have asked the agency to forward the email with clearer images to me so I can check those. For anyone that knows the site, there are circa 16 parking bays for HGV, along with pumps for both car and hgv, with a truckwash on site and small cafe and toilet block. The site can get very busy during the day, and its not unusual to find all the hgv bays taken, which isn't much help when you're close to running out of time and need to take a tacho break, which may have been what happened here. To be honest, I cant remember, and until I can check my digi card and do a printout for the day in question, I won't know. Google maps image of the service station, the red squiggle being where I was parked. The current situation is they allow 2hrs free parking, after which you must pay, and you must park in the marked bays. There are enough signs dotted around the place mentioning this. So, your views please? Can I contest, being that I was the driver but the haulage company have already paid and are looking to recover the money from me. It is mentioned on the notice that the name and address of the driver is unknown, and that the keeper may pay the charge, or pass on the details of the driver for them to contact me, and that they have 28 days of the date of service of the letter to pass on my details or pay the charge or they themselves become legally liable for the charge.
  2. hi i need some help/advice i went to court a few months back for non payment of a fine was told to pay the £300 odd back weekly i have not payed as my circumstances have changed and i could not afford to pay, i have had nothing from them to say any thing so was going to pay after Christmas, today i had a knock at the door and when i opened it there was a hco that asked if i was myself (full name used) my reply was i am me, he then went on to tell me why he was here, which was to collect the balance which is now £650?! and that if i can pay by 6 pm tomo which is Sunday they will be back Monday to seize goods! i have not let him in, i have not said that i am me, also i do not have anything worth that money, i also have 3 children who are 4-5-8 and work 16 hours a week, if any one can help i would be great full thankyou x

Hello I need some help please I worked for a company selling insurances back in 2011 in august 2014 i received a county court letter saying certain people had cancelled there insurance meaning they were clawing back the payment already made to me this was the first i knew about it, a cci was obtained in september 2014 and they have now issued me with a Notice of enforcement thru marstons the enforcement is claiming the money i owe plus £90.00 for compliance stage it also say about enforcement details high court writ of control based upon judgement obtained against you by ****** in september Do they have the power to force there way into my home and remove goods now?
  4. Anglia councils plan own bailiff service Seven councils are planning to launch a revenues enforcement service, allowing them to bypass commercial bailiff firms. Breckland, East Cambs, Fenland, Forest Heath, St Edmundsbury, Suffolk Coastal and Waveney Councils. The Cabinet report (Anglia Revenues Partnership (ARP) - Internal Enforcement Agency Proposals) at paragraph 4.6 shows there's a financial benefit of doing away with their contractors.
  5. [ATTACH=CONFIG]53821[/ATTACH]Hi CAGers, hoping I can get your advice on how to deal with this PCN. I've had a PCN before but this was years ago and the advice at the time was to ignore them. I believe legislation has now changed and the advice is not to ignore... and that there's something called POPLA? Is that right? Anyhow, I received this PCN for parking in the car park at my local Co-op because I overstayed (by 23 minutes) the stated 2 hours of free parking. There are signs on site stating the parking rules, although they are all attached to post at above head height level. I was aware of the 2 hour parking rule and I don't deny that I did overstay (I got there earlier than planned for a 1pm appointment (better early than late, right?) and it took me longer than anticipated to get back to the car) but I don't think £90 is a fair or appropriate fine for a fairly short overstay and I'll be damned if I'm going to pay these extortionate fees if I don't have to. So, gentle CAGers, please advice me of how I go about appealing this and what this POPLA thing is please? Am attaching a .pdf of the PCN letter. [ATTACH=CONFIG]53816[/ATTACH]
  6. Hi, I parked in a Civil enforcement Limited car park in February 2012 and didn't realised I had over stayed the allocated free parking time. The system was fairly new also and I didnt know that the pay machine was in the entrance to the downstairs supermarket as there are virtually no signage detailing what to do. They sent me a fine, to which I researched on the internet about what to do. All advice was to not pay, and send a letter to same effect. i did not admit I was the driver as advised online. I had one more letter then nothing more until last week when i recieved a court summons (N1) for breach of contract. The amount is £165. I dont know what to do now. I can't afford that or need the black mark on my credit. I tried calling CIvil Enforcement Ltd but the number on the claim form and internet are not working. Either saying the are not recieving calls or wont accept my PCN number. I have until the 28th of July to respond. I only just picked up the letter as I am living away from home while our communal roof is being fixed so I need to send something today or they will pass judgement on me as detailed in the letter!   7. My mother is in arrears with Mortgages 1 Ltd and has fallen behind with the repayment proposal due to my father being off work ill. (Broken ankle and complications). HL Interactive have written saying "YOU ARE AT RISK OF EVICTION. We have now been instructed to enforce the Order for Possession. This means that an eviction date will be scheduled and you may have to vacate the property. ACT NOW BEFORE ITS TOO LATE Please contact us on ********* as soon as possible. We will try to work with you to find a solution to your mortgage arrears and avoid the possibility of you losing your home." The end of term for the mortgage is 4th May 2015. Closing arrears balance £13,409.59 Current oustanding mortgage (including arrears) £22984.54 She can only afford to pay £950 per month. How can we stop this eviction? Were looking at equity release to pay off the mortgage but this will take time. (more than the 9 days remaining before eviction) Failure of equity release, are there any other re-mortgage options? Hi There i was wondering if i can get some good advice on my problem i have had a letter hand delivered by by an enforcement agent and it says on there its a REMOVAL VISIT payment due in full, i did only owe £175 with them as i was meant to pay two payments of £137.50 but i could only afford £100 at the time and payed on my card! i still had £175 remaing and was gona pay the rest the next month but i lost my job and could not afford it. now ive had this letter saying i owe collectica £410 now!! i am currently claiming ESA on my partners claim as i have no job.i did phone up the enforement officers number on the leeter to tell them my circumstances they didnt not care to be honest and gave me till the end of the month to pay it and they stated they was going back to the court to put that exstension until the end of the month. i basicly got forced into saying i would pay it and i dont know what to do now as i cant afford it being on benefits plus i dont knoe if they can enter my property and take my goods like they said!! can they remove my goods even if im not in and also can i not take it back to court because i lost my job as its not my fault i broke the payment plan and advice and help would be great thank you

  10. Hello I had a parking ticket from the council and more fees added so was £240 and i agreed to pay £24 pw but missed 4th payment yesterday as changing job and forgot. And now had notice of attendance £500 total bill owed pushed through letterbox. Shall i ring and offer £50 pw , any advice appreciated

Hi All I got a PCN from Civil Enforcement Ltd, to which i sent them a letter refusing their specuilative invoice and also informing them that I wasn't sure of the drivers identity, as many people have access to this vehicle. They have rejected my representation (see below) How should i proceed? should I send a further letter to them or go down the POPLA route. Many Thanks EOS 5D
  12. Hi urgent help needed please I gave my car to my son so he could use it. The car was insured under his name only. He then bought a new car and transferred his insurance to that car. A friend of his was going to buy my car and I was going to give that money to my son as my contribution towards the cost of his new car. His friend could not come up with the money. my car was not purchased. Of course, i was not fully aware of the last final piece of information. So the DVLA fined me for not having insurance on my car. Unfortunately, at that time i was abroad. I had been recovering from a breakdown and just came off ESA as i found employment. i had to go abroad with work. I wrote to the magistrates explaining the situation and asked if i could have the judgement set aside so i could present my case. After some back/forth letters they wrote to me asking me to get in touch with the court. This was at the end of August. Unfortunately, i had some terrible news about my 94 year old aunt to whom i am extremely close and i had a relapse. i was not able to contact the court On Friday 26 Sept. I had a visit from Collectica with a warrant to enter my house and seize goods. I did not let the guy in but explained to him about my health and showed him a letter from my doctor. He left a letter which said i had to pay £ 640 or they will force entry and seize goods. This actually added to my depression and totally messed me up. I was unable to do anything and doubled up on my anti depressants. Its not until today that I could write this post on CAG. Please help me and advise what i can do next. i have written to the court and explained my condition and situation in detail and sent them copies of all my medical certificates. thank you CAG Wrecked.

Culture Secretary Sajid Javid will say more than 10% of all cases heard by magistrates involve TV licences and question whether the system is working. The review should conclude early in the next Parliament, he will say. It comes as Rona Fairhead, ministers' preferred candidate to chair the BBC Trust, prepares to face MPs' questions. The former Financial Times chief executive will be questioned about her views on the future regulation and funding of the BBC when she appears before the Commons Media Select Committee. The Conservatives and Labour have said they are sympathetic to calls for the decriminalisation of non-payment of the licence fee, which is used to fund BBC services. Legislation currently going through Parliament would give a future government the power to move towards decriminalisation if it was deemed to be in the public interest. Taking evidence In a speech to the Royal Television Society, Mr Javid will say the question of how the BBC enforces payment of the licence fee - currently £145.50 a year for a colour TV - must be considered now. "In 2012/13, almost 200,000 people ended up in court accused of not buying a TV licence," he will say. "More than 50 were sent to prison. "When over 10% of magistrates' court cases concern this one offence, you have to ask whether the current system is really working. So that's exactly what I'm going to do. "The government is committed to launching a review of decriminalisation once the Deregulation Bill receives Royal Assent. But we can't afford to wait that long. This needs to begin now. "Very shortly I will be publishing the terms of reference for a review of TV licence enforcement. I expect it to begin taking evidence in the autumn, and to conclude early in the next Parliament." 'Loved services' Mr Javid will insist the review will not pre-empt renewal of the BBC's royal charter, the process of agreeing its future funding and governance arrangements which is due to take place in 2016. "This will allow it to shape the future of the BBC in a way that works for both the corporation and those who pay for it," he will add. A spokesman for the BBC, which is is obliged to ensure its collection arrangements are efficient, appropriate and proportionate, said it hoped the review would be thorough and "not rushed". "Licence fee evasion is low which maximises investment in the programmes and services that audiences love," he said. "Changing the system could lead to higher evasion, so it is important that any decisions are made as part of the Charter Review process." A BBC Trust spokeswoman added that this was an issue that should be discussed "in the round", including the "potential impact on licence fee income and BBC output", with any decisions made as part of the BBC's charter review process. She said the trust looked forward to engaging fully with the review when the time comes. The BBC's director of strategy and digital James Purnell has suggested the time taken up by licence fee cases in court was actually much lower than often stated. "The last fact we saw was that it took up 0.3% of time because most of these cases are processed pretty quickly, about three minutes on average," he told BBC Radio 4's PM programme in March.
  15. Hi all! Long story short, I got into a bit of a mess 18-24 months ago and through my own daft fault failed to pay a number of PCNs issued for parking too long at work/home (my area operates a time clock system). 1 of these went to TEC and Jacobs were instructed (pre April 2014, in May 2013). After a couple of visits and notices through the letterbox I heard nothing more from Jacobs and as far as I understand the Warrant for Northampton expired start of April 14. I had 9 others which I managed to set up a payment plan with the council for and was paying off monthly. However in March / April after a period of financial hardship (like literally not having enough food to always eat daily) I had difficulty paying my payment plan. I did get it reinstated in May time and made 3 further payments which meant I had fully paid 7 of these 9. In July and August with school holidays (I have a son) and the extra costs this always brings + school uniform costs plus various other financial issues (feel like its a vicous spiral I'm trapped in) I fell behind again. This time I did not get the 'you've fallen behind' letter and I had anticipated making my next instalment on 17th Sept when I get paid my tax credits. However I came home on Friday to 3 Notice of Enforcements (2 for the outstanding PCNs on my arrangement and a further one for a parking violation at the end of 2013). I immediately wrote to the Council profusely apologising (I realise this will do absolutely naff all but thought it was worth a try) anf then set about panicking like mad. Having done my research online I see the rules re bailiffs have changed in April 2014 with new regs so I have 1 main question: Are they still not allowed to force entry in your absence? or can they come in to 'Take Control' regardless? Absolutely stressing as am out all day at work and my teenager gets in before I do and although he isn't allowed to open the door when Im not in I'm terrified they'll come and break in or whatever whilst I'm at work. Secondly, I absolutely will arrange to pay these amounts owed but can only do so at smaller amounts and although I will write to Marstons to make a payment offer I expect this to be rejected as too low. The notice suggests I have until 15.9.14 to arrange to pay but everything I have read suggests that the notice is a 7 day thing (they're dated 1.9.14) so thats 14 days? I'm sorry for the questions but I'm still operating in a barely contained state of panic and I'm so frightened that they'll come and get in by force and I (or my boy) will come home to all our / his things taken... .. that would simply break my heart. And yes I know its all my own fault and I take full blame for being rubbish with finances and money but I do want to resolve this. Help please :'(

Hi was looking for a little advice, I have an outstanding ticket for parking, never disputed it but for the last 2 months had an awful lot of problems and forgot, yes I know my own fault and could kick myself. This morning an equita agent turns up claiming I now owe 407.00 and I have until the end of this month to pay it! I am right now a single mum of 5 children under 16.Partner is in prison so ive had to survive on income support and child tax credits.I have to pay towards my rent due to benefit cap and told this agent basically your telling me I either pay and make my children go hungry or not and you take my car and goods? He was horrible telling me I should be thankful he isnt taking my car right now because he could and he doesnt care but I have to pay in full by end of september.Thats 100.00 a week?! Im really worried and stressed now and only way I do this is by getting a loan to pay or not feed my children, now I, ll be in more debt! seriously can they demand this from me? I accept the debt and willing to pay but in such a short amount of time?
  17. Hi, in need of help and advice History, In Sept 2013, I parked my car,I went to the meter to purchase my ticket, walking time approx 2 mins. Upon my arrival a warden had just started to issue a ticket, he confirmed a mistake was made but could not stop the ticket process, he said he would make notes a error had occurred. I disputed the ticket within two days using a online complaints procedure, I received no formal response and assumed the matter to closed. This afternoon I received a letter from Equita requesting payment within 24 hrs. The notice received is not in my name but partners, I confirmed during the complaints procedure I was the driver and provided correct contact info A numerous phone calls the council, traffic enforcement in northampton nothing can be resolved. I had a valid ticket, photo evidence to support this claim and I do not want to pay Regards in advance
  18. I too am experiencing the might of a Jacobs enforcent Agent. He said he was attending with the police at 5pm today. He did not show up but I spoke to him earlier and i asked for his registration details and ID and a breakdown of all his charges. He said he does not have to provide them. Previous to this, and this action is for a parking offence(which is a civil offence) He said failure to pay in full would result in a warrant being issued for my arrest.
  19. A bit of background for this, 2 years a go I had a joint tenancy agreement that a friend of mine took the 'lead' for. With this, he took the bills in his name - This included the Council Tax. Unknowingly to me, he moved out and I discovered that despite me sending him the money, the bills had not been paid. Most of them stopped chasing me because his name was solely on the accounts and had nothing to do with me. Since he moved, I subsequently opened a new account with the Council that started a fresh payment plan for the property. I was contacted a while after saying I had missed payments on my new plan - This confused me and it had turned out that my direct debit was incorrectly setup by the council to the OLD account that my friend was paying for (my name was not on this). I subsequently had all the payment from the last several months moved to the correct account and I haven't heard from anyone since. Since then, I have heard nothing from the Council that would indicate I am in any danger of debt. Today, I found a letter from a Collectica Enforcement agency stating they wanted to come into the property and take items that would pay for the 'Outstanding Council Tax' debt. Since its a Saturday I am limited to who I can talk to in hopes of getting this sorted. In preparation for this, can anyone help educate me on what can be done with this? As far as I'm aware, I never signed or agreed to have my name on the council tax. My name would only ever be on the account from the moment the council set up the direct debit against the wrong account against this property.

  21. Brief back story: In 2013, whilst on maternity leave, I raised concerns about how my line manager was treating me. Subsequently, my employer initiated a swift redundancy process, and within a month had made me redundant without notice and whilst still on maternity leave. The employer retained my maternity cover worker. I represented myself at an employment tribunal in Jan 2014; an Employment Judge judged that I was unfairly dismissed and treated unfavourably by my employer to section 18 of the Equality Act 2010. The employer was ordered to pay my notice pay, compensation for unfair dismissal and compensation for injury to feelings, amounting to around £8,000 in total. The establishment is named on the order rather than the names of trustees. The employers are a small registered charity, a playgroup, managed as an unincorporated trustee body. The members of the trustee body change frequently. They operate out of rented premises and they don’t have much by way of assets. At the tribunal the employer presented bank statements attempting to show that they have ‘no money’. However, the Judge noted that the statements showed money was being moved around between several accounts. The employer has engaged a solicitor who in short says the employer has no assets and no money and that the trustees are not financially liable for the debts. The solicitor has rejected a payment plan of £150 per month and a without prejudice settlement offer of £6,500. The solicitor has advised that they can only make payments of £50 per month. The employer has paid the notice pay one made one late payment of £50. A County Court Order has since been issued for the full award plus interest to date. I haven’t engaged a HCEO yet although I did enquire and they advised me that bank accounts were protected. Please could colleagues here advise me on the best approach in going forward? I’ve included as much relevant detail as I can here but please just ask if there is something that needs clarifying. Thank you for all your help.

Morning, Just had a visit from a high court enforcement officer Over a outstanding CCJ for around 6 grand the delightful chap informs me he has taken control of my goods ( car on drive) they will remove it next week if I do not pay them The car has just under 200k miles and bodywork tells a sad sad story But it is 12 years old Cost me £500 last year scrap would pay around £200 so at auction without keys must be worth at least a fiver! It is my only asset and needed for children and work arrangements
  23. Hi all it's been a while since I have used the forum but have always received good advice when I have. I have received a N1 claim form through the door from Northampton County Court with the claimant Civil Enforcement Limited apparently claiming for damages from breach of contract. I will attach the pictures of the letter. I do not remember this incident as it's from over a year ago. It's been sent to an old address which I haven't lived at for some years but as it was a works van then the company will of given them the last address they had for me. Obviously it's the first I have heard of any of this as the person at the old address doesn't generally forward letters on but since they could see it was from a court they did this one! I am adamant I never entered into a contract with these people and wish to submit a defence but need some advice as to how to go about it. Any advice would be much lay appreciated!

I had a PCN from a council for £202 for a hire purchase car, bailiff sent me a letter on March 24, 2014 for £431 I filed an out of time declaration because I had never received an NTO on 11 April 2014, On June1 I got letter from the court TEC, saying that the council had refused the declaration.I did not recieve any letter for council or bailiffs (now called enforcement agents) Today 20th June 2014, I received a call from newlyn enforcement agent saying that they have clamped the car on my drive way. The agent said over the phone that the charge is now £666.11, which is £202 for PCN, £229.11 for compliance stage fee and £235 for enforcement stage fee. QUESTIONS: I thought i was supposed to receive a 7 days(11days including weekends) compliance letter charge....I never received this. I thought the whole idea of the 7days compliance was to give me the opportunity to pay the £202+£75 and save the trouble of a visit. I was not give this opportunity . I told the EA that the car is on hire purchase and does not belong to me , that he is not supposed to clamp it and threaten to recover it. is this correct ? I also wanted to find out if a car packed on my drive way can be clamped by an enforcement agent. Is my drive way not private property? Since i was not given the 7 days compliance letter and hence not given the opportunity to pay the £75, what can i do to get the EA to revert back to that stage as it seems obvious they failed to send the 7days letter ...so they can get more money if they visit. Any help would be appreciated

I received a NOTICE OF ENFORCEMENT on Saturday 31/5 from Shergroup Enforcement It says an HCEO is BEING instructed to take legal control of my goods by issuing a "writ of Control" against me & my goods. The original amount of the debt, which originated from a Financial Consent Order as a result of my divorce 7 years ago, when I was given 5 years to pay 10K I didn't pay - mainly as I didn't have the money at any point. They now want the 10k + £10310.10 interest plus their £90 fee. My questions are .. Can I now "just" pay my ex 10k - the original amount plus pay them their £90 for action so far ? ARE they allowed to add the interest ? Who gets the interest ? What is the likely timescale for events IF I dont get things sorted by the 5pm Friday deadline ? Thanks in anticipation!
