  1. Just a very quick question, I am trying to establish who is collecting one of my debts, over the past year this debt has been passed through four companies, listed here, Westcott, first source, cap quest, Debt Managers, I have been paying monthly to clear this account, when suddenly no one wanted to own up to holding this account, so I sent a letter stating I wanted this account placed on hold until such time someone stated in writing they are collecting on behalf of the original creditor Halifax. I sent all the companies the Credit agreement request and £1 postal order, non compiled with this request, The company Debt Managers Limited TODAY wrote there have sent the account BACK to cap quest and that they have closed the account at they end. I am now in the process of penning a letter to Cap quest to establish if they in deed do have control of this debt, and if payments should be sent to them. Is they any letter/template that would be suitable to send them, without costing me, as total is adding up in postal orders and recorded delivery postage. I just want to know which company is collecting this debt and who to send payments to ? cheers
  2. Please help I have a mortgage with Halifax which is in serious arrears. Reasons due to redundancy and then taking a lower paid job. Since then I fell pregnant and am at present a single mum on benefits. I am however returning to work full time in March as needs must. I have been on an interest only mortgage for a long while but never missed a payment. Halifax are demanding arrears fully paid off and is at litigation stage. I am massively stressed as don't want to lose my home as is a safe and secure place for bubba and I. Please please can someone advise on best thing to do next? Thank you x
  3. Lowell has issued me with a county court claim for an amount left on an old debt. They state they purchased this debt from Halifax earlier in 2013. I have another thread open in relation to the court case, access to info etc. I have just accessed my credit report (experian). It shows two entries for the same loan. 1. It is recorded as Lender: halifax. Balance: '£xxx and Status: Default. Default date is 11/02/2011. This has not been updated since 2012, which makes sense if they sold it on. It is also in my married name. 2. Lowell Portfolio. Balance: £xxx (slightly different amount) Status: Default date is 16/02/2011. It is in my maiden name. Can there be two defaults for the same debt? It reads like I have two loans, both of which I have defaulted on, when it's the same loan and there is nothing to link the two. I get that Lowell are now the owners and therefore are going to be adding their input onto my credit file, but how should this be recorded, to show that there are not TWO defaults (different amounts, different default dates would suggest to a third party that I had two loans at the same time, defaulted on them both rather than one loan balance being sold to another company). Is this wrong, and if so, how do I go about getting it amended? Thank you
  4. Way back in the year 2000 I started using a Halifax credit card, all was well up to 2011 when I lost my job and couldn't pay the minimum payments. No problem (said Halifax - Blair Oliver & Scott) Just pay £1.00 per month we'll accept that. Fast forward to jan 2014 when out pf the blue I got a letter stating that Halifax had assigned all of it's respective rights to that well known company Cabot Financial (Europe) in spite of tha fact I had never missed a single payment, or ever had a problem with Halifax/BO&S. Cabot acceped a continuation of the £1.00 per month payment and sent me a nice bar code payment card, how kind of them. One boy I spoke to told me that the law had now changed (when?) and all DCA's wern't allowed to chase or demand more payment than could be afforded by us sad little debtors. I had to smile at that one. Then why oh why are forums full of people complaining of heavy handed tatics being used I have to ask? The total balance sold by Halifax to Cabot is in excess of £15,000. Now I wasn't born yesterday, and having read a good few posts on this forum, I have to ask why would Halifax sell such a substantial debt on to antoher party? Why not keep the debt 'in house' and get every penny back to boost the Halifax bottom line, not someone else's, UNLESS of course they know something that I don't. I'm pretty sure that something smells wrong here. I wonder if some paperwork is missing making enforcement difficult or out of the question? So what should my next action be? SAR Halifax? CCA Halifax and or Cabot, is there anything else I can do and what are the logical first steps. In spite of reading the posts on this forum I've never got involved with any SAR's or CCA's or anything like this I'm a newbieto all of this. I've also not reclaimed any charges or PPI not wanted to 'rock the boat' in case I awoke a slumbering monster, as Japan did in 1941 (and look how it ended for them!!) I look forward to any pointers anyone could give, as stated above I'm a novice at thisand could do with all the help I can get. Thanks in Advance.
  5. Hi any advice appreciated. I took out a Mortgage with the Halifax in 2006. It wasn't until recently and numerous calls from different companies asking if I had PPI on anything, that I decided to call the halifax to ask if I had PPI they seemed to be unsure? but put me through to ppi complaints department who have just sent me a personal payment protection questionnaire. Ive received the questionnaire and then decided to trace my original mortgage paperwork to enable me better in answering the questions. This is where Ive become totally confused. Ive found some documents saying: Thank you for choosing Halifax Total Mortgage Protection Plan. Covering Mortgage repayments, critical illness cover and life cover. It states monthly payment during the first payments of the plan £137.06? I do not pay this seperately, in fact I don't even remember paying it? Then reading further it says please note 3 payments will be taken on the requested date in the month after completion. or in the instance date is equal to the start date 2 payments will be taken. Also says if you have applied for a plan in connection with a new halifax mortgage for a property to be used as your main residence this cover will come into force automatically on completion of mortgage. This being my first, current and only mortgage, which Ive never really understood just due to being naive in this situation. I need help from where to go from here please, if I have it then which type of statement do I write is it acceptable to say I wasn't aware I had it? seeing as I have now found paperwork to back up I possibly did? although I'm pretty sure I was never given an option? Also, there has been a period throughout my mortgage where myself and husband had suffered no work and never claimed anything as didnt know this could have been an option and they never informed me at the time either? I'm very confused anyone able to help?
  6. My husband and I are executors of my father's estate. He died 2 yearas ago and his apartment has been on the market for 18 months and is still unsold. Halifax were sent all the documentation after his death and have repeatedly sent us letters demanding interest which they have accumulated be paid. They have not responded to any of the correspondence returned by us and have now sent a court order to each of us personally regarding their intention to reclaim the property, and we must attend court. The form also request details of our own property where we live. We are quite happy for the bank to have the flat as there will be nothing to come to us after everything has been paid off - my father having to remortgage to pay for three years residential full care for my mother as she was dying slowly of MND. Our main concern is that rather than be addressed to the executors the courts papers are addressed to each of us personally so does this affect our financial standing/ credit record which has always been excellent? It is also causing a lot of personal distress. Thanks for reading this and I hope someone can help.
  7. Hi, just looking for a bit of advice about halifax and them withdrawing a 2k overdraft on a joint account. I received a letter from them as my yearly overdraft review was due (it has been approved every Jan since account opened 5 years ago) stating that they are withdrawing my OD as it has 'expired', the withdrawl letter was dated 6 jan, and i recieved it on 10 Jan, saying the withdrawl will take place on 1 feb. I rang them straight away and was told that they are not willing to discuss the matter untill the overdraft has lapsed. Also they dont have to give a reason why. I then wrote an email complaint to which i have received a reply, reaffirming it will not be discussed untill 1 feb, and 25 quid for my troubles. I ststed i was aware that an OD was a short term borrowing facility, and i was more complaining about the 20 days notice. As i dont have the 2k to pull out and pay it off, i am panicking as they are going to start charging me 5 per day plus interest and charges for using 'an unauthorised overdraft'. Further, my husbands wages are due to be paid in on 31 Jan and i am scared they are going to freeze them and use to repay overdraft. Now i have kick started a new acc opening with another bank but it has ground to halt as my husbands driving licence had not been updated with our new address (naughty i know) so the new bank has asked him to contact hmrc and get a tax notification letter but this is going to take 7-10 working days to get to us and obviously his coming payday is going to be here before that letter will. In desperation i contacted CAB and was advised to make a first right appropriation letter to the bank which i did. I personally took it to the bank and the lady disappeared with it for a good 15 minutes. She came back and said hands are tied nothing more they can do, before i left she tried to flog me a loan, and said if i do it now my chances of getting it are extremely good, if i wait til feb and they have messed up my credit rating by withdrawing the OD - i probablies wont get it! Nice. Is there anything else i can do? I cant believe they can do this. I have a good credit rating (just purchased 3k sofa at dfs in december no probs) my account has been ran in exactly the same way since it opened, the OD has been paid off in its entirety many times, and we have volunatrily made payments to reduce it over time by chipping away when we could afford it (it was originally 2.5) As a foot note, and rather ironically on the same day i received this bombshell letter about the OD, in a seperate letter it was Halifax offering me a pre-approved loan of 15k!!! Also over christmas my chip and pin card got damaged so i had to ring to order new one and they offered me a credit card with a 0% promo rate! I just dont get it, any suggestions appreciated.:

  9. Hi i hope somebody can give me some advice. I have received a letter today from robinson way saying i owe halifax £241.77. I had a bank account with halifax approximately 5 years ago which is has been closed for at least 3 years. I have never owed halifax a penny or had any debt with anyone. I did apply for a mortgage via a broker with halifax about 3 months ago but see no reason why it could be for that, there was a fee of £300 paid at the time which is morethan 241 pounds in any case. I have spoken to halifax on the phone who cannot help me locate any alleged debt. What should i do??
  10. Hi, I am wondering if anyone can help. I have an overdraft of £2570 with Halifax/Bank of Scotland. This was a student OD that I haven't paid off. I pretty much live in it every month. I have being paying their monthly fees every month for the OD without fail (since graduation in 2009!!!), however, my circumstances have changed. I am due to go on maternity leave in the next month, and will only be earning statutory pay of ~£500 per month after tax. This low wage means I will be unable to pay the ~£90 per month fees, let alone attempt to reduce the overdraft. Is there anything I can do. I have payment plans two other debts, and I have requested a reduced payment for the maternity leave period, but given this isn't a debt but a fee I am not sure where I stand. I have an account with RBS which I dont use, so could switch all monthly payments etc to that, but I would still incur fees on the halifax account. Thanks in advance
  11. Hi,t This is just a bit of a query, but does anyone know or work in the loans department of Halifax? I'm looking to apply for a loan and just wanted to know if it mattered wether you apply in branch or online? I have a lot of paperwork to back my application that wont matter on online as i cannot offer it, but it might if i apply in branch. Does anyone have any insider type knowledge of this?
  12. Halifax have sold an old overdraft to Lowell Portfolio 1. I have been receiving and ignoring letters for a long time, but have now decided to get my head out of the sand and sort my finances out. The current account the debt refers to has been closed for several years. It was originally opened 02/11/94 and the default date on Equifax is 13/01/10. I have been offered increasingly large discounts from Lowell to settle the account. Most recently they sent me an offer of a 50% discount. Should I consider myself lucky and accept the discount or would it be possible to try for a larger one? I ask as I'm going back into full time education after losing my job and so don't have two pennies to rub together. Any thoughts / advice greatly appreciated.
  13. I have recently taken a complaint to FOS, regarding us being mis sold our mortgage by Halifax. We approached several mortgage companies in 2007 for a mortgage and were refused by everyone except for Halifax. At the time my husband was working and i was and still am on benefits as i am disabled. They offered us a mortgage at fixed rate. In 2009 my husbands health deteriorated and he had to take early retirement which meant that we began to struggle making repayments to the mortgage. Halifax were very unhelpful in assisting us with how to sort our problems out. Everything we suggested such as adding our daughter on the mortgage they refused. It has since come to light that they had made assumptions when it came to my husbands pension and had foolishly calculated his yearly pension as his monthly incoming???? we took the complaint to the FOS and they have come back to us and we have in writing that halifax have ADMITTED mis-selling our mortgage yet our only options are to pay the arrears or sell our home??? Surely if they have admitted liability then they are responsible to give us some compensation? all we want is to remain in our home with payments we can afford and not the £900 a month they are asking for. can anyone help or advise?
  14. hi all am just new to this forum dont know who else to turn to i am 30 years old and from glasgow scotland i have been a - halifax personal customer 25 years bank of scotland business customer 6 years the story so far (27 days no access to funds) 3rd december 2013 block put on my halifax personal and bank of scotland business account 5th december went to pay for fuel at petrol station both cards didnt work. 6th december went to local branch they informed me accounts is blocked contacted complaints informed me that i would receive a letter in the post they couldnt give me information on the phone 9th december letter received states in letter that my accounts have been blocked due to processing error 10-11-12-13-14 december constant calls and branch visits to try get problem resolved to no avail same old excuse processing error and they pass me round different departments like an old scud book and there all really sorry and working on it 15th december contact financial ombusm made big complaint about them and told them am in bad situation as this is really effecting my company that i run with 3 employees who i have not been able to pay. informed me can take upto 8 weeks before do anything 18th december feeling very down all letters from my car, van , insurances all my bills phone, tv,life insurance, mortgages all demanding money off me. called fos again explained the extreme harship this is causing me they said they are going to put a request in to fast track it for me which sounds good to me 24th december extreme hardship not one pence left to my name borrowed from friends and family to buy food and electricity to get me by 30th december sitting in my friends house typing this to ask for everyones help and advise. i have no money for food, electricity,fuel for transport or gas for heating i went from runnin my own electrical contractors company and i have around 40 thousand of my life savings that i worked really hard for in my life tied up between my 2 accounts. went for other visit to halifax branch the man at counter says really sorry can do nothing and he has only seen one similar case where someones account was blocked for 7 months i cant wait that long i will be dead before then im suffering extreme depression and everyone i talk to is just really sorry i need answers and fast im really lost.(HOW CAN BANKS GET AWAY WITH THIS!![ATTACH=CONFIG]48381[/ATTACH][ATTACH=CONFIG]48382[/ATTACH][ATTACH=CONFIG]48383[/ATTACH]) i would appreciate any feedback or advise thanks and god bless.
  15. Hi I have written to the Halifax to request validation of credit card debt (£7800) and asked for a certified copy of the original credit agreement. They have sent me a photocopy of the "original signed application form" and a "reconstituted version of the original agreement". The form was dated 7 July 2006. Is this 'agreement' enforceable?   16. hello All, I am new to this forum but hope that I will get the required advice do deal with Halifax. I had an account with Halifax with an overdraft facility of £1000 which I have used, I had then finish university had no regular income coming into the account; Since no income was coming into the account, Halifax called me asking for the overdraft to be paid in full or they will close the account down. the first time the call demanding the money was in September 2010, during the conversation I promised to make full payment first week in November 2010 and then followed it up with a letter telling them the same confirming the conversation asking Halifax to confirm their happiness with the proposed payment terms. in the absence of no reply from Halifax, the money was paid in full on 1st November 2010. Just recently I obtained my credit profile information from Experian and realised that Halifax had recorded a default against me on 20th October 2010 just two weeks before I paid in full despite sending them a letter of proposed date of payment. On 14th November 2013, I wrote a letter to Halifax to remove the default from my profile as it is not a true reflection of how I have managed my finances so far as the overdraft is concerned; Halifax then replied by saying they are right to default me as I have not made payment within the time frame they gave and apologising for mistakenly applying charges to my account in excess of £125 and that to make up for it, they are given me £75 pounds for the inconveniences caused. can Halifax default me even though I gave them a proposed payment date and can I sue them for mistakenly applying charges to my account. please help
  17. Hello, I have now officially moved abroad and no longer resident for tax purposes. I have left a correspondence address in the UK at a friend's because the customer service officer at the branch told me they couldn't keep my account alive if I had a foreign address. My friend, for his own reasons, is not very happy with receiving mail for me and is a bit paranoid about possible consequences for him. You will be probably aware that Halifax gives often incorrect advise both in person and by telephone, so I wonder if anybody has a clue on how to move from here. I will probably receive a couple of letters a year and in 3 years I will receive new ATM and credit cards, so this could be a problem. I would like to keep this account alive as I still do online shopping from the UK. Any help will be appreciated.
  18. My mother received a letter today advising her that her tracker bond taken out in June 2013 at 1.7% AER/Gross was wrong and that they had sent the wrong Certificate of Investment. Today they have sent her a duplicate Certificate Of Investment which advises that the AER/Gross interest rate will now be 1.19% How can this be so? She took out the product because 1.7% was attractive to her at the time and the bank base rate which the tracker is linked to has remained constant at 0.5%. I have attached a link to the letters. In return the defendant agreed to pay at least the minimum payment given in the statement. A default notice was served on the defendant which has expired and upon which the defendant has failed to comply with. A Notice of Assignment has been sent to the defendant notifying them that this debt has been assisgned to the Claimant. The claimant therefore claims the sum of £xxxx plus costs.   20. Have an outstanding debt with Halifax for credit card, that was handed over to Blair Oliver Scott in 2009. Have been making regular payments and balance is reduced from £7,400 to currently £1529.72. I have had had problems with Blair Oli Scott contacting by tel while working away on business etc, and so stated last year that no telephone communications were acceptable and written comms only. This took 2 goes over 2 months to establish this and make sure it was recorded by collection team, I was annoyed and frustrated when in Nov this year I got 2 automated phone calls from collections team, the first I just shouted at the Bangalore calle centre person to 'read your records' , the second I asked to be put through to call centre supervisor, waited 5 mins nothing called them back and made a complaint about the harassment and debt collection guideline breaches being made by Blair Oliver Scott on behalf of Halifax. I also complained about the costs incurred by me on mobile phone charges to a 0845 number to make a complaint, for this I received a cheque from Halifax Retail Collections Chester for £40 5 days later () to reimburse me on call charges. I then received a letter dated 25th Nov 2013 with a name change from Blair Oliver Scott ( a wholly owned subsidary of BOS PLC) to Halifax Retail Recoveries (same address in Rosyth/ Fife) quoting the same reference number and CC account number they have used all along, so things seem to tie up there. (Thought this would have been in response to the previous problems Bl Ol Sc and HBOS have had with a dormant company with no accounts published) I then sent a letter with £1 SO for a CCA to Blair Oliver Scott dated 26th November only quoting the reference number they have used for past 4 1/2 years with my name and address. I also sent a seperate letter of complaint dated 26th Nov advising them of their breaches in OFT debt collections guidelines and that any further phone calls made to me would constitute harassment and would be reported to the police and OFT and a copy of this letter would be accompanying my complaint to trading standards and OFT. Onto replies, I received a letter from Claire Ellis in Halifax Customer services in Leeds dated 10th Dec thanking me for my recent enquiry and they are sorry to learn I'm unhappy with them. Then promising a reply as soon as possible but certainly within 8 weeks and accompanying leaflet about how to complain with the Halifax. CCA Reply exactly as written from Halifax Card Services Dunfermline Fife dated 5th Dec Dear Mr Xxxxxx I refer to your attached letter You have not provided a valid account number and I cannot trace your account with the details provided. Once you have provided us with a valid 16 digit account number, we will be able to assist you with your enquiry. If you are unable to provide to provide to us this, please supply us with as much information as possible such as full address details any change of name date of birth date account opened Please be aware that section 78 only applies during the lifetime of an agreement. If your account has been closed and paid in full, then there would no longer be a regulated agreement between us. In view of the above, we would unable to provide you with the documentation as requested Yours sincerely Pam Heslop Head of Card Operations As the CCA contained my name and home address and the reference Blair Oliver Scott have used for the past 4 years +, surely this person could quite easily have found my details very easily or is that letter saying they have insufficient data collection and storage procedures within the company. wonder if the ICO would be interested in that ? Only other alternative thought is that Halifax (BOS) are just time wasting ? hindering or delaying a request ? What Steps should I take now apart from including my CC number in reply and should I now only make letters for the attention of Pam Heslop? I thought I read somewhere that she be made responsible if they fail to deliver the said details if I decide to pursue anything with them. As the debt has not been paid in full and is still on my CRA report, surely there is an agreement between myself and the Halifax Any advice welcome, knowing that the Halifax love to crush anyone complaining about them, wishing to take them on and also that I still have a current account with them so they could by rights remove money from it to recover debt on card.

    in 1988 i was infortunately diagnose wit a chronic illness M.S. a whic was devastating. me and my wife had to make some serious life changing desicions one of which was our mostgage to ensure it would be paid off when we retired. the only logical option was a jointrepayment mortgage so while i was capble of working i would contribute. we went to th the local branch of the leeds permanent building siciety for a repayment mortgage. without telling or asking us our application was reffrered to martin taylor mostgage financial advisor of stockport who it turns out to be was a bogus non authorised business selling endowment mortgage policies on a commision basis on behalf the building siciety who sctually ceased selling endoments in march 1988. it is obvios that individuals at branch level were ignoring company poliicy as the assurance state ndoment policies are only issued upon rquest and referring applications on to thif business informally or otherwaise possibly for some reward. the endoment linked mortgage was most definately not an option we wanted as it had a chronic illness covrer within the policy and this would have been pointless being previosly diagnosed. has anybody else ever dealt with the leeds permanent building society of ashton under-lne and been given an endowment mortgage if so you too may have ben decieced in this fashion
  22. hi again . i have had a letter from red offering me a discount on the account it says i owe lowell the money it is a halifax account overdraft. i dont know who owns it now do i ring them to find out who owns this then send them a cpr or a cca request. the letter also says that this will go to hamptons legal if they dont hear from me in 10 days well 10 days as been and gone letter was posted 25 oct 2013 not heard from hamptons yet. they say hamptons will put in a claim. if i get a cca or cpr request to them now will it stop them from putting in a claim if they dont send me the stuff i ask for
  23. Halifax having been charging me for going slightly into my overdraft each month. They know I am on benefits as my money gets paid into them. Can I apply to ask them to stop this or even ask for a refund.

I do have a thread on this but didn't put this on there in case it got missed ..Firstly I like to thank DX for his expertise Couldn't of done it with out your help AN Angel in the making .....Well Halifax have upheld my complaint no questions asked ..And are refunding £3, 100 just over a 1000 short from what me made it , But Im very happy with that ..DONATION WILL BE MADE WHEN RECEIVE AND CHEQUE IS CLEAR ..Thank you guys soooooooooooooooo much
  25. So, I complained to Halifax a few weeks ago, they 'refused' my complaint. I wrote to the FOS, who contacted Halifax on my behalf. Halifax told them that they were going to make me an offer within eight weeks (eight weeks is tomorrow). I can see in my Credit Card account (being handled by Capquest, but still visible in my Halifax online banking) that they have credited a sum to my account. I don't have a breakdown of what this sum is, but it was ever-so-slightly more than I was expecting. My question is; given that I had to take this to the FOS and their intervention resulted in Halifax paying up, what am I entitled to in terms of interest? As an aside, I see this as deliberate delaying tactics on Halifax's part, and fully intend making a formal complaint about this - again involving the FOS if needs be.
