    • Good evening, My husband and I are looking for some help regarding a faulty car which we have recently purchased from Big Motoring World Enfield. The details are as follows: - Make - Nissan Qashqai 2017 1.2L milage 55,349 miles.  Date purchased -   01/06/2024 Price paid - Deposit £9000, finance £4794 (this includes the 3yr Nissan extended warranty), buyers fee £249.      Total including all fees etc = £ 13794.        Initially, during the test drive, there was no problem with the car at all and this is why my husband bought the car on the day. No problems on the way home from the dealership and up to three days after purchase, the car drove smoothly. However, after day 4, occasionally we would feel a slight shudder during some gear changes (automatic car). Over the next few days these shudders worsened and then on day 5 the car would make very a very loud shudder with every single gear change. It was at this point we contacted Big Motoring World for advice as we are still under the 14 days no questions asked return.  My husband contacted BMW for advice on 06/06/2024 and stated the problems as above. He spoke to a sales person who informed him that he should only take the car to a Nissan dealership (we have now been told that this is false information). We were also promised that a courtesy car would be provided for us after the fault on the car had been identified and confirmed by their mechanic fixing the car. We took the car to the garage that Big Motoring World had told us to go. Upon arrival there we discovered it was a third-party garage, not Nissan. We took the car to the garage on day 9. The mechanic ran a diagnostic test which found no faults, but after the test drove the car and below are his findings...   we scan the car but no faults with the gearbox showing but when I test drove the car it was really juddering and jumping.I spoke to my auto transmission specialist and he said they are very common on these as the CVT belt starts jumping within the box due to pressure loss.  We had this vehicle in for diagnostics for gearbox mate but both the gearbox and battery are faulty.Gearbox supplied and fitted comes to £3500 plus vat   Where we are at now…. My husband spent all of day 10 (11/06/2024) making phone calls between the garage, Warranties2000 and Big Motoring World. He tried, unsuccessfully to find out if the diagnostic reports had been shared between all three. Everyone kept saying the report hadn’t been received and yet the garage assured us it had been sent. Eventually we were told that the courtesy car would be given to us if it was deemed the works to fix the car would take longer than 8 working hours, and that decision would be made after 48hours of receiving the report. Today is day 11 and no decision has been made as nobody is telling us any decisions as people are off sick or on holiday! Today we called the garage and told the mechanic NOT to start any work as we will be returning the car. He said none have been started and we have left the car in his storage as he has deemed the car undrivable. I have sent an email to BMW now formally stating that we want to return the car and I have used the terminology that was suggested.   What can we do next?   Thank you everyone. .
    • Yes will do thanks Dave, I wonder what will happen at the preliminary hearing no idea what they will ask I assumed once I sent the proof they asked for about my sons condition that I would have just  been given the go ahead to be Litigation friend
    • First the judge will rule on you representing your son, which will be a doddle. After that the full hearing date will be fixed, with WSs exchanged 14 days before. So for the moment just concentrate on getting the right to represent your son.
    • Thank you, the mediations in a couple of days so hopefully they show up this time. I'll update this thread after how it goes

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

i had my decision through the post today (saturday) and i had the medical tuesday i did think thats quick i never thought id pass it it didnt give me any score though it just said i was put into the work group

its just not right they have made you wait 3 months !! they are indeed getting worse the gov are just shameful for us uk citizens the gov are more interested than the people who are coming into our country finding work ,

i have to ask myself are they just plain stupid to let all these people from other countries and they end up with our jobs (half of the time its because they will work for less pay) and they take benefits

and then the government say "we want 60% of the people claiming disability off the benefits and put into work"

well it would help if they didnt let people into our country and take the jobs in the 1st place ]

so to me we will always be worse off , and what makes me mad is, if we were to go to the countries the others have left, we would not recieve a nice welcome as the british government like to give

we were discussing what the original poster was talking about. Is this whole site going to be governed like this now as I have had 2 posts removed without explanation.

hi all

wonderiing if anyone can help ,

i didnt attend my pathways to work interviews (id been really down and didnt go outside my door plus my ex husband is around the town where the jobcenter is and really didnt want to bump into him as i was still frightened of him having a violent outburst)

they sent me 2 appointments then showed up on my door there were 2 people and i wouldnt answer (i never answer to strangers),

i thought "great they are going to stop my benefit" but it has been going into my bank but at a reduced rate im around £100-110 worse off each fortnight ,

problem is how do i go about asking for them interviews im worried ill ring them up and they will stop my benefit all together

any help gladly appreciated

thank you again

Hi Banks

They have applied a sanction on your benefits for each appointment missed, had the same problem when was on benefits,if you ring them

and explain and make another appointment they should lift the sanctions.

they really need to tread very carefully what they are up to with disabled people and their "sanctions".i have long said that the job centre and the culture within is no place for people with disabilities.they are at risk of and potentially exposed to ignorance, contempt, and not uncommonly mentioned on here exposed to personal verbal abuse.

the lack of awareness is astonishing.while people with the above and health problems are the most likely be in there for some time however staff leave, retire, move on the "customer" is left having to deal with someone else from square one.

Right you should have been informed of this and been give the chance to explain why you have not attended and also to appeal the sanction.

More infor on WFI/ESA/Sanctions & the process can be found here

So the 1st question is where you notified of the failure to attend? Whilst the 2nd is have to lodged an appeal?

Have you any communication from either the patheways provider or the DWP?

Banks ment to do this earlier

Right you have to get yourself or somebody to start at this. You can not be sanctioned further (lose more money than you are) so it's a bit of a no-brainer.

You need to contact the DWP and find out where these letters asking why you did not attend and the sanction letters are?

Then you need to fight this.

1stly get statments of doctor relatives etc on how you would not be able to travel there or open door to strangers.

2ndly argue that due to your condition/lack of notification etc that any appeal should be allowed.

Also if you can contact MIND/DIAL or anybody you think might be able to help you.

They expect you not to fight it but it's something you have to do!!! If you appeal you will more than likely win plus then you're protected from this guff for a fair while in the future!

I supose I'm lucky I have brief periods when I'm post attack or not ****ed I can do business due to being all panicced out.

I have no doubt that members of the Committee will ask about sanctions, and I shall explain the process. At the moment, the existing sanctions for ESA are open-ended until claimants re-comply with requirements placed on them, which usually involve a work-focused interview. Of the work-related activity component, 50% can be sanctioned for the first four weeks and thereafter it is 100%. As part of the process of tightening the regime, a person who disengages and does not turn up will lose part of their benefits until they do turn up. Thereafter, a lower-level sanction for non-appearance will apply, of the sort that the shadow Minister and I discussed in the Welfare Reform Bill Committee. The amounts have yet to be decided, but it is not our intention to remove any of the components we discussed in the Bill Committee—housing, child care and so forth. The sanctions will apply simply to lower-level benefit receipts

you must have been on pathways to work for a reason, the dwp are only to aware of this.therefore be wary of being "given the runaround".you are covered by the equality act.

doctors letters cost money, holding a sanction at an appeal is difficult against a disabled person who has a disability and effects of such, the dwp are all to aware of this also.

Hi

Agree with HB cannot see a problem as this is due to medical ill health of a relative.

What I would do is first thing in the morning is phone the actual job centre he was meant to sign on in and explain the situation and due to this will go into the local job centre at and give them the full address of that job centre.

Also to keep him in the right ask the person for there name and contact number so that he can give this information to the local job centre where he is going to sign on at so that they can confirm this with them while he is in front of them.

It would also do no harm in asking the actual job centre to contact the local one and explain this before he pops into that one.

He will only be able to sign at a different jobcentre if it is agreed prior to him leaving and he has to be actively seeking employment in the new area, if he is going to care fior somebody in the new area (however temporary) it is likely that he will be denied this and he should declare a period of a week to cover a domestic emergency. The maximum period that can be awarded is 1 week I'm afraid to cover the domestic emergency.

The form that is required if he will be activekly seeking (and most importantly available to take emploment) whether it is offered in the home area or new temporary area is form ES90 which needs to be obtained from your home office and there os a part that is completed by the issuing officer and then it has to be agreed with the new office that they will accept him to sign at their office (could be offered an appointment to complete and returm the form ES90) as it is not always a guarantee that te new office will have staff available to complete this action :o

I know this is an old thread but surely these So called HCP shouldn't get away with blatant lies. I recorded my medical the thing is it was in my pocket and you can barely hear anything she said to me but you can hear my replies to her so i have some sort of reference. What annoys me is how can a Nurse assess someone with Mental Health Issues unless they are a fully qualified Mental Health Professional. If they are going to knock you off these benefits they should at least make sure you are being seen by the proper qualified people.

I asked straight away what qualifications she had regarding Mental Health Problems and all she said was she was a RGN Nurse i said what right does a Nurse have to assess people with Mental Health Issues but she was typing away on the keyboard. I said this is a total waste of time i said your taking people off the sick who have cancer she said its not us doing that its the DWP. I said but its what you put in your report that goes a long way to the DWP Decision Maker takes note of. I wasn't very pleasant with her i wasn't aggressive which i was surprised maybe if it was a male Doctor id have flipped. If they are going to take my benefits off me i wanted to at least speak my mind. One thing that puzzled me was i was there for my Mental Health Issues but she did the Physical part of the medical which at the time i should have said something but i didn't because i was starting to get annoyed.

Here's mine word for word from 2010 (okay it's missing me going erm erm erm a lot). Zero points all round \o/

I highly recommend using a Sansa Zip clip for covert recording - works well (better than my phone did even under a thick t-shirt) clear as a bell and easy transfer of files to a PC or anything else. Records in wav format so plays in WMP (Windows Media Player!

k = a Nurse s = me

K. My names K I'm a nurse. Do you understand why you are here?

S. Yes

K. I see from the form you suffer from anxiety and depression?

S. yes

k. how long have you suffered with that?

s Erm.. depression was diagnosed 3-4 years ago. Probably been going on a lot longer than that. & panic as well same time

k. how often are you seeing your doctor at the moment?

s. erm erm when needed

k. so there's no regular

s, no er I've been going to see a councillor regularly

k. how often do you see your councillor?

s, erm initially it was every 1 week now it's every 2 weeks. Been referred for low cost psychotherapy which I'm just waiting to hear back from which should be twice a week for a year.

k. so apart from GP & councillor you see nobody else at the moment

s. no

k. any thoughts of self harm

s. no

k. what medication do you take

s. non

k. non at the moment?

k. do you sleep alright through or get up during the middle of the night anything like that?

s. erm

s. just get up

k. what about washing and dressing? do you do it daily or do you feel that sometime you can't be bothered?

k you don't what?

s. erm erm I haven't had a bath or shower for about a year and a half and basically wake up in the clothes I went to bed in.

s. super market

k. what weekly

s. yeah

k. or monthly

s. weekly

k. is that by yourself or do you go with someone

s. myself

k. do you drive?

ss. no

k. what about public transport? busses tubes?

s. no

k. you don't do that?

s. no

k. why is that?

s. erm I don't go out

k. is that because of other people?

s. erm every time I leave the house I basically have a panic attack

k. how do you cope with going to the supermarket?

s. erm just focus on getting there and once I get there things sort of calm down a little bit and because the supermarkets big and anonymous I can sort of navigate round so basically I set way of doing it so I'll go get one thing get another and that's it.

k. any hobbies interests at you can be doing at home

s. no

k. watching TV

s. I can't concentrate on it.

k. do you use a computer at home

s. yeah

k. how about reading newspapers magazines?

s. no

k. no?

s. no

k. listen to music?

s. mainly radio and if I'm out I listen to music as I find it sort of helps distract me

k. so you have an IPod or something and listen to your music?

s. yeah

k. how about friends do you have some good supportive friends?

s. don't know anyone any more

k. any family?

s. non

k. no family

s. not in this city no

k. do you use mobile phone

s. erm no I've got one but I don't

k. who helped you with the form?

s. welfare rights bloke

k. who?

s. welfare rights bloke

k. and what about your bills letters and that do you do all that yourself or does somebody give you a hand?

s. erm it's all on line so it just manages it itself

k. do you drink?

s. yeah

k. safe limits or over the top

s. over the top

k. how much would you say you drunk a day?

s. erm I don't drink daily any more

k. how would you describe your temperament? Are you a generally calm person do you get very angry are you irritable with people

s. don't know because I don't really see people

k. now what happens when you get a panic attack? Is there a certain situation which brings them on do they come out of the blue what happens

s. erm if if I go out basically as soon as I get out the front door sort of like my legs start going and I get tunnel vision head starts spinning then I fell like erm I feel like er my right foots collapsing and I basically just it just everything just goes and I'm not really in control I have to sort of like I basically just focus on myself going the shop just go shop and get there and when I'm there it sort of clams down a little bit but it doesn't stop until I get back and when I'm in the house if I'm having to do anything or go anywhere the same sort of thing happens. It's just it's a lot less severe

k. u hum

s. you sort of sort of know it's happening because everything's going a bit spacial its like.. like.. excuse me er just get confused

k.

s. and erm it.. just a sec erm erm that just keeps going on. Then after I've had one I just get a headache and I need to sleep.

k. do you find that once you remove yourself from that situation that you calm back down and it's ok or does it go on for a little while after.

s. yeah its its sort of erm its like if I get to the shop it sort of calms down for a bit but it's still sort of at a high level but it's not as bad as it was but if anything sort of happens it will kick it straight back off again. So if I've had one I'll have another one and another one till basically I'm just to tired.

k. ok I've got what I need to write the report is there anything you want to ask me?

s. no

k. then let me tell you what happens now this will go back to the DWP okay? If they have anything from your mental health team or GP they will look at that as well. Erm put everything together and usually write to you in two weeks. ok so just continue with what you're doing at the moment wait for the letter and see what that says ok?

s. mumbles

k. everything ok

s. sort of

k. you understand what the process is.

s yeah

k. so if you are sending certificate in from your doctor keep sending them in don't stop until you hear differently from the DWP ok? which will be in that letter that you get from them ok

k ok?

s. yes

k. well thanks for coming in I'm just going to let you out

I walked into a wall on the way out too

s. no I don't.

k you don't what?

s. erm erm I haven't had a bath or shower for about a year and a half and basically wake up in the clothes I went to bed in.

k. so you haven't changed clothes for how long?

s. well if I go out I put clothes on but erm if I'm just in the house I don't know usually a week to 2.

k. what about cooking do you cook yourself?

s. yes

k. proper meals or microwave meals?

s. depends if I remember normally it's just snack nuts crisps n things or if I can put something in the over or a pan I can do that.

k. any accidents in the kitchen recently?

s. erm no

k. what about things like house work?

s. erm I just Hoover every now and again that's about it.

k. you Hoover

s .yeah

k. anything else? washing your clothes in a washing machine?

s. well I don't get changed so there's never really anything to wash.

k. what about your shopping? Do you go to the local shops or supermarket?

s. super market

k. what weekly

s. yeah

k. or monthly

s. weekly

k. is that by yourself or do you go with someone

s. myself

k. do you drive?

ss. no

k. what about public transport? busses tubes?

s. no

k. you don't do that?

s. no

k. why is that?

s. erm I don't go out

k. is that because of other people?

s. erm every time I leave the house I basically have a panic attack

k. how do you cope with going to the supermarket?

s. erm just focus on getting there and once I get there things sort of calm down a little bit and because the supermarkets big and anonymous I can sort of navigate round so basically I set way of doing it so I'll go get one thing get another and that's it.

k. any hobbies interests at you can be doing at home

s. no

k. watching TV

I've just read through your transcript. I have had absolutely no training regarding medicine or benefits, but from a layman's point of view I am not at all surprised that you received 0 points!

Your explanations were all over the place, you contradicted earlier statements, you didn't pick up on the 'normally accepted' symptoms that they would have expected you to have and described a panic attack that I can't find in any reference book.

To be fair to speedfreek, the sad reality is that no matter what the claimants responses are the HCP is on a mission to score 0 points, IMHO one might just as well sit there like a dummy and say nothing for all the difference it makes. The way the system is at present, the only real assessment is at appeal.
