1, "failure to attend"

 

as this is ESA then you didn't turn up for a WCA (Work Capability Assessment) with ATOS were declared Fit For Work without a LCW (Limited Capacity for Work) decision.

 

2, The Decision Made On 14/9/2012 Is Set Aside

 

the decision made in 1 above is over turned as from the date above.

 

Note the DWP has the right to appeal this decision to the Upper Tier (as is yours) but it's very rarely they do this.

 

3, What does that mean? Hard to say as you need to give us a fuller picture of where you are with your ESA claim.

 

You will be paid any missed benefit payments from that date up to now and continue on as normal.

 

Usually with a FTA (Failure to Attend) the advice is lodge a new ESA claim straight away and get a LCW decision by attending and ATOS WCA. The appeal for the FTA is separate to this.

 

If you still haven't had a WCA (so didn't lodge a new claim) then you will have to have one.

 

We can only tell you more if you tell us where you are at tbf.

Congrats. The tribunal panel decided you'd good cause for not getting to those work capability assessments.

 

You'll be due arrears (of employment n support?) from 14 September 12, at whatever rate you were in receipt of. Currently it's taking Jobcentreplus anywhere between a few days and three months to process tribunal decisions. Payment of the arrears doesn't depend on a new Atos assessment.

 

Expect a new appointment for a work capability assessment some time soon and if you'd like it audio recorded;

was hoping someone might know a little about my situation

 

my cousin who lives 300 miles away asked me to have her 21 year old son move in with me to help care for me and also to keep him from a bad bunch of lads he was hanging about with , he has stayed here 2 weeks and its worked out okay , so he asked me if he could stay a few months ,

i currently get ESA and he gets JSA (the jobcenter closed his claim cos he didnt sign on) my brother gets carers allowance as he calls everyday to help etc

 

will my money be affected by my cousins son moving in ? and will he be able to claim jsa while living here (300 miles away from his home)

 

any advice appreciated

Can't see a problem. He will need to reclaim JSA at your address and nearest Jobcentre, your ESA should not be affected unless you receive the Severe Disability Premium. (And presumably you don't if your brother gets CA for you.)

 

If you get Housing Benefit, he may count as a non-dependent on your claim, but since he's under 25 and on JSA that probably won't be an issue. He must reclaim JSA as soon as possible if he moves in. He will simply need to use your address as his for the duration of his stay.

As you are getting care component of DLA, there would be no deduction applied to your HB for him, you may even get extra HB if an extra bedroom is allowed for him.

Thanks for that - I had an idea that non-dep wouldn't be an issue, but wasn't sure.

hi

i really dont understand what has happened today , they sent me a pip form to fill in a few months ago and then out the blue i had a phone call today saying that a home assessment professional would be doing a home assessment and the only dates she gave me was this wednesday or thursday , she said i need proof of id her words "as you wont be having a letter because its 2 days away"

 

why do i have to have one in 2 days ?

i have 2 carers living with me , my brother and my cousins son and they couldnt have chosen a more inconveniant time as my dog who i have had since he was 4 weeks old and is now 12 is dying i have 2-4 weeks left with him

hes my best friend everything to me , when i was going through a violent marriage he was there for me and when i lost my partner due to a road accident he was there ,

 

i dont even want to live thats seriously how i feel (i know ppl think its just a dog) but i dont have children and im 38 and hes my everything ,

 

ive had to have 2 carers move in cos im not sleeping , cant eat , im a mess ,

 

im worried now cos ive refused to have medication they will look at it negitively (like "she hasnt picked up her prescription she must be fine") but its just down to the fact

i dont care anymore about anything ,

my carer is on my case saying i have to have it cos i will have a vet bill of £300 to put him to sleep

i cant even type it im crying now with the thought of it , how the hell am i supposed to answer this medical person properly

im in a panic because lately im snappy at everyone and dont want this to happen

i have been feeling like a volcano ready to erupt

 

can anyone help me , what to expect or what i should do

i went to see my GP and having a family who have never been there an alcoholic mother etc etc , i told my GP i think i needed to talk to someone , because i noticed i was more aggressive when i was out , and i dont go out often , im at my all time low

so my GP said he would send a letter out for me to see someone ,

 

i am in wales uk ,

i had the appointment and she asked me LOADS of things i thought was weird because i thought i was there to talk to someone ,

she kept taking notes etc

 

well i just recieved a letter [ATTACH=CONFIG]58693[/ATTACH]

 

i dont understand what it means , why i was being "assessed" ?

will this affect my ESA ?

I read that letter to mean that you had an assessment to determine if you needed to be seen by the psychiatry specialist team, or if counselling / psychology was the better path for you.

 

So, you don't have a formal psychiatric diagnosis.

I can't see this affecting your ESA, as you have no new diagnosis.

Because mental health services generally are not sufficient for demand, people who have mental health issues are assessed to see if they fit criteria of needing care - for instance seeing a psychiatrist, community mental health nurse or other support staff. It looks like the assessment decided that you don't qualify for a full referral to mental health services, but are being offered some sort of therapy to help you with coping skills - possibly some sort of cognitive behavioural therapy.

 

As long as you still meet the criteria for your ESA group, then it shouldn't affect your ESA at this time - it will only possibly come into play when you are next assessed for ESA.

 

Secondary mental health services are for the most severe cases. Basically they feel you need some help, but aren't severe enough to be seen by a psychiatrist.

Hi All

 

i dont understand :

 

DWP sent me a letter saying "Looking At Your Personal Independance Payment Again"

 

i only just had a medical (doctor came out to see me) last year when my DLA tranfered over to PIP ?

and it stated they wouldnt be doing it again until 2017 !!

 

has anyone else had this , i cant believe ive got to fill in this form again

ive only just moved house , coping with my mother and cancer , finding out i have the gene and having non stop blood work done

this was the last thing i needed

 

any help id be REALLY grateful for

i cant find it anywhere so i must have binned it ,

Do you think it is because i moved house ?

ive only been here 3-4 weeks and im at my peak stress levels

 

surviving on no cooker because the house is electric only

 

no carpet in living room

 

my asthma getting worse

everyday my eyes are red raw from my allergies

my mother with her cancer etc etc ,

 

this was the last thing i needed right now

plus ive read somewhere that hardly no one passes it ,

if your claiming for for the same conditions is that true ?

 

ive got until the 9th and i have filled it in wether ive put everything is another story

what really annoys me is im a 40 year old woman and they act like i want to be the way i am

id love to swap places with them to feel "normal"

i Feel strong about this as im 40 and my auntie sent her eldest son aged 22 years old to live with me im in wales and he was in england to help and also she was worried he was mixing with the wrong crowd ,

 

i cannot thank him enough he does EVERYTHING from shopping to cleaning and cooking , his career is on hold and all he wants is a scooter so he can get around quicker as i moved 40 miles away and he moved with me , it literally is so hard for him i have to see him an hour later sweating and he suffers with a bad lung ,

 

everytime i try and save you can guarantee i get a bill especially as ive moved ,

 

my auntie was telling me that in england he would have had the option to rent out a scooter and charged very little through the jobcenter , hes looked for hired scooters but they wants £250 a week !!

 

does anyone know how he can get some help ,

i felt bad because he cant run a car its too expensive ,

he gets £61 on a monday and he only gets £53 and that is fortnightly , he roughly has about £290 a month , hes also paying bills ,

 

he has turned down jobs

 

so please anyone with any info on how he can get any help with a scooter id be so happy for him

They won't look at your claim again just because you've moved house. The only change in which they'd look at your claim again, would be if you told them your health had changed.

 

I'm sure I read on here somewhere that they were sending out the renewals a year in advance.

banksarggg, CB is right, this is worth looking into.

 

I suggest you start a thread in our benefits forum so that people can talk you through this and whether claiming carer's allowance etc would impact on your nephew's other benefits.

He does get carers allowance of £60 weekly (monday) amd they put him on income support of just £26 a week he gets £52 fortnightly ,

 

I have even tried applying for credit to pay for one monthly for him but every where I tried said you have to be in full paid employment 😢 ,

 

I don't know what to do , it's just the fact that because we are in a village wit 1 shop he walks 6 miles to the post office hes gone ages and him having a scooter he would be back sooner so that means more time for himself ,

 

Plus his girlfriend and him can't see each other much as neither have transport

And it's my fault 😭

I suspect the aunt was referring to one of the Wheels 2 Work charities. They offer mopeds to qualifying individuals at a low cost (typically, £30 per week) to help them back to work. The good news is there are three (possibly more) schemes operating in Wales, have a look at http://www.wheels2workassociation.org for more information.

 

I suspect that IS & CA will not qualify your nephew for any subsidised rental as he isn't currently registered as unemployed/looking for work.

 

If he has already completed the Compulsory Basic Training and holds a suitable license, saving up for a cheap, used moped may be an option.

Suggestion: Get him saving a regular amount with a local Credit Union, and he will be able to apply for a (relatively) low cost loan after a few months.
