i had my decision through the post today (saturday) and i had the medical tuesday i did think thats quick i never thought id pass it it didnt give me any score though it just said i was put into the work group

 

its just not right they have made you wait 3 months !! they are indeed getting worse the gov are just shameful for us uk citizens the gov are more interested than the people who are coming into our country finding work ,

 

i have to ask myself are they just plain stupid to let all these people from other countries and they end up with our jobs (half of the time its because they will work for less pay) and they take benefits

and then the government say "we want 60% of the people claiming disability off the benefits and put into work"

well it would help if they didnt let people into our country and take the jobs in the 1st place ]

 

so to me we will always be worse off , and what makes me mad is, if we were to go to the countries the others have left, we would not recieve a nice welcome as the british government like to give

 

we were discussing what the original poster was talking about. Is this whole site going to be governed like this now as I have had 2 posts removed without explanation.

No Problem i just wanted to help others as ive recieved so much help from all of you everytime i had a panic letter from the DWP id come here and all of you would reply within minutes , you put time aside out of your lives to help others , you really do make a lot of difference to peoples lives Thank You again :)

hi all

wonderiing if anyone can help ,

i didnt attend my pathways to work interviews (id been really down and didnt go outside my door plus my ex husband is around the town where the jobcenter is and really didnt want to bump into him as i was still frightened of him having a violent outburst)

 

they sent me 2 appointments then showed up on my door there were 2 people and i wouldnt answer (i never answer to strangers),

i thought "great they are going to stop my benefit" but it has been going into my bank but at a reduced rate im around £100-110 worse off each fortnight ,

 

problem is how do i go about asking for them interviews im worried ill ring them up and they will stop my benefit all together

any help gladly appreciated

Hi Banks

 

They have applied a sanction on your benefits for each appointment missed,had the same problem when was on benefits,if you ring them

and explain and make another appointment they should lift the sanctions.

they really need to tread very carefully what they are up to with disabled people and their "sanctions".i have long said that the job centre and the culture within is no place for people with disabilities.they are at risk of and potentially exposed to ignorance,contempt,and not uncommonly mentioned on here exposed to personal verbal abuse.

 

the lack of awareness is astonishing.while people with the above and health problems are the most likely be in there for some time however staff leave, retire, move on the "customer" is left having to deal with someone else from square one.

Right you should have been informed of this and been give the chance to explain why you have not attended and also to appeal the sanction.

So the 1st question is where you notified of the failure to attend? Whilst the 2nd is have to lodged an appeal?

 

Have you any communication from either the patheways provider or the DWP?

Right you have to get yourself or somebody to start at this. You can not be sanctioned further (lose more money than you are) so it's a bit of a no-brainer.

 

You need to contact the DWP and find out where these letters asking why you did not attend and the sanction letters are?

 

Then you need to fight this.

 

1stly get statments of doctor relatives etc on how you would not be able to travel there or open door to strangers.

 

2ndly argue that due to your condition/lack of notification etc that any appeal should be allowed.

 

Also if you can contact MIND/DIAL or anybody you think might be able to help you.

 

They expect you not to fight it but it's something you have to do!!! If you appeal you will more than likely win plus then you're protected from this guff for a fair while in the future!

 

I supose I'm lucky I have brief periods when I'm post attack or not ****ed I can do business due to being all panicced out.

 

I have no doubt that members of the Committee will ask about sanctions, and I shall explain the process. At the moment, the existing sanctions for ESA are open-ended until claimants re-comply with requirements placed on them, which usually involve a work-focused interview. Of the work-related activity component, 50% can be sanctioned for the first four weeks and thereafter it is 100%. As part of the process of tightening the regime, a person who disengages and does not turn up will lose part of their benefits until they do turn up. Thereafter, a lower-level sanction for non-appearance will apply, of the sort that the shadow Minister and I discussed in the Welfare Reform Bill Committee. The amounts have yet to be decided, but it is not our intention to remove any of the components we discussed in the Bill Committee—housing, child care and so forth. The sanctions will apply simply to lower-level benefit receipts

you must have been on pathways to work for a reason,the dwp are only to aware of this.therefore be wary of being "given the runaround".you are covered by the equality act.

 

doctors letters cost money,holding a sanction at an appeal is difficult against a disabled person who has a disability and effects of such,the dwp are all to aware of this also.

hi

i was wondering if anyone could shed any light

 

i recieved a letter saying :

"You could be entitled to The Severe Disability Premium please fill out form enclosed" which i did weeks ago

i live alone and no-one gets carers allowance for me

 

does anyone know how long it normally takes and also who do i contact to find out whats happening is it the DLA or the DWP ?

Hi all

 

i was hoping someone could help me ,

my cousin has had to go see our uncle who is really unwell and needs my cousin so he is staying with him for 3 weeks

would my cousin be able to sign on at the jobcenter which is by my uncle ?

he doesnt want to make a new claim because he will only be there for 3 weeks

any help much appreciated

Hi

 

Agree with HB cannot see a problem as this is due to medical ill health of a relative.

 

 

What I would do is first thing in the morning is phone the actual job centre he was meant to sign on in and explain the situation and due to this will go into the local job centre at and give them the full address of that job centre.

 

Also to keep him in the right ask the person for there name and contact number so that he can give this information to the local job centre where he is going to sign on at so that they can confirm this with them while he is in front of them.

 

It would also do no harm in asking the actual job centre to contact the local one and explain this before he pops into that one.

He will only be able to sign at a different jobcentre if it is agreed prior to him leaving and he has to be actively seeking employment in the new area, if he is going to care fior somebody in the new area (however temporary) it is likely that he will be denied this and he should declare a period of a week to cover a domestic emergency. The maximum period that can be awarded is 1 week I'm afraid to cover the domestic emergency.

The form that is required if he will be activekly seeking (and most importantly available to take emploment) whether it is offered in the home area or new temporary area is form ES90 which needs to be obtained from your home office and there os a part that is completed by the issuing officer and then it has to be agreed with the new office that they will accept him to sign at their office (could be offered an appointment to complete and returm the form ES90) as it is not always a guarantee that te new office will have staff available to complete this action :o

I know this is an old thread but surely these So called HCP shouldn't get away with blatant lies. I recorded my medical the thing is it was in my pocket and you can barely hear anything she said to me but you can hear my replies to her so i have some sort of reference. What annoys me is how can a Nurse assess someone with Mental Health Issues unless they are a fully qualified Mental Health Professional. If they are going to knock you off these benefits they should at least make sure you are being seen by the proper qualified people.

 

I asked straight away what qualifications she had regarding Mental Health Problems and all she said was she was a RGN Nurse i said what right does a Nurse have to assess people with Mental Health Issues but she was typing away on the keyboard. I said this is a total waste of time i said your taking people off the sick who have cancer she said its not us doing that its the DWP. I said but its what you put in your report that goes a long way to the DWP Decision Maker takes note of. I wasn't very pleasant with her i wasn't aggressive which i was surprised maybe if it was a male Doctor id have flipped. If they are going to take my benefits off me i wanted to at least speak my mind. One thing that puzzled me was i was there for my Mental Health Issues but she did the Physical part of the medical which at the time i should have said something but i didn't because i was starting to get annoyed.

I've just read through your transcript. I have had absolutely no training regarding medicine or benefits, but from a layman's point of view I am not at all surprised that you received 0 points!

 

Your explanations were all over the place, you contradicted earlier statements, you didn't pick up on the 'normally accepted' symptoms that they would have expected you to have and described a panic attack that I can't find in any reference book.

To be fair to speedfreek, the sad reality is that no matter what the claimants responses are the HCP is on a mission to score 0 points, IMHO one might just as well sit there like a dummy and say nothing for all the difference it makes. The way the system is at present, the only real assessment is at appeal.
