  1. Hello i was wondering if i could get some advice please. Trying to resolve my current bad credit rating with equifax (218) with two defaults lodged upon my equifax report - after years of avoiding i am finally in a financial position to repay/sort out my current credit standing. My basic back story: I had a current account with RBS since 2007 that then changed to have student overdraft facilities added in 2009 when i started studying. T he problem being i changed my address & stopped studying (I was only living in temporary accommodation) and neglected to notify my bank of the change - after years of just completely ignoring/not thinking about my maxed out overdraft its finally time for me to repay/sort out my bad credit rating. On my credit report it shows the account defaulted in 2011 - I phoned RBS to see if i could just pay the outstanding balance and they notified me that i can't get the default removed from my account even if the balance is paid. Is their any other option i could go through to try and get this default removed? The account ended in Aug 2011 - so waiting until 2017 isn't really the best option for myself. The second default is for the same address and its a BT broadband bill of £220 that is defaulted on my account. This is marked as May 2009 on my credit report - this means it will expire in this coming may for the six years mark. Is it worth just paying this or waiting? Regards Maunder p.s it may also be worth noting my credit rating for the exact same details on EXPERIAN state my credit score rating is 'GOOD' Why would this be?
  2. Hi all, Amongst my outstanding debts, 'Erudio' Student Loans from 1992-1995 is one of them. I am in the process of clearing up creditors on my DMP with PAYPLAN. Done the CCA's with each. Successful on two counts (had debts cancelled ��) I want to pay off, with a little capital expected in January, and get some Full and Final offers going. On here, I've been advised to check the PPI additions. I've heard just by phoning each creditor this is possible? I defaulted on my PAYPLAN for the last 2 payments. Erudio have sent me a letter stating the balance is £2000+, with arrears of £1930. Not sure if that means I add those to figures together for a final figure or not. Either way, they are now asking me to pay £1930, because I missed the last £55 installment....
  3. I hope this is the correct place for this post. I have a UK student loan that I originally started paying back in the UK. We then moved to NZ and as I wasn't working the loan was deferred for the first 12 months. We moved house again (still in NZ) and I wrote and advised the SLC of our new address a couple of times and even had the mail forwarded from our old address. I never heard from them. I've now received a letter from CCI Legal in NZ chasing the debt. My question is this: are they chasing the repayments on behalf of SLC or have they purchased the debt? Has anyone got any suggestions for dealing with them? Any advise greatly appreciated.
  4. Hi everyone, I'm after some advice on my student account. I've been in higher education for a while and have a student account with an overdraft facility. I just graduated this September just gone, from Open University. I had transferred from another university and my graduation date is later than first anticipated. When I first started at the new uni, I had gone into a branch to let them know I had changed unis and asked them what needed to be done. The staff at the branch asked me if I were still and student and I said yes. They said it's fine, so that's how I took it. 2 years later, they've contacted me saying that because I've graduated for a while, my overdraft facility was no longer interest fee. I owe approximately £450 for interest overdraft charges but they're willing to shave a couple of hundred off that if I paid straight away. I spoke to someone from the complaint's department and she insists she believes what I've said as she has no reason not to but she still believes that the charges and interest was applied correctly, which baffled me. They also said they sent me letters, none of which I have received, quite honestly. I am able to pay at the moment, but would rather not for obvious reasons. I just wanted to get a second opinion from people on here to see if I should just pay up and whether it's worth arguing it with the bank. Thanks in advance for your help
  5. Hi, I trade through my own limited company. My accountant has received a letter from HMRC, addressed to my company, stating that student loan deductions must start next month. My position is that any alleged debt is statute barred. Reading through other threads on this forum has confirmed this. What is my next step? The letter says that a penalty can be charged to my company if the deductions do not start next month. I would send the standard statute barred letter. However since this has gone through my company is there any other action that I need to take to avoid incurring penalties?
  6. I have an old student loan from 1993. In 2001 I fell into arrears and received a ccj. I have ben paying this off at a pound a month with their agreement. I have now had a letter saying that the debt has been sold and that interest and account charges are being applied. Can they do this? How do I fight it as they want @300 a year in interest and charges so the debt is spiralling out of control. There is no way I can pay it as i am on benefits. The original debt was less than a thousand.
  7. Hi everyone, I'm looking for some advice on an account with Honour Student Loans please. It's a little complicated and, yes, largely my fault, but any advice would be appreciated. I look at small ( This year I decided to enroll on a degree with Open Uni, starting with an Access course this year and moving onto the actual degree next September. It was during setting this up that I realised that I still had this loan, and that it had been passed to Honour Student Loans. I'm afraid my dealings with them have been far from satisfactory... They're telling me I owe over £1200, give very few details on how this is broken down - other than to state that SLC went to court in 2001, which I was never informed about. I've stated I want full details before I agree to any repayments, which they are refusing to do so. I have requested all paperwork, and will put in an SAR shortly if needed, before I make any agreements. Am I within my rights to do so? Whilst I may need to pay this off, I've already seen their attempts at bullying me into paying and I will not stand for that. I'll keep you informed of any progress.
  8. Hi all. I had a student loan / grant for a course started September 2004. I left the course early 2005 and claimed jobseekers. Jobseekers would not pay me anything until the summer as they said I had to live off the grant I had received. I still had to sign on but received no payments. About a year or two later the student loan company wanted me to repay the grant. I phoned them and explained how I was ineligible to jsa because of their grant, so if they wanted a repayment they could get it from the job center. She said she would look into it and that's the last I heard. Today, nearly 10 years later, I have got a letter as follows from the slc This is the first time I have heard from them so I don't know what the recent contact is they are referring to. I have moved house several times, but been in my current house 2 years. When I complete my tax return, if I bump up my income then the loan repayments are automatically added, so they surely know where I have lived all this time! I still have the loan to repay but have not yet met the income requirements. Is this statue barred, or is this type of debt not eligible? I didn't want to ring them until I have some advice as I don't want to open any cans of worms! Thanks
  9. hello friends, I would require some help to get correct info. I have contacted my local council and each time i spoke to someone in there has given me different answers to others, and this has confused us a lot. So thats why I would like info regarding the matter I am about to mention. I am in part time employment 24 hrs a week, earn around £1100 PM after deduction in tax, NI and pension. We live in a rented property and we get housing and some towards council tax benefits. My wife dont work and look after children age 6 yr and 13 yr. Recently my wife has decided and went thru some interviews to get admission in local college for a beauty therapy course 2 evenings a week (6 hrs per week) for a full one year and she has also got admission with other course Hair Dressing in another college which runs 3 full days a week (18 hrs per week) for a full one year. My question is 1) Would we both be exempted from council tax or the council will consider to exempt my wife ONLY and will I still end up paying council tax ? Would appreciate your replies.
  10. Hi, Im not sure where I should be posting this but here goes. I am a 2nd year mature student and last year got full dependents grants as I have two children, both of which need childcare while I study. This yesr however I am having major problems in that Im apparently getting much less (nearly £7000) even though my income this year is actually lower than last. If anyone had had the displeasure of dealing with the SFE advisors they will know how frustrating it is to get a straight answer on thresholds and entitlement. I was wondering if anyone knows what calculation they use for the dependant grants so I can try and work out why its much less this year. Im also really afraid that I must have had an overpayment last year since my income was higher but I got more. I just cant get a straight answer out of SFE and the not knowing is driving me to distraction. Any help massively appreciated. Dizzy
  11. Hi Guys Bit of advice needed guys. A girl I have recently started seeing told me that she has a CCJ against her name relating to her house share and an unpaid utility bill she was unaware of. the utility company were owed approx £1k from an 8 bed house and my Girlfriend was the named person on the utility contract. They then left the house, utility company pursued the debt, my Girlfriend probably buried her head in the sand as girls sometimes do and then next thing is a letter from court stating she has a CCJ. Queue the month to pay and satisfy the debt. ..she leaves it until the last minute, has been in constant contact with the utility companies solicitor who have stated on at least five occasions verbally that the deadline was 5pm today to make payment - she calls up, and then they say.. oh actually I have just re-read and the deadline was 5pm on Monday this week. When my Girlfriend told me this I was in shock - surely this is complete professional negligence? Said girl now faces 5 years on the CCJ register, wont be able to get mortgage, loan etc...severely affecting her financial future. What would you guys advise to do next? My advice was; Complain to them asking for their complaints handling procedure Complain to the Law Society Complain to the Legal Services Ombudsman Request that said Solicitor applies to court to set aside the Judgement or state it has been satisfied so she can get removed. Failing that I would be inclined to sue them for ruining my financial future... I fully expect at least 10 posts on how daft this is and should never have got to this stage but am hopeful at least one person responds with something useful! Many thanks in advance.

Hello, new here and hoping i can get some advice from you helpful people as getting through to CAB where i live is like finding a box full of hens teeth I had a Student Loan back in 1992 ( old style) the loan was deffered a few times in the late 90's and then they 'apparently' never received the last defferment in early 2002 and told me to cough up a large percentage of the whole loan in one go, being low waged i could not do this, they would not negotiate and i eventually panicked borrowed a couple of hundred pounds and payed them that and said i would pay no more, and asked for a new defferal - i moved house shortly after and apart from a letter forwarded from my old house from Mackenzie in the March of that year i never heard from them again until the end of 2008, this despite being on the electoral register all this time. I ignored these letters from Meritforce as i was advised by a friend that over 6 years had passed and the loan had been sold on. I confirmed from reading around on CAG that the loan was now time barred and having been made redundant a few months ago decided to go back to college and complete my degree and hopefully retrain - i went to the Open University and was told that i would be eligable for a grant, which is payed out by, guess who - the Student Loans Company. As the old loan ( of which i had paid off almost 60%) was now time barred when i filled out the form i stated that i did not have an outstanding debt with them. I recieved the very small £200 grant last week and thought all was well until today when i received a letter from the Student Loans Company ( not Mackenzie or Meritforce) telling me i am in arrears for my 1992 loan ( which due to extra charges i presume is now actually more than the original loan) and i must pay up, they have also restarted applying interest to the loan applied retrospectivaly from October of last year. Surely this cant be right? I also thought that the loan had been sold to Mackenzie and besides isnt my loan really time barred? Would really appreciate some help, thankyou.
  13. I am a student from the University of Kent. Recently I signed a contract with a student lettings company (however the landlord has not signed the client copy of the contract must I mention. But this probably doesn't make a difference anyway since there are two signed agreements from all parties with the landlord himself and with the agency.) The rent is from September 2014 to July 2015. There is no break clause from the contract either. Unfortunately I did not pass one of my exams and I also have a startup company that was just accepted into an accelerator program in the San Francisco in August, so I will be travelling there for a month in August. This is when my resits take place and therefore I won't be able to resit that particular exam, therefore unable to continue with my second year and thus won't be able to pay for my rent in the second year that I am liable for. I haven't managed to find a replacement tenant either. I am now in a position where I cannot pay the fees for the house as I am not going to University for a year and I do need some urgent advice on this. There is no way I can afford that rent without going to University, my University won't let me continue unless I resit and the next resit dates are August 2015 - forcing me to take a gap year. If you guys can help me out here that'll be great! Cheers!
  14. Hi all, Just wondering if I could grab some advice. I am a student nurse on maternity leave and also a single Mum. I receive a maternity bursary, maternity allowance, child tax credits and child benefit. I was advised to apply for Housing Benefit, so I went to the housing office and made an appointment. I brought all my financial information with me, and made the housing advisor fully aware that I was a student. She made the decision to not take my student maternity bursary into account as she wasn't sure if she was supposed to. They made a calculation that I should receive some housing benefit (most of my rent). Two weeks down the line I get a letter telling me I owe them £143 overpayment. I have submitted a letter of appeal, but just wanted some advise if possible please. I mean, if I wasn't entitled, that's fine but how is it fair that they make the wrong decision and I must pay for it down the line? I was 100% honest and open with them about my status and income!   15. Hi, hoping someone can help. I was contacted today on the phone by the student loan company telling me I was overpaid £180 in 2006, the last year in which I was a student. First, I told them that they should send me all the information by post as I will take nothing they say over the phone. They claim they have sent me numerous letters since then but I changed address in 2006. They said it was not their responsibility to send any other information and contact student finance. At the same time they said that they had been informed off this overpayment in 2006 but could not explain why it's taken until now to do something about it, especially when they got hold of me over the phone straight away. Lastly, they said they would send the bailiffs if not paid ASAP. When I contacted student finance I was unable to pass the security test as I cannot remember or do not have some of the details they require. So it's been left an impasse until I can find a way to get the info. What worries me about this is - that it's taken right years for this to kick off without it getting any further. - the threat of bailiffs even though no one can tell me what this £180 is for. - the reluctance to send any more info. Can they do this? Is it legal? What should I do? Many thanks.
  16. Hello, I need some advice.... Brief back story.... I have old style student loans which have been sold to Erudio. I have always been in deferment as only work part time and am way under the threshold. I received a deferment application as usual from SLC (in february) which I completed as I always do - I had no idea at this point about Erudio buying my loans. I then received a letter dated 11th March from SLC which clearly says my deferment has been accepted and then lists the loans which are "Erudio Student Loan administered" - the letter clearly states this then says I have deferment from 25th April 2014 to 24th April 2015. Following that I received a letter from Erudio explaining that they had the loans. I thought nothing more about it - I had a letter which clearly says I am in deferment. However, I have been offered a place to study a PGCE in September and recently applied for Student Finance. I spoke to them last week and was told I was not eligible for student finance as I am in arrears with Erudio. Needless to say I have spent a week on the telephone and emailing to try to get this resolved. No one seems to want to help me in any way and I am now facing the prospect of not being able to accept the teacher training offer as I cannot afford £9k fees if I can't get the student loan. Erudio are a nightmare to speak to and no one actually rings or replies like they say they will do. I have sent them a copy of the letter I have from the SLC saying quite clearly I have deferment until next April but have not received confirmation that they will accept this or back date the info so I am no longer in arrears. I have also just read that this may now be on my credit file - which I daren't even look at as it will just stress me out too much (my credit score and rating etc is absolutetly un-blemished and I have never ever been refused credit, never been in arrears for anything etc) So what can I do??? SLC do the whole "we can't help, the computer says no" type of thing even though they can see the letter they sent to me in March. Sounds incredibly melodramatic but see my future career plans crumbling around me and can't do anything to put it right Thanks in advance for any help and advice
  17. I have been a mature student in the past and attended at least two different Universities - one in 1999 and another in 2002. Neither courses were completed for reasons to do with past childhood abuse trauma that has impacted upon my adult life to an extent I never imagined possible, and has affected job prospects as well as integral self-esteem about achieving a career of somekind. I have recently received a shocking student loan statement, that shows how much I owe in terms of past student debts, and the interest that is being wacked on each year - despite the fact that I am not in work and - in receipt of vital disability benefits due to my mental health conditions. The statements are not requests for repayment of the loans, yet, I am wanting to find out if there is any possible action I can take about having the loans written off, and especially in view of the fact, that it is doubtful that at 41, I will unlikely be in a well-salaried job. I understand completely that the vast majority of students will incur debt via having taken out student loans in their time; yet in all honesty, these people will not be in the kind of vulnerable-adult situation that I face - I also live in long-term supported housing. I also understand that unless you are earning a salary as low as £15'000 per year or whatever it is now, you only pay a minimum back. Yet what I am trying to establish, is the fact that former students should not be made to ever repay loans if their personal situation is exceptional as mine is and will be for some time. I am positive that I can get these loans written off, as they can and do in the United States, here in the UK. I am not wanting morally charged answers to my question, just someone who may be able to offer me helpful advice.
  18. Just posting this out of interest, as nothing has actually happened, but I was speaking to my daughter recently regarding her campus accomodation agreement. According to the agreement, the uni can fine students for inappropriate behaviour (one case in question is wedging a fire door open during hot weather). Question is basically, can a university levy fines against students for not following procedures, and more to the point, can they refuse to hand out degrees and results if the 'fines' are not paid ?
  19. HI I'm a part time student on ESA. The Job Centre are aware of this, I asked them for advice as I was looking to studying an Access course, I got none, but they kindly sent me a change of circumstances form. I'm going to the interview soon and will ask to do the full time course part time because I'm unable to study full time. I'm worried my ESA will stop because I'm studying an Access course. Can the Job Centre do this? Do I have to prove this is therapeutic study somehow? Thanks
  20. I also have this letter from SLC about them being non compliant and giving me reduction, but it doesn't say that Eruido or anyone else is taking over. There's no mention of it being sold. I have not been informed of this. Then I got the Erudio deferment pack. A few years ago the SLC refused me my legal rights to deferment and refused over the phone to send me a deferment form, saying that I could only defer for so long and that time had come to an end and now I had to start paying it back. I argued that i wasn't earning the threshold and was told that didn't I still had to start paying it back. I was scared I didn't know what to do, so I left it. Consequently, cos I didn't defer, Got harrassed for a few years by debt companies for arrears that had built up cos I hadn't deferred. I would say that refusing my legal rights to deferment is motion enough for statute barred. Has anyone else had this particular problem of the SLC lying to them by refusing to send out a deferment form?
  21. Hi All, I took out a new style student loan (in '99/2000), which I was paying (slowly) through PAYE, before I moved to New Zealand around 6 and a bit years ago. I have, since making this move, received no further contact on this - despite having a forwarding address at a previous UK address. I have, however, just received a Final Notification letter to my current address in New Zealand from SLC informing me they plan to pass my debt to a debt collector unless I pay 1300 pounds of arrears in the next 21 days. As stated this is my first contact from them. I therefore be really grateful for advice on the following: 1) Could this debt by Statute Barred (have read in some places these new style loans were 12yrs rather than standard 6 yrs)? 2) how actively can they pursue me in NZ? I have no plans to return to the Uk and no UK assets. I am not altogether unwilling to start payments for my loan, but certainly wouldn’t be able to afford the repayment rates as represented on the SLC site for overseas payment and think the arrears seem somewhat unfair. If I know my position I'll be able to decide how to proceed. If I can get this Statue Barred, as I am in NZ I'd think they would struggle to take payment from PAYE so I could presumably determine my own repayment rate on this with no comeback. If they are unable to successfully/actively pursue me in NZ it will affect my bargaining power should I decide to attempt to agree a payment schedule with SLC. As yet, I haven’t responded to this and have made no contact (or payment) for over 6 yrs. Any advice much appreciated! Thanks.
  22. Hi I hope someone can help me, I have been in receipt of Disability Living Allowance Higher rate care & mobility since 1999. I have also been in receipt of Severe Disablement Allowance (SDA) continuously since 1998. My benefit didnt stop when they scrapped SDA and replaced it with Incapacity Benefit. I was just told I could remain on SDA indefinatly. This was also the case when they scrapped Incapacity benefit for Employment and support allowance. My benefit didn't change. Alas, I have today received a form ESA50 to migrate from SDA to Employment & Support Allowance. I knew this would happen sooner rather than later due to all the benefit changes etc. Having read the rules for exemptions for medical assessment I notice that I may fall into one of the categories for exemption of the assessment and am seeking confirmation that I am correct. I am a mature student (age 34) studying 5 GCSE's on a full time college course. I have been on the course since Sept 2013. I read on a website that as a student who is in receipt of DLA then I am treated as having Limited Capabiliy for work. Please can somebody clarify this information. To give you some further info about my circumstances...I live with my husband and 3 children. My husband works full time but earns minimum wage. We also receive tax credits and some housing benefit. I'm also wandering where I stand with claiming ESA due to my husband working and if this impacts on my exemption from the medical as I am a student. Hope this all makes sense!   23. Hello I've had a very worrying conversation with Erudio and now am very afraid of what lies ahead. My have an old Motrage Style loan. To give you some background, due to some tragic circumstances, I have been a single parent since my little one was born and work 4 days per week. Due to my salary I have Working Tax credits to enable me to pay nursery fees. Due to the top up I recieve from Tax Credits (for childcare) I have been approx 106 per month over the threshold for deferment. This has been the case for approx 18 months. SLC have been very understanding of my situation and agreed to a private agreement of me paying 50 per month. Anyway...today I called to make my monthly installments and have been advised that the debt was sold to Erudio so I would need to call them and make payment. I then called this company for them to scare me sh1tless....I explained my payment plan (which they accepted) but have advsed me that that if I do not pay the arrears on my account (which is just over £2000) then I will lose my right to defer ever again, and will also not be entitled to have the loan cancelled when I reach 50. My long term plan was to defer when my daughter goes to school in September (as i will not receive CTC so will be under the threshold) then pay the arrears each month after that) I cant believe this company has been able to buy the loans, and thus treat people like this. My work are offering Voluntary Redundancy and I am now considering taking this so that I can pay my Student Loan and not get my credit rating trashed. Is anyone else in a similar position, or even know if Eurodia are correct. Thanks In Advance
  24. Hello! I have a graduate account with Natwest. My overdraft is £1600, I know very silly of me but then it's offered to a student with no money it's very tempting! After uni I was unemployed for a year, Natwest were pretty awful. I have NO direct debits active on my account. I've been charged £36 a go everytime I go past my unarranged overdraft (out of my job seekers money). Thing is, I only take money out when it's says it's available on my online banking app. It's pretty annoying to get charged when I take money out which is apparently available only to find out it's not. 2 months ago my balance was -£1588 so I withdrew £10 from a cash point and think no more of it. I visited tesco earlier in the day and spent money, which apparently was pending and didnt come out until 2 days later, leaving my account as £1608. Natwest charged me £96 for this as I had no way of paying back into my account to make it level again for a couple of weeks. I've been unemployed since university but I've recently found employment which I start next week. I've opened an account with barclays and plan to get my wages paid into that, then every payday pay a bit towards my natwest overdraft. I'v sent a letter complaining about them charging me, and charging me when my account was already past the overdraft limit and received this reply. Is this a good reply to them or is it worth me chasing it some more? Is there anyway I could close the account and set up a payment plan with Natwest? £2385.99 of charges in 9 years is pretty disgusting and even getting the £92 back would be great.   25. Hi, and Hello to those of you that know me already! My daughter has a loan with SLC and had to drop out of Uni after a year do to Mental Health Issues, that was about 4 years ago, she is still having these issues and has been on ESA for most of this time. Because of this, I have been dealing with the debts that she built up (due to mental health issues) and I have managed to sort most of them apart from SLC, I have given them proof that she is on ESA but I wont given them her address as she is a vulnerable person and isn't tough enough to deal with it. She gets about £52 per week to live on, I pay her rent so that I know she will have a roof over her head, everything else, gas, electricity, food, clothes, travel, she has to pay for. This morning SLC have phoned me to say that it is their Policy that even if you are on benefits, you have to pay something and he suggested between £10 and £30 pounds per month! I asked him if he could live on that amount of money and he declined to answer, I also told him that if he kept ringing and harrassing me for payment, I wouldnt be amused. I also stated that once she was fit for work and was earning, she would make arrangements to pay. He them told me that they might have to take further action, I wished him luck taking a vulnerable person to court for a debt that they wouldn't be able to pay because they are on benefits. I asked him to send me an income and expenditure sheet but I could do with some advice as I am not sure where to take it from here.
