  1. just a quick one, i done the full HPI check on a car a few days ago , All came back ok so i purchased the car for 8k but i tried to call the seller a few times since to see if he had a spare key as when i picked the car up he said the company he buys from sometimes finds a spare and then he would pass on but the phone is permenetly off or turned off, He has also closed his Ebay account from which i first seen the classified add on , he also had zero feedback and had only opened his account the day before the car was listed , like i said i have had the full works hpi check and even went to a local garage for them to do which they did for £10 and all came back good, just a bit suspicious with him closing of the account on Ebay , Can anything come back and kick me in the ass after all the checks ive done
  2. Hi everyone! I had recently a bit unusual ebay case on the ebay as a seller. I'll try to describe it below, but sorry for my English , I am not a native speaker. In the end of June I sold on the ebay a piece of relatively expensive equipment on the ebay (selling price was $4000). Next week after the end of the auction I intended to go to the vacation and wrote to the about this to the buyer as well as offer to pay later (in 3 weeks, after I come back) or cancel the deal if he not able to arrange payment before my leaving to the vacation (3-4 days, so I could post item immediately). He agree with dispatching after 3 weeks and paid after 5 days. As soon as I come back to Italy sent the parcel to the buyer by "priority international parcel" and sent him tracking with scanned cpy of postal receive. To tell the trough the tracking number work by a bit strange way: it was not indicated on the web site of Italian post and on the usps.com starting from 2-nd or 3-rd day after dispatching it was indicated as "Origin Post is Preparing Shipment". I made a couple of phone calls to the help line of the Italian post and they confirmed that parcel is dispatched, and now processing on the custom. They where also able to tell the dispatching date and address of the dispatching office. So I forward all this information to the buyer. on the 1-st of August (a bit more than one month afte the end of the listing and after one week after dispatching) buyer opened the case on the ebay. I again provide him tracking number and wrote about possibility to call to the post. two weeks after (3 weeks after dispatching of the parcel) he escalated dispute to the claim and I got a huge minus on my PayPal account. Once again I informed ebay customer support and buyer about possibility to confirm shipping by calling to the post but seems this offer was ignored. Finally 26-th of August (1 month and 2 day after posting) parcel appear on the usps.com and tracking told that: >Processed Through Sort Facility August 27, 2013, 7:41 am ISC NEW YORK NY (USPS) I forward this information to both, ebay resolution center and buyer, then start to wait. on September 2-nd I got letter from the ebay that "Your account was debited to repay eBay" I got zero balance and ebay took $580 from there (there was no money on the PayPal). ebay was not able to get any money from "reimbursement payment method" because credit card I entered there expired in April and they never ask me for the new one on September 3-rd tracking on usps.com finally told that that: >Priority Mail International Parcels Delivered September 3, 2013, 11:18 am I immediately forward this news to ebay and buyer, asked him immediately contact me in the case of any problems with the equipment (damaged, lost etc) and also ask buyer to close ebay case if he didn't received payment from the ebay or pay me again if he got it. I didn't get any answer until now. on September 4-th I appeal ebay case on the ebay and indicated that Item is finally delivered, dispatching date can be obtained from the scanned copy of postal receive or from by the phone call to help line of the post. They promise to respond in 48h but answered after 5 days following: So, they ignored possibility to check posting date again and they claiming that I sent parcel from Europe same day when it's appear in the NY. So, finally I am somehow upset with this situation but I didn't rally suffered financially from it. Ebay was able to take $580 from my account but I was owed to the ebay $290 as a seller fees, so total loss is less than $300. My account is blocked but in any case I didn't plan to sell anymore on the ebay for obvious reasons. As far as I understood ebay sending me two types of letters: to pay $290 seller fees (this would be very reasonable requirement in normal situation but after ebay steal from me $580 I am doubt if I should do this or not) to pay $3400 "reimbursement payment method" (what I consider as obvious [problem] from buyer or ebay because I have proofs of posing and delivery of the item as well as no complaints about damage or loss of the imem). What would you thing will be the most rational thing to do in this situation? Just leave everything as is? To pay seller fees and try to bring ebay to the court after (in order to get my $580)? To send some complain to the local police office? I would not spend plenty time for the actual loss of $300 but if there are some chances to escalate this situation to any direction it might has sense to pay more attention to it.

Hi there, I am new to CAG just joined today, and I am only 20 so please be gentle with me lol I have an ebay account but I recently got made redundant, I have always paid seller fees and I think been a very good customer, obviously with being unemployed at the moment I cannot pay the seller fees. I have a job, but I am waiting for my criminal record check to come back before they will let me start, so anyway I rang Ebay and said you know I have no Job I cant pay these fees that are £40.51. The lady on the phone said well theres really nothing we can do about that you must pay it, I answered how can I pay these fees when I have no job? She said you need to make a one off payment by the 15th of september otherwise we will suspending your Ebay account, I said so what happens when my Ebay account is suspended she said you cant use it and your account will go into the arrears department! I said oh right, so what happens if I dont pay it because I cant? She said and then Ebay will come to your house and get the money at which point I put the phone down, I know from my mum being a member of CAG that they have absolutely no right but im just wondering what do i do now? I cant pay it!

Not sure if this is in the right palce but here goes x I won a car on thursday night on ebay and paid the £300 deposit for it as described to hold the car, went to pick up the car , over 200 miles away and it was no where near as described, It was described as immaculate and not a single blemish, Turned up to find 5 dents on roof , few on the doors, front bumper not lined up , advertised with xenons and had normal bulb headlights, advertised with led door handle lights , none fitted , at this point we said it wasnt for us and at a cost of £70 fuel we headed back home, Now the big question i want to as you guys is that will i get my £300 deposit back, He said he would refund it no problem as soon as he got home and have now just text me saying he wont, so alarm bells are already ringing with him being dishonest as not describing the car truthfully .. What do i do next guys as im reading conflicting advice saying i will get it back and some saying i wont as paypal dont do refunds on motor vehicles Cheers guys
  5. The problem hasn't fully happened yet but it's on the verge of it and I could end up £500 out of pocket. I'll try and be brief. At the start of this month I bought an electronic item off a website (Music studio keyboard). The RRP was £520 but I got it for just under £500 as the box was a bit crumpled from warehouse storage (The item inside however was brand new and completely sealed). When it arrived I took it out of it's box and realised it's a bit too big to fit where I wanted it. I knew I wouldnt be able to get a refund as it's not faulty so I decided to take it on the chin and sell it on ebay at a slight loss but a lesson learnt to completely measure up before buying anything in the future. I gave it a 5 minute test and everything worked perfectly (as expected for a brand new item). I listed it as new>other and explained what I paid for the item and reason's for selling. I offered no return's policy as these specific items are known for working for many years without a problem. I received an offer on it for nearly £400 and as it didnt look like it would sell I accepted the offer (at a £100 loss). They paid and I sent the item in the same packaging it came in (boxed with 3 layers of bubble wrap and 2 layers of cling fillm so it wouldnt get damaged in the post). I spent the money on some other things and today they have been in touch saying that the item's sound bank's and demo's work but none of the key's work. I'm pretty certain that it's something they have done wrong and not linked it to their computer correctly or has not configured it correctly. Otherwise they have plugged something in wrong and broke it. They said they were getting a friend to test it who knows a lot about them and I should hear back from them shortly. Here's the predicament. If they do get in touch with ebay, ebay will always favour the buyer. Had a similar situation before with an item where they favoured the buyer (faulty good's), I was forced to accept it back and they took the money for the refund right out of my bank. Even though a few days later I relisted the exact same auction, it sold and the new buyer was more than happy with it. I don't know what to do because if I am forced to accept it back, I will be out of pocket massively. If they have indeed broken it, im going to be £500 down, if they just didnt use it correctly, chances are they wouldnt of packaged it back up in the same way they received it and I will have to sell it as "used" and have a total £250 loss
  6. hi everyone, i have an problem and hoping to find a solution here. I sold some items on ebay and the listing was removed by the company through ebay VERO. i contacted the company who removed the listing and they told me i can't sell that item as they say its counterfeit. I received a letter from pb legal solicitors after a few months asking for £550 legal cost and all the profit i made by selling these items. I know someone already discussed a similar issue with the same solicitors in 2010/2011 but I don't know if that person paid the solicitors, ignored them or negotiated with them. Please advise what steps i need to take to escape this problem. many thanks
  7. H i I purchased an electric golf trolley from an ebay shop. The trolley was faulty and they sent out some parts for me to replace. Trolley still faulty so they sent me a new trolley chassis, this lasted one round before packing up. To send both trolleys cost me £43 postage. The company only sent me a refund for £171 ( purchase price). This was sent through paypal and because its over 60 days since purchase it hasnt been paid as a refund so I will be charged on that money. By my reckoning i'm at least £50 out of pocket can anyone suggest my next move ?
  8. I have sold two items on ebay. On both occasions I selected a reserve price. On both occasions the bids increased until the reserve was reached then the high bidder retracted their bid. When I complained to ebay and gave them proof of this activity, nothing was done. Do they care about sellers? or do they just want totake the listing fees ?.

Hi, I recently sold a mobile phone on ebay for £200, I listed in the article twice that the phone had a defect and I had numerous emails from buyers asking about it which I gave full information on, some of them bidded. It was then sold and the money paid - i sent the item out, a few days later the buyer puts in a dispute saying that the item doesnt match description as it has a defect (yes the same one i listed in the article). After a few back and forward emails ebay stepped in and yesterday I got an email saying they have decided in buyers favour - immediately i contacted ebay who informed me this wasn't the case and it was an automated email but they have asked buyer to send item back and i should check it when it comes back for any faults. Now if they would of read his complaint to me they would of realised it was the same thing i mentioned in the article and looking at ebays OWN terms and conditions it does state that they will not decide the buyer is right if the defect is mentioned fully in the article... but obviously it seems they have ignored this and are trying to push for a refund anyways... as far i'm concerned they are now in breach of there own contractual agreements with me and anyone else who has a similar issue. I am pushing the complaints every day and seeing if I can get anywhere but keep getting conflicting emails off different members of ebay staff all the time. Some saying when I get item then I should appeal and say it does match description, others saying it will auto refund when it is returned. I have closed my paypal account (can they still push a refund?) and will be closing my ebay account after this, I am totally unwilling to give a refund based on what the buyer has said (he has simply changed his mind). Does anyone know where I stand on this as I am totally willing to push a small claim against ebay for breaching the contract and going against there own buyers/sellers protection guidelines. As you can imagine, this locked my paypal account for like 2 weeks and caused loads of issues with shops I use paypal to pay - and it looks like this is going to continue for a while yet.   10. Good morning all. Can anyone advise me what to do with this problem? I bought an Ipad mini case off an Ebay seller not one of the cheap little cases but a more expensive version as I wanted a reliable 'Sleep wake' function as I do my work on my ipad and have a habit of leaving it on...not recommended... I have had this case for 2 months and it has stopped working unless I press very hard and move it around which is making marks on my ipad....again not recommended. Ebay have a 45 day resolution code in place so too late to start that I have contacted the seller who has told me to return the item and I quote 'In its original condition with all packaging intact' I have explained that it is impossible for me to do this and of course they are now ignoring me. My question is have I any rights at all or do I just chalk this up to experience and buy a case off the high street? My apologies for being long winded but I wanted to explain the situation. many thanks in advance Rose
  11. Hi, Please can someone advise me as this debt company is ringing me 3 to 5 times per day as well as sending me threatening letters. I owed ebay £62 my account was suspended until I payed it but in meantime I received letter from this IQOR saying I owed £78 and demanded payment in full. I told them I couldn't pay straight away so asked when I would and that I had to ring them up and pay over phone. I decided to check my ebay account and noticed it had £62 and allowed me to pay ebay direct which I did. I have had this company on my back today 3 times saying I have to pay them the £16 I owe which I said I don't see why I had to pay them anything and had already settled my fees which ebay accepted. I have now been told by IQOR that they will be pursuing me for the £16. Please help can they do this and will I have to pay them as I'm now getting really scared I'm going to end up paying them even more if I'm took to court.
  12. I recently purchased a dehumidifier from an ebay seller. Item was listed to be brand new and seemed to be a bargain. I sent a message to the seller just to confirm that the item was brand new i.e box unopened, I also asked does the humidifier come with the manufacturers warranty. I was informed that yes the item is brand new and comes with the manufacturers 12 month warranty. What I didn't realise was the the seller is private, checking the product registration it is requesting what company was the dehumidifier purchased from and the date? Because this was a private ebay sale. I dont believe that I will be able to register the product for any warranty problems. Any advice please?

    Hi, I have an issue regarding ebay spoof that we have recently been the victims of. Before i go any further please do not think that i am stupid. I am normally so careful with my money and feel so stupid at what happened. I will try and keep it short. My partner have been looking fro a mobile home for some time. One recently came up on ebay. We communicated with who we thought was the seller via text as he told us his hearing had been affected by an accident. Called ebay, they confirmed that the advert was there and read it to us word for word. Invoice came through with his bank details. (Barcalys Leicester) Transferred the money which included delivery. Mobile home never turned up. The person who we thought that we were buying from has sent us confirmation that his account had been hacked into. The police and Barclays have been of no help . All ebay will say is they can find no trace of the sale. Can anyone offer any advice please.
  14. Hi I have recently sold a new galaxy S4 on ebay then after 5 weeks the buyer as opened an item not as described case. The buyer left positive feedback saying the Good & genuine product good service. I spoke to the buyer trying resolve this and quite clearly stated in those messages I am not prepared to give a refund as this was brand new and worked perfectly. The buyers problem is that apparently it as now got problems getting a signal which it didn't have until 5 weeks after?!?! I have offered to ring the shop I got it from to see if it would be repaired if this was the case but never heard anything back for 9 days. I then after speaking to ebay support I escalated the case as there had been no contact from the buyer and being assured that the case would go in my favour as it was accurately described and genuine product and the description also stated no returns accepted. 2 days later I get a final decision siding with the buyer and Ive got to give them a full refund!!! How can this be??? I'm now going to end up with a used damaged phone if its even the same one and have to give a full refund for a brand new phone that obviously in the 7 weeks that's gone past now isn't worth as much anyway and is used. It seems to me that Ive been ripped off and cant do anything about it? its one way of getting a mobile phone for rent free for 2 months! Is there anything I can do? cos to be honest I don't have the money now so I assume they are going to take it straight out of my bank account. Surely this cant be right!! Ive done nothing wrong but look like I going to be £500 out of pocket for selling something brand new and working please somebody advise
  15. Hello All, I have a problem with ebay. A buyer opened up a case with ebay saying the item I sent him was damaged - in the resolution process I asked for video or even just a picture of the damage so I could email it to the courier company so they could go to his address and inspect the damage.Once the couriers have confirmed it was dmaged I was going to refund the buyer and not require him to return the item as the couriers would have refunded me and paid for the item...BUT the buyer wouldnt even take a picture nor let me have his phone number etc which is strange! After being away for a week I checked my ebay account and the buyer has esculated the case to ebay and they've ruled in his favour - they havent told him to return the item and they have said they will be taking the refund from my 'reimbursement payment method' in 10 days time which is actually now only 7 days time. I have opened an appeal but dont hold much hope as ebay can do what they like and everyone is at the mercy of them Does anyone have any ideas what to do incase they still take the money without returning my item. Thanks.
  16. Hi All - seeking advice from those in the know. Brief background, or as brief as i can be. Sold my conservatory on ebay auction for £1300. Inthe following days the buyer arranged to come and look at logisitcs of taking it down. There were some mails and texts to say about timing, they were trying to pay a deposit of £300 but were having some isses, agreed they would pay when they came to visit. 10 days later they came to the house and for an hour and we discussed how to take it down, size of van needed for transport etc. The reason for saying all this is that this was not an impulse buy, bid on wrong item etc - they gave every indication of going through with it. After an hour they made an exscuse to go to their car and a few mins later drove off. I waited 30mins and texted them to see if they were coming back - no answer. Sent text to his wife and she said they needed to think about it then later got text to say sorry for wasting time but not going ahead. I contacted several other bidders and as 10 days had past they had purchased other conservatories and so i could not sell to them either I mailed the buyer and told them i intended to relist and that any difference i would treat as my loss as they had a contract with me to buy and i with them to sell and that due to their delays i could not go to other buyers and so i would hold them responsible for any difference Re-sold conservatory for £485 so significantly less !! We are having an extension built and so there is a time constraint on the sale and removal I have mailed the buyer and told them if they pay me the deposit as agreed i will take no further action (they were clealry going to pay this amount and they would have lost this anyway), if they do not pay or do not reply i will go to the small claims court to recover the difference as a loss attribuatable to their actions So my questions: Did we have a contract in place either real or implied? They delayed thier change of mind for 10 days so this lost me the option to go to other buyers in a timely way and in this 10 days they clearly indicated their intention to go ahead and to pay a deposit of £300 which i would have been able to retain - does this count for anything? Can i go to court for the difference between what they had agreed to pay and the actual second selling price i.e. can i claim this as my LOSS as well as any other directly attribuatable costs? I understnad i can only claim for my loss, no penalties etc when talking about breach of contract - got a lot of info on this when i was looking into clamping and car parking tickets !. My opinion is i had a contract to sell and they had one to buy for £1300, they clearly indicated over a number of days they would go ahead (i have every mail and text ...), i then had to resell due to time constraints and it went for less and so my loss is the difference - right? So can i do this or am i just frustrated at people who go back on deals but its ok to do that, no problem? Would i get anywhere with this other than the satisfaction of making them think long and hard about not backing out on a deal and thinking its ok and that there are no consequences to such actions? there seems to be very little info about people who have done this despite all the statements on ebay about auction bids forming legal contracts ...... I hope thats clear but please ask questions if anything needs to be clarified Any input welcome - the more qualified the better
  17. Hi I’m a new member and feeling a bit unsure of how/where to post so please bear with me. I know this is long but I wanted to include everything so that readers would have the whole picture. Thank you in advance for your support. On April 2, 2013 I listed a wedding dress auction. I had indicated in the listing, this dress came as a donation item in effort to contribute to active fundraising activities. The dress description indicated that the item had the tags in place, would need to be cleaned and pressed, and had a few clasps that were coming loose. The listing gave specifications of the dress to include measurements, fabrics, and original retail price. Also included in the listing was that the dress was donated and all proceeds would be directly given to the charitable organization, in my area, I included details about the organization name and efforts. Pictures used were taken the same day as the listing was created. Upon completion of the listing, the dress was wrapped in plastic, was then placed into a box with packing papers for added protection, and made ready for shipping. The buyer contacted me on 04/08/2013 with an inquiry about the train length; she requested that a photo be taken of the dress on so that she would have more of an idea as to the length. I explained that the dress does not fit me and an attempt to photograph myself in the dress would not be a fair representation. I did not tell the buyer that I’m just five feet tall, 109 pounds and a size four, the size 22 dress is 18 sizes to large but only that I did not feel it appropriate that I model the dress. I instead sent her a photo of the train and a link to the David’s Bridal webpage so that she could get exact dress specification. She responded that what I had sent would suffice. She then sent a follow up message asking what color the dress was. I told her it was Ivory. The auction ended with her as the highest bidder. Once payment was received total amount of the funds were taken from my personal account, minus shipping and selling fees funds and donated in the original dress donator’s name. The buyer and I exchanged a few very pleasant messages; she requested a tracking number which I provided. I messaged her tracking details and expressed that I hoped she would be pleased with the dress. On April 22, 2013 the buyer contacted me to express her dissatisfaction with dress; she indicated that the train of the dress was dirty and that she believed that the tags had been replaced after it had been worn. I responded conveying my disappointment that she was not pleas with the dress, assuring her that the dress had not been worn, as well as reminding her that the listing had clearly stated that the dress would need to be cleaned. I further explained that the funds had been immediately donated to the Best Buddies organization and were no longer in my possession. She responded that “it is an insult to have a worn wedding dress on my wedding day.” At which point I remained apologetic in her disappointment but assured her that the dress had not been worn prior to her receiving it; I again reminded her that the listing clearly indicated that the dress would need to be cleaned. At which point (01:04 PM PST 04/22/2013) she exercised the “Buyer Protection” option under the classification that the item was not as described, stating that the train was dirty and that “NO BRIDE WANTS A DIRTY WEDDING DRESS ON HER SPECIAL DAY!!” Throughout that same day we, exchanged many of the same details within the dispute resolution process. I attempted multiple times to assure her that the dress had not been worn but as indicated in the listing, it did need to be cleaned. She indicated that she would send pictures of the dress and that I was untrustworthy. That same afternoon (03:54 PM PST 04/22/2013) she responded stating that she would keep the dress under the condition that I pay for cleaning. At which point I stated that she was essentially asking me to pay for something that was stated as needing being done in the first place but to go ahead and get the estimate and in the meantime I would need to find out what my rights were. The following morning (07:32 AM PST 04/23/2013 she indicated that she had taken the dress to the cleaners and that it was estimated to be $100-$150. She went on to details other areas of the dress that were of concern; stating that they were the professional opinion of the cleaners. I expressed an interest in seeing an itemized statement from the cleaner, as my own wedding dress with preservation had not been as high. I also told her that the areas of concern were not noted when the dress was in my possession. I also asked if she had taken it to more than one cleaner. She responded that she had taken the dress to two cleaners and that the second cleaner estimated that the cost of cleaning would be $100-$125. She also indicated that the cost of living in area residence was much more affordable. She knew this because she has shopped in an area that is more than four hours away and that she knew “all about the CHEAP PRICES THERE.” Moments later she responded stating that "ALSO TAGS CAN BE REATTACHED!!! AS I BELIEVE IS WHAT HAPPENED HERE. CONSIDERING I USE TO WORK IN RETAIL. I HAVE HAD SEVERAL PEOPLE RETURN ITEMS WITH THE TAG ATTACHED BUT SMELLED LIKE PERFUME AND HAD BEEN WASHED. " While I did not agree with her request, for resolution purposes I agreed to pay ½ of the cost of her lowest cleaning estimate, which would have been $50. I did not hear from her again on this day. I contacted an ebay representative (07:36 PM PST 04/24/2013) in order to understand how the process works and how I might be able to submit several of the photos of the dress while it was still in my possession, as well as a written statement from the donor in regards to the dress condition and history. At the suggestion of the ebay representative I requested (08:26 PST 04/23/2013) that the buyer upload pictures of the dress so that I might be able to see her concerns. The following morning (06:04 AM PST 04/24/2013) the buyer responded, stating that she would accept $65 for the cleaning of the dress and that she would upload pictures of the dress if ebay would instruct her as to how to do it. I repeated the instructions that I was given by the ebay representative who indicated that it was allowable to use the ebay messages area to upload supportive evidence for verification purposes; stating that once an upload has been completed to then make a note in the resolution area, both platforms are monitored by ebay & will be used when making any determinations on the case. I again requested that share the images in the ebay message area and then make note of the upload within the resolution area. This request elicited a withdrawal of all previous negotiations and a cease in all communications from the buyer. Her last communication (07:40 AM PST 04/24/2013) "I CAN DO SOMETHING EVEN BETTER FOR YOU. I WILL SEND THE DRESS BACK TO YOU SO THAT YOU CAN SEE FOR YOURSELF. AND I WILL SEND A NOTE WITH THE DRESS DESCRIBING ALL THE AREAS OF THE DRESS THAT ARE DIRTY. THAT WAY YOU CAN SEE WITH YOUR OWN EYES. I USUALLY WALK AWAY FROM ARGUMENTS. I WILL LET YOU KNOW THE TRACKING NUMBER WHEN I TAKE THE DRESS TO THE POST OFFICE. HAVE A BLESSED DAY." That evening I had not heard back and sought clarification as to where we were in the process, previously the buyer had indicated that she would share pictures and was agreeable to splitting the cleaning expenses. Based on her last communication I asked for clarification as to my understating of where we were in the process stating that my understanding “As I understand it, you do not wish to send photos & plan to move forward in the dispute process. Is this correct? " The buyer did not respond and did not supply me with pictures or a written estimate of the cleaning bill. When the time for “working it out” had passed, I contacted ebay and asked if I would be able to escalate the process. I was told no that the buyer would have to do this but at that time I would be able to submit my pictures and written statement from the original donor. The buyer escalated the case early the next morning at which point I received notification from ebay that I would be contacted within 48 hours. This morning, I received notice that ebay had made decision, stating the following: Decision: We've asked the buyer to return the item to you for full refund. Comments: The buyer has been asked to return the item to you. Once tracking shows the item has been delivered to you, the buyer will be issued a full refund. I contacted ebay again. I told the representative that I had been advised that I would be provided an opportunity to submit my own “evidence” once the case had been escalated but this had not occurred but yet a decision had been made in favor of the buyer. I was told that message may be a bit misleading. At this point the buyer was to return the dress to me and I was to inspect it and contact ebay upon receipt. At this point I would be able to file an appeal and give my “evidence” as to the condition of the dress. The rep assured me that by no means was the case closed. I’ve been a user for some 12 years, I have successfully engaged in hundreds of mostly buying and a few selling transactions. While I am disappointed in the outcome of this transaction, I have tried unsuccessfully to negotiate a fair end for both parties. As indicated, the posting clearly stated that the dress would need to be cleaned. Even though I do feel that I accurately represent the condition of the dress I still offered to share this burden of cleaning for the sake of resolution. I made no unreasonable demands, nor did I question the buyer’s integrity (though mine was continually attacked). I continued to keep respectful communications open but was met with opposition of silence. The funds from this sale were given to charity, I simply do not have the means to meet this out of pocket burden and I’m not feeling overly confident that ebay will be of any support, there is no recourse for me as a seller and there has been no opportunity to be heard. I strongly doubt that once the dress is returned and in my possession I will be given any other means of dispute and will have to shoulder this regardless. I plan on closing my ebay account once this is resolved, based on principle. I have no desire to continue contributing to any operation that is biased and partial. I do however I do need my paypal account. I’m clueless as to what to do at this point. Please any advice would be greatly valued.
  18. Hi. To say I'm fuming is an understatement. On 30th April I bought a speedo from a seller on Ebay. It was a very reasonable price including delivery. 15th April I opened a case as it hadn't arrived. 20th April I got an email from the seller apologising, saying that my order had been missed and would put it out for delivery the next day. It was during this email that he stated that the speedo would be coming from the Czech Republic. This was not made clear in his ad. 28th April I contacted the seller again as I still hadn't received it. On 30th April it turned up. Obviously I left negative feed back to the effect of I just happened to look at my own feedback today and spotted this gem. Compare that with what he told me in the email. Anyone who knows me would know this is not true. I have emailed him demanding removal 'or else' I have taken a screenshot of it. How very dare he!
  19. Three weeks ago, I received an email from eBay telling me that my account had been suspended. The reason given was that another account, that had a name that bore some similarity to mine, was linked to my account and had been suspended, meaning that my account was automatically suspended too. I have been using eBay for years and have never opened a second account. When I tried to get more information from them, all they would tell me is that there were similarities between the two accounts that led them to believe they were linked. I have disputed this several times and now they just ignore my emails. I feel insulted and abused by eBay. I have been a good customer of theirs for many years, both as a buyer and as a seller, each with a 100% record, and suddenly they do this to me. I know they have the right to do so, under their T&Cs, but it just isn't right. I don't know how to get the situation rectified. I have tried writing to the Sunday Times, hoping they might take up the case, but I have heard nothing. If I can't get my account re-instated, maybe I can at least warn other people about the arrogant way in which they treat customers.
  20. I sold to a buyer, buyer claims damage on the item. Buyer returns item but with expensive parts missing. I refuse to refund, ebay comes down on side of buyer despite the missing parts and now expects me to cover the refund. The buyer is dodgy as he has kept the expensive parts for himself!! what can I do about this as I am not happy having to refund ebay when I do not have the original items returned? thanks.
  21. Hi all, my first post here! I recently bought a Desktop PC from a business seller on eBay through a Buy it now listing. The item was described as having 2GB RAM (Memory). However when it arrived and I checked, it did not. I contacted the seller who then offered to send some replacement RAM which I accepted, however, it was wrong type of RAM that wasn't compatible with the PC. After some more communication with the seller, he asked me to return the PC to him, which I have, via courier (with tracking) which cost me £9.50. I have asked the seller whether he will cover the cost of the return postage and he has flat out said No. Seeing as though it was the sellers fault for not describing the item correctly, why should I be out of pocket nearly £10? I have done a little research (Google mainly) it seems I may be covered under the Distance Selling Regulations or the Sale of Goods Act. However I can't seem to find an exact piece or quote of legislation relative to what I am asking. Does anyone have any advice?

  23. Hi All, I am sooo very angry so please bear with me here! I recently sold an old phone (due to upgrade) through eBay. As I put it with my car keys to remember to take to work to post the next day I realised I hadn't declared that it had a small crack on the screen, it didn't/doesn't affect the function of the screen. As soon as I realised the mistake I had made I emailed the winner, via eBay, explaining my mistake and offering him the option to cancel the transaction. I received no response, so emailed again 24 hours later saying if I had not heard from him, I gave him until 10am that morning, I would relist it. I didn't hear from him at all but DID receive payment for the phone that evening. I gave him every opportunity to ask questions re. the extent of the damage or to cancel the sale. He has now received the phone and decided that he is going to open a case against me saying it is not as described. All he does is give me abuse and tell me I think I am smarter than everyone else ( I am definitely not nor do I think I am!!) and eBay are being really unhelpful, although they can see that I sent him two emails they have put my Paypal account into a Negative balance of £51.50. This either puts me £51.50 out of pocket for eight days or unable to use my Paypal account. I asked to speak to a manager and eventually (after 1.05hrs) got a "manager" although her mannerisms etc were exactly the same as the previous girl I had been talking to. They won't escalate the complaint until after 8 days, even though looking at the emails it is quite clear that it is not going to be resolved. To add to my problems, he has given me negative feedback saying that my item was not as described and that he had opened a case, eBay Customer Services would answer whether that negative comment would be removed if they found in my favour. The thought has occurred to me that maybe the phone has been damaged in the postal system but how do I prove this? I have proof of postage but no schedule of condition of the phone when I posted it! Any advice on making sure that the eBay do find in my favour? I am certain that I am in the right but have heard of instances when eBay really don't care about the sellers and nearly always find in favour of the buyer. This buyer wants to keep the phone AND have a refund, I have told them definitely not! I know that there are always two sides to every story but I made two attempts to contact him and am quite worried that I am either going to have my eBay account closed, or some massively negative feedback. I am not a regular user to sell stuff but I do buy quite a bit through them. Any advice? I have reported the buyer and tried to put my point of view across to him but he just gets horrid and it is upsetting!! Sorry for the long winded post Thanks.
  24. I felt the need to share this information with all buyers from eBay. I recently bought an item that cost £160 from a seller with a good feedback score. I read that the item would be sent by tracked parcel with Royal Mail so I went ahead with the purchase. After a week and the item still not arriving I checked the provided tracking number to find to my surprise that it was reported to have been delivered. I contacted the seller who was very unhelpful and stated that as far as eBay and they were concerned it had been delivered and that was that! He or she did say I should make a claim at my local post office for the lost item. I first went to our local sorting office to see if it had been returned undelivered but it had not. I asked the clerk if he had any forms for me to make a claim but he said that only the poster can make the claim as they took out the insurance when they purchased the postage. He also stated that if it was signed for the sender could get evidence of the signature used to sign for it. I emailed the seller again when I got home and asked if they could start a claim on the advice that the post office gave me and if they could request the signature card. Sadly the seller just stated back to me the tracking number and would not give me any of the information I requested or help in getting a copy of the signature card. It is only myself and my family that live at my address and I don't share a post box or anything like that so I thought if I had the signature I could look up the surname and see if I could match it to anyone in my street who may have had my item delivered to them in error. Because the seller declined to help me I was left with no options and had to start a dispute. I also decided to leave negative feedback stating that the seller would not help me with the information I needed to recover my parcel or my £160. To my shock eBay removed the feedback when the seller requested them to. When I asked eBay what was the justification in doing so I was told that it was likely an automated removal due to 'key words' being used. Just to clarify I used no bad or insulting language in the text whatsoever. Several days later and after no response from the seller other than to gloat how they had the negative feedback removed I escalated the dispute to a claim. The dispute was quickly awarded in favour of the seller as providing a tracking number is all they need to do to cover themselves according to the eBay decision maker. I have since found out that a tracking number can be bought for just £1.00 and the parcel doesn't need insurance or indeed to be signed for in order to have a tracking number attached to it. I am quite sure my seller did not insure the goods nor had them to be signed for which is why they were avoiding answering any of my questions. So there you go, when you're thinking you have eBay's 'buyer protection', think again! It just cost me £160 and I feel like eBay have not even considered a single effort that I have made or that the seller was in any way negligent for sending high value goods through (most likely) a standard postal service with no cover. I have appealed the decision but it looks pretty hopeless. I may very well take this to small claims just out of principle.
  25. Having bidded on a cycle on eBay I was really pleased that i'd won it. I messaged the seller to inform him that I would pay for the bike in a couple of days as I told him I was away. He, in the meantime, asked me if I could pay which I duly did two days after. The bike was over 300 miles away so I asked him if I could arrange collection in the next couple of weeks once I had arranged a way of collecting it. The bike cost £300. The original purchase was on 11/3/13 Payment date: 14/3/13 Through PayPal On the 18/3/13 I was e/mailed by the seller asking me if I'd got his message as he'd sold the bike! At first I thought it was a mistake, but then realised that he informed me that he was going to give me a refund for the bike. I informed him that it was not his bike to sell and that it was mine since I had paid for it. I informed him that we'd entered into a legally binding contract and I would take it up with eBay to get their position on it. Ebay told me has was in breach of contract and that they would also inform him. I then informed my seller of the situation and told him I would get the authorities involved since he had broken the law. He thinks he hasn't done anything wrong and was quite blaise about the situation! Where do I stand and what's next is my question?? Gav
